بَابُ دُخُولِ مَكَّةَ وَالطَّوَافِEntering Makkah and Performing Tawaf

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَلْيَطَّوَّفُوا بِالْبَيْتِ الْعَتِيقِ (الحج: ٢٩، وَقَوْلِهِ: وَاتَّخِذُوا۱ مِن مَّقَامِ إِبْرَاهِيمَ مُصَلَّى(البقرة: )، وَقَوْلِهِ: إِنَّ الصَّفَا۲ وَالْمَرْوَةَ مِن شَعَابِرِ اللهِ فَمَنْ حَجَّ الْبَيْتَ أَوِ اعْتَمَرَ فَلَا جُنَاحَ عَلَيْهِ أَن يَطَّوَّفَ بِهِمَا (البقرة: ١٥٨)

۱ قوله: واتخذوا : وقال في فتح القدير»: إنه علقة لما انتهى إلى مقام إبراهيم قرأ: ﴿وَاتَّخِذُوا مِن مَقَامِ إِبْرَاهِيمَ مُصَلَّى (البقرة: ۱۲۵. نبه بالتلاوة قبل الصلاة على أن صلاته هذه امتثالا لهذا الأمر، والأمر للوجوب، إلا أن استفادة ذلك من التنبيه، وهو ظني، فكان الثابت الوجوب أي بالمعنى المصطلح ويلزمه حكمنا بمواظبته من غير ترك؛ إذ لا يجوز عليه ترك الواجب، انتهى. وفي «البناية»: عن عمر له أنه نسي ركعتي الطواف، فقضاهما بذي طوى. فدل الأمر والقضاء على الوجوب.

۲ قوله: إن الصفا والمروة إلخ : قلنا بأول الآية، وهو قوله تعالى: ﴿إِنَّ الصَّفَا وَالْمَرْوَةَ مِن شَعَابِرِ اللهِ (البقرة: ١٥٨)، فإن الشعائر جمع شعيرة، وهي العلامة، وذلك يكون فرضا، فأول الآية يدلُّ على الفرضية، وآخرها على الإباحة، فعملنا بهما، وقلنا بالوجوب؛ لأنه ليس بفرض علما، وهو فرض عملا ، فكان فيه نوع من كل واحد من الفرض والاستحباب. كذا في «البناية» و«العناية».

English

Allah the Almighty says: "And let them perform Tawaf around the ancient House." (Al-Hajj 22:29)

And His saying: "And take the standing place of Ibrahim as a place of prayer." (Al-Baqarah 2:125)

And His saying: "Indeed, Safa and Marwah are among the symbols of Allah. So whoever makes Hajj to the House or performs Umrah, there is no blame upon him for walking between them." (Al-Baqarah 2:158)

1 The statement "And take...": In Fath al-Qadeer, it is said: "It is linked to when he reached the standing place of Ibrahim, so he recited: 'And take the standing place of Ibrahim as a place of prayer.' (Al-Baqarah 2:125). By reciting this before the prayer, he indicated that this prayer was in compliance with this command, and the command implies obligation. However, deriving this from the indication is speculative, so the established ruling is obligation in the terminological sense, and it necessitates adherence without omission, as it is impermissible to neglect an obligation."

In Al-Binayah: It is narrated that Umar (may Allah be pleased with him) forgot the two rak'ahs of Tawaf and performed them at Dhu Tuwa. This command and his action indicate obligation.

2 The statement "Indeed, Safa and Marwah...": We rely on the beginning of the verse: "Indeed, Safa and Marwah are among the symbols of Allah." (Al-Baqarah 2:158). The word sha‘a’ir (symbols) is the plural of sha‘īrah, meaning a sign, and this implies obligation. The beginning of the verse indicates obligation, while the end indicates permissibility. Thus, we combine both and affirm obligation, not as a theoretical obligation but as a practical one, containing elements of both obligation and recommendation. This is mentioned in Al-Binayah and Al-'Inayah.

وَعَنْ نَافِعٍ قَالَ: إِنَّ ابْنَ عُمَرَ (رضي الله عنهما)كَانَ لَا يَقْدَمُ مَكَّةَ إِلَّا بَاتَ۱ بِذِي طُوًى حَتَّى يُصْبِحَ وَيَغْتَسِلَ۲ وَيُصَلِّي. ثُمَّ يَدْخُلُ مَكَّةَ نَهَارًا۳ وَإِذَا نَفَرَ٤ مِنْهَا مَرَّ بِذِي طُوًى وَبَاتَ بِهَا حَتَّى يُصْبِحَ، وَيَذْكُرُ عَنِ النبي كَانَ يَفْعَلُ ذَلِكَ. مُتَّفَقٌ عَلَيْهِ.

