زجاجة المصابيح

من تأليف حضرة الفاضل الأجل أبي الحسنات السيد عبد الله شاه الحيدرآبادي الحنفي، متعنا الله بحياته.

بذل المؤلف العلام قصارى مجهوده في جمع تلك الأحاديث وترتيبها التي منها تستنبط مسائل الفقه الحنفي، وبها تؤيد، وحذا في ذلك حذو «مشكاة المصابيح»، وذلل صعابها وأنار غياهبها برويته الثاقبة وفكرته الغامضة، حتى وجد ضالته المنشودة على أحسن ما يرام، جعل الله أمنيته ضاحكة مستبشرة بأبهر نجاح.

فالحمد لله على أن تيسر لنا أن ننشر جزءا أول من أجزائها القيمة، وسنذكر نبذة فيما يأتي من ميزاتها السامية؛ تعريفا إياها إلى القراء الكرام؛ ليكونوا على بصيرة منها، على أن جوهرها الساطع لا يستطاع تقدير قيمته إلا بعد الوصول إليه والظفر به، وكشف القناع عنه، وهي هذه:

ليكن القراء على علم بأن المؤلف الفاضل لما تفرغ لدرس «المشكاة»، وعكف عليها، وأجال فكرته في كيفية جمعها ونوعية تبويبها وتنسيقها، وعرف أنها خير ذخيرة من الأحاديث النبوية التي تؤيد مسائل الفقه الشافعي وتعضدها، صمم بوخز شعوره على أن يقفو أثرها، ويَتْلُو تِلْوَها في جمع تلك الأحاديث التي تأسس عليها الفقه الحنفي، ولَكُمْ مَن سعى من قبل للقيام بهذه الخدمة الجلي وألقى ما فيه وتخلى لها لكن لم يستطع أن يأتي بما يساوي «المشكاة ويضاهيها قدرًا وقيمة، ولم يطق أحد بعد أن يسد هذا الخلل ويرأب هذا الثأي.

فمما يسرنا أن الله سبحانه قد أسعد بهذه الخدمة الجليلة الهامة هذا المؤلف الجليل الذي قد جمع بين العلوم منقولها ومعقولها، خفيها وجليها، وألهمه وأيده من وراء الغيب، كما يلوح من بيانه في ديباجة الكتاب عن سبب المنافسة في هذا التأليف الأنيق والتصميم عليه. ولقد كشف الغطاء عن من يقدح في قول الإمام الأعظم أبي حنيفة لله، وأثبت أنه ما من قول من أقواله إلا وله سند يعتمد عليه ويحتج به، وهو إما رواية أحد من الصحابة الأبرار، وإما قول أحد من التابعين الأخيار.

ومما يزداد به القارئ بصيرة أن المؤلف العلام قد ألزم نفسه عدة أمور في تأليفه هذا، وهي هذه:

الأول: قد جمع لكل موضوع كبير من موضوعات الكتب ما يتعلق به من الآيات القرآنية، وقد تلا في ذلك تلو الصحيح البخاري».

الثاني: قد سلك المؤلف في تبويب هذا الكتاب مسلك المشكاة»؛ لأن غايته لم تكن إلا أن يدخر ذخيرة جامعة على أسلوبها، تُوفي بمقصود أصحاب الفقه الحنفي وتشفي غلتهم.

الثالث: كما أن صاحب المشكاة راعى في التبويب وجهة الفقه الشافعي ولاحظه ثقة به وتائيدًا إياه، فكذلك أقام الفاضل المؤلف مقامه وجهة الفقه الحنفي تحقيقا إياه وتأكيدا عليه.

الرابع: لا توجد مسألة في المشكاة» إلا وقد انتشرت أحاديثها التي يستدل بها في ثلاثة فصول، وذلك ما يشق على القراء التفحص عنها والوقوف عليها؛ لأن القارئ في هذه الصورة لم يستطع أن يلم بما قصد إليه في نظرة خاطفة، ولكن الفاضل المؤلف أجاد فيما أفاد من أنه جمع لكل مسألة كل ما ينوط به من الأحاديث النبوية في موضع واحد، لا ترى فيها عوجا ولا فصلا.

الخامس: لا خفاء في أن الفقه الحنفي بحر لا يُرَى ساحله، فما من مسألة من مسائله إلا وفيها أقوال يفوتها الحصر، فلذلك تسهيلا على القراء الكرام وتقريبا إلى الأفهام أخذ المؤلف اللبيب : أولا قولًا أُفتي به، وثانيًا شفعها وأتبعها بحديث من الأحاديث النبوية الذي يوافقه ويوثقه، وثالثا مهد السبيل إلى ردّ ما يرد عليه من القدح فيه، وقد ذيل أكثر الأحاديث بالنقد على الرواة لينقشع غمام الريب عما هو الحق.

