ف : جس چیز اور مال کے بدل میں نکاح کیا جاتا ہے اس کو مہر یا صداق کہتے ہیں۔ 12

وَقَوْلُ اللّٰہِ عَزَّ وَ جَلَّ : " وَ أُحِلَّ لَكُمْ مَا وَ رَآءَ ذَلِکُمْ أَنْ تَبْتَغُوَا بِأَمْوَالِكُمْ "۔ اور اللہ تعالیٰ

کا ارشاد ہے (سورۃ نساء، پ:5، ع:4، آیت نمبر:24، میں) (جو عورتیں تم پر حرام کی گئی ہیں) ان کے سوا

سب عورتیں تمہارے لئے حلال ہیں کرتا اپنے مالوں (لیجن مہر) کے بدل ان کو تلاش کرو۔

ف : اس آیت شریف سے ثابت ہوتا ہے کہ (1) نکاح میں مہر ضروری ہے (2) اگر مہر نہ مقرر کیا جائے تو تب

جسی واجب ہوتا ہے۔ (3) مہر مال ہی ہوتا ہے نہ کہ خدمت اور تعليم و غیرہ کیونکہ یہ مال نہیں ہیں (4) انتہائی زرا مال جس کو

مال نہ کہا جائے وہ مہر ہو سکے صلاحیت نہیں رکھتا (5) مہر کی ادنیٰ مقدار دس درہم ہے اس سے کم مہر نہیں ہوگا۔ (مدار

وَ قَوْلُہُ تَعَالٰی : " قَدْ عَلِمْنَا مَا فَرَضْنَا عَلَيْهِمْ فِیْ أَزْوَاجِهِمْ " اور اللہ تعالیٰ کا ارشاد ہے

( سورۃ احزاب، پ:22، ع:6، آیت نمبر:50، میں ) تمام معلوم ہے کہ ہم نے مسلمانوں پران کی پیوپی کا

حق ( لیجن مہر ) مقرر کر دیا ہے ( جس کو نہیں بھرصورت ادا کرنا ہوگا )۔

ف : واضح ہو کہ پیوپی کے حق میں مہر کے علاوہ نکاح کے وقت گواہوں کا ہونا اور ایک سے زیادہ پیوالہول

توباری کا واجب ہونا اور چاہے جو عورت کی حد تک نکاح میں لا ناپیسہ شامل ہیں۔ اس آیت سے یہی معلوم ہوتا ہے

کہ شرعًا مہر کی مقدار اللہ تعالیٰ کے نزدیک مقرر ہے اور وہ دس درہم سے جس کے کرنا ممنوع ہے جسیا کہ حدیث

ع:3، آیت نمبر:20، میں) اور تم نے اپنی کسی پیوی کو مال کثرت دیا ہو۔

ف : تفسیرات احمدی میں لکھا ہے کہ اس آیت سے گرن مہر مقرر کرنے کا جواز ملتا ہے ایک مرتہ حضرت عمر

رضی اللہ عنہ نے منبر پر فرما ایعورتوں کے مہر کا مقرر نہ کر و ایک عورت نے کہا ایمر المومنین ! ہم آپ کی بات

میں یا اللہ تعالیٰ کی بات میں؟ اور پیآ یت پڑھیں " وَ اَتَیْتُمْ اَحَدَتَہُنَّ قِنْطَارًا " اس پر ایمر المومنین نے

اپنی نفس کو خطاب کرتے ہوئے فرما یا لے عمر! تجھے بھر شخص زیادہ بھی دار سے تم لوگ جو چاہو مہر مقرر کرو! سجان

الد خلیفۃ رسول کا شان انضاف اور نفس شریف کی پا کیزگی! الد تعالیٰ نے کوآ پکی اتباع نصیب فرما لے آ مین!

کوئی مہر دس درہم سے کم نہ ہو

That which is given in exchange for a woman in marriage is called Mahr or Sadaq. 12

And Allah, the Exalted and Glorious, says: 'And lawful for you are all beyond that, to seek with your wealth' (Surah An-Nisa, Vol. 5, Part 4, Verse 24). And the guidance of Allah, the Most High, is (in Surah An-Nisa, Vol. 4, Part 3, Verse 24): 'All women are lawful for you except those who have been forbidden to you; seek them in marriage by giving them their due Mahr from your wealth.'

From this noble verse, it is established that: (1) Mahr is necessary in marriage, (2) if Mahr is not specified, then what is obligatory must be given, (3) Mahr must be in the form of wealth, not services such as labor or education, because these are not considered wealth, (4) an extremely small amount that cannot be considered wealth cannot serve as Mahr, (5) the minimum amount of Mahr is ten dirhams, and anything less than this is not permissible as Mahr.

