بَابُ حَرَمِ مَكَّةَ حَرَسَهَا اللَّهُ تَعَالَىThe Sanctity of Makkah

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: وَمَنْ۱ دَخَلَهُ كَانَ آمِنًا (آل عمران: ۹۷

۱ قوله: ومن دخله كان آمنا استدل بعضهم بحديث ابن خطل على جواز إقامة الحدود والقصاص في حرم مكة قلنا: قال الله تعالى: ﴿وَمَن دَخَلَهُ ، كَانَ عَامِنَا) (آل عمران: ۹۷، ومتى تعرض إلى من التجأ به يكون سلب الأمن عنه، وهذا لا يجوز، وكان قتل ابن خطل في الساعة التي أحلت للنبي ، وحيئذ مكة كغيرها، بخلافها بعدها. قاله في عمدة القاري».

And the statement of Allah the Almighty:"And whoever enters it shall be secure." (Aal Imran 3:97)

1 The statement: "And whoever enters it shall be secure", some have used the incident of Ibn Khatal as evidence to permit carrying out legal punishments and retribution within the sanctity of Makkah. However, we respond by citing Allah’s words: "And whoever enters it shall be secure" (Aal Imran 3:97). If someone who seeks refuge in it is subjected to harm, this would violate their security, which is impermissible. The killing of Ibn Khatal occurred during the brief period when the sanctity of Makkah was temporarily lifted for the Prophet (ﷺ), making it like any other land at that time, unlike its status afterward. وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ يَوْمَ افْتَتَحَ مَكَّةَ: «لَا هِجْرَةَ وَلَكِنْ جِهَادٌ وَنِيَّةٌ۱، وَإِذَا اسْتُنْفِرْتُمْ فَانْفِرُوا»۲. وَقَالَ يَوْمَ فَتْحِ مَكَّةَ: «إِنَّ هَذَا الْبَلَدَ حَرَّمَهُ۳ اللهُ يَوْمَ خَلَقَ السَّمَوَاتِ وَالْأَرْضَ ، فَهُوَ حَرَامٌ بِحُرْمَةِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ٤، وَإِنَّهُ لَمْ يَحِلُّ الْقِتَالُ فِيهِ لِأَحَدٍ قَبْلِي، وَلَمْ يَحِلَّ لِي إِلَّا سَاعَةً٥ مِنْ نَهَارٍ، فَهُوَ حَرَامٌ بِحُرْمَةِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ، لَا يُعْضَدُ٦ شَوْكُهُ وَلَا يُنَفَّرُ٧ صَيْدُهُ». مُتَّفَقٌ عَلَيْهِ.

وَقَالَ۸ ابْنُ الْمُنْذِرِ: وَرَوَيْنَا عَنْ عُمَرَ وابْنِ عَبَّاسٍ وَعَائِشَةَ وَابْنِ الْمُسَيِّبِ: أَنَّ٩ حُكْمَلُقْطَةِ مَكَّةَ كَحُكْمِ سَائِرِ الْبُلْدَانِ.

Ibn Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said on the day Makkah was conquered:

"There is no Hijrah (migration) after the conquest, but there remains Jihad and sincere intention. And if you are called to fight, then respond."

He also said on the day of the conquest:

"This city was made sacred by Allah on the day He created the heavens and the earth. It remains sacred by the sanctity of Allah until the Day of Resurrection. Fighting was never permitted in it for anyone before me, nor was it permitted for me except for a brief period of a day. It is sacred by the sanctity of Allah until the Day of Resurrection. Its thorns may not be cut, nor its game disturbed." [Agreed upon]

Ibn al-Mundhir said: "We have also reported from Umar, Ibn Abbas, Aisha, and Ibn al-Musayyib that the ruling regarding lost property in Makkah is the same as in other lands."

(Al-Hidayah) adds: "If one cuts wild plants or trees in the Haram that are not cultivated, they must pay compensation, except for dried trees, as they are no longer growing. Grazing is also prohibited except for idhkhir (a type of grass). The Shafi‘is permit grazing in the Haram, while Ahmad’s view aligns with ours. If it is argued that the prohibition applies only to cutting, not grazing, the response is that grazing (with teeth) is akin to cutting (with tools). The prohibition is general, so grazing is also forbidden unless one brings fodder from outside the Haram." This is mentioned in (Al-‘Inayah) and (Fath al-Qadir).

