بَابُ قَطْعِ السَّرَقَةِAmputation for Theft

العربية

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿ وَالسَّارِقُ وَالسَّارِقَةُ فَقْطَعُواْ أَيْدِيَهُمَا جَزَآءٌ بِمَاكَسَبَا نَكَلَا مِّنَ اللَّهِ وَاللهُ عَزِيزٌ حَكِيمٌ ٣٨ فَمَن١ تَابَ مِنْ بَعْدِظُلْمِهِ، وَأَصْلَحَ فَإِنَّ اللهَ يَتُوبُ عَلَيْهِ إِنَّ اللّهَ غَفُورٌ رَّحِيمٌ ٌ﴾المائدة: ٣٨ – ٣٩.

١قوله: فمن تاب إلخ: عدم تعذيبه في الآخرة بعد التوبة دون سقوط الحد. وقال في (الكشاف): وأما القطع فلا تسقطه التوبة عند أبي حنيفة وأصحابه . وعند الشافعي له في أحد قوليه تسقطه. وقيل: يسقط عن الحربي إذا سرق بالتوبة؛ ليكون أدعى له إلى الإسلام دون المسلم؛ لأن في إقامته الصلاح للمؤمنين. كذا في (التفسيرات الأحمدية).

English

And the saying of Allah, the Mighty and Majestic: "And the male thief and the female thief, cut off their hands as a recompense for what they have earned, an exemplary punishment from Allah; and Allah is Mighty, Wise. But whoever 1 repents after his wrongdoing and makes amends, Allah will accept his repentance; indeed Allah is Forgiving, Merciful" (Al-Ma'idah: 38-39).

1 His saying "but whoever repents", to the end: the absence of his punishment in the Hereafter after repentance, without the lapse of the hadd. The author of al-Kashshaf said: as for the cutting, repentance does not cause it to lapse with Abu Hanifa and his companions, while with al-Shafi'i, in one of his two positions, it causes it to lapse. And it is said: it lapses from the harbi who steals, upon his repentance, so that it may the better call him to Islam; not from the Muslim, for in carrying it out upon him lies the well-being of the believers. So it is in al-Tafsirat al-Ahmadiyya.

عَنْ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ رَضِي اللهُ عَنهُ عَنِ الَّنبيِّ ﷺ قَالَ: (لَا قَطْعَ ٢ إِلَّا فِي عَشْرَةِ دَرَاهِمَ). رَوَاهُ الطَّبَرَانِيُّ فِي (الْأَوْسَطِ)۔

وَرَوَى التَّرْمِذِيُّ فِي كِتَابِ الْجَامِعِ عَنِ ابْنِ مَسْعُوْدٍ رَضِي اللهُ عَنهُ أَنَّهُ قَالَ: لَا قَطْعَ إِلَّا فِي دِيْنَارٍأَوْ عَشْرَةٍ دَرَاهِمَ، وَهُوَ مُرْسَلٌّ، رَوَاهُ الْقَاسِمُ بْنُ عَبْدِ الرَّحْمَنِ عَنِ ابْنِ مَسْعُوْدٍ رَضِي اللهُ عَنهُ ،وَالْقَاسِمُ بْنُ عَبْدِ الرَّحْمَنِ لَمْ يَسْمَعْ مِنْ ابْنِ مَسْعُوْدٍ.

وَقَالَ عَلِيُّ الْقَارِي: وَهُوَ صَحِيْحٌ لَكِنْ فِي مُسْنَدِ أَبِيْ حَنِيْفَةَ الَّذِيْ جَمَعَهُ الْحَصْفَكِيُّ مِنْرِوَايَةِ ابْنِ مُقَاتِلٍ عَنْ أَبِيْ حَنِيْفَةَ عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ عن ابيه عَنِ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ قال كان يقطع اليد علي عهد رسول الله ﷺ فی عَشْرَةِ دَرَاهِمَ. وَفِي رِوَايَةٍ: إِنَّمَا كَانَ الْقَطْعُ فِي عَشْرَةٍ دَرَاهِمَ. فَهَذَا مَوْصُوْلٌ مَرْفُؤْعٌ، وَلَوْكَانَ مَوَقُوْفًا لَكَانَ لَهُ حُكْمُ الرَّفْعِ ؛ لِأَنَّ الْمُقَدَّرَاتِ الشَّرْعِيَّةِ لَا دَخَلَ لِلْعَقْلِ فِيْهَا،فَالْمَوْقُوْفُ فِيْهَا تَحْمُوْلُ عَلَى الْمَرْفُوْعِ.

وَرَوَى مُحَمَّدُ فِي (كِتَابِ الْآثَارِ) عَنْ أَبِيْ حَنِيْفَةَ عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِيْهِعَنْ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ رَضِي اللهُ عَنهُ قَالَ: لَا يُفْطَعُ يَدُ السَّارِقِ فِي أَقَلَّ مِنْ عَشْرَةٍ دَرَاهِمَ. وَرَوَىأَحْمَدُ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ ثُ مَرْفُوْعًا مِثْلَهُ.

وَرَوَى ابْنُ أَبِيْ شَيْبَةَ عَنِ الْقَاسِمِ قَالَ: أُتِيَ عُمَرُ بِرَجُلٍ سَرَقَ تَوْبًا فَقَالَ لِعُثْمَانَ: قَوِّمْهُ،فَقَوَّمَهُ ثَمَانِيَةَ دَرَاهِمَ، وَلَمْ يَقْطَعْهُ.

English

Abdullah ibn Mas‘ud (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: No amputation except for ten dirhams. [Narrated by al-Tabarani in Al-Awsat]

Al-Tirmidhi narrated in Jami‘ from Ibn Mas‘ud: No amputation except for a dinar or ten dirhams, but it is mursal, narrated by al-Qasim ibn Abd al-Rahman from Ibn Mas‘ud, and al-Qasim did not hear from Ibn Mas‘ud. Ali al-Qari said: It is authentic, but in Abu Hanifa’s Musnad, compiled by al-Hasfaki, from Ibn Muqatil, from Abu Hanifa, from al-Qasim ibn Abd al-Rahman ibn Abdullah ibn Mas‘ud, from his father, from Abdullah ibn Mas‘ud: Hands were amputated in the Prophet’s (ﷺ) time for ten dirhams. Another narration: Amputation was only for ten dirhams. This is connected and raised. Even if stopped, it has the ruling of a raised hadith, as legal quantifications are not subject to reason, so a stopped narration is treated as raised. Muhammad narrated in Kitab al-Athar from Abu Hanifa, from al-Qasim, from his father, from Ibn Mas‘ud: A thief’s hand is not amputated for less than ten dirhams. Ahmad narrated from Amr ibn Shu‘ayb, from his father, from his grandfather, raised, similarly. Ibn Abi Shayba narrated from al-Qasim: Umar was brought a man who stole a garment. He told Uthman: Value it. He valued it at eight dirhams, and he did not amputate.

