(اس باب میں ایس شخص کو معاف کر دینے اور معاف کرنے کا بیان ہے جو قرض دار ہو

اور مفلس ہو گیا ہو )

This chapter discusses the forgiveness and pardoning of a person who is indebted and has become insolvent.

وقول الله عزوجل وان كان ذو عسره فنظره الي ميسره وان تصدقوا خير لكم ان كنتم تعلمون

اور اللہ تعالیٰ کا ارشاد ہے : ( سورۃ بقرہ، پ : 3، ع : 38، آیت نمبر : 280، میں ) " اگر وہ ( جسے قرض دار )

تنگدست ہو ( اور وہ پر قرض ادا نہ کر سکے ) تو ( اس کو مہلت دینے کا حکم ہے خوشحالی تک ( جسے جب تک اس کے پاس

اور اس کی نجابت پیش پڑا ہو جائے ) اور یہ بات ہے ( بالکل یہ ) معافی کر دو اور زیادہ مہتر ہے تمہارے لئے اگر تم کو ( اس

کے ثواب کی ) خبر ہو

And the guidance of Allah Almighty is: (Surah Al-Baqarah, Part 3, Section 38, Verse Number 280) "If the debtor is in difficulty and cannot pay the debt, then (the command is to) grant him respite until he becomes prosperous (until such time as he has the means and ability to pay). And it is better for you to forgive the debt if you knew (the reward thereof)."

روایت فرماتے ہیں کہ حضرت صلی اللہ علیہ و آلہ وسلم نے ارشاد فرمایا کہ کوئی شخص کسی کے باٹھ پچھے

مال ( اموار ) فروخت کر دے اور ( ادا کی سے پہلے ) وہ شخص جسے خریدار مفلس ہو جائے اور ( پیچھے

والا ) اپنا مال خریدار کے پاس موجود پا کر تو ایسی صورت میں وہ مال پیچھے والے کی کاہوگا ( اور وہ

اس کو حاصل کر لے ) ( اور اگر کوئی شخص اپنا مال کسی کے باٹھ پچھے نقدا اور پچھا ادہار فروخت کر کے پچھے

رقم باقی رہے ) اور پچھے رقم حاصل کر لے ( اور ادا کی سے پہلے خریدار مفلس ہو جائے ) تو ایسی صورت

میں باقی رقم پیچھے والے کی ان قرضوں اہول میں شامل ہو جائے گا ( جس کو اس مفلس شخص سے رقم

وصول طلب ہے ) اور اس کا حکم یہ ہو گا کہ قرضوں اہول کے حصر کے بر ابر بر ابر ہو گا ( جس کی جتنی

رقم اس کے پاس سے حاصل ہووہ سب قرض خواہول میں مساوی تقسیم کی جائے گی)۔

اس کی روايت دار ني اور ان ماجر نے کی ہے اور ان ماجکي سندي میں ابن عياش بین جن کو

امام احمد نے ثقہ قرار دیاہے، یحدیث مرسل ہےاور مرسل ہمارے پاس جحت ہے-

اور امام طحاوی نے بھی اس کے قریب قریب روایت کی ہے-

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “If a man sells a commodity and finds his commodity as it is with a person who has become bankrupt, and he has not received any of its price, then it belongs to him. But if he has received any part of its price, he is equal to the other creditors.” [Narrated by Ad-Daraqutni and Ibn Majah]

In its chain is Ibn ‘Ayyash, whom Ahmad deemed reliable, but it is mursal, and according to us, a mursal is a proof. At-Tahawi narrated something similar, and ‘Abdur-Razzaq narrated it as a connected narration.

(1) The statement: “Equal to the creditors”: For this reason, it is said in the completion of Bahr Ar-Ra’iq: This means that if someone buys goods and becomes bankrupt while the goods are still in his possession, the seller of the goods is equal to the creditors in it. The intent is after the buyer takes possession of the goods with the seller’s permission. If it is before possession, the seller may withhold the goods until he receives the price. Likewise, if the buyer takes possession without the seller’s permission, the seller may reclaim and withhold it for the price. It is stated in Umdat Al-Qari: Ibrahim An-Nakha‘i, Al-Hasan Al-Basri, Ash-Sha‘bi in one narration, Waki‘ ibn Al-Jarrah, ‘Abdullah ibn Shubrumah, the judge of Kufa, Abu Hanifah, Abu Yusuf, Muhammad, and Zufar held that the seller of the commodity is equal to the creditors. It is authentically reported from ‘Umar ibn ‘Abdul-‘Aziz that if someone receives part of the price of his commodity and then the buyer becomes bankrupt, he is equal to the creditors. This is also the view of Az-Zuhri, and a similar view is narrated from ‘Ali ibn Abi Talib (may Allah be pleased with him). Ash-Shafi‘i, Malik, and Ahmad argued with what Bukhari and Muslim narrated from Abu Hurairah, who said: “If a man becomes bankrupt and someone finds his property as it is, he has more right to it than others.” They followed the apparent meaning of this hadith, stating that if a man becomes bankrupt and possesses goods he purchased, which remain as they are, the owner has more right to them than other creditors. At-Tahawi responded to this hadith, saying that it refers to someone finding his property as it is, but the sold item is not his actual property; it is only property that was his. His actual property refers to usurped items, borrowed items, deposits, and the like. That is his property as it is, so he has more right to it than other creditors. This hadith from the Messenger of Allah (ﷺ) supports this, as does what is narrated from the Messenger of Allah (ﷺ) in the hadith of Samurah, where he said: The Messenger of Allah (ﷺ) said: “If someone’s property is stolen or lost and he finds it as it is with someone, he has more right to it, and the buyer may seek the price from the seller.”

Al-Tabarani also narrated it, clarifying that the hadith of Abu Hurairah refers to deposits, borrowed items, usurped items, and the like. The owner of the property has more right to it if he finds it as it is in someone’s possession, and the creditors have no share in it because it remains in his ownership. The hand of the usurper is one of transgression and injustice, as is the thief’s, unlike when it is sold and delivered to the buyer, as it then leaves the seller’s ownership, even if the price is not received. The seller here is no longer the owner of the property, as it has left his ownership, and the characteristic has changed as the essence has changed. Thus, the sold item is no longer his property, though it was his property initially.

اور عبد الرزاق نے اس کی روایت ا پنی سندي کے ساتھ کی ہے-

کاروبار میں کسی کونقصان ہوجاے تو سبل کراس کی مدد کرنا چاہئ

And 'Abd al-Razzaq narrated it with his chain of transmission:

If there is a loss in someone's business, one should help them financially.

ابوسعید خدری رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ نبی کریم صلی اللہ

علیہ وآلہ وسلم کے مبارک زمانے میں ایک شخص (جو چلون کی تجارت کیا کرتا تھا) کو (ایک باغ کے)

چلون پر جن کواس نے خریدا تھا (کسی وجہ سے) سخت نقصان ہوا۔ جس کی وجہ سے وہ بے حد مقرود

ہوگیا (بیڑ کی کر) رسول اللہ صلی اللہ علیہ وآلہ وسلم سے ارشاد فرماياس شخص پرپچھہ خیرات

کرو (تا کراس کی مدد ہو جائے) صحابہ کرامؓ نے (حسب استطاعت اس کو) نہرات دی اس کے

باوجود بھی (اس رقم سے) ان کا قرض پورا دانہ ہوسکا تو رسول اللہ صلی اللہ علیہ وآلہ وسلم اس کے دام دارول

سے ارشاد فرمايا (سردست) تم کو جو کچھ ملاہے لے لو اس لے کراس کے پاس (ادا کی کے لے) پچھاور

نہیں ہے (بالآ کہہاگروہ خوشحال ہوجاے تو تم کو اپنا بقیہ قرض وصول کر نے کا حق ہے)-

اس کی روایت مسلم نے کی ہے-

ویالیہ متتعلق احكام

ف :اس حدیث شریف سے یہی معلوم ہوتا ہے کہ تگ کے حال کومہلت دینا واجب ہےاور مسلم معاشرہ پر ایہ

شخص کی امداد واجب ہےاور مہلت سے قرض کی ادائی ساقط نہیں ہوتی بلکہ آنده خوشحالی پر دیندار کو چاہئ کہ اپنا قرض

و اپنی کردے اور قرض دہندہ کو بھی اپنی بقیہ رقم لینا حق رہتاہے-مرقات

مقروض کو مہلت دینے کا حکم اور قرض وصول کرنے کے طریقے

Abu Sa‘id (may Allah be pleased with him) narrated: A man during the time of the Messenger of Allah (ﷺ) suffered a loss in fruits he had purchased, and his debts increased. The Messenger of Allah (ﷺ) said: “Give charity to him.” So people gave charity to him, but it did not suffice to pay off his debt. The Messenger of Allah (ﷺ) said to his creditors: “Take what you find, and you have nothing beyond that.” [Narrated by Muslim]

(1) The statement: “From Abu Sa‘id”: This hadith was mentioned recently in the chapter on prohibited sales.