And His Exalted Saying: 'We know what We have prescribed for them concerning their wives' (Surah Al-Ahzab, Vol. 22, Part 6, Verse 50). And the guidance of Allah, the Most High, is (in Surah Al-Ahzab, Vol. 22, Part 6, Verse 50): 'We know what We have prescribed for them concerning their wives,' meaning that We have determined the right of the bride (Mahr) for Muslims, which must be paid without any reduction.

It is clear that besides Mahr, the presence of witnesses at the time of marriage and the requirement of more than one male witness or two female witnesses, and the inclusion of a dowry in the marriage contract, are also necessary. From this verse, it is evident that the amount of Mahr is determined by Allah, the Most High, and it is prohibited to set it below ten dirhams, as mentioned in the noble Hadith. And His Exalted Saying: 'And you gave one of them a great amount' (Surah An-Nisa, Vol. 4, Part 3, Verse 20). And the guidance of Allah, the Most High, is (in Surah An-Nisa, Vol. 4, Part 3, Verse 20): 'And you gave one of them a great amount.'

In Tafsir Ahmad, it is written that from this verse, the permissibility of setting a high Mahr is derived. Once, during his sermon, Umar (RA) said, 'Do not set a high Mahr for women.' A woman then asked, 'O Commander of the Faithful! Is this your word or the word of Allah, the Most High?' She then recited the verse, 'And you gave one of them a great amount.' Upon this, the Commander of the Faithful (Umar, RA) acknowledged her point.

Addressing his own soul, he says: O Umar! You are more dear to me than my own life! O noble successor of the Messenger of Allah (SAW), your status is exalted and your noble self is pure! May Allah the Exalted grant steadfastness in obedience to all who follow you, Ameen! Let no one’s affection be less than ten dirhams.

جا بر ضی اللہ علیہ روایت سے وہ فرما تے ہیں کر رسول اللہ علیہ وآل وسلم

نے ارشاد فرما یا کر کوئی مہر دس درہم سے کم نہ ہو جسیا کر ایک طویل حدیث میں مرودی ہے۔

اس کی روایت ابن ابی حاتم نے کی ہے۔ اور حافظ ابن ججر نے کہا ہے کہ پیر وايت اس سن دکے

ساتھ حسن ہے جسیا کر قدیر کے باب الكفارہ میں ذکور ہے۔

Jabir ibn Abdullah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said, “There is no dowry (1) less than ten [dirhams],” in a long Hadith. Narrated by Ibn Abi Hatim.

Al-Hafiz Ibn Hajar said: With this chain, it is good, as in Fath al-Qadir in the chapter on compatibility. Ad-Daraqutni and Al-Bayhaqi narrated in their Sunan from him that the Messenger of Allah (ﷺ) said, “There is no dowry less than ten dirhams.”

In another narration by them from Ali (may Allah be pleased with him), stopped (2): “The dowry shall not be less than ten dirhams.” Sa‘id ibn Mansur narrated in his Sunan from Abu an-Nu‘man al-Azdi, who said: The Messenger of Allah (ﷺ) married a woman for a chapter of the Qur’an (3), then said, “It shall not be a dowry for anyone after you.”

In a narration by Abu Dawud from Makhul, he said, “That is not for anyone after the Messenger of Allah (ﷺ).”

(1) The statement: “There is no dowry less than ten”: Thus, in Sharh al-Wiqayah, it is said: The minimum is ten dirhams, according to us. For Ash-Shafi‘i, anything valid as a price is valid as a dowry, whether ten dirhams, less, or more. In Umdat ar-Ri‘ayah, it means anything that can be a price in transactions, even a dirham or less, is valid as a dowry, so there is no minimum limit except its validity as compensation, and there is no maximum limit by consensus. In Ad-Durr al-Mukhtar: The minimum is ten dirhams, due to Al-Bayhaqi’s Hadith and others: No dowry less than ten dirhams. Narrations allowing less are interpreted as the prompt portion. In Radd al-Muhtar: Meaning, what the Hadiths apparently indicate as permissible for less than ten is all weak except the Hadith: “Seek, even if a ring of iron,” which must be interpreted as the prompt portion, as it was their custom to give part of the dowry before consummation as recommended. The rest is deferred. In Al-Bada’i‘: It is possible that Hadiths allowing less than ten were in a time when marriage without a dowry was permissible, as it is said that marriage was allowed without a dowry until the Prophet (ﷺ) prohibited shighar.

