بَابُ الْإِجَارَةِHiring

العربية

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: ﴿فَإِنْ أَرْضَعْنَ لَكُمْ فَئَاتُوهُنَّ۱ أُجُورَهُنَّ(الطلاق: ٦ ، وَقَوْلِهِ تَعَالَى حِكَايَةً عَنْ شُعَيْبٍ عَلَيْهِ السَّلَامِ: (قَالَ إِنِّي أُرِيدُ۲ أَنْ أُنكِحَكَ إِحْدَى ابْنَتَى هَتَيْنِ عَلَى أَن تَأْجُرَنِي ثَمَنِي حِجَجٍ) (القصص: ۲۷)

۱ قوله: فآتوهن أجورهن فيه دليل على شرعية الإجارة. كذا في تكملة فتح القدير».

۲ قوله: إني أريد أن أنكحك إحدى ابنتي هاتين على أن تأجرني ثماني حجج سيأتي الكلام عليه إن شاء الله تعالى في هذا الباب تحت حديث عتبة بن النذر.

English

And the statement of Allah, the Mighty, the Exalted: So if they breastfeed for you, give them their wages [Surah At-Talaq: 6], and His statement, narrating about Shuaib (peace be upon him): He said, “Indeed, I wish to wed you to one of these two daughters of mine on the condition that you work for me for eight years” [Surah Al-Qasas: 27].

1 The statement: So give them their wages indicates the permissibility of hiring. As stated in Takmilah Fath Al-Qadir.2 The statement: Indeed, I wish to wed you to one of these two daughters of mine on the condition that you work for me for eight years will be discussed, God willing, in this chapter under the narration of Utbah ibn An-Nudr.

عَنْ مَعْبَدِ اللَّهِ بْنِ مُغَفَّلٍ (رضي الله عنه)، قَالَ : زَعَمَ ثَابِتُ بْنُ الضَّحَاكِ: أَنَّ رَسُوْلَ اللهِ ﷺ نَهَى۱ عَنِ الْمُزَرَاعَةِ وَأَمَرَ۲ بِالْمُؤَاجَرَةِ، وَقَالَ: «لَا بَأْسَ بِهَا». رَوَاهُ مُسْلِمٌ.

English

Ma’bad ibn Mughaffal (may Allah be pleased with him) narrated: Thabit ibn Ad-Dahhak claimed that the Messenger of Allah (ﷺ) forbade sharecropping and ordered hiring, saying: “There is no harm in it.” [Narrated by Muslim]

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) أَنَّ النَّبِيَّ ﷺ احْتَجَمَ فَأَعْطَى الْحَجَّامَ۱ أَجْرَهُ وَاسْتَعَطَ. مُتَّفَقٌ عَلَيْهِ.

English

Ibn Abbas (may Allah be pleased with him) narrated that the Prophet (ﷺ) underwent cupping and gave the cupper his wage, and he used snuff. [Agreed upon]

وَعَنْ أَبِي هُرَيْرَةَ(رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «مَا بَعَثَ اللَّهُ نَبِيًّا إِلَّا رَعَى الْغَنَمَ». فَقَالَ أَصْحَابُهُ: وَأَنْتَ؟ فَقَالَ: «نَعَمْ، كُنْتُ۱ أَرْعَاهَا عَلَى قَرَارِيطَ لِأَهْلِ مَكَّةَ». رَوَاهُ الْبُخَارِيُّ.

