عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ (رضي الله عنه) رَفَعَهُ إِلَى النَّبِيِّ ﷺ قَالَ فِي سَبَايَا أَوْطَاسَ: لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ، وَلَا غَيْرُ ذَاتِ حَمْلٍ حَتَّى تَحِيضَ حَيْضَةً». رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ والدارمي.

وَرَوَى الْبَيْهَقِيُّ فِي سُنَنِهِ عَنِ الْحَسَنِ وَعَطَاءٍ وَابْنِ سِيْرِينَ وَعِكْرَمَةَ أَنَّهُمْ قَالُوْا: يَسْتَبْرَوْهَا وَإِنْ كَانَتْ بِكْرًا.

وَفِي رِوَايَةِ رَزِينٍ عَنِ ابْنِ عُمَرَ الله أَنَّهُ قَالَ: إِذَا وُهِبَتْ وَلِيْدَةُ الَّتِي تُوْطَأُ أَوْ بِيْعَتْ أَوْأُعْتِقَتْ فَلْتَسْتَبْرِئُ رَحِمَهَا بِحَيْضَةٍ. وَقَالَ الْإِمَامُ النَّوَوِيُّ: إِنَّ كَانَتْ المُتَبَرَّأَةُ مِنْ ذَوَاتِ الْأَشْهُرِ فَعِنْدَ الْجُمْهُورِ تَسْتَبْرِأُ بِشَهْرٍ؛ لِأَنَّهُ بَدْلَ قَرْءٍ.

English

Abu Sa’id Al-Khudri (may Allah be pleased with him) narrated that the Prophet (ﷺ) said regarding the captives of Awtas: "A pregnant woman is not to be approached until she gives birth, and a non-pregnant woman is not to be approached until she experiences one menstrual cycle." [Narrated by Ahmad, Abu Dawud, and Ad-Darimi]

Al-Bayhaqi narrated in his Sunan from Al-Hasan, Ata, Ibn Sirin, and Ikrima that they said: She must undergo istibra’, even if she is a virgin.

In a narration by Razin from Ibn Umar (may Allah be pleased with him), he said: If a slave woman who is approached is gifted, sold, or freed, she must undergo istibra’ for one menstrual cycle. Imam An-Nawawi said: If the woman undergoing istibra’ is one who observes waiting periods by months, according to the majority, she undergoes istibra’ for one month, as it is a substitute for a qar’.

It is stated in Ad-Durr Al-Mukhtar: Whoever acquires the right to enjoy a slave woman through any form of ownership, such as purchase, inheritance, captivity, payment for a crime, or rescission of a sale after possession, etc., and it is restricted to enjoyment to exclude purchasing a wife, even if a virgin, or purchased from a slave or woman, even if he is a mukatab, authorized, or indebted slave, otherwise there is no istibra’. Or from her mahram, other than her womb, so she does not become free upon him, or from a minor’s wealth, even an infant, it is forbidden to approach her, as are its preliminaries, as is most correct, due to the possibility of her falling into another’s ownership if she appears pregnant, until she undergoes istibra’ with one menstrual cycle for those who menstruate, or one month for those who observe by months, such as young girls, postmenopausal women, or those whose menstruation has ceased. If she menstruates during it, the istibra’ by days is invalidated. If her menstruation ceases, becoming prolonged in purity, and she is one who menstruates, she undergoes istibra’ for two months and five days according to Muhammad, and this is the fatwa. For a woman with istihada, he leaves her for ten days from the start of the month. [Barjandi and others, so let it be noted] And with delivery for a pregnant woman.

It is stated in Tansiq An-Nizam, in summary: Istibra’ linguistically means seeking clearance and purity, and in Shariah, it is seeking the clearance of a slave woman’s womb from pregnancy. Whoever acquires a slave woman through purchase, gift, bequest, or inheritance, it is forbidden to approach her or engage in its preliminaries until she undergoes istibra’ with one menstrual cycle, one month, or delivery.

