بَابُ النَّظَرِ إِلَى الْمَخْطُوبَةِ وَبَيَانِ الْعَوْرَاتِLooking at the Betrothed and the Limits of Awrah

العربية

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: {فَانكِحُوا مَا طَابَ لَكُم مِّنَ النِّسَاءِ} (النساء: ٣ ، وَقَوْلِهِ تَعَالَى: ﴿يَاأَيُّهَا النَّبِيُّ قُلْ لِأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِنْ جَلَابِيبِهِنَّ ذَلِكَ أَدْنَى أَنْ يُعْرَفْنَ فَلَا يُؤْذَيْنَ} (الأحزاب: ٥٩ ، وَقَوْلِهِ تَعَالَى: {أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ}(النور: ۳۱)

English

And the statement of Allah, the Mighty and Sublime: Marry those that please you of women (An-Nisa: 3), and His statement, the Exalted: O Prophet, say to your wives and your daughters and the women of the believers to bring down over themselves [part] of their outer garments. That is more suitable that they will be known and not be abused (Al-Ahzab: 59), and His statement, the Exalted: Or those whom their right hands possess (An-Nur: 31).

عَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ: إِنِّي تَزَوَّجْتُ امْرَأَةً مِنَ الْأَنْصَارِ، قَالَ: «فَانْظُرْ إِلَيْهَا؛۱ فَإِنَّ فِي أَعْيُنِ الْأَنْصَارِ شَيْئًا». رَوَاهُ مُسْلِمٌ.

English

Abu Hurairah (may Allah be pleased with him) narrated: A man came to the Prophet (ﷺ) and said: I have married a woman from the Ansar. He said: Look at her, for there is something in the eyes of the Ansar [Narrated by Muslim].

1 The statement: Look at her, etc. Scholars have differed regarding the permissibility of looking at a woman one intends to marry. Al-Awza‘i, Ath-Thawri, Abu Hanifah, Ash-Shafi‘i, Ahmad, and Ishaq permitted it absolutely, whether the woman consented or not, based on the hadiths of Jabir and Al-Mughirah. Malik permitted it with her consent, and it is narrated from him that he prohibited it absolutely. If a woman were sent to describe her, it would be more in line with avoiding disagreement. Al-Mirqat and Al-Luma‘at are sourced from this. It is said in Ad-Durr Al-Mukhtar: It is recommended to look at her beforehand.

۱ قوله: فانظر إليها إلخ وللعلماء خلاف في جواز النظر إلى المرأة التي يريد أن يتزوجها، فجوزه الأوزاعي والثوري وأبو حنيفة والشافعي وأحمد وإسحاق مطلقا، أذنت المرأة أم لم تأذن لحديثي جابر واللمغيرة، وجوزه مالك بإذنها، وروى عنه المنع مطلقا، ولو بعث امرأة نصفها له لكان أدخل في الخروج عن الخلاف. «المرقاة» و«اللمعات» ملتقط منهما، وقال في الدر المختار: ويندب النظر إليها قبله.

وَعَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ (رضي الله عنه). قَالَ : خَطَبْتُ امْرَأَةً، فَقَالَ لِي رَسُوْلُ اللَّهِ ﷺ: هَلْ نَظَرْتَ إِلَيْهَا؟ قُلْتُ: لَا ، قَالَ: «فَانْظُرْ إِلَيْهَا، فَإِنَّهُ أَحْرَى أَنْ يُؤْدَمَ بَيْنَكُمَا رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَهِ وَالدَّارِيُّ.

English

Al-Mughirah ibn Shu‘bah (may Allah be pleased with him) narrated: I proposed to a woman, and the Messenger of Allah (ﷺ) said to me: Have you looked at her? I said: No. He said: Then look at her, for it is more likely to foster harmony between you [Narrated by Ahmad, Tirmidhi, Nasa’i, Ibn Majah, and Ad-Darimi].

وَعَنْ جَابِرٍ (رضي الله عنه)قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِذَا خَطَبَ أَحَدُكُمُ الْمَرْأَةَ، فَإِنْ اسْتَطَاعَ أَنْ يَنْظُرَ إِلَى مَا يَدْعُوهُ إِلَى نِكَاحِهَا فَلْيَفْعَلْ». رَوَاهُ أَبُو دَاوُدَ.