2 The statement: "There is no Hijrah but Jihad and intention", Hijrah refers to migrating from the land of war to the land of Islam. This differs for later generations and is not discussed in the books of the Hanafis. The Shafi‘is, however, address it here. Shah Abdul Aziz, in one of his letters, considered Hijrah recommended (mustahabb), which is the preferred view. Some scholars deemed it obligatory. Hadiths and verses indicate its recommendation, such as the narration of Tirmidhi from Buraydah, where it is mentioned that they would be like Bedouin Muslims, etc. They said: "Hijrah was obligatory for the people of Makkah and may become obligatory in certain situations." This is mentioned in (Al-‘Urf al-Shadhi).

3 The statement: "If you are called to fight, then respond", Jihad is a collective obligation (fard kifayah). If the objective is achieved by some, it is lifted from the rest, like the funeral prayer and returning greetings. If no one fulfills it, all people sin by neglecting it, unless the call is general, in which case it becomes an individual obligation (fard ‘ayn) for all residents of that land, whether the caller is just or sinful. This is stated in (Fath al-Qadir).

4 The statement: "Allah made it sacred on the day He created the heavens and the earth", This indicates an ancient, continuous sanctity. This is mentioned in (Al-Mirqah).

5 The statement: "Until the Day of Resurrection", This implies its sanctity cannot be abrogated. This is mentioned in (Al-Mirqah).

6 The statement: "Except for a brief period of a day", This proves Makkah was conquered by force, as held by our school. This is mentioned in (Al-Mirqah).

7 The statement: "Its thorns may not be cut", This means even its thorns may not be cut, let alone its trees. (Al-‘Inayah) states: "Know that the vegetation of the Haram is of two types: 1 what is cultivated by humans and 2 what grows naturally. The first type does not incur a penalty, while the second does if it is not of a kind typically cultivated. Ownership does not affect this ruling. For example, if someone cuts a wild tree growing on another’s property, they must compensate both the owner and the sanctity of the Haram."

8 The statement: "Nor its game disturbed", After entering Ihram, one must avoid killing, pointing at, or assisting in hunting (e.g., lending weapons or scaring animals). This is stated in (Rad al-Muhtar).

9 The statement: "Ibn al-Mundhir said...", This is mentioned in (Umdat al-Qari).

10 The statement: "The ruling regarding lost property in Makkah is the same as in other lands", This means lost property in the Haram and elsewhere is treated equally, according to Malik, Ahmad, and one opinion of Shafi‘i. Another opinion holds that one must donate it after a year if unclaimed, based on the Hadith: "Do not take lost property except to announce it." Our school argues that the Hadith: "Recognize its container and tie, then announce it for a year" applies universally, and the restriction for the Haram merely emphasizes announcement due to the high number of travelers. This is mentioned in (Fath al-Qadir), (Al-Hidayah), and (Al-‘Inayah).

۲ قوله: وإذا استنفرتم فانفروا الجهاد فرض على الكفاية، فإذا حصل المقصود بالبعض سقط عن الباقين كصلاة الجنازة ورد السلام، فإن لم يقم به أحد أثم جميع الناس بتركه، هذا إذا لم يكن النفير عاما، فإن كان فيصير من فروض الأعيان، سواء كان المستنفر عدلا أو فاسقا، فيجب على جميع أهل تلك البلدة النفر. كذا في فتح القدير».

۳قوله: حرمه الله يوم خلق السماوات والأرض: أي تحريمة شريعة سالفة مستمرة. قاله في «المرقاة».

٤ قوله : إلى يوم القيامة : إيماء إلى عدم نسخه. كذا في «المرقاة».

٥ قوله : إلا ساعة من نهار: دل على أن فتح مكة كان عنوة وقهرا كما هو عندنا كذا في «المرقاة».

