وَقَوْلِ الله عز وجل: وَأَن تَصُوْمُوا خَيْرٌ لَّكُمْ ) (البقرة: ١٨٤)
And the words of Allah Almighty: “And fasting is better for you, if only you knew.” (Qur’an 2:184)
وَعَنْ عَائِشَةَ (رضي الله عنها) قَالَتْ: إِنَّ حَمْزَةَ بْنَ عَمْرٍو الْأَسْلَمِيَّ قَالَ لِلنَّبِيِّ : أَصُوْمُ فِي السَّفَرِ؟ وَكَانَ كَثِيرَ الصِّيَامِ، فَقَالَ: «إِنْ شِئْتَ ۱ فَصُمْ، وَإِنْ شِئْتَ فَأَفْطِرُ». مُتَّفَقٌ عَلَيْهِ.
Aisha (may Allah be pleased with her) narrated: Hamzah ibn Amr Al-Aslami asked the Prophet (ﷺ), “Should I fast while traveling?” He was a frequent faster. The Prophet (ﷺ) said, “If you wish, fast, and if you wish, do not fast.” 1 [Agreed upon]

Abu Sa’id Al-Khudri (may Allah be pleased with him) narrated: “We traveled with the Messenger of Allah (ﷺ) on the sixteenth of Ramadan. Some of us fasted, 2 and some did not. Those who fasted did not criticize those who did not, and those who did not fast did not criticize those who did.” [Narrated by Muslim]

Anas (may Allah be pleased with him) narrated: “We were traveling with the Prophet (ﷺ). Some of us were fasting, and some were not. We stopped at a place on a hot day. Those who were fasting fell down, while those who were not fasting set up the tents and watered the animals. Ibn Abbas (may Allah be pleased with him) narrated: “The Messenger of Allah (ﷺ) left Madinah for Makkah and fasted 4 until he reached Usfan. Then he asked for water, raised it to his hand so the people could see, and broke his fast until he arrived in Makkah. This was during Ramadan. Ibn Abbas would say, ‘The Prophet (ﷺ) fasted and broke his fast, so whoever wishes may fast, and whoever wishes may break their fast.’” [Agreed upon]
In a narration by Muslim from Jabir (may Allah be pleased with him), he drank after Asr. Abu Dawud mentioned in his Sunan that Abu Sa’id said: 5 “I saw myself fasting with the Prophet (ﷺ) before and after that.”
In a narration by our Imam Abu Hanifah from Anas ibn Malik (may Allah be pleased with him), he said: “The Messenger of Allah (ﷺ) left Madinah for Makkah on the second night of Ramadan. He fasted until he reached Qudaid, where the people complained to him about the difficulty, so he broke his fast and continued to do so until he arrived in Makkah.” Ibn Abi Shaybah and Muslim narrated from Jabir (may Allah be pleased with him), and Al-Tahawi narrated from Ibn Abbas (may Allah be pleased with him) and Abu Sa’id something similar.

