بَابُ أَكْلِ الْمُضْطَرِّEating out of Necessity
وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ( إِنَّمَا حَرَّمَ عَلَيْكُمُ ٱلْمَيْنَةَ وَٱلدَّمَ وَلَحْمَالْخِنزِيرِ وَمَآ أُهِلَّ بِهِ لِغَيْرِ ٱللَّهِ فَمَنِ ٱضْطُرَ غَيْرَ بَاغِ وَلَا عَادٍ فَلَاإِثْمَ عَلَيْهِ إِنَّ ٱللَهَ غَفُورٌ رَحِيمٌ وَقَوْلِهِ تَعَالَى: ( فَمَنِ ٱضْطُرَّفِي مَخْمَصَةٍ غَيْرَ مُتَجَانِفٍ لَإِثْمٍ فَإِنَّ اللهَ غَفُورٌ رَحِيمٌ ٣
Allah Almighty says: “He has only forbidden to you dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah. But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit], there is no sin upon him. Indeed, Allah is Forgiving and Merciful” (Qur’an 2:173). And: “But whoever is forced by severe hunger with no inclination to sin, then indeed, Allah is Forgiving and Merciful” (Qur’an 5:3).
وَعَنْ وَاقدٍ اللَّيْثيِّ أَنَّ رَجُلًا قَالَ: يَا رَسُوْلَ اللهِ، إِنَّا نَكُوْنُ بِأَرْضِفَتُصِيْبَنَا بِهَا الْمَخْمَصَةُ فَمَتَى يَحِلُّ لَنَا الْمَيْنَةَ؟ قَالَ:(مَا لَمْ تَصْطَبِحُوْا أَوْ تَغْتَيِقُوْا أَوْنَحْتَفِؤُوْا بِهَا بَقلًا، فَشَأْنُكُمْ بِهَا) مَعْنَاهُ: إِذَا لَمْ تَجِدُوْا صَبُوْحًا أَوْ غَبُوْقًا وَلَمْ تَجِدُوْا بَقْلَةًتَأْكُلُوْنَهَا حَلَّتْ لَكُمْ الْمَيْتَةُ. رَوَاهُ الدَّارِميُّ.
فِيْهِ دَلِيْلُنَا عَلَى الْأَمْرِ الَّذِيْ يُبِيْحُ لَهُ الْمَيْتَةُ هُوَ الإِضْطَرَارُ، وَلَا يَتَحَقَّقُ ذَلِكَ مَعَ مَايَتَبَلَّغُ بِهِ مِنَ الْغُبُوْقِ وَالصُّبُوْحِ فَيُمْسِكُ الرَّمَقَ. وَأَوْرَدَ ١ صَاحِبُ (الْمِشْكَاةِ) فِي هَذَا الْبَابِحَدِيْثَ أَبِيْ دَاوُدَ لإِثْبَاتِ مَذْهَبِهِمْ وَأَرَادَ أَنَّ الإِضْطَرَارَ لَا يَتَوَقَّفُ عَلَى خَوْفِ الْهَلَاكِ كَمَاكَانَ عَنْدَ الْحَنَفِيَّةِ؛ لِأَنَّ ذَلِكَ الْحَدِيْثَ قَدْ ثَبَتَ فِيْهِ أَنَّ خَوْفَ الْهَلَاكِ لَيْسَ بِمَنَاطِ لِحِلِّالْمَيْتَةِ، كَيْفَ وَالْمَرْءُ لَيْسَ بَعْدَ اغْتِبَاقِ الْقَدحِ وَاصْطِبَاحِهِ مِمَّا يُخَافُ عَلَيْهِ الْهَلَاكَ،قُلْنَا: فَالْجُوَابُ عَنْهُ: أَنَّ الْقَدحَ كَانَ لِكُلِّ أَهْلِ الْبَيْتِ جَمِيْعًا لَا قَدحًا قَدحًا لِكُلِّ أَحَدٍ، فَإِنَّبَعْدَ الْقَدحَيْنِ فِي يَوْمٍ لَا حَاجَةَ فِي الْطَعَامِ، فَضْلًا عَنْ الإِضْطَرَارِ.
Waqid al-Laythi narrated: A man said: “O Messenger of Allah, we are in a land where famine strikes us. When is the dead animal lawful for us?” He said: “As long as you do not have breakfast or dinner or gather herbs to eat, you may take it.” Meaning: If you have no breakfast, dinner, or herbs to eat, the dead animal becomes lawful. This is our evidence that necessity permits eating a dead animal, but this is not fulfilled if one has breakfast or dinner that sustains life. The author of “Mishkat” included Abu Dawud’s hadith in this chapter 1 to support their view that necessity does not require fear of death, as per the Hanafi view, since that hadith shows fear of death is not the condition for permissibility. How so, when one is not at risk of death after breakfast or dinner? We say: The response is that the cup (of food or drink) was for the entire household, not per person. After two cups in a day, there is no need for food, let alone necessity.

