بَابُ الشَّفَاعَةِ فِي الْحُدُوْدِIntercession in Prescribed Punishments
وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿جَزَّآءٌ١ بِمَا كَسَبًا﴾
١قوله: جزاء بما كسبا: فيه نص على أن القطع جميع موجب فعله لما بَيَّنًا أن في لفظ الجزاء إشارة إلى الكمال، فلو أوجبنا الضمان معه لم يكن القطع جميع موجب الفعل، فكان نسخًا لما هو ثابت بالنص. وعن عبد الرحمن بن عوف رضي الله عنه أن النبي ﷺ قال: (لا غرم على السارق بعد ما قطعت يده) والمعنى فيه أن القطع عقوبة تندرئ بالشبهات، والضمان غرامة تثبت مع الشهبات، فلا يجمع بينهما بسبب فعل واحد، كالقصاص مع الدية. كذا في (المبسوط)۔
Allah, the Mighty and Exalted, said: “As a recompense for what they earned” (Al-Ma’ida: 38)
1 The statement: As a recompense for what they earned: This indicates that amputation is the full consequence of the act, as the term “recompense” implies completeness. If we required compensation alongside it, amputation would not be the full consequence, contradicting the text. Abd al-Rahman ibn Awf (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: No liability on the thief after his hand is cut. The meaning: Amputation is a punishment averted by doubts, while compensation is a liability established with doubts, so they are not combined for one act, like retribution with blood money. (As in Al-Mabsut)
عَنْ عَائِشَةَ رضى الله عنها أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ،فَقَالُوا: وَمَنْ يُكَلِّمُ فِيهَا رَسُولَ اللهِ ﷺ ؟ فَقَالُوا: وَمَنْ يَجْتَرِئُّ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍحِبُّ رَسُولِ اللهِ ﷺ، فَكَلَّمَهُ أُسَامَةُ، فَقَالَ رَسُوْلُ اللهِ ﷺ: (أَتَشْفَعُ٢ فِي حَدَّ مِنْ حُدُودٍاللهِ؟)، ثُمَّ قَامَ فَاخْتَطَبَ ثُمَّ قَالَ: (إِنَّمَا أَهْلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمْالشَّرِيفُ تَرَكُوهُ، وَإِذَا سَرَقَ فِيهِمْ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ، وَأَيْمُ اللهِ، لَوْ أَنَّ فَاطِمَةَبِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا). مُتَّفَقُّ عَلَيْهِ.
وَفِي رِوَايَةٍ لِمُسْلِمِ: (قَالَتْ: كَانَتِ١ امْرَأَةُ مَخْزُومِيَّةٌ تَسْتَعِيرُ الْمَتَاعَ وَتَجْحَدُهُ، فَأَمَرَ النَّبِيُّ ﷺ أَنْ تُقْطَعَ يَدُهَا، فَأَتَى أَهْلُهَا أَسَامَةَ بن زَيْدٍ فَكَلَّمُوهُ، فَكَلَّمَ رَسُولَ اللَّهِ ﷺ فِيهَا، ثُمَّ ذَكَرَ الْحَدِيْثَ نَحْوَمَا تَقَدَّمَ.
Aisha (may Allah be pleased with her) narrated: The Quraysh were concerned about the Makhzumite woman who stole. They said: Who will speak to the Messenger of Allah (ﷺ) about her? They said: Who dares but Usama ibn Zayd, the beloved of the Messenger (ﷺ)? Usama spoke to him, and the Messenger (ﷺ) said: Do you intercede in one of Allah’s limits? He stood, addressed the people, and said: What destroyed those before you was that if a noble stole, they let him go, but if a weak person stole, they enforced the limit. By Allah, if Fatima, daughter of Muhammad, stole, I would cut her hand. [Agreed upon]
In Muslim’s narration: She said: The Makhzumite woman borrowed goods and denied them. The Prophet (ﷺ) ordered her hand cut. Her family went to Usama ibn Zayd, spoke to him, and he spoke to the Messenger (ﷺ) about her. Then the hadith continues as above.
