بَابُ إِحْيَاءِ الْمَوَاتِ وَالشَّرْبِReviving Dead Land and Water Rights
وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: وَنَبِّئْهُمْ أَنَّ الْمَاءَ۱ قِسْمَةٌ بَيْنَهُمْ كُلُّ شِرْبٍ مُحْتَضَرٌ (القمر : ٢٨) ، وَقَوْلِهِ تَعَالَى: لَهَا۲ " شِرْبٌ وَلَكُمْ شِرْبُ يَوْمٍ مَّعْلُومٍ (الشعراء: ١٥٥)
۱قوله: إن الماء قسمة إلخ : وفي البزدوي»: واحتج محمد في تصحيح المهاياة والقسمة بقوله تعالى: ﴿ وَنَبِّئُهُمْ أَنَّ الْمَاءَ قِسْمَةٌ بَيْنَهُمْ (القمر : ۲۸ ، وقال الله تعالى: ﴿لَهَا شِرْبٌ وَلَكُمْ شِرْبُ يَوْمٍ مَّعْلُومٍ ﴾ (الشعراء: ١٥٥). كذا في التفسيرات الأحمدية».
۲ قوله : لها شرب ولكم شرب يوم معلوم هذا دليل على جواز المهاياة. قاله في «المدارك».
And the statement of Allah, the Mighty, the Exalted: And inform them that the water is to be shared between them, each share attended [Surah Al-Qamar: 28], and His statement: It has its share, and you have your share on a known day [Surah Ash-Shu’ara: 155].
1 The statement: That the water is to be shared, etc., in Al-Bazdawi: Muhammad used this verse to validate water sharing and division, as Allah says: And inform them that the water is to be shared between them [Surah Al-Qamar: 28], and Allah says: It has its share, and you have your share on a known day [Surah Ash-Shu’ara: 155]. As stated in Tafsir Al-Ahmadiyyah.2 The statement: It has its share, and you have your share on a known day, this is evidence for the permissibility of water sharing. As stated in Al-Madarak.
وَعَنْ عَائِشَةَ (رضي الله عنها) عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ عَمَرَ أَرْضًا لَيْسَتْ لِأَحَدٍ فَهُوَ۱ أَحَقُّ بِهَا ». قَالَ عُرْوَةُ: قَضَى بِهِ عُمَرُ فِي خِلَافَتِهِ. رَوَاهُ الْبُخَارِيُّ.
وَرَوَى الطَّبَرَانِيُّ فِي مُعْجَمِهِ الْكَبِيْرِ وَالْوَسْطِ عَنْ مُعَادٍ الله أَنَّ النَّبِيَّ ﷺ قَالَ: «إِنَّمَا لِلْمَرْءِ مَا طَابَتْ بِهِ نَفْسُ إِمَامِهِ».
وَفِي رِوَايَةٍ لِلْبُخَارِيِّ عَنِ ابْنِ عَبَّاسِ لا أَنَّ الصَّعْبَ بْنَ جَنَّامَةَ قَالَ: سَمِعْتُ رَسُوْلَ اللهِ ﷺ يَقُولُ: «لَا حِمَى۲ إِلَّا لِلَّهِ وَلِرَسُولِهِ».
Aishah (may Allah be pleased with her) narrated that the Prophet (ﷺ) said: “Whoever cultivates land that belongs to no one, he is most entitled to it.” Urwah said: Umar judged by this during his caliphate. [Narrated by Bukhari]
At-Tabarani narrated in his Mu’jam Al-Kabir and Al-Wasat from Mu’adh (may Allah be pleased with him) that the Prophet (ﷺ) said: “A man only has what his leader willingly gives him.”
In a narration by Bukhari from Ibn Abbas (may Allah be pleased with him), As-Sa’b ibn Jathamah said: I heard the Messenger of Allah (ﷺ) say: “There is no protected land except for Allah and His Messenger.”