2 The statement: No amputation except for ten dirhams: Theft linguistically is taking another’s property secretly, regardless of what it is. Legally, conditions were added: the thief must be sane, as Allah called amputation a deterrent, a punishment requiring a crime, which needs sanity and puberty. The stolen item must be valued, owned property from a secure place (hirz) with no doubt. If taken openly, or not property (e.g., intoxicants), or from an insecure place (e.g., a relative’s house, spouse’s house, host’s house), or by cutting a purse from outside, or unowned property (e.g., waqf), or less than ten dirhams, amputation is not required. The thief must return the item if it exists or compensate its value if destroyed. The ruling: Amputation deters, needed for property valued by people. Value is subjective, varying by custom, so the Sharia specified it. A hadith states: No amputation except for the price of a shield. Its value differed: per us, ten dirhams; al-Shafi‘i, a quarter dinar; Malik, three dirhams. Due to disagreement on the shield’s value but consensus on its specification, we take the highest to be certain, as no one denies amputation for ten dirhams, while lesser amounts are disputed, so amputation is not required due to doubt, to avert punishment. The ten-dirham narration is from a jurist. In sum: Consensus holds amputation for ten dirhams; below that, scholars differ due to varying hadiths, creating uncertainty, so it is not required, as punishments are averted by doubts and require certainty. Ibn al-Humam said: Some, like Hasan al-Basri, Dawud, the Khawarij, and Ibn Bint al-Shafi‘i, said amputation applies to any amount, per the verse’s generality and the Prophet’s (ﷺ) saying: Cursed is the thief who steals an egg and his hand is cut, or a rope and his hand is cut. Most jurists of the regions hold it requires a specific amount. Our school and some Tabi‘in say ten dirhams; al-Shafi‘i, a quarter dinar; Malik and Ahmad, a quarter dinar or three dirhams. Companion consensus is cited, restricting the verse. Reason: Trivial items lack desire, like a wheat grain, included in the verse’s generality, and cannot be taken secretly, failing theft’s condition of secrecy. Thus, the rope and egg hadith is interpreted as a ten-dirham rope, an iron egg, or pre-specification when the verse was revealed vaguely, later clarified, or abrogated, as amputation initially had no minimum. Gathered from Uqud al-Jawahir, Al-Tafsir al-Ahmadiyya, Al-Kawkab al-Durri, Badhl al-Majhud, Al-Ta‘liq al-Mumajjad, Al-Mirqat, and Kanz commentaries.

٢ قوله: لا قطع إلا في عشرة دراهم: اعلم أن السرقة لغة: أخذ الشيء من الغير على وجه الاستتار أيَّ شيء كان. وقد زِيْدَ على المعنى اللغوي أوصاف شرعًا، منها في السارق: أن يكون عاقلًا؛ لأن الله تعالى سمَّى القطع نكالًا وهي عقوبة، فتستدعي كون السرقة جناية، ولا جناية بلا عقل ولا بلوغ، ومنها في المسروق: أن يكون مالًا متقوِّمًا مملوكًا من حرز لا شبهة فيه. فإن أخذ غير خفية، أو سرق غير مال مثل الأشربة المطربة، أو مالًا غير محرز مثل أن يسرق من

بيت ذي رحم محرم وبيت زوجه وعرسه، ومن مضيفه، ومثل أن طرَّ صُرَّةً من خارجها فأخذ المال، أو مالًا محرزًا غيرمملوك لِأحدٍ مثل مال الوقف، أو سرق أقل من عشرة دراهم، لا يجب القطع في هذه الصُّوَر، لكن يجب ردّ ما أخذ إن كانت قائمة، وضمان قيمتها إن كانت هالكة.

وحكمه: القطع زجرًا له، وإنما يحتاج إلى الزجر في أخذ مال له خطر عند الناس، والخطر صفة مجهولة، وعادة الناس فيه غير متساوية، فوجب التعريف من الشرع. فقد جاء في الحديث: (لا يقطع السارق إلا في ثمن المجن). واختلفوا في تقديره، فعندنا عشرة دراهم. وعند الشافعي قدر رُبع دينار. وعند مالك قدر ثلاثة دراهم. ولما اختلفوا في قيمة المجن مع اتفاقهم أن النصاب مقدر به ذهبنا إلى الأكثر للتيقن به؛ لأن أحداً لم يقل: إن العشرة لم يقطع فيها،وما دونها مختلف فيه، فلا يجب القطع للشك وللاحتيال لدرء الحد، مع أن رواية العشر رواية فقيه. حاصله: أن الإجماع انعقد على وجوب القطع في العشرة، وفيما دون العشرة اختلف العلماء لاختلاف الأحاديث،فوقع الاحتمال في وجوب القطع، فلا يجب مع الاحتمال، يعني لما جاء الاختلاف في ذلك عن رسول الله ﷺ وعن أصحابه بعده، ولم يعرف التقدم والتأخر ليعرف الناسخ والمنسوخ، أخذنا فيه بالأحوط المعتمد الذي لا يشك فيه،وهو عشرة دراهم؛ لأن الحدود تندرأ بالشبهات، ولا يثبت إلا بما لا شك فيه.

وقال الشيخ ابن الهمام: واختلف في أنه هل يقطع بكل مقدار من المال أو بمعين لا يقطع في أقل منه، فقال بالأول الحسن البصري وداود والخوارج وابن بنت الشافعي لاطلاق الآية، ولقوله ﷺ: (لعن الله السارق يسرق البيضة فتقطع يده، ويسرق الحبل فتقطع يده)، ومن سوى هؤلاء من فقهاء الأمصار وعلماء الأقطار على أنه لا قطع إلا بمال مقدر. واختلفوا لمقدار معين في تعيينه، فذهب أصحابنا في جماعة من التابعين إلى أنه عشرة دراهم، وذهب الشافعي إلى أنه رُبع دينار. وذهب مالك وأحمد إلى أنه ربع دينار أو ثلاثة دراهم. وقد نقل إجماع الصحابة على ذلك، وبه يتقيد إطلاق الآية. وبالعقل أن الحقير مطلقًا تفتر الرغبات فيه، فلا يمنع أصلً كحَبَّة قمح، وهو مما يشمله إطلاق الآية، وكذا لا يخفى أخذه، فلا يتحقق بأخذه ركن السرقة، وهو الأخذ خفيةً، فهذا مخصّص عقلي بعد كونها مخصوصة بما ليس من حرز بالإجماع، فلزم في حديث الحبل والبيضة التأويل بالحبل الذي يبلغ عشرة دراهم، وبيضة من الحديد، أو أن النبي ﷺ قال هذا عند نزول آية السرقة مجملة من غير بيان نصاب، ثم بيَّن بعد ذلك النصاب، أو النسخ يعني كان القطع بلا نصاب في ابتدء الإسلام ثم نسخ. التقطته من (عقود الجواهر) و(التفسيرات الأحمدية) و(الكوكب الدري) و(بذل المجهود) و(التعليق الممجّد) و(المرقاة) وشروح (الكنز).