English

Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: When one of you proposes to a woman, if he is able to look at what would encourage him to marry her, let him do so [Narrated by Abu Dawud].

وَعَنِ ابْنِ مَسْعُوْدٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَا تُبَاشِرُ الْمَرْأَةُ الْمَرْأَةَ فَتَنْعَتَهَا۱ لِزَوْجِهَا، كَأَنَّهُ يَنْظُرُ إِلَيْهَا». مُتَّفَقٌ عَلَيْهِ.

English

Ibn Mas‘ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: A woman should not touch another woman to describe her to her husband as if he were looking at her [Agreed upon].

1 The statement: To describe her to her husband as if he were looking at her. In Sharh Al-Akmal: Jurists have used this hadith as evidence for the permissibility of forward sales in animals, as it indicates that describing something makes it as if it were seen. Thus, it is something whose characteristics can be precisely defined and its quantity known, like something tangible and observed at the time of sale. Whatever can have its characteristics precisely defined and its quantity known is permissible for forward sale by consensus. I say: The Prophet’s (ﷺ) statements indicate that describing something makes it as if it were seen in what is observed, as evidenced by his saying: As if he were looking at her. The prohibition of forward sales in animals according to Abu Hanifah is not from this perspective, but because animals include internal characteristics that cannot be known by looking at them. Thus, it is something whose characteristics cannot be precisely defined, and what cannot have its characteristics precisely defined is not permissible for forward sale. This is stated in Al-Mirqat.

۱قوله: فتنعتها لزوجها كأنه ينظر إليها في شرح الأكمل: قد استدل الفقهاء بهذا الحديث على جواز السلم في الحيوان؛ لأنه أخبر أن وصف الشيء يجعله كالمعاينة، فكان مما يمكن ضبط صفته ومعرفة مقداره كالمحسوس المشاهد حال البيع، وما أمكن ضبط صفته ومعرفة مقداره جاز السلم فيه بالاتفاق. وأقول: إن أخبار النبي ﷺ يَدُلُّ على أن وصف الشيء يجعله كالمعاينة فيما هو منظور بدليل قوله: كأنه ينظر إليها، وعدم جواز السلم في الحيوان عند أبي حنيفة ليس من تلك الجهة، بل من حيث إن الحيوان يشتمل على أوصاف باطنية، لا يطلع عليها بالنظر إليه، فكان مما لا يمكن ضبط صفته، وما لا يمكن ضبط صفته لا يجوز السلم فيه. قاله في «المرقاة».

وَعَنْ أَبِي سَعِيدٍ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «لَا يَنْظُرُ الرَّجُلُ إِلَى عَوْرَةِ الرَّجُلِ، وَلَا الْمَرْأَةُ إِلَى عَوْرَةِ الْمَرْأَةِ، وَلَا يُفْضِي الرَّجُلُ إِلَى الرَّجُلِ فِي ثَوْبِ وَاحِدٍ، وَلَا تُفْضِي الْمَرْأَةُ إِلَى الْمَرْأَةِ فِي القَوْبِ الْوَاحِدِ». رَوَاهُ مُسْلِمٌ.

English

Abu Sa‘id (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: A man should not look at the private parts of another man, nor a woman at the private parts of another woman. A man should not lie with another man under one cloth, nor a woman with another woman under one cloth [Narrated by Muslim].

English

Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Let no man spend the night with a previously married woman unless he is married to her or is her unmarriageable kin [Narrated by Muslim].

English

Jabir (may Allah be pleased with him) narrated from the Prophet (ﷺ): Do not visit women whose husbands are absent, for the devil runs through one of you like the blood. We said: And you? He said: And me, but Allah has helped me against him, so I am safe [Narrated by Tirmidhi].

Uqbah ibn Amir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Beware of entering upon women. A man said: O Messenger of Allah, what about the in-law? He said: The in-law is death [Agreed upon].

وَعَنْ جَابِرٍ (رضي الله عنه) أَنَّ أُمَّ سَلَمَةَ اسْتَأْذَنَتْ رَسُولَ اللهِ ﷺ فِي الْحِجَامَةِ، فَأَمَرَ۱أَبَا طَيِّبَةً أَنْ يَحْجُمَهَا، قَالَ: حَسِبْتُ۲ أَنَّهُ كَانَ أَخَاهَا مِنَ الرَّضَاعَةِ أَوْ غُلَامًا لَمْ يَحْتَلِمْ. رَوَاهُ مُسْلِمٌ.