(2) The statement: “In fruits he purchased”: This indicates that if the fruits are damaged, the buyer is responsible for them. This was discussed in detail in the chapter on prohibited sales, so refer to it.

(3) The statement: “And you have nothing beyond that”: Meaning, you take what you find, and the implication is that you have nothing beyond taking what you find and deferring the remaining debt until a time of ease. It does not mean that you take only what you find, and the remaining debt is void, due to the saying of Allah, the Exalted: And if someone is in hardship, then [let there be] postponement until [a time of] ease (Al-Baqarah: 280). This was stated in Al-Marqah.

عبدالرحمٰن بن کعب بن ما لک رحمۃ اللہ علیہ ت روایت سے وہ فرماتے ہیں کہ

معاذ بن جبل رضی اللہ عنہ ایک نو جوان اور تی آدمی تھا اور اس پاس کوئی چیز نہ رکھتے تھے۔ لیکن

دوسرول کودے دیا کرتے تھے۔ اس وجہ سے بیشتر مقروض رہتے تھے۔ پہلے کہ آپ کا تمام زر

سرماپیر (قرض کی ادائیگی میں) ختم ہوگیا۔ اس کے باوجود بھی قرض باقی رہ گیا تو۔ حضرت صلی اللہ علیہ

وآلہ وسلم کی خدمت اقدس میں حاضر ہوکر عرض کے۔ تاکہ حضور صلی اللہ علیہ وآلہ وسلم نے قرض خواہول سے غفتگو فرما کیں

تاکہ وہ یا تو پورا قرض معاف کردیا اس میں سے کچھ حصہ چھوڑدیا چنانچہ حضرت صلی اللہ علیہ وآلہ

وسلم نے قرض خواہول سے غفتگو فرما کی تو پرہے چلا کر قرض خواہ اس موقف میں نہیں ہیں۔ اگر وہ کسی کو

معافی دینے کے موقف میں ہوتے تو حضور صلی اللہ علیہ وآلہ وسلم کی وجہ سے حضرت معاذ کا قرض

ضرور چھوڑ دیتے۔ پیحال تو کیا کرے رسول اللہ صلی اللہ علیہ وآلہ وسلم نے حضرت معاذ کا ربا سے

سا مان کچھ کھوا دیا جہاں تک حضرت معاذ باکل خالی با تحریر گیا۔

اس حدیث کی روایت سعید بن منصور نے اپنی سنن میں مرسلاً روایت کی ہے۔

ایک اور روایت میں ہے کہ حضرت معاذ مقروض تھے تو ان کے قرض خواہ نی

‘Abdur-Rahman ibn Ka‘b ibn Malik (may Allah be pleased with him) narrated: Mu‘adh ibn Jabal (may Allah be pleased with him) was a generous young man who did not hold onto anything. He continued borrowing until all his wealth was consumed by debt. He came to the Prophet (ﷺ), who spoke to his creditors on his behalf. If they would have waived the debt for anyone, they would have done so for Mu‘adh because of the Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) sold his property for them until Mu‘adh was left with nothing. [Narrated by Sa‘id in his Sunan as mursal]

It is also narrated that Mu‘adh was in debt, and his creditors came to the Prophet (ﷺ). The Prophet (ﷺ) sold all his property to cover his debt until Mu‘adh was left with nothing. This is a mursal narration, and this is the wording of Al-Masabih, and it was not found in the original sources except in Al-Muntaqa.

In the narration of Abu Dawud and An-Nasa’i: The Prophet (ﷺ) said: “The delay of a wealthy person makes his honor and punishment permissible.” Ibn Al-Mubarak said: “Makes his honor permissible” means he is reproached severely, and “his punishment” means he is imprisoned.

In the narration of Ad-Daraqutni and Ibn ‘Adi: The Prophet (ﷺ) said: “The one with a right has authority and speech.”

(1) The statement: “The Prophet (ﷺ) sold all his property”: This means that if the creditors of a bankrupt person request restriction, the judge restricts him, sells his property if he refuses to sell it, distributes his property among the creditors, and prevents him from transactions that harm the creditors, such as acknowledgment or selling at less than its value. It is narrated in this hadith that Mu‘adh was overwhelmed by debt, so the Messenger of Allah (ﷺ) sold his property and distributed the proceeds among his creditors proportionally. This restriction is in consideration of the creditors to prevent harm through acknowledgment. This is the view of Abu Hanifah’s two companions. Abu Hanifah said: He is not restricted due to debt, even if the creditors request it, because restriction diminishes his legal capacity and equates him to animals, which is significant harm and thus not permissible. However, if the creditors of a debtor request his imprisonment, the judge imprisons him to compel him to sell his property to pay his debt, as paying the debt is obligatory, and delaying is injustice. The ruler imprisons him to prevent his injustice and ensure the right reaches its owner, not to coerce him into selling, as the purpose of imprisonment is to compel payment of the debt by any means. This is derived from the completion of Bahr Ar-Ra’iq.

(2) The statement: “The delay of a wealthy person makes his honor and punishment permissible”: This hadith is used as evidence for the permissibility of imprisoning someone with a debt until he pays it, if he is capable, as a disciplinary measure and to be strict with him, but not if he is incapable, as indicated by “wealthy.” This implies that the honor and punishment of an insolvent person are not permissible. The Hanafis and Zaid ibn ‘Ali permitted imprisonment for the wealthy. The majority said the ruler sells on his behalf, as indicated by the hadith of Mu‘adh. As for the non-wealthy, the majority said he is not imprisoned, but Abu Hanifah said the creditor may pursue him, based on the statement: “The one with a right has authority and speech,” meaning authority refers to pursuit and speech to demanding. This is derived from Nail Al-Awtar and Al-Hidayah.

اور ابوودا ورنسائی کی روایت میں اس طرح ہے کہ نبی کریم صلی اللہ علیہ و آلہ وسلم نے ارشاد فرمایا ہے کہ مالدار (یعنی جو شخص قرض ادا کرنے کی استطاعت رکتا ہے لیکن ادالہ قرض میں) دریکرتا ہے اور ثال مطلوب کرتا ہے تو (قرض دینے والے کسی بیجا نزہوجاتا ہے کہ اس کو بآبرو کرے یا مزا دے اب مبارک رحمۃ اللہ نے کہا ہے کہ بآبرو کا مطلب یہ ہے کہ اس کو شرم دلانے کیلئے) سخت ست کہا جاتے اور مزا ہے مراد یہ کہ اس کو قید کروا یاجاتے۔

It is narrated on the authority of Abu Wada Waransai that the Noble Prophet ﷺ said:

If a person who has the means to repay a debt (but delays repayment) and demands more time, then (the lender should not seek any additional benefit or favor from him, as) Mubarak (RA) said that 'seeking benefit' means to make him feel ashamed, and 'favor' means to imprison him.

قطعنی اور ابن عدی کی روایت میں اس طرح ہے کہ نبی کریم صلی اللہ علیہ و آلہ وسلم نے ارشاد فرمایا ہے کہ صاحب حق یعنی قرض دینے والے کسیے جاتزنہ کروہ (قرض لینے والے کے خلاف) اپنے اتحداورا پنی زبان کواستعمال کرے۔

مقروض کی حالتون کے اعتبار سے قرض وصول کرنے کے طریقے

ف: اس حدیث شریف میں ارشاد ہے کہ مقروض مالدار ہونے کے باوجود قرض ادا کرنے میں ثال مطلوب کرے تو اس کی بآبرو کرنا اور اس کومزا دینا جائزہے۔

