بَابُ الْحَلْقِShaving the Head

العربية

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: لَتَدْخُلُنَّ الْمَسْجِدَ الْحَرَامَ إِن شَاءَ اللَّهُ عَامِنِينَ مُحَلِّقِينَ رُءُوسَكُمْ وَمُقَصِّرِينَ (الفتح: ۲۷) ، وَقَوْلِهِ: ثُمَّ لْيَقْضُوا۱تَفَثَهُمْ (الحج: ٢٩

۱قوله : ثم ليقضوا تفتهم المراد منه الخروج عن الإحرام بالحلق إلخ. كذا في «الخازن».

English

And Allah's Statement: "You will surely enter the Sacred Masjid, if Allah wills, in safety with your heads shaved and [hair] shortened" (Qur'an 48:27),

And His Statement: "Then let them end their untidiness" (Qur'an 22:29)

1 The statement "Then let them end their untidiness" refers to exiting the state of ihram by shaving, etc. As mentioned in Al-Khazin.

وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) أَنَّ رَسُولَ اللهِ ﷺ حَلَقَ۱ فِي حَجَّةِ الْوَدَاعِ وَأُنَاسٌ مِنْ أَصْحَابِهِ وَقَصَّرَ بَعْضُهُمْ مُتَّفَقٌ عَلَيْهِ.

English

Ibn Umar (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) shaved his head during the Farewell Pilgrimage, while some of his companions shaved and others shortened their hair. [Agreed upon]

1 The statement "He shaved his head during the Farewell Pilgrimage": Ibn al-Humam said, "As for the evidence used by those who claim he was performing Tamattu' and that he exited ihram - from the hadith of Mu'awiyah: 'I shortened the hair of the Prophet (ﷺ) with a sharp tool' - they argue that Mu'awiyah accepted Islam after the Conquest, and the Prophet (ﷺ) was not in ihram during the Conquest, thus this must refer to the Farewell Pilgrimage during the ihram of Umrah. This is supported by Abu Dawud's narration mentioning 'at Marwah', since shortening in Hajj only occurs in Mina. However, this is refuted by numerous authentic hadiths showing he did not exit ihram, including Ibn Umar's preceding hadith, the narrations in Al-Fath, and Jabir's lengthy hadith in Sahih Muslim. Even if Ibn Umar's hadith stood alone, it would take precedence over Mu'awiyah's narration. Given the overwhelming evidence, Mu'awiyah's narration must be considered irregular (shadh) or possibly referring to the Umrah of Ji'ranah (which occurred at night, as reported in Tirmidhi and Nasa'i). Any addition in Nasa'i's version mentioning 'the first ten days' must be considered erroneous, whether due to Mu'awiyah's or a narrator's mistake." Al-Mirqat adds: "It is confirmed the Prophet (ﷺ) did not shorten his hair during Hajj but shaved it. Thus, Mu'awiyah's narration about shortening must refer to his Umrah, as indicated by the phrase 'at Marwah' - had it been Hajj, he would have said 'at Mina'."

۱ قوله: حلق رأسه في حجة الوداع: قال ابن الهمام: وأما ما ستدل به القائلون بأنه كان متمتعا، وأنه أحل منحديث معاوية قصرت عن رسول الله ﷺ بمشقص. قالوا: ومعاوية أسلم بعد الفتح، والنبي ﷺ لم يكن محرما في الفتح، فلزم كونه في حجة الوداع وكونه عن إحرام العمرة؛ لما رواه أبو داود في رواية من قوله عند المروة، والتقصير في الحج إنما يكون في منى، فدفعه أن الأحاديث الدالة على عدم إحلاله جاءت مجيئا متظاقرا يقرب القدر المشترك من الشهرة التي هي قريبة من التواتر كحديث ابن عمر السابق، وما تقدم في «الفتح» من الأحاديث وحديث جابر الطويل الثابت في «مسلم» وغيره، ولو انفرد حديث ابن عمر كان مقدما على حديث معاوية، فكيف والحال ما أعلمناك، فلزم في حديث معاوية الشذوذ عن الجم الغفير، فإما هو خطأ أو محمول على عمرة الجعرانة؛ فإنه قد كان أسلم إذ ذاك، وهي عمرة خفيت على بعض الناس؛ لأنها كانت ليلا على ما في الترمدي» و«النسائي»: أنه عليه الصلاة والسلام خرج إلى الجعرانة ليلا معتمرا فدخل مكة ليلا فضلى عمرته، ثم خرج من ليلته، الحديث. قال: فمن أدل ذلك خفيت على الناس، وعلى هذا فيجب الحكم على الزيادة التي في سنن النسائي»، وهو قوله: في أيام العشر بالخطأ ولو كانت بسند صحيح، إما للنسيان من معاوية أو من بعض الرواة عنه، انتهى. وقال في «المرقاة»: وقد صحأن النبي ﷺ لم يقصر في حجته، بل حلق، فيكون التقصير الذي رواه معاوية في عمرته والذي يدلُّ عليه أنه قال: عند المروة»، فلو كان له حاجا لقال بمنى.