1 The statement: “The author of Mishkat included Abu Dawud’s hadith, etc.”: This refers to Abu Dawud’s narration from al-Faji’ al-Amiri: He came to the Prophet (ﷺ) and asked: “What is lawful for us from the dead animal?” He said: “What is your food?” They said: “We have breakfast and dinner.” Abu Nu’aym said: Uqbah explained it as a cup in the morning and a cup in the evening. He said: “That, by my father, is hunger.” So he permitted the dead animal in that state. Al-Shafi’i used this hadith to say it is permissible to eat a dead animal with minimal satiety and up to full satiety in necessity. This contradicts al-Darimi’s hadith in “Mishkat,” which we cited, as it states necessity requires the absence of sustenance like breakfast or dinner to sustain life. The reconciliation is that the breakfast and dinner cups were shared among the group, as indicated by the questioner saying, “What is lawful for us,” as if representing his people, not himself alone, and the Prophet’s question: “What is your food?” When it was clear the group was in need, lacking enough to sustain life with the described food, he permitted the dead animal in that state. Al-Khattabi said: A cup of milk in the morning and evening sustains life, though not fully satisfying. Allah permitted eating the dead animal in such a state, indicating it is allowed until one reaches satiety. This is the view of Malik and Ahmad and one of al-Shafi’i’s opinions. Abu Hanifah said: One may only eat enough to sustain life, which is al-Shafi’i’s other opinion. Al-Khattabi’s statement that eating a dead animal is lawful with partial satiety is unusual, as no one is known to hold this view. His claim that Allah permitted it in this state is unsupported by the verse, and if he meant with the hadith, it is contradicted by al-Darimi’s hadith and open to interpretation, as explained. With such ambiguity, the evidence is not conclusive, especially with a contradicting hadith, and the principle is to favor prohibition over permission for caution, per “Al-Mirqat.”
قوله: وأورد صاحب (المشكاة) في هذا الباب حديث أبي داود إلخ: هذا الحديث هو الذي رواه أبو داود عنالفجيع العامري: أنه أتى النبي صلي الله عليه واله وسلم ، قال: ما يحل لنا من الميتة؟ قال: ما طعامكم؟ قلنا: نغتبق ونصطبح. قال أبونعيم: فسَّره لي عقبة قدح غدوة وقدح عشية، قال: ذاك وأبي الجوع، فأحل لهم الميتة على هذه الحالوقد تمسك الشافعي بهذا الحديث، وقال: يجوز تناول الميتة مع أدنى شبع، والتناول منه عند الاضطرار إلىحد الشبع. وقد خالف على هذا حديث الدارمي الذي يليه في (المشكاة). وذكرناه في هذا الكتاب؛ لأن في حديثالدارمي الأمر الذي يبيح له الميتة هو الاضطرار، ولا يتحقق ذلك مع ما يتبلغ به من الغبوق والصبوح، فيمسكالرمق، فالوجه أن يقال: الاغتباق بقدح والاصطباح بآخر كانا على سبيل الاشتراك بين القوم كلهم. ومن الدليل عليهقول السائل:(ما يحل لنا) كأنه كان وافد قومه، فلم يسأل لنفسه خاصة، وكذا قول النبي وَالِي: ( ما طعامكم؟). فلماتبين له أن القوم مضطرون إلى أكل الميتة؛ لعدم الغنى في إمساك الرمق بما وصفه من الطعام، أباح لهم تناول الميتةعلى تلك الحالة، هذا وجه التوفيق بين الحديثين.قال الخطابي: القدح من اللبن بالغدوة والقدح بالعشي يمسك الرمق، ويقيم النفس، وإن كان لا يشبع الشبعالتام. وقد أباح اللّٰه تعالى مع ذلك تناول الميتة، وكان دلالته أن تناول الميتة مباح إلى أن تأخذ من القوت الشبع، وإلىهذا ذهب مالك وأحمد، وهو أحد قولي الشافعي. وقال أبو حنيفة: لا يجوز أن يتناول منه إلا قدر ما يمسك به رمقه،وهو القول الآخر للشافعي اه. وأغرب في قوله: وإن كان لا يشبع الشبع التام، حيث يشعر بأن أكل الميتة يحل معالشبع إذا لم يكن تاما، ولا أظن أحدا قال به. وأما قوله: وقد أباح اللّٰه تعالى مع ذلك تناول الميتة، فإن أراد به أنه مع ما ذكر من الحال فممنوع؛ إذ لا دلالة للآية على ذلك، وإن أراد به أنه مع الحديث المذكور، فقد علمت أنه معارضبالحديث الذي يليه ومحتمل للتأويل كما سبق، ومع الاحتمال لا يتم الاستدلال، لا سيما مع وجود المعارض على أنالقاعدة ترجيح المحرم على المبيح احتياطا. أخذته من (المرقاة).