وَعَنِ ابْنِ عَبَّاسِ رضی اللہ عنهما قَالَ: قَطَعَ رَسُولُ اللهِ ﷺ يَدَ رَجُلٍ فِي مِجَنَّ قِيمَتُهُدِينَارٌ أَوْ عَشَّرَةُ دَرَاهِمَ. رَوَاهُ أَبُوْ دَاوُدَ.

وَرَوَى النَّسَائِيُّ وَالْبَيْهَقِيُّ وَالطَّحَاوِيُّ عَنْهُ قَالَ: كَانَ ثَمَنُ الْمِجَنِّ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ يُقَوَّمُ عَشْرَةَ دَرَاهِمَ.

وَرَوَاهُ الْحَاكِمُ فِي (الْمُسْتَدْرَكِ) عَنِ ابْنِ إِسْحَاقَ، وَقَالَ: حَدِيْثٌ صَحِيْحٌ عَلَى شَرْطٍمُسْلِمٍ وَلَمْ يُخْرِجْهُ.

وَفِي رِوَايَةِ النَّسَائِيِّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِعنه قَالَ: كَانَ ثَمَنُعَلَى عَهْدِ رَسُولِ اللهِ ﷺ عَشْرَةَ دَرَاهِمَ.

English

Ibn Abbas (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) amputated a man’s hand for a shield worth a dinar or ten dirhams. [Narrated by Abu Dawud]

Al-Nasa’i, al-Bayhaqi, and al-Tahawi narrated from him: The shield’s price in the Prophet’s (ﷺ) time was valued at ten dirhams. Al-Hakim narrated in Al-Mustadrak from Ibn Ishaq, saying: Authentic per Muslim’s conditions, but he did not include it. Al-Nasa’i narrated from Amr ibn Shu‘ayb, from his father, from his grandfather: Its price in the Prophet’s (ﷺ) time was ten dirhams.

عَن رافعِ بنِ خَدِيجٍ رَضِي اللهُ عَنهُ عَنِ النبي ﷺ قَالَ (لاَ قَطْعَ ١فِي ثَمَرٍ وَلاَ كَثَرٍ) رَوَاهُ مَالِكٌ وَالتِّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَالنَّسَائِيُّ وَالدَّارِيُّ وَابْنُ مَاجَه.

وَرَوَى أَبُوْ دَاوُدَ فِي الْمَرَاسِيْلِ عَنِ الْحَسَنِ الْبَصْرِيِّ: أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: (إِنيْ لَاأَقْطَعُ فِي الطَّعَامِ). وَذَكَّرَهُ عَبْدُ الْحَقِّ وَلَمْ يُعِلَّهُ بِغَيْرِ الْإِرْسَالِ، وَأَنْتَ تَعْلَمُ أَنَّهُ لَيْسَ بِعِلَّةٍعِنْدَنَا، فَيَجِبُ الْعَمَلُ بِمَوْجِبِهِ.

Rafi‘ ibn Khadij (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: No amputation for fruit or palm pith. [Narrated by Malik, al-Tirmidhi, Abu Dawud, al-Nasa’i, al-Dari, and Ibn Majah]

Abu Dawud narrated in Marasil from Hasan al-Basri: The Messenger of Allah (ﷺ) said: I do not amputate for food. Abd al-Haqq mentioned it without faulting it beyond being mursal, which, as you know, is not a flaw in our view, so it must be acted upon.

Others required amputation if secured, per Malik and al-Shafi‘i. In Al-Hidaya: No amputation for perishable items like milk, meat, or fresh fruits, per: No amputation for fruit or palm pith. Palm pith is the palm’s core or sap. The Prophet (ﷺ) said: No amputation for food, meaning perishables prepared for eating, like meat or fruit, as amputation applies to wheat and sugar by consensus. Al-Shafi‘i said: Amputation applies, per: No amputation for fruit or palm pith, but if stored in a granary, amputation applies. We say: He followed custom, where granary-stored fruit is dry, subject to amputation. In Al-Mirqat: They conflict on secured fresh fruit; in punishments, the view preventing punishment prevails to avert it. In Al-Lam‘at: No amputation for fruit on trees or unharvested crops due to lack of security. For harvested, secured fruit, al-Shafi‘i requires amputation; Ahmad, in one narration, if from a guarded orchard or tree in a secured house with a nisab stolen. In our view, no amputation for perishables like milk, meat, or fresh fruits, per: No amputation for fruit or palm pith, meaning perishables prepared for eating.

١ قوله: لا قطع في ثمر ولا كثر: في (شرح السنة) ذهب أبو حنيفة إلى ظاهر هذا الحديث، فلم يوجب القطع في سرقة شيء من الفواكه الرطبة، سواء كانت محرزة أو غير محرزة، وقاس عليه اللحوم والألبان والأشربة. وأوجب الآخرون القطع في جميعها إذا كان محرزا، وهو قول مالك والشافعي. كذا في (المرقاة). وقال في (الهداية): ولا قطع فيما يتسارع إليه الفساد كاللبن واللحم والفواكه الرطبة؛ لقوله عليه السلام :(لا قطع في ثمر ولا كثر) والكثر: الجمار. وقيل: الودي. وقال عليه السلام (لا قطع في الطعام). والمراد - والله أعلم - ما يتسارع إليه الفساد كالمهياً للأكل منه وما في معناه كاللحم والثمر؛ لأنه يقطع في الحنطة والسكر إجماعًا. قال الشافعي : يقطع فيها؛ لقوله علیہ السلام : (لا قطع في ثمر ولا كثر، فإذا آواه الجرين قطع). قلنا: أخرجه على وفاق العادة، والذي يؤويه الجرين في عادتهم هو اليابس من الثمر، وفيه القطع. وقال في (المرقاة): فقد تعارضا في الرطب الموضوع في الجرين ،ومثله من الحدود يجب تقديم مايمنع الحد درأ اللحد انتهي وقال في (اللمعات) واعلم أنه لا قطع في الثمر على الشجر والزرع الذي لم يحصد لعدم الإحراز، وأما الثمر الذي قطع وأحرز ففيه القطع عند الشافعي. وعند أحمد في رواية، إذا كان في بستان محفوظ، أو كانت شجرة في دار محرزة فسرق منها نصابًا، فإن عليه القطع، وأما عندنا فلا قطع فيما يتسارع إليه الفساد، كاللبن واللحم والفواكه الرطبة؛ لقوله عليه السلام : (لا قطع في ثمر ولا كثر)، كان المراد ما يتسارع إليه الفساد كالمهياً للأكل وما في معناه كاللحم والثمر.