English

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Allah did not send a prophet except that he herded sheep.” His companions asked, “And you?” He said: “Yes, I used to herd them for some carats for the people of Makkah.” [Narrated by Bukhari]

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) : أَنَّ نَفَرًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ مَرُّوا بِمَاءٍ فِيهِمْ لَدِيْغٌ أَوْ سَلِيمٌ، فَعَرَضَ لَهُمْ رَجُلٌ مِنْ أَهْلِ الْمَاءِ ، فَقَالَ: هَلْ فِيكُمْ مِنْ رَاقٍ؟ إِنَّ فِي الْمَاءِ رَجُلًا لَدِيْغًا أَوْ سَلِيمًا، فَانْطَلَقَ رَجُلٌ مِنْهُمْ، فَقَرَأَ بِفَاتِحَةِ الْكِتَابِ عَلَى شَاءٍ فَبَرَأَ، فَجَاءَ بِالشَّاءِ إِلَى أَصْحَابِهِ، فَكَرِهُوا ذَلِكَ وَقَالُوا: أَخَذْتَ عَلَى كِتَابِ اللَّهِ أَجْرًا حَتَّى قَدِمُوا الْمَدِينَةَ، فَقَالُوا: يَا رَسُولَ اللهِ ، أَخَذَ عَلَى كِتَابِ اللهِ أَجْرًا، فَقَالَ۱ رَسُولُ اللَّهِ ﷺ: «إِنَّ أَحَقَّ مَا أَخَذْتُمْ عَلَيْهِ أَجْرًا كِتَابُ اللهِ». رَوَاهُ الْبُخَارِيُّ.

وَفِي رِوَايَةٍ: «أَصَبْتُمْ، إِقْسِمُوْا وَاضْرِبُوا لِي مَعَكُمْ سَهْمًا.

وَرَوَى أَبُو دَاوُدَ وَابْنُ مَاجَه عَنْ عُبَادَةَ بْنِ الصَّامِتِ له قَالَ: قُلْتُ: يَا رَسُوْلَ اللهِ، رَجُلٌ أَهْدَى إِلَيَّ قَوْسًا مِمَّنْ كُنْتُ۲ أُعَلِّمُهُ الْكِتَابَ وَالْقُرْآنَ وَلَيْسَتْ بِمَالٍ، [وَأَرْمِي عَنْهَا]في سَبِيلِ اللَّهِ. قَالَ: «إِنْ كُنْتَ تُحِبُّ أَنْ تُطَوَّقَ طَوْقًا مِنْ نَارٍ فَاقْبَلْهَا».

وَفِي رِوَايَةٍ لِأَحْمَدَ وَأَبِي دَاوُدَ عَنْ خَارِجَةَ بْنِ الصَّامِتِ عَنْ عَمِّهِ (اللهِ) قَالَ: أَقْبَلْنَا مِنْ عِنْدِ رَسُولِ اللهِ ﷺ فَأَتَيْنَا عَلَى حَيَّ مِنَ الْعَرَبِ فَقَالُوا إِنَّا أُنْبِثْنَا أَنَّكُمْ قَدْ جِئْتُمْ مِنْ عِنْدِ هَذَا الرَّجُلِ بِخَيْرٍ، فَهَلْ عِنْدَكُمْ مِنْ دَوَاءٍ أَوْ رُقْيَةٍ فَإِنَّ عِنْدَنَا مَعْتُوهَا فِي الْقُيُودِ. [قَالَ: فَقُلْنَا: نَعَمْ، قَالَ : فَجَاءُوا بِمَعْتُوهِ فِي الْقُيُودِ، قَالَ: فَقَرَأْتُ عَلَيْهِ فَاتِحَةَ الْكِتَابِ ثَلَاثَةَ أَيَّامٍ غُدْوَةً وَعَشِيَّةٌ، أَجْمَعُ بُرَاقِي، ثُمَّ أَتْفُلُ، قَالَ: فَكَأَنَّمَا نَشَطَ مِنْ عِقَالٍ، [قَالَ:] فَأَعْطَوْنِي جُعْلًا، فَقُلْتُ: لَا حَتَّى أَسْأَلَ رَسُولَ اللهِ ، فَقَالَ: كُلْ، فَلَعَمْرِي لِمَنْ أَكَلَ بِرُقْيَةِ بَاطِلٍ، لَقَدْ أَكَلْتَ بِرُقْيَةِ حَقٍّ».