It appears intercession is allowed after reaching the judge but before proof, as Tahtawi cited from Hamawi. (As in Al-Durr al-Mukhtar and Radd al-Muhtar)

1 The statement: Do you intercede in one of Allah’s limits?: Intercession in a prescribed punishment is not permitted after reaching the judge. Before reaching or being proven before the judge, intercession is allowed for the one raising the case to release him, as the punishment’s obligation is not yet established. Obligation arises not from the act alone but upon proof before the Imam. (As in Fath al-Qadir)
2 The statement: The Makhzumite woman borrowed goods and denied them, so the Prophet (ﷺ) ordered her hand cut: The intent is that she was cut for theft. Borrowing was mentioned to identify and describe her, as it was the cause. The amputation was for her theft, and denial was noted for identification. Muslim’s narrations explicitly state she stole and was cut for theft, so this narration aligns to reconcile them, as it is one incident. Some imams said this narration is irregular, contradicting most narrators, and irregular narrations are not acted upon. Scholars said: Theft was omitted here because the narrator’s focus was prohibiting intercession in limits, not reporting theft. Most scholars and jurists of the regions hold there is no amputation for denying borrowed goods and interpret this hadith accordingly. Ahmad and Ishaq said amputation is required, per al-Tayyibi and al-Nawawi.
In Al-Mirqat: They agreed intercession in a prescribed punishment is forbidden after reaching the Imam, per this hadith, and seeking intercession is forbidden. Before reaching, most scholars allow it if the person is not a habitual wrongdoer. For offenses requiring discretionary punishment, intercession is permitted whether it reaches the Imam or not, as they are weaker, and it is recommended if the person is not harmful, per al-Nawawi.
٢ قوله: أتشفع في حد من حدود الله إلخ: لذلك لا تجوز الشفاعة في الحد بعد الوصول للحاكم، وأما قبل الوصول إليه والثبوت عنده فتجوز الشفاعة عند الرافع له إلى الحاكم ليطلقه؛ لأن وجوب الحد قبلُ لم يثبت، فالوجوب لا يثبت بمجرد الفعل، بل على الإمام عند الثبوت عنده. كذا في (الفتح). وظاهره جواز الشفاعة بعد الوصول للحاكم قبل الثبوت عنده، وبه صرَّح الطحطاوي عن الحموي. قاله في (الدر المختار) و(رد المحتار). وقال في (المرقاة): وقد أجمعوا على تحريم الشفاعة في الحد بعد بلوغه إلى الإمام لهذا الحديث، وعلى أنه يحرم التشفيع فيه، فأما قبل البلوغ فقد أجاز فيها أكثر العلماء إذا لم يكن المشفوع فيه صاحب شر وأذى للناس، وأما المعاصي التي يجب فيها التعزير، فيجوز الشفاعة والتشفيع فيها سواء بلغت الإمام أم لا؛ لأنها أوهن، بل هي مستحبة إذا لم يكن المشفوع فيه صاحب أذى، كذا قاله النووي .
١ قوله كانت المخزومية تستعير المتاع وتجحده فامر النبي ﷺ بقطع يدها الخ:المراد انها قطعت بالسرقة وانما ذكرت العارية تعريفًا لها ووصفًا لها؛ لأنها سبب، فالقطع كان لسرقتها، وإنما ذكرت الجحود لتعريفها. وقد ذكر مسلم هذا الحديث في سائر الطُّرُق المصرحة بأنها سرقت وقطعت بسبب السرقة، فيتعين حمل هذه الرواية على ذلك جمعًا بينالروايات؛ فإنها قضية واحدة مع أن جماعة من الأئمة قالوا: هذه الرواية شاذة، فإنها مخالفة بجماهير الرُّواة، والشاذة لايعمل بها. قال العلماء: وإنما لم يذكر السرقة في هذه الرواية؛ لأن المقصود منها عند الراوي ذكر منع الشفاعة في الحدودلا الإخبار عن السرقة. قال جماهير العلماء وفقهاء الأمصار: لا قطع على من جحد العارية، وتأولوا هذا الحديث بنحو ماذكرته. وقال أحمد وإسحاق: يجب القطع في ذلك، قاله الطيبي والنووي.
وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ رضی اللہ عنہما قَالَ: سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُوْلُ: (مَنْحَالَتْ شَفَاعَتُهُ دُونَ حَدٍّ مِنْ حُدُودِ اللهِ فَقَدْ ضَادَّ اللهَ، وَمَنْ خَاصَمَ فِي بَاطِلٍ وَهُوَ يَعْلَمُهُلَمْ يَزَلْ فِي سَخَطِ اللّهِ حَتَّى يَنْزِعَ عَنْهُ، وَمَنْ قَالَ فِي مُؤْمِنٍ مَا لَيْسَ فِيهِ أَسْكَنَهُ اللهُ رَدْغَةَالْخَبَالِ حَتّى يَخْرُجَ مِمَّا قَالَ). رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ.