However, Abu Hanifah (may Allah be pleased with him) stipulated the leader’s permission, while his two companions, Shafi’i, and Ahmad disagreed, citing the generality of the narration. The narration: A man only has what his leader willingly gives him indicates the condition of permission, so the general is interpreted by it, as they relate to the same incident. Abu Hanifah also cited: There is no protected land except for Allah and His Messenger in the two Sahihs, where “protected land” refers to land reserved. This indicates that the authority over lands belongs to the leaders, not others. This is supported by what Ahmad narrated from Samurah ibn Jundub and At-Tahawi from Muhammad ibn Ubaydullah ibn Sa’id Abu Awn Ath-Thaqafi Al-A’war Al-Kufi, a Tabi’i, who said: A man from the people of Basra, called Abu Abdullah, went to Umar (may Allah be pleased with him) and said: “In the land of Basra, there is land that does not harm any Muslim and is not taxable land. If you wish, grant it to me, and I will make it into reeds and olives.” Umar wrote to Abu Musa: If it is protected land, grant it to him. Do you not see that Umar did not allow him to take it or own it except by the caliph’s grant? If it were otherwise, he would have said: “Why do you need my grant? Protect it, cultivate it, and own it.” This indicates that revival, according to Umar (may Allah be pleased with him), is what the leader permits for the one who undertakes it and grants ownership. It is also argued with the narration: The land belongs to Allah and His Messenger, then to you after me. Whoever revives something from the dead land, its title is his, narrated by Abu Yusuf in Kitab Al-Kharaj. Since it is attributed to Allah and His Messenger, it cannot be exclusively owned except with the leader’s permission. Summarized from Al-Marqah, Umdat Al-Qari, and Al-Binayah. On the first, no governor after him can protect land. On the second, it is exclusive to the caliph. Al-Hafiz said: Shafi’i’s companions derived two opinions from this, with the second being more likely among them, though the first is closer to the apparent wording. Some Shafi’is included regional governors with the caliph. Al-Hafiz said: Permissibility is general if it does not harm all Muslims. The Imam, even if equated with the Prophet (ﷺ), cannot protect land for himself, as per Malik, Shafi’is, and Hanafis. They said: He protects it for the Muslims’ horses and livestock, especially for the weak among them, as Umar (may Allah be pleased with him) did.
۱ قوله : فهو أحق أي صار تلك الأرض مملوكة له، لكن إذن الإمام شرط له عند أبي حنيفة الله، وخالفه صاحباه والشافعي وأحمد محتجين بإطلاق الحديث، وفيه أن قوله : ليس للمرأ إلا ما طابت به نفس إمامه» يدلُّ على اشتراط الإذن، فيحمل المطلق عليه؛ لأنهما في حادثة واحدة، واحتج أيضًا أبو حنيفة بقوله ﷺ : لا حمى إلا الله ورسوله، في الصحيحين، والحمى : ما حمي من الأرض، فدل أن حكم الأرضين إلى الأئمة لا إلى غيرهم. ويؤيد هذا ما رواه أحمد عن سمرة بن جندب، والطحاوي عن محمد بن عبيد الله بن سعيد أبي عون الثقفي الأعور الكوفي التابعي قال: خرج رجل من أهل البصرة يقال له: أبو عبد الله إلى عمر الله، فقال: إن بأرض البصرة أرضا لا تضر بأحد من المسلمين، وليست بأرض خراج، فإن شئت أن تقطعنيها أتخذها قضبا وزيتونا، فكتب عمر إلى أبي موسى أن كانت حمى فأقطعها إياه، أفلا ترى أن عمر الله لم يجعل له أخذها، ولا جعل له ملكها إلا بإقطاع خليفة ذلك الرجل إياها، ولو ذلك لكان يقول له: وما حاجتك إلى إقطاعي إياك تحميها وتعمرها فتمكلها، فدل ذلك أن الإحياء عند عمر الله وهو ما أذن الإمام فيه للذي يتولاه ويمكله إياه.
وأيضًا استدل له بحديث: الأرض الله ورسوله ثم لكم من بعدي، فمن أحيى شيئًا من موتات الأرض فله رقبتها ، أخرجه أبو يوسف في كتاب الخراج؛ فإنه إضافه إلى الله ورسوله، وكل ما أضيف إلى الله ورسوله لا يجوز أن يختص به إلا بإذن الإمام المرقاة» و «عمدة القاري» و «البناية» ملتقط منها. وقال في رد المحتار: وقول الإمام هو المختار، ولذا قدمه في الخانية» و«الملتقى كعادتها، وبه أخذ الطحاوي، وعليه المتون، انتهى. وقال في «الدر المختار: هذا لو مسلما، فلو ذميًا شرط الإذن اتفاقا، ولو مستأمنا لم يملكها أصلا اتفاقا.