(2) The statement: “From Ali, stopped”: It appears he said it by instruction, as this is a matter not reached by independent reasoning or analogy, as stated in Umdat al-Qari.

(3) The statement: “The Messenger of Allah (ﷺ) married a woman for a chapter of the Qur’an, etc.”: Meaning, if a man marries a woman on the condition that he teaches her the Qur’an, the contract is valid, and according to us, she is entitled to the dowry of her peers. Ash-Shafi‘i said: She is entitled to the teaching of the Qur’an, as in the Hadith of Sahl ibn Sa‘d as-Sa‘idi: “Do you have anything of the Qur’an?” He said, “Yes.” He said, “I have given her to you for what you have of the Qur’an,” narrated by Abu Dawud. We say: It does not indicate that the Qur’an was made the dowry, as he did not stipulate teaching her. Rather, it means by the blessing of what you have, or because you are among the people of the Qur’an, like Abu Talhah’s marriage for his Islam, which is not a valid dowry for private parts. The marriage occurred with her dowry, and she gifted it to him due to his Islam based on her promise. Thus, Islam became a cause for her entitlement to him, like a dowry, not the dowry itself, as Islam is a religious benefit, and a religious benefit without worldly benefit is not called wealth by consensus, contradicting His saying: “And lawful to you is what is beyond that, that you seek with your wealth” [An-Nisa: 24]. This is the essence of what Al-‘Ayni and Ali al-Qari (may Allah have mercy on them) said.

In Nayl al-Awtar: Al-Tahawi, Al-Abhari, and others said this was specific to that man, as the Prophet (ﷺ) was permitted to marry a woman who gifted herself, so he could marry her to whomever he wished without a dowry. They supported this with Abu an-Nu‘man’s mursal Hadith, which says, “It shall not be a dowry for anyone after you,” and Abu Dawud’s Hadith via Makhul: “This is not for anyone after the Prophet (ﷺ).” In Umdat ar-Ri‘ayah: As for Bukhari’s Hadith and others that he said to a man, “Seek, even if a ring of iron,” and he sought but found nothing, so he said, “Do you have anything of the Qur’an?” He said, “Yes, such and such chapters,” and he said, “I have given her to you for what you have of the Qur’an.” Ash-Shafi‘i used this to argue that a dowry can be non-wealth. Our scholars responded that the “ba” here is not for exchange but for causation or justification. In Fath al-Qadir, it is said: Since Ash-Shafi‘i permitted taking a fee for teaching the Qur’an, he validated calling it a dowry. Likewise, we say: What is ruled permissible should validate calling it a dowry, but I have not seen anyone address this. In Al-Bahr: It will come in the chapter on hiring that the ruling permits hiring for teaching the Qur’an and jurisprudence, so it should be valid to call it a dowry, as what is permissible to take a fee for as a benefit can be called a dowry, as we cited from Al-Bada’i‘. In Ad-Durr al-Mukhtar: The dowry of peers is obligatory for teaching the Qur’an, due to the text on seeking with wealth, and the “ba” in “I married her to you for what you have of the Qur’an” is for causation or justification. However, in An-Nahr, it should be valid according to later scholars.

تے روایت کی ہے وہ فرما تے ہیں کر رسول اللہ علیہ وآل وسلم نے ارشاد فرما یا کر کوئی مہر

اوران میں دونوں نے منی دار تنی اور قطعنی کی ایک اور روایت میں حضرت علی ضی

اللہ علیہ مو تو فاًمرودی کر کوئی مہر دس درہم سے کم نہ ہو۔

اور سعید بن منصور نے اپنی سنن میں ابو النعمان ازدی ضی اللہ علیہ روایت

کی ہے انہوں نے کہا کر رسول اللہ علیہ وآل وسلم نے ایک عورت کا نکاح قرآن کی ایک سورۃ

(کی تعلیم) کے معاوضہ میں کر دیا پھر ارشاد فرما یا کر اسی مہر تمهار سے بعد کسی کے لیے نہیں ہوگا۔

It is narrated by Saeed bin Mansoor in his Sunan from Abu An-Naaman Azdi, may Allah have mercy on him, that he said:

The Messenger of Allah ﷺ married a woman in exchange for teaching her one chapter of the Quran. Then he said, 'Do not make this dowry for anyone after you.'