وَفِي رِوَايَةٍ لِلْبَيْهَقِيَّ فِي (شُعَبِ الْإِيْمَانِ): (أَعَانَ عَلَى خُصُوْمَةٍ لَا يَدْرِيْ أَحَقُّ أَوْ بَاطِلُفَهُوَ فِي سَخَطِ اللهِ حَتَّى يَنْزِعَ)
Abdullah ibn Umar (may Allah be pleased with them) narrated: I heard the Messenger of Allah (ﷺ) say: Whoever’s intercession prevents one of Allah’s limits opposes Allah. Whoever disputes falsely, knowing it, remains under Allah’s wrath until he desists. Whoever says of a believer what is not true, Allah makes him dwell in the mire of corruption until he retracts. [Narrated by Ahmad and Abu Dawud]
In al-Bayhaqi’s narration in Shu‘ab al-Iman: Whoever aids a dispute, unsure if it is just or false, is under Allah’s wrath until he desists.
وَعَنْ أَبِي هُرَيْرَةَ رضی اللہ عنه قَالَ: أُتِيَ بِسَارِقٍ إِلَى النَّبِيِّ ﷺ فَقَالُوا: يَا رَسُولَ اللَّهِ، إِنَّهَذَا سَرَقَ، فَقَالَ: مَا إِخَالُهُ سَرَقَ، فَقَالَ ١ السَّارِقُ: بَلَى يَا رَسُوْلَ اللهِ، ﷺ قَالَ (اذْهَبُوا بِهِفَاقْطَعُوهُ ثُمَّ احْسِمُوهُ، ثُمَّ اثْتُونِى بِهِ)، قَالَ: فَذُهِبَ بِهِ فَقُطِعَ ثُمَّ حُسِمَ ثُمَّ أَتِيَ بِهِ، فَقَالَ:(تُبْ إِلَى اللهِ) قَالَ: تُبْتُ إِلَى اللهِ. قَالَ (تَابَ اللهُ عَلَيْكَ). رَوَاهُ الطّحَاوِيُّ
Abu Hurayra (may Allah be pleased with him) narrated: A thief was brought to the Prophet (ﷺ). They said: O Messenger of Allah, he stole. He said: I don’t think he stole. The thief said: Yes, O Messenger of Allah. He said: Take him, cut him, cauterize him, and bring him back. He was taken, cut, cauterized, and returned. He said: Repent to Allah. He said: I repent to Allah. He said: Allah has accepted your repentance. [Narrated by al-Tahawi]

1 The statement: The thief said: Yes, O Messenger of Allah, and he said: Take him, cut him, etc.: A thief’s hand is cut if he takes property with the conditions in fiqh books upon one confession. This is the view of Abu Hanifa, Muhammad, Malik, al-Shafi‘i, and most scholars. Abu Yusuf, Ahmad, Ibn Abi Layla, Zufar, and Ibn Shubruma said: No amputation, per Abu Umayya al-Makhzumi’s hadith, where he was not cut until repeated confessions. Abu Hanifa and others cite al-Tahawi’s narration from Abu Hurayra, where he was cut after one confession. The two hadiths conflict, requiring verification. The prior hadith is understood as the first confession being before Companions, who then told the Prophet (ﷺ): He stole, based on their witness. ١قوله: فقال السارق: بلى يا رسول الله ، قال: اذهبوا فاقطعوه إلخ؛ أي يجب قطع يد السارق إذا أخذ المال بالقيود المذكورة في كُتُب الفقه بإقراره مَرَّةً واحدة. وهذا عند أبي حنيفة ومحمد ومالك والشافعي وأكثر علماء الأمة. وقال أبو يوسف: لا يقطع، وهو قول أحمد وابن أبي ليلى وزفر وابن شبرمة؛ لحديث أبي أمية المخزومي حيث لم يقطعه إلا بعد تكرار إقراره، ولأبي حنيفة وغيره ما أسند الطحاوي إلى أبي هريرة في هذا الحديث. فقد قطعه بإقراره مَرَّةً، ووقع حينئذٍ التعارض بين الحديثين، ويحتاج إلى التصحيح والترجيح، فالأولى حمل الحدیث السابق على أن اعترافه الأول كان بحضرة الصحابة، ثم الصحابة بناء على اعترافه عندهم، قالوا: يا رسول الله! إن هذا سرق؛ لأنهم شهدوا وبهذا يحصل الجمع بين الحديثين ويرفع التناقض بين الدليلين، فمآلهما واحد في أنه لا يحتاج إلى الإقرار المتعدد. التقطته من (فتح القدير) و(المرقاة) وشروح (الكنز)۔

In al-Daraqutni’s narration: No liability on the thief after his right hand is cut. In al-Bazzar and al-Tabarani’s narration: The thief does not compensate for his theft after the limit is enforced. Ibn Jarir al-Tabari narrated in Tahdhib al-Athar with a connected, reliable chain from him that the Messenger (ﷺ) said: If the limit is enforced on the thief, there is no liability on him.

