بَابُ الْمُسَاهَلَةِ فِي الْمُعَامَلَةِLeniency in Business Transactions
عَنْ جَابِرٍ قَالَ: قَالَ رَسُولُ اللهِ ﷺ : رَحِمَ اللَّهُ رَجُلًا سَمْحًا إِذَا بَاعَ وَإِذَا اشْتَرَى وَإِذَا اقْتَضَى». رَوَاهُ الْبُخَارِيُّ.
Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said:
"May Allah have mercy on a man who is lenient when selling, buying, and collecting debts." [Narrated by Bukhari]
وَعَنْ حُذَيْفَةَ (رضي الله عنه)، قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِنَّ رَجُلًا كَانَ فِيمَنْ كَانَ قَبْلَكُمْ أَتَاهُ الْمَلَكُ لِيَقْبِضَ رُوحَهُ ، فَقِيلَ لَهُ : هَلْ عَمِلْتَ مِنْ خَيْرٍ قَالَ: مَا أَعْلَمُ، قِيلَ لَهُ: انْظُرْ، قَالَ: مَا أَعْلَمُ شَيْئًا، غَيْرَ أَنِّي كُنْتُ أَبَايِعُ النَّاسَ فِي الدُّنْيَا وَأُجَازِيهِمْ، فَأُنْظِرُ الْمُوسِرَ وَأَتَجَاوَزُ عَنِ الْمُعْسِرِ، فَأَدْخَلَهُ اللَّهُ الْجَنَّةَ». مُتَّفَقٌ عَلَيْهِ.
وَفِي رِوَايَةٍ لِمُسْلِمٍ نَحْوُهُ عَنْ عُقْبَةَ بْنِ عَامِرٍ الله وَأَبِي مَسْعُودٍ الْأَنْصَارِيِّ، فَقَالَ اللهُ: أَنَا أَحَقُّ بِذَا عَنْكَ تَجَاوَزُوْا عَنْ عَبْدِي».
Hudhayfah (may Allah be pleased with him) narrated:
"A man from previous nations was about to die when the angel asked if he had done any good. He replied: 'I only know that I used to give extensions to the solvent and forgive the insolvent.' So Allah admitted him to Paradise." [Agreed upon]
Muslim's version from Uqbah ibn Amir and Abu Mas'ud adds: Allah said: "I am more worthy of such mercy - forgive My servant."

۱ قوله : أدخله الذل : قال بعض علمائنا من الشراح: ظاهر هذا الحديث أن الزراعة تورث المذلة، وليس كذلك؛ لأن الزراعة مستحبة؛ لأن فيها نفعا للناس، والخبر اطلبوا الأرض من جثاياها، إنما قال ذلك؛ لئلا يشتغل الصحابة بالعمارات وبترك الجهاد، فيغلب عليهم الكفار، وأي ذل أشد من ذلك. وقيل: هذا في حق من بقرب العدو؛ لأنه لو اشتغل بالحرث وترك الجهاد لأدى إلى الإذلال بغلبة العدو عليه. كذا في «المرقاة».
وَعَنْ أَبِي قَتَادَةَ قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِيَّاكُمْ وَكَثْرَةَ الْخَلِفِ فِي الْبَيْعِ فَإِنَّهُ يُنَفِّقُ ثُمَّ يَمْحَقُ». رَوَاهُ مُسْلِمٌ.
Abu Qatadah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said:
"Beware of frequent oath-taking in sales, for it may boost trade but erase blessings." [Narrated by Muslim]
وَعَنْ أَبِي هُرَيْرَةَ هِ (رضي الله عنه)قَالَ: سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: «الْخَلِفُ مُنَفِّقَةٌ لِلسِّلْعَةِ مُمْحِقَةٌ لِلْبَرَكَةِ». مُتَّفَقٌ عَلَيْهِ.
Abu Hurairah (may Allah be pleased with him) narrated that he heard the Messenger of Allah (ﷺ) say:
"Oaths may promote sales but eliminate blessings." [Agreed upon]
وَعَنْ أَبِي ذَرٍّ (رضي الله عنه)، عَنِ النَّبِيِّ ﷺ قَالَ: «ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللَّهُ يَوْمَ الْقِيَامَةِ، وَلَا يَنْظُرُ إِلَيْهِمْ وَلَا يُزَكِّيهِمْ، وَلَهُمْ عَذَابٌ أَلِيمٌ». قَالَ أَبُو ذَرٍّ خَابُوا وَخَسِرُوا مَنْ هُمْ يَا رَسُولَ اللَّهِ؟ قَالَ: «الْمُسْبِلُ۱ وَالْمَنَّانُ وَالْمُنَفِّقُ سِلْعَتَهُ بِالْحَلِفِ الْكَاذِبِ». رَوَاهُ مُسْلِمُ.
Abu Dharr (may Allah be pleased with him) narrated that the Prophet (ﷺ) said:
"Three types of people Allah will not address on Judgment Day nor look at nor purify - for them is painful punishment." Abu Dharr asked who they were. He replied: "The one who lets his garment drag (out of pride), the one who reminds others of his favors, and the one who sells goods with false oaths." [Narrated by Muslim]