وَعَنْ جَابِرٍ رضي الله عنه عَنِ النبي ﷺ قَالَ: (لَيْسَ ١عَلَى خَائِنٍ وَلَا مُنْتَهِبٍ وَلَامُخْتَلِيسٍ قَطْعٌ). رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَه وَالدَّارِميُّ.

Jabir (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: No amputation for a betrayer, plunderer, or snatcher. [Narrated by al-Tirmidhi, al-Nasa’i, Ibn Majah, and al-Darimi]

وَعَنْهُ رَضِي اللهُ عَنهُ ، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعُّ، وَمَنْانْتَهَبَ نُهْبَةً مَشْهُورَةً فَلَيْسَ مِنَّا). رَوَاهُ أَبُوْ دَاوُدَ.

وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ: فِي حَدِيْثِ٢ صَفْوَانَ اضْطِرَابٌ، وَالإِضْطِرَابُ مُوْجِبَةٌلِلِضُّعْفِ. وَقَالَ شَمْسُ الْأَئِمَّةِ السَّرَخْسِيُّ: وَلَمْ يُرْوَ مَشْهُوْرًا أَنَّهُ ﷺ قَطْعُ يَدِ السَّارِقِبَعْدَ همة صَفْوَانَ لَه.

English

Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: No amputation for a plunderer, and whoever plunders famously is not of us. [Narrated by Abu Dawud]

Ibn al-Humam said: The hadith of Safwan has inconsistency, which causes weakness. Shams al-A’imma al-Sarakhsi said: It is not famously narrated that he (ﷺ) amputated a thief’s hand after Safwan’s gift.

2 The statement: The hadith of Safwan has inconsistency, etc.: If the victim gifts or sells the stolen item to the thief before the judge’s amputation ruling, amputation is dropped without dispute, as the dispute ends. After the ruling but before execution, Abu Hanifa and Muhammad say it is dropped; Abu Yusuf and al-Shafi‘i say it is not. Their evidence is Safwan’s hadith: He was sleeping in the Prophet’s (ﷺ) mosque with his cloak as a pillow. A thief stole it. Safwan caught him and brought him to the Prophet (ﷺ), who ordered amputation. Safwan said: Cut his hand for my cloak? I gift it to him. The Prophet (ﷺ) said: Why not before bringing him to me? This suggests gifting after the ruling does not drop amputation. We say: Execution completes the judge’s ruling in punishments. Before execution is like before the ruling. If owned before the ruling, no amputation; so too before execution. In Fath al-Qadir: In Mishkat, Safwan said: I sell it to him and forgive its price, and he was silent. Many narrations omit this, only saying: I did not intend this, or: Is an Arab’s hand cut for thirty dirhams? It is not confirmed he gifted it. The incident is one, so this addition is inconsistent, causing weakness. His saying: It is charity for him may have been after delivery, not ownership without possession. In Al-Mabsut: Some narrations say: I forgave him. The hadith narrates a specific case, not general. The Prophet’s (ﷺ) saying: Why not before bringing him to me? means to avoid exposing him. His face changed, and Safwan said: It seems to distress you. He replied: How could it not, when you aid devils against your Muslim brother? This shows he disliked exposure. It is not famously narrated that he amputated after the gift. If narrated, the thief may not have accepted the gift, and since his cover was exposed, the Prophet (ﷺ) purified him with the punishment, rejecting the gift. In our view, if the thief rejects the gift, amputation is not dropped. In Badhl al-Majhud: Safwan’s hadith is not evidence, as he said: It is charity for him, possibly meaning the stolen item or waiving amputation, which does not drop the punishment. Some narrations say: I gifted the amputation. It may mean he gifted the item but it was not received, and amputation is dropped only with gifting and possession.

٢ قوله: في حديث صفوان اضطراب إلخ: اعلم أنه إذا وهب المسروق منه المال من السارق أو باعه منه، فإن كانقبل قضاء القاضي بالقطع سقط القطع عنه بلا خلاف لانقطاع خصومته. وإن كان بعد القضاء قبل الإمضاء يسقط القطع عند أبي حنيفة ومحمد ، وعن أبي يوسف أنه لا يسقط القطع عنه، وهو قول الشافعي وحجتهما حديث صفوان فإنه كاننائما في مسجد رسول الله ﷺ متوسدا بردائه، فجاء سارق، وسرق ردئه، فأتبعه حتى أخذه، فجاء به إلى رسول الله ﷺ فأمر بقطعه، فقال: تقطعه بسبب ردائي وهبتها له، فقال رسول الله ﷺ: (هلا قبل أن تأتيني). فهذا يدل على أن الهبة بعد القضاء لا تسقط القطع. ولنا أن الإمضاء يعني استيفاء الحدبالفعل من تتمة قول القاضي في باب الحدود، فما قبل الاستيفاء كما قبل القضاء، ولو ملكه قبل القضاء لا يقطع، فكذاقبل الاستيفاء.

هذا حاصل ما في (المبسوط) و(بذل المجهود) و(فتح القدير) و(العناية)، والبسط في هذه الكتب، تركناهلطوله، من شاء الاطلاع عليه فليرجع إليها. وقال في (فتح القدير): وأما حديث صفوان، ففي رواية كما ذكر في (المشكاة) وفي رواية الحاكم في (المستدرك): قال: (أنا أبيعه وأنسته ثمنه)، وسكت عليه. وفي كثير من الروايات لميذكر ذلك، بل قوله: (ما كنت أريد هذا)، وقوله:(أيقطع رجل من العرب في ثلاثين درهما)، ولم يثبت أنه سلمه إليهفي الهبة، ثم الواقعة واحدة، فكان في هذه الزيادة اضطراب، والاضطراب موجب للضعف. ويحتمل كون قوله: (هو صدقة عليه ) كان بعد الدفع اليه وفي ذلك لايكون ملكا له قبل القبض انتهي .

