بَابٌ فِي الْأُضْحِيَةِThe Sacrifice (Al-Udhiyah)

العربية

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: فَصَلِّ۱ لِرَبِّكَ وَانْحَرْ (الكوثر : ٢ ، وَقَوْلِهِ: ذَلِكَ وَمَن يُعَظِّمْ۲ شَعَابِرَ اللهِ فَإِنَّهَا مِن تَقْوَى الْقُلُوْبِ ) (الحج: ۳۲)

۱ قوله فصل إلخ : أي صل صلاة العيد. وانحر النسك. قاله في «المرقاة».

۲ قوله : ومن يعظم إلخ : قال في التفسير الأحمدي»: فهذه الآية أصل في أنه ينبغي أن يكون الهدايا متصفة بالأوصاف المذكورة. ولعله لهذا المعنى لم يجوز الفقهاء في الأضحية العمياء والعوراء والعجفاء والعرجاء التي لا يمشي إلى المنسك والمقطوع يدها ورجلها وما ذهب أكثر من ثلث أذنها أو ذنبها أو عينها أو إليتها. وذلك لأن الأضحية كالهدايا واجب التعظيم، وهذه المذكورات متصفا بالعيب والنقصان فضلا عن أن يكون معظمة؛ إذ التعظيم على ما " ذكر أمر زائد عليه، فتقيم الآية دليلا على استخراجها عن الجواز، بخلاف الجماء والخصي والثولاء؛ لأنها لا تبلغ في حد النقصان إلى ما ذكر، فيجوز التضحية بها.

English

And the saying of Allah, the Almighty: "So pray 1 to your Lord and sacrifice." (Qur’an 108:2)

And His saying: "That [is so]. And whoever honors 2 the symbols of Allah – indeed, it is from the piety of hearts." (Qur’an 22:32)

1 The statement: "So pray..." means to pray the Eid prayer and offer the sacrifice. This is mentioned in Al-Mirqat.

2 The statement: "And whoever honors..." In Tafsir al-Ahmadi, it is said: "This verse establishes that sacrificial animals should possess the qualities mentioned. Perhaps for this reason, jurists do not permit sacrificing animals that are blind, one-eyed, emaciated, lame, unable to walk to the place of sacrifice, or those with a limb cut off, or those with more than a third of their ear, tail, eye, or udder missing. This is because the sacrifice, like offerings, must be honored, and these defects diminish its value. The verse serves as evidence for excluding such animals from being permissible for sacrifice. However, animals that are hornless, castrated, or have a small defect are permissible, as their defects do not reach the level of those mentioned."

وَعَنْ أَنَسٍ (رضي الله عنه) قَالَ: ضَحَى رَسُولُ اللهِ ﷺ كَبْشَيْنِ أَمْلَحَيْنِ أَقْرَنَيْنِ، ذَبَحَهُمَا بِيَدِهِ وَسَمَّى وَكَبَّرَ، قَالَ: رَأَيْتُهُ وَاضِعًا قَدَمَهُ عَلَى صَفَاحِهِمَا، وَيَقُولُ: «بِسْمِ اللهِ وَاللهُ أَكْبَرُ». مُتَّفَقٌ عَلَيْهِ.

English

Anas (may Allah be pleased with him) narrated: "The Messenger of Allah (ﷺ) sacrificed two white, horned rams. He slaughtered them with his own hand, recited Allah’s name, and said the takbir. I saw him placing his foot on their sides and saying, 'In the name of Allah, and Allah is the Greatest.'" [Agreed upon]

English

Abu Sa’id (may Allah be pleased with him) narrated: "The Messenger of Allah (ﷺ) used to sacrifice a horned ram that was mature, with black eyes, black legs, and a black belly." [Narrated by Tirmidhi, Abu Dawud, Nasa’i, and Ibn Majah]

وَعَنْ جَابِرِ بْنِ عَبْدِ اللهِ (رضي الله عنه) أَنَّ النَّبِيَّ ﷺ ضَحَى بِكَبْشَيْنِ أَشْعَرَيْنِ أَمْلَحَيْنِ، أَحَدُهُمَا عَنْ نَفْسِهِ وَالْآخَرُ۳ عَمَّنْ شَهِدَ أَنْ لَا إِلَهَ إِلَّا اللهُ مِنَ امَّتِهِ. رَوَاهُ إِمَامُنَا أَبُو حَنِيفَةَ، وَرَوَاهُ مُحَمَّدُ فِي الْآثَارِ».