اس حدیث سے ثابت ہوتا ہے کہ مقروض باوجوداستطاعت کے قرض ادا کرنے میں دریکرے تو اس کو قید کروا یا جا سکتا ہے بلکہ مقروض مالدار نہو اور تگلدست ہوتاس کی بآبرو کرنا اور اس کومزا ادلوا نادرست نہیں۔ بلکہ اس کومہلت دینا چاہئے اور مالدار مقروض کو قرض کی ادائیگی مجبور کیا جاتا ہے۔ قید کروا نا احتیاط اور حضرت زید بن علی رضی اللہ عنہم کے پاس جاتے ہے اور جبہو را تمہ کا قول یہ ہے کہ حاکم وقت مقروض کی جانب اکفر وخت کر دے جسیا کہ حضرت معاذ رضی اللہ عنہ کی حدیث سے جو صدر میں گزری ہے ثابت ہوتا ہے اور اسیا مقروض جو تگلدست ہوتا اس بارے میں جبہو را تمہ کا قول یہ ہے کہ اس کو قید کروا یا جا یکن ابوحنیفہ رحمۃ اللہ علیہ نے فرمایا ہے کہ ایے مقروض کے ساتھ ساتھ قرض دینے والا لگا رہے اور زبان سے تقاضا کرتا ہے چنانچہ ذکورہ حدیث میں حضور صلی اللہ علیہ وآلہ وسلم کے ارشاد "

لصاحب الحق اليد و اللسان " سے میں مراد ہے۔(ثعل الاوطار، بدایہ)

قرض ارکو مہلت دینے کا ثواب

It is narrated from Qutaybah and Ibn Adi that the noble Prophet ﷺ said:

The one with the right, meaning the creditor, should use his hand and tongue against the debtor. In the case of the debtor, if he is wealthy but delays repayment, it is permissible to show him respect and give him respite. This hadith establishes that if a debtor, despite being capable, delays repayment, it is permissible to imprison or punish him. However, if the debtor is wealthy and evasive, it is not incorrect to show him respect and give him respite; rather, he should be given leniency, and the wealthy debtor should be compelled to repay the debt. Imprisonment is a matter of precaution, as per the view of Zayd bin Ali (RA). His opinion is that the ruler of the time should grant a reasonable period to the debtor, as is established from the hadith of Mu'adh (RA) mentioned earlier. Regarding the evasive debtor, the opinion is that he should be imprisoned or punished, but Abu Hanifah (RA) said that the creditor should remain with the debtor and demand repayment verbally. The meaning of the noble Prophet's ﷺ statement in the aforementioned hadith, 'Let the one with the right use his hand and tongue,' is intended.

عمران بن حسین رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم ارشاد فرما ہے ہیں کہ جس شخص کا کسی پر کوئی حق ہو (جسے قرض وغیرہ اور وہ اس کی وصیت ) میں (قرض دار کی حالت کے اعتبار سے) اس کو مہلت دے تو ہر دن (اس مہلت کے بدلے) صدقہ ہوگا (یعنی ہر دن اس مہلت کے معاوضہ میں اس کو نیما ملتی رہیں گی)۔ اس کی روایت امام احمد نے کی ہے۔ مسلما نوں کا باہم ایک دوسروں کی مدد کرنا مشروع ہے ف : نذکورہ احادیث ثبوت یفہ میں قرض دار کو مہلت دینے والے کو جس اجر اور فضلیت کی خوشخبری دی گئی ہے اس بارے میں صاحب نعل الاوطار نے فرما یا ہے کہ آن اور احادیث کی رو سے مسلما نوں کا آپس میں ایک دوسروں کی ضرورت کا رفع کرنا، حاجت کو پورا کرنا، تکلیف کا رفع کرنا اور فاقہ میں کھانا کھلانا مشروع ہے اور ان کا ثواب ہے اس لئے کہ ان کی فضلیت میں جا بجا قرض آن میں ترغیب اور احادیث ثبوت یفہ میں تاکید وارد ہوئی ہے۔ تاکید ست سے وصیت قرض میں نزیکر نے کا اجر

‘Imran ibn Husayn (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever has a claim against someone, and he delays it, he will have the reward of charity for each day.” [Narrated by Ahmad]

(1) The statement: “He will have the reward of charity for each day”: There are hadiths on the virtue of lending, and the general Qur’anic and hadith evidence on the merit of helping, fulfilling a Muslim’s need, relieving his distress, and meeting his needs encompass this. There is no disagreement among Muslims regarding its legitimacy. This is stated in Nail Al-Awtar.

ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ نبی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یا کہ ایک شخص لوگول کو قرض دیا کرتا تھا اور اس پچ کارندہ سے کہا کرتا تھا کہ جب تم (قرض وصول کرنے) کسی تاگد ست کے پاس جاؤ تو (ناداری کی وجہ سے) اس سے درگز رکیا کر ممکن ہے کر اللہ تعالیٰ (اس کی وجہ سے) تم سے درگز رفرما ہے، اس شخص کا انتقال ہوگیا تو اللہ تعالیٰ نے اس کے اس عمل (کی برکت) سے اس سے درگز رفرما دیا (یعنی گناہوں کو معاف فرما دیا اس حدیث ثبوت یف سے معلوم ہوا کہ جو ملوق پر تم کرتا ہے اللہ تعالیٰ مجی اس پر تم فرما تے ہیں)۔

اس حدیث کی روایت بخاری اور مسلم نے متفق طور پر کی ہے۔

دوسری حدیث

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “There was a man who lent to people and would say to his servant: ‘When you come to an insolvent person, overlook him, perhaps Allah will overlook us.’ He met Allah, and Allah overlooked him.” [Agreed upon]

ابوقادہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ

وآلہ وسلم ارشاد فرماتے ہیں کہ جس کسی کو بی بات پسند ہو کہ اللہ تعالیٰ اس کو قیامت کی شدتون سے

پاچے تو اس کو چاہے کرا لے مقروض کو جوئگد ستہول مہلت دے (یعنی وصول قرض میں جلدی

نہ کرے) یا پھراس کو (قرض کی ادائیگی سے جزوی یا کلی طور سے) معاف کر دے اس کی روایت

مسلم نے کی ہے۔

تیسری حدیث

Abu Qatadah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever is pleased that Allah saves him from the distress of the Day of Resurrection, let him relieve an insolvent person or waive part of his debt.” [Narrated by Muslim]

ابوقادہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میں نے رسول اللہ

صلی اللہ علیہ وآلہ وسلم کو ارشاد فرماتے سنا ہے کہ جو شخص (قرض کے وصول کرنے میں) مفلس کو

مہلت دے یا (جزءاً یا کلًا اس کے قرض کو) معاف کر دے تو اللہ تعالیٰ اس کو روز قیامت کی شدتون

سے پاچے گا۔

اس کی روایت مسلم نے کی ہے۔

چوتھی حدیث

From him, he said: I heard the Messenger of Allah (ﷺ) say: “Whoever grants respite to an insolvent person or waives part of his debt, Allah will save him from the distress of the Day of Resurrection.” [Narrated by Muslim]

ابویسر رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میں نے نبی کریم صلی

اللہ علیہ وآلہ وسلم کو ارشاد فرماتے سنا ہے کہ آپ فرمایا کرتے تھے کہ جو شخص کسی مفلس کو مہلت دے یا

(جزءاً یا کلًا اس کے قرض کو) معاف کر دے تو اللہ تعالیٰ اس کو اپنے (عرش کے) ساپین جگردے

گا (جس دن کوئی اور ساپینہ ہوگا) اس کی روایت مسلم نے کی ہے۔

ان مسائل کا بیان حسن میں نوافل فرائض پر فضیلت رکھتے ہیں

ف: واضح ہو کہ فرائض نوافل پر ستر (70) درج فضیلت رکھتے ہیں لیکن بعض مسائل ایسے ہیں جن میں

نوافل فرائض پر فضیلت رکھتے ہیں۔ مثلًا مفلس کو جزءی یا کلی طور پر قرض سے معافی دے دیا مستحب ہے اور قرض کی

اورتی میں مہلت دیاواج ب ہے۔ اگر کوئی شخص مقروض کو معافی دے دے تو یا مرستحب فضیلت رکھتا ہے مہلت دینے

پر جزوی اجب ہے۔ (2) سلام کی ابتدا مستحب ہے اور سلام کا جواب دینا فرض ہے۔ یہاں کچھ سلام میں پہل کرنے فضل

ہے جواب دینے پر حالاً کہ سلام کا جواب دینا فرض ہے اس لیے کہ سلام میں پہل کرنا تو اضع کی علامت ہے اور جو اضع

کرتا ہے اللہ تعالیٰ اس کو بلند فرماتے ہیں۔ (3) وقت نماز سے پہلے وضو کرنا مستحب ہے اور جب نماز کا وقت شروع

ہوجاتے تو وضو کرنا فرض ہے۔ یہاں کچھ نماز کے وقت سے پہلے وضو کرنا فضل ہے وقت نماز کے شروع ہونے پر وضو کرنے

سے جو فرض ہے۔ نکوہ بالا تینوں امور میں نوافل اور مستحبات فرائض اور واجبات پر فضیلت رکھتے ہیں۔ (مرقات)-

