بَابُ أَحْكَامِ الْمِيَاهِThe Rulings of Water

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَيُحَرِّمُ عَلَيْهِمُ الْخَبَيثَ (الأعراف: ١٥٧) ، وَقَوْلِهِ: ﴿وَأَنزَلْنَا مِنَ السَّمَاءِ مَاءً طَهُورًا ﴾(الفرقان: ٤٨) ، وَقَوْلِهِ: وَيُنَزِّلُ عَلَيْكُم مِّنَ السَّمَاءِ مَاءً ليُطَهِّرَكُم بِهِ (الأنفال: ١١) ، وَقَوْلِهِ: أَنزَلَ مِنَ السَّمَاءِ مَاءً فَسَالَتْ أَوْدِيَةٌ بِقَدَرِهَا (الرعد: ١٧

English

And the saying of Allah, the Exalted: And He prohibits upon them the impure and the saying of Allah: ﴿And We sent down from the sky pure water (Al-A'raf: 157)

And His saying: And He sends down upon you from the sky water (Al-Furqan: 48)

And His saying: He sent down from the sky water and the valleys flowed in proportion to their measure (Al-Anfal: 11) (Ar-Ra'd: 17).

عَنْ جَابِرٍ قَالَ: نَهَى رَسُوْلِ اللهِ ﷺ أَنْ يُبَالَ فِي الْمَاءِ الرَّاكِدِ. رَوَاهُ مُسْلِمُ.

Narrated Jabir: The Messenger of Allah ﷺ prohibited urinating in stagnant water. [Narrated by Muslim]

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَا يَبُوْلَنَّ أَحَدُكُمْ فِي الْمَاءِ الدَّائِمِ الَّذِي لَا يَجْرِي، ثُمَّ يَغْتَسِلُ فِيْهِ». مُتَّفَقٌ عَلَيْهِ.

وَفِي رِوَايَةٍ لِمُسْلِمٍ: «قَالَ: لَا يَغْتَسِلُ۱ أَحَدُكُمْ فِي الْمَاءِ الدَّائِمِ وَهُوَ جُنُبُ. قَالُوا: كَيْفَ يَفْعَلُ يَا أَبَا هُرَيْرَةً؟ قَالَ: يَتَنَاوَلُهُ تَنَاوُلًا».

English

Narrated Abu Huraira: The Messenger of Allah ﷺ said: "None of you should urinate in standing water that does not flow, and then wash in it." [Agreed upon]

In a narration of Muslim, he said: "None of you should wash in standing water while in a state of janabah." They asked: "How should he do that, O Abu Huraira?" He replied: "He should take it out by scooping."

1 The statement "None of you should wash...", The Qadi said: The restriction of the prohibition to a specific state indicates that the water used for the ritual washing (ghusl) after janabah (impurity) if it is stagnant, no longer retains its purity. Otherwise, there would be no benefit in the restricted prohibition. This is either because the purity is lost, as said by Abu Hanifa, or because the water ceases to be purifying, as said by Shafi'i. This is also the opinion of Muhammad, and it is the view followed in legal rulings, as mentioned in "Al-Mirqaat."

وَعَنْ جَابِرٍ (رضي الله عنه) قَالَ: مَرِضْتُ، فَأَتَانِي النَّبِيُّ ﷺ يَعُوْدُنِي وَأَبُو بَكْرٍ، فَوَجَدَانِي قَدْ أُغْمِيَ عَلَيَّ، فَتَوَضَّأَ النَّبِيُّ للهِ ، ثُمَّ صَبَّ وَضُوْءَهُ عَلَيَّ، فَأَفَقْتُ. مُتَّفَقٌ عَلَيْهِ.

English

Jabir (may Allah be pleased with him) narrated: "I was ill, and the Prophet ﷺ came to visit me along with Abu Bakr. They found me unconscious, so the Prophet ﷺ performed ablution and then poured his water of ablution over me, and I regained consciousness." [Agreed upon]

وَعَنْ أَبِي جُحَيْفَةَ (رضي الله عنه) خَرَجَ عَلَيْنَا رَسُولُ اللهِ ، فَأُتِيَ بِوَضُوْءٍ فَتَوَضَّأ، فَجَعَلَ النَّاسُ يَأْخُذُوْنَ مِنْ فَضْلِ وَضُوْئِهِ، فَيَتَمَسَّحُوْنَ بِهِ. رَوَاهُ الْبُخَارِيُّ.

English

Abu Juhaifah (may Allah be pleased with him) narrated: "The Messenger of Allah ﷺ came out to us and was brought some water for ablution. He performed ablution, and the people began to take from the leftover water of his ablution and wipe themselves with it." [Narrated by Bukhari]

وَعَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ (رضي الله عنه) قَالَ: إِذَا تَوَضَّأَ النَّبِيُّ ﷺ كَادُوا يَقْتَتِلُوْنَ عَلَى وَضُوْئِهِ. رَوَاهُ الْبُخَارِيُّ.

وَفِي السَّعَايَةِ»: فَهَذِهِ الْأَخْبَارُ وَأَمْثَالُهَا تَدُلُّ عَلَى طَهَارَةِ الْمَاءِ الْمُسْتَعْمَلِ، وَإِلَّا لَمْ يَكُنْ لِلتَّبَرُّكِ وَالتَّمَسُّحِ وَنَحْوِ ذَلِكَ مَعْنَى. اهـ وَالْفَتْوَى عَلَى أَنَّ الْمَاءَ الْمُسْتَعْمَلَ طَاهِرُ فِي مَذْهَبٍ أَبِي حَنِيفَةَ الله.

English

Al-Miswar bin Makhrama (may Allah be pleased with him) narrated: "When the Prophet ﷺ performed ablution, the people nearly fought over his leftover water." [Narrated by Bukhari]

In the explanation: "These reports and similar ones indicate the purity of used water, and without this, there would be no meaning to seeking blessings and wiping with it. The legal ruling is that the water used for ablution remains pure according to the Hanafi school."