English

Ibn Abbas (may Allah be pleased with him) narrated: A group of the Prophet’s (ﷺ) companions passed by a water source where there was a man who had been stung or bitten. A man from the people of the water source approached them and said, “Is there anyone among you who can perform ruqyah? There is a man at the water source who has been stung or bitten.” One of them went and recited the Opening of the Book for some sheep, and the man recovered. He brought the sheep to his companions, who disapproved and said, “You took a wage for the Book of Allah!” When they arrived in Madinah, they said, “O Messenger of Allah, he took a wage for the Book of Allah.” The Messenger of Allah (ﷺ) said: “The most rightful thing you take a wage for is the Book of Allah.” [Narrated by Bukhari]

In another narration: “You have done well. Divide it and assign a share for me with you.”

Abu Dawud and Ibn Majah narrated from Ubadah ibn As-Samit (may Allah be pleased with him) that he said: “O Messenger of Allah, a man gifted me a bow from those I was teaching the Book and the Qur’an, and it is not wealth, [and I shoot with it] in the way of Allah.” He said: “If you wish to be collared with a collar of fire, then accept it.”

In a narration by Ahmad and Abu Dawud from Kharijah ibn As-Samit, from his uncle (may Allah be pleased with him), he said: “We came from the Messenger of Allah (ﷺ) and passed by an Arab tribe. They said, ‘We have heard that you have come from this man with goodness. Do you have any medicine or ruqyah? We have a madman in chains.’ We said, ‘Yes.’ They brought the madman in chains. I recited the Opening of the Book over him for three days, morning and evening, collecting my saliva and then spitting. It was as if he was released from a tether. They gave me a reward, but I said, ‘Not until I ask the Messenger of Allah.’ He said, ‘Eat it, for by my life, whoever eats from a false ruqyah, you have eaten from a true ruqyah.’”