۱ قوله: المسيل : قال الشافعية من أسبل بدون التبختر، ليس له وعيد، وأما الأحناف فيذكر المسألة بلا قيد، فإذن لا يتبدل الحكم وإن اختاره للمصلحة. كذا في العرف الشذي».
وَعَنْ أَبِي سَعِيدٍ(رضي الله عنه) ، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «التَّاجِرُ الصَّدُوقُ الْأَمِينُ مَعَ النَّبِيِّينَ وَالصَّدِّيقِينَ وَالشُّهَدَاءِ». رَوَاهُ التَّرْمِذِيُّ وَالدَّارِمِيُّ وَالدَّارَقُطْنِيُّ. وَرَوَاهُ ابْنُ مَاجَه عَنِ ابْنِ عُمَرَ قَالَ التَّرْمِذِيُّ: هَذَا حَدِيثُ غَرِيبٌ.
Abu Sa'id (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said:
"The truthful, trustworthy merchant will be with the prophets, the truthful, and the martyrs." [Narrated by Tirmidhi, Darimi, and Darqutni]
Ibn Majah's version from Ibn Umar is graded gharib by Tirmidhi.
وَعَنْ قَيْسِ ابْنِ أَبِي غَرَزَةَ قَالَ: كُنَّا نُسَمَّى فِي عَهْدِ رَسُولِ اللهِ ﷺ السَّمَاسِرَةَ،۱ فَمَرَّ بِنَا رَسُولُ اللهِ ﷺ فَسَمَّانَا بِاسْمٍ هُوَ أَحْسَنُ مِنْهُ، فَقَالَ: «يَا مَعْشَرَ التَّجَّارِ، إِنَّ الْبَيْعَ يَحْضُرُهُ الْخَلِفُ وَاللَّغْوُ، فَشُوبُوهُ بِالصَّدَقَةِ۲. رَوَاهُ أَبُوْ دَاوُدَ وَالتَّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَه.
Qays ibn Abi Gharzah (may Allah be pleased with him) said:
"We were called 'brokers' (samasira) during the Prophet's time. Once he passed by us and gave us a better name, saying:
'O merchants! False speech and oaths often accompany trade, so mix it with charity.'" [Narrated by Abu Dawud, Tirmidhi, Nasa'i, and Ibn Majah]

1 "Brokers" - This confirms the permissibility of brokerage. Hanafis allow brokers to take fees from buyers, sellers, or both based on custom. Commerce is generally superior to farming. [Al-'Urf ash-Shadhi] 2 "Mix it with charity" - Some literalists wrongly cite this against commercial zakat. In reality, this refers to voluntary charity to atone for trade-related sins, not replacing obligatory zakat established by consensus. [Badhl al-Majhud]
۱ قوله: السماسرة دل الحديث على جواز الدلالة والسمسرة، وفي كتبنا: أن الدلال يجوز له أن يأخذ الأجرة من المشتري أو البائع أو من كليهما، إن كان العرف كذلك، واختلف في المفاضلة بين التجارة والزراعة، ومختارنا أن التجارة أفضل. كذا في العرف الشذي».
۲قوله: فشوبوه بالصدقة قال الخطابي: وقد احتج بهذا الحديث بعض أهل الظاهر ممن لا يرى الزكاة من أموال التجارة، وزعم أنه لو كان يجب فيها صدقة كما يجب في سائر الأموال الظاهرة لأمرهم النبي ة بها، ولم يقتصر على قوله: «فشوبوه بالصدقة». قال الشيخ : وليس فيما ذكروه دليل على ما ادعوه؛ لأنه إنما أمرهم في هذا الحديث بشيء من الصدقة غير معلوم المقدار في تضاعيف الأيام من الأوقات؛ لتكون كفارة عن اللغو والحلف، وأما الصدقة المقدرة التي هي ربع العشر الواجبة عند تمام الحول فقد وقع البيان فيها من غير هذه الجهة، ثم هو عمل الأمة وإجماع أهل العلم، فلا يعد قول هؤلاء معهم خلافًا. كذا في بذل المجهود».
وَعَنْ عُبَيْدِ بْنِ رِفَاعَةَ عَنْ أَبِيْهِ (رضي اللهُ عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «إِنَّ التُّجَّارَ يُحْشَرُونَ يَوْمَ الْقِيَامَةِ فُجَّارًا إِلَّا مَنِ اتَّقَى وَبَرَّ وَصَدَقَ. رَوَاهُ التَّرْمِذِيُّ وَابْنُ مَاجَهِ وَالدَّارِمِيُّ.
وَرَوَى الْبَيْهَقِيُّ فِي «شُعَبِ الْإِيْمَانِ» عَنِ الْبَرَاءِ. وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيْثٌ حَسَنٌ صَحِيحٌ.
Ubayd ibn Rifa'ah narrated from his father (may Allah be pleased with him) that the Prophet (ﷺ) said:
"On Judgment Day, merchants will be resurrected as sinners except those who feared Allah, acted righteously, and spoke truthfully." [Narrated by Tirmidhi, Ibn Majah, and Darimi]
Bayhaqi narrated a similar version from Al-Bara'. Tirmidhi graded it hasan sahih.

1 The statement "do not consume…": The author of Al-Madarik said, "This verse negates the option of session (Khiyar al-Majlis), as it permits consumption through trade by mutual consent without restricting it to separation from the place of contract. Restricting it would be an addition to the text." As mentioned in At-Tafsirat al-Ahmadiyyah.
2 The statement "Fulfill [your] contracts": A sale is a contract that necessitates fulfillment according to the apparent meaning of the verse. Affirming the option of session contradicts this obligation, as it negates the necessity of fulfillment. Taken from ‘Umdat al-Qari’.