اور ابو داود کی ایک روایت میں رحمۃ اللہ علیہ سے مرودی ہے وہ کہتا

کر تے تھا کہ پیر (یعنی قرآن کی سورۃ کی تعلیم کا مہر مقرر کرنا) رسول علیہ صلاۃ اللہ کے بعد کسی کے لیے

دورست نہیں۔

امہات المومنین کا مہراپچ سودرہمتعا

It is narrated on the authority of Abu Dawud that it is reported from Allah's mercy be upon him that he said

It is not right to charge a fee for teaching a chapter of the Qur'an after the prayer of the Messenger of Allah ﷺ. The dowry of the Mothers of the Believers was twelve dirhams.

ا ب و س ل م ة ر ح م ة اللہ علیہ سروايتہ وه فما تہیں کہ میں ام المومنین حضرت عائشہ رضی اللہ عنها سے دریافت کیا کہ نبی کریم صلی اللہ علیہ وآلہ وسلم ( کی بی بیول ) کا مہر کیا ہوا کرتا تھا ام المومنین نے فرما یا کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم کی بیبول کا مہر بارہ او قیہ اور ایک نش تھا ام المومنین نے ( اب وسل مے ) پوچھا کیا تم جانتے ہو کہ ش کے کہتے ہیں ( اب وسل م ) کہتے ہیں میں نے جواب دیا تم بیس ! تو ام المومنین نے فرما یا ( نش ) آدے اوقیہ کو کہتے ہیں تویی ( سائے بارہ او قیہ چاندی کاسکه ) پانچ سودرہم ہوتے ۔ اس کی روايت مسلم نے کی ہے اور شرح السنہ اور مصانع کے تمام نسخوں میں نش نون کے پیش سے لمحا ہے۔

ا ور نسا ئی نے اور ابو داود نے ام حبیبر ضی اللہ عنها سے روايت کی ہے کروہ عبد اللہ بن جبش کے نکاح میں تحسین اور ان کا انتقال جبش میں ہوگیا تو نجاٹی ( شاہ جبش نے عدہ گذر نے کے بعد حضور صلی اللہ علیہ وآلہ وسلم کی اجازت تے ) آپ کا نکاح نبی کریم صلی اللہ علیہ وآلہ وسلم سے کردیا اور اپنے پاس سے چار بھرا ر مہر آپ کودیا۔

ش ع می ر ح م ة اللہ علیہ سروايتہ وه فما تہیں کہ ( ایک مرتبہ ) امیر المومنین عمر بن خطاب ضی اللہ عنه نے خطبہ ارشاد فرما یا اللہ تعالی کی حمد و ثناء بیان کی اور فرما یا

خبردار عورتوں کے مہر میں غلو نہ کرو (لیکن بطورے بطورے مہر نہ مقرر کرو) سن لو! جس کسی کے

بارے میں مجھے اطلاع مل کر اس نے اس مقدار سے زیادہ مہر مقرر کیا ہے جس کو رسول اللہ

صلی اللہ علیہ وآلہ وسلم نے مقرر کیا تھا ایسی کو زیادہ مال دیا گیا ہوتا اس زائد مقدار کو میں بیت

المال میں داخل کر دوں گا پھر آپ نے ممبر سے اتر گئے۔ ایک قریشی عورت آپ کے رودبرو

حاضر ہوئی اور کہا ایمر المومنین! اللہ کی کتاب پیروی کے قابل ہے یا آپ کا قول؟ آپ صلی

اللہ علیہ وسلّم نے فرمایا: اللہ کی کتاب! واقع کیا ہے؟ اس عورت نے کہا آپ نے ابھی منبر

پر لوگوں کو منع فرما کر عورتوں کے مہر مقرر کرنے میں غلونہ کرواور اللہ تعالیٰ اپنی کتاب میں

فرماتے ہیں۔

"وَاتَيْتُمْ أَحْدَثُهُنَّ قِنْطَارًا فَلَا تَأْخُذُوا مِنْهُ شَيْئًا" (سورۃ نساء، پ:4، ع:3، آیت

نمبر:20) (اور تم نے اپنی کسی بھی کو مال کثرت دیا ہواس میں سے کچھ بھی واپس نہ لو) یعنی کہ

حضرت عمر نے فرما یاہر شخص عمر سے زیادہ مہر رکھتا ہے۔ آپ نے یہ بات دوبارہ تین بار فرمائی

پھر آپ منبر پر لوٹ آ گے اور لوگوں سے فرما یا میں نے ابھی تم کو عورتوں کے مہر مقرر کرنے میں