4 The statement: “He fasted...” In ‘Umdat al-Qari, it is said: “This clearly indicates that fasting while traveling is permissible, and it refutes those who do not permit it. It also shows the permissibility of breaking the fast while traveling.” In Fath al-Qadir: “Know that breaking the fast is permissible for a traveler if they did not intend to fast. If they intended to fast at night and woke up without breaking their resolve before dawn, they are fasting, and it is not permissible to break the fast on that day. However, if they break it, there is no expiation because the reason permitting it (travel) is present, creating doubt, which removes the expiation. This is mentioned in Al-Mirqat and Sharh al-Niqayah.”
5 The statement: “Abu Sa’id said...” This means he fasted with the Prophet (ﷺ) while traveling after that. This hadith indicates that fasting while traveling after the Prophet’s (ﷺ) breaking of the fast mentioned in these narrations is permissible. Al-Tahawi said this.
٤ قوله: فصام الخ: وقال في عمدة القاري: فيه بيان صريح أنه لا صام في السفر، وفيه رد على من لم يجوز الصوم في السفر، وفيه بيان إباحة الإفطار في السفر انتهى. وفي فتح القدير: واعلم أن إباحة الفطر للمسافر إذا لم ينو الصوم، فإذا نواه ليلا وأصبح من غير أن ينقض عزيمته قبل الفجر أصبح صائما، فلا يحل فطره في ذلك اليوم، لكن لو أفطر فيه لا كفارة عليه؛ لأن السبب المبيح من حيث الصورة - وهو السفر - قائم، فأورث شبهة. وبها تندفع الكفارة، ويشكل عليه حديث كراع العميم بناء على أن الصحيح أن فطره عنده ليس في اليوم الذي خرج فيه من المدينة؛ لأنه مسافة بعيدة لا يصل إليها في يوم واحد، بل معنى قول الراوي: حتى إذا كان بكراع الغميم، وهو صائم»: أنه كان صائما حين وصل إليه. ولا شك أنه صوم يوم لم يكن في أوله مقيما غير أنه شرع في صوم الفرض، وهو مسافر، ثم أفطر. وتبين بهذا اندفاع الإشكال عن تعين الصوم في اليوم الذي أنشأ فيه السفر.

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: إِنَّمَا أَرَادَ اللهُ عَزَّوَجَلَّ بِالْفِطْرِ فِي السَّفَرِ التَّيْسِيرَ۱ عَلَيْكُمْ، فَمَنْ يَسُرَ عَلَيْهِ الصَّيَامُ فَلْيَصُمْ، وَمَنْ يَسُرَ عَلَيْهِ الْفِطْرُ فَلْيُفْطِرُ». رَوَاهُ الطَّحَاوِيُّ.

2 The statement: “Allah has reduced...” If someone asks, “Since fasting is reduced for the traveler, if they fast, it is not obligatory, so it does not count,” the response is: “It is possible that the fasting reduced for them is the fasting they cannot avoid during those days, just as the resident cannot avoid it. This hadith indicates this meaning. Do you not see that it mentions the pregnant and nursing woman? If they fast Ramadan, it counts for them, and they are not like those who fast before the obligation of fasting. Rather, fasting becomes obligatory for them at the beginning of the month, but they are allowed to delay it due to necessity. The traveler is like them. This is the best way to understand this narration to avoid contradicting other narrations mentioned in this chapter.” This is summarized from Sharh Ma’ani al-Athar. 1 The statement: “We were traveling...” This and what follows confirm that fasting while traveling during Ramadan is better than breaking the fast. This is supported by the fact that the Prophet (ﷺ) and many of his companions fasted during Ramadan while traveling for the conquest of Makkah, as narrated by Al-Bukhari. If breaking the fast were absolutely better, this would not have happened. This is mentioned in ‘Umdat al-Qari and ‘Umdat al-Wiqayah. It is understood from these hadiths that if a traveler is not harmed by fasting, fasting is better, but if they break the fast, it is permissible. This is mentioned in Al-Hidayah. Al-Isbijabi said in Sharh Mukhtasar al-Tahawi: “It is better to fast while traveling if fasting does not weaken the person. If fasting weakens them and causes hardship, breaking the fast is better. If they break the fast without hardship, they are not sinful.” This is mentioned in ‘Umdat al-Qari. Abu Al-Darda (may Allah be pleased with him) narrated: “We traveled with the Prophet (ﷺ) on one of his journeys on a hot day. The heat was so intense that a man would place his hand on his head. None of us were fasting except the Prophet (ﷺ) and Ibn Rawahah.” [Narrated by Al-Bukhari]