وقال في (المبسوط): فأما حديث صفوان ، فقد ذكر في بعض الروايات: عفوت عنه، والحديث حكاية حال لا عموم له ،معني قولهﷺ (هلا قبل ان تأتيني به) كيلا ينتهك ستره،الا تري ان ما روي ان وجه رسول الله ﷺ تغير، فقال صفوان: كأنه شق عليك ذلك يا رسول الله، قال: وكيف لا يشق عليّ، وكأنكم أعوان الشياطينعلى أخيكم المسلم، فعرفناه أنه كره هتك الستر عليه ولم يرو مشهورا أنه قطع يده بعد هبته. وإن روي ذلك فيحتملأن السارق لم يقبل الهبة، ولما انتهتك ستره استحب أن يطهره رسول الله ﷺ بإقامة الحد عليه، فلم يقبل الهبة لذلك.وعندنا إذا لم يقبل الهبة السارق لا يسقط القطع انتهى.

وقال في (بذل المجهود): وأما حديث صفوان رضي الله عنه فلا حجة فيه؛ لأن المروي قوله: (هو عليه صدقة)

وقوله: (هو يحتمل) أنه أراد به المسروق. ويحتمل أنه أراد به القطع وهبة القطع لا تسقط الحد، يدل عليه أنه روي فيبعض الرويات: أنه قال: وهبت القطع، وكذا يحتمل أنه تصدق عليه بالمسروق أو وهبه منه، ولكن لم يقبضه،والقطع انما يسقط بالهبة مع القبض.

وَعَنْ عُبَادَةَ بْنِ الصَّامِتِ رَضِي اللهُ عَنهُ أَنَّ رَسُوْلَ اللّهِ ﷺ قَالَ: (جَاهِدُوْا النَّاسَ فِياللّهِ الْقَرِيبَ وَالْبَعِيدَ، وَلَا تُبَالُوا فِي اللهِ لَوْمَةَ لَائِمٍ، وَأَقِيمُوا١ حُدُودَ اللهِ فِي الْحَضَرِ وَالسَّفَر).رَوَاهُ عَبْدُ اللهِ بْنُ أَحْمَدَ فِي مُسْنَدِ أَبِيْهِ.

English

Ubadah ibn al-Samit (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Strive for Allah against near and far, heed no blame in Allah’s cause, and establish Allah’s limits in residence and travel. [Narrated by Abdullah ibn Ahmad in his father’s Musnad]

١ قوله: وأقيموا حدود الله في الحضر والسفر: اعلم أن السفر المذكور في هذا الحديث أعم؛ لأن المسافر قد يكونغازيا وقد لا يكون، فثبت بذلك أن يقام الحدد في الغزو أيضًا، ولهذا صرَّح فقهائنا بجواز إقامة الحدود في المعسكر، وأماحديث بسر بن أرطاة (لا تقطع الأيدي في الغزو)، فقال قائل: هو ضعيف، أخذ به الأوزاعي ولم يقل به فقهائناً وما أخذ به أكثر الفقهاء أيضًا فإنهم لا يفرقون بين أرض الحرب ولا غيرها، ويرون إقامة الحدود على من ارتكبها، كما يرون وجوب الفرائض والعبادات عليهم في دار الإسلام والحرب سواء. وقال قائل: المراد بقوله: (فيغزو) أي في مال الغزو أي الغنيمة قبل القسمة؛ إذ له حق فيها. أخذته من هامش (الكوكب الدري) و(نيل الأوطار)والسندهي و (المرقاة).

وَعَنْ عَلِيِّ بْنِ أَبِيَّ طَالِبٍ رَضِي اللهُ عَنهُ قَالَ: إِذَا١ سَرَقَ السَّارِقُ قُطِعَتْ يَدُهُ الْيُمْنَى،فَإِنَّ عَادَ قُطِعَتْ رِجْلُهُ الْيُسْرَى، فَإِنَّ عَادَ سَجَنَهُ السِّجْنَ حَتَّى يُحْدِثَ خَيْرًا، إِنَّيْ لَأَسْتَحْبِيُّمِنَ اللهِ أَنْ أَدَعَهُ لَيْسَ لَهُ يَدُّ يَأْكُلُ بِهَا وَيَسْتَنْجِيْ بِهَا، وَرِجْلٌ يَمْشِيْ عَلَيْهَا. رَوَاهُ مُحَمَّدُ بْنُالْحَسَنِ فِي (كِتَابِ الْآثَارِ). وَرَوَى عَبْدُ الرَّزَّاقِ وَابْنُ أَبِيْ شَيْبَةَ وَالْبَيْهَقِيُّ وَالدَّارِقُطْنِيَّ َحْوَهُ.

وَفِي رِوَايَةٍ لِابْنِ أَبِيْ شَيْبَةَ أَنَّ نَجْدَةً كَتَبَ إِلَى ابْنِ عَبَّاسِ يَسْأَلُّهُ عَنْ السَّارِقِ فَكَتَبَإِلَيْهِ بِمِثْلٍ قَوْلٍ عَلِيٍّرَضِي اللهُ عَنهُ.

وَرَوَى سَعِيْدُ بْنُ مَنْصُوْرٍ عَنْ سَعِيْدِ بْنِ أَبِيْ سَعِيْدِ الْقَبُرِيِّ عَنْ أَبِيْهِ قَالَ: حَضَرْتُ عَلِيَّ بْنَأَبِيْ طَالِبٍ رَضِي اللهُ عَنهُ وَقَدْ أَتِيَ بِرَجُلِ مَقْطُوْعِ البَّدِ وَالرِّجْلِ قَدْ سَرَقَ، وَقَالَ لِأَصْحَابِهِ: مَا تَرَوْنَفِي هَذَا؟ قَالُوْا: أَقْطِعْهُ يَا أَمِيْرَ الْمُؤْمِنِيْنَ، قَالَ: قَتَلْتُهُ إِذَا وَمَا عَلَيْهِ الْقَتْلُ، بِأَيٍّ شَيْءٍ يَأْكُلُالطَّعَامَ بِأَيّ شَيْءٍ يَتَوَضَّأُ لِلصَّلَاةِ بِأَيَّ شَيْءٍ يَغْتَسِلُ عَنْ حَاجَتِهِ بِأَّيِّ شَيْءٍ يَقُوْمُ عَلَىحَاجَتِهِ، فَرَدَّهُ إِلَى سِجْنٍ أَيَّامًا، ثُمَّ أَخْرَجَهُ وَاسْتَشَارَ أَصْحَابَهُ، فَقَالُوْا مِثْلَ قَوْلِهِمْ الْأَوَّلِ،وَقَالَ لَهُمْ مِثْلَ مَا قَالَ أَوَّلَ مَرَّةً، فَجَلَدَهُ جَلَدًا شَدِيْدًا ثُمَّ أَرْسَلَهُ. وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ:وَمَا رُوِيَ يُقْطَعُ ثَالِثًا أَوْ رَابِعًا إِنْ صَحَّ١ حُمِلَ عَلَى السِّيَاسَةِ أَوْ نَسْخِ.