Abu Al-Yusr (may Allah be pleased with him) narrated: I heard the Prophet (ﷺ) say: “Whoever grants respite to an insolvent person or waives part of his debt, Allah will shade him under His shade.” [Narrated by Muslim]

پانچویں حدیث

کعب بن مالک رضی اللہ عنہ سے روایت ہے کہ انہوں نے رسول اللہ صلی اللہ

علیہ وآلہ وسلم کے زمانے میں مسجد نبوی میں ابن ابی حدرد رضی اللہ عنہ سے اپنے قرض کا تقاضا کیا اور

(گفتگو میں) دونوں کی آوازیں بلند ہو گئیں۔ یہاں تک کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ان

آوازوں کو سن لیا جب کہ آپ اپنے حجرے مبارک میں تھے۔ اس میں حضور صلی اللہ علیہ وآلہ نے اپنے

حجرے سے نکلے۔ باہر آنے کا ارادہ فرمایا اور پڑھے ہٹا کر کعب بن مالک کو آواز دی، کعب رضی اللہ عنہ نے

عرض کیا: یا رسول اللہ صلی اللہ علیہ وآلہ! میں حاضر ہوں! تو حضور صلی اللہ علیہ وآلہ کے اشارے سے بتایا کہ اپنا آواز

قرض معاف کرو، کعب نے فرمایا یا رسول اللہ! میں نے معاف کر دیا (اور آپ کے حکم کی تتمیل کر دی)

پیش کر رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ابن ابی حدرد سے فرمایا کہ تم بقیہ قرض فوراً ادا کرو!

اس کی روایت بخاری اور مسلم میں مستقیم طور پر کی ہے۔

ف: اس حدیث ثریفے حسب ذیل مسائل معلوم ہوتے ہیں:

(1) قرض کے تقاض میں شدت نہیں کرنا چاہیے -

(2) اپنے سے قرض دار کی حالات کے اعتبار سے جزء آیا کلا و ستبردار ہونا چاہیے -

(3) ایسے امور میں سفارش جائزہ ہو فیشرعی نہ ہو - (مرقیت اوراشتعالمعات)

دو تین صفات جودخل جنت سے روکتے ہیں

Ka‘b ibn Malik (may Allah be pleased with him) narrated that he demanded a debt owed to him by Ibn Abi Hadrad in the mosque during the time of the Messenger of Allah (ﷺ). Their voices rose until the Messenger of Allah (ﷺ) heard them while he was in his house. He came out to them, lifted the curtain of his room, and called out to Ka‘b ibn Malik, saying: “O Ka‘b!” He replied: “At your service, O Messenger of Allah!” He said: “Waive part of your debt,” gesturing to waive half of it. Ka‘b said: “I have done so, O Messenger of Allah.” He said: “Get up and pay him.” [Agreed upon]

(1) The statement: “He demanded from Ibn Abi Hadrad”: This indicates that leniency and demanding payment do not coexist, as the creditor is entitled to demand his debt. Ibn Battal said: It shows the permissibility of raising voices in the mosque if it is not excessive, due to the absence of disapproval. It also permits relying on gestures, which are equivalent to speech if understood, so the oath, testimony, and contracts of a mute person are valid if understood. It indicates the judge gesturing toward reconciliation as guidance. Here, reconciliation occurred with mutual acknowledgment, as their dispute was not about the debt but about demanding it. Reconciliation with denial is permitted by Abu Hanifah and Malik, and it is the view of Al-Hasan, but Ash-Shafi‘i and Ibn Abi Layla said it is invalid. It also indicates persistence in demanding payment, intercession with the creditor, reconciling between disputants, and mediating well between them, accepting intercession in non-sinful matters, and lifting curtains at the room. This is stated in Umdat Al-Qari.

ثوبان مولی رسول اللہ صلی اللہ علیہ وآلہ وسلم سے روایت ہے وہ فرماتے ہیں

کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم میں کہ جو شخص اس حالت میں وفات پائے کہ وہ کبراور غرور سے

بری ہو ( کبر یہ کہ حق کو قبول نہ کرے اور لوگوں کو حقیر سمجھے )اور خیانت سے اس کا امن پائے ہو

اور وہ کسی کا قرض دار نہ ہو تو ایس شخص جنت میں داخل ہوگا ( اس سے معلوم ہوا کہ یہ تینوں صفات

( دخول جنت سے منع ہیں ) اس حدیث کی روایت ترمذی، ابن ماجہاور دارمی نے کی ہے -

قرض کی رقم کو اضافے کے ساتھ واپس کرنے کی جائزصورت

Thawban (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever dies free of arrogance, misappropriation, and debt will enter Paradise.” [Narrated by At-Tirmidhi, Ibn Majah, and Ad-Darimi]

مجاهد رحمہ اللہ سے روایت ہے وہ کہتے ہیں کہ عبد اللہ بن عمر رضی اللہ عنہما نے

ایک صاحب سے چند درہم قرض لیا اور مقرر وقفہ درہم سے زیادہ واپس کیے ان صاحب نے

( اس خیال سے کہ میں پیسودہ ہو جاؤں ) کہا میں نے جتنے درہم قرض دیے تھے پیوان سے زائد

میں حضرت ابن عمر نے فرما ئیں کہ اس کو جانتا ہوں لیکن میں پیاضافہ درہم تم کو ( بلاشرط )بخشی

دے رہا ہوں اس کی روایت امام محمد نے اپنی موافقت میں کی ہے اور کہا ہے کہ حضرت ابن عمر کے قول

کو اختیار کرتے ہیں اور پیمانے قرض کی رقم سے زائد رقم واپس دینا جب کہ بغیر شرط کے ہوا س میں کوئی

حرج نہیں ہے اور امام ابو حنیفہ رحمۃ اللہ کہتے ہیں کہ قول ہے -

دومری حدیث

Mujahid narrated that ‘Abdullah ibn ‘Umar (may Allah be pleased with him) borrowed some dirhams from a man and repaid him with better ones. The man said: “These are better than the dirhams I lent you.” Ibn ‘Umar said: “I know, but my soul is content with it.” [Narrated by Muhammad in his Muwatta]

He said: We follow the saying of Ibn ‘Umar: There is no harm in it if it is without a stipulated condition. This is the view of Abu Hanifah (may Allah have mercy on him).

(1) The statement: “He repaid with better ones”: The hadith of Abu Rafi‘ also indicates that if someone borrows something and returns something better or more without a condition, it is an act of kindness, and it is permissible for the lender. It permits lending animals, which is the view of Malik and Ash-Shafi‘i. Abu Hanifah’s view is that it is not permissible. His evidence includes what the Imams narrated from Ibn ‘Abbas that the Prophet (ﷺ) prohibited selling animals for animals on credit, and from Jabir that the Messenger of Allah (ﷺ) saw no harm in selling animals, two for one, but disliked credit. From Ibn ‘Umar, the Prophet (ﷺ) prohibited selling animals for animals on credit, and similarly from Samurah. At-Tahawi narrated it in Ma‘ani Al-Athar. Abu Ja‘far said: This abrogates what we narrated from the Messenger of Allah (ﷺ) permitting the sale of animals for animals on credit, including borrowing animals. In Al-‘Urf Ash-Shadhi, Abu Hanifah said: Lending is only permissible for fungible items, i.e., measured or weighed. Ash-Shafi‘i said: Borrowing animals is permissible like forward sales, with clear specification to avoid disputes. Ash-Shafi‘i has the hadith of Abu Rafi‘, while we have the general prohibition against selling animals for animals on credit. The incident in Abu Rafi‘’s hadith is a specific case. If it is said that the prohibition applies to sales, not loans, I say: Their basis is the same. The context of Abu Rafi‘’s hadith, in my view, is that he bought a camel for a deferred price and gave camels in place of that price, so the narrator expressed it this way. Such transactions are common in our time. This is derived from Badhl Al-Majhud.

(2) The statement: “There is no harm in it”: Meaning, repaying a debt with something better than what was taken. This is stated in At-Ta‘liq Al-Mumajjad.