وَعَنْهُ (رضي الله عنه)، أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ فِي حَجَّةِ الْوَدَاعِ: «اللَّهُمَّ ارْحَمِ الْمُحَلِّقِينَ». قَالُوا: وَالْمُقَصِّرِينَ يَا رَسُولَ اللهِ؟ قَالَ: «اللَّهُمَّ ارْحَمِ الْمُحَلَّقِينَ». قَالُوا: وَالْمُقَصِّرِينَ يَا رَسُولَ اللهِ؟ قَالَ: «وَالْمُقَصِّرِينَ». مُتَّفَقٌ عَلَيْهِ.

English

Ibn Umar (may Allah be pleased with him) reported that during the Farewell Pilgrimage, the Messenger of Allah (ﷺ) said, "O Allah, have mercy on those who shave their heads." They asked, "And those who shorten their hair, O Messenger of Allah?" He repeated, "O Allah, have mercy on those who shave their heads." When they asked a third time, he added, "And those who shorten their hair." [Agreed upon]

وَعَنْ يَحْيَى بْنِ الْحُصَيْنِ عَنْ جَدَّتِهِ (رضي الله عنهما) أَنَّهَا سَمِعَتْ النَّبِيَّ ﷺ فِي حَجَّةِ الْوَدَاعِ دَعَا لِلْمُحَلَّقِيْنَ ثَلَاثًا ، وَلِلْمُقَصِّرِينَ مَرَّةً وَاحِدَةً. رَوَاهُ مُسْلِمٌ.

English

Yahya ibn al-Husayn narrated from his grandmother that she heard the Prophet (ﷺ) during the Farewell Pilgrimage supplicate three times for those who shaved their heads and once for those who shortened their hair. [Narrated by Muslim]

وَعَنْ أَنَسٍ (رضي الله عنه) أَنَّ النَّبِيَّ ﷺ أَتَى مِنّى فَأَتَى الْجُمْرَةَ فَرَمَاهَا، ثُمَّ أَتَى مَنْزِلَهُ بِمِنِّي وَنَحَرَ نُسُكَهُ، ثُمَّ دَعَا بِالْخَلاقِ وَنَاوَلَ الْخَلاقَ شِقَّهُ۱ الْأَيْمَنَ فَحَلَقَهُ، ثُمَّ دَعَا أَبَا طَلْحَةَ الْأَنْصَارِيَّ فَأَعْطَاهُ إِيَّاهُ، ثُمَّ نَاوَلَهُ الشَّقَّ الْأَيْسَرَ، فَقَالَ: «احْلِقْ» فَحَلَقَهُ فَأَعْطَاهُ أَبَا طَلْحَةَ فَقَالَ: «اقْسِمُهُ بَيْنَ النَّاسِ»۲. مُتَّفَقٌ عَلَيْهِ.

English

Anas (may Allah be pleased with him) reported that the Prophet (ﷺ) came to Mina, stoned the Jamrah, went to his residence, sacrificed his animal, then asked for a razor. He gave the right side of his head to the barber to shave, then called Abu Talha al-Ansari and gave him the hair. He then offered the left side and said, "Shave," and gave that hair to Abu Talha, saying, "Distribute it among the people." [Agreed upon]

1 "The right side": Indicates starting with the right is recommended. Some scholars preferred the left (initially held by Abu Hanifah, who later retracted this view after realizing the Sunnah prioritizes the right side of the person being shaved, not the barber). As stated in Al-Mirqat: "If the barber stands behind, both rights can be accommodated."

1 The statement: Immediately, In Al-Hidayah: If it is something the owner is unlikely to seek, like date pits or pomegranate peels, discarding it permits use without announcement, but it remains the owner’s property, as ownership from an unknown person is invalid. 2 The statement: Stray camels, etc., Its apparent meaning is that stray camels should not be taken, as there is no fear of loss, as held by Shafi’i, Malik, and Ahmad for cows, camels, and horses, preferring leaving them. Our scholars and others said this was due to the prevalence of righteous people then. In our time, there is risk of dishonest hands, so taking it preserves it, making it preferable. Ibn Al-Humam elaborated on this. This is supported by Uthman’s practice, as times changed, ordering announcement after taking due to fear of betrayal, then sale, with the price held in the treasury for the owners. As stated in At-Ta’liq Al-Mumajjad.