۲ قوله : لا حمى إلا الله ورسوله : أي لا حمى لأحد يخص نفسه يرعى فيه ماشيته دون سائر الناس؛ لأن فيه منع الكلا وهو ممنوع، وإنما هو الله ولرسوله ولمن ورد ذلك عنه من الخلفاء بعده إذا احتاج إلى ذلك لمصلحة المسلمين، كما فعل الصديق والفاروق وعثمان لما احتاجوا إلى ذلك، عمدة القاري ملخصا. وقال في نيل الأوطار»: لا حمى إلا الله ولرسوله قال الشافعي: يحتمل معنى الحديث شيئين، أحدهما : ليس لأحد أن يحمي للمسلمين إلا ما حماه النبي ، والآخر: معناه إلا على مثل ما حماه عليه النبي ، فعلى الأول ليس لأحد من الولاة بعده أن يحمي، وعلى الثاني يختص الحمى بمن قام مقام رسول الله ، وهو الخليفة خاصة. قال في «الفتح»: وأخذ أصحاب الشافعي من هذا أن له في المسألة قولين، والراجح عندهم الثاني، والأول أقرب إلى ظاهر اللفظ. ومن أصحاب الشافعي من ألحق بالخليفة ولاة الأقاليم. قال الحافظ ومحل الجواز مطلقا أن لا يضر بكافة المسلمين اهـ. ولا يجوز للإمام على فرض إلحاقة بالنبي ﷺ وأن يحمي لنفسه، وإلى ذلك ذهب مالك والشافعية والحنفية، قالوا: بل يحمي الخيل المسلمين وسائر أنعامهم، ولا سيما أنعام من ضعف منهم، كما فعله عمر (رضي الله عنه).
وَعَنْ طَاوُسٍ مُرْسَلًا أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «مَنْ أَحْيَا مَوَاتًا مِنَ الْأَرْضِ فَهُوَ لَهُ وَعَادِيُّ الْأَرْضِ لِلَّهِ وَلِرَسُوْلِهِ، ثُمَّ هِيَ۱ لَكُمْ مِنِّي». رَوَاهُ الشَّافِعِيُّ.
وَرَوَى فِي شَرْحِ السُّنَّةِ»: أَنَّ النَّبِيَّ ﷺ أَقْطَعَ۲ لِعَبْدِ اللَّهِ بْنِ مَسْعُودٍ الدُّورَ بِالْمَدِينَةِ، وَهِيَ بَيْنَ ظَهْرَانَيْ عِمَارَةِ الْأَنْصَارِ مِنَ النَّازِلِ وَالنَّخْلِ، فَقَالَ بَنُو عَبْدِ بْنِ زُهْرَةً: نَكَبَ عَنَّا ابْنُ أُمَّ عَبْدٍ، فَقَالَ لَهُمْ رَسُولِ اللهِ : فَلِمَ ابْتَعَثَنِي اللَّهُ إِذَا، إِنَّ اللَّهَ لَا يُقَدِّسُ أُمَّةً لَا يُؤْخَذُ لِلضَّعِيْفِ فِيهِمْ حَقَّهُ».
Tawus narrated in a mursal form that the Messenger of Allah (ﷺ) said: “Whoever revives dead land, it is his, and the barren land belongs to Allah and His Messenger, then it is for you from me.” [Narrated by Shafi’i]
In Sharh As-Sunnah: The Prophet (ﷺ) granted Abdullah ibn Mas’ud houses in Madinah, located among the Ansar’s buildings, between their dwellings and palm trees. Banu Abd ibn Zuhrah said: “Ibn Umm Abd has encroached upon us.” The Messenger of Allah (ﷺ) said to them: “Why then did Allah send me? Allah does not sanctify a nation where the weak among them are not given their rights.”