English

Nafi’ reported: Ibn Umar (may Allah be pleased with them) would never enter Makkah without spending the night at Dhu Tuwa until dawn, performing ghusl, and praying. Then he would enter Makkah during the day. When departing, he would pass through Dhu Tuwa and spend the night there until dawn, mentioning that the Prophet (ﷺ) did the same. [Agreed upon]

In Fath al-Qadeer: "It does not matter if one enters at night or day, as narrated by An-Nasa’i that Ali (may Allah be pleased with him) entered both at night and day, during his Hajj by day and his Umrah by night. Both are equal in terms of entering to fulfill the rites of Ihram, or because it is merely entering a city. As for what is narrated from Ibn Umar, that he discouraged entering at night, this was not an affirmation of Sunnah but out of concern for pilgrims being robbed."

1 The statement "spent the night at Dhu Tuwa": In At-Talwih, it is said: "There is no disagreement that spending the night at Dhu Tuwa and entering Makkah during the day are not rituals. However, since he did so in emulation of the Prophet (ﷺ) and following his practices, his reward for this was immense."

2 The statement "and performed ghusl": In Al-Bahr Ar-Ra’iq, it is said: "Among the recommended acts of ghusl is performing it upon entering Makkah, for cleanliness. It is recommended even for menstruating women and those in postnatal bleeding."

3 The statement "during the day": In Lubab al-Manasik: "There is no harm in entering at night or day, but entering during the day is preferable." In Fatawa Qadi Khan: "It is recommended to enter by day, as Ibn Umar (may Allah be pleased with them) would not enter Makkah except by day."

4 The statement "When departing...": I say: This is good but not an established Sunnah according to the majority. As stated in Al-Maswa.

۱ قوله: بات بذي طوى: وفي التلويح»: لا خلاف أن المبيت بذي طوى ودخول مكة نهار ليس من المناسك، لكن أن فعله اقتداء بالنبي وتبعا لآثاره، كان ثوابه في ذلك جزيلا. كذا في عمدة القاري». وقال في «فتح القدير»: ولا يضره ليلا دخلها أو نهارا؛ لما روي النسائي أنه علي دخلها ليلا ونهارا، دخلها في حجه نهارا وليلا في عمرته. وهما سواء في حق الدخول؛ لأداء ما به الإحرام، أو ولأنه دخول بلد. وما روي عن ابن عمر : أنه كان ينهى عن الدخول ليلا، فليس تقريرا للسنة، بل شفقة على الحاج من السراق.

۲قوله: ويغتسل وقال في البحر الرائق: إن من الاغتسلات المسنونة الاغتسال لدخولها، وهو للنظافة فيستحب للحائض والنفساء.

۳قوله: نهارا وفي لباب المناسك ولا بأس بدخوله ليلا ونهارا، ولكن دخوله نهارا أفضل، في فتاوى قاضىخان»: المستحب أن يدخلها نهارا، لما كان ابن عمر الله لا يقدم مكة الحديث. كذا في بذل المجهود».

٤قوله: وإذا نفر إلخ قلت: هو حسن، وليس بسنة لازمة عند الجمهور. قاله في «المسوى».

وَعَنْ عَائِشَةَ (رضي الله عنها) قَالَتْ: أَنَّ النَّبِيَّ ﷺ لَمَّا جَاءَ إِلَى مَكَّةَ دَخَلَهَا۱ مِنْ أَعْلَاهَا وَخَرَجَ مِنْ أَسْفَلِهَا. مُتَّفَقٌ عَلَيْهِ.

English

Aisha (may Allah be pleased with her) reported: When the Prophet (ﷺ) came to Makkah, he entered from the upper side and exited from the lower side. [Agreed upon]

1 The statement "he entered it...": In Al-Bahr Ar-Ra’iq: "It is recommended to enter Makkah from the direction of Al-Ma‘la, so that one faces the House upon entry as a sign of reverence. When exiting, one should depart from the lower side."

1 The statement: “The Messenger of Allah (ﷺ) bought”: In Sharh As-Sunnah, it is stated: This indicates the permissibility of buying on credit, pledging for a debt, pledging in residence, though the Book restricts it to travel, and transacting with the People of the Covenant, even if their wealth may involve usury or the price of wine. This is stated in Al-Marqah. 2 The statement: “From a Jew”: This indicates the permissibility of transacting with disbelievers in matters where the prohibition of the transacted item is not confirmed, disregarding their corrupt beliefs and transactions among themselves. It also permits selling, pledging, leasing weapons, and other things to disbelievers who are not at war. This is stated in Umdat Al-Qari.