The four Imams held this view based on this Hadith, which establishes the obligation of istibra’ on the master and indicates the reason for it in captives, which is acquiring ownership and possession, as this is the context of the text. The wisdom behind istibra’ is to ascertain the womb’s clearance to protect honorable lineages from mixing and genealogies from confusion. This protection is needed when there is actual or potential occupation by honorable seed, meaning a child with established lineage. Istibra’ is obligatory on the buyer, not the seller, as the true reason is the intention to approach, which the buyer has, not the seller. Thus, it is obligatory on him, though intention is an internal matter, so the ruling is based on its indicator, which is the ability to approach. This ability is established by ownership and possession, making it the cause, and the ruling is applied to it for ease. Thus, the cause for a captive is acquiring ownership of her person, confirmed by possession. The ruling extends to all forms of ownership, such as purchase, gift, bequest, inheritance, khul’, kitaba, and others. Istibra’ is also obligatory on the buyer from a minor’s wealth, a woman, a slave, or someone for whom approaching her is not permissible. Similarly, if the purchased woman is a virgin who has not been approached, as the cause, acquiring ownership and possession, is fulfilled. Rulings are based on causes, not their wisdom, which here is ascertaining the womb’s clearance. The cause is considered when there is actual or potential occupation by seed. A menstrual cycle during which she was purchased, or one she experienced after purchase or other forms of ownership before possession, or one after possession, does not suffice, contrary to Abu Yusuf, as the cause is acquiring ownership and possession, and the ruling does not precede the cause. Similarly, istibra’ before approval in a fuduli sale, even if the slave woman is in the buyer’s possession, or after possession in an invalid sale before a valid purchase, does not suffice, as stated, due to the lack of fulfillment of the cause. 2 The statement: They said: She undergoes istibra’, even if a virgin: The majority agreed on istibra’ for a virgin due to the generality of the Hadith about the captives of Awtas and this report. Similarly, istibra’ for a non-menstruating woman is one month, not months.

1 قوله: قال في سبايا أوطاس إلخ فيه دليل أن استحداث الملك في الأمة يوجب الاستبراء، وبظاهره قال الأئمة الأربعة؛ لأن الأصل في الاستبراء هذا الحديث وهو أفاد وجوب الاستبراء على المولى ودل على السبب في المسبية وهو استحداث الملك واليد لأنه هو الموجود في مورد النص، وهذا أي وجوب الاستبراء؛ لأن الحكمة فيه التعرف عن براءة الرحم صيانة للمياه المحترمة عن الاختلاط والأنساب عن الاشتباه، وذلك الصيانة عند حقيقة الشغل أو توهم بماء محترم، وهو أي المحترم بأن يكون الولد ثابت السنب، ويجب الاستبراء على المشتري لا على البائع؛ لأن العلة الحقيقة أو إرادة الوطء والمشتري هو الذي يريده دون البائع، فيجب عليه غير أن الإرادة أمر مبطن ليدار الحكم على دليلها، وهو التمكن من الوطء.

والتمكن إنما يثبت بالملك واليد، فانتصب التمكن سببا، وأدير الحكم عليه تيسيرًا، فكان السبب في المسبية استحداث ملك الرقبة المؤكد باليد، وتعدى الحكم إلى سائر أسباب الملك كالشراء والهبة والوصية والميراث والخلع والكتابة وغير ذلك، وكذا يجب الاستبراء على المشتري من مال الصبي ومن المرأة ومن المملوك وممن لا يحل له وطيها، وكذا إذا كانت المشتراة بكرًا لم توطأ لتحقق السبب هو استحداث الملك واليد وإدارة الأحكام على الأسباب دون الحكم لبطونها، وهي ههنا تعرف براءة الرحم، فيعتبر تحقق السبب وعند توهم الشغل بالماء، وكذا لا يجتزأ بالحيضة التي اشتراها في أثنائها، ولا يجتز بالحيضة التي حاضتها بعد الشراء أو غيره من أسباب الملك قبل القبض ولا بالوائدة الحاصلة بعدها قبل القبض خلاف لأبي يوسف ؛ لأن السبب استحداث الملك واليد والحكم لا يسبق السبب، وكذا لا يحتزأ بالاستبراء الحاصل قبل الإجازة في بيع الفضولي، وإن كانت الجارية في يد المشتري، ولا بالاستبراء الحاصل بعد القبض في الشراء الفاسد قبل أن يشتريها شراء صحيحًا لما قلنا من دليل عدم الاجتزاء، أخذته من الهداية» وشروحها.