1 The statement: Then it is for you from me, I say: This indicates the condition of the leader’s permission for reviving dead land. 2 The statement: Granted Abdullah ibn Mas’ud houses in Madinah, etc., if a Muslim or non-Muslim under protection revives barren land that has no owner, far from the village such that if someone stood at the edge of the inhabited area and shouted, his voice would not be heard, he owns it according to Abu Yusuf, which is the chosen opinion, as stated in Al-Mukhtar and others. Muhammad considered the lack of benefit to the village’s residents, so it is not permissible to revive land they benefit from, even if far, but it is permissible to revive land they do not benefit from, even if near the inhabited area. وَعَنِ الْحَسَنِ عَنْ سَمُرَةَ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ أَحَاطَ حَائِطًا عَلَى أَرْضِ فَهِيَ لَهُ۱. رَوَاهُ أَبُوْ دَاوُدَ.
Al-Hasan narrated from Samurah (may Allah be pleased with him) that the Prophet (ﷺ) said: “Whoever surrounds a piece of land with a wall, it is his.” [Narrated by Abu Dawud]

The marginal note says: The apparent narration indicates that surrounding is sufficient for ownership, which is Ahmad’s more well-known opinion, provided the wall is strong as per custom. Most scholars hold that ownership is by revival, and enclosing is not revival. The narration is interpreted as revival for residence. Al-Qari said: An-Nawawi said: If he intends an enclosure for livestock or a yard to dry fruits or gather firewood and grass, enclosing is required, and setting up markers or stones without building is insufficient. I say: In Al-Bada’i: If he encloses dead land, he does not own it by consensus, as dead land is owned by revival. I say: In Al-Hidayah: Enclosing is not revival to own it, as revival is cultivation, and enclosing is for marking, named so because they marked it with stones or to prevent others from reviving it. Thus, it remains unowned as it was, which is the correct view.

قلت: قال في «البدائع»: ولو حجر الأرض الموات لا يملكها بالإجماع؛ لأن الموات يملك بالإحياء؛ لأنه عبارة عن وضع أحجار أو خط حولها يريد أن يحجر غيره عن الاستيلاء عليها، وشيء من ذلك ليس بإحياء، فلا يملكها، لكن صار أحق بها من غيره حتى لم يكن لغيره أن يزعجه، ولأنه سبقت يده إليه، والسبق من أسباب الترجيح في الجملة. قال النبي : منى مناخ من سبق. كذا في بذل المجهود». وقال في «رحمة الأمة»: وبأي شيء تملك الأرض، ويكون إحياؤها به؟ قال أبو حنيفة وأحمد بتحجيرها، وأن يتخذ لها ماء، وفي الدار بتحويطها وإن لم يسقفها. وقال مالك: بما يعلم بالعادة أنه إحياء لمثلها من بناء وغراس وحفر بئر وغير ذلك. وقال الشافعي: إن كانت للزرع فبزرعها واستخراج مائها، وإن كانت للسكنى فبتقطيعها بيوتا وتسقيفها. قلت: وقال في «الهداية»: إن التحجير ليس بإحياء ليملكه به؛ لأن الإحياء إنما هو العمارة، والتحجير للإعلام، سمى به؛ لأنهم كانوا يعلمونه بوضحالأحجار حوله أو يُعلمونه لحجر غيرهم عن إحيائه، فبقي غير مملوك كما كان، هو الصحيح.
وَعَنْ سَمُرَةَ بْنِ جُنْدُبٍ (رضي الله عنه) أَنَّهُ كَانَتْ لَهُ عَضُدُ مِنْ نَخْلٍ فِي حَائِطِ رَجُلٍ مِنَ الْأَنْصَارِ، قَالَ: وَمَعَ الرَّجُلِ أَهْلُهُ ، فَكَانَ سَمُرَةُ يَدْخُلُ عَلَيْهِ، فَيَتَأَذَّى بِهِ وَيَشُقُّ عَلَيْهِ، فَطَلَبَ إِلَيْهِ أَنْ يَبِيعَهُ فَأَبَى، فَطَلَبَ إِلَيْهِ أَنْ يُنَاقِلَهُ فَأَبَى، فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ، فَطَلَبَ إِلَيْهِ النَّبِيُّ ﷺ أَنْ يَبِيعَهُ فَأَبَى، فَطَلَبَ إِلَيْهِ أَنْ يُنَاقِلَهُ فَأَبَى، قَالَ: «فَهِبْهُ لَهُ وَلَكَ كَذَا وَكَذَا أَمْرًا رَغَبَهُ فِيهِ فَأَبَى، فَقَالَ: «أَنْتَ مُضَارٌ»، فَقَالَ لِلْأَنْصَارِيِّ: «اذْهَبْ [فَاقْلَعْ] نَخْلَهُ»۱. رَوَاهُ أَبُو دَاوُدَ.
