عن ابْن عُمَرَ قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم :(مَنْ اقْتَنَى كَلْبًا إِلَّا كَلْبَ مَاشِيَةٍ أَوْضَارٍ نَقَصَ مِنْ عَمَلِهِ كُلَّ يَوْمِ قِيرَاطَانِ). مُتَفَقُ عَلَيْهِ.

وَفِي رِوَايَةٍ لَهُمَا عَنْ أَبِيْ هُرَيْرَةَ رضى الله عنه قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم : ( مَنْ اتَّخَذَ كَلْبًا إِلَّا كَلْبَمَاشِيَةٍ أَوْ صَيْدٍ أَوْ زَرْعِ انْتَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمِ قِيرَاطَ). وَقَالَ مُحَمَّدٌ فِي (الْمُوَطَّا):يُكْرَهُ ١ اقْتِنَاءُ الْكَلْبِ لِغَيْرِ مَنْفَعَةٍ، فَأَمَّا كَلْبُ٢ الزَّرْعِ أَوْ الضَّرْعِ أَوْ الصَّيْدِ أَوالْحَرْسِ فلاباس.

وَرَوَى التِّرْمِذِيُّ عَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه قَالَ: نَهَى النَبِيُّ صلي الله عليه واله وسلم عَنْ ثَمَنِ الْكَلْبِ إِلَّا كَلْبالصَّيْدِ. وَرَوَى النَّسَائِيُّ عَنْ جَابِرٍ( نَحْوَهُ. وَقَالَ فِي (الجَوْهَرِ النَّقِيّ): سَنَدُ النَّسَائِيِّ جَيِّدُ.

وَرَوَى٣ أَبُوْ حَنِيْفةَ فِي مُسْنَدِهِ عَنِ الْهَيْثَمِ عَنْ عِكْرَمَةَ عَنِ ابْنِ عَبَّاسِ رضي الله عنهما قَالَ:رَخَّصَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم فِي ثَمَنِ كَلْبِ الصَّيْدِ. وَهَذَا سَنَدُ جَيِّدٌ، فَإِنَّ الْهَيْثَمَ ذَكَرَهُ ابْنُحبَان فِي الثَّقَاتِ مِنْ أَثْبَاتِ التَّابِعِيْنَ.

وَفِي رِوَايَةٍ لِلْبَيْهَقِيَّ عَنْ عَبْدِ اللهِ بْنِ عَمْرِو بنِ الْعَاصِ ( أَنَّهُ قَضَى فِي كَلْبِ صَيْدٍقَتَلَهُ رَجُلُ بِأَرْبَعِيْنَ دِرْهَمًا، وَقَضَى فِي كَلْبِ مَاشِيَةٍ بِكَبَشِ.

English

Ibn Umar narrated: The Messenger of Allah (ﷺ) said: “Whoever keeps a dog, except a dog for livestock or hunting, has two qirats deducted from his deeds daily.” [Narrated by Bukhari and Muslim]

In their narration from Abu Hurayrah (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “Whoever keeps a dog, except a dog for livestock, hunting, or crops, has a qirat deducted from his reward daily.” Muhammad said in “Al-Muwatta”: Keeping a dog without benefit is disliked, 1 but dogs for crops, 2 livestock, hunting, or guarding are permissible. Al-Tirmidhi narrated from Abu Hurayrah that the Prophet (ﷺ) forbade the price of a dog except a hunting dog. Al-Nasa’i narrated similarly from Jabir, and in “Al-Jawhar al-Naqi,” al-Nasa’i’s chain is good. Abu Hanifah narrated in his Musnad 3 from al-Haytham, from Ikrimah, from Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (ﷺ) permitted the price of a hunting dog. This chain is good, as Ibn Hibban mentioned al-Haytham among reliable successors. Al-Bayhaqi narrated from Abdullah ibn Amr ibn al-As that he ruled for a hunting dog killed by a man at forty dirhams and for a livestock dog at a ram.

1 The statement: “Keeping a dog without benefit is disliked”: This is by consensus. As for its sale, al-Shafi’i said it is not permissible at all, as did Ahmad. Some Malikis said the sale of permitted dogs is allowed. According to us, it is permissible except for a vicious dog that cannot be trained. Our evidence includes narrations from al-Nasa’i, Abu Hanifah’s Musnad, and al-Bayhaqi, with other evidence in “Al-Hidayah” and its commentaries. In “Al-Ta’liq al-Mumajjad,” Mawlana Muhammad Abdul Halim (may Allah sanctify his resting place) noted in “Al-Hidayah”’s margin: There is an issue, as the evidence is more specific than the claim, which is the permissibility of selling dogs generally, while the hadith permits only hunting and livestock dogs. Responses include: First, as chosen in “Al-Nihayah,” this hadith refutes the opponent’s claim of general prohibition, while the claim is proven by Abdullah ibn Amr’s narration: “He (ﷺ) ruled for a dog at forty dirhams,” without specifying dog types, and compensation for a valued item indicates its worth. Second, as chosen in “Al-Kifayah” and others, the hadith indicates the permissibility of selling all dogs, as every dog can guard livestock by barking at wolves or thieves. Third, dogs beyond hunting and livestock are included by implication.

2 The statement: “As for a dog for crops, etc.”: In “Al-Alamgiriyyah,” keeping a dog for guarding is legally permissible, as is for hunting, crops, or livestock. Thus, in “Al-Dhakhirah.”

3 The statement: “Abu Hanifah narrated, etc.”: In “Fath al-Qadir,” this hadith, per their view, serves as a specifier, and a specifier clarifies the general, so it is permissible, even if weaker. They permitted specifying the general and definitive with a single report initially, refuting their claim of general prohibition. The specifier’s rationale, excluding hunting dogs for their hunting benefit, extends to any beneficial dog, whether for hunting or guarding livestock.

١قوله: يكره اقتناء الكلب لغير منفعة: هذا بالإجماع، وأما بيعه فلا يجوز عند الشافعي مطلقًا، وبه قال أحمد، وعندبعض المالكية يجوز بيع الكلب المأذون بإمساكه، وعندنا يجوز مطلقًا إلا إذا كان عقورا لا يقبل التعليم، دلائلناأحاديث (النسائي) و(مسند أبي حنيفة) و (البيهقي)، وسائر الأدلة مذكورة في (الهداية) وشروحها. كذا في (التعليقالممجّد). وكتب مولانا محمد عبد الحليم نور اللّٰه مرقده في هامش (الهداية): ههنا بحث، وهو أن الدليل أخص منالدعوى، فإن المدعى جواز بيع الكلب مطلقًا، والحديث يفيذ جواز بيع كلب الصيد والماشية لا غير، وأجيب عنهبوجوه، الأول: ما اختاره في (النهاية) من أن إيراد هذا الحديث لإبطال مذهب الخصم؛ إذ هو يدعي شمول عدمالجواز، وأما إثبات المدعى فبحديث ذكره في (الأسرار) برواية عبد اللّٰه بن عمرو بن العاص: (أنه قضى عليه السلام في كلببأربعين درهما)، ذكره مطلقًا من غير تخصيص في أنواع الكلاب في التضمين، وتضمين المؤتلف دليل على تقومه.

والثاني: ما اختاره في (الكفاية) وغيره، وهو أن الحديث يدل على جواز بيع جميع الكلاب؛ لأن كل كلب يصلحلحراسة الماشية؛ إذ من عادة الكلاب نباحها عند حس الذئب أو السارق.والثالث: أن ما وراء كلب الصيد والماشيةملحق به دلالةً، فتدبر.

٢ قوله: فأما كلب الزرع إلخ: قال في (العالمكيرية): ويجب أن يعلم بأن اقتناء الكلب لأجل الحرس جائز شرعًا،وكذلك اقتنائه للاصطياد مباح، وكذلك اقتنائه لحفظ الزرع والماشية جائز. كذا في (الذخيرة).

٣ قوله: روى أبو حنيفة إلخ: قال في (فتح القدير): فهذا الحديث على رأيهم يصلح مخصصا، والمخصص بيان للمرادالعام فيجوز، وإن كان دونه في القوة عندهم، حتى أجازوا تخصيص العام والقاطع بخبر الواحد ابتداء، فبطلمدعاهم من عموم منع البيع، ثم دليل التخصيص مما يعلل تعليل إخراج كلب الصيد ساطع أنه لكونه منتفعابوخصوص الاصطياد ملغى، فصار الكلب المنتفع به خارجا، سواء انتفع به في صيد أو حراسة ماشية.

وَعَنْ عَبْدِ اللهِ ابْنِ مُغَفَّلٍ رضي الله عنه عَنِ النَّبِيِّ صلي الله عليه واله وسلم قَلَ: (لَوْلَا أَنَّ الْكِلَابَ أُمَّةً مِنَالْأُمَمِ لَأَمَرْتُ بِقَتْلِهَا كُلِّهَا، فَاقْتُلُوا ١ مِنْهَا كُلَّ أَسْوَد بَهِيمِ). رَوَاهُ أَبُوْ دَاوُدَوَالدَّارِميُّ.

وَزَادَ التَّرْمِذِيُّ وَالنَّسَانِيُّ: وَمَا مِنْ أَهْلٍ بَيْتٍ يَرْتَبِطُونَ كَلْبًا إِلَّا نَقَصَ مِنْ عَمَلِهِمْ كُلَّيَوْمِ قِيرَاطٌ إِلَّا كَلْبَ صَيْدٍ أَوْ كَلْبَ حَرْثِ أَوْ كَلْبَ غَنَمِ.