السادس: لقد زين المؤلف حواشي الكتاب بالأجوبة المؤيدة بالحجج الدامغة، وكشف القناع عن المقاصد الحنفية بعد التعبير الصحيح عن الأحاديث وكتب المسائل على أحوط طريق.

السابع: يشتمل هذا التأليف الجليل على أربعة أجزاء، وهذا جزء أول منها، ابتدأ المؤلف فيه بـ كتاب الإيمان وانتهى إلى باب الاعتكاف».

فصفوة ما أقول: إن هذا الكتاب قد ازدان بمزايا باهرة، تنكشف عليك محاسنها عند ما تطالعه، فليعلم القراء أن مشكاة المصابيح كما هي نعمة عظمى لحضرات الشوافع الكرام، فكذلك زجاجة المصابيح خير هدية أهديت إلى السادات الأحناف.

(May Allah prolong his life and benefit us through it)

The distinguished author exerted his utmost effort in compiling and arranging those hadiths upon which the principles of Hanafi jurisprudence are derived and supported. He followed the model of "Mishkat Al-Masabih", simplifying its complexities and illuminating its obscurities with his profound insight and deep intellect, until he achieved his intended goal in the most excellent manner. May Allah make his noble aspiration radiantly successful and blessed with the greatest achievements.

Praise be to Allah, who made it possible for us to publish the first part of this valuable work. In what follows, we will outline some of its distinguished features to introduce it to esteemed readers so that they may approach it with clarity and understanding. However, the true worth of its illuminating content can only be appreciated upon encountering it, gaining possession of it, and unveiling its treasures.

It is as follows:

Let the readers be informed that the honorable author, after devoting himself to the study of "Mishkat Al-Masabih", closely examining it, reflecting on its method of compilation, classification, and arrangement, and realizing that it is an excellent repository of prophetic hadiths that support and strengthen the principles of Shafi’i jurisprudence, resolved, driven by his earnest desire, to emulate its approach. He set out to compile those hadiths upon which the foundations of Hanafi jurisprudence are based.

Indeed, some before him had aspired to undertake this noble task, yet they could neither produce something equivalent to "Mishkat" nor match its stature and value. No one succeeded in bridging this gap or addressing this deficiency.

It is a source of great joy for us that Allah, the Exalted, has blessed this noble author with success in undertaking this significant and honorable task. He is a scholar who combines transmitted and rational sciences, both their subtle and evident aspects, and has been divinely inspired and supported in unseen ways. This is evident from the preface of the book, where he explains the reason for this elegant composition and his determination to pursue it.

The author has dispelled doubts cast upon the statements of the great Imam Abu Hanifa, proving that every one of his opinions is based on a reliable foundation and valid evidence. These are either narrations from one of the esteemed Companions of the Prophet (peace be upon him) or statements of one of the righteous Followers (Tabi’in).

Furthermore, the author has adhered to several principles in this work, which will enhance the reader’s understanding. These are as follows:

First: He has compiled, for each major subject in the book, the related Qur’anic verses, following the methodology of Sahih Al-Bukhari in this regard.

Second: The author has followed the structure of Mishkat Al-Masabih in organizing this book, as his ultimate goal was to create a comprehensive repository in its style. This work serves the purpose of the followers of Hanafi jurisprudence and fulfills their scholarly needs.

Third: Just as the author of Mishkat considered and supported the principles of Shafi’i jurisprudence while structuring the book, this noble author has taken a similar approach by emphasizing and affirming the principles of Hanafi jurisprudence.

Fourth: In Mishkat Al-Masabih, the hadiths relevant to any particular issue are often scattered across three chapters, which makes it difficult for readers to locate and comprehend them quickly. In contrast, this skillful author has brought together all the hadiths related to a single issue in one place, without any disorganization or separation, making it easier for readers to grasp the intended meaning at a glance.

Fifth: It is well known that Hanafi jurisprudence is like an ocean with no visible shore, and almost every issue has numerous opinions beyond enumeration. To simplify matters for esteemed readers and make them easier to understand, the insightful author has adopted the following approach:

He begins by presenting the opinion that has been most commonly issued as a fatwa.

He then supports it with a prophetic hadith that aligns with and strengthens it.

Finally, he addresses any objections to this opinion, refuting them effectively.