Samurah ibn Jundub (may Allah be pleased with him) narrated that he had a cluster of palm trees in an Ansari man’s garden, and the man had his family there. Samurah would enter, causing the man discomfort and hardship. He asked him to sell it, but he refused. He asked him to exchange it, but he refused. Samurah went to the Prophet (ﷺ) and informed him. The Prophet (ﷺ) asked the man to sell it, but he refused. He asked him to exchange it, but he refused. He said: “Gift it to him, and you will have such and such,” enticing him, but he refused. He said: “You are causing harm.” He said to the Ansari: “Go and uproot his palm trees.” [Narrated by Abu Dawud]

1 The statement: Uproot his palm trees, he ordered the Ansari to uproot the palm trees because it was clear that Samurah was harming him, as it was known that they were planted on borrowed land. As stated in Al-Marqah. In Al-Hidayah: If someone borrows land to build or plant, it is permissible, and the lender can retract and require the removal of the building or plants.

وَعَنْ أَبْيَضَ بْنِ حَمَّالِ الْمَارِبِيِّ (رضي الله عنه) أَنَّهُ وَفَدَ إِلَى رَسُولِ اللَّهِ ﷺ فَاسْتَقْطَعَهُ الْمِلْحَ الَّذِي بِمَأْرِبَ [ فَقَطَعَهُ لَهُ ۱] ، فَلَمَّا وَلَّى قَالَ رَجُلٌ : يَا رَسُولَ اللَّهِ، إِنَّمَا قَطَعْتَ لَهُ الْمَاءَ الْعِدَّ، قَالَ: فَرَجَعَهُ۲ مِنْهُ، قَالَ: وَسَأَلَهُ عَمَّا يُحْمَى مِنَ الْأَرَاكِ، قَالَ: «مَا لَمْ تَنَلْهُ۳ أَخْفَافُ الْإِبِلِ». رَوَاهُ التَّرْمِذِيُّ وَابْنُ مَاجَهِ وَالدَّارِمِيُّ.
Abyad ibn Hammal Al-Maribi (may Allah be pleased with him) narrated that he came to the Messenger of Allah (ﷺ) and requested the salt mine in Ma’rib, which he granted. When he turned away, a man said: “O Messenger of Allah, you have granted him flowing water.” So he revoked it from him. He asked about what could be protected from the arak trees, and he said: “What the camels’ hooves cannot reach.” [Narrated by Tirmidhi, Ibn Majah, and Ad-Darimi]

Granting means designating some dead lands for specific individuals, whether minerals or land, making them more entitled to it than others, provided it is from dead lands not exclusively owned. As stated in Nayl Al-Awtar. 2 The statement: He revoked it from him, hence they said: The leader cannot grant what the Muslims cannot do without, such as salt or wells from which people draw water. What is surface-level and obtained without labor or effort cannot be granted, as people share in it, like grass and valley waters. If the judge rules and it becomes clear that the truth is otherwise, his ruling is overturned, and he retracts it. 3 The statement: What the camels’ hooves cannot reach, I say: This indicates that granting and revival are restricted to what is not tied to public interests. The narration indicates that revival is not permissible except with the leader’s permission, otherwise it would not have been revoked from him. Understand. As stated in Ath-Thawb Al-Hali.
۱ قوله: فقطع له: أحاديث الباب تدل على أنه يجوز للنبي الله ولمن بعده من الأئمة اقطاع للمعادين. والمراد بالإقطاع جعل بعض الأراضي الموات مختصة ببعض الأشخاص، سواء كان ذلك معدنا أو أرضًا، فيصير ذلك البعض أولى به من غيره، ولكن بشرط أن يكون من الموات التي لا يختص بها أحد، وهذا أمر متفق عليه. قاله في نيل الأوطار».