English

Ali ibn Abi Talib (may Allah be pleased with him) narrated: If a thief steals, his right hand is cut. If he repeats, his left foot is cut. If he repeats, he is imprisoned until he does good. I am ashamed before Allah to leave him without a hand to eat or clean with, or a leg to walk on. [Narrated by Muhammad ibn al-Hasan in Kitab al-Athar]

Abd al-Razzaq, Ibn Abi Shayba, al-Bayhaqi, and al-Daraqutni narrated similarly. Ibn Abi Shayba narrated: Najda wrote to Ibn Abbas about a thief, and he replied with Ali’s view. Sa‘id ibn Mansur narrated from Sa‘id ibn Abi Sa‘id al-Qaburi, from his father: I was with Ali ibn Abi Talib when a man, whose hand and foot were cut, was brought for stealing. Ali asked his companions: What do you think? They said: Cut, O Commander of the Faithful. He said: That would kill him, and he does not deserve death. How would he eat, perform ablution, clean, or stand for his needs? He sent him to prison for days, then consulted again. They repeated their view, and he repeated his, flogged him severely, and released him. Ibn al-Humam said: Narrations of cutting a third or fourth time, if authentic, are understood as policy or abrogated.

It is unlikely the Prophet (ﷺ) cut four limbs then killed, unknown to Ali, Ibn Abbas, and Umar, close Companions who would know by custom. Ali’s refusal suggests the narration’s weakness or that it was not a fixed punishment but the Imam’s discretion, seeing corruption or incorrigibility, allowing killing as policy, meaning figurative killing. ١ قوله: إن صح حمل على السياسة أو نسخ: أشار إلى ما قاله الإمام الطحاوي: تتبعنا هذه الآثار، فلم نجد لشيء منها أصلًا. قال في (الفتح): وفي (المبسوط) الحديث غير صحيح، ولئن سلم يحمل على الانتساخ؛ لأنه كان في الابتداءتغليظ في الحدود، كقطع أيدي العرينيين وأرجلهم وسمر أعينهم. ثم قال في(الفتح) بعد نقله مثل مذهبنا عن عليوابن عباس وعمر: أن هذا قد ثبت ثبوتا لا مَردَّ له، وبعيد أن يقطع ﷺ أربعة السارق، ثم يقتله، ولا يعلمه مثل عليوابن عباس وعمر من الصحابة الملازمين، ولو غابوا لا بُدَّ من علمهم عادة، فامتناع علي رضی اللہ عنہ ، إما لضعف ما مراولعلمه بأن ذلك ليس حدًّا مستمرا، بل من رأي الإمام قبله لما شاهد فيه من السعي بالفساد في الأرض وبعد الطباععن الرجوع فله قتله سياسةً، فيفعل ذلك القتل المعنوي اهـ. أي إنّ قطع أربعته قتل معنى، فإذا رأى أن له قتله سياسةً فله قتله معنى. وهذا يشير إلى ما قدمناه من أن له قتله سياسة في الثالثة. كذا في (رد المحتار).

وَعَنْ أَبِي هُرَيْرَةَ رضي الله عنه أَنَّ النَّبِيَّ ﷺ أَتِي بِسَارِقٍ سَرَقَ شَمْلَةً، فَقَالَ النَّبِيُّ ﷺ (مَا إِخَالُهُ سَرَقَ)، وَقَالَ السَّارِقُ: بَلَى يَا رَسُوْلَ اللهِ، فَقَالَ:(ذْهَبُوا بِهِ فَاقْطَعُوهُ،٢ ثُمَّ احْسِمُوهُ،ثُمَّ ائْتُونِى بِهِ)، فَقُطِعَ ثُمَّ حُسِمَ، ثُمَّ أُنِيَ بِهِ، وَقَالَ: (تُبْ إِلَى اللهِ) قَالَ: تُبْتُ إِلَى اللّهِ. قَالَ(تَابَ اللهُ عَلَيْكَ). رَوَاهُ الْحَاكِمُ فِي (الْمُسْتَدْرَكِ)، وَقَالَ: صَحِيْحُ عَلَى شَرْطٍ مُسْلِمٍ.

وَرَوَى الْبَغَوِيُّ فِي (شَرْجِ السُّنَّةِ) فِي قَطْعِ السَّارِقِ عَنِ النَّبِيِّ ﷺ: (اقْطَعُوهُ ثُمَّاحْسِمُوهُ). وَرَوَى الدَّارِقُطْنِيُّ وَأَبُوْ دَاوُدَ فِي الْمَرَاسِيْلِ وَعَبْدُ الرَّزَّاقِ وَغَيْرُهُمْ نَحْوَهُ.

English

Abu Hurayra (may Allah be pleased with him) narrated: A thief who stole a cloak was brought to the Prophet (ﷺ). He said: I don’t think he stole. The thief said: Yes, O Messenger of Allah. He said: Take him, cut him, cauterize him, and bring him back. He was cut, cauterized, and returned. He said: Repent to Allah. He said: I repent to Allah. He said: Allah has accepted your repentance. [Narrated by al-Hakim in Al-Mustadrak, who said: Authentic per Muslim’s conditions]

Al-Baghawi narrated in Sharh al-Sunna on thief amputation from the Prophet (ﷺ): Cut him, then cauterize him. Al-Daraqutni, Abu Dawud in Marasil, Abd al-Razzaq, and others narrated similarly.

وَقَالَ النَّسَائِيُّ: فِيْهِ الْحَجَّاحُ بْنُ أَرْطَاةَ ضَعِيفٌ، وَلَا يُحْتَجُّ بِحَدِيثِهِ. وَقَالَ الشَّيْخُ ابْنُالْهُمَامِ: عِنْدَنَا ذَلِكَ مُظْلَقُّ لِلْإِمَامِ إِنْ رَآهُ، وَلَمْ يَثْبُتْ مَنْهُ عَلَيْهِ الصَّلاةِ وَالسَّلَامُ فِي كُلِّمَنْ قَطَعَهُ لِيَكُوْنَ سُنَّةً.

وَرَوَى أَبُوْ دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَه عَنْ أَبِيْ هُرَيْرَةَ رضی اللہ عنہ ، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ(إِذَا سَرَقَ٢ الْمَمْلُوكُ فَبِعْهُ وَلَوْ بِنَشِّ).