ولذلك قال في الدر المختار: من ملك استمتاع أمة بنوع من أنواع الملك كشراء وارث وسبي ودفع جناية وفسخ بيع بعد القبض ونحوها ، وقيدت بالاستمتاع ليخرج شراء الزوجة، ولو بكرا أو مشرية من عبد أو امرأة، ولو عبده كمكاتبه ومأذونه أو مستعرقا بالدين وإلا لا استبراء، أو من محرمها غير رحمها كيلا تعتق عليه، أو من مال صبي، ولو طفله حرم عليه وطؤها، وكذا دواعيه في الأصح؛ لاحتمال وقوعها في ملك غير ملكه بظهورها حبلى حتى يستبرئها بحيضة فيمن تحيض، وبشهر في ذات أشهر وهي صغيرة وآئسة ومنقطعة حيض، ولو حاضت فيه بطل الاستبراء بالأيام، ولو ارتفع حيضها بأن صارت ممتدة الطهر، وهي ممن تحيض استبرأها بشهرين وخمسة أيام عند محمد، وبه يفتى، والمستحاضه يدعها من أول الشهر عشرة أيام، برجندي وغيره، فليحفظ. وبوضع الحمل في الحامل. وقال في تنسيق النظام حاصله : أن الاستبراء في اللغة: طلب البراءة والطهارة، وفي الشرع : طلب براءة رحم جارية عن حمل، ومن ملك أمةً شراء أو هبة أو وصية أو إرثا يحرم عليه الوطئ ودواعيها حتى يستبرأها بحيضة أو شهر أو وضع حمل.

۲ قوله: قالوا: يستبرأها وإن كانت بكرا أي اتفق الجمهور على استبراء العذراء؛ لحديث سبايا أوطاس بعمومه، وأيضًا لهذا الأثر، وكذا على استبراء غير الحائض بشهر لا بأشهر.

وَعَنْ أَبِي الدَّرْدَاءِ(رضي الله عنه) قَالَ: مَرَّ النَّبِيُّ ﷺ بِامْرَأَةِ فَسَأَلَ عَنْهَا، فَقَالُوا: أَمَةٌ لِفُلَانٍ. قَالَ: «أَيُلِمُ بِهَا؟ فَقَالُوا : نَعَمْ، قَالَ: «لَقَدْ هَمَمْتُ أَنْ أَلْعَنَهُ لَعْنَا يَدْخُلُ مَعَهُ فِي قَبْرِهِ، كَيْفَ يَسْتَخْدِمُهُ وَهُوَ لَا يَحِلُّ لَهُ، أَمْ كَيْفَ يُوَرِّثُهُ وَهُوَ لَا يَحِلُّ لَهُ». رَوَاهُ مُسْلِمٌ.