۲ قوله: فرجعه منه ولهذا قالوا: لا يملك الإمام أن يقطع ما لا غنى للمسلمين عنه كالملح، والآبار يستسقى منها الناس. كذا في تكملة البحر الرائق». وقال في المرقاة: ومن ذلك عُلم أن إقطاع المعادن إنما يجوز إذا كانت باطنة لا ينال منها شيء إلا بتعب ومؤنة، كالملح والنفط والفيروزج والكبريت ونحوها، وما كانت ظاهرة يحصل المقصود منها من غير كد وصنعة لا يجوز إقطاعها، بل الناس فيها شريك كالكلاً ومياه الأودية. وإن الحاكم إذا حكم ثم ظهر أن الحق في خلافه ينقض حكمه، ويرجع عنه.
۳قوله: ما لم تنله أخفاف الإبل : قلت : دل على أن الاستقطاع والإحياء مخصوص بما لم يتعلق به المصالح العامة. ودل الحديث على أن الإحياء لا يجوز إلا بإذن الإمام، وإلا لم ينتزع منه، فافهم. كذا في الثوب الحلي».
وَعَنْ أَسْمَاءَ بِنْتِ أَبِي بَكْرٍ (رضي الله عنهما) أَنَّ رَسُولَ اللَّهِ ﷺ أَقْطَعَ۱ لِلزُّبَيْرِ نَخْيَلًا. رَوَاهُ أَبُو دَاوُدَ.
وَرَوَى۲ الْبُخَارِيُّ فِي آخِرِ كِتَاب الْخُمْسِ مِنْ حَدِيْثِ أَسْمَاءَ اها : أَنَّ النَّبِيَّ ﷺ أَقْطَعَ لِلزُّبَيْرِ أَرْضًا مِنْ أَمْوَالِ بَنِي النَّضِيْرِ.
Asma bint Abi Bakr (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) granted Zubair palm groves. [Narrated by Abu Dawud]
Bukhari narrated at the end of the Book of Khums from Asma (may Allah be pleased with her) that the Prophet (ﷺ) granted Zubair land from the wealth of Banu Nadir.

The Shafi’i and Maliki view, as An-Nawawi said: The leader may grant land owned by the public treasury that no one owns except by the leader’s grant. Sometimes he grants its title, and the person owns it for a beneficial purpose, so it is permissible to own it like owning coins or other items given. Sometimes he grants its benefit, so the person is entitled to benefit from it for the duration of the grant. As for dead land, anyone may revive it without needing the leader’s permission. The Hanafi view on granting, as stated in Al-Bada’i: Lands are of two types: owned and unowned permissible land. Owned land is of two types: inhabited and ruined. Permissible land is of two types: part of the town’s utilities, such as firewood or grazing for livestock, and what is not part of its utilities, called dead land. Owned inhabited land cannot be disposed of without the owner’s permission, as the sanctity of ownership prevents it. Dead land outside the town, not owned or exclusively entitled to anyone, is not dead land if within the town. The granting to Zubair is evidence for Abu Hanifah (may Allah be pleased with him), as this granting is either from the fifth that is his share or from dead land that no one owns, owned by revival. This is supported by what is in Bukhari’s narration afterward. 2 The statement: Bukhari narrated, etc., it specifies the mentioned land as being from what Allah bestowed on His Messenger from the wealth of Banu Nadir, so he granted Zubair from it. This resolves Al-Khattabi’s confusion, where he said: I do not know how the Prophet (ﷺ) granted land in Madinah when its people embraced Islam willingly, unless it refers to what the Ansar gave to the Prophet (ﷺ) from their land that water did not reach, so he granted it to whomever he wished. والمملوكة نوعان: عامرة وخراب، والمباحة نوعان أيضًا: نوع هو من مرافق البلدة محتطبا لهم ومرعى لمواشيهم، ونوع ليس من مرافقها، وهو المسمى بالموات. وأما الأراضي المملوكة العامرة، فليس لأحد أن يتصرف فيها من غير إذن صاحبها؛ لأن عصمة الملك تمنع من ذلك. وأما أرض الموات وهي أرض خارج البلد لم تكن ملكا لأحد ولا حقا له خاصا، فلا يكون داخل البلد موات أصلا، وكذا ما كان خارج البلدة من مرافقها محتطبا بها لأهلها أو مرعى لهم لا يكون مواتا حتى لا يملك الإمام إقطاعها، فالإمام يملك إو قطاع الموات من مصالحالمسلمين لما يرجع ذلك إلى عمارة البلاد، والتصرف فيما يتعلق بمصالح المسلمين للإمام ككري الأنهار العظام وإصلاح قناطرها ونحوه. ولو أقطع الإمام الموات إنسانًا فتركه ولم يعمره لا يتعرض له إلى ثلاث، فإذا مضى ثلاث سنين فقد عاد مواتا كما كان، وله أن يقطعه غيره؛ لقوله : ليس المحتجر بعد ثلاث سنين حق اهـ. ففي إقطاع الزبير دليل لأبي حنيفة لله؛ لأن هذا الإقطاع يكون من الخمس الذي سهمه، أو أن يكون من الموات الذي لم يملكه أحد فيتملك بالإحياء. قاله في المرقاة»، ويؤيده ما وقع في رواية البخاري بعد ذلك.

وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) أَنَّ النَّبِيَّ ﷺ أَقْطَعَ لِلزُّبَيْرِ حُضْرَ فَرَسِهِ، فَأَجْرَى فَرَسَهُ حَتَّى قَامَ، ثُمَّ رَمَى بِسَوْطِهِ، فَقَالَ: «أَعْطُوهُ۱ مِنْ حَيْثُ بَلَغَ السَّوْطُ». رَوَاهُ أَبُو دَاوُدَ.

In At-Tawdih: The prohibition is for unlawfulness according to Malik and Al-Awza’i, and Al-Khattabi and Ibn At-Tin narrated it from Shafi’i. Some preferred it and interpreted it as recommended. The correct view among us is that it is obligatory to provide it for livestock, not for crops, as stated by Al-Ayni. He said: This is also the Hanafi view, specific to livestock. In Al-Hidayah: It is not permissible to sell or lease pastures, meaning grass, as per the statement: People are partners in three: fire, grass, and water. Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “There are three whom Allah will not speak to or look at on the Day of Resurrection: a man who swore about a commodity, claiming he was given more than he was, and he lied; a man who swore a false oath after Asr to seize a Muslim’s wealth; and a man who withheld excess water. Allah will say: ‘Today, I withhold My favor from you as you withheld the excess of what your hands did not make.’” [Agreed upon]

1 The statement: In water, grass, and fire, water refers to that in rivers and wells. If taken and placed in a vessel, it is contained, so selling it is permissible. Grass refers to what grows in unowned land or in owned land without the owner’s cultivation. If the owner cultivates it by watering and preparing the land, the narrations differ. In Adh-Dhakhirah and Al-Muhit: If he sells grass in his land that he cultivated by watering for the sake of the grass, and it grew with his effort, it is permissible, as he owns it. No one can take it without his permission. If it grew naturally, it is not permissible, as it is not owned by him but is permissible by default, as anyone can take it. In Al-Quduri: Selling grass in its land is not permissible, even if he brought water to his land and incurred expenses, as the partnership in grass is established naturally, and partnership ends only by containment. Aishah (may Allah be pleased with her) narrated that she said: “O Messenger of Allah, what is the thing that is not lawful to withhold?” He said: “Water, salt, and fire.” She said: “O Messenger of Allah, we understand water, but what about salt and fire?” He said: “O little red one, whoever gives fire is as if he gave charity with all that the fire cooked. Whoever gives salt is as if he gave charity with all that the salt seasoned. Whoever gives a Muslim a drink of water where water is available, it is as if he freed a slave. Whoever gives a Muslim a drink of water where water is not available, it is as if he brought him to life.” [Narrated by Ibn Majah]

Urwah narrated that Zubair disputed with an Ansari man over a stream in Al-Harrah. The Prophet (ﷺ) said: “Water, O Zubair, then send the water to your neighbor.” The Ansari said: “Because he is your cousin?” His face changed color, then he said: “Water, O Zubair, then hold the water until it reaches the wall, then send the water to your neighbor.” The Prophet (ﷺ) upheld Zubair’s right explicitly in the ruling when the Ansari provoked him. 1 The statement: Water, O Zubair, then hold the water until it reaches the wall, then send the water to your neighbor, means that no one can block the river from the lower land, but he takes his share, as blocking introduces something new in the middle of the river, and the river’s title is shared among them. No one can do that without the partners’ permission. If they agree that the upper land blocks the river to take his share and they settle that each blocks it in turn, it is permissible, as the impediment is their right, and it is removed by their agreement. If they can block it with a board or gate, he cannot block it with mud or dirt, as that harms the partners. If the water in the river is such that it does not flow to each one’s land except by blocking, the upper land starts until it is irrigated, then the next, and the upper land cannot prevent it from the lower land. As stated in Takmilah Al-Bahr Ar-Ra’iq.