1 The statement: The Messenger of Allah (ﷺ) said: The most rightful thing you take a wage for is the Book of Allah, Al-Qadi said: This indicates the permissibility of hiring for reciting the Qur’an and performing ruqyah with it, and the permissibility of taking wages for teaching the Qur’an. Some scholars prohibited it, including Az-Zuhri, Abu Hanifah, and Ishaq, citing the upcoming narration of Ubadah ibn As-Samit. In Sharh As-Sunnah, this narration proves the permissibility of ruqyah with the Qur’an and Allah’s remembrance and taking wages for it, as recitation is among permissible actions. This was used as evidence by those who permitted the sale and purchase of Qur’an manuscripts and taking wages for writing them, including Al-Hasan, Ash-Sha’bi, and Ikrimah. This view was held by Sufyan, Malik, Shafi’i, and the companions of Abu Hanifah. As stated in Al-Marqah. It is also said in Bazl Al-Majhood: This narration is the greatest evidence that wages are permissible for ruqyah and medicine, as stated by Shafi’i, Malik, Abu Hanifah, and Ahmad. As for wages for teaching the Qur’an, the majority permitted it based on this narration and Bukhari’s narration: The most rightful thing you take a wage for is the Book of Allah. Abu Hanifah prohibited it, as stated by Ibn Ruslan. I say: Later Hanafis permitted it due to necessity. In Radd Al-Muhtar: It is stated in Al-Hidayah: Some of our scholars approved hiring for teaching the Qur’an today due to the evident negligence in religious matters, as prohibiting it would lead to the loss of Qur’an memorization, and this is the fatwa. Taj Ash-Shari’ah said in his commentary on Al-Hidayah: Reciting the Qur’an for a wage does not earn reward for the deceased or the reciter. Al-Ayni said in his commentary on Al-Hidayah: The reciter for worldly gain, the giver, and the taker are all sinful. The conclusion is that the common practice today of reciting portions of the Qur’an for wages is impermissible, as it involves commanding recitation and giving reward to the one who commands, with the recitation being for money. If the reciter earns no reward due to an impure intention, how can the reward reach the employer? Were it not for the wage, no one would recite for another in this era. They have made the great Qur’an a means of livelihood and collecting worldly gains. We belong to Allah and to Him we return. Some were misled by what is in Al-Jawhara, as the author of Al-Bahr in the Book of Endowments followed it, and the commentator followed him in the Book of Bequests, suggesting the permissibility of hiring for all acts of obedience, including recitation. This was refuted by Shaykh Khayruddin Ar-Ramli in his marginal notes on Al-Bahr in the Book of Endowments, where he said: I say: The fatwa is that taking wages for teaching the Qur’an is permissible by approval, not for mere recitation, as explicitly stated in At-Tatarkhaniyyah, where it says: There is no meaning to this bequest or the reciter’s connection to his recitation, as it is akin to a wage, and hiring for it is invalid and an innovation not done by any of the caliphs. We mentioned the issue of teaching the Qur’an by approval, meaning due to necessity, and there is no necessity in hiring for recitation at graves. In Az-Zayla’i and many books: If the door to teaching for wages were not opened, the Qur’an would be lost, so they issued a fatwa permitting it and deemed it good. Be aware. The evidence some annotators used from Bukhari’s narration about the stung man to permit it is incorrect, as the early scholars who prohibited hiring absolutely permitted ruqyah for a wage, even with the Qur’an, as stated by At-Tahawi, because it is not purely an act of worship but a form of treatment. This is a summary of Radd Al-Muhtar. 2 The statement: From those I was teaching the Book and the Qur’an, etc., this is clear evidence for Abu Hanifah (may Allah be pleased with him). وفي رد المحتار»: قال في الهداية»: وبعض مشايخنا استحسنوا الاستئجار على تعليم القرآن اليوم لظهور التواني في الأمور الدينية، ففي الامتناع تضييع حفظ القرآن، وعليه الفتوى. وقال تاج الشريعة في شرح الهداية»: إن القرآن بالأجرة لا يستحق الثواب لا للميت ولا للقارئ. وقال العيني في شرح الهداية»: ويمنع القارئ للدنيا، والآخذ والمعطي آثمان.

فالحاصل أن ما شاع في زماننا من قراءة الأجزاء بالأجرة لا يجوز؛ لأن فيه الأمر بالقراءة وإعطاء الثواب للآمر والقراءة لأجل المال، فإذا لم يكن للقارئ ثواب؛ لعدم النية الصحيحة فأين يصل الثواب إلى المستأجر، ولولا الأجرة ما قرأ أحد لأحد في هذا الزمان، بل جعلوا القرآن العظيم مكسبا ووسيلة إلى جمع الدنيا، إنا لله وإنا إليه راجعون. وقد اغتر بما في «الجوهرة» صاحب البحر» في كتاب الوقف، وتبعه الشارح في كتاب الوصايا حيث يشعر كلامهما بجواز الاستجئار على كل الطاعات ومنها القراءة، وقد ردَّه الشيخ خير الدين الرملي في حاشية «البحر» في كتاب الوقف حيث قال: أقول: المفتى به جواز الأخذ استحسانًا على تعليم القرآن لا على القراءة المجردة، كما صرحبه في «التاتارخانية، حيث قال: لا معنى لهذه الوصية ولصلة القارئ بقراءته؛ لأن هذا بمنزلة الأجرة، والإجارة في ذلك باطلة، وهي بدعة، ولم يفعلها أحد من الخلفاء، وقد ذكرنا مسألة تعليم القرآن على استحسان، يعني للضرورة، ولا ضرورة في الاستئجار على القراءة على القبر.

وفي «الزيلعي» وكثير من الكتب: لو لم يفتح باب التعليم بالأجر الذهب القرآن، فأفتوا بجوازه ورأوه حسنًا، فتنبه اهـ. وما استدل به بعض المحشين على الجواز بحديث البخاري في اللديغ فهو خطأ؛ لأن المتقدمين المانعين الاستئجار مطلقا جوزوا الرقية بالأجرة، ولو بالقرآن كما ذكره الطحاوي؛ لأنها ليست عبادة محضة، بل من التداوي تم كلام رد المحتار مختصرا.