اپوہریرضی اللہ عنہ روایت ہے کراپ ک شخص نے (جس سے رسول اللہ صلی اللہ علیہ وآلہ وسلم نے اپاونٹ بطور قرض لیا تھا) آپ سے تقاضا کیا اوراس میں شدت اور تخت کی (رسول اللہ صلی اللہ علیہ وآلہ وسلم کے مقابلے میں اس کے اس رویکود کی کر صحابہ کرام رضی اللہ عنہم (اس کو مارنے کے ارادہ تے) اے، حضرت صلی اللہ علیہ وآلہ وسلم نے ان لوگوں سے فرمايتم لوگ اس کو اس طرح نہ دھکاواس لے کہ حقا رکوخت ست کینہ کا حن بے پڑر (حضرت علیؓ صحابہ اکرام سے خطاب ہوکر) فرماتے اس کو اپاونٹ خرید کر دے دوسحابہ رضوان اللہ علیہم اجمعین نے عرض کیا (یا رسول اللہ ! تم تو دین کے لے تیار ہیں لیکن) اس وقت ہمارے پاس جواونٹ نہیں وہ اس کے (دیہوئے) اونٹ سے عمر میں برے (اوربہتر) ہیں حضرت علیؓ ارشاد فرماتے (کوئی حرج نہیں) انہیں میں سے اپاونٹ خرید کر دے دو (اورپایا رکھو) کہ بہتر آدی وہی بے جو (اپے قرض کو) خوبی کے ساتھ ادا کرے۔ اس کی روایت بخاری اورمسلم میں متفق طور پرکی ہے۔ ف: واشہوکا س واقعت حضرت صلی اللہ علیہ وآلہ وسلم کے کمالی خلق اورانصاف پسندی اورعدل کا ثبوت ملتا ہے جو دلیل ہے آپ کے پغمبر حق ہو نے کی چناچھا س واقعے وہ شخص مسلمان ہوگیا اس حدیث سے دومری بات یہ معلوم ہوتی ہے کہ قرض میں لی ہوئے مال سے اچھا مال دینا مستحب ہے بلکہ زائد مال بھی دیا جاسکتا ہے بشرط کہ زیادتی کے لے کوئی شرط نہ کی گئی ہو ورنہ وہ سودہو جائے گا۔ تو لے وقت جعلتا تولنا چاہیے

Abu Hurairah (may Allah be pleased with him) narrated that a man demanded a debt from the Messenger of Allah (ﷺ) and was harsh with him. His companions intended to intervene, but he said: “Leave him, for the one with a right has a say. Buy a camel for him and give it to him.” They said: “We only find one better than his age.” He said: “Buy it and give it to him, for the best of you is the one who repays best.” [Agreed upon]

سوید بن قس رضی اللہ عنہ روایت ہے انہول نے بیان کیا کہ میں اور مخزف عبدی مقام "بجر" (ایک مقام جو مدینہ منورہ کے قریب ہے) سے (پچھے کے لے) پچھے

پڑھنے لے کر کہ معظّم پیو پچ تو رسول اللہ صلی اللہ علیہ وآلہ وسلم چلتے ہوئے ہمارے پاس

تشریف لاگے اور ہم سے شلوار کا معاملہ فرمایا اور ہم نے اس کو آپ کے باٹھنے دیا ہمارے بان

تو لے والا ایک ملازم تھا (حضرت صلی اللہ علیہ وآلہ وسلم نے اس شلوار کی قیمت کے معاوضہ میں جو

جنس تول میں دی تو فرمایا لے تو لے وا لے) زرا جھلنا تول (تا کر فریق ثانی کوفا نہ پہوچے) اس

سے معلوم ہوا کہ تولے وقت جعلتا تو لنا چاہے)۔

اس حدیث کی روايت امام احمد، البوداود، ترمذی، ابن ماجا ورداری نے کی ہے اور ترمذی نے

کہا ہے کہ یہ حدیث گھے ہے۔

قرض کی رقم اضافے کے ساتھ واپس کرنا جائز ہے

Suwayd ibn Qays narrated: I and Makhramah Al-‘Abdi brought barley from Hajar and came with it to Makkah. The Messenger of Allah (ﷺ) came to us walking and bargained with us for trousers, so we sold them to him. There was a man weighing for a wage, and the Messenger of Allah (ﷺ) said to him: “Weigh and add more.” [Narrated by Ahmad, Abu Dawud, At-Tirmidhi, Ibn Majah, and Ad-Darimi. At-Tirmidhi said: This hadith is good and authentic]

(1) The statement: “He bargained with us for trousers, so we sold them to him”: There is disagreement about him wearing trousers. Some denied it, citing that ‘Uthman did not wear them on the day he was killed, but it is confirmed that he purchased them. Ibn Al-Qayyim said: It appears he wore them, and they used to wear them in his time. This is stated in Al-Marqah.

جابر رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ نبی کریم صلی اللہ علیہ و

آلہ وسلم پر میرا پچھا قرض تھا (اور جب حضرت علیؓ نے ادا کرنا چاہا) تو آپ نے میرا پورا قرض ادا فرما

دیا بلکہ پچھا زا ڈے عطا فرمایا اس کی روایت البوداود نے کی ہے۔

قرض لینے والے اور قرض دینے والے ادائیگی کے موقع پر سطرح دعا کریں

Jabir (may Allah be pleased with him) narrated: I had a debt owed to me by the Prophet (ﷺ), and he paid me and gave me extra. [Narrated by Abu Dawud]

عبد اللہ بن ابی ربعیہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ (غزوہ

حنین کے موقع پر) نبی کریم صلی اللہ علیہ وآلہ وسلم نے مجھے سے چاپیس ہزار درہم قرض حاصل

فرماتے اور جب آپ کے پاس مال آگیا تو حضرت نے میرا قرض ادا فرمادیا اور یہ دعا کہتے

وبارک اللہ تعالیٰ فی اہلک ومالک“(اللہ تعالیٰ تیرے ابل وعیال اور مال میں برکت

دوے)اور یہی فرمایا کہ قرض کا بدل شکریا اور قرض کا ادا کرنا ہے (قرض دار کی دعا سننے کے بعد

قرض دینے والا پول جواب دے کر تم نے میرا پورا قرض ادا کر دیا اللہ تعالیٰ تم کو پورا پورا حق

دیوے)۔ اس حدیث کی روایت البوداود نے کی ہے۔

صاحب استطاعت کا اولی قرض میں وبرکرنا گناہ ہے

‘Abdullah ibn Abi Rabi‘ah (may Allah be pleased with him) narrated: The Prophet (ﷺ) borrowed forty thousand from me. When wealth came to him, he paid me and said: “May Allah, the Exalted, bless your family and wealth. The reward for a loan is praise and repayment.” [Narrated by An-Nasa’i]

ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا ہے کہ مالدار کا (اپنے قرض کی) ادائیگی میں (باوجود استطاعت کے) وبرکرنا ظلم ہے (اور حرام ہے) اور کوئی (تنگدست قرض دار (اپنا قرض ادا نہ کرسکے اور) کسی مالدار کا حوالہ دیدے تو قرض دار کو چاہے کر (اس حوالے کو) قبول کر لے اس کی روایت مسلم اور بخاری نے متفق طور پر لی ہے۔ ف: واضح ہوگا کہ حوالہ قبول کرنے کی ایک مثل یہوسکتی ہے کہ زید نے بکرے قرض لیا اور زید مالدار ہے اور ایک تیسرے شخص نے بکرے قرض لیا اور بکرے نے اپنے قرض کا مطالبہ کیا تو اگر بکرے نے قرض کا حوالہ زید پر دیا جس کا وہ مقروض ہے تو ایسی صورت میں تیسرے شخص کو چاہے کر دوہ اس حوالے کو قبول کر لے بشرط یہ زیرمجی اس حوالے کو مان لے۔ (ترنڈی)

اولی قرض کے لئے مزروکہ نے چھوڑ کر مر نے کی وعید

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “The delay of a wealthy person is injustice. If one of you is referred to a solvent person, let him follow.” [Agreed upon]

(1) The statement: “Let him follow”: An-Nawawi said: The view of our companions and the majority is that the command is for recommendation. Some said it is for permissibility, and others said it is obligatory. This is stated in Al-Marqah and Umdat Al-Qari.