غلو (اور زیادتی) سے روکا ہے۔ شخص اپنے مال میں اپنی پسند کے مطابق کام کرے۔

اس کی روایت سے نہیں میں کی ہے اور سعید بن منصور نے کہی اس کی روایت کی ہے۔

شوعہ نکاح کے بعد مہر مقرر کے بغیر اور صحت سے پہلے مر جائے تو کیا حکم ہے

علیہ رحمۃ اللہ علیہ حضرت ابن مسعود رضی اللہ عنہ روایت فرماتے

Ash-Sha‘bi narrated: Umar ibn al-Khattab (may Allah be pleased with him) gave a sermon, praised Allah and extolled Him, and said, “Do not exaggerate in women’s dowries. If it reaches me that anyone has given more than what the Messenger of Allah (ﷺ) gave or was given to him, I will place the excess in the public treasury.” Then he descended, and a Qurayshi woman confronted him, saying, “O Commander of the Faithful, is the Book of Allah more worthy of being followed, or your words?” He said, “The Book of Allah, so what is it?” She said, “You just forbade people from exaggerating in women’s dowries, but Allah, the Exalted, says in His Book: ‘And if you have given one of them a qintar, do not take anything from it’ [An-Nisa: 20].” Umar said, “Everyone is more knowledgeable than Umar,” twice or thrice, then returned to the pulpit and said to the people, “I forbade you from exaggerating in women’s dowries, but let a man do with his wealth as he pleases.” Narrated by Al-Bayhaqi in his Sunan and Sa‘id ibn Mansur.

ہیں کہ آپ اپنے شخص کے بارے میں مستند ریافت کیا گیا جس نے ایک عورت سے نکاح

کیا اور اس کے لیے مہر مقرر نہیں کیا اور اس سے صحت کرنے سے پہلے انتقال کر گیا، پیس کر ابن

مسعود رضی اللہ عنہ نے فرما یا میں عورت کو اس کے خاندان کی عورتوں کے مہر کی طرح لیجن مہرش

لے گا۔ نداس میں کی ہوگی اور نہ زیادتی اور ایسی عورت پر شوہر کے وفات کی وجہ سے عدت بھی واجب ہوگی اور اس کو تزکرہی لے گا۔ یہ کر معقل بن سنان ابی رضی اللہ عنہ نے کہا کہ فرمایا کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے بروع بنت واشق کے بارے میں جو ہمارے قبیل کی ایک خاتون تھی اسی کی فصل فرمایا تھا، حضرت ابن مسعود رضی اللہ عنہ نے کہا کہ بیٹا خوش ہوئے اس لے کر آپ کا فتوی رسول اللہ صلی اللہ علیہ و آلہ وسلم کے مطابق تھا۔ اس حدیث کی روایت ترمذی، ابو داود، نسائی اور داری نے کی ہے۔ اور ترمذی نے اس حدیث کو اور حسن قرار دیا ہے۔

Alqamah narrated from Ibn Mas‘ud (may Allah be pleased with him) that he was asked about a man who married a woman without specifying a dowry and died before consummating the marriage. Ibn Mas‘ud said (1), “She is entitled to the dowry of her peers, neither deficient nor excessive, and she must observe the waiting period, and she has inheritance.” Ma‘qil ibn Sinan al-Ashja‘i stood and said, “The Messenger of Allah (ﷺ) ruled in the case of Birwa‘ bint Washiq, a woman from us, as you have ruled.” Ibn Mas‘ud was pleased with it. Narrated by Tirmidhi, Abu Dawud, An-Nasa’i, and Ad-Darimi. Tirmidhi authenticated it and deemed it good.

(1) The statement: “Ibn Mas‘ud said, ‘She is entitled to the dowry of her peers, etc.’”: The detail is that if a man marries an adult woman with her consent without a dowry, the marriage is valid, and she can demand a dowry. If he consummates before specifying, she is entitled to the dowry of her peers. If he divorces her before specifying and consummation, she is entitled to a compensatory gift. If one of them dies before consummation and specification, scholars differed on whether she is entitled to a dowry. Some, including Ali, said she has no dowry, as if divorced before consummation and specification. Others said she is entitled to a dowry, as death is like consummation in confirming a specified dowry, so it confirms the dowry of peers if none was specified in the contract. This is Ibn Mas‘ud’s view. Ash-Shafi‘i has two opinions aligning with both, and Abu Hanifah and Ahmad’s school aligns with Ibn Mas‘ud. It is narrated that Ash-Shafi‘i retracted his first opinion in Egypt and adopted the Hadith of Birwa‘ bint Washiq. This is the essence of At-Ta‘liq al-Mumajjad, Al-Marqah, and Tansiq an-Nizam.

(2) The statement: “And she must observe the waiting period, and she has inheritance”: Meaning the waiting period for death. In Tansiq an-Nizam, it is said: As for her having inheritance, it is agreed upon, as stated in At-Ta‘liq al-Mumajjad.