وَعَنِ الْمُهَاجِرِ الْمَكَّيَّ قَالَ: سُئِلَ جَابِرُ بْنُ عَبْدِ اللهِ (رضي الله عنه) عَنِ الرَّجُلِ يَرَى الْبَيْتَ يَرْفَعُ يَدَيْهِ، فَقَالَ: مَا كُنْتُ أَرَى أَحَدًا يَفْعَلُ هَذَا إِلَّا الْيَهُودَ ، وَقَدْ حَجَجْنَا مَعَ رَسُولِ اللهِ ﷺ فَلَمْ يَكُنْ يَفْعَلُهُ۱. رَوَاهُ أَبُو دَاوُدَ.

English

Al-Muhajir Al-Makki reported: Jabir ibn Abdullah (may Allah be pleased with him) was asked about a man who raises his hands upon seeing the Ka‘bah. He said, "I have never seen anyone do this except the Jews. We performed Hajj with the Messenger of Allah (ﷺ), and he never did so." [Narrated by Abu Dawud]

1 The statement "he never did so": In Al-Lubab: "One should not raise hands upon seeing the Ka‘bah. Some say it is permissible. Al-Qari said in his commentary: 'The correct view is not to raise them, even while supplicating, as it is not mentioned in the reliable books of our scholars.' At-Ṭahawi explicitly stated that it is disliked according to our three Imams."

وَعَنْ عُرْوَةَ بْنِ الزُّبَيْرِ (رضي الله عنه) قَالَ: قَدْ حَجَّ النَّبِيُّ ﷺ فَأَخْبَرَتْنِي عَائِشَةُ (رضي الله عنها)أَنَّ أَوَّلَ شَيْءٍ بَدَأَ بِهِ حِينَ قَدِمَ أَنَّهُ تَوَضَّأَ۱ثُمَّ طَافَ۲ بِالْبَيْتِ ثُمَّ لَمْ تَكُنْ۳ عُمْرَةً. ثُمَّ حَجَّ أَبُو بَكْرٍ (رضي الله عنه)، فَكَانَ أَوَّلَ شَيْءٍ بَدَأَ بِهِ الطَّوَافُ بِالْبَيْتِ، ثُمَّ لَمْ تَكُنْ عُمْرَةً ثُمَّ عُمَرُ (رضي الله عنه)، ثُمَّ عُثْمَانُ (رضي الله عنه)مِثْلُ ذَلِكَ٤ . مُتَّفَقٌ عَلَيْهِ.

English

Urwah ibn Az-Zubayr (may Allah be pleased with him) reported: The Prophet (ﷺ) performed Hajj, and Aisha (may Allah be pleased with her) informed me that the first thing he did upon arrival was perform wudu, then Tawaf around the House. He did not perform Umrah separately, as his Umrah was combined with Hajj. Abu Bakr (may Allah be pleased with him) also began with Tawaf, then performed Hajj without a separate Umrah. The same was done by Umar and Uthman (may Allah be pleased with them). [Agreed upon]

1 The statement "he performed wudu": Because purity from ritual impurity is obligatory in Tawaf according to the Madhhab, and this is the correct view. This does not prove that purity is a condition for the validity of Tawaf, as its legislation is agreed upon. The disagreement is over whether Tawaf is valid without it. According to us, it is obligatory, while the majority consider it a condition.

2 The statement "then performed Tawaf": Meaning the Tawaf of Umrah, as he was performing Hajj Qiran (combined Hajj and Umrah).

3 The statement "He did not perform Umrah separately": Meaning he did not perform an additional Umrah afterward, as the Umrah combined with Hajj sufficed.

4 The statement "the same was done...": The summary is that all of them performed a separate Umrah after their Hajj.

الحواشي

۱قوله : إنه توضأ لأن الطهارة في الطواف من النجاسة الحكمية على المذهب واجبة، وهو الصحيح، فلا دلالة فيه على كون الطهارة شرطا لصحة الطواف؛ لأن مشروعيتها مجمع عليها، وإنما الخلاف في صحة الطواف بدونها، فعندنا أنها واجبة، والجمهور على أنها شرط. وأما الاستدلال بقوله : «الطواف بالبيت صلاة، إلا أن الله أباح فيه النطق فمدفوع؛ لأن الحديث ضعيف مع أن المشبه بالشيء لا يستدعي المشاركة معه في كل شيء، ألا ترى إلى جواز الأكل والشرب في الطواف بالإجماع مع عدم جوازهما في الصلاة من غير نزاع الدر المختار» و«رد المحتار» و«المرقاة» ملتقط منها .