2 The statement: A thief is not liable for compensation if the limit is enforced: If the thief is cut and the stolen item is intact, it is returned to its owner. If sold or gifted, it remains the owner’s property. There is no liability whether the item is destroyed or consumed, per Abu Yusuf’s narration from Abu Hanifa, the well-known view. Hasan narrated liability for consumption but not destruction. Al-Shafi‘i said: Liable in both. In detail: Amputation is obligatory for theft. If the stolen item exists, it must be returned. If destroyed or consumed, no liability per us, unlike al-Shafi‘i, as amputation and liability do not combine, though return is allowed. The property was protected for the person’s right, but theft made the limit a Sharia right, making the property protected for Sharia, not the person, so no liability. Allah justified amputation as recompense, which, in legal punishments, means a right for Allah against the act. “Recompense” from “jaza” (to suffice, fulfill) indicates amputation is a complete, sufficient penalty for theft, achieved only if the crime fully violates Allah’s right, not a person’s, which is partial. Protection must shift to Allah for the act to be inherently forbidden. If protection remained with the person, it would not be inherently forbidden. This is from “As a recompense”, not “Cut off their hands”, as you claimed. Our school cites: The hadith A thief is not liable for compensation if the limit is enforced, and narrations from Ibn Sirin, al-Nakha‘i, al-Sha‘bi, Ata, al-Hasan, and Qatada against liability. In Al-Binaya: This is sound per “Cut off their hands as a recompense for what they earned” [Al-Ma’ida: 38], which does not mention liability, and if required, it would be stated. Objection: The hadith is flawed? Al-Daraqutni said: Its chain includes Sa‘id ibn Ibrahim, unknown, and all its chains are unreliable. If accepted, it may mean no torment in the Hereafter, or no payment to the executioner, or no liability initially in Islam. These possibilities prevent using it to deny liability. I say: No, al-Maraq’s claim is not accepted alone. Abu al-Layth said: Muhammad ibn al-Hasan said: No liability in legal ruling, but in piety, liability is due. This is the better view and fatwa-worthy. In Fath al-Qadir and Al-Mabsut: Hisham narrated from Muhammad: Liability is dropped in ruling due to inability to equate. In piety, liability is issued due to the owner’s loss from the thief. ٢ قوله: لا يغرم صاحب السرقة إذا أقيم عليه الحد: يعني إذا قطع السارق والعين قائمة في يده ردّت إلى صاحبها وإنباعها أو وهبها لبقائها على ملك مالكها، ولا فرق في عدم الضمان بين هلاك العين واستهلاكها في الظاهر من الرواية،وهو رواية أبي يوسف عن أبي حنيفة ، وهو المشهور. روى الحسن أنه يضمن بالاستهلاك دون الهلاك. وقالالشافعي : يضمن فيهما، تفصيله إن القطع واجب في السرقة البتة، وأما المسروق إن كان قائمًا يجب رد عينه، وإنكان هالكًا أو مستهلكًا لا يجب الضمان عندنا، خلافًا للشافعي؛ لأن القطع لا يجتمع مع الضمان عندنا، وإن كان يجتمعمع الرد؛ وذلك لان المال كان معصوما حقا للعبد، فإذا ورد عليه السرقة أوجب الشارع الحد، وهو حق الشرع،فالجناية وردت على حق الشرع.