وَعَنِ ابْنِ سِيْرِيْنَ: أَنَّ زَنْجِيًّا وَقَعَ فِي زَمْزَمَ، يَعْنِي مَاتَ، فَأَمَرَ بِهِ ابْنُ عَبَّاسٍ فَأُخْرِجَ، وَأَمَرَ بِهَا أَنْ تُنْزَحَ. قَالَ: فَغَلَبَتْهُمْ عَيْنٌ جَاءَتْ مِنَ الرُّكْنِ، قَالَ: فَأَمَرَ بِهَا فَدُسَّتْ بِالْقَبَاطِيَّ وَالْمَطَارِفِ حَتَّى نَزَحُوْهَا، فَلَمَّا نَزَحُوْهَا انْفَجَرَتْ عَلَيْهِمْ. رَوَاهُ الدَّارَ قُطْنِي مُرْسَلًا . وَقَالَ الْعَلَامَةُ التَّيْمِوِيُّ : إِسْنَادُهُ صَحِيحٌ، وَرَوَى البَيْهَقِيُّ وَابْنُ أَبِي شَيْبَةَ وَعَبْدُ الرَّزَّاقِ نَحْوَهُ، وَسَنَدُ ابْنِ أَبِي شَيْبَةَ صَحِيحٌ.

English

Ibn Sirin (may Allah be pleased with him) narrated: "A black man fell into the Zamzam well, meaning he died. Ibn Abbas (may Allah be pleased with him) ordered his body to be removed, and he ordered that the water be drawn out. They were then overwhelmed by a spring that came from the corner. Ibn Abbas (may Allah be pleased with him) ordered it to be drawn out with sheets and blankets until they drew it out, and when they did, it erupted." [Narrated by al-Daraqutni (with a broken chain)]

Imam al-Taymiyyah said: "Its chain is authentic," and al-Bayhaqi, Ibn Abi Shaiba, and Abdul Razzaq reported something similar, and Ibn Abi Shaiba's chain is also authentic.

وَعَنْ عَطَاءٍ : أَنَّ حَبَشِيًّا وَقَعَ فِي زَمْزَمَ فَمَاتَ، فَأَمَرَ ابْنُ الزُّبَيْرِ، فَنُزِحَ مَاؤُهَا، فَجَعَلَ الْمَاءُ لَا يَنْقَطِعُ، فَنَظَرَ فَإِذَا عَيْنٌ تَجْرِي مِنْ قِبَلِ الْحَجَرِ الْأَسْوَدِ، فَقَالَ ابْنُ الزُّبَيْرِ: حَسْبُكُمْ. رَوَاهُ الطَّحَاوِيُّ. وَرَوَى ابْنُ أَبِي شَيْبَةَ نَحْوَهُ، وَقَالَ الْإِمَامُ ابْنُ الْهُمَّامِ: سَنَدُهُ صَحِيح.

English

Ata (may Allah be pleased with him) narrated: "A black man fell into Zamzam and died. Ibn Zubair (may Allah be pleased with him) ordered the water to be drawn out. The water kept flowing, and when they looked, they saw a spring flowing from the Black Stone area. Ibn Zubair (may Allah be pleased with him) said: 'That's enough for you.'" [Narrated by Al-Tahawi]

Ibn Abi Shaiba reported something similar, and Imam Ibn al-Humam said: "Its chain is authentic."

وَعَنْ أَنَسٍ : أَنَّهُ قَالَ فِي الْفَارَةِ إِذَا مَاتَتْ فِي الْبِثْرِ وَأُخْرِجَتْ مِنْ سَاعَتِهَا: نُزِحَ مِنْهَا عِشْرُوْنَ دَلْمًا أَوْ ثَلَاثُوْنَ. رَوَاهُ الطَّحَاوِيُّ مِنْ طُرُقٍ فِي غَيْرِ شَرْحِ الْآثَارِ»، قَالَهُ الْإِمَامُ ابْنُ الْهُمَّامِ وَالزَّيْلَعِيُّ ، وَرَوَى أَبُو عَلِيَّ الْحَافِظُ السَّمَرْ قَنْدِيُّ مِثْلَهُ بِإِسْنَادِهِ مَرْفُوْعًا.

Anas (may Allah be pleased with him) narrated: "If a rat dies in a well and is removed immediately, twenty or thirty buckets of water should be drawn out from it." [Narrated by al-Tahawi through various chains, as mentioned by Imam Ibn al-Humam and al-Zayla'i]

Abu Ali al-Hafiz al-Samarkandi also narrated a similar report with a chain.

وَرَوَى الطَّحَاوِيُّ نَحْوَهُ. وَفِي رِوَايَةٍ لِعَبْدِ الرَّزَّاقِ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ : أَنَّ النَّبِيَّ ﷺ تَوَضَّأَ أَوْ شَرِبَ مِنْ غَدِيْرٍ، كَانَ يُلْقَى فِيْهِ حُوْمُ الْكِلَابِ وَالْحِيَفُ، فَذُكِرَ لَهُ ذَلِكَ، فَقَالَ: إِنَّ الْمَاءَ لَا يُنَجِّسُهُ شَيْءٌ».

اخْتَلَفَ الْعُلَمَاءُ فِي نَجَاسَةِ الْمَاءِ، فَقَالَتِ الظَّاهِرِيَّةُ وَالْإِمَامُ مَالِكُ : لَا يَتَنَجَّسُ الْمَاءُ لِمُلَاقَاةِ النَّجَاسَةِ، مَا لَمْ يَتَغَيَّرُ أَحَدُ أَوْصَافِهِ الثَّلَاثَةِ. وَذَهَبَ الْحَنَفِيَّةُ وَالشَّافِعِيَّةُ وَالْحَنَابِلَةُ وَإِسْحَاقُ إِلَى أَنَّهُ يَتَنَجَّسُ الْقَلِيْلُ بِمُلَاقَاةِ النَّجَاسَةِ، وَإِنْ لَمْ يَتَغَيَّرُ أَحَدُ أَوْصَافِهِ، لَكِنِ اخْتَلَفُوْا فِي تَعْيِيْنِ الْقَلِيلِ ، فَذَهَبَ الْإِمَامَانِ - الشَّافِعِيُّ وَأَحْمَدُ - إِلَى التَّحْدِيدِ بِالْقُلَّتَيْنِ،

وَقَالَ الْإِمَامُ أَبُو حَنِيفَةَ عَلَى مَا فِي الْهِدَايَةِ»: إِنَّ الْغَدِيرَ الْعَظِيمَ الَّذِي لَا يَتَحَرَّكُ أَحَدُ طَرَفَيْهِ بِتَحْرِيكِ الطَّرَفِ الْآخَرِ، إِذَا وَقَعَتْ نَجَاسَةُ فِي أَحَدِ جَانِبَيْهِ جَازَ الْوُضُوْءُ مِنَ الْجَانِبِ الْآخَرِ. وَبَعْضُهُمْ قَدَّرُوا الْمَسَاحَةَ عَشْرًا فِي عَشْرِ بِذِرَاعِ الْكِرْبَاسِ؛ تَوْسِعَةً لِلْأَمْرِ عَلَى النَّاسِ، وَعَلَيْهِ الْفَتْوَى.