٦قوله : لا يعضد شوكه: أي لا يقطع شوكه فضلا من أشجارها قال في العناية: اعلم أن حشيش الحرم وشجره على نوعين شجر أنبته الإنسان وشجر ينبت بنفسه وكل واحد منهما على نوعين؛ لأنه إما أن يكون من جنس ما ينبته الناس أو لا يكون والأول بنوعيه لا يوجب الجزاء، والأول من الثاني كذلك، وإنما يجب الجزاء في الثاني منه، وهو ما نبت بنفسه، وليس من جنس ما ينبته الناس ويستوي فيه يكون مملوكًا للإنسان بأن ينبت في ملكه، أو لم يكن حتى قالوا في رجل بنت في ملكه أم غيلان فقطعها إنسان، فعليه قيمتها لمالكها، وعليه قيمة أخرى لحق الشرع، انتهى.

وفي «الهداية»: فإن قطع حشيش الحرم أو شجره وهو ليس بمملوك، وهو ما لا ينبته الناس فعليه قيمة، إلا ما جف من شجر الحرم لا ضمان فيه؛ لأنه ليس بنام، ولا يرعى حشيش الحرم ولا يقطع إلا الإذخر، وعند الشافعي ومن وافقه يجوز رعي البهائم في كل الحرم، ومذهب أحمد كمذهبنا، فإن قيل : النص في القطع لا في الرعي؟ أجيب عنه بأن القطع بالمشافر كالقطع بالمناجل والعضد قطع الشجر من حد ضرب، فقد منع النص القطع مطلقا، أعم من كونه بالمناجل أو المشافر ، فلا يحل الرمي، والضرورة تندفع بحمل الحشيش من الحل. كذا في «العناية» و«فتح القدير».

٧قوله: ولا ينفر صيده فبعد الإحرام يتقي قتل صيد البر والإشارة إليه والدلالة عليه، وفي حكم الدلالة الاعانة عليه كإعارة سكين، ومناولة رمح وسوط وكذا تنفيره. قاله في رد المحتار».

۸ قوله : قال ابن المنذر إلخ : كذا في عمدة القاري».

٩ قوله : أن حكم لقطة مكة كحكم سائر البلدان أي لقطة الحل والحرم سواء، وبه قال مالك وأحمد والشافعي في قول وفي قول يعرفها أبدًا من تصدق، ولا تملك لقوله : في الحرم، ولا يحل لقطتها إلا لمنشد، ولنا قوله : «أعرف عقاصها ووكائها، ثم عرفها سنة من غير فصل، ولأنها لقطة في التصدق بعد مدة التعريف ببقاء ملك المالك من وجه فیملكه، كما في سائرها وتأويل ما روي أنه لا يحل الالتقاط إلا للتعريف والتخصيص بالحرم بيان أنه لا يسقط التعريف فيه لمكان أنه للغرباء ظاهرا، وبيانه أن مكة - شرفها الله تعالى - مكان الغرباء؛ لأن الناس يأتون إليها من كل فج عميق، ثم يتفرقون بحيث يندر الرجوع إليها، فالظاهر أنها للغرباء لا يظن عودهم في سنة وأكثر، فينغي أن يسقط التعريف؛ لعدم الفائدة، فأزال رسول الله له ذلك الوهم بقوله: «لا يحل رفع لقطتها إلا لمعرفها، كما هو الحكم في غيرها من البلاد، فتح القدير» و «الهداية» و«العناية» ملتقط منها.

وَعَنْ مُعَاذَةَ الْعَدَوِيَّةَ أَنَّ امْرَأَةً قَدْ سَأَلَتْ عَائِشَةَ (رضي الله عنها) فَقَالَتْ: إِنِّي قَدْ أَصَبْتُ ضَالَّةً فِي الْحَرَمِ، فَإِنِّي قَدْ عَرَّفْتُهَا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا، فَقَالَتْ لَهَا عَائِشَةُ: اسْتَنْفِقِي بِهَا. رَوَاهُ الطَّحَاوِيُّ.

وَفِي رِوَايَةٍ لَهُمَا: وَلَا يُخْتَلَى خَلَاهَا، فَقَالَ الْعَبَّاسُ : يَا رَسُولَ اللَّهِ، إِلَّا الْإِذْخِرَ فَإِنَّهُ لِقَيْنِهِمْ لِبُيُؤْتِهِمْ، فَقَالَ: «إِلَّا الْإِذْخِرَ»۱.

وَفِي رِوَايَةِ أَبِي هُرَيْرَةَ الله: «لَا يُعْضَدُ شَجَرُهَا».