۲قوله: ثم طاف أي طواف العمرة لكونه قارنا دلت عليه أحاديث كثيرة، وقد ذكرناها في باب الإحرام»، «المرقاة» و «عمدة القاري» ملخصا.

۳ قوله : ثم لم تكن عمرة: أي ثم لم يوجد منه بعد ذلك عمرة؛ فإنه اكتفى بالعمرة المقرونة بالحج. كذا في «المرقاة».

٤قوله : مثل ذلك والحاصل: إن ما وقع منهم جميعهم عمرة مفردة بعد حجهم. قاله في «المرقاة».

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) أَنَّ النَّبِيَّ ﷺ قَالَ: «الطَّوَافُ حَوْلَ الْبَيْتِ مِثْلُ الصَّلَاةِ۱ إِلَّا أَنَّكُمْ تَتَكَلَّمُوْنَ فِيهِ، فَمَنْ تَكَلَّمَ فِيهِ فَلَا يَتَكَلَّمَنَّ إِلَّا بِخَيْرٍ». رَوَاهُ التَّرْمِذِيُّ وَالنَّسَائِيُّ وَالدَّارَمِيُّ، وَذَكَرَ التَّرْمِذِيُّ جَمَاعَةً وَقَفُوْهُ عَلَى ابْنِ عَبَّاسٍ.

English

Ibn Abbas (may Allah be pleased with them) reported: The Prophet (ﷺ) said, "Tawaf around the House is like prayer, except that you may speak during it. So whoever speaks, let him only speak good." [Narrated by At-Tirmidhi, An-Nasa’i, and Ad-Dārimi]

1 The statement "like prayer": This refers to similarity in reward, not in all rulings. Walking, turning away from the Qiblah, or speaking intentionally do not invalidate Tawaf, unlike prayer.

۱قوله: مثل الصلاة المراد به مثلها في حصول الثواب لا في جميع الأحكام؛ إذ لا يبطله المشي والانحراف عن القبلة وتعمد الحديث، بخلاف الصلاة، ولو سبقه الحدث فبنى جاز على الأصح من مذهب الشافعي، وفي الصلاة يستقبل، ولو نذر أن يصلي فطاف لم يجزه، ألا ترى إلى جواز الأكل والشرب في الطواف بالإجماع مع عدم جوازهما في الصلاة من غير نزاع. ولهذا لا ركوع فيه ولا سجود، ولو كان حقيقة لكان احتاج إلى تحليل وتسليم ويعلم من فعله عدم شرطية الاستقبال، وليس لأصل الطواف وقت مشروط، وبقي بقية شروط الصلاة من الطهارة الحكمية والحقيقة وستر العورة فهي معتبرة عند الشافعي كالصلاة وواجبات عندنا؛ لأنه لا يلزم من مثل الشيء أن يكون مشاركا له في كل شيء على الحقيقة مع أن الحديث من الأحاد، وهو ظني لا تثبت به الفرضية، «الجوهر النقي» و عمدة القاري» و «المرقاة» مختصرا.

۲ قوله : من يهودي فيه جواز معاملة الكفار فيما لم يتحقق تحريم عين المتعامل فيه وعدم الاعتبار بفساد معتقدهم ومعاملاتهم فيما بينهم، وفيه جواز بيع السلاح ورهنه وإجارته وغير ذلك من الكفار ما لم يكن حربيا. قاله في عمدة القاري».

وَعَنْهُ(رضي الله عنهما)قَالَ: قَالَ رَسُولُ اللهِ ﷺ: نَزَلَ الْحَجَرُ الْأَسْوَدُ مِنَ الْجَنَّةِ وَهُوَ أَشَدُّ بَيَاضًا مِنَ اللَّبَنِ فَسَوَّدَتْهُ خَطَايَا بَنِي آدَمَ. رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ، وَقَالَ: هَذَا حَدِيثُ حَسَنٌ صَحِيحٌ.