Moreover, the author has critically analyzed the narrators of most hadiths, ensuring that any doubts about authenticity are dispelled and the truth is made evident.

Sixth: The author has adorned the margins of the book with responses supported by compelling evidence. He has unveiled the objectives of Hanafi jurisprudence by accurately interpreting the hadiths and referencing legal texts in the most cautious and reliable manner.

Seventh: This monumental work consists of four volumes. This first volume begins with the Book of Faith (Kitab Al-Iman) and concludes with the Chapter on I'tikaf (Bab Al-I'tikaf).

In summary, this book is distinguished by its remarkable features, which will become evident as you read it. Let the readers understand that just as Mishkat Al-Masabih is a great blessing for the noble followers of Shafi’i jurisprudence, so too is Zujajat Al-Masabih a precious gift presented to the esteemed adherents of Hanafi jurisprudence.

بِسْمِ اللهِ الرَّحْمٰنِ الرَّحِيْمِ

الْحَمْدُ لِلّهِ الَّذِي هُوَ نُورُ السَّمَاوَاتِ وَالْأَرْضِ ، مَثَلُ نُوْرِهِ كَمِشْكَاةٍ فِيهَا مِصْبَاحٌ ، الْمِصْبَاحُ فِي زُجَاجَةٍ، وَهُوَ الْهَادِي إِلَى سُبُلِ السَّلَامِ وَفِجَاجِهِ ، ومُلْهِمُنَا طَرِيقَ الْحَقِّ وَمِنْهَاجَهُ، وَالْمُعْطِي بِاتَّبَاعِ السُّنَنِ الْبَهَّاجَةِ ، وَبِيَدِهِ الْكَرِيْمَةِ إِنْجَاحُ الْحَاجَةِ.

وَالصَّلَاةُ وَالسَّلَامُ عَلَى رَسُوْلِهِ الَّذِي جَعَلَهُ اللهُ لِلْعَالَمِينَ سِرَاجًا ، وَأَنْزَلَ عَلَيْهِ الْكِتَابَ وَلَمْ يَجْعَلْ لَهُ اعْوِجَاجًا ، وَهُوَ الَّذِي دَخَلَ النَّاسُ فِي دِينِهِ أَفْوَاجًا ، وَسَمَّى الخَلَائِقَ عَامَ وِلَادَتِهِ ابْتِهَاجًا ، وَعَلَى آلِهِ وَأَصْحَابِهِ الَّذِينَ هُمْ مَصَابِيحُ الْهُدَى وَنُجُوْمُ الاقْتِدَاءِ مَا كَانَ الزَّيْتُ يُضِيءُ سِرَاجًا.

أَمَّا بَعْدُ ، فَيَقُوْلُ أَفْقَرُ عِبَادِ اللهِ إِلَى رَحْمَةِ اللهِ أَبُو الْحَسَنَاتِ السَّيِّدُ عَبْدُ اللهِ بْنُ مَوْلَانَا السَّيِّدِ مُظفّر حُسَيْن الْحَيْدَرْآبَادِي الْحَنَفِيُّ - عَامَلَهُمَا اللهُ بِلُطْفِهِ الْخَفِيِّ، وَتَجَاوَزَ عَنْهُمَا بِكَرَمِهِ الْوَفِيِّ : إِنَّ التَّمَسُّكَ بِهَدْيِ النَّبِيِّ ﷺ لَا يَسْتَتِبُّ إِلَّا بِالاقْتِفَاءِ لِمَا صَدَرَ مِنْ مِشْكَاةِ صَدْرِهِ ، وَالاعْتِصَامُ بِحَبْلِ اللهِ لَا يَتِمُّ إِلَّا بِبَيَانِ كَشْفِ أَسْرَارِهِ.

وَكَانَ كِتَابُ «مِشْكَاةُ الْمَصَابِيحِ» - الَّذِي أَلَّفَهُ مَوْلَانَا الْحَبْرُ الْعَلَّامَةُ وَالْبَحْرُ الْفَهَّامَةُ ، مُظْهِرُ الْحَقَائِقِ وَمُوْضِحُ الدَّقَائِقِ الشَّيْخُ التَّقِيُّ النَّقِيُّ وَلِيُّ الدِّيْنِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْخَطِيبُ التِّبْرِيزِيُّ - أَجْمَعَ كِتَابِ فِي الْأَحَادِيثِ النَّبَوِيَّةِ، وَأَنْفَعَ لُبَابٍ مِنَ الْأَسْرَارِ الْمُصْطَفَوِيَّةِ، وَأَجْمَعَ تَأْلِيْفٍ صُنِّفَ فِي بَابِهِ، وَأَضْبَطَ لِشَوَارِدِ الْأَحَادِيثِ وَأَوَابِدِهَا.