Jabir (may Allah be pleased with him) narrated: "I reached a pond and found a dead donkey in it. We refrained from drawing water until the Messenger of Allah ﷺ came to us and said: 'Water is not made impure by anything.' So we drew water, watered ourselves, and carried the water." [Narrated by Ibn Majah]

It is also noted that the Shafi'i school estimated it based on the Hadith of the two qullas (two large vessels), but many scholars, including al-Hafiz Ibn Abd al-Barr, al-Qadi Ismail bin Is’haq, and Abu Bakr Ibn al-Arabi, who were Maliki scholars, rejected it, considering the narration weak. Al-Bayhaqi also commented that the Hadith is not strong, and even al-Ghazali and al-Ruwayani, despite their strong adherence to the Shafi'i school, disregarded it. Ali bin al-Madini, the teacher of al-Bukhari, also stated that the Hadith of the two qullas has not been proven. Furthermore, Ibn Abbas and Ibn Zubayr ordered the water of Zamzam to be drained when a black person died in it, and had this Hadith been valid, the other companions and followers would have used it to support their arguments. Therefore, it should be considered weak like the narration about "ablution from something touched by fire."

In "Ihya' al-Sunan", it is clarified that the Hadith of the two qullas should be understood in the context of when water is spread over the ground, as in ponds. The Hadith specifically addresses this scenario. Water spread over the ground, if its depth is such that it doesn't leave the ground exposed when drawn from, would be treated as plentiful (two qullas), and its edges would not move when the other side is disturbed. This is the definition of 'abundant water' in this school. For practical guidance, they taught it as being ten by ten for ease of understanding among the public. This has been tested and confirmed by our teacher, Sayyid Ahmad Rashid al-Janjohee. The reason behind this is that impurity dissipates and doesn't affect the whole surface of water used for ablution, but if the water is shallow or limited, impurity has a stronger effect on the parts of the water, requiring careful consideration.

The narration from al-Tahawi and others, including the one related by Abd al-Razzaq from Abu Sa'id al-Khudri, mentions that the Prophet ﷺ drank or performed ablution from a pond where dog and cat carcasses were thrown. Upon being informed about this, the Prophet ﷺ declared: "Water is not made impure by anything." This illustrates the idea that water, regardless of what may fall into it, does not become impure unless its qualities (taste, smell, or color) change due to contamination.

Scholars have differed on the issue of whether water becomes impure (najis) upon contact with impurity. The Zahiriyyah and Imam Malik's view is that water does not become impure by contact with impurity unless one of its three qualities (taste, smell, or color) changes. The Hanafi, Shafi'i, Hanbali, and Ishaq schools, however, hold that even a small quantity of water becomes impure upon contact with impurity, even if its qualities do not change. They disagreed on what constitutes a "small quantity," with Imam Shafi'i and Imam Ahmad specifically determining the quantity by the "two qullas" measure (a large container). Imam Abu Hanifah, in the Hidayah, defined a large pond where one side does not move when the other side is disturbed as a space from which ablution can still be performed if the impurity is on one side. Some scholars estimated this space to be around "ten by ten" with the span of a cubit for ease, and this is the position followed in fatwas.

Hadith about the protected area (harim) of a well:

Narration 553 mentions that the Prophet ﷺ said the protected area (harim) of a well extends forty arms' length from all sides. [Narrated by Ahmad.

Narration 554 reports that the Prophet ﷺ stated anyone who digs a well would have a protected area of forty arms' length surrounding it. [Narrated by Abu Yusuf, Ibn Majah, and al-Tabarani from Abdullah ibn Mughaffal.

Narration 555 reports that al-Sha'bi said the protected area around a well extends forty arms' length from each side, and no one is allowed to enter this area or its water. [Narrated by Abu Yusuf. The scholar Sadr al-Shari'ah stated that this area is a protected space, and it is forbidden to dig another well within this protected area, as the water from the first well might be affected, resulting in impurity. However, wells outside of this space, defined as "ten by ten," are not subject to the same restriction.

These narrations and scholarly opinions highlight the significance of maintaining the purity of water sources and ensuring that one well does not negatively affect another, particularly when dealing with the potential spread of impurity. The ten by ten measurement is a standard used to ensure that the area is adequately protected from contamination.

1 Regarding the phrase: "I reached a pond..." Ali al-Qari in the explanation of al-Nuqayah said: "Our scholars have unanimously agreed that a large pond is treated as a flowing water source. However, there is a difference regarding its classification. The earlier scholars said that the edge of the water should not move when the other edge is moved, meaning it should neither rise nor fall from its original position. According to Abu Hanifah, movement is considered for the purpose of ablution because it is more necessary in larger pools, and this is a narration from Abu Yusuf. From him, it is also said that moving the hand is sufficient, to make it easier for the people. Muhammad (may Allah be pleased with him) stated that moving for ablution is enough, which is considered the middle opinion. In "al-Ghaya", the apparent position of Abu Hanifah is that it should be judged by the predominant assumption. If the person performing ablution assumes that impurity has reached the other side, they should not perform ablution from it; otherwise, they may do so. This is considered the correct opinion. Abu Asimah reported that Muhammad (may Allah be pleased with him) used to estimate it to be ten by ten, but then he reverted to Abu Hanifah's opinion. The estimation was preferred by Ibn Mubarak and other scholars from Balkh, and this is the position of Abu Lays and the ruling followed by the jurists of 'Hidayah.'"

۱ قوله: انتهيت إلى غدير إلخ : قال علي القاري في شرح النقاية»: واعلم أن علماءنا اتفقوا على أن الغدير العظيم في حكم الجاري، واختلفوا بماذا يُعتبر ؟ فقال المتقدمون بعدم تحرك طرفه عند تحريك الطرف الآخر بأن لا ينخفض ولا يرتفع عن ساعته. ثم عن أبي حنيفة لتحريك الاغتسال؛ لأن الحاجة إلى الحياض فيه أشد، وهو رواية عن أبي يوسف، وعنه تحريك اليد؛ توسعة على الناس، وعن محمد تحريك التوضى؛ لأنه الوسط، وهو رواية عن أبي حنيفة وفي الغاية: ظاهر الرواية عن أبي حنيفة اعتباره بغلبة الظن بأن غلب على ظن المتوضئ وصول النجاسة إلى الجانب الآخر لا يتوضأ به، وإلا توضأ، قال : وهو الأصح. وقال أبو عصمة: كان محمد يقدره بعشر في عشر، ثم رجع إلى قول أبي حنيفة، وقال: لا أقدر فيه شيئا، لكن التقدير مختار ابن المبارك ومشايخ بلخ وجماعة من المتأخرين، قال أبو الليث وعليه الفتوى، وبه قال صاحب الهداية».