Ibn Abbas (may Allah be pleased with them) reported: The Prophet (ﷺ) said, "The Black Stone descended from Paradise, whiter than milk, but the sins of the children of Adam blackened it." [Narrated by Ahmad and At-Tirmidhi]

وَعَنْهُ (رضي الله عنهما، قَالَ: قَالَ رَسُولُ اللهِ ﷺ فِي الْحَجَرِ: وَاللهِ لَيَبْعَثَنَّهُ اللَّهُ يَوْمَ الْقِيَامَةِ، لَهُ عَيْنَانِ يُبْصِرُ بِهِمَا، وَلِسَانُ يَنْطِقُ بِهِ، يَشْهَدُ عَلَى مَنْ اسْتَلَمَهُ بِحَقِّ». رَوَاهُ التَّرْمِذِيُّ وَابْنُ مَاجَهُ وَالدَّارِمِيُّ وَالْبَيْهَقِيُّ بِإِسْنَادٍ صَحِيحٍ عَلَى شَرْطِ مُسْلِمٍ.

English

Ibn Abbas (may Allah be pleased with them) reported: The Prophet (ﷺ) said about the Black Stone, "By Allah, Allah will resurrect it on the Day of Judgment with two eyes to see and a tongue to speak, testifying for those who touched it in truth." [Narrated by At-Tirmidhi, Ibn Majah, Ad-Dārimi, and Al-Bayhaqi]

وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما)قَالَ: سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: «إِنَّ الرُّكْنَ وَالْمَقَامَ يَاقُوتَتَانِ مِنْ يَاقُوتِ الْجَنَّةِ ، طَمَسَ اللهُ نُورَهُمَا، وَلَوْ لَمْ يَطْمِسْ نُورَهُمَا لَأَضَاءَنَا مَا بَيْنَ الْمَشْرِقِ وَالْمَغْرِبِ». رَوَاهُ التَّرْمِذِيُّ.

English

Ibn Umar (may Allah be pleased with them) reported: The Prophet (ﷺ) said, "The Corner (Black Stone) and the Maqam (Station of Ibrahim) are two rubies from the rubies of Paradise. Allah extinguished their light, and had He not done so, they would have illuminated between the east and the west." [Narrated by At-Tirmidhi]

وَعَنْ عُبَيْدِ بْنِ عُمَيْرٍ أَنَّ ابْنَ عُمَرَ (رضي الله عنه)كَانَ يُزَاحِمُ عَلَى الرُّكْنَيْنِ زِحَامًا۱ مَا رَأَيْتُ أَحَدًا مِنْ أَصْحَابِ رَسُولِ اللهِ لا يُرَاحِمُ عَلَيْهِ ، قَالَ: إِنْ أَفْعَلْ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: «إِنَّ مَسْحَهُمَا كَفَّارَةُ لِلْخَطَايَا وَسَمِعْتُهُ يَقُولُ: «مَنْ طَافَ بِهَذَا الْبَيْتِ أُسْبُوعًا فَأَحْصَاهُ كَانَ كَعِتْقِ رَقَبَةٍ وَسَمِعْتُهُ يَقُوْلُ: «لَا يَضَعُ قَدَمًا وَلَا يَرْفَعُ أُخْرَى إِلَّا حَطَّ اللهُ عَنْهُ خَطِيئَةً وَكَتَبَ لَهُ بِهَا حَسَنَةً». رَوَاهُ التَّرْمِذِيُّ .

وَفِي رِوَايَةٍ لِأَحْمَدَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ عُمَرَ (رضي الله عنه)أَنَّهُ لا قَالَ لَهُ: «إِنَّكَ رَجُلٌ قَوِيٌّ لَا تُرَاحِمْ عَلَى الْحَجَرِ فَتُؤْذِي الضَّعِيفَ إِنْ وَجَدْتَ خَلْوَةً فَاسْتَلِمْهُ، وَإِلَّا فَاسْتَقْبِلْهُ وَكَبِّرْ وَهَلَّلْ».

English

Ubaid ibn Umayr reported: I saw Ibn Umar (may Allah be pleased with them) pushing through the crowd at the two corners (Black Stone and Yemeni Corner) in a way I never saw any other Companion do. He said"If I do so, it is because I heard the Prophet (ﷺ) say, 'Touching them erases sins,' and I heard him say, 'Whoever performs Tawaf properly, it is like freeing a slave,' and I heard him say, 'No one lifts a foot or places it down except that Allah erases a sin and records a good deed.'" [Narrated by At-Tirmidhi]

In a narration by Ahmad: Sa‘id ibn Al-Musayyab reported that Umar (may Allah be pleased with him) said to him, "You are a strong man, do not push at the Stone and harm the weak. If you find space, touch it; otherwise, face it and say Takbir and Tahlil."