وَرَوَى الْحَاكِمُ وَابْنُ مَاجَه وَأَحْمَدُ نَحْوَهُ، وَصَحَّحَهُ الْحَاكِمُ عَلَى شَرْطِ مُسْلِمٍ.

وَفِي رِوَايَةٍ لِابْنِ مَاجَه عَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما): أَنَّ النَّبِيَّ ﷺ أَتَاهُ رَجُلٌ، فَقَالَ: إِنَّ عَلَيَّ بُدْنَةٌ وَأَنَا مُوْسِرٌ بِهَا وَلَا أَجِدُهَا فَأَشْتَرِيْهَا، فَأَمَرَهُ النَّبِيُّ ﷺ أَنْ يَبْتَاعَ سَبْعَ شِيَاءٍ فَيَذْبَحُهُنَّ.

وَفِي رِوَايَةِ عَبْدِ الرَّزَّاقِ وَفِي كُلِّ أَضْحَى شَاةٌ، وَقَالَ الطَّحَاوِيُّ: أَمَّا الاشْتِرَاكُ فِي الشَّاةِ الْوَاحِدَةِ فِي الْأُضْحِيَةِ الْوَاجِبَةِ فَهُوَ مَنْسُوخٌ، وَأَوَّلَهُ مُحَمَّدُ اللهِ إِلَى أَنَّهُ مَحْمُوْلُ عَلَى مَا إِذَا كَانَ الرَّجُلُ فَقِيرًا لَا يَجِبُ عَلَيْهِ الْأُضْحِيَةُ يُشْرِكُهُمْ فِي الثَّوَابِ، فَذَلِكَ جَائِزُ. أَمَّا الاشْتِرَاكُ فِي الشَّاةِ الْوَاحِدَةِ فِي الْأُضْحِيَةِ الْوَاجِبَةِ فَلَا.

English

Jabir ibn Abdullah (may Allah be pleased with him) narrated: "The Prophet (ﷺ) sacrificed two horned, white, and speckled rams. One was for himself, and the other was for those among his Ummah who testified that there is no god but Allah." 3 [Narrated by our Imam Abu Hanifah and Muhammad in Al-Athar]

Al-Hakim, Ibn Majah, and Ahmad narrated something similar, and Al-Hakim declared it authentic according to the conditions of Muslim.

In a narration by Ibn Majah from Ibn Abbas (may Allah be pleased with him): "A man came to the Prophet (ﷺ) and said, 'I am obligated to sacrifice a camel, and I can afford it, but I cannot find one to buy.' The Prophet (ﷺ) commanded him to buy seven sheep and sacrifice them."

In a narration by Abd al-Razzaq: "There is one sheep for every Udhiyah." Al-Tahawi said:

"As for sharing a single sheep for an obligatory Udhiyah, it is abrogated. Muhammad (may Allah be pleased with him) explained that it applies when a poor person, who is not obligated to sacrifice, shares the reward with others. However, sharing a single sheep for an obligatory Udhiyah is not permissible."

In Al-Ta’liq al-Mumajjad, it is said: "Muhammad (may Allah be pleased with him) explained that it applies when a person is in need of meat or is poor and not obligated to sacrifice. He may sacrifice a single sheep for himself and feed his family or share the reward with them. However, sharing a single sheep for an obligatory Udhiyah is not permissible."

Al-Tahawi said: "It is either abrogated or specific. The evidence is that while a ram suffices for multiple people without restriction, a cow or camel is more appropriate for multiple people. However, the Prophet (ﷺ) limited a camel to seven people and a cow to seven people. This indicates that a sheep cannot suffice for more than seven people. Therefore, a sheep cannot suffice for more than one person, as agreed upon by Abu Hanifah, Abu Yusuf, and Muhammad (may Allah have mercy on them)."

3 The statement: "The other was for those among his Ummah who testified that there is no god but Allah." Some hadiths indicate that a single sheep suffices for a man and his household. Muhammad (may Allah be pleased with him) explained in Al-Muwatta: "A needy person would sacrifice a single sheep for himself, eat from it, and feed his family. However, a single sheep cannot be sacrificed for two or three people as an Udhiyah. This is the view of Abu Hanifah and the majority of our scholars."

فأما الاشتراك في الشاة الواحدة في الأضحية الواجبة فلا . وقال الطحاوي : إنه منسوخ أو مخصوص، فما دل على ذلك أن الكبش لما كان يجزئ عن غير واحد، لا وقت في ذلك ولا عدد، كانت البقرة والبدنة أحرى أن تكون تجزئتان عن غير واحد، لا وقت في ذلك ولا عدد ثم قد روينا عن النبي ﷺ ما قد دل على خلاف ذلك مما قد ذكرناه في الباب الذي قبل هذا من نحر أصحابه معه الجزور عن سبعة، والبقرة عن سبعة، وكان ذلك عند أصحابه على التوقف منه لهم على أن البقرة والبدنة لا تجزئ واحدة منهما عن أكثر مما ذبحت يومئذ، وتواترت عنهم الروايات بذلك. فلما جعلت البقرة عن سبعة، وكان ذلك مما قد وقف عليه، ولم يجعل لنا أن نعدو ذلك إلى ما هو أكثر منه، كانت الشاة أحرى أن لا تجزئ عن أكثر مما تجزئ عنه البقرة من ذلك.

فلما ثبت أن الشاة لا تجزئ عن أكثر من سبعة انتفى بذلك قول من قال: إنها تجزئ عن جميع من ذبحت عنه ممن لا وقت لهم ولا عدد، ولا يجاوز إلى غيره، وثبت ضده، وهو قول من قال: إن الشاة لا تجزئ إلا عن واحد، وقد ذكرنا عن رسول الله له في الباب الذي قبل هذا أن رجل قال له: إن على ناقةً وقد غربت عني، فأمره أن يجعل مكانه سبعا من الغنم. فَدَلَّ ذلك على ما ذكرنا أيضا. فلما كانت البدنة أعظم ما يهدى ثبت أنها أعظم ما يضحى به، ولما كانت باتفاقهم لا تجزئ في الأضحية عما فوق السبعة كانت الشاة أحرى أن لا تجزئ عن ذلك. ولما انتفى أن تجزئ الشاة عما فوق السبعة ثبت أنها لا تجزئ إلا عن خاص من الناس. وقد أجمعوا على أنها مجزئة عن الواحد، واختلفوا فيما هو أكثر منه، فلا يدخل فيما قد ثبت له حكم الخصوصية، إلا ما قد أجمعوا على دخوله فيه. فثبت بما ذكرنا أنه لا يجوز أن يُضحى بالشاة الواحدة عن اثنين، ولا عن أكثر من ذلك، وهو قول أبي حنيفة وأبي يوسف ومحمد رحمة الله عليهم أجمعين.

وَعَنْ إِبْرَاهِيمَ أَنَّهُ كَانَ يَكْرَهُ أَنْ يَذْكُرَ اسْمَ إِنْسَانٍ مَعَ اسْمِ اللهِ عَلَى ذَبِيحَتِهِ أَنْ يَقُولَ: بِسْمِ اللهِ تَقَبَّلْ مِنْ فُلَانٍ رَوَاهُ مُحَمَّدُ فِي الْآثارِ»، وَيُؤَيِّدُهُ مَا قَالَ فِي الْهِدَايَةِ» عَنِ ابْنِ مَسْعُوْدٍ الله جَرِّدُوا التَّسْمِيَةَ.

English

Ibrahim reported that he disliked mentioning the name of a person alongside Allah’s name when slaughtering an animal, such as saying, "In the name of Allah, accept from so-and-so." [Narrated by Muhammad in Al-Athar]

This is supported by what is mentioned in Al-Hidayah from Ibn Mas’ud (may Allah be pleased with him): "Purify the name (of Allah) when slaughtering."

وَعَنْ أَبِي رَافِعِ (رضي الله عنه) أَنَّ رَسُوْلَ اللهِ ﷺ كَانَ إِذَا أَضْحَى اشْتَرَى كَبْشَيْنِ عَظِيمَيْنِ أَمْلَحَيْنِ حَتَّى إِذَا خَطَبَ النَّاسَ وَصَلَّى أُتِيَ بِأَحَدِهِمَا، وَهُوَ قَائِمٌ فِي مُصَلَّاهُ، فَذَبَحَهُ بِيَدِهِ، ثُمَّ قَالَ: «اللهُمَّ هَذَا عَنْ أُمَّتِي جَمِيعًا مَنْ شَهِدَ لَكَ بِالتَّوْحِيدِ وَشَهِدَ لِي بِالْبَلَاغِ»، ثُمَّ يُؤْتَى بِالْآخَرِ فَيَذْبَحُهُ، ثُمَّ يَقُوْلُ: «اللهُمَّ هَذَا عَنْ مُحَمَّدٍ وَآلِ مُحَمَّدٍ». رَوَاهُ الطَّحَاوِيُّ.

وَقَالَ فِي الدُّرِّ الْمُخْتَارِ»: فَإِنْ فَصَلَ صُورَةً وَمَعْنَى كَالدُّعَاءِ قَبْلَ الْإِضْجَاعِ، وَالدُّعَاءِ قَبْلَ التَّسْمِيَةِ أَوْ بَعْدَ الذَّبْحِ لَا بَأْسَ بِهِ، وَقَالَ فِي رَدَّ الْمُحْتَارِ»: أَي لَا يُكْرَهُ.

English

Abu Rafi’ (may Allah be pleased with him) narrated: "The Messenger of Allah (ﷺ) would, when sacrificing, buy two large, white rams. When he delivered the sermon and prayed, one of them was brought to him while he was standing at the prayer ground. He would slaughter it with his own hand and say, 'O Allah, this is on behalf of my entire Ummah, those who testify to Your Oneness and to my message.' Then the other ram would be brought, and he would slaughter it, saying, 'O Allah, this is on behalf of Muhammad and the family of Muhammad.'" [Narrated by Al-Tahawi]

In Al-Durr al-Mukhtar, it is said: "If one separates the form and meaning, such as making a supplication before placing the animal down, or making a supplication before or after the slaughter, there is no harm in it."

In Rad al-Muhtar, it is said: "There is no dislike for it."

English

Jabir ibn Abdullah (may Allah be pleased with him) narrated: "The Messenger of Allah (ﷺ) sacrificed two rams on the day of Eid. When he faced them, he said, 'Indeed, I have turned my face toward He who created the heavens and the earth...' (Qur’an 6:79). Then he said, 'O Allah, this is from You and for You, on behalf of Muhammad and his Ummah.' Then he recited Allah’s name, said the takbir, and slaughtered them." [Narrated by Al-Tahawi]

Ahmad, Abu Dawud, Ibn Majah, and Al-Darimi narrated something similar.

English

Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: "Do not slaughter except a mature animal, unless it is difficult for you, in which case you may slaughter a young sheep." [Narrated by Muslim]

Mujashi’ from Banu Sulaym (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: "A young sheep suffices for what a mature sheep suffices." [Narrated by Abu Dawud, Nasa’i, and Ibn Majah]

وَعَنْ عُقْبَةَ بْنِ عَامِرٍ (رضي الله عنه) أَنَّ النَّبِيَّ ﷺ أَعْطَاهُ غَنَمًا يَقْسِمُهَا عَلَى صَحَابَتِهِ ضَحَايَا، فَبَقِيَ عَتُودُ۱، فَذَكَرَهُ لِرَسُولِ اللهِ ، فَقَالَ: «ضَحٌ بِهِ أَنْتَ». وَفِي رِوَايَةٍ: قُلْتُ يَا رَسُوْلَ اللهِ ، أَصَابَنِي جَزَعُ، قَالَ: «ضَحٌ بِهِ». مُتَّفَقٌ عَلَيْهِ.

English

Uqbah ibn Amir (may Allah be pleased with him) narrated: "The Prophet (ﷺ) gave him sheep to distribute among his companions as sacrifices. A young goat remained, 1 and he mentioned it to the Messenger of Allah (ﷺ), who said, 'Sacrifice it yourself.'" In another narration, he said, "O Messenger of Allah, I have a young goat." The Prophet (ﷺ) said, "Sacrifice it." [Agreed upon]

1 The statement: "A young goat." In Al-Nihayah, it is explained as a young goat that has reached one year of age. This indicates the permissibility of sacrificing a young goat that is one year old, which is the view of our school. This is mentioned in Al-Mirqat.

۱ قوله: عتود: في النهاية»: بفتح العين المهملة هو الصغير من أولاد المعز إذا قوي وأتى عليه حول. وفيه دليل على جواز التضحية بالمغز إذا كان له سنة، وهو مذهبنا. قاله في «المرقاة».

2 The statement: "At the prayer ground." It is mentioned in Al-Mirqat that this hadith, narrated by Ibn Umar, was previously mentioned in the chapter on Eid prayer. It is repeated here to clarify the place of slaughter, as slaughtering at the prayer ground is preferred to display the symbol of sacrifice. Umm Salamah (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) said: "When the ten days (of Dhul-Hijjah) begin and one of you intends to sacrifice, 3 let them not remove anything from their hair or skin."

In another narration: "Let them not remove 4 their hair or trim their nails." In another narration: "Whoever sees the crescent of Dhul-Hijjah and intends to sacrifice, let them not cut their hair or nails." [Narrated by Muslim]

3 The statement: "Intends to sacrifice..." In Sharh al-Sunnah, it is said that this hadith indicates that the sacrifice is not obligatory, as it is left to one’s intention. If it were obligatory, it would not be left to one’s choice. However, this is refuted by other narrations, such as the Prophet’s (ﷺ) statement: "Whoever intends to perform Hajj, let them hasten," and "Whoever intends to attend Friday prayer, let them perform ghusl." This is mentioned in Al-Mirqat.

4 The statement: "Let them not remove." In Al-Mirqat, it is said that according to Hanafi scholars, this is recommended (mustahabb) according to Abu Hanifah, meaning the prohibition is for avoidance of the better option, not strict prohibition. This differs from the Shafi’i view. Al-Tahawi argued that this is supported by the narration from Aisha (may Allah be pleased with her) in the book of Hajj, where she said, "I used to braid the garlands for the sacrificial animals of the Prophet (ﷺ), and he would send them, then remain among us as a non-Muhrim, not avoiding anything that a Muhrim avoids, until the people returned." This indicates the permissibility of what this hadith prohibits.

Jundub ibn Abdullah (may Allah be pleased with him) narrated: "I attended the Eid al-Adha sacrifice with the Messenger of Allah (ﷺ). After he finished the prayer and said the tasleem, he saw that some sacrificial meat had been slaughtered before he finished the prayer. He said, 'Whoever slaughtered before praying or before we prayed, let them slaughter another in its place.'" 1

In another narration: "The Prophet (ﷺ) prayed on the day of Eid, delivered the sermon, and then slaughtered. He said, 'Whoever slaughtered before praying, let them slaughter another in its place, and whoever has not slaughtered, let them slaughter in the name of Allah.'" [Agreed upon]

Mikhnaf ibn Sulaym reported: "We were standing with the Messenger of Allah (ﷺ) at Arafat when I heard him say, 'O people, every household must offer a sacrifice 2 (Udhiyah) and an Atirah every year. Do you know what the Atirah is? It is what you call the Rajabiyah.'" [Narrated by Tirmidhi, Abu Dawud, Nasa’i, and Ibn Majah]

Abu Dawud said: "The Atirah is abrogated." The author of Mishkat said in this context: "Tirmidhi said, 'This is a strange (gharib) hadith with a weak chain.'" However, Mirqat said: "Tirmidhi’s wording is, 'This is a strange hadith, and we do not know it to be marfu’ (elevated to the Prophet) except through this chain from Ibn Awn.' Tirmidhi did not explicitly declare the chain weak, as found in many current copies, and this is how the author of Al-Takhrij narrated it."

Abdullah ibn Amr (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: "I have been commanded to observe the day of Eid al-Adha as a festival, which Allah has made for this Ummah." A man asked, "O Messenger of Allah, what if I cannot find anything except a female sheep that I have been lent? 3 Should I sacrifice it?" He replied, "No. 4 But you should cut your hair, 5 trim your nails, shorten your mustache, and shave your pubic hair. That will complete your sacrifice in the sight of Allah." 4 The statement: "He replied, 'No.'" The apparent meaning of the hadith is that the Udhiyah is obligatory except for those who are unable. Abu Hanifah said: "It is only obligatory for those who own the nisab." This is mentioned in Al-Mirqat.

Ibn Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said:

"There are no days in which righteous deeds are more beloved to Allah than these ten days." The companions asked, "Not even jihad in the way of Allah?" He replied, "Not even jihad, except for a man who goes out with his life and wealth and returns with nothing." [Narrated by Bukhari]

Aisha (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) said:

"No deed of the son of Adam on the day of sacrifice is more beloved to Allah than the shedding of blood. It will come on the Day of Resurrection with its horns, hair, and hooves, and the blood will reach Allah before it falls to the ground. So purify your hearts with it." وَعَنْ زَيْدِ بْنِ أَرْقَمَ (رضي الله عنه) قَالَ: قَالَ أَصْحَابُ رَسُوْلِ اللهِ ﷺ يَا رَسُولَ اللهِ، مَا هَذِهِ الْأَضَاحِي؟ قَالَ: «سُنَّةُ أَبِيْكُمْ إِبْرَاهِيمَ ، قَالُوا : فَمَا لَنَا فِيهَا؟ يَا رَسُولَ اللهِ، قَالَ: بِكُلِّ شَعْرَةٍ حَسَنَةٌ، قَالُوا: فَالصُّوْفُ يَا رَسُوْلَ اللهِ؟ قَالَ: بِكُلِّ شَعْرَةٍ مِنَ الصُّوْفِ حَسَنَةٌ». رَوَاهُ أَحْمَدُ وَابْنُ مَاجَه.

English

Zayd ibn Arqam (may Allah be pleased with him) narrated: "The companions of the Messenger of Allah (ﷺ) asked, 'O Messenger of Allah, what are these sacrifices?' He replied, 'The tradition of your father Ibrahim.' They asked, 'What is in it for us, O Messenger of Allah?' He said, 'For every hair, there is a reward.' They asked, 'What about the wool, O Messenger of Allah?' He said, 'For every hair of the wool, there is a reward.'" [Narrated by Ahmad and Ibn Majah]

وَعَنْ حَنَشِ قَالَ: رَأَيْتُ عَلِيًّا (رضي الله عنه) يُضَجِّيْ بِكَبْشَيْنِ، فَقُلْتُ لَهُ: مَا هَذِهِ؟ فَقَالَ: إِنَّ رَسُوْلَ اللهِ ﷺ أَوْصَانِي أَنْ أُضَحِّيَ عَنْهُ، فَأَنَا أُضَحَّيْ عَنْهُ. رَوَاهُ أَبُو دَاوُدَ، وَرَوَى التَّرْمِذِيُّ نَحْوَهُ.

English

Hanash reported: "I saw Ali (may Allah be pleased with him) sacrificing two rams. I asked him, 'What is this?' He replied, 'The Messenger of Allah (ﷺ) instructed me to sacrifice on his behalf, so I am sacrificing for him.'" [Narrated by Abu Dawud]

Tirmidhi narrated something similar.

فَأَشَارَ بِيَدِهِ، فَقَالَ: «أَرْبَعُ: الْعَرْجَاءُ الْبَيِّنُ ظَلَعُهَا، وَالْعَوْرَاءُ الْبَيِّنُ عَوْرُهَا، وَالْمَرِيضَةُ الْبَيِّنُ مَرَضُهَا، وَالْعَجْفَاءُ الَّتِي لَا تَنْقِي». رَوَاهُ مَالِكٌ وَأَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَه وَالدَّارِمِيُّ وَالطَّحَاوِيُّ.

English

Al-Bara’ ibn Azib (may Allah be pleased with him) narrated: "The Messenger of Allah (ﷺ) was asked what defects should be avoided in sacrificial animals. He gestured with his hand and said, 'Four: the lame whose limp is evident, the one-eyed whose blindness is evident, the sick whose illness is evident, and the emaciated that has no marrow in its bones.'" [Narrated by Malik, Ahmad, Tirmidhi, Abu Dawud, Nasa’i, Ibn Majah, Al-Darimi, and Al-Tahawi]

وَعَنْ أَبِي الضَّحَاكِ عُبَيْدِ بْنِ فِيْرَوْزَ مَوْلَى بَنِي شَيْبَانٍ قَالَ: قُلْتُ لِلْبَرَاءِ: حَدِّثْنِي عَمَّا نَهَى عَنْهُ رَسُولُ اللهِ ﷺ مِنَ الْأَضَاحِي، قَالَ: قَامَ رَسُولُ اللهِ ﷺ وَيَدِي أَقْصَرُ مِنْ يَدِهِ، فَقَالَ: «أَرْبَعُ لَا يَجْزِيْنَ الْعَوْرَاءُ الْبَيِّنُ عَوْرُهَا، وَالْمَرِيضَةُ الْبَيِّنُ مَرَضُهَا، وَالْعَرْجَاءُ الْبَيِّنُ ظَلَعُهَا، وَالْكَسِيْرَةُ الَّتِي لَا تَنْقِي». قُلْتُ إِنِّي أَكْرَهُ أَنْ تَكُوْنَ فِي الْقَرْنِ۱ نَقْصُ وَأَنْ يَكُوْنَ فِي السِّنَّ ۲ نَقْصٌ ، قَالَ : مَا كَرِهْتَهُ فَدَعْهُ وَلَا تُحَرِّمْهُ عَلَى أَحَدٍ. رَوَاهُ النَّسَائِيُّ.

وَفِي رِوَايَةِ ابْنِ مَاجَه: قَالَ: فَإِنِّي أَكْرَهُ أَنْ يَكُوْنَ نَقْصُ فِي الْأُذُنِ، قَالَ: فَمَا كَرِهْتَ مِنْهُ فَدَعْهُ وَلَا تُحَرِّمْهُ عَلَى أَحَدٍ. وَرَوَى الطَّحَاوِيُّ نَحْوَهُمَا.

English

Abu al-Dahhak Ubayd ibn Furayz, the freed slave of Banu Shayban, reported: "I asked Al-Bara’, 'Tell me what the Messenger of Allah (ﷺ) prohibited regarding sacrificial animals.' He said, 'The Messenger of Allah (ﷺ) stood, and my hand was shorter than his. He said, "Four are not acceptable: the one-eyed whose blindness is evident, the sick whose illness is evident, the lame whose limp is evident, and the emaciated that has no marrow in its bones."' I said, 'I dislike it if there is a defect in the horn 1 or a defect in the teeth.' 2 He said, 'What you dislike, leave it, but do not forbid it to anyone.'" [Narrated by Nasa’i]

In a narration by Ibn Majah: "I said, 'I dislike it if there is a defect in the ear.' He said, 'What you dislike, leave it, but do not forbid it to anyone.'" Al-Tahawi narrated something similar.

1 The statement: "A defect in the horn." In Rad al-Muhtar, it is said: "It is permissible to sacrifice a hornless animal, one that naturally has no horns. Similarly, an animal with a broken horn is permissible unless the break reaches the brain."

2 The statement: "A defect in the teeth." In Talkhis al-Habir, it is said: "Al-Qadi al-Husayn narrated from Al-Shafi’i that he said, 'We do not find any prohibition from the Prophet (ﷺ) regarding defects in the teeth.'"

۱ قوله: في القرن : قال في رد المحتار: ويضحي بالجماء، هي التي لا قرن لها خلقة، وكذا العظماء التي ذهب بعض قرنها بالكسر وغيره بلغ الكسر إلى المخ لم يجز. (قهستاني)

۲ قوله: في السن: قال في التلخيص الحبير» ونقل القاضي الحسين عن الشافعي أنه قال: لا نحفظ عن النبي ﷺ في نقص الأسنان شيء، يعني في النهي.

وَعَنْ حَجِيَّةِ بْنِ عَدِيٌّ عَنْ عَلِيٍّ (رضي الله عنه) قَالَ: الْبَقَرَةُ عَنْ سَبْعَةٍ. قُلْتُ: فَإِنْ وَلَدَتْ؟ قَالَ: اذْبَحْ وَلَدَهَا مَعَهَا. قُلْتُ: وَالْعَرْجَاءُ؟ قَالَ: إِذَا بَلَغَتِ الْمَنْسَكَ فَاذْبَحْ. قُلْتُ: فَمَكْسُوْرَةُ الْقَرْنِ؟ قَالَ: لَا بَأْسَ ، أَمَرَنَا رَسُولُ اللهِ ﷺ أَنْ نَسْتَثْرِفَ الْعَيْنَيْنِ وَالْأُذُنَيْنِ. رَوَاهُ الدَّارِمِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَه وَالدَّارَ قُطْنِيُّ وَالْبَيْهَقِيُّ وَأَبُوْ دَاوُدَ الطَّيَالِسِيُّ وَالتَّرْمِذِيُّ وَالْحَاكِمُ فِي الْمُسْتَدْرَكِ»، وَقَالَ التَّرْمِذِيُّ: حَسَنٌ صَحِيحٌ.

English

Hajjiyah ibn Adiyy reported from Ali (may Allah be pleased with him): "A cow suffices for seven people." I asked, "What if it gives birth?" He said, "Slaughter its offspring with it." I asked, "What about a lame animal?" He said, "If it can reach the place of slaughter, slaughter it." I asked, "What about an animal with a broken horn?" He said, "There is no harm. The Messenger of Allah (ﷺ) commanded us to examine the eyes and ears." [Narrated by Al-Darimi, Nasa’i, Ibn Majah, Al-Daraqutni, Al-Bayhaqi, Abu Dawud al-Tayalisi, Tirmidhi, and Al-Hakim in Al-Mustadrak]

Tirmidhi said: "It is Hasan Sahih."

وَفِي رِوَايَةِ الطَّحَاوِيَّ عَنْ قَتَادَةَ فَقُلْتُ: لِسَعِيدِ۱ بْنِ الْمُسَيِّبِ: مَا عَضْبَاءُ الْأُذُنِ؟ قَالَ: إِذَا كَانَ النِّصْفُ فَأَكْثَرُ مِنْ ذَلِكَ مَقْطُوْعًا.

English

Qatadah reported: "I asked Sa’id ibn al-Musayyab, 'What is Al-A’dab (a defect in the ear)?' He said, 'Half or more of the ear is cut off.'" [Narrated by Abu Dawud]

Tirmidhi narrated something similar.

In a narration by Al-Tahawi from Qatadah: "I asked Sa’id ibn al-Musayyab, 1 'What is Al-‘Adba’ (a defect in the ear)?' He said, 'When half or more of the ear is cut off.'"

وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ (رضي الله عنه) قَالَ: ابْتَعْنَا كَبْشًا نُضَحَيْ بِهِ، فَأَصَابَ الذَّئْبُ مِنَ أَلْيَتَيْهِ وَأُذُنِهِ، فَسَأَلْنَا النَّبِيَّ ﷺ فَأَمَرَنَا۲ أَنْ تُضَحَى بِهِ. رَوَاهُ ابْنُ مَاجَه.

English

Abu Sa’id al-Khudri (may Allah be pleased with him) narrated:

"We bought a ram to sacrifice, but a wolf injured its hindquarters and ear. We asked the Prophet (ﷺ), and he commanded us 2 to sacrifice it." [Narrated by Ibn Majah]

English

Nafi’ reported that Ibn Umar (may Allah be pleased with him) said: "The Udhiyah is for two days after the day of Eid al-Adha." [Narrated by Malik]

Malik said: "It reached me that Ali ibn Abi Talib (may Allah be pleased with him) said the same."

English

Ibn Abbas (may Allah be pleased with him) said: "The Udhiyah is for three days: the day of Eid and the two days after it." [Narrated by Al-Tahawi with a good chain]

Our Imam Abu Hanifah narrated something similar from Ibrahim.