ثم اعلم أن الشافعي قدره بقلتين بحديث القلتين، قلنا: ضعفه جماعة منهم الحافظ ابن عبد البر والقاضي إسماعيل بن إسحاق وأبو بكر بن العربي المالكيون، وقال البيهقي: إنه ليس بالقوي، وقد تركه الغزالي والروياني مع شدة اتباعهما للشافعي، وعن أستاذ البخاري علي بن المديني أنه قال: لم يثبت حديث القلتين، ولأن ابن العباس وابن الزبير أمرا بنزح ماء زمزم حين مات فيها الزنجي، ولو كان هذا صحيحا لاحتج به بقية الصحابة والتابعين عليهما به فيرد كخبر: الوضوء مما مسته النار. ثم حديث القلتين ضعفه أبو داود أيضا، للاضطراب في سنده، كذا في متنه. اهـ

وقال في إحياء السنن: وما روي من أحاديث القلتين يحمل على ما إذا كان الماء مبسوطا على الأرض، كما يكون في الحياض. وقد وقعت الأحاديث في جواب السؤال عنها، والمبسوط من القلتين إذا كان عُمقه بحيث لا ينحسر الأرض بالاعتراف منه، كان في السعة، حيث لا يتحرك طرف منه بحركة طرف آخر. وهذا هو حد الكثير في المذهب. وقد رووه للضبط على العوام بعشر في عشر. هذا من إفادات سيد العلماء في عصره مولانا رشيد أحمد المحدث الجنجوهي، وجربناه نحن فوجدناه كذلك. والسر في قيد البسط أن النجاسة يضمحل، ولا يؤثر في كل وجه الماء الذي هو محل للاغتراف للوضوء، وإذا قل السعة قوي أثر النجاسة في أجزاء وجه الماء، فتدبر.

وَعَنِ الْحَسَنِ: أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «مَنِ احْتَفَرَ بِثْرًا كَانَ لَهُ مِمَّا حَوْلَهَا أَرْبَعُوْنَ ذِرَاعًا». رَوَاهُ أَبُو يُوْسُفَ، وَرَوَى ابْنُ مَاجَه وَالطَّبَرَانِيُّ عَنْ عَبْدِ اللهِ بْنِ مُغَفَّلٍ نَحْوَهُ مَرْفُوعًا.

English

Al-Hasan narrated that the Messenger of Allah (ﷺ) said: "Whoever digs a well, he has a protected area of forty cubits around it." [Narrated by Abu Yusuf, and a similar narration was narrated by Ibn Majah and Al-Tabarani from Abdullah bin Mughaffal as a Marfu’ Hadith]

وَعَنِ الشَّعْبِيِّ : أَنَّهُ قَالَ: حَرِيمُ الْبِثْرِ أَرْبَعُوْنَ ذِرَاعًا مِنْ هَهُنَا وَهَهُنَا وَهَهُنَا وَهَهُنَا، لَا يَدْخُلُ أَحَدٌ فِي حَرِيمِهِ وَلَا فِي مَائِهِ. رَوَاهُ أَبُو يُوْسُفَ وَقَالَ صَدْرُ الشَّرِيعَةِ: فَيَكُوْنُ لَهَا حَرِيمُهَا، مِنْ كُلِّ جَانِبِ عَشْرَةٌ. فَفُهِمَ مِنْ هَذَا أَنَّهُ إِذَا أَرَادَ آخَرُ أَنْ يَحْفِرَ فِي حَرِيمِهَا بِثْرًا يُمْنَعُ مِنْهُ؛ لِأَنَّهُ يَنْجَذِبُ الْمَاءُ إِلَيْهَا، وَيَنْقُصُ الْمَاءُ فِي الْبِثْرِ الْأَوْلَى، وَإِنْ أَرَادَ أَنْ يَحْفِرَ بِثْرَ بَالُوْعَةِ يُمْنَعُ أَيْضًا؛ لِسِرَايَةِ النَّجَاسَةِ إِلَى الْبِئْرِ الْأَوْلَى وَتَنْجِيْسِ مَائِهَا، وَلَا يُمْنَعُ فِي مَا وَرَاءَ الْحَرِيمِ، وَهُوَ عَشْرُ فِي عَشْرٍ، فَعُلِمَ أَنَّ الشَّرْعَ اعْتَبَرَ الْعَشْرَ فِي الْعَشْرِ فِي عَدَمِ سِرَايَةِ النَّجَاسَةِ، حَتَّى لَوْ كَانَتْ النَّجَاسَةُ تَسْرِي يُحْكَمُ بِالْمَنْعِ.

English

Al-Sha’bi said: "The protected area of a well is forty cubits in all directions, and no one may enter its protected area or use its water." [Narrated by Abu Yusuf]

Sadr al-Shari’ah said: "Thus, the well has its protected area, which is ten cubits on each side." From this, it is understood that if another person intends to dig a well within this protected area, he is prevented from doing so, because the water would be drawn toward the new well, reducing the water in the first well. If someone wishes to dig a drainage well within this area, he is also prevented, as impurity may seep into the first well and contaminate its water. However, digging beyond the protected area, which is ten by ten cubits, is not prohibited. It is thus understood that Islamic law considers ten by ten cubits as the minimum distance required to prevent the transmission of impurity. If impurity is likely to spread, it is ruled as prohibited.

وَعَنِ الْوَاقِدِيَّ قَالَ: إِنَّ بِثْرَ بُضَاعَةَ كَانَتْ طَرِيقًا لِلْمَاءِ إِلَى الْبَسَاتِيْنِ، فَكَانَ الْمَاءُ لَا يَسْتَقِرُّ فِيْهَا، فَكَانَ حُكْمُ مَائِهَا كَحُكْمِ مَاءِ الْأَنْهَارِ. رَوَاهُ الطَّحَاوِيُّ.

وَفِي السَّعَايَةِ»: أَنَّ جَمَاعَةٌ مِنَ النُّقَادِ قَدْ وَثَقُوْا الْوَاقِدِيَّ. وَقَالَ الْعَيْنِيُّ فِي الْبِنَايَةِ»: إِنَّ الْوَاقِدِيَّ وَهُوَ مِنْ أَهْلِ الْمَدِينَةِ، أَعْلَمُ بِحَالِهَا، وَمَنْ أَنْكَرَهُ فَلَعَلَّ مُرَادَهُ أَنَّهُ لَمْ يَكُنْ مَاءً جَارِيًا عَلَى وَجْهِ الْأَرْضِ، وَمَاءُ بُضَاعَةَ كَانَ جَارِيًا تَحْتَ الْأَرْضِ.