۲ قوله: ممن كنت أعلمه الكتاب والقرآن إلخ : هذا دليل واضح لأبي حنيفة الله. كذا في «المرقاة».

وَعَنْ عُتْبَةَ بْنِ الْمُنْذِرِ (رضي الله عنه) قَالَ: كُنَّا عِنْدَ رَسُولِ اللَّهِ ﷺ فَقَرَأَ طَسٍ حَتَّى إِذَا بَلَغَ قِصَّةَ مُوسَى، قَالَ: «إِنَّ مُوسَى۱ (عليه السلام) أَجَرَ نَفْسَهُ ثَمَانِيَ سِنِينَ أَوْ عَشْرًا عَلَى عِفَّةِ فَرْجِهِ وَطَعَامِ بَطْنِهِ». رَوَاهُ أَحْمَدُ وَابْنُ مَاجَه.

English

Utbah ibn Al-Mundhir (may Allah be pleased with him) narrated: We were with the Messenger of Allah (ﷺ), and he recited Surah Ta-Sin until he reached the story of Musa. He said: “Indeed, Musa (peace be upon him) hired himself for eight or ten years for the chastity of his private parts and the food of his stomach.” [Narrated by Ahmad and Ibn Majah]

1 The statement: Indeed, Musa (peace be upon him) hired himself, etc., the prevailing view is that Shuaib (peace be upon him) made herding sheep the dowry, as Allah mentioned this without disapproval, so it should be permissible in our Sharia as well. This is based on the established principle in usul that the laws of those before us are binding if Allah or His Messenger narrate them without disapproval. If the dowry was service other than herding sheep, it would not be permissible according to us if the service was for the bride, but it may be permissible if it was for another person, as is the case here, since the service was for Shuaib (peace be upon him). The details of this matter are appropriately explained in Al-Hidayah in the chapter on dowry: If a free man marries a woman on the condition of his service for a year or teaching the Qur’an, the marriage is valid, but what is mentioned does not qualify as a dowry. She is entitled to a dowry of her peers according to Abu Hanifah and Abu Yusuf, and the value of his service according to Muhammad. If a slave marries a free woman with his master’s permission on the condition of his service, or a free man marries a free woman on the condition of another free man’s service, or on herding the husband’s sheep, what is mentioned qualifies as a Leadership dowry. Shafi’i says that what is mentioned qualifies as a dowry in all cases, equating the first two scenarios with the others. We say: The legislated means is to seek through wealth, as Allah says: That you seek through your wealth [Surah An-Nisa: 24]. Teaching the Qur’an is not wealth, nor are benefits according to our principle, so they do not qualify as a dowry. This differs from the service of a slave husband, as it is seeking through wealth due to the guarantee of his person. For a free man, it requires altering the subject. This differs from the service of a free man serving another free man with his consent, as it does not require that, so there is no contradiction. This also differs from herding sheep, as it falls under fulfilling marital duties, so no contradiction arises. However, it is not permissible in one narration. This is the summary of his statement. It is understood that herding sheep qualifies as a dowry in one narration, unlike the benefits of another, which do not qualify. The story of Shuaib (peace be upon him) indicates the permissibility of herding sheep as a dowry, as well as the permissibility of fathers taking the dowry, the marriage being in the future tense, the bride and dowry being unspecified, and the permissibility of choosing between less or more. The first was mentioned in a narration, as you know, but the