English

Jabir (No Allah be pleased with him) narrated that Umm Salamah sought permission from the Messenger of Allah (ﷺ) for cupping, and he ordered Abu Taibah to perform cupping on her. He said: I think he was her foster brother or a boy who had not reached puberty [Narrated by Muslim].

1 The statement: He ordered Abu Taibah to perform cupping on her. For this reason, it is said in Al-Hidayah: It is permissible for a doctor to look at the affected area of her body out of necessity, but it is preferable to teach a woman to treat her. If they cannot, every part of her body should be covered except the affected area. 2 The statement: I think, etc. This is Jabir’s statement, indicating that the need was not absolutely necessary; otherwise, it would be permissible for a non-relative to look at her entire body for treatment. This is stated by At-Tayyibi.

۱قوله: فأمر أبا طيبة أن يحجمها : لذلك قال في «الهداية»: ويجوز للطبيب أن ينظر إلى موضع المرض منها للضرورة، وينبغي أن يعلم امرأة مداواتها، فإن لم يقدروا يستر كل عضو منها سوى موضع المرض.

۲ قوله : حسبت إلخ : هذا قول جابر يدل على أن الحاجة لم تكن ضرورية، وإلا يجوز للأجنبي أن ينظر إلى جميع بدنها للعلاج. قاله الطيبي.

Buraidah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said to Ali: Do not follow one glance with another. The first is for you, but the second is not [Narrated by Ahmad, Tirmidhi, Abu Dawud, and Ad-Darimi].

وَعَنْ أَبِي أُمَامَةَ (رضي الله عنه)، عَنِ النَّبِيِّ ﷺ قَالَ: «مَا مِنْ مُسْلِمٍ يَنْظُرُ إِلَى مَحَاسِنِ امْرَأَةٍ أَوَّلَ مَرَّةٍ ثُمَّ يَغُضُّ بَصَرَهُ إِلَّا أَحْدَثَ اللهُ لَهُ عِبَادَةً يَجِدُ حَلَا وَتَهَا». رَوَاهُ أَحْمَدُ.

English

Abu Umamah (may Allah be pleased with him) narrated from the Prophet (ﷺ): No Muslim looks at the charms of a woman the first time and then lowers his gaze except that Allah grants him worship, the sweetness of which he finds [Narrated by Ahmad].

English

Al-Hasan narrated without a chain: It reached me that the Messenger of Allah (ﷺ) said: Allah has cursed the one who looks and the one who is looked at [Narrated by Al-Bayhaqi in Shu‘ab Al-Iman].

وَعَنْ جَابِرٍ(رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِنَّ الْمَرْأَةَ تُقْبِلُ فِي صُورَةِ شَيْطَانٍ وَتُدْبِرُ فِي صُورَةٍ شَيْطَانٍ، إِذَا أَحَدُكُمْ أَعْجَبَتْهُ الْمَرْأَةُ فَوَقَعَتْ فِي قَلْبِهِ فَلْيَعْمِدْ إِلَى امْرَأَتِهِ فَلْيُوَاقِعْهَا فَإِنَّ ذَلِكَ يَرُدُّ مَا فِي نَفْسِهِ». رَوَاهُ مُسْلِمٌ.

English

Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: A woman approaches in the form of a devil and departs in the form of a devil. If one of you is impressed by a woman and she affects his heart, let him go to his wife and be intimate with her, for that will repel what is in his soul [Narrated by Muslim].

وَعَنِ ابْنِ مَسْعُودٍ (رضي الله عنه) قَالَ: رَأَى رَسُولُ اللهِ ﷺ امْرَأَةً فَأَعْجَبَتْهُ، فَأَتَى سَوْدَةَ وَهِيَ تَصْنَعُ طِيباً وَعِنْدَهَا نِسَاءً فَأَخْلَيْنَهُ، فَقَضَى حَاجَتَهُ ثُمَّ قَالَ: «أَيُّمَا رَجُلٍ رَأَى امْرَأَةً تُعْجِبُهُ فَلْيَقُمْ إِلَى أَهْلِهِ، فَإِنَّ مَعَهَا مِثْلَ الَّذِي مَعَهَا». رَوَاهُ الدَّارِيُّ.