English

Al-Waqidi said: "The well of Buda‘ah was a water passage leading to the gardens, so water did not remain settled in it. Therefore, its ruling was like that of river water."

[Narrated by Al-Tahawi]

In Al-Sa‘ayah, it is mentioned that a group of critics have deemed Al-Waqidi reliable. Al-‘Ayni said in Al-Binayah: "Al-Waqidi, being from the people of Madinah, was more knowledgeable about its affairs. If someone denies his report, perhaps they mean that it was not a surface-flowing water source, while the water of Buda‘ah was flowing underground."

وَعَنْ رَاشِدِ بْنِ سَعْدٍ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «الْمَاءُ لَا يُنَجِّسُهُ شَيْءٌ إِلَّا مَا غَلَبَ عَلَى لَوْنِهِ أَوْ طَعْمِهِ أَوْ رِيحِهِ». رَوَاهُ الطَّحَاوِيُّ وَالدَّارَقُطْنِيُّ مُرْسَلًا، وَصَحَّحَ أَبُو حَاتِمٍ إِرْسَالَهُ، وَرَوَى ابْنُ مَاجَه وَالطَّبَرَانِي فِي الْأَوْسَطِ» وَالْكَبِيْرِ» نَحْوَهُ.

English

Rashid bin Sa‘d narrated that the Messenger of Allah (ﷺ) said: "Water is not rendered impure by anything unless its color, taste, or smell is altered." [Narrated by Al-Tahawi and Al-Daraqutni as a Mursal narration]

Abu Hatim deemed its Mursal status authentic. Ibn Majah and Al-Tabarani, in Al-Awsat and Al-Kabir, reported a similar narration.

وَعَنْ أَبِي هُرَيْرَةَ قَالَ سَأَلَ رَجُلٌ رَسُولَ اللهِ ، فَقَالَ: يَا رَسُولَ اللهِ، إِنَّا نَرْكَبُ الْبَحْرَ وَنَحْمِلُ مَعَنَا الْقَلِيْلَ مِنَ الْمَاءِ، فَإِنْ تَوَضَّأْنَا بِهِ عَطِشْنَا، أَفَنَتَوَضَّأُ بِمَاءِ الْبَحْرِ؟ فَقَالَ رَسُولُ اللهِ ﷺ: «هُوَ الطَّهُورُ مَاؤُهُ وَالْحِلُّ مَيْتَتُهُ. رَوَاهُ مَالِكُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَه وَالدَّارِمِيُّ وَمُحَمَّدٌ.

English

Abu Hurairah narrated that a man asked the Messenger of Allah (ﷺ), "O Messenger of Allah, we travel by sea and carry only a small amount of water. If we use it for ablution, we will be left thirsty. Can we perform ablution with sea water?" The Messenger of Allah (ﷺ) replied:

"Its water is pure, and its dead (animals) are lawful (to eat)." [Narrated by Malik, Al-Tirmidhi, Abu Dawud, Al-Nasa'i, Ibn Majah, Al-Darimi, and Muhammad]

وَعَنْ سَلْمَانَ : أَنَّ النَّبِيَّ ﷺ قَالَ: «يَا سَلْمَانُ، كُلُّ طَعَامٍ وَشَرَابٍ وَقَعَتْ فِيْهِ دَابَّةٌ لَيْسَ لَهَا دَمُ، فَمَاتَتْ فِيْهِ فَهُوَ حَلَالُ أَكْلُهُ وَشُرْبُهُ وَوُضُوْؤُهُ». رَوَاهُ الدَّارَقُطْنِيُّ.

English

Salman narrated that the Prophet (ﷺ) said: "O Salman, any food or drink in which a creature that has no blood falls and dies remains lawful to eat, drink, and use for ablution." [Narrated by Al-Daraqutni)

وَزَادَ أَحْمَدُ وَالتَّرْمِذِيُّ وَابْنُ أَبِي شَيْبَةَ وَالطَّحَاوِيُّ: فَتَوَضَّأَ مِنْهُ. وَقَالَ التَّرْمِذِيُّ: أَبُو زَيْدٍ مَجْهُولُ. وَالْجَوَابُ عَنْهُ أَنَّ أَبَا بَكْرِ بْنَ الْعَرَبِيِّ ذَكَرَ فِي شَرْحِ جَامِعِ التَّرْمِذِيَّ»: أَنَّ أَبَا زَيْدٍ

مَوْلَى عَمْرِو بنِ حُرَيْثٍ، رَوَى عَنْهُ رَاشِدُ بْنُ كَيْسَانَ الْعَبَسِيُّ الْكُوْفِيُّ وَأَبُوْ رَوْقٍ، وَبِهَذَا يَخْرُجُ عَنْ حَدَّ الْجَهَالَةِ، وَلَا يُعْرَفُ إِلَّا بِكُنْيَةٍ، فَيَجُوْزُ أَنْ يَكُوْنَ التَّرْمِذِيُّ أَرَادَ بِهِ أَنَّهُ مَجْهُولُ الاسْمِ، وَلَا يَضُرُّ ذَلِكَ؛ فَإِنَّ جَمَاعَةً مِنَ الرُّوَاةِ لَا تُعْرُفُ أَسْمَاؤُهَا، وَإِنَّمَا عُرِفُوْا بِالْكُنَى، كَذَا ذَكَرَهُ الْإِمَامُ ابْنُ الْهُمَامِ وَالْعَيْنِيُّ.