rest do not align with our Sharia. Therefore, they said it is possible that the laws differ in this regard, or the dowry could be the lesser or greater amount as a favor. Shuaib’s statement: I wed you is considered an offer of marriage, not the marriage itself, so it is not in the future tense, and the bride is not unspecified. The permissibility of fathers taking the dowry has been abrogated now. The evidence is that it is mentioned in Al-Husayni that Shuaib’s statement: On the condition that you work for me, with the pronoun referring to himself, indicates that in previous Sharias, the dowry of daughters went to the fathers, and this was abrogated in our Sharia by Allah’s statement in Surah An-Nisa: And give the women their dowries graciously [Surah An-Nisa: 4], meaning give the women their dowries, not their fathers. This verse abrogates that aspect. It is explicitly stated that benefits other than herding sheep do not qualify as a dowry according to us but do according to Shafi’i. The author of Al-Madarak stated under Allah’s statement: Indeed, I wish [Surah Al-Qasas: 27]: This statement is a promise from Shuaib, not the marriage itself, as if it were the marriage, it would have been expressed in the past tense, such as: “I have wed you.” This is the summary of his statement. Shuaib’s words were not interpreted as a marriage contract, as marriage is only with the past tense and for a specified woman. He also said: Marrying on the condition of herding sheep is permissible by consensus, as it falls under fulfilling marital duties, so there is no contradiction, unlike marrying on the condition of service. ۱قوله : إن موسى (عليه السلام) آجر نفسه إلخ والمال أن شعيب عليه جعل المهر هو رعي الغنم على المشهور، وقد ذكر الله تعالى ذلك لنا من غير إنكار علينا، فينبغي أن يجوز في شريعتنا أيضًا لما تقرر في علم الأصول أن شرائع من قبلنا يلزمنا إذا قص الله أو رسوله من غير إنكار علينا، وإن كان المهر هو الخدمة سوى رعي الغنم، فلا يجوز عندنا إن كان المقصود خدمة المنكوحة، ولعله يجوز إن كان خدمة شخص آخر ، وههنا كذلك؛ إذ الخدمة خدمة شعيب عليه، وتفصيل هذا المقام على وجه يليق أنه ذكر صاحب الهداية» في باب المهر»: إن تزوج حرّ امرأة على خدمته سنة أو على تعليم القرآن يجوز النكاح، ولكن لا يصلح ما يذكر مهرا، وإنما يكون لها مهر المثل عندهما، وقيمة خدمته عند محمد. وإن تزوج عبد حرة بإذن مولاه على خدمته، أو تزوج حر حرةً على خدمة حر آخر، أو على رعي الزوج غنما يكون ما يذكر مهرا، والشافعي يقول بأن ما يذكر يصلح مهرًا في جميع الصور فقد قاس الصورتين أوليين على البواقي، ونحن نقول: إن المشروع إنما هو الابتغاء بالمال، حيث قال: أَن تَبْتَغُوا بِأَمْوَالِكُمْ﴾ (النساء: ٢٤ وتعليم القرآن ليس بمال، وكذا المنافع على أصلنا، فلا يصلح مهرا، بخلاف خدمة الزوج العبد؛ فإنه ابتغاء بالمال؛ لتضمن تسليم الرقبة، وفي الحر يلزم قلب الموضوع.

وبخلاف خدمة الزوج الحر حرا آخر برضاه؛ لأنه لا يلزم فيه ذلك فلا مناقضة، وبخلاف رعي الأغنام؛ فإنه من باب القيام بأمور الزوجية، فلا يلزم المناقضة على أنه لا يجوز في رواية، هذا حاصل كلامه. فعلم منه أن رعي الغنم يصلح مهرا في رواية، بخلاف منافع آخر؛ فإنها لا تصلح ذلك. ثم إن قصة شعيب الله كما يدلُّ على جواز كون رعي الغنم مهرا كذلك يدلُّ على جواز أخذ المهر للآباء، وكون النكاح بلفظ المستقبل، وكون المنكوحة والمهر مجهولة، وكون التخيير بين القليل والكثير جائزا، والأول جاء في رواية كما علمت والبواقي كل منها لم يوافق شريعتنا، فلهذا قالوا: إنه يمكن اختلاف الشرائع في ذلك، ويمكنه أن يكون المهر هو القليل والكثير تفضلا منه، وإن قول شعيب عليه : أنكحك عد للنكاح، لا أنه نكاح، فلا يكون بلفظ المستقبل، ولا المنكوحة مجهولة.