Ibn Abbas (may Allah be pleased with them) reported: The Prophet (ﷺ) and his companions performed Umrah from Al-Ji‘irranah, walking briskly (Ramal) around the House, with their cloaks tucked under their right armpits and draped over their left shoulders. [Narrated by Abu Dawud]

Abdullah ibn As-Sa’ib (may Allah be pleased with him) reported: I heard the Prophet (ﷺ) say between the two corners (Rukn Yamani and Black Stone): "Our Lord, give us good in this world and good in the Hereafter, and protect us from the punishment of the Fire." (Al-Baqarah 2:201) [Narrated by Abu Dawud]

In Radd al-Muḥtar: "It is narrated that the Prophet (ﷺ) said between the two corners: 'Our Lord, give us...' (Al-Baqarah 2:201). This does not contradict the earlier ruling, as it likely refers to recitation unrelated to dhikr, or it was said specifically for dhikr, or to demonstrate permissibility."

Abu Hurairah (may Allah be pleased with him) reported: The Prophet (ﷺ) said, "Whoever performs Tawaf around the House seven times, speaking only: 'Subhan Allah,' 'Alhamdulillah,' 'La ilaha illa Allah,' 'Allahu Akbar,' and 'La hawla wa la quwwata illa billah,' ten sins are erased, ten good deeds are recorded, and he is raised ten degrees. But whoever performs Tawaf while speaking (otherwise), he is like one wading into mercy up to his ankles." [Narrated by Ibn Majah]

Safiyyah bint Shaybah reported: A woman from Quraysh told me, "I entered a house with other women to observe the Prophet (ﷺ) performing Sa‘i between Safa and Marwah. I saw him walking so vigorously that his lower garment swayed, and I heard him say, 'Perform Sa‘i, for Allah has prescribed it for you.'" [Narrated in Sharh as-Sunnah]

۲ قوله: اسعوا فإن الله كتب عليكم السعي : أي السعي بين الصفا والمروة واجب، وليس بركن. وقال الشافعي : إنه ركن لهذا الحديث، وإنا قد قلنا أيضًا بموجبه؛ إذ مثله لا يزيد على إفادة الوجوب؛ لأن الحديث آحاد، فلا يثبت به الفرضية، وإنما يثبت به الوجوب، وقد قلنا به، أما الركن فإنما يثبت عندنا بدليل مقطوع به، فإثباته بهذا الحديث إثبات بغير دليل، فحقيقة الخلاف في أن مفاد هذا الدليل ماذا؟ والحق فيه ما قلنا؛ لأن نفس الشيء ليس إلا ركنه وحده أو مع شيء آخر، فإذا كان ثبوت ذلك الشيء قطعيا لزم في ثبوت أركانه القطع؛ لأن ثبوتها هو ثبوته، فإذا فرض القطع به كان ذلك للقطع بها، وتقدم مثل هذا في مسألة قراءة الفاتحة في الصلاة، «الهداية» و«فتح القدير» و«شرح النقاية» ملخصا.

Abis ibn Rabi‘ah reported: I saw Umar (may Allah be pleased with him) kiss the Black Stone and say, "I know you are just a stone that can neither harm nor benefit. Had I not seen the Prophet (ﷺ) kiss you, I would not have done so." [Agreed upon]

وَعَنْهُ (رضي الله عنهما)قَالَ: مَا تَرَكْنَا اسْتِلَامَ هَذَيْنِ الرُّكْنَيْنِ الْيَمَانِيِّ وَالْحَجَرِ فِي شِدَّةٍ وَلَا رَخَاءٍ مُنْذُ رَأَيْتُ رَسُولَ اللهِ ﷺ يَسْتَلِهُمَا. مُتَّفَقٌ عَلَيْهِ.

وَفِي رِوَايَةٍ لَهُمَا: قَالَ نَافِعُ: رَأَيْتُ ابْنَ عُمَرَ(رضي الله عنهما) يَسْتَلِمُ الْحَجَرَ بِيَدِهِ ثُمَّ قَبَّلَ يَدَهُ، وَقَالَ: مَا تَرَكَتُهُ مُنْذُ رَأَيْتُ رَسُوْلَ اللهِ ﷺ يَفْعَلَهُ.

English

Ibn Umar (may Allah be pleased with them) reported: "We never abandoned touching these two corners, the Yemeni Corner and the Black Stone, in hardship or ease, since I saw the Prophet (ﷺ) do so." [Agreed upon]

In another narration: Nafi‘ said, "I saw Ibn Umar touch the Black Stone with his hand and kiss his hand, saying, 'I have never abandoned this since I saw the Prophet (ﷺ) do it.'"