وَقَالَ صَاحِبُ الْمِشْكَاةِ»: صَحَّ عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ اللهِ قَالَ: لَمْ أَكُنْ لَيْلَةَ الْجِنَّ مَعَ رَسُوْلِ اللهِ ﷺ رَوَاهُ مُسْلِمُ وَالْجَوَابُ عَنْهُ مِنْ وُجُوهِ:

أَحَدُهَا : أَنَّهُ ذَكَرَ الْإِمَامُ ابْنُ الْهُمَامِ أَنَّ مَا رُوِيَ عَنِ ابْنِ مَسْعُودٍ (رضي الله عنه) أَنَّهُ سُئِلَ عَنْ لَيْلَةِ الْجِنِّ، فَقَالَ: لَمْ أَكُنْ لَيْلَةَ الْجِنِّ مَعَ رَسُوْلِ اللهِ ﷺ فَهُوَ مُعَارِضُ بِمَا فِي حَدِيْثِ ابْنِ أَبِي شَيْبَةَ مِنْ أَنَّهُ كَانَ مَعَهُ، وَرَوَى أَيْضًا أَبُو حَفْصِ بْنُ شَاهِيْنَ عَنْهُ أَنَّهُ قَالَ: كُنْتُ مَعَ النَّبِيِّ لَيْلَةَ الْجِنَّ وَعَنْهُ : أَنَّهُ رَأَى قَوْمًا مِنَ الرُّطٌ ، فَقَالَ: هَؤُلَاءِ أَشْبَهُ مَنْ رَأَيْتُ بِالْجِنِّ لَيْلَةَ الْجِنِّ وَالْإِثْبَاتُ مُقَدَّمُ عَلَى النَّفْيِ.

وَثَانِيهَا: مَا ذَكَرَهُ الْحَافِظُ ابْنُ حَجَرٍ وَغَيْرُهُ فِي التَّطْبِيقِ بَيْنَ رِوَايَاتِ الْإِثْبَاتِ وَبَيْنَ رِوَايَاتِ النَّفْيِ أَنَّ ابْنَ مَسْعُودٍ لَمْ يَكُنْ مَعَ النَّبِيِّ ﷺ فِي مَوْضِعِ مُلَاقَاتِهِ مَعَ الْجِنِّ وَقِرَاءَتِهِ الْقُرْآنَ عَلَيْهِمْ، وَإِنَّمَا جَلَسَ حَيْثُ خَطَّ لَهُ رَسُولُ اللهِ ﷺ إِلَى أَنْ أَتَاهُ، كَمَا فِي مُسْنَدِ أَحْمَدَ، فَحَيْثُ نَفَى ابْنُ مَسْعُودٍ أَوْ غَيْرُهُ مَعِيَّتَهُ أَرَادَ بِهَا الْمَعِيَّةَ الْخَاصَّةَ، فَلَا تَنَافِيَ بَيْنَهُ وَبَيْنَ رِوَايَةِ الْمَعِيَّةِ فِي تِلْكَ اللَّيْلَةِ.

وَثَالِثُهَا: أَنَّهُ ذَكَرَ الْعَيْنِيُّ أَنَّ أَرْبَعَةَ عَشَرَ رَجُلًا رَوَوْا شِرْكَةَ ابْنِ مَسْعُودٍ مَعَ النَّبِيَّ ﷺ لَيْلَةَ الْجِنَّ، وَذَلِكَ كَافٍ لِلِاسْتِدْلَالِ انْتَهَى.

English

Abu Zayd narrated from Abdullah bin Mas‘ud that the Prophet (ﷺ) asked him on the Night of the Jinn: "What is in your water container?" He replied, "I said: Nabidh (a drink made from dates soaked in water)." The Prophet (ﷺ) said: "A good date and pure water." [Narrated by Abu Dawud, Ibn Majah, Al-Bazzar, Al-Tabarani, Al-Daraqutni, and Ibn ‘Adi]

Ahmad, Al-Tirmidhi, Ibn Abi Shaybah, and Al-Tahawi added: "Then he performed ablution with it."

Al-Tirmidhi said: "Abu Zayd is unknown."

Abu Bakr bin Al-‘Arabi mentioned in his explanation of Jami‘ Al-Tirmidhi that Abu Zayd was the freed slave of ‘Amr bin Hurayth. Rashid bin Kaisan Al-‘Absi Al-Kufi and Abu Rawq narrated from him, removing him from the category of unknown narrators. He is only known by his kunya (nickname), which may be why Al-Tirmidhi referred to him as "unknown," but this does not affect authenticity, as many narrators were known only by their kunya, as mentioned by Imam Ibn Al-Humam and Al-‘Ayni.

The author of Mishkat stated: "It is authentically narrated from ‘Alqamah that Abdullah bin Mas‘ud said: 'I was not with the Messenger of Allah (ﷺ) on the Night of the Jinn.'" [Narrated by Muslim]

The response to this is from multiple angles:

Firstly, Imam Ibn Al-Humam mentioned that the narration from Ibn Mas‘ud stating he was not present on the Night of the Jinn contradicts the narration in Musannaf Ibn Abi Shaybah, which affirms that he was with the Prophet (ﷺ).

Similarly Abu Hafs bin Shahin also narrated from him that he said: "I was with the Prophet (ﷺ) on the Night of the Jinn."

And there is another narration from him states that he saw a group of people from Al-Rut and said: "These are the most similar people to the jinn I saw on the Night of the Jinn." Affirmation takes precedence over negation.

Secondly, as mentioned by Hafiz Ibn Hajar and others in reconciling the affirming and negating narrations, Ibn Mas‘ud was not with the Prophet (ﷺ) at the specific location where he met the jinn and recited the Qur'an to them. Rather, he remained seated at the spot where the Messenger of Allah (ﷺ) had drawn a line for him until the Prophet (ﷺ) returned to him, as stated in Musnad Ahmad. Therefore, when Ibn Mas‘ud or others denied his companionship, they meant his specific companionship at that location, which does not contradict the narrations affirming his presence on that night.

Thirdly, Al-‘Ayni mentioned that fourteen men narrated that Ibn Mas‘ud was with the Prophet (ﷺ) on the Night of the Jinn, which is sufficient as evidence.

وَعَنْ عَلِيَّ : أَنَّهُ كَانَ لَا يَرَى بَأْسًا بِالْوُضُوْءِ بِنَبِيْدِ الثَّمَرِ، وَبِهِ قَالَ الْحَسَنُ وَالْأَوْزَاعِيُّ، وَقَالَ عِكْرِمَةُ : النَّبِيْذُ وَضُوْءُ مَنْ لَمْ يَجِدِ الْمَاءَ، قَالَهُ فِي عُمْدَةِ الْقَارِي».

English

It is reported from ‘Ali that he saw no harm in performing ablution with nabidh (fermented drink) made from fruits. This opinion was also held by Al-Hasan and Al-Awza‘i. ‘Ikrimah said: "Nabidh is the ablution of one who does not find water." This was mentioned in ‘Umdat al-Qari’.

English

Abu Huraira reported that the Messenger of Allah (ﷺ) said: "The cat is a predatory animal (sabu‘)." [Narrated by Al-Hakim, who authenticated it, and a similar report was recorded by Al-Daraqutni and Ahmad.