English

Mu‘adhah al-‘Adawiyyah narrated that a woman asked Aisha (may Allah be pleased with her): "I found a lost item in the Haram and announced it but found no claimant." Aisha replied: "Use it for your needs." [Narrated by Tahawi]

In another narration: "Its greenery may not be uprooted." Al-Abbas said: "O Messenger of Allah, except idhkhir, for it is used by goldsmiths and for homes." The Prophet (ﷺ) said: "Except idhkhir."

In Abu Hurairah’s narration: "Its trees may not be cut."

One group said it is not lawful to own after announcement; the finder must preserve it forever for its owner, only announcing it until the owner comes, based on the saying about the Sanctuary: “Its found property is not lawful except for its announcer,” as held by Shafi’i. Another group said there is no difference between the Sanctuary and elsewhere; its ruling is like other places, as held by Abu Hanifah, Malik, and Ahmad. Ibn Al-Mundhir said: We narrate this view from Umar, Ibn Abbas, Aishah, and Ibn Al-Musayyib, supported by these reports and the general saying, Note its container and tie, and announce it for a year, without distinguishing between the lawful and the Sanctuary. Rulings established with a condition, if contradicted with a corrupting factor, are discontinued, unlike rulings established for a reason whose absence does not corrupt continuity, like brisk walking and uncovering the shoulder in tawaf to show strength. 1 The statement: In the Book of Allah, meaning in His rulings and obligations. The term “Book” often refers to obligation. This is used by the followers of Abu Hanifah as evidence for the inheritance of distant relatives, supported by the hadith of Al-Miqdam: “The maternal uncle is the heir of one who has no heir.” As stated in Al-Marqah.

2 The statement: And those with whom you have made a pledge, The author of Al-Madarik said: This refers to the contract of alliance, which is legislated, and inheritance through it is established according to most Companions, and this is our view. Shafi’i said: Alliance is nothing, as it nullifies the right of the public treasury. Our evidence is this verse, which pertains to alliance. As stated in At-Tafsir Al-Ahmadiyyah.

3 The statement: And Allah will never grant the disbelievers a way over the believers, As stated in Umdat Al-Qari: A disbeliever does not inherit from a Muslim by consensus, supported by the hadith and this verse. Inheritance establishes a way for the disbeliever over the Muslim.

وتخصيص مكة حينئذ لدفع وهم سقوط التعريف بها بسبب أن الظاهر أن مكة مكان الغرباء؛ لأن الناس يأتون إليه من كل فج عميق ثم يتفرقون، فالغالب أن اللقطة للغريب، لا يدرى عوده، فلا فائدة إذا في التعريف، فينبغي أن يسقط التعريف؛ لعدم الفائدة، فأزال رسول الله له ذلك الوهم بقوله : لا تحل لقطتها إلا لمنشدها. وأما قوله : نهى عن لقطة الحاج، فقال في «الفتح»: قال ابن وهب يعني يتركها حتى يجيء صاحبها. ولا عمل على هذا في هذا الزمان لفشو السرقة بمكة من حوالي الكعبة فضلا عن المتروك، فالأحكام إذا علم شرعيتها باعتبار شرط، ثم علم ثبوت ضده متضمنا مفسدة بتقدير شرعيته معه علم انقطاعها، بخلاف العلم بشرعيتها لسبب إذا علم انتفاؤه، ولا مفسدة في البقاء فإنه لا يلزم ذلك كالرمل والاضطباع في الطواف لإظهار الجلادة، عمدة القاري» و«المرقاة» و «البناية» و«فتح القدير» ملتقط منها.

۱قوله: في كتاب الله أي في أحكامه وفرائضه والكتاب كثيرًا ما يجيء بمعنى الفريضة، واستدل به أصحاب أبي حنيفة الله على توريث ذوي الأرحام، وينصره حديث المقدام والخال وارث من لا وارث له. كذا في «المرقاة».

۳ قوله: ولن يجعل الله للكافرين على المؤمنين سبيلا : وقال في عمدة القاري»: إن الكافر لا يرث المسلم بالإجماع وبالحديث وبهذه الآية، وفي الميراث إثبات السبيل للكافر على المسلم.

وَعَنْ أَبِي شُرَيْحٍ الله أَنَّهُ قَالَ لِعَمْرِو بْنِ سَعِيدٍ - وَهُوَ يَبْعَثُ الْبُعُوثَ إِلَى مَكَّةَ -: ائْذَنْ لِي أَيُّهَا الْأَمِيرُ أُحَدِّثْكَ قَوْلًا قَامَ بِهِ رَسُوْلُ اللهِ ﷺ الْغَدَ مِنْ يَوْمِ الْفَتْحِ، سَمِعَتْهُ أُذْنَايَ، وَوَعَاهُ قَلْبِي، وَأَبْصَرَتْهُ عَيْنَايَ حِينَ تَكَلَّمَ بِهِ، حَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ، ثُمَّ قَالَ: «إِنَّ مَكَّةَ حَرَّمَهَا اللهُ وَلَمْ يُحَرِّمْهَا النَّاسُ، فَلَا يَحِلُّ۱ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْفِكَ بِهَا دَمًا، وَلَا يَعْضِدَ بِهَا شَجَرَةً، فَإِنْ أَحَدٌ تَرَخَّصَ۲ لِقِتَالِ رَسُولِ اللهِ ﷺ فِيهَا، فَقُولُوا: إِنَّ اللَّهَ قَدْ أَذِنَ لِرَسُولِهِ وَلَمْ يَأْذَنْ لَكُمْ۳ ، وَإِنَّمَا أَذِنَ لِي فِيهَا سَاعَةً مِنْ نَهَارٍ، وَقَدْ عَادَتْ حُرْمَتُهَا الْيَوْمَ كَحُرْمَتِهَا بِالْأَمْسِ، وَلْيُبَلِّغُ الشَّاهِدُ الْغَائِبَ». رَوَاهُ النَّسَائِيُّ.

وَذَكَرَ صَاحِبُ «الْمَدَارِكِ»: أَنَّ عُمَرَ (رضي الله عنه) قَالَ :٤ لَوْ ظَفَرْتُ فِيْهِ بِقَاتِلِ الْخَطَابِ مَا مَسِسْتُهُ، حَتَّى يَخْرُجَ مِنْهُ.

English

Abu Shurayh (may Allah be pleased with him) said to Amr ibn Sa‘id, who was sending troops to Makkah:

"O leader, let me tell you what the Messenger of Allah (ﷺ) said the day after the conquest, my ears heard it, my heart memorized it, and my eyes saw him speak. He praised Allah and said:

'Makkah was made sacred by Allah, not by people. It is not lawful for anyone who believes in Allah and the Last Day to shed blood or cut trees here. If anyone justifies fighting in it, say: Allah permitted His Messenger but not you. He only permitted me for a brief time, and its sanctity has returned as before. Let the witness inform the absent.'" [Narrated by Nasa’i]

The author of (Al-Madarik) mentioned that Umar (may Allah be pleased with him) said: "If I found the killer of Al-Khattab in the Haram, I would not touch him until he left."

5 The statement: "If I found the killer of Al-Khattab...", This refers to one who commits a crime outside the Haram and then seeks refuge in it. According to our school, he is safe from execution, while Shafi‘i holds he may be killed. This disagreement stems from interpreting "whoever enters it shall be secure" (3:97) as either absolute (our view) or partially restricted (Shafi‘i’s view). The Prophet’s (ﷺ) order to kill Ibn Khatal is explained as specific to that hour when the Haram’s sanctity was temporarily lifted. This is discussed in (Al-Tafsirat al-Ahmadiyyah).

٤ قوله: لو ظفرت إلخ أي من جنى في غير الحرم، ثم التجئ إلى الحرم لم يقتل فيه، بل يكون آمنا من القتل عندنا، وعند الشافعي يقتل فيه، وهذا الاختلاف مبني على اختلاف آخر بيننا وبينه ذكره أهل الأصول، وهو أن قوله تعالى: وَمَن دَخَلَهُ كَانَ آمِنَا (آل عمران: ۹۷) عام باق على عمومه عندنا، فكان قطعيا، وعند الشافعي عام مخصوص عنه بعض أفراده، وبيانه أن من عليه قصاص في الطرف مثل قطع اليد وغير ذلك إذا دخل في الحرم والتجئ إليه يؤخذ منه ذلك في البيت بالاتفاق، وكذا من جنى في الحرم واستحق له القتل يقتل فيه بالاتفاق، فالشافعي (رحمه الله) زعم أن هاتين الصورتين مخصوصتان من قوله تعالى: ﴿وَمَن دَخَلَهُ كَانَ آمِنَا (آل عمران : ۹۷ ، ثم قاس عليهما من جنى في غير الحرم واستحق به القتل، فالتجئ إليه حيث قال: يقتل فيه أيضًا، وتمسك بخبر الواحد أيضًا، وهو ما روي أنه قيل لرسول الله ﷺ يوم فتح مكة: إن ابن خطل تعلّق بأستار الكعبة بعد الارتداد، فقال: «اقتلوه».

ونحن نقول: إن كلتا الصورتين ليستا بمخصوصتين؛ لأن النص لم يتناولهما، والمخصوص ما كان متناولا أولا، ثم عنه؛ لأن مفهوم النص هو أن من جنى في غير الحرم، ثم التجئ إلى الحرم، ودخل فيه بعد الجناية كان آمن الذات، ولم يتناول لمن جنى في عين الحرم، ولا لكونه آمن الطرف، ففي الصورة الأولى، وإن كان ذلك الرجل داخلا في الحرم بعد الجناية، لكنه آمن الذات، وإنما القصاص في الطرف، والطرف في حكم الأموال، والنص لم يتناول؛ لكونه أمن الطرف، وفي الصورة الثانية إنما يقتل؛ لأنه ليس بداخل في الحرم بعد الجناية، وإنما الجناية وقعت بعد الدخول. فلما كان هاتان الصورتان غير مخصوصتين فبالحري أن تكون الصورة المقيسة للشافعي باقية، على ما اقتضاه النص فمباح الدم بردّةٍ أو زنا أو قطع الطريق أو قصاص إذا التجئ لا يقتل، ولا يؤذى ولكن لا يطعم، ولا يسقى حتى يضطر إلى الخروج، ويؤيده قول عمر (رضي الله عنه) : لو ظفرت إلخ. كذا في التفسيرات الأحمدية».

وَفِي رِوَايَةٍ لِلْبُخَارِيِّ عَنِ الْبَرَاءِ: قَالَ: اعْتَمَرَ النَّبِيُّ ﷺ فِي ذِي الْقَعْدَةِ فَأَبَى أَهْلُ مَكَّةَ أَنْ يَدَعُوهُ يَدْخُلُ مَكَّةَ، حَتَّى قَاضَاهُمْ لَا يُدْخِلُ مَكَّةَ سِلَاحًا إِلَّا فِي الْقِرَابِ.

Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said:

"It is not lawful for any of you to carry weapons in Makkah." [Narrated by Muslim]

In Bukhari’s narration from Al-Bara’: "The Prophet (ﷺ) performed ‘Umrah in Dhul-Qa‘dah, but the people of Makkah refused to let him enter until he agreed not to bring weapons except in sheaths."

Aisha (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) said:

"An army will march towards the Ka'ba. When they reach a desert plain, the first and last of them will be swallowed by the earth."

She said: "I asked: 'O Messenger of Allah, how will they all be swallowed when among them are their markets and people not of them?' He replied: 'They will all be swallowed, then resurrected according to their intentions.'" [Agreed upon]

"This Ummah will remain in good as long as they honor this sanctity with its due honor. When they neglect that, they will be destroyed." [Narrated by Ibn Majah]

وَرَوَى عَبْدُ الرَّزَّاقِ فِي مُصَنَّفِهِ أَنَّ عُمَرَ بْنَ الْخَطَابِ كَانَ يَدُورُ عَلَى الْحَاجِّ بَعْدَ قَضَاءِ النُّسُكِ بِالدُّرَّةِ، وَيَقُوْلُ: يَا أَهْلَ الْيَمَنِ، يَمْنُكُمْ. وَيَا أَهْلَ الشَّامِ، شَامُكُمْ وَيَا أَهْلَ الْعِرَاقِ عِرَاقُكُمْ، فَإِنَّهُ أَبْقَى لِحُرْمَةِ بَيْتِ رَبِّكُمْ فِي قُلُوْبِكُمْ، وَكَانَ أَصْحَابُ رَسُوْلِ اللَّهِ ﷺ يُحْجُوْنَ ثُمَّ يَرْجِعُوْنَ وَيَعْتَمِرُوْنَ ثُمَّ يَرْجِعُوْنَ وَلَا يُجَاوِرُوْنَ.

Ibn Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said about Makkah:

"How good you are as a land and how beloved you are to me! Had my people not driven me out from you, I would not have lived anywhere else." [Narrated by Tirmidhi who said: This is a hasan sahih hadith with a rare chain]

Abdur-Razzaq reported in his Musannaf that Umar ibn al-Khattab would walk among the pilgrims after completing their rites with a whip, saying: "O people of Yemen, go back to Yemen! O people of Syria, go back to Syria! O people of Iraq, go back to Iraq! For this preserves the sanctity of your Lord's House in your hearts." The Companions would perform Hajj then return, perform Umrah then return, without settling there.

1 The statement: "Had my people not driven me out..." - Scholars agree that Makkah and Madinah are the best lands, but differ over which is superior. Three Imams and some Companions held Makkah superior (this hadith supports them), while some Malikis and Shafi'is held Madinah superior - perhaps specifically during the Prophet's life or for the Muhajirun. (Rad al-Muhtar) Ibn al-Humam mentioned scholars differed about the dislike of residing in Makkah - some Shafi'is considered it recommended unless one fears falling into sin (Abu Yusuf and Muhammad's view), while Abu Hanifah and Malik disliked it. (Al-Durr al-Mukhtar adds: Residing in Madinah is not disliked, nor in Makkah for those confident in themselves). Some said the dislike was due to multiplying sins or lacking proper reverence. (Al-Hamawi said this applies to Makkah's Haram, not Madinah which has no Haram). The cautious position is dislike (Abu Hanifah's view), though people commonly reside there following Abu Yusuf and Muhammad's view. (Multaqat)

۱قوله : ما سكنت غيرك وفي آخر الباب وشرحه : أجمعوا على أن أفضل البلاد مكة والمدينة - زادهما الله تعالى شرفا وتعظيما - واختلفوا أيهما أفضل؟ فقيل: مكة، وهو مذهب الأئمة الثلاثة، والمروي عن بعض الصحابة، (وهذا الحديث دليل لهم ، وقيل : المدينة، وهو قول بعض المالكية والشافعية. قيل: وهو المروي عن بعض الصحابة، ولعل هذا مخصوص بحياته و أو بالنسبة إلى المهاجرين من مكة. كذا في رد المحتار»، وقال ابن الهمام: اختلف العلماء في كراهة المجاورة بمكة وعدمها، فذكر بعض الشافعية أن المختار استحبابها إلا أن يغلب على ظنه الوقوع في المحذور، وهذا قول أبي يوسف ومحمد رحمها ، وذهب أبو حنيفة ومالك إلى كراهتها، انتهى.

وفي الدر المختار ولا تكره المجاورة بالمدينة، وكذا بمكة لمن يثق بنفسه، وقال في رد المحتار: وقيل: تكره كمكة، وقيل: إنها على الخلاف بين أبي حنيفة وصاحبيه، فإن تضاعف السيئات أو تعاظمهما إن فقد فيهما فمخافة السامة وقلة الأدب المفضي إلى الإخلال بواجب التوفير، والإجلال قائم، وقال في موضع آخر : ولا يظن أن كراهة القيام تناقض فضل البقعة؛ لأن هذه الكراهة علتها ضعف الخلق وقصورهم عن القيام بحق الموضع انتهى.

وقال الحموي في شرح الأشباه والنظائر وتكره المجاورة به أي بالحرم، والمراد به حرم مكة؛ إذ المدينة لا حرم لها، وإن كان تكره المجاورة بها وعلة الكراهة خوف سقوط حرمة البيت في نظره القاصر كسائر البيوت والعياذ بالله تعالى أو تنقص الهيبة والحرمة الأولى في نظره كما هو شأن كثير والقول بالكراهة مذهب الإمام الأعظم وجميع من المحتاطين في الدين، ووقال أبو يوسف ومحمد لا بأس بالمجاورة، وهو الأفضل، وعليه عمل الناس. كذا في الملتقطات ونقل الفارسي أن الفتوى على قولهما.