English

Fudala ibn Ubayd (may Allah be pleased with him) narrated: A thief was brought to the Messenger of Allah (ﷺ), his hand was cut, and he ordered it hung around his neck. [Narrated by al-Tirmidhi, Abu Dawud, al-Nasa’i, and Ibn Majah]

Al-Nasa’i said: It includes al-Hajjaj ibn Arta’a, who is weak, and his hadith is not used as evidence. Ibn al-Humam said: In our view, this is at the Imam’s discretion if he sees fit, and it is not established that the Prophet (ﷺ) did this for every amputee to make it a Sunna. Abu Dawud, al-Nasa’i, and Ibn Majah narrated from Abu Hurayra (may Allah be pleased with him): The Messenger of Allah (ﷺ) said: If a slave steals, sell him, even for a pittance.

1 The statement: Hung around his neck: Ibn al-Humam said: Al-Shafi‘i and Ahmad hold it is recommended to hang the hand around the neck, as the Prophet (ﷺ) ordered it. In our view, it is at the Imam’s discretion if he sees fit, and it is not established for every amputee to be a Sunna.

2 The statement: If a slave steals, sell him, even for a pittance: In Badhl al-Majhud: Mawlana Muhammad Yahya noted: This is mentioned to indicate the Imam may add what he deems appropriate beyond the punishment, as a form of discipline. Selling for a pittance or less than his value is a humiliation, like hanging the hand around the neck.

وَعَنْ نَافِعِ أَنَّ غُلَامًا لِابْنِ عُمَرَ أَبَقَ فَسَرَقَ فِي إِبَاقِهِ، فَأَتِيَ بِهِ ابْنَ عُمَرَ وَقَالَلَهُ ابْنُ عُمَرَ: لَنْ يُنْجِيْكَ إِبَاقُكَ مِنْ حَدِّ مِنْ حُدُودِ اللهِ قَالَ: فَقَطَعَهُ٣. رَوَاهُ الْبَيْهَقِيُّ فِيسُنَنِهِ. وَرَوَى مَالِكٌّ تَحْوَهُ.

English

Nafi‘ narrated: A slave of Ibn Umar fled and stole during his flight. He was brought to Ibn Umar, who said: Your flight will not save you from Allah’s limits. He cut him. [Narrated by al-Bayhaqi in his Sunan]

Malik narrated similarly.

3 The statement: He cut him: In Al-Bahr al-Raiq, Al-Mirqat, and Al-Hidaya: If a slave steals from someone other than his master or his master’s wife, he is cut, whether fugitive or not, per this report and the verse: “As for the thief, male or female, cut off their hands” [Al-Ma’ida: 38], which does not distinguish between free and slave. Halving the punishment between free and slave is infeasible, so it is fulfilled to protect people’s property. This is the view of Abu Hanifa, Malik, and al-Shafi‘i (may Allah have mercy on them).

وَعَنِ ابْنِ عُمَرَ رضي الله عنهما قَالَ: جَاءَ رَجُلُّ إِلَى عُمَرَ بِغُلَامٍ لَهُ، فَقَالَ: اقْطَعْ يَدَهُ؛فَإِنَّهُ سَرَقَ مِرْآَةً لِامْرَأَّتِيْ، فَقَالَ عُمَرُ: لَا ٤ قَطْعَ عَلَيْهِ، وَهُوَ خَادِمُكُمْ أَحَدُ مَتَاعِكُمْ.رَوَاهُ مَالِكٌ. وَزَادَ مُحَمَّدُّ فِي رِوَايَتِهِ: سَرَقَ مِرْآَةً لِمْرَأْتِيَّ ثَمَنُهَا سِتُّونَ دِرْهَمًا.

English

Ibn Umar (may Allah be pleased with them) narrated: A man brought his slave to Umar, saying: Cut his hand; he stole my wife’s mirror. Umar said: No amputation; he is your servant, part of your possessions. [Narrated by Malik]

Muhammad’s narration adds: He stole my wife’s mirror worth sixty dirhams.

وَعَنْ عَائِشَةَ ُ رضي الله عنها قَالَتْ: أُتِيَ رَسُوْلُ اللّهِ ﷺ بِسَارِقٍ فَقَطَعَهُ قَالُوا: مَا كُنَّا نرِيدُ أَنْ يَبْلُغَ مِنْهُ هَذَا؟ قَالَ: (لَوْ كَانَتْ فَاطِمَةَ لَقَطَعْتُهَا). رَوَاهُ النَّسَائِيُّ.

English

Aisha (may Allah be pleased with her) narrated: A thief was brought to the Messenger of Allah (ﷺ), and he cut him. They said: We did not want it to reach this. He said: If it were Fatima, I would cut her. [Narrated by al-Nasa’i]

وَعَنِ ابْنِ عَبَّاسِ رضى الله عنهما قَالَ: لَيْسَ١ عَلَى النَّبَّاشِ قَطْعُّ. رَوَاهُ ابْنُ أَبِيْ شَيْبَةً.وَفِي رِوَايَةٍ لَهُ عَنْ الزُّهْرِيّ قَالَ: أَخَذَ بَّاشِّ فِي زَمَنِ مُعَاوِيَةَ، وَكَانَ مَرْوَانُ عَلَى الْمَدِيْنَةِ،فَسَأَلَ مَنْ يَحْضُرُ مِنَ الصَّحَابَةِ وَالْفُقَّهَاءِ فَأَجْمَعَ رَأْيَهُمْ عَلَى أَنْ يُضْرَبَ وَيُطَافَ بِهِ. وَرَوَىعَبْدُ الرَّزَّاقِ تَحْوَهُ، قَالَ عَلِيُّ الْقَارِيْ: لَا يَلْزَمُ مِنْ جَوَازِ إِظْلَاقِ الْبَيْتِ عَلَى الْقَبْرِ حَقِيْقَةً أَوْحُكْمًا أَنْ يَكُوْنَ حِرِزًّا، أَلَا تَرَى أَنَّهُ لَوْ أَخَذَ شَيْئًا مِنْ بَيْتٍ لَمْ يَكُنْ لَهُ بَابٌّ مُغْلَقُّ أَوْحَارِسُ لَمْ يُقْطَعْ بِلَا خِلَافٍ .

Ibn Abbas (may Allah be pleased with them) narrated: No amputation for a grave robber. [Narrated by Ibn Abi Shayba]

In his narration from al-Zuhri: A grave robber was caught in Muawiya’s time, with Marwan governing Madinah. He consulted attending Companions and jurists, who agreed he should be beaten and paraded. Abd al-Razzaq narrated similarly. Ali al-Qari said: A house locked over a grave, literally or legally, does not make it secure. If something is taken from a house without a locked door or guard, there is no amputation by consensus.