سلمہ بن اکوع رضی اللہ عنہ سے روایت ہے وہ فرما تے ہیں کہ ہم (ایک دفعہ) نبی کریم صلی اللہ علیہ وآلہ وسلم کی خدمت میں بیٹھے تھے کہ ایک جنازہ لاگیا صحابہ نے عرض کیا یا رسول اللہ اس کی نماز پڑھادتے ہیں رسول اللہ صلی اللہ علیہ وآلہ وسلم نے دریافت فرمایا کہ اس پر کوئی قرض تو نہیں ہے صحابہ کرام نے عرض کیا نہیں (یا رسول اللہ صلی اللہ علیہ وآلہ وسلم نے اس کی نماز جنازہ پڑھادی۔ تحورثی دیر بعد ایک اور جنازہ لاگیا حضور صلی اللہ علیہ وآلہ وسلم نے پھر ہی دریافت فرمایا کہ یہ مقروض تو نہیں؟ عرض کیا گیا ہیں! مقروض تو ہے! اس پر آپ صلی اللہ علیہ وسلّم نے دریافت فرمایا کر (اولی قرض کے لئے) کچھ چھوڑ کر مر ہے؟ صحابہ نے عرض کیا ہیں! تین دینار (چھوڑ کر انتقال کیا ہے!) یعنی کرآپ صلی اللہ علیہ وسلّم نے اس کی نماز جنازہ پڑھادی۔ چھوڑی دیر بعد ایک اور جنازہ لاگیا آپ نے وہی سوال فرمایا کہ یہ مقروض تو نہیں ہے!

صحابہ نے عرض کیا جو بالی مقروض ہے! آپ نے پھر دریافت فرمایا (ادائی قرض کے لئے) اس

نے پھر ججوڑا ہے۔ صحابہ نے عرض کیا نہیں یارسول اللہ! پس کرآ پے وسے صحابہ سے فرمایا کہ تم

اپنے دوست کی نماز جنازہ پڑھو۔ پس کر ابوقتادہ رضی اللہ عنہ نے عرض کیا: یارسول اللہ! آپ

اس کی نماز جنازہ پڑھ دیتے میں اس کا قرض ادا کر دوں گا۔ پس کرآ پے وسے نے اس کی نماز جنازہ

پڑھ دی۔ اس کی روایت بخاری نے لکھے۔

ف: اس حدیث شریف سے معلوم ہوتا ہے کہ مقروض ہو کر مرنا ادائی کے لئے پچھڑ کھنا بہت برائے اوراس کی

وعید ہے۔

جو خصوصاً مسلمان بھائی کا قرض ادا کرے اللہ تعالیٰ اس کو قیامت کی مشقتیں سے پچادے گا

Salamah ibn Al-Akwa‘ (may Allah be pleased with him) narrated: We were sitting with the Prophet (ﷺ) when a funeral was brought, and they said: “Pray over it.” He said: “Does he have any debt?” They said: “No.” He said: “Did he leave anything?” They said: “No.” So he prayed over it. Then another funeral was brought, and they said: “O Messenger of Allah, pray over it.” He said: “Does he have any debt?” They said: “Yes.” He said: “Did he leave anything?” They said: “Three dinars.” So he prayed over it. Then a third was brought, and they said: “Pray over it.” He said: “Did he leave anything?” They said: “No.” He said: “Does he have any debt?” They said: “Three dinars.” He said: “Pray over your companion.” Abu Qatadah said: “Pray over him, O Messenger of Allah, and his debt is on me.” So he prayed over it. [Narrated by Bukhari]

(1) The statement: “And his debt is on me”: This refers to guaranteeing the debt of a deceased person. Ibn Battal said: Scholars differed on someone guaranteeing a debt for a deceased person. Ibn Abi Layla, Muhammad, Abu Yusuf, and Ash-Shafi‘i said: Guaranteeing is permissible for him, even if he left nothing to cover it, based on this hadith. Abu Hanifah said: If the deceased left nothing, guaranteeing is not permissible, but if he left something, it is permissible to the extent of what he left. The response to the hadith is that it may refer to a prior guarantee, as the wording of acknowledgment and initiation in guaranteeing is the same, and the narration of an act is not general. It may also be abrogated, as its abrogation became clear to him. The hadith of Abu Hurairah, which comes later, indicates abrogation, where he said: “I am more entitled to the believers than themselves. Whoever dies among the believers and leaves a debt, its repayment is on me, and whoever leaves wealth, it is for his heirs.”

In the narration of Abu Hazim from Abu Hurairah, the Prophet (ﷺ) said: “Whoever leaves a burden, it is to me, and whoever leaves wealth, it is for the heir.” Abu Bishr Yunus ibn Habib said: I heard Abu Al-Walid say: This abrogates those hadiths about not praying over someone with debt. Ibn ‘Abbas said: The Messenger of Allah (ﷺ) did not pray over someone who died with debt. A man from the Ansar died, and they said: “He has a debt.” He said: “Pray over your companion.” Then Jibril descended and said: “Allah, the Mighty and Sublime, says: The oppressor in debts is with Me for debts taken in transgression, extravagance, and sin. As for the chaste person with dependents, I guarantee to pay on his behalf.” So he prayed over him and said afterward: “Whoever leaves loss or debt, it is to me or on me, and whoever leaves sustenance, it is for his family.” He prayed over them. It may be said that it was not a guarantee but a promise to pay his debt. When the Messenger of Allah (ﷺ) knew the promise was true, he prayed, as the obstacle was lifted. This is derived from Umdat Al-Qari, Al-Luma‘at, and Bahr Ar-Ra’iq. In Ad-Durr Al-Mukhtar, it is stated: Guaranteeing a debt for a bankrupt deceased is not valid according to him, but the three others validated it absolutely, and if someone voluntarily undertakes it, it is valid by consensus.

ابوسعید خدری رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ (اکیو فرم)

رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں ایک جنازہ لا گیا تاکہ آپ صلی اللہ علیہ وسلم پر نماز جنازہ پڑھیں

آپ صلی اللہ علیہ وسلم نے دریافت فرمایا کہ کیا اس پر کوئی قرض ہے؟ عرض کیا گیا جی بال! پھرآ پے وسے نے

ارشاد فرمایا اس نے اتنے مال ججوڑا ہے جس سے اس کا قرض ادا ہو جائے۔ صحابہ نے عرض کیا نہیں

(یارسول اللہ!) اس پرآ پے وسے نے فرمایا تم ہی اپنے دوست کی نماز جنازہ پڑھ لو (پیدیکر)

حضرت علی ابن ابی طالب رضی اللہ عنہ نے عرض کیا اس کا قرض ادا کرنا میرے ذمہ ہے! (پس کر)

حضرت علی صلی اللہ علیہ وسلم نے پھر ہی اوراس کی نماز جنازہ پڑھادی۔

Abu Sa‘id Al-Khudri (may Allah be pleased with him) narrated: A funeral was brought to the Prophet (ﷺ) to pray over it. He said: “Does your companion have any debt?” They said: “Yes.” He said: “Did he leave anything to cover it?” They said: “No.” He said: “Pray over your companion.” ‘Ali ibn Abi Talib (may Allah be pleased with him) said: “His debt is on me, O Messenger of Allah.” So he stepped forward and prayed over it. In another narration with the same meaning, he said: “Allah has freed your pledge from the Fire, just as you freed your Muslim brother’s pledge. No Muslim servant pays his brother’s debt except that Allah frees his pledge on the Day of Resurrection.” [Narrated in Sharh As-Sunnah]

ایک اور روایت ہے اس کے تمام معنی ہے اوراس میں بھی مضموں زیادہ

ہے (حضرت علی کا قول سن کر) رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: اے علی! جس طرح تم نے

اپنے بھائی کو قرض کے بوجہے آزاد کیا ہے اللہ تعالیٰ تم کو بھی دوزخ کی آگ سے پچادے! (پھر

فرمايا) جو مسلمان بنده اپنے بھائی کا قرض ادا کرے گا اللہ تعالیٰ اس کو قیامت کے دن سختیوں سے

پاچے گا۔ اس کی روایت ثرہ السنبل کی ہے۔

حضرت علیؓ کی اپنی امت پر شفقت و رحمت کا ایک ثبوت

ابوہریرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ

علیہ و آلہ وسلم کی خدمت اقدس میں جب کچھ کوئی جنازہ لا یا جاتا اور وہ مقرود ہوا کرتا تو

حضرت علیؓ یہ دریافت فرما لیتے کہ کیا شخص اپنے قرض کی ادائیگی کے لیے پچھے چھوڑ کر مراتے ہیں! اگر یہ

پیان کیا جاتا کر اس سے اتنامال چھوڑتا ہے جو قرض کی ادائیگی کے لیے کافی ہوتا آپ علیؓ اس کی نماز

جنائزہ پڑھ لیتے ورنہ آپ علیؓ صحاب کرامؓ سے فرماتے کہ تم اپنے بھائی کی نماز پڑھ لو پھر جب اللہ

تعالیٰ نے حضرت علی اللہ علیہ و آلہ وسلم پر مال غنیمت (کے دروازے) کھول دیا (اور کشاوگی