English

Abu Ad-Darda (may Allah be pleased with him) narrated: The Prophet (ﷺ) passed by a woman and asked about her. They said, "She is a slave woman of so-and-so." He said, "Does he approach her?" They said, "Yes." He said, "I was about to curse him with a curse that would enter his grave with him. How can he enslave her when she is not permissible for him? Or how can he make her inherit when she is not permissible for him?" [Narrated by Muslim]

وَعَنْ رُوَيْفِعِ بْنِ ثَابِتٍ الْأَنْصَارِيِّ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ الله ﷺ يَوْمَ حُنَيْنٍ: لَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْقِي مَاءَهُ زَرْعَ غَيْرِهِ - يَعْنِي إِثْيَانَ الْحَبَالَى ، وَلَا يَحِلُّ لِامْرِي يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَقَعَ عَلَى امْرَأَةٍ مِنَ السَّبْيِ حَتَّى يَسْتَبْرِئَهَا، وَلَا يَحِلُّ لِامْرِي يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَبِيعَ مَغْنَمًا حَتَّى يُقْسَمَ». رَوَاهُ أَبُو دَاوُدَ، وَرَوَاهُ التَّرْمِذِيُّ إِلَى قَوْلِهِ: «رَزْعَ غَيْرِهِ».

Ruwayfi’ ibn Thabit Al-Ansari (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said on the day of Hunayn: "It is not permissible for a man who believes in Allah and the Last Day to water the crop of another, meaning approaching a pregnant woman. Nor is it permissible for a man who believes in Allah and the Last Day to approach a captive woman until she undergoes istibra’. Nor is it permissible for a man who believes in Allah and the Last Day to sell spoils until they are divided." [Narrated by Abu Dawud, and At-Tirmidhi narrated up to "the crop of another"]

1 The statement: To water the crop of another, etc.: It is stated in Tansiq An-Nizam: Istibra’ in our view applies to a purchased pregnant woman, a pregnant woman from zina, and captive women whose marriages to their non-Muslim husbands were annulled due to Islam or migration, becoming those whom our right hands possess, not to a married pregnant woman, as it is permissible to approach her. Similarly, it is permissible to approach a pregnant woman from zina if the husband is the one who committed zina with her before marriage. Nor does it apply to a Muslim migrant non-Muslim woman who is pregnant, as her marriage is not permissible until she delivers, let alone approaching her, as their marriages among themselves are valid in our view, and her waiting period is delivery. The basis for the prohibition of approaching is the statement that one’s water should not water another’s crop.

1 The statement: And accompany them in this world with kindness: This indicates that the maintenance of parents is obligatory on a man, as stated in Al-Hidayah.

2 The statement: And upon the heir is the like of that: This refers to the distant relative, pointing to the beginning of the verse, which is Allah’s statement: And upon the father is their provision and clothing [Al-Baqarah: 233]. This indicates that maintenance is obligatory on the heir, restricted to a relative with a prohibited degree of kinship based on Ibn Mas’ud’s reading, and there is no doubt that his reading was heard from the Prophet (ﷺ) and is well-known, making it equivalent to a widely narrated report. As is known, it is permissible to restrict the generality of the Book with it. [Inayah and Binayah, excerpted from them]

3 The statement: And give to the near relative his right: The authors of Al-Kashshaf and Al-Madarik explicitly stated that Allah’s statement: So give to the near relative his right [Ar-Rum: 38] is evidence for the obligation of maintenance for relatives with prohibited degrees of kinship, as is our view. It was previously mentioned that according to Ash-Shafi’i, there is no maintenance except for lineage relatives, while in our view, maintenance is obligatory for every relative with a prohibited degree of kinship who is in need and unable to earn, upon every wealthy relative, according to the order of inheritance and agnates, as is known in fiqh. ۱ قوله : أن يسقي ماءه زرع غيره إلخ لذلك قال في تنسيق النظام: إن الاستبراء عندنا إنما هو في الحبلى المشتراة والحبلى من زنا والسبايا التي فسخ نكاحهن عن أزواجهن الحربيين بوجه الإسلام أو الهجرة، وصارت مما ملكت أيماننا، لا في حق منكوحته الحبلى؛ فإنه يجوز جماعها، وكذا يجوز وطئ الحبلى من زنا إذا كان الزوج هو الزاني، زنى بها قبل النكاح، ولا في حق الحربية المهاجرة مسلمة إذا كانت حاملاً؛ فإنه لا يجوز عندنا نكاحها حتى تضع، فضلًا عن الوطئ؛ لأن نكاحهم فيما بينهم صحيح عندنا فعدته وضع الحمل، ومبنى حرمة الوطئ ما نص عليه أن لا يسقى ماءه زرع غيره.