2 "Distribute it among the people": Proves the permissibility of keeping human hair and seeking blessings from the Prophet's relics. As mentioned in Al-Mirqat.

۱ قوله : شقه الأيمن: دل على أن المستحب الابتداء بالأيمن، وذهب بعضهم إلى أن المستحب الأيسر؛ ليكون أيمن الحالق ونسب إلى أبي حنيفة إلا أنه رجع عن هذا، وسبب ذلك أنه قاس أولا يمين الفاعل، كما هو المتبادر من التيامن، ولما بلغه أنه اعتبر يمين المفعول رجع عن ذلك القول المبني على المعقول إلى صريح المنقول؛ إذ الحق بالاتباع أحق. قاله في المرقاة» كذا في رد المحتار». قال في اللباب»: هو المختار، قال شارحه : كما فيمنسك ابن العجمي و«البحر»، وقال «النخبة»: وهو الصحيح، انتهى. وفي المرقاة»: ولو وقف الحالق خلف المحلوق أمكن الجمع بين الأيمنين.

۲ قوله : أقسمه بين الناس : دل على طهارة شعر الآدمي وأن يتبرك بأشعاره وباقي آثاره. كذا في «المرقاة».

۱قوله: في الحال وقال في الهداية»: وإن كانت شيئًا يعلم أن صاحبها لا يطلبها كالنواة وقشور الرمان يكون إلقائه إباحة حتى جاز الانتفاع به من غير تعريف، ولكنه مبقى على ملك مالكه؛ لأن التمليك من المجهول لا يصح.

۲ قوله: فضالة الإبل إلخ فظاهره أن ضالة الإبل لا ينبغي أخذها؛ لعدم خوف ضياعها، وبه قال الشافعي ومالك وأحمد في البقر والإبل والفرس أن الترك أفضل. وقال أصحابنا وغيرهم كان ذلك إذ ذاك لغلبة أهل الصلاح. وفي زماننا لا يأمن وصول يد خائنة، ففي أخذه أحياؤها ، فهو أولى. وقد بسط الكلام فيه ابن الهمام. ويؤيد ما قال أصحابنا ما ثبت في زمان عثمان لانقلاب الزمان حيث أمر بتعريفها بعد التقطها خوفا من الخيانة، ثم بيعها وإمساك ثمنها في بيت المال لأربابها. كذا في التعليق الممجد».

وَعَنْ عَائِشَةَ (رضي الله عنها)قَالَتْ: كُنْتُ أُطَيِّبُ رَسُولَ اللَّهِ ﷺ قَبْلَ أَنْ يُحْرِمَ وَيَوْمَ النَّحْرِ قَبْلَ أَنْ يَطُوفَ بِالْبَيْتِ بِطِيبٍ فِيهِ مِسْكُ. مُتَّفَقٌ عَلَيْهِ.

وَفِي رِوَايَةٍ لِلطَّحَاوِيِّ عَنْهَا قَالَتْ: قَالَ رَسُولُ اللهِ ﷺ: «إِذَا رَمَيْتُمْ وَحَلَقْتُمْ فَقَدْ حَلَّ لَكُمُ الطَّيبُ وَالثَّيَابُ وَكُلُّ شَيْءٍ إِلَّا النِّسَاءَ». وَرَوَى الدَّارَ قُطْنِيُّ نَحْوَهُ.

English

Aisha (may Allah be pleased with her) said, "I would perfume the Messenger of Allah (ﷺ) before he entered ihram and on the Day of Sacrifice before he performed Tawaf around the House, using musk-based perfume." [Agreed upon]

In a version by Tahawi, she added: The Prophet (ﷺ) said, "When you stone (the Jamrah) and shave, everything becomes permissible for you except women (intimacy)." A similar narration was reported by Darqutni.

وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ ﷺ أَفَاضَ يَوْمَ النَّحْرِ، ثُمَّ رَجَعَ فَصَلَّى الظُّهْرَ بِمِنَّي۱. رَوَاهُ مُسْلِمٌ.