English

Ibn Mas‘ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) saw a woman who impressed him, so he went to Sawdah while she was making perfume, and there were women with her who left. He fulfilled his need, then said: If any man sees a woman who impresses him, let him go to his wife, for she has the same as she has [Narrated by Ad-Darimi].

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ(رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «إِذَا زَوَّجَ أَحَدُكُمْ عَبْدَهُ أَمَتَهُ فَلَا يَنْظُرُ إِلَى عَوْرَتِهَا. رَوَاهُ أَبُو دَاوُدَ.

وَفِي رِوَايَةٍ لِلدَّارَ قُطْنِي عَنْهُ أَنَّ النَّبِيَّ ﷺ قَالَ: «وَإِذَا زَوَّجَ أَحَدُكُمْ أَمَتَهُ عَبْدَهُ أَوْ أَجِيْرَهُ فَلَا يَنْظُرُ إِلَى مَا دُوْنَ السُّرَّةِ وَفَوْقَ الرُّكْبَةِ؛ فَإِنَّ مَا تَحْتَ السُّرَّةِ إِلَى الرُّكْبَةِ مِنَ الْعَوْرَةِ». وَفِي رِوَايَةٍ لَهُ عَنْ عَلَى أَنَّ النَّبِيَّ ﷺ قَالَ: «الرُّكْبَةُ مِنَ الْعَوْرَةِ»، وَرَوَى عَبْدُ الرَّزَّاقِ عَنْ أَنَسٍ ، أَنَّ عُمَرَ ضَرَبَ أَمَةً لِآلِ أَنَسٍ رَآهَا مُتَقَنِّعَةً، فَقَالَ: اكْشِفِي۱ رَأْسَكِ، لَا تَتَشَبَّهِيْ بِالْحَرَائِرِ.

English

Amr ibn Shu‘aib, from his father, from his grandfather (may Allah be pleased with him) narrated from the Prophet (ﷺ): If one of you marries his slave to his female slave, he should not look at her private parts [Narrated by Abu Dawud]. In a narration by Ad-Daraqutni from him, the Prophet (ﷺ) said: If one of you marries his female slave to his slave or his hired man, he should not look at what is below the navel and above the knee, for what is below the navel to the knee is the private part. In another narration by him from Ali, the Prophet (ﷺ) said: The knee is part of the private part. Abdul-Razzaq narrated from Anas that Umar struck a female slave of Anas’s family when he saw her veiled, saying: Uncover your head; do not resemble free women.

وَعَنْ أُمَّ سَلَمَةَ (رضي الله عنهما)، أَنَّهَا كَانَتْ عِنْدَ رَسُوْلِ اللَّهِ ﷺ وَمَيْمُوْنَهُ إِذْ أَقْبَلَ ابْنُ أُمَّ مَكْتُومٍ فَدَخَلَ عَلَيْهِ، فَقَالَ رَسُولُ اللهِ : احْتَجِبَا مِنْهُ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، أَلَيْسَ هُوَ أَعْمَى لَا يُبْصِرُنَا ؟ فَقَالَ رَسُولُ اللهِ ﷺ: «أَفَعَمْيَاوَانِ۱ أَنْتُمَا؟ أَلَسْتُمَا تُبْصِرَانِهِ؟». رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ.

وَرَوَى الْبُخَارِيُّ عَنْ عَائِشَةَ اللهِ قَالَتْ: كَانَ يَوْمُ عِيدٍ يَلْعَبُ السُّودَانُ بِالدَّرَقِ وَالْحِرَابِ، فَإِمَّا سَأَلْتُ رَسُولَ اللهِ ﷺ وَإِمَّا قَالَ: «تَشْتَهِينَ تَنْظُرِينَ؟ فَقَالَتْ: نَعَمْ، فَأَقَامَنِي وَرَاءَهُ خَدِّي عَلَى خَدِّهِ، وَيَقُولُ: «دُوْنَكُمْ بَنِي أَرْفِدَةً حَتَّى إِذَا مَلِلْتُ، قَالَ: «حَسْبُكِ؟» قُلْتُ: نَعَمْ، قَالَ: «فَاذْهَبِي».