۱ قوله: وصاحبهما في الدنيا معروفا فيه دليل على أن نفقة الأبوين على الرجل كذ في «الهداية».

۲ قوله: وعلى الوارث مثل ذلك فإن ذلك للإشارة إلى البعيد، فيكون إشارة إلى أول الآية، وهو قوله تعالى: ﴿وَعَلَى الْمَوْلُودِ لَهُ رِزْقُهُنَّ وَكِسْوَتُهُنَّ ﴾ (البقرة: ۲۳۳ فيدل على أن على الوارث النفقة، وتقييده بذي الرحم المحرم بقراءة ابن مسعود ، ولا شك أن قراءته كانت مسموعة من النبي ، وقراءته مشهورة ، فصارت بمنزلة خبر مشهور، وعلى ما عرف فجاز تقييد إطلاق الكتاب بها، عناية و بناية»، ملتقط منهما. وقال في المدارك»: وعلى الوارث عطف على قوله: وعلى المولود له رزقهن وكسوتهن، وما بينهما تفسير للمعروف متعرض بين المعطوف والمعطوف عليه، أي وعلى وارث الصبي عند عدم الأب مثل ذلك أي مثل الذي كان على أبيه في حياته من الرزق والكسوة، واختلف فيه.

فعند ابن أبي ليلى كل من ورثه وعندنا من كان ذا رحم محرم منه لقراءة ابن مسعود ، وعلى الوارث ذي الرحم المحرم مثل ذلك، وعند الشافعي الله لا نفقة فيما عدا الولادة، انتهى. وفي التفسيرات الأحمدية»: قال فخر الإسلام: وفي ظاهر هذه الآية إشارة إلى أن النفقة تستحق بغير الولاد، وهي نفقة ذوي الأرحام خلافًا للشافعي؛ لأن قوله تعالى: ﴿وَعَلَى الْوَارِثِ مِثْلُ ذَلِكَ﴾ (البقرة: ۲۳۳) بعمومه يتناول الأخ والعم وغيرهما، ويتناولهم بمعناه؛ لأنه اسم مشتق من الإرث مثل الزاني والسارق، وفيه إشارة إلى أن من عدا الوالد يتحملون النفقة على قدر المواريث، حتى أن النفقة يجب على الأم والجد أثلاثا؛ لقوله تعالى: ﴿وَعَلَى الْوَارِثِ مِثْلُ ذَلِكَ ﴾ (البقرة: ۲۳۳ واسم مشتق معنى، فيجب بناء الحكم على معناه هذا كلامه، ومراده أن في قوله تعالى: ﴿وَعَلَى الْوَارِثِ مِثْلُ ذَلِكَ﴾ (البقرة: ۲۳۳) إشارة إلى العموم فيتناول ما عدا قرابة الولاد، وإشارة إلى أن النفقة على قدر الإرث، ففيه إشارتان.

۳ قوله: فآت ذا القربى حقه وقد نص صاحب الكشاف» و «المدارك» أن في قوله تعالى:فَئَاتِ ذَا الْقُرْبَىٰ حَقَّهُ ﴾ (الروم: ۳۸ دليلا على وجوب نفقة ذوي المحارم كما هو مذهنبا، وقد مضى فيها قبل أن عند الشافعي لا نفقة إلا في قرابة الولاد، وعندنا يجب نفقة كل ذي رحم محرم إذا كان محتاجا عاجزا من الكسب على كل غني قريب بترتيب الإرث والعصبات، على ما عرف في الفقه، كذا في التفسيرات الأحمدية».