Hadith 3046

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما)قَالَ: طَافَ النَّبِيُّ ﷺ فِي حَجَّةِ الْوَدَاعِ عَلَى۲ بَعِيرٍ يَسْتَلِمُ الرُّكْنَ بِمِحْجَرٍ مُتَّفَقٌ عَلَيْهِ.

وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ عَنْهُ : أَنَّ رَسُوْلَ اللهِ ﷺ قَدِمَ مَكَّةَ وَهُوَ يَشْتَكِيْ، فَطَافَ عَلَى رَاحِلَتِهِ، كُلَّمَا أَتَى عَلَى الرُّكْنِ اسْتَلَمَ الرُّكْنَ بِمِحْجَنٍ، فَلَمَّا فَرَغَ مِنْ طَوَافِهِ أَنَاخَ فَصَلَّى رَكْعَتَيْنِ.

English

Ibn Abbas (may Allah be pleased with them) reported: The Prophet (ﷺ) performed Tawaf during the Farewell Hajj on a camel, touching the Corner with a stick. [Agreed upon]

In a narration by Abu Dawud: The Prophet (ﷺ) entered Makkah while ill and performed Tawaf on his mount, touching the Corner with a stick. After Tawaf, he dismounted and prayed two rak‘ahs.

2 The statement "on a camel": The reasons for riding vary in narrations, some mention illness, others visibility for the people.

۲ قوله: على بعير : اختلفت الروايات في سبب ركوبه في الطواف، ففي رواية ابن عباس عند أبي داود: «أن رسول الله ﷺ قدم مكة، وهو يشتكي فطاف على راحلته، ووقع في حديث جابر عند مسلم أن النبي ﷺ طاف راكبا؛ ليراه الناس، وليسألوه»، فيحتمل أن يكون فعل ذلك لأمرين وحينئذ لا دلالة فيه على جواز الطواف راكبا بغير عذر قاله في بذل المجهود». ولذلك قال في فتح القدير: ومن طاف راكبا أو محمولا أو سعى بين الصفا والمروة، كذلك إن كان بعذر جاز، فلا شيء عليه، وإن كان بغير عذر فما دام بمكة يعيد، فإن رجع إلى أهله بلا إعادة فعليه دم؛ لأن المشي واجب عندنا على هذا نص المشايخ، وهو كلام محمد.

وَعَنْ أُمَّ سَلَمَةَ (رضي الله عنها)قَالَتْ: شَكَوْتُ إِلَى رَسُولِ اللهِ ﷺ أَنِّي أَشْتَكِي، قَالَ: طُوفِي مِنْ وَرَاءِ النَّاسِ وَأَنْتِ رَاكِبَةٌ ، فَطُفْتُ وَرَسُولُ اللهِ ﷺ يُصَلِّي إِلَى جَنْبِ الْبَيْتِ يَقْرَأُ بِ الطُّورِ وَكِتَابِ مَسْطُورِ مُتَّفَقٌ عَلَيْهِ.

English

Umm Salamah (may Allah be pleased with her) reported: I complained to the Prophet (ﷺ) about my illness. He said, "Perform Tawaf behind the people while riding." So I did, while the Prophet (ﷺ) prayed beside the Ka‘bah, reciting Surah At-Tur. [Agreed upon]

وَعَنْ جَابِرٍ (رضي الله عنه)قَالَ: طَافَ رَسُولُ اللهِ ﷺ بِالْبَيْتِ فِي حَجَّةِ الْوَدَاعِ عَلَى رَاحِلَتِهِ يَسْتَلِمُ الْحَجَرَ بِمِحْجَنِهِ ؛ لِأَنْ۱ يَرَاهُ النَّاسُ وَلِيُشْرِفَ وَلِيَسْأَلُوهُ، فَإِنَّ النَّاسَ غَشُوهُ. رَوَاهُ مُسْلِمٌ.

English

Jabir (may Allah be pleased with him) reported: The Prophet (ﷺ) performed Tawaf during the Farewell Hajj on his mount, touching the Black Stone with a stick, so people could see him, ask him, and he could be visible to all, as they crowded around him. [Narrated by Muslim]

۱قوله: لأن يراه الناس إلخ : هذا بيان لعلة ركوبه ، وجاء في سنن أبي داود أنه كان له في طوافه هذا مريضا، وإلى هذا المعنى أشار البخاري، وترجم عليه باب المريض يطوف راكبا فيحتمل أنه طاف راكبا لهذا كله. قاله النووي.