Sa’id ibn Jubayr said: “Fasting is better, and breaking the fast is a concession, meaning while traveling.” [Narrated by Al-Tahawi]
وَعَنْ يَحْيَى بْن أَبِي كَثِيرٍ قَالَ: حَدَّثَنِي الْقَاسِمُ بْنُ مُحَمَّدٍ عَنْ عَائِشَةَ (رضي الله عنها)ا
أَنَّهَا كَانَتْ تَصُوْمُ فِي السَّفَرِ فِي الْحَرِّ فَقُلْتُ: مَا حَمَلَهَا عَلَى ذَلِكَ؟ فَقَالَ: إِنَّهَا كَانَتْ تُبَارِدُ۱ . رَوَاهُ الطحاوي.
Yahya ibn Abi Kathir reported: “Al-Qasim ibn Muhammad narrated to me from Aisha (may Allah be pleased with her) that she would fast while traveling in the heat. I asked, ‘What motivated her to do that?’ He said, ‘She would hasten to fast.’” 1 [Narrated by Al-Tahawi]

بَابُ الْقَضَاءِ
وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: ﴿وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى) (الأنعام: ١٦٤) ، وقوله: ﴿فَمَن كَانَ مِنكُم مَّرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ۱ مِّنْ أَيَّامٍ أُخَرَ (البقرة: ١٨٤)

And the words of Allah Almighty: “No bearer of burdens will bear the burden of another.” (Qur’an 6:164)And His words: “But whoever is ill or on a journey, then an equal number of other days.” 1 (Qur’an 2:184)
1 The statement: “An equal number of other days.” etc. The generality of Allah’s words, “An equal number of other days,” indicates that delaying the makeup fasts is not restricted until the next Ramadan. Aisha (may Allah be pleased with her) delayed her makeup fasts because the Prophet (ﷺ) would enjoy her company, and during Sha’ban, he would be preoccupied with fasting, so she would be busy making up her fasts. Outside of Ramadan, she would devote herself to serving him. This is mentioned in Al-Jawhar al-Naqi. In Al-Hidayah, it is said: “One may make up the missed fasts of Ramadan consecutively or separately, as the text is general. However, it is recommended to do so consecutively to hasten the fulfillment of the obligation. If one delays until the next Ramadan begins, they should fast the current Ramadan and make up the previous one afterward, as it is the time for making up the fasts. There is no expiation for this.” Regarding the hadith about expiation, Ibrahim ibn Nafi’ is mentioned. Abu Hatim Al-Razi said he was a liar, and some accused him of fabricating the hadith. وَقَالَ: لَمْ يَذْكُرُ اللَّهُ الْإِطْعَامَ إِنَّمَا قَالَ: ﴿فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ وَوَصَلَهُ سَعِيدُ بْنُ (البقرة: ١٨٤) مَنْصُورٍ مِنْ طَرِيقِ يُونُسَ عَنِ الْحَسَنِ، وَمِنْ طَرِيقِ الْحَارِثِ الْعُكلي.
Ibrahim Al-Nakha’i said: “If someone neglects making up their fasts until the next Ramadan comes, they should fast both and are not required to provide food.” [Narrated by Al-Bukhari in a suspended chain]
Al-Bukhari said: “Allah did not mention providing food; He only said, ‘An equal number of other days.’” Sa’id ibn Mansur connected it through Yunus from Al-Hasan and through Al-Harith Al-Ukli.