English

Umm Salamah (may Allah be pleased with them) narrated: She was with the Messenger of Allah (ﷺ) and Maymunah when Ibn Umm Maktum approached and entered upon him. The Messenger of Allah (ﷺ) said: Veil yourselves from him. I said: O Messenger of Allah, is he not blind and unable to see us? The Messenger of Allah (ﷺ) said: Are you both blind? Do you not see him? [Narrated by Ahmad, Tirmidhi, and Abu Dawud]. Bukhari narrated from Aishah (may Allah be pleased with her): It was a festival day, and the Abyssinians were playing with shields and spears. Either I asked the Messenger of Allah (ﷺ), or he said: Would you like to watch? She said: Yes. He stood me behind him, my cheek against his cheek, and he said: Go on, Banu Arfidah, until I grew tired. He said: Is that enough? I said: Yes. He said: Then go.

1 The statement: Are you both blind? Do you not see him? It is said that this prohibits a woman from looking at a non-relative man absolutely. Some specified it to cases where there is fear of temptation for her, to reconcile it with Aishah’s statement: I was watching the Abyssinians playing with their spears in the mosque. The more correct view is that it is permissible for a woman to look at a man from above the navel to below the knee without desire, as evidenced by Aishah’s statement: I was watching the Abyssinians, and because women used to attend prayers with the Messenger of Allah (ﷺ) in the mosque, and their gaze would inevitably fall on men. If it were not permissible, they would not have been commanded to attend the mosque and prayer ground. Women were commanded to veil from men, but men were not commanded to veil from women. This hadith is understood in the context of piety and righteousness. This is stated in Al-Mirqat. It is said in Al-Hidayah: It is permissible for a woman to look at a man at what a man may look at of another man if she is safe from desire. If there is desire in her heart, or she believes she may desire, or she is uncertain, it is recommended for her to lower her gaze.

Muhammad ibn Hajsh (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) passed by Ma‘mar while his thighs were exposed. He said: O Ma‘mar, cover your thighs, for the thighs are a private part [Narrated by Al-Baghawi in Sharh As-Sunnah].

Ibn Umar (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Beware of being naked, for there are with you those who do not part from you except at the toilet or when a man is intimate with his wife. So be shy of them and honor them [Narrated by Tirmidhi].

This is stated in Al-Mirqat. It is said in Ad-Durr Al-Mukhtar: The fourth condition is covering the private part, and its obligation is general, i.e., in prayer and outside it, even in seclusion, according to the correct view, except for a valid purpose such as defecation, purification, or intimacy.

وَفِي رِوَايَةٍ لِابْنِ مَاجَه عَنْ عَائِشَةَ لها قَالَتْ: مَا نَظَرْتُ أَوْ مَا رَأَيْتُ فَرْجَ رَسُوْلِ الله ﷺ قَط.

Bahz ibn Hakim, from his father, from his grandfather (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Guard your private parts except from your wife or what your right hand possesses. I said: O Messenger of Allah, what if a man is alone? He said: Allah is more deserving of your shyness [Narrated by Tirmidhi, Abu Dawud, and Ibn Majah]. In a narration by Ibn Majah from Aishah, she said: I never looked at or saw the private part of the Messenger of Allah (ﷺ) ever.

It is said in Ad-Durr Al-Mukhtar: A man may look at the private part of his wife or his permissible female slave with or without desire, but it is preferable to avoid it, as it causes forgetfulness. End of quote. It is said in Radd Al-Muhtar: It is said in Al-Hidayah: It is preferable that neither of them looks at the private part of the other, based on the statement: When one of you approaches his wife, let him cover as much as he can and not be completely naked like a donkey. This is because it causes forgetfulness, as it has been narrated. Ibn Umar used to say: It is preferable to look to achieve the fullest sense of pleasure, but in its explanation by Al-Ayni, this is not established from Ibn Umar with a sound or weak chain. Abu Yusuf asked Abu Hanifah about a man touching his wife’s private part and her touching his to arouse each other; he said: No harm, and I hope it brings great reward. This is in Dakhirah. 2 The statement: What if a man is alone? etc. This indicates the obligation of covering in seclusion except out of necessity. This is stated in Al-Mirqat.

وَعَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ قَالَ: حَمَلْتُ حَجَرًا ثَقِيلًا فَبَيْنَا أَمْشِي فَسَقَطَ عَنِّي تَوْبِي فَلَمْ أَسْتَطِعْ أَخْذَهُ، فَرَآنِي رَسُولُ اللهِ ، فَقَالَ لِي: «خُذْ عَلَيْكَ ثَوْبَكَ وَلَا تَمْشُوْا عُرَاةً». رَوَاهُ مُسْلِمٌ.

English

Miswar ibn Makhramah (may Allah be pleased with him) narrated: I was carrying a heavy stone, and while I was walking, my garment fell off me, and I could not pick it up. The Messenger of Allah (ﷺ) saw me and said to me: "Take your garment and do not walk naked" [Narrated by Muslim]

وَعَنْ سَعِيدِ بْنِ الْمُسَيِّبِ قَالَ: لَا يَغُرَّنَكُمُ الْآيَةُ: ﴿إِلَّا مَا مَلَكَتْ أَيْمَانُهُنَّ} إِنَّمَا۱ عَنَى بِهِ الْإِمَاءَ وَلَمْ يَعْنِ بِهِ الْعَبِيدَ. رَوَاهُ أَبِي شَيْبَةَ.

وَحَمَلَ۲ الشَّيْخُ أَبُوْ حَامِدٍ حَدِيثَ فَاطِمَةَ الله عَلَى أَنَّ الْعَبْدَ كَانَ صَغِيْرُ، لِإِطْلَاقِ لَفْظِ الْغُلَامِ، وَلِأَنَّهَا وَاقِعَةُ حَالٍ.

English

Sa‘id ibn al-Musayyib (may Allah be pleased with him) narrated: Do not be deceived by the verse: except those whom their right hands possess. It refers only to female slaves and not to male slaves [Narrated by Abu Shaybah]. The Shaykh Abu Hamid interpreted the Hadith of Fatimah (may Allah be pleased with her) to mean that the slave was young, due to the use of the term "ghulam" (boy) and because it was a specific incident

1 The statement: "It refers only to female slaves, etc." means that her male slave is like a stranger to her, because the risk of temptation from him is like that of a stranger, or even greater due to frequent interaction. The texts prohibiting this are absolute. The meaning of the verse: or those whom their right hands possess [An-Nur: 31] refers to female slaves, not male slaves, as stated by Al-Hasan and Ibn Jubayr. Thus, he may only look at her face and hands. Indeed, he may enter upon her without her permission by consensus, but he may not travel with her by consensus, as stated in "Khulasah." According to Ash-Shafi‘i and Malik, he is like her mahram. This is derived from "Ad-Durr al-Mukhtar" and "Radd al-Muhtar." In "Fatawa Qadikhan," a male slave looking at his free mistress, with no kinship between them, is like a free stranger man; looking at a free stranger woman, he may look at her face and hands but not at what a free stranger man may look at of a free stranger woman, whether he is castrated or not, if he has reached maturity.

۱قوله: إنما عنى به الإماء إلخ : يعني عبدها كالأجنبي معها؛ لأن خوف الفتنة منه كالأجنبي بل أكثر؛ لكثرة الاجتماع، والنصوص المحرمة مطلقة، والمراد من قوله تعالى: ﴿أَوْ مَا مَلَكَتْ أَيْمَنُهُنَّ) (النور: ٣ الإماء دون العبيد. قاله الحسن وابن جبير فينظر لوجهها وكفيها فقط. نعم، يدخل عليها بلا إذنها إجماعًا، ولا يسافر بها إجماعا، «خلاصة»، وعند الشافعي ومالك كمحرمه، الدر المختار و رد المحتار ملتقط منهما. وفي فتاوى قاضيخان والعبد في النظر إلى مولاته الحرة التي لا قرابة بينه وبينها بمنزلة الرجل الأجنبي الحر، ينظر إلى وجهها وكفيها، ولا ينظر إلى ما ينظر الأجنبي الحر من الأجنبية الحرة، سواء كان العبد خصياً أو فحلا إذا بلغ مبلغ الرجال.