نصیب ہوئی) تو حضرت علیؓ نے منبر پر چڑھ کر یون خطبہ ارشاد فرما کر (سنو!) میں مسلما نوں کے

لیے ان کی جانوں سے زیادہ عزیز ہوں تو جو (نادار) شخص اس حالت میں مر جاتے کہ اس پر قرض

ہوتا اس کے قرض کو ادا کرے نہ کہ میں زیادہ زمردار ہوں اور جو شخص متروک چھوڑ کر مرے تو وہ مال اس

کے وارثوں کا ہوگا (پرتمہ للعالمین صلی اللہ علیہ و آلہ وسلم کا اپنی امت پرا کی برآ حسان اور کرم ہے

جس پر یامت جتنا فخر کرے کم ہے!)۔

اس حدیث کی روایت بخاری اور مسلمؓ نے متقق طور پر کی ہے۔

ف : اس حدیث میں ارشاد ہے کہ جونا دار شخص مقرود مرے تو میں اس کا کفیل ہوں۔ علامہ ابن بطال رحمۃ

اللہ علیہ نے فرما یا ہے کہ یہ حدیث نازک ہے اس حدیث کی جس میں ارشاد فرما یا گیا تھا کہ نادر شخص کی نماز جنازہ تم

لوگ ادا کر لو میں نہیں پڑھاونگا اور امام بخاری نے کچھ ترجیح الباب میں اس مضمون کا اشارہ کیا ہے جسیا کہ عمدہ

القاری میں نذکور ہے۔

اداکرنے کینیت سے قرض لیاجا لے تو قرض اداہو جاتاہے

Abu Hurairah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) was brought a deceased person with a debt, and he would ask: “Did he leave anything to pay his debt?” If he was told he left something to cover his debt, he prayed. Otherwise, he said to the Muslims: “Pray over your companion.” When Allah granted him conquests, he stood and said: “I am more entitled to the believers than themselves. Whoever dies among the believers and leaves a debt, its repayment is on me, and whoever leaves wealth, it is for his heirs.” [Agreed upon]

(1) The statement: “Leaves a debt, its repayment is on me”: In Umdat Al-Qari, Ibn Battal said: This abrogates his not praying over someone who died with a debt. I say: This is because he did not pray over them before the conquests. When Allah granted the conquests, he prayed over them, so this act abrogated his earlier act, as Ibn Battal said. Bukhari indicated this with the chapter title.

اللہ تعالیٰ قرض کومعاف نہیں فرماتے

ابوہریرہ رضی اللہ عنہ سے روایت ہے: وہ نبی کریم صلی اللہ علیہ وآلہ وسلم سے روایت فرماتے ہیں کہ آپ علیہ السلام نے ارشادفرمايا جولگون سے قرض لے اوراس کے اداکرنے کا ارادہ رکھتا ہوتا اللہ تعالیٰ (اس کی نیت کی خوبی کی مجحتے ) ادائی قرض کا سامان ( غیبت سے ) فرما دیتے ہیں۔اور جو شخص اس نیت سے قرض لے کہ اس کو ادا کرے گا تو اللہ تعالیٰ ( اس کی بد نيتي کی مجحتے ) اس کو بر باد کردیتے ہیں ( ادائی قرض میں اس کی اعانت نہیں فرماتے مجس کی مجحتے وہ نتو قرض ادا کر سکتا ہے اور نہ خوشحال رہ سکتا ہے )۔ اس کی روایت بخاری نے کی ہے۔

From him, the Prophet (ﷺ) said: “Whoever takes people’s wealth intending to repay it, Allah will repay it for him. Whoever takes it intending to waste it, Allah will destroy him for it.” [Narrated by Bukhari]

ابوقتادہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ صاحب نے عرض کیا یارسول اللہ صلی اللہ علیہ وآلہ وسلم ! اگر میں راہ خدا میں ایسی حالت میں شہید ہو جاؤں کہ ( میران جنگ میں ) ثابت قد م تھا ور ( لڑائی میں ) اللہ تعالیٰ میں تو اب کا طالب تھا ور آئے گے، میں براحتار باقی چھوکیں ہے تو کیا ایسی صورت میں اللہ تعالیٰ میرے سب گناہ معاف فرمادیں گے تو رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشادفرمايا ؐلا! ( یعنی کہ ) جب وہ صاحب واپس ہوئے نے گئے تو رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ان کوآوازدے کربلا یا ورقمایا سنو ءبال ( سارے گناہ تو اللہ تعالیٰ معاف فرمادیں گے ) مگر قرض ( جو حق العبارہ ہے وہ معاف نہ ہوگا ) اوریہی بات مجحتے جبریل نے ( ابطوروی کے ) کہی ہے۔ اس سے معلوم ہوتا ہے کہ حق العبارہ کی ادائیگی قدر اتم ہے )۔

اس حدیث کی روایت مسلم نے کی ہے۔

راہ خدا میں شہادت کی قرض کے بارکواذین کرستی

Abu Qatadah (may Allah be pleased with him) narrated: A man said: “O Messenger of Allah, if I am killed in the way of Allah, patient, seeking reward, advancing, not retreating, will Allah forgive my sins?” The Messenger of Allah (ﷺ) said: “Yes.” When he turned away, the Prophet (ﷺ) called him and said: “Yes, except for debt. That is what Jibril told me.” [Narrated by Muslim]

محمد بن عبد اللہ بن حبش رضی اللہ عنہما فرماتے ہیں کہ، تم (یعنی صحابہ کرام رضی اللہ عنہم ) مسجد نبوی کے محجن میں اس مقام پر بیٹھے ہوئے تھے جہاں جنازے (نماز جنازہ کے لیے)

رکے جاتے ہیں اور رسول اللہ صلی اللہ علیہ وآلہ وسلم ہمارے درمیان تشریف فرماتے یا کی آپ علیہ صلاۃ اللہ نے اپنی نظریں آسمان کی طرف انہیں اور (آسمان کی طرف پڑھی) ملاحظہ فرمایا اور نظریں پھر میں اور پیشانی پراپناپا تحریک کر (بطور حرارت اور استعجاب کے) فرمایاپاکے اللہ!

پاک اللہ! آج کس قدرتی نازل ہوتی ہے راوی کا بیان بے کر (پسن کر) تم ایک دن اور ایک رات خاموش رہے (اس انظار میں کر دیسی کیا کچھ پیش آتی ہے) لیکن تم کو بجز جلالی کے کوئی اور چیز نظر نہ آئی پیشانی تک کر (دوسرادن) ثروت ہوگیا راوی حدیث محمد بن عبد اللہ فرماتے ہیں کہ میں نے جرات کرکے رسول اللہ صلی اللہ علیہ وآلہ وسلم سے دریافت کیا کر حضرت! وہ کیا کچھ جس کا آپ صلی اللہ علیہ وسلم نے کل ذکر فرمایا تھا حضرت صلی اللہ علیہ وآلہ وسلم نے فرمایا سنو!(وہ کچھ) قرض کے بارے میں تھی! (یہ کہ کر آپ نے فرمایا) قسم جا اس ذات کی جس کے قبض میں محمد صلی اللہ علیہ وآلہ وسلم کی جان سے (ادائی قرض کی اتنی اہمیت ہے کہ) اگر کوئی شخص خدا کی راہ میں مارا جائے پھر زندہ ہو، پھر اللہ کی راہ میں شہید ہو پھر زندہ ہو، پھر اللہ کی راہ میں مارا جائے پھر زندہ ہو اور اس پر پھر قرض ہوتا ہی وہ (اتنی بار راہ خدا میں مارے جانے کے باوجود) اس وقت تک جنت میں داخل نہ ہوگا جب تک کہ اس کا قرض ادائی کر دیا جائے۔

اس کی روایت امام احمد نے کی ہے اور تشریح السنن میں کچھ اس طرح مردی ہے۔

دوسری حدیث

Muhammad ibn ‘Abdullah ibn Jahsh (may Allah be pleased with him) narrated: We were sitting in the courtyard of the mosque where funerals are placed, and the Messenger of Allah (ﷺ) was sitting among us. He raised his gaze to the sky, looked, then lowered his gaze and placed his hand on his forehead, saying: “Glory be to Allah, glory be to Allah, what a severe matter has descended.” We remained silent that day and night, not seeing any good until morning. Muhammad said: I asked the Messenger of Allah (ﷺ): “What is the severe matter that descended?” He said: “Regarding debt. By the One in Whose hand is Muhammad’s soul, if a man is killed in the way of Allah, then lives, then is killed in the way of Allah, then lives, and has a debt, he will not enter Paradise until his debt is paid.” [Narrated by Ahmad and in Sharh As-Sunnah similarly]

(1) The statement: “Where funerals are placed”: This indicates that they did not pray over funerals inside the noble mosque. This is stated in Al-Marqah.