۱ قوله: اسق يا زبير ثم احبس الماء حتى يرجع إلى الجدر ثم أرسل الماء إلى جارك يعني ليس لأحدهم أن يسكر النهر على الأسفل ولكن يشرب حصته؛ لأن في السكر إحداث شيء لم يكن في وسط النهر، ورقبة النهر مشترك بينهم، فلا يجوز لأحدهم أن يفعل ذلك بغير إذن الشركاء، فإن تراضوا على أن الأعلى يسكر النهر حتى يشرب بحصته، واصطلحوا أن يسكر كل واحد في نوبته جاز؛ لأن المانع حقهم، وقد زال ذلك بتراضيهم، ولكن إن أمكنهم أن يسكر بلوح أو باب فليس له أن يسكر ذلك بالطين والتراب؛ لأن به ضررًا بالشركاء. ولو كان الماء في «النهر» بحيث لا يجري إلى أرض كل واحد منهم إلا بالسكر، فإنه يبدأ بالأعلى حتى يروي، ثم بالذي بعده كذلك، وليس لأهل الأعلى أن يمنعوه من أهل الأسفل. كذا في تكملة البحر الرائق».
وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ (رضي الله عنه)، أَنَّ رَسُوْلَ اللهِ ﷺ قَضَى فِي السَّيْلِ الْمَهْزُورِ أَنْ يُمْسَكَ ۱ حَتَّى يَبْلُغَ الْكَعْبَيْنِ، ثُمَّ يُرْسِلُ الْأَعْلَى عَلَى الْأَسْفَلِ. رَوَاهُ أَبُوْ دَاوُدَ وَابْنُ مَاجَه. قَالَ مُحَمَّدٌ: وَبِهِ نَأْخُذُ؛ لِأَنَّهُ كَانَ كَذَلِكَ الصُّلْحُ بَيْنَهُمْ لِكُلِّ قَوْمٍ مَا اصْطَلَحُوْا وَأَسْلَمُوا عَلَيْهِ مِنْ عُيُونِهِمْ وَسُيُوْلِهِمْ وَأَنْهَارِهِمْ وَشِرْبِهِمْ.
Amr ibn Shu’aib narrated from his father, from his grandfather, that the Messenger of Allah (ﷺ) judged regarding a channeled stream that it be held until it reaches the ankles, then the upper land sends it to the lower. [Narrated by Abu Dawud and Ibn Majah] Muhammad said: We adopt this, as it was the agreement among them. Each people have what they agreed and submitted to regarding their springs, streams, rivers, and water shares.

1 The statement: Held until it reaches the ankles, etc., Shafi’i stated in Al-Minhaj: Permissible waters from valleys, springs, streams, and rains are equal for people. If people want to irrigate their land from it and it is insufficient, the upper land irrigates first, and each holds the water until it reaches the ankles. As stated in Al-Musawwa. In At-Ta’liq Al-Mumajjad: According to the Hanafis, there is no specific limit set by Sharia, but the matter is left to the partners’ opinions. This is the summary of what Muhammad (may Allah be pleased with him) said.
۱ قوله: إن يمسك حتى يبلغ الكعبين إلخ وعليه الشافعي في المنهاج»: والمياه المباحة من الأودية والعيون والسيول والأمطار يستوي الناس فيها، فإن أراد الناس سقي أرضهم منها فضاق، سقى الأعلى فالأعلى، وحبس كل واحد الماء حتى يبلغ الكعبين. قاله في المسوى». وقال في التعليق الممجد» وعند الحنفية ليس فيه حد معين شرعا، بل الأمر مفوض إلى آراء الشركاء، انتهى. هذا حاصل ما قال محمد رحمه الله .