وَلَمَّا سَلَكَ الْخَطِيبُ - رَفَعَ اللهُ دَرَجَتَهُ - فِي تَصْنِيفِهِ مَسْلَكَ الْإِمَامِ الشَّافِعِيِّ (رضي الله عنه) كثيرًا مَّا كَانَ يَخْتَلِجُ فِي قَلْبِي أَنْ أُؤَلِّفَ كِتَابًا عَلَى مِنْوَالِ «الْمِشْكَاةِ» ، أَسْلُكُ فِيْهِ مَسْلَكَ إِمَامِنَا الأعظم أَبِي حَنِيفَةَ النُّعْمَانِ - عَلَيْهِ الرَّحْمَةُ وَالرِّضْوَانُ - إِلَّا أَنَّ ضِيقَ بَاعِي قَدْ كَانَ يَثْبُطُنِي عَنِ الْقِيَامِ فِي هَذَا الْمَقَامِ، حَتَّى رَأَيْتُ فِي الْمَنَامِ أَنَّ شَمْسَ الضُّحَى وَبَدْرَ الدُّجَى وَنُوْرَ الْهُدَى، وَمِصْبَاحَ الظُّلَمِ حَبِيبَنَا النَّبِيَّ الْأَكْرَمَ ﷺ طَلَعَ عَلَيَّ وَقَالَ: سَلَامًا، قُلْتُ: سَلَامًا، فَضَمَّنِي - رُوْحِي فِدَاهُ - إِلَى صَدْرِهِ الَّذِي هُوَ مَنْبَعُ الْعِلْمِ وَالْحِكَمِ وَعَانَقَنِي. فَلَمَّا اسْتَيْقَظْتُ فَرَحًا وَمَسْرُورًا حَمِدتُّ اللهَ عَلَى هَذِهِ النِّعْمَةِ وَشَكَرْتُ لَهُ، فَأَصْبَحَتْ هَذَهِ الرُّؤْيَا الصَّالِحَةُ شَرْحًا لِي صَدْرِي، وَصَارَ عُسْرُهُ عَلَيَّ بِهَا يُسْرِي. فَصَمَمْتُ عَزْمِي بِتَأْلِيْفِهِ وَشَدَدتُّ مِيزَرِي لِكِتَابَتِهِ، وَمَا وَضَعْتُ فِيْهِ حَدِيثًا إِلَّا وَصَلَّيْتُ عَلَى النَّبِيِّ ﷺ عِنْدَ وَضْعِهِ. وَسَمَّيْتُهُ «زُجَاجَةُ الْمَصَابِيحِ».

وَاللهَ تَعَالَى أَسْأَلُ سُؤَالَ الضَّارِع الْخَاشِعِ ، مُتَوَسِّلًا بِحَبِيْبِهِ الْمُشَفَّعِ الشَّافِعِ أَن يَّجْعَلَهُ خَالِصًا لِّوَجْهِهِ مِنْ فَضْلِهِ، وَأَن يَنْفَعَ الْمُسْلِمِينَ بِهِ كَمَا يَنْفَعُهُمْ بِأَصْلِهِ، وَأَن يَتَقَبَّلَ هَذَا، وَيَجْعَلَهُ ذَخِيْرًا لِّمعَادِي. إِنَّهُ بِالْإِجَابَةِ جَدِيرٌ، وَعَلَى كُلِّ شَيْءٍ قَدِيرٌ.

"The Sermon of the Book"

In the Name of Allah, the Most Gracious, the Most Merciful

Praise be to Allah, who is the Light of the heavens and the earth. The example of His light is like a niche within which is a lamp; the lamp is enclosed in glass. He is the One who guides to the paths of peace and their ways, inspires us to the path of truth and its methodology, and grants us joy through adherence to the Sunnah. In His generous hand lies the fulfillment of all needs.

Blessings and peace be upon His Messenger, whom Allah made a radiant lamp for all creation, revealed to him the Book free from any crookedness, and through whom people entered into His religion in multitudes. The year of his birth was named a year of joy for all creation. Blessings also upon his family and companions, who are the lamps of guidance and the stars to be followed, for as long as oil continues to illuminate lamps.