عبداللہ بن عمر رضی اللہ عنہما سے روایت ہے کر رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا ہے کر شہید کے تمام گناہ بخش دیے جائیں گے مگر قرض معاف نہیں کیا جائے گا۔ قرضدار کی روح معلق رہتی ہے

ابوہریرہ رضی اللہ عنہ سے روایت ہے کر رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کر مومین کی روح معلق رہتی ہے (یعنی جنت میں داخل نہیں کی جائے) جب تک اس کا قرض ادا نہ ہوجائے۔ اس کی روایت امام شافعی، امام احمد، ترمذی، ابن ماجراور دار قطني نے لکھے ہیں۔ قرضدار موت کے بعد قید تہائی میں رکھا جاتا ہے

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “The soul of a believer is suspended by his debt until it is paid on his behalf.” [Narrated by Ash-Shafi‘i, Ahmad, At-Tirmidhi, Ibn Majah, and Ad-Darimi]

براء بن عازب رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کر رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا ہے کر قرضدار قیامت تک (اپنے قرض کی وجہ سے) محصور رہے گا۔ (یعنی صاحبین اور شفاعت کرنے والوں کی محبت سے دور رکھا جائے گا) جس کی وجہ سے وہ قیامت میں اللہ تعالیٰ سے اپنی تہائی (کی وحدت) کا شکوہ کرے گا۔ اس کی روایت ثرہ السنبلی نے لکھی ہے۔ میت کے قرض کی ادائیگی میراث کی تقسیم پر مقدم ہے

Al-Bara’ ibn ‘Azib (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “The one with a debt is imprisoned by his debt, complaining to his Lord of loneliness on the Day of Resurrection.” [Narrated in Sharh As-Sunnah]

سعید بن الاطول رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میرے بجاٹی کا انتقال ہوگیااور انہیں نے تین سودیناراورچحوڑے پیچھوڑے میں نے چاپا کر اس رقم کو پچول پر خرچ کر دول۔ رسول اللہ صلی اللہ علیہ و آلہ کو میرے اس ارادہ کا علم ہوا تو ارشاد فرمایا سنوتمہارا بجاٹی اللہ کے پاس اس قرض کے وجہ سے قید ہے انذا(پیلے) قرض ادا کردو چنانچہ میں نے جاکر سارا قرض ادا

کر دیا پھر حاضر خدمت ہو کر عرض کیا یارسول اللہ! میں نے اپنے بھائی کا سارا قرض ادا کروایا۔

البتہ ایک عورت باقی رہ گئی ہے جو دور بنارقرض بتائے لیکن اس کا کوئی گواہ موجود نہیں ہے تو حضرت

صلی اللہ علیہ وآلہ وسلم نے (بنظر اختیاط فرمایا) وہ چیز ہے (دورینار) اس کو ادا کرواس کی

روایت امام احمد نے کی ہے۔

ف: اس حدیث شریف سے معلوم ہوا کہ میت کا قرض ادا کرنا میراث کی تقسیم پر مقدم۔

کبیرہ گناہوں کے سواب سے برآگناہ مقروض ہو کر مرنا ہے

Sa‘id ibn Al-Atwal narrated: My brother died and left three hundred dinars and young children. I wanted to spend on them, but the Messenger of Allah (ﷺ) said to me: “Your brother is detained by his debt, so pay it on his behalf.” I went and paid it on his behalf, then came and said: “O Messenger of Allah, I have paid it on his behalf, and only a woman claiming two dinars remains, but she has no proof.” He said: “Give it to her, for she is truthful.” [Narrated by Ahmad]

(1) The statement: “My brother died and left three hundred dinars and young children, and I wanted to spend on them, but the Messenger of Allah (ﷺ) said: Your brother is detained by his debt, so pay it on his behalf”: For this reason, our Hanafi scholars said: Debt takes precedence over inheritance. This is stated in As-Siraji.

البموی اشعری رضی اللہ عنہ روایت ہے وہ بی کریم صلی اللہ علیہ وآلہ

وسلم سے روایت فرماتے ہیں کہ پعلیہ نے ارشاد فرمایا کہ ممنوع کبیرہ گناہوں کے بعد سب سے

برآگناہ اللہ کے پاس پیچ کہ بندہ اللہ تعالیٰ سے ایسی حالت میں مل کراس کا انتقال ایسی حالت

میں ہوا تو کراس پر قرض ہواوراس نے اتنامال نہ چھوڑا ہو جس سے اس کا قرض ادا ہوجائے۔

اس کی روایت امام احمداوراپوداور نے کی ہے۔

حرام چیزوں پر حاورناجا تزر اٹکا قبول کرنا ممنوع ہے

Abu Musa (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “The greatest sin a servant meets Allah with, after the major sins Allah prohibited, is that a man dies with a debt and leaves nothing to pay it.” [Narrated by Ahmad and Abu Dawud]

عمر و ابن عوف مرزی رضی اللہ عنہ حضرت بی کریم صلی اللہ علیہ وسلم روایت فرماتے ہیں

کہ حضرت صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ مسلماون کے درمیان نہ جائزہے کہ ایسے صح نہیں جوحلال کو حرام

اور حرام کو حلال کردے (مثال کوئی مالدار ہویی) اپنے مفلس شوہر پر پیداوار زوالے کر وہ دوسری

شادی نہ کرے اور حضرت صلی اللہ علیہ وسلم نے یہی فرمایا کہ )مسلماون پروا جب ہے کہ وہ اپنے ثروط نہیں عمدہ

کی پابندی کریں لیکن اپنی شرط ناجائزہے جوحلال کو حرام اور حرام کو حلال کردے۔(مثال کوئی شخص

کسی ضرورت مند کواس شرط پر قرض دے کرواپسی کے وقت اتنی رقم زاندا داکرے گا)۔اس کی روایت تزندی، ابن مجراورا بودا ودنے کی ہے۔ ف : اس حدیث کی مناسبت اس باب سے اس طرح سے کرآدمی عموماً غربت اور افلاس کی وجہ سے دب کر خلاف شرع شرائط کو لکرنے پرمجبور ہوجاتا ہے اور اس طرح صلح کے وقت بھی ہوا کرتا ہے لہذا دولت منداور صاحب اقتدار حضرات کو چاہئے کہ فرائض خلاف کی کمزوری سے ناجائز فاکده ناٹھا کیں اور ناس کو خلاف شرع امور پرمجبور کرنے۔

‘Amr ibn ‘Awf Al-Muzani (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Reconciliation is permissible among Muslims, except a reconciliation that prohibits something lawful or permits something unlawful. Muslims are bound by their conditions, except a condition that prohibits something lawful or permits something unlawful.” [Narrated by At-Tirmidhi, Ibn Majah, and Abu Dawud, and his narration ends at “their conditions”]

(1) The statement: “Reconciliation is permissible”: Mawlana Muhammad Yahya, the deceased, wrote from his teacher’s dictation: Ash-Shafi‘i said: Reconciliation with wealth in case of denial is not permissible, because if someone reconciles with part of his wealth, the remainder that the creditor waives remains in the other’s possession, which is unlawful for him. The response is that it is not unlawful after the creditor waives his right. The unlawful and lawful refer to what is supported by Shari‘ah. The unlawful remains unlawful even after reconciliation, or the lawful remains lawful after it and becomes prohibited by reconciliation. Here, it is not so, as the prohibition is only for wasting another’s right. When he permits it, it is no longer unlawful. Ash-Shawkani said: The apparent meaning of this wording is general, encompassing all reconciliations except what the Lawgiver exempted in this hadith. Whoever claims the impermissibility of reconciliation beyond what the Lawgiver exempted must provide evidence. Abu Hanifah, Malik, Ahmad, and the majority followed the general meaning. It is narrated in Bahr from Al-‘Itrah, Ash-Shafi‘i, and Ibn Abi Layla that reconciliation with denial is not permissible. Reconciliation that prohibits the lawful, such as a wife reconciling with her husband on the condition that he does not divorce her, marry another, or stay with her co-wife, or that permits the unlawful, such as reconciling for intercourse with a slave woman that is not permissible for him, or consuming wealth that is not lawful for him, or the like, is prohibited. This is stated in Badhl Al-Majhud. In Al-Luma‘at, it is said: The relevance of this hadith to the chapter is subtle, except that reconciliation is often related to bankruptcy.