وَعَنْ كَبْشَةَ بِنْتِ كَعْبِ بْنِ مَالِكٍ ، وَكَانَتْ تَحْتَ ابْنِ أَبِي قَتَادَةَ: أَنَّ أَبَا قَتَادَةَ دَخَلَ عَلَيْهَا، فَسَكَبْتُ لَهُ وَضُوْمًا، فَجَاءَتْ هِرَّةٌ تَشْرَبُ مِنْهُ، فَأَصْغَى لَهَا الْإِنَاءَ حَتَّى شَرِبَتْ قَالَتْ كَبْشَةُ: فَرَآنِي أَنْظُرُ إِلَيْهِ ، فَقَالَ: أَتَعْجَبِيْنَ يَا ابْنَةَ أَخِي؟ قَالَتْ: فَقُلْتُ: نَعَمْ. فَقَالَ: إِنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «إِنَّهَا لَيْسَتْ بِنَجَسٍ، إِنَّهَا مِنَ الطَّوَّافِينَ۱ عَلَيْكُمْ أَوِ الطَّوَّافَاتِ». رَوَاهُ مَالِكُ وَأَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَه وَالدَّارِمِيُّ وَمُحَمَّدُ، وَقَالَ التَّرْمِذِيُّ: حَسَنٌ صَحِيحٌ.

English

It is narrated from Kabshah bint Ka‘b ibn Malik, who was the wife of the son of Abu Qatadah, that Abu Qatadah entered her house. She poured some water for him to perform ablution. A cat came and started drinking from it, so he tilted the vessel for it to drink. Kabshah said: "He saw me looking at him in surprise, so he said: ‘Are you amazed, O daughter of my brother?’ I replied, ‘Yes.’ He then said: ‘The Messenger of Allah (ﷺ) said: It is not impure, for it is among those that frequently move around you.’"

This was narrated by Malik, Ahmad, Al-Tirmidhi, Abu Dawud, Al-Nasa’i, Ibn Majah, Al-Darimi, and Muhammad. Al-Tirmidhi graded it Hasan Sahih.

The statement "from those that frequently move around you" (min al-tawwafin), The Sheikh explained that the reasoning behind considering the cat as tawwaf (one that moves around frequently) indicates that its original ruling is impurity. However, it has been exempted due to necessity. Therefore, the leftover water from all predatory animals (sabu‘) is considered impure, except in cases where necessity is established, such as with the cat. This was mentioned in the commentary on Ihya’ al-Sunan.

وَعَنْ دَاوُدَ بْنِ صَالِحِ بْنِ دِينَارٍ عَنْ أُمِّهِ أَنَّ مَوْلَاتَهَا اللهُ أَرْسَلَتْهَا بِهَرِيْسَةٍ إِلَى عَائِشَةَ قَالَتْ: فَوَجَدْتُهَا تُصَلِّي، فَأَشَارَتْ إِلَى أَنْ ضَعِيْهَا، فَجَاءَتْ هِرَّةٌ فَأَكَلَتْ مِنْهَا، فَلَمَّا انْصَرَفَتْ عَائِشَةُ مِنْ صَلَاتِهَا أَكَلَتْ مِنْ حَيْثُ أَكَلَتِ الْهِرَّةُ، فَقَالَتْ: إِنَّ رَسُولَ اللهِ ﷺ قَالَ: «إِنَّهَا لَيْسَتْ بِنَجَسٍ، إِنَّهَا مِنَ الطَّوَّافِينَ عَلَيْكُمْ. وَإِنِّي رَأَيْتُ رَسُوْلَ اللهِ ﷺ يَتَوَضَّأُ بِفَضْلِهَا. رَوَاهُ أَبُو دَاوُدَ.

وَقَالَ التَّيْمِوِيُّ: إِسْنَادُهُ حَسَنٌ، وَرَوَى التَّرْمِذِيُّ: أَنَّ النَّبِيَّ ﷺ قَالَ: «إِذَا وَلَغَتْ فِيهِ الْهِرَّةُ غُسِلَ مَرَّةً». وَصَحَّحَهُ.

وَرَوَى الطَّحَاوِيُّ وَآخَرُوْنَ عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ ﷺ قَالَ: «طُهُورُ الْإِنَاءِ إِذَا وَلَغَ فِيْهِ الْهِرُّ أَنْ يُغْسَلَ مَرَّةً أَوْ مَرَّتَيْنِ». وَقَالَ الدَّارَقُطْنِيُّ: هَذَا صَحِيحٌ.

English

Narrated by Dawud bin Salih bin Dinar from his mother: Her mistress sent her with harisah (a type of food) to Aisha (may Allah be pleased with him). She found Aisha (may Allah be pleased with him) praying, so Aisha (may Allah be pleased with him) gestured for her to place it down. A cat came and ate from it. When Aisha (may Allah be pleased with him) finished her prayer, she ate from the same place where the cat had eaten and said:

"Indeed, the Messenger of Allah ﷺ said: ‘It is not impure; it is among those that frequently move around you.’ And I saw the Messenger of Allah ﷺ perform ablution with the leftover water of a cat." [Narrated by Abu Dawud and Al-Taymi said: "Its chain is Hasan]

Tirmidhi narrated that the Prophet ﷺ said: "If a cat licks from a vessel, it should be washed once." He authenticated it.

Tahawi and others narrated from Abu Huraira (may Allah be pleased with him) that the Prophet ﷺ said:

"The purification of a vessel if a cat licks from it is to wash it once or twice."

Al-Daraqutni said: "This is authentic."

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: إِذَا وَلَغَ الْهِرُّ فِي الْإِنَاءِ فَأَهْرِقْهُ وَاغْسِلْهُ مَرَّةً. رَوَاهُ الدَّارَ قُطْنِيُّ مَوْقُوْفًا، وَإِسْنَادُهُ صَحِيحٌ.

وَقَالَ الْخَلْبِيُّ: إِنَّ الْمُتَعَلَّق بِالسَّبَاعِ حُكْمَانِ: حُكْمُ السُّورِ وَحُكْمُ اللَّحْمِ. فَثَبَتَ فِي الْهِرَّةِ حُكْمُ اللَّحْمِ، وَهُوَ الْحُرْمَةُ؛ لِعَدَمِ الْمُعَارِضِ. وَحُكْمُ الضَّرُورَةِ وَحُكْمُ السُّورِ شَيْئَانِ: النَّجَاسَةُ كَسِبَاعِ الْبَهَائِمِ، وَالْكَرَاهَةُ كَسِبَاعِ الطَّيْرِ. فَإِذَا انْتَفَى إِرَادَةُ النَّجَاسَةِ لِعِلَّةِ الطَّوَافِ، قُلْنَا : تَعَيَّنَ إِرَادَةُ الْكَرَاهَةِ. وَبِهِ قَالَ أَبُو حَنِيفَةَ، وَعَنِ الشَّافِعِي أَنَّهُ طَاهِرُ.