وجواز أخذ المهر للآباء قد نسخ الآن، ومصداق كله أنه قد ذكر في «الحسيني» أن قول شعيب : على أن تأجرني - بالإضافة إلى ياء المتكلم - يَدلُّ . على أنه كان مهر البنات في الشرائع السابقة للآباء، وقد نسخ ذلك في شريعتنا؛ لقوله تعالى في سورة النساء: ﴿وَءَاتُوا النِّسَاءَ صَدُقَاتِهِنَّ نِحْلَةً (النساء: ٤ أي آتوا النساء مهورهن لا لآبائهن، فهذه الآية منسوخة في هذا المقدار، وقد نص بأن ما سوى رعي الغنم من المنافع لا يصلح مهرا عندنا، ويصلح عند الشافعي، وذكر صاحب المدارك تحت قوله تعالى : إني أريد (القصص: ۲۷): إن هذا القول موعدة من شعيب لا ، لا أنه عين نكاح؛ لأنه لو كان عين نكاح، لعبره بصيغة الماضي، وهو قوله: «قد أنكحتك» هذا حاصل کلامه، فلم يحمل كلام شعیب الله على المناكحة؛ لأن النكاح لا يكون إلا بالماضي وعلى المعينة. وقال أيضًا: إن التزوج على رعي الغنم جائز بالإجماع؛ لأنه من باب القيام بأمور الزوجية فلا مناقضة، بخلاف التزوج على الخدمة، ملخص من التفسيرات الأحمدية».

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : قَالَ اللَّهُ تَعَالَى: ثَلَاثَةُ أَنَا خَصْمُهُمْ يَوْمَ الْقِيَامَةِ: رَجُلٌ أَعْطَى بِي ثُمَّ غَدَرَ ، وَرَجُلٌ بَاعَ حُرًّا فَأَكَلَ ثَمَنَهُ، وَرَجُلٌ اسْتَأْجَرَ أَجِيرًا فَاسْتَوْفَى مِنْهُ وَلَمْ يُعْطِهِ أَجْرَهُ». رَوَاهُ الْبُخَارِيُّ.

English

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Allah, the Exalted, said: ‘There are three whom I will oppose on the Day of Resurrection: a man who gave a pledge in My name then betrayed it, a man who sold a free person and consumed the price, and a man who hired a worker, took full work from him, and did not pay his wage.’” [Narrated by Bukhari]

Abdullah ibn Umar (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: “Give the worker his wage before his sweat dries.” [Narrated by Ibn Majah]

وَعَنِ الْحُسَيْنِ بْنِ عَلِيَّ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: لِلسَّائِلِ۱ حَقٌّ وَإِنْ جَاءَ عَلَى فَرَسٍ». رَوَاهُ أَحْمَدُ وَأَبُو دَاوُدَ.

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: وَنَبِّئْهُمْ أَنَّ الْمَاءَ۱ قِسْمَةٌ بَيْنَهُمْ كُلُّ شِرْبٍ مُحْتَضَرٌ (القمر : ٢٨) ، وَقَوْلِهِ تَعَالَى: لَهَا۲ " شِرْبٌ وَلَكُمْ شِرْبُ يَوْمٍ مَّعْلُومٍ (الشعراء: ١٥٥)

English

Al-Husayn ibn Ali (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “The beggar has a right, even if he comes on a horse.” [Narrated by Ahmad and Abu Dawud]

And the statement of Allah, the Mighty, the Exalted: And inform them that the water is to be shared between them, each share attended [Surah Al-Qamar: 28], and His statement: It has its share, and you have your share on a known day [Surah Ash-Shu’ara: 155].