Ibn Abbas (may Allah be pleased with them) reported: The Prophet (ﷺ) performed Tawaf on a camel, pointing to the Corner with something in his hand and saying Takbir. [Narrated by Al-Bukhari]

وَعَنْ أَبِي الطَّفَيْلِ (رضي الله عنه)قَالَ: رَأَيْتُ رَسُوْلَ اللهِ ﷺ يَطُوْفُ بِالْبَيْتِ وَيَسْتَلِمُ الرُّكْنَ بِمِحْجَنٍ مَعَهُ، وَيُقَبِّلُ الْمِحْجَنَ. رَوَاهُ مُسْلِمٌ.

English

Abu At-Ṭufayl (may Allah be pleased with him) reported: I saw the Prophet (ﷺ) perform Tawaf, touching the Corner with a stick and kissing the stick. [Narrated by Muslim]

وَعَنْ عَائِشَةَ (رضي الله عنها)قَالَتْ: خَرَجْنَا مَعَ النَّبِيِّ ﷺ لَا تَذْكُرُ إِلَّا الْحَجَّ۱ ، فَلَمَّا كُنَّا بِسَرِفَ طَمِثْتُ، فَدَخَلَ عَلَيَّ النَّبِيُّ ﷺ وَأَنَا أَبْكِي فَقَالَ: «مَا يُبْكِيكِ؟» قَالَ: «لَعَلَّكِ نُفِسْتِ؟» قُلْتُ: نَعَمْ. قَالَ: «فَإِنَّ ذَلِكِ شَيْءٌ كَتَبَهُ اللهُ عَلَى بَنَاتِ آدَمَ، فَافْعَلِي۲ مَا يَفْعَلُ الْحَاجَ، غَيْرَ أَنْ لَا تَطُوفِي بِالْبَيْتِ حَتَّى تَظْهُرِي». مُتَّفَقٌ عَلَيْهِ.

English

Aisha (may Allah be pleased with her) reported: We set out with the Prophet (ﷺ) only intending Hajj. When we reached Sarif, I began menstruating. The Prophet (ﷺ) entered while I was crying and asked, "What is wrong?" I said, "I have gotten my period." He said, "This is what Allah has decreed for the daughters of Adam. Do everything the pilgrims do, except Tawaf until you are pure." [Agreed upon]

2 The statement "Do everything...": A menstruating woman may perform all rites except Tawaf.

۱ قوله: إلا الحج: يعني إلا قصد الحج؛ لأنهم كانوا يظنون امتناع العمرة في أشهر الحج، فأخبرت عن اعتقادها. كذا في عمدة القاري».

۲ قوله: فافعلي إلخ وفي «الهداية»: وإذا حاضت المرأة عند الإحرام اغتسلت وأحرمت، وصنعت كما يصنعه الحاج، غير أنها لا تطوف بالبيت حتى تطهر .

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)قَالَ: بَعَثَنِي أَبُو بَكْرٍ فِي الْحَجَّةِ الَّتِي أَمَرَهُ النَّبِيُّ ﷺ عَلَيْهِا قبل قَبْلَ حَجَّةِ الْوَدَاعِ يَوْمَ النَّحْرِ فِي رَهْطٍ أَمَرَهُ أَنْ يُؤَذِّنَ فِي النَّاسِ: أَلَا لَا يَحُجَّ۱ بَعْدَ الْعَامِ مُشْرِكٌ، وَلَا يَطُوفَنَّ۲ بِالْبَيْتِ عُرْيَانُ. مُتَّفَقٌ عَلَيْهِ.

English

Abu Hurairah (may Allah be pleased with him) reported: Abu Bakr (may Allah be pleased with him) sent me on the Hajj the Prophet (ﷺ) appointed him to lead before the Farewell Hajj, on the Day of Sacrifice, to announce: "No polytheist may perform Hajj after this year, and no one may perform Tawaf naked." [Agreed upon]

1 The statement "No polytheist may perform Hajj": This abolished pre-Islamic practices.

2 The statement "no one may perform Tawaf naked": Covering one’s awrah is obligatory in Tawaf.

الحواشي

۱ قوله : لا يحج بعد العام مشرك : أي فلا يحجوا، ولا يعتمروا كما كانوا يفعلون في الجاهلية. كذا في «المدارك»، وفي المقام تفصيل موضع بسطه هو التفسير الأحمدي».

۲قوله: ولا يطوفن بالبيت عريان ولذلك ستر العورة في الطواف عندنا من واجبات الطواف التي تجبر بالدم، فلو طاف كاشفا ربع عضو من العورة يجب الدم. كذا في «الدر المختار».