To proceed: The poorest of Allah’s servants in need of His mercy, Abu Al-Hasanat Sayyid Abdullah, son of Mawlana Sayyid Muzaffar Husayn Al-Hyderabad Al-Hanafi, may Allah deal with both of them with His subtle kindness and pardon them with His abundant generosity, says:

Adhering to the guidance of the Prophet ﷺ cannot be fully achieved except by following what emanated from the niche of his noble heart. Likewise, holding fast to the rope of Allah is only perfected through the explanation and unveiling of its mysteries.

The book Mishkat Al-Masabih, authored by our master, the esteemed scholar, and erudite luminary, the revealer of truths and clarifier of intricacies, the pious and righteous Sheikh Waliuddin Muhammad ibn Abdullah Al-Khatib Al-Tabrizi, may Allah elevate his rank, stands as the most comprehensive book on Prophetic hadiths, the most beneficial compendium of the chosen secrets of Prophethood, and the most meticulous compilation in its field, thoroughly encompassing scattered and obscure hadiths.

When Al-Khatib, may Allah raise his status, adopted the methodology of Imam Al-Shafi’i (may Allah be pleased with him) in his compilation, it often stirred within me the desire to author a book modeled after Mishkat, following the methodology of our great Imam, Abu Hanifa Al-Nu‘man, may Allah have mercy upon him and grant him divine pleasure. However, the constraints of my capacity deterred me from embarking on this endeavor, until I saw in a dream the Sun of the Forenoon, the Full Moon of the Night, the Light of Guidance, the Lamp of Darkness, our beloved Prophet ﷺ.

He appeared to me and greeted me, saying"Peace be upon you." I replied"Peace be upon you." He then embraced me, may my soul be ransomed for him, and pressed me to his noble chest, which is the fountain of knowledge and wisdom. He embraced me lovingly. When I awoke, I was overwhelmed with joy and gratitude. I praised Allah for this blessing and thanked Him. This blessed vision became a source of relief and enlightenment for my heart, turning the difficulties of this task into ease.

Thus, I resolved with determination to undertake the authorship of this book and firmly girded myself to write it. I did not place a single hadith in it without sending blessings upon the Prophet ﷺ as I recorded it. I have named the book Zujajat Al-Masabih (The Glass of Lamps).

I ask Allah Almighty, with the plea of one who is humble and submissive, through His beloved, the intercessor and advocate, to make this work sincere for His sake, out of His grace. I ask Him to benefit the Muslims through it as He has benefited them through its original source, and to accept this work and make it a treasure for my Hereafter. Indeed, He is worthy of answering prayers and is capable of all things.

عَنْ عُمَرَ بْنِ الْخَطَابِ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «إِنَّمَا الْأَعْمَالُ بِالنِّيَّاتِ 1، وَإِنَّمَا لِامْرِئٍ مَا نَوَى. فَمَنْ كَانَتْ هِجْرَتُهُ إِلَى اللهِ وَرَسُوْلِهِ فَهِجْرَتُهُ إِلَى اللهِ وَرَسُوْلِهِ. وَمَنْ كَانَتْ هِجْرَتُهُ إِلَى دُنْيَا يُصِيبُهَا أَوِ امْرَأَةٍ يَتَزَوَّجُهَا ، فَهِجْرَتُهُ إِلَى مَا هَاجَرَ إِلَيْهِ». مُتَّفَقٌ عَلَيْهِ.

وَرَوَاهُ إِمَامُ الْمَذْهَبِ أَبُو حَنِيفَةَ (رضي الله عنه) فِي مُسْنَدِهِ مَعَ اخْتِلَافٍ يَسِيرٍ، وَفِيهِ: «الْأَعْمَالُ بِالنِّيَّاتِ» الْحَدِيثَ.

قَالَ عَلِيٌّ الْقَارِي (رحمه الله تعالى) : وَلَا يُمْكِنُ هُنَا نَفْيُ نَفْسِ الْأَعْمَالِ؛ لِثُبُوْتِهَا حِسًّا وَصُوْرَةً مِنْ غَيْرِ اقْتِرَانِ النَّيَّةِ بِهَا، فَلَا بُدَّ مِنْ إِضْمَارِ شَيْءٍ يَتَوَجَّهُ إِلَيْهِ النَّفْيُ وَيَتَعَلَّقُ بِهِ الْجَارُّ، فَالتَّقْدِيرُ: «مُعْتَبَرَةٌ» أَوْ «تُعْتَبَرُ» عَلَى مَذْهَبِ الْإِمَامِ أَبِي حَنِيفَةَ وَأَصْحَابِهِ.

English

On the authority of Umar ibn Al-Khattab (may Allah be pleased with him), he said: The Messenger of Allah ﷺ said:

"Actions