English

Ibn Umar (may Allah be pleased with him) reported that the Messenger of Allah (ﷺ) departed (from Mina) on the Day of Sacrifice, then returned to pray Dhuhr in Mina. [Narrated by Muslim]

1 "He prayed Dhuhr in Mina": Al-Lubab states this is recorded in Sahih Muslim, though other authentic collections mention he prayed in Makkah. Ibn Hajar in Fath al-Bari favored the Makkah version. Al-Mirqat reconciles: The conflict between Jabir's hadith (mentioning Dhuhr in Makkah) and this narration suggests one contains an error. Given the virtue of praying in the Sacred Mosque, the Makkah version is stronger. Alternatively, he may have prayed Dhuhr twice (once in each location) or this occurred on a different day during the pilgrimage. The hadith in Abu Dawud about departing after Dhuhr contradicts established evidence and is best interpreted as referring to another day.

۱ قوله: فصلى الظهر بمنى ذكر في اللباب» أنه يصلي الظهر بعد ما يرجع إلى منى، وهو مروي في صحيح مسلم، لكن في الكتب الستة : أنه له صلى الظهر بمكة، ومال إليه في «الفتح». وقال في شرح اللباب»: إنه أظهر نقلا وعقلا وتمامه فيه. قاله في رد المحتار»، وقال في المرقاة»: قال ابن الهمام والذي في حديث جابر الطويل الثابت في صحيح مسلم وغيره من كتب السنن خلاف ذلك حيث قال: ثم ركب رسول الله ﷺ فأفاض إلى البيت، فصلى الظهر بمكة، ولا شك أن أحد الخبرين وهم، وإذا تعارضا ولا بُدَّ من صلاة الظهر في أحد المكانين، ففي مكة بالمسجد الحرام ثبوت مضاعفة الفرائض فيه أولى.

والحمل على أنه أعاد الظهر بمنى مقتديًا على مذهبنا، أو إمامًا على مذهب الشافعي، وأمر أصحابه بالظهر حين انتظروه أولى من الحمل على الوهم، كما لا يخفى على أنه روى أنه كان يزور البيت في كل يوم من أيام النحر، فليحمل على يوم آخر، وأما خبر الترمذي الذي حسنه : أنه أخر طوافه إلى الليل، فمؤول بأنه أخر طواف نسائه إلى الليل أو جوز تأخير طواف الزيارة إلى الليل أو المعنى أخر طوافه الكائن مع نسائه إلى إلى ا الليل الرواية أنه زار زار . مع نسائه ليلا، وفيه في موضع آخر : وأما خبر أبي داود: «أنه أفاض من آخر يومه حين صلى الظهر ففيه دلالة على أنهصلى الظهر بمنى ثم أفاض، وهو خلاف ما ثبت في الأحاديث؛ لا تفاقها على أنه صلى الظهر بعد الطواف مع اختلافها أنه صلاها بمكة أو منى». نعم، لا يبعد أن يحمل على يوم آخر من أيام النحر بأن صلى الظهر بمنى ونزل في آخر يومه مع نسائه لطواف زيارتهن.

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَيْسَ عَلَى النِّسَاءِ حَلْقُ، إِنَّمَا عَلَى النِّسَاءِ التَّقْصِيرُ.۱ رَوَاهُ أَبُو دَاوُدَ وَالدَّارِمِيُّ.

English

Ibn Abbas (may Allah be pleased with him) reported that the Messenger of Allah (ﷺ) said: "Women are not required to shave [their heads]; rather they should only shorten their hair." [Narrated by Abu Dawud and Ad-Daraqutni]

English notes

1 The statement "they should only shorten their hair" means this is obligatory for women unlike men who must either shave or shorten. Shaving is superior and recommended for men but disliked for women as it disfigures them, just as shaving a beard disfigures a man. According to our school, shortening means taking off about an ant's length of hair from the head, whether male or female. Even if one only shaves a quarter, it is valid but disliked for abandoning the Sunnah, as the Sunnah is to shave the entire head or shorten all hair. [As mentioned in Sharh al-Lubab, Al-Qahistani, Al-Mirqat and Rad al-Muhtar]

۱ قوله : إنها على النساء التقصير : أي إنما الواجب عليهن التقصير خلاف الرجال، فإنه يجب عليهم أحدهما، والحلق أفضل، وهو مسنون، وهذا في حق الرجل ويكره للمرأة؛ لأنه مثلة في حقها كحلق الرجل لحيته، ثم عندنا التقصير هو أن يأخذ من رؤوس شعر رأسه مقدار النملة، رجلا كان أو إمرأة، ولو اقتصر على حلق الربع جاز، كما في التقصير، لكن مع الكراهة لتركه السنة؛ فإن السنة حلق جميع الرأس أو لتقصير جميعه، كما في شرح «اللباب» و«القهستاني». المرقاة» ورد المحتار ملتقط منهما.