English

Narrated by Abu Huraira (may Allah be pleased with him): "If a cat licks from a vessel, then spill it out and wash it once." [Narrated by Al-Daraqutni as a Mawquf (a narration attributed to a companion), with an authentic chain.

Al-Khalbi said:

"Regarding predatory animals, there are two rulings: the ruling of their leftover water (su’r) and the ruling of their meat. In the case of the cat, the ruling on its meat is that it is impermissible; there is no opposing view regarding this. As for the ruling on necessity and the ruling on leftover water, there are two aspects: impurity, as with land predators, and dislike, as with predatory birds. If impurity is negated due to the reasoning of frequent movement around humans, then we say that the ruling of dislike is affirmed."

This was also the opinion of Abu Hanifa, while Al-Shafi’i considered it pure.

وَعَنْ جَابِرِ بْنِ عَبْدِ اللهِ (رضي الله عنه) قَالَ: نَهَى النَّبِيُّ ﷺ۱ يَوْمَ خَيْبَرَ عَنْ حُوْمِ الْحُمُرِ، وَرِخَّصَ فِي حُوْمِ الْخَيْلِ. رَوَاهُ الْبُخَارِيُّ، وَفِي رِوَايَةٍ لَهُ عَنِ ابْنِ عُمَرَ : نَهَى النَّبِيُّ ﷺ عَنْ حُوْمِ الْحُمُرِ الْأَهْلِيَّةِ يَوْمَ خَيْبَرَ.

English

Narrated by Jabir bin Abdullah: The Prophet ﷺ prohibited the mating of donkeys on the day of Khaybar, but allowed the mating of horses. [Narrated by Bukhari]

In another narration from Ibn Umar, it is stated that the Prophet ﷺ prohibited the mating of domesticated donkeys on the day of Khaybar.

1 The statement: "The Prophet ﷺ prohibited..." The evidence regarding the permissibility or prohibition of its meat conflicts. Additionally, there was disagreement among the companions about its purity and impurity. It was narrated from Ibn Abbas that it is pure, and from Ibn Umar that it is disliked. This raised doubt about its saliva. The most correct approach, as mentioned in "Al-Bahr" and "Al-Binayah" and others, is to be uncertain in the case of necessity. This is because the donkey is tied in homes and courtyards, and it drinks from vessels. Necessity has an effect in relieving impurity, as in the case of the saliva of a cat or a mouse. However, the necessity for the donkey is less than that for the cat or mouse, because they enter the narrow parts of the house, unlike the donkey. If necessity were not established at all, as in the case of dogs and wild animals, the ruling would have been impurity without any doubt. If the necessity were like that of the cat or mouse, the ruling would have been to relieve impurity without any doubt. Since necessity was established in some aspects and not others, and the reasons for impurity and purity were equal, they canceled each other out due to the conflict. Thus, the original ruling must be followed. Here, the two original rulings are: purity with respect to water and impurity with respect to saliva, so the matter remains uncertain. This is the essence of what is mentioned in "Al-Sayah".

۱ قوله : نهى النبي ﷺ إلخ : تعارضت الأدلة في إباحة لحمه وحرمته. وأيضًا اختلف الصحابة في نجاسته وطهارته، فروي عن ابن عباس طهارته، وروي عن ابن عمر كراهته، فأوجب الشك في سؤره. والأصح في التمسك على ما في «البحر» و«البناية» وغيرهما، هو التردد في الضرورة؛ فإن الحمار تربط في الدور والأفنية، ويشرب من الأواني. وللضرورة أثر في إسقاط النجاسة، كما في سؤر الهرة والفأرة، إلا أن الضرورة في الحمار دون الضرورة فيهما؛ لدخولهما مضايق البيت دونه، ولو لم تكن الضرورة ثابتة أصلا كما في الكلب والسبع، لَوَجَبَ الحكم بالنجاسة بلا إشكال. ولو كانت الضرورة فيه كضرورة الفأر والهرة، لَوَجَبَ الحكم بإسقاط النجاسة بلا إشكال. فلما ثبتت الضرورة من وجه دون وجه، واستوى موجب النجاسة والطهارة، تساقطا للتعارض، ووجب المصير إلى الأصل، والأصل ههنا شيئان: الطهارة في جانب الماء، والنجاسة في جانب اللعاب، فبقي الأمر مشكلا، هذا حاصل ما في «السعاية».

وَعَنْ عُمَرَ بْنِ الْخَطَّابِ (رضي الله عنه) قَالَ: لَا تَغْتَسِلُوا۱ بِالْمَاءِ الْمُشَمَّسِ؛ فَإِنَّهُ يُوْرِثُ الْبَرَصَ. رَوَاهُ الدَّارَقُطْنِيُّ.

English

It was narrated from Umar ibn al-Khattab (may Allah be pleased with him) that he said: "Do not perform ghusl (ritual washing) with sun-exposed water, for it causes leprosy." [Narrated by Al-Daraqutni]

1 The statement "Do not perform ghusl with sun-exposed water": In the book "Radd al-Muhtar," it is mentioned that we previously stated in the recommendations for ablution in "Al-Imdad" that one should not use sun-exposed water. This is affirmed in "Al-Hilya," citing the prohibition from Umar (may Allah be pleased with him), and in "Al-Fath," it is declared disliked. Similar views are found in "Al-Bahr." In "Miraj al-Darayah" and "Al-Qunya," it is stated that using sun-exposed water for purification is disliked, supported by the narration where Umar advised Aisha (may Allah be pleased with her) not to use sun-exposed water, saying it causes leprosy. Some have narrated differently, stating it is not disliked, and Malik and Ahmad held this view. According to the Shafi'i school, it is disliked only if the intention is to expose the water to the sun. In "Al-Ghayah," it is stated that it is disliked to use sun-exposed water in hot regions at certain times, but the intent is considered weak, and its absence does not have a significant effect. From this, it is clear that the accepted view in our madhhab is that it is disliked, supported by the authentic narration, and that the absence of dislike is considered a weak view. It is also apparent that the dislike is in the form of a recommendation for avoidance, not an absolute prohibition, as evident from its classification under desirable actions in the books of fiqh. Therefore, there is no difference between our madhhab and the Shafi'i view on this matter. This clarification should be noted.