وَعَنْ أُمِّ سَلَمَةَ(رضي الله عنها) ، أَنَّ النَّبِيَّ ﷺ كَانَ عِنْدَهَا وَفِي الْبَيْتِ مُخَنَّةٌ، فَقَالَ لِعَبْدِ اللَّهِ بْنِ أَبِي أُمَيَّةَ أَخِي أُمِّ سَلَمَةَ: يَا عَبْدَ اللَّهِ، إِنْ فَتَحَ اللهُ لَكُمْ غَدًا الطَّائِفَ فَإِنِّي أَدُلُّكَ عَلَى بِنْتِ غَيْلَانَ، فَإِنَّهَا تُقْبِلُ بِأَرْبَعٍ وَتُدْبِرُ بِثَمَانٍ، فَقَالَ النَّبِيُّ ﷺ: «لَا يَدْخُلَنَّ هَؤُلَاءِ عَلَيْكُنَّ»۱. مُتَّفَقٌ عَلَيْهِ.

وَقَوْلِ الله عز وجل: {حَتَّى۱ تَنكِحَ زَوْجًا غَيْرَهُ} (البقرة: ۲۳۰) ، وَقَوْلِهِ تَعَالَى: {أَن يَنكِحْنَ أَزْوَاجَهُنَّ} (البقرة: ۲۳۲ ، وَقَوْلِهِ تَعَالَى: ﴿فَلَا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ فِي أَنفُسِهِنَّ} (البقرة: ٢٣٤)

Umm Salamah (may Allah be pleased with her) narrated: The Prophet (ﷺ) was at her house, and there was a effeminate man in the house. He said to Abdullah ibn Abi Umayyah, the brother of Umm Salamah: "O Abdullah, if Allah grants you victory at Ta’if tomorrow, I will guide you to the daughter of Ghaylan, for she approaches with four and retreats with eight." The Prophet (ﷺ) said: "These people should not enter upon you" [Agreed upon]

And the saying of Allah, the Mighty, the Exalted: until she marries another husband [Al-Baqarah: 230], and His saying, the Exalted: that they marry their husbands [Al-Baqarah: 232], and His saying, the Exalted: there is no blame upon you for what they do with themselves [Al-Baqarah: 234]

1 The statement: "until she marries, etc." attributes the contract in these verses to them, indicating that a woman can directly engage in marriage, as it is a transaction concerning her exclusive right, and she is capable of it, being rational and mature. This is why she is permitted to manage her wealth and choose her husbands by consensus. Thus, there is no sense in denying the contract’s validity based on her expression, and requiring a guardian for its validity is the utmost limit. The guardian has the right to object if she falls short, such as marrying someone not her equal or for less than the dowry of her peers. The Hadiths of the opponents, according to us, are interpreted as referring to the marriage of a non-competent woman or one who cannot manage affairs, to reconcile the evidence, or as negating perfection and obligation. This is supported by the fact that Aishah (may Allah be pleased with her), one of the narrators of the Hadith requiring a guardian, married Hafsah, the daughter of her brother Abdul Rahman, who was absent in Sham, as narrated by Malik in "Al-Muwatta," as stated in "Umdat ar-Ri‘ayah"

۱ قوله : لا يدخلن هؤلاء عليكم لذلك قال في الدر المختار والخصي والمجبوب والمخنث في النظر إلى الأجنبية كالفحل.

۱ قوله: حتى تنكح إلخ : أضاف العقد في هذه الآيات إليهن، فدل على أنها تملك المباشرة بالنكاح مع أن النكاحتصرف في خالص حقها، وهي من أهله؛ لكونها عاقلة بالغة، ولهذا أجاز له التصرف في الأموال، واختيار الأزواج اتفاقا فلا معنى؛ لعدم انعقاده بعبارتها، ولاشتراط الولي لصحته غاية ما في الباب أن يكون للولي حق الاعتراض إذا قصرت في أمر بأن تزوجت بغير كفؤ أو بأقل من مهر المثل، وأحاديث الخصوم عندنا محمولة على النكاح الغير المكلفة، ومن لا يملك التصرف جمعا بين الأدلة أو على نفي الكمال ونفي اللزوم، ويؤيده أن عائشة له ، وهي أحد رواة حديث اشتراط الولي، زوجت حفصة بنت أخيها عبد الرحمن، وهو غائب بالشام، كما أخرجه مالك في الموطأ. كذا في عمدة الرعاية».