ففي حالة السرقة صار المال معصوما حقا للشرع، فلم يبق معصومًا لحق العبد، فلا يجب الضمان، وشرعجزاءه القطع جزاء كاملا، فلا يجتمع معه. ويرد عليه أنه لو صحَّ هذا التقرير لزم أن لا يرد المسروق إذا كان قائمابعينه، وليس كذلك. ويجاب عنه بأنه يرد للتشابه الصور ولبقاء ملك المالك فيه، وإن انتقلت العصمة إلى الله تعالى،وإن شئت زيادة تفصيل في هذا المقام فارجع إلى كُتُب الأصول. واعترض عليه الشافعي بله بأن قوله تعالى:﴿فَأَقْطَعُواْ﴾ (المائدة: ٣٨) إنما يدل على مجرد القطع؛ لأنه لفظ خاص وضع لهذا لمعنى المخصوص، ولا يدل علىتحول العصمة إلى الله تعالى، فأنتم قد أبطلتم لعمل بالخاص، وزدتم عليه بقوله علیہ السلام : (لا غرم على السارق بعد ما قطعت بيمينه)
فأجاب عنه الحنفية في كُتُب أصولهم: أن بطلان العصمة عن المسروق وتحوله إلى الله تعالى إنما نُثبته من قولهتعالى: ﴿جَزَآءٌ بِمَا كَسَبَا﴾ (المائدة: ٣٨) لا بقوله تعالى: ﴿فَأَقْطَعُواْ﴾ (المائدة: ٣٨)؛ وذلك لأن الله تعالى علَّل القطعبالجزاء، ولجزاء على الإطلاقات الشرعية إذا استعمل في العقوبات يراد به ما يجب حقا لله تعالى في مقابلة فعل العبد،ولأن الجزاء مصدر (جزى) بمعنى (كفى) و(قضى)، وهو دل على أن القطع جزاء كامل كافٍ للسرقة، ولا يكون ذلكإلا بكمال الجناية، وهي إنما تكون كاملة إذا كانت واقعة على حق الله تعالى؛ لأنها جناية من جميع الوجوه، والجناية علىحق العبد جناية من وجه دون وجه، فوجب أن تحول العصمة إلى الله تعالى ليكون حراما بعينه، ولو بقيت العصمة فيالمال من جهة العبد لا يكون حرامًا لعينه، فإنما أثبتنا هذا من إشارة قوله تعالى: ﴿جَزَآءَ﴾ لا من قوله تعالى:﴿فَأَقْطَعُوّأْ﴾ كما زعمتم۔
واستدل أصحابنا على عدم وجوب الضمان بوجوه، منها: حديث لا يغرم صاحب السرقة إذا أقيم عليه الحد، ثمروي عدم التضمين عن ابن سيرين والنخعي والشعبي وعطاء والحسن وقتادة. وقال في (البناية): هذا هو الصوابلقوله تعالى: ﴿فَآَقْطَعُواْ أَيْدِيَهُمَا جَزَّآْءٌ بِمَا كَسَبَا﴾ (المائدة: ٣٨)، فلم يأمر بالتغريم ولو كان لازمًا عليهم لذكره. فإن قلت: الحديث معلول؟ قال الدارقطني: وفي إسناده سعيد بن إبراهيم، وهو مجهول، ويروى بطرق كلها لا تثبت، ولوسلم احتمل أنه أراد بنفي الغرم نفي العذاب في الآخرة. ويحتمل أنه أراد أجرة الحداد أو نفي الضمان أبدًا، كما كان فيبدء الإسلام، ومع هذه الاحتمالات لا يمكن الاحتجاج به لنفي الضمان.
قلت: قول الدارقطني لا يقبل إذا انفرد، وإنما تكلموا في الحديث من حيث إسناده؛ لأنه رواه المسور عن عبدالرحمن بن عوف، والمسور لم يلقه. وهذا إن ثبت فهو صفة الإرسال، والمرسل حجة. علا أن العيني ذكر في(البناية) أنه أخرجه ابن جرير الطبري في (تهذيب الآثار) بسند متصل محتج به وهذا المسور وأبوه على شرط البخاري، وأبوه ذكره ابن حبان في ثقات التابعين، وأن الزهري يروي عنسعيد بن إبراهيم هذا الحديث، نقله عبد الباقي، وقال عبد الباقي: هذا صحيح. قيل: هو قاضي المدينة أحد الثقات الاثبات۔ واطلاق الغرم علی اجرۃ القاطع خلاف الظاهر مع انه ذكر النبي ﷺ الغرم منكرا في رواية وهو في موضع النفي، والنكرة في موضع النفي تعمّ، فينبغي عنه جميع أنواع الغرم. وقال الفقيه أبو الليث: روي عن محمد بنالحسن أنه قال: إنما لم يجب عليه الضمان في الحكم والقضاء، وأما ديانة فالضمان واجب. وهذا القول أحسن ويفتىبه؛ لأنه قال في (الفتح): وفي (المبسوط): روى هشام عن محمد أنه إنما يسقط الضمان عن السارق قضاء لتعذر الحكمبالمماثلة. فأما ديانة فيفتى بالضمان للحوق الخسران والنقصان للمالك من جهة السارق. التقطته من (الهداية) و(الدرالمختار) و(رد المحتار) و(شرح الوقاية) و(عمدة الرعاية) و(البناية) وشروح (الكنز) و(التفسيرات الأحمدية)و (المرقاة)