وَرَوَى مُسْلِمٌ عَنْ جَابِرٍ رضي الله عنه قَالَ: أَمَرَنَا رَسُوْلُ اللهِ صلي الله عليه واله وسلم بِقَتْلِ الْكِلَابِ حَتَّى إِنَّ الْمَرْأَةَتَقْدَمُ مِنَ الْبَادِيَةِ بِكَلْبِهَا فَنَقْتُلُهُ، ثُمَّ نَهَى رَسُولُ اللهِ صلي الله عليه واله وسلم عَنْ قَثْلِهَا، وَقَالَ:(عَلَيْكُمْبِالْأَسْوَدِ الْبَهِيمِ ذِي النُّقْطَتَيْنِ فَإِنَّهُ شَيْطَانٌ). وَقَالَ إِمَامُ الْحَرَمَيْنِ: أَمَرَ النَّبِيُّ صلي الله عليه واله وسلم أَوَلَابِقَثْلِهَا كُلَّهَا، ثُمَّ نُسِخَ ذَلِكَ إِلَّا الْأَسْوَدُ الْبَهِيْمُ، ثُمَّ اسْتَقَرَّ الشَّرْعُ عَلَى النَّهْيِ مِنْ قَتْلِ جَمِيْعالْكِلَابِ الَّتِيْ لَا ضَرَرَ فِيْهَا حَتَّى الْأَسْوَدُ الْبَهِيْمُ.

English

Abdullah ibn Mughaffal (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Were dogs not a community among communities, I would have ordered their killing. So kill every pure black dog.” 1 [Narrated by Abu Dawud and al-Darimi]

Al-Tirmidhi and al-Nasa’i added: “No household keeps a dog except that a qirat is deducted from their deeds daily, except for a hunting, crop, or sheep dog.” Muslim narrated from Jabir (may Allah be pleased with him): The Messenger of Allah (ﷺ) ordered us to kill dogs, even a woman from the desert with her dog, which we killed. Then he forbade their killing, saying: “Target the pure black dog with two spots, for it is a devil.” Imam al-Haramayn said: The Prophet (ﷺ) initially ordered their killing, then this was abrogated except for the pure black dog, and the law settled on prohibiting the killing of harmless dogs, including the pure black one.

1 The statement: “Kill every pure black dog”: Al-Nawawi and al-Ayni said: There is consensus on killing a vicious dog. They differed on harmless dogs. Malik, his companions, and many scholars permitted killing dogs except those exempted, without considering the order abrogated but established. In “Al-Musawwa,” killing dogs was initially ordered due to their widespread keeping, which required killing to stop. It was said Madinah was specified for killing dogs, as it was the landing place of angels with revelation, who do not enter a house with a dog. This was later abrogated, and he said: “It is a community among communities.” Imam al-Haramayn said: The Prophet (ﷺ) initially ordered their killing, then this was abrogated except for the pure black dog, and the law settled on prohibiting the killing of harmless dogs, even the pure black one. In “Al-Durr al-Mukhtar”’s miscellaneous issues, it is permissible to kill harmful dogs like a vicious dog or harmful cat. In “Al-Alamgiriyyah,” if a village has many dogs causing harm, their owners are ordered to kill them; if they refuse, the matter is raised to the judge to enforce it. Thus, in “Muheet al-Sarakhsi.”

١قوله: فاقتلوا منها كل أسود بهيم: وقال النووي والعيني: أجمعوا على قتل العقور، واختلفوا فيما لا ضرر فيه، فأخذمالك وأصحابه وكثير من العلماء جواز قتل الكلاب إلا ما استثنى منها، ولم يرو الأمر بقتل ما عدا المستثنىمنسوخا، بل محكما. وقال في (المسوى) كان قتل الكلاب في صدر الإسلام لعموم البلوى باقتنائها، فكانوا لا يتركوناقتنائها إلا بالقتل. وقيل: خصت المدينة بقتل ما فيها من الكلاب من حيث إن المدينة كانت مهبط الملائكةبالوحي، وهم لا يدخلون بيتا فيه كلب، ثم نسخ، وقال: (إنها أمة من الأمم). وقال إمام الحرمين: أمر النبي صلي الله عليه واله وسلم أولًابقتلها كلها، ثم نسخ ذلك إلا الأسود البهيم، ثم استقر الشرع على النهي من قتل جميع الكلاب التي لا ضرر فيها حتىالأسود البهيم؛ لذلك قال في(مسائل شتى) من (الدر المختار): جاز قتل ما يضر منها ككلب عقور وهرة تضر. وقالفي (العالمكيرية): قرية فيها كلاب كثيرة، ولأهل القرية منها ضرر، يؤمر أرباب الكلاب أن يقتلوا الكلاب، فإن أبوارفع الأمر إلى القاضي حتى يلزمهم ذلك. كذا في (محيط السرخسي).

وَعَنِ ابْنِ عَبَّاسِ رضي الله عنه قَالَ: نَهَى ١ رَسُوْلُ اللهِ صلي الله عليه واله وسلم عَنْ التَّحْرِيْشِ بَيْنَالْبَهَائِمِ. رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ.

١قوله: نهى رسول اللّٰهصلي الله عليه واله وسلم عن التحريش بين البهائم: قال في (بذل المجهود): التحريش: هو الإغراء وتهييجبعضها على بعض، كما يفعل بين الجمال والكباش والديوك وغيرها، وإنما نهي عن ذلك؛ لأنه من الملاهي، وفيه إيلامالدواب وإهلاكهم، وإن كان بشرط من الجانبين فهو قمار أيضًا.