2 The statement: “Without his permission.” This means a woman may not observe a voluntary fast without her husband’s permission, except in cases of harm to him. Voluntary fasts are unrestricted, so they include what is originally voluntary but becomes obligatory due to circumstances. Therefore, it is said in Al-Bahr from Al-Qunya: “A husband may prevent his wife from anything that is obligatory on her part, such as voluntary acts, vows, and oaths, but not what is obligatory from Allah, such as making up Ramadan fasts.” This is mentioned in Al-Durr al-Mukhtar and Rad al-Muhtar, summarized from both.
۲ قوله : إلا بإذنه: أي لا تصوم المرأة نقلًا إلا بإذن الزوج إلا عند عمد الضرر به، وأطلق النفل، فشمل ما أصله نفل لكن وجب بعارض، ولذا قال في البحر» عن «القنية»: للزوج أن يمنع زوجته عن كل ما كان الإيجاب من جهتها، كالتطوع والنذر واليمين دون ما كان من جهته تعالى كقضاء رمضان. الدر المختار» ورد المحتار ملتقط منهما.
وَعَنْ مُعَاذَةَ الْعَدَوِيَّةِ أَنَّهَا قَالَتْ لِعَائِشَةَ: مَا بَالَ الْحَائِضِ تَقْضِي الصَّوْمَ وَلَا تَقْضِي الصَّلَاةَ؟ قَالَتْ عَائِشَةَ: كَانَ يُصِيبُنَا ذَلِكَ فَنُؤْمَرُ بِقَضَاءِ الصَّوْمِ وَلَا نُؤْمَرُ بِقَضَاءِ الصَّلَاةِ رَوَاهُ مُسْلِمٌ.
Mu’adhah Al-Adawiyyah reported that she asked Aisha (may Allah be pleased with her): “Why does a menstruating woman make up missed fasts but not missed prayers?” Aisha said: “We used to experience that, and we were commanded to make up the fasts but not the prayers.” [Narrated by Muslim]
وَعَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ (رضي الله عنهما) عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ مَاتَ وَعَلَيْهِ صِيَامُ شَهْرِ رَمَضَانَ فَلْيُطْعِمُ عَنْهُ مَكَانَ كُلِّ يَوْمٍ مِسْكِيْن». رَوَاهُ التَّرْمِذِيُّ، وَقَالَ: وَالصَّحِيحُ أَنَّهُ مَوْقُوْفٌ عَلَى ابْنِ عُمَرَ، قَالَ فِي الْجَوْهَرُ النَّقِيُّ. رَوَاهُ ابْنُ مَاجَهِ مَرْفُوعًا بِسَنَدٍ صَحِيحٍ.
Nafi’ reported from Ibn Umar (may Allah be pleased with him) that the Prophet (ﷺ) said: “Whoever dies owing fasts from Ramadan should have a meal provided for a needy person for each day.” [Narrated by Al-Tirmidhi, who said: “The correct view is that it is attributed to Ibn Umar.”]
[In Al-Jawhar al-Naqi, it is mentioned that Ibn Majah narrated it as a marfu’ hadith with a Sahih chain]

وَرَوَى عَبْدُ الرَّزَّاقِ فِي مُصَنَّفِهِ فِي كِتَابِ الوَصَايَا عَنِ ابْنِ عُمَرَ الله قَالَ: لَا يُصَلِّيَنَّ أَحَدٌ عَنْ أَحَدٍ وَلَا يَصُوْمُ أَحَدٌ عَنْ أَحَدٍ.
Malik reported that it reached him that Ibn Umar (may Allah be pleased with him) was asked: “Can someone fast or pray on behalf of another?” He replied: “No one can fast or pray on behalf of another.” [Narrated in Al-Muwatta’]
Malik said: “I have not heard 1 from any of the Companions or the Successors in Madinah that anyone ordered someone to fast or pray on behalf of another.”
Abd al-Razzaq narrated in his Musannaf in the book of wills from Ibn Umar (may Allah be pleased with him) that he said: “No one should pray or fast on behalf of another.”

In Al-Jawhar al-Naqi, it is said: “This chain is sound according to the conditions of Al-Bukhari and Muslim, except for Ibn Abd al-A’la, who meets Muslim’s conditions.” In Al-Binayah, it is mentioned similarly, but with two mudds of wheat. Abu Bakr Al-Razi narrated in his commentary on Mukhtasar al-Tahawi from Ibn Umar (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “Whoever dies owing fasts from Ramadan should have half a sa’ of food provided for a needy person for each day.”