1 The statement: No amputation for a grave robber: Grave robbing is taking a corpse’s shroud after burial. No amputation for it is the view of Abu Hanifa and Muhammad, whether the grave is in a locked house or open land, and whether the taken item is the shroud or else. The reason: Grave robbing is not theft due to lack of security, as the dead do not secure themselves, and a grave is not a secure place. Ownership is doubtful, as the dead have no true ownership, nor do heirs, as the deceased’s needs for burial precede inheritance rights. As in Hidaya’s notes. Ibn Abbas’s saying: No amputation for a grave robber, narrated by Ibn Abi Shayba, supports this. Al-Zuhri said: Marwan was brought people robbing graves, beat and exiled them, with many Companions present. Abd al-Razzaq narrated it, adding: And paraded them. Abu Yusuf and al-Shafi‘i hold amputation is required, following Ibn al-Zubayr, who cut a grave robber, per Bukhari’s History. Umar did similarly, per Abd al-Razzaq. The hadith: Whoever robs a grave, we cut him, narrated raised by al-Bayhaqi, supports them. Hidaya’s denial of its being raised is baseless, as is dismissing the hadith: No amputation for a grave robber as insignificant. Abu Hanifa’s response to: Whoever robs a grave, we cut him: First, its chain includes an unknown narrator, so it is not considered. Second, it is understood as policy, supported by some narrations adding: Whoever drowns, we drown him. No hadith in this matter is narrated with a chain suitable for evidence on amputation or its absence. Companion disagreement hinges on whether grave robbing is theft. Those deeming it theft ruled for amputation; those seeing no theft due to lack of security or ownership ruled against it, except as policy. The truth likely aligns with this unless a hadith with a valid chain proves otherwise. The case of pickpocketing, taking another’s property while they are awake, present, and intent on guarding it by exploiting a moment of inattention, is also not theft, like grave robbing. Why then is a pickpocket’s hand cut but not a grave robber’s? Ibn Malik in Sharh al-Manar and other usulis explain: The theft verse implying amputation applies to secretive taking, but for pickpockets and grave robbers, we assess if secrecy adds or detracts. For pickpockets, secrecy enhances, as pickpocketing, though distinct, exceeds theft, taking openly with inattention. For grave robbers, secrecy detracts, as grave robbing is lesser than theft. Thus, amputation applies to pickpocketing but not grave robbing, as a ruling for the lesser extends to the greater, not vice versa. (As in Umdat al-Ri‘aya)

1 The statement: As a recompense for what they earned: This indicates that amputation is the full consequence of the act, as the term “recompense” implies completeness. If we required compensation alongside it, amputation would not be the full consequence, contradicting the text. Abd al-Rahman ibn Awf (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: No liability on the thief after his hand is cut. The meaning: Amputation is a punishment averted by doubts, while compensation is a liability established with doubts, so they are not combined for one act, like retribution with blood money. (As in Al-Mabsut)

١ قوله: ليس على النباش قطع: النبش: بالفتح أخذ كفن الميت بعد الدفن، وعدم القطع في النبش مذهب أبي حنيفةومحمد ، سواء كان القبر في بيت مقفَّل أو في مفازة، وسواء كان المأخوذ من القبر هو كفن الميت أو غيره. والوجهفي ذلك أن النبش ليس بسرقه لفوات الحرز؛ فإن الميت لا يحرز نفسه، والقبر ليس بمحل للحرز، ولأن الشبهة تمكنتفي الملك؛ إذ لا ملك للميت حقيقة ولا للوارث؛ لتقدم حاجة الميت من الجهيز والتكفين على حق الورثة. كذا فيحواشي (الهداية). ويؤيده قول ابن عباس: ليس على النباش قطع، أخرجه ابن أبي شيبة. وأخرج أيضًا عن الزهريقال: أتي مروان بقوم يختفون أي ينبشون القبور، فضربهم ونفاهم والصحابة متوفرون. وأخرجه عبد الرزاق، وزاد:وطوَّف بهم.

وثانيًا بأنه محمول على السياسة، ويؤيده أنه ورد في بعض الروايات مع تلك الجملة: (ومن غرق غرقناه).وبالجملة ليس في الباب حديث مرفوع يروى بسند محتجٍّ به، يدل على قطع النباش، أو عدم قطعه، واختلاف الصحابةفيه مبني على أن النبش هل هو سرقة أم لا؟ فمن ظن أنه سرقة أفتى بالقطع، ومن ظن أنه ليس بسرقة لاختلال الحرزوالملك أفتى بعدم القطع إلا سياسةً. ولعل الحق يدور حوله ما لم يثبت عن صاحب الشريعة بسند يحتج به خلافه،ويرد في هذا المقام أن الطر وهو أخذ مال الغير وهو يقظان حاضر قاصد لحفظه بضرب غفلة منه أيضًا ليس بسرقة،كما أن النبش ليس بسرقة، فما بالهم حكموا بقطع يد الطرار دون النّاش؟

والجواب عنه على ما بسطه ابن مالك في (شرح المنار) وغيره من الأصوليين أن آية السرقة التي فيها حكمالقطع ظاهرةٌ فيما وضع له السارق خَفيَّةٌ في حق الطرار والنباش، فنظرنا في أن الخفاء فيهما لمزية أو نقصان، فظهر لناأن الخفاء في حق الطرار لزيادة؛ فإن الطر وإن كان غير السرقة، لكن فيه زيادة على السرقة، فإن السارق يأخذ خفية،والطرار يأخذ علانية بنوع غفلة. وإن الخفاء في حق النباش لنقصان؛ لأن النبش أدون من السرقة، فأوجبنا القطعبالطر دون النبش؛ بناءً على أن الحكم إذا ثبت للأدنى ثبت للأعلى بالطريق الأولى، ولا عكس. كذا في (عمدةالرعاية).

١قوله: جزاء بما كسبا: فيه نص على أن القطع جميع موجب فعله لما بَيَّنًا أن في لفظ الجزاء إشارة إلى الكمال، فلو أوجبنا الضمان معه لم يكن القطع جميع موجب الفعل، فكان نسخًا لما هو ثابت بالنص. وعن عبد الرحمن بن عوف رضي الله عنه أن النبي ﷺ قال: (لا غرم على السارق بعد ما قطعت يده) والمعنى فيه أن القطع عقوبة تندرئ بالشبهات، والضمان غرامة تثبت مع الشهبات، فلا يجمع بينهما بسبب فعل واحد، كالقصاص مع الدية. كذا في (المبسوط)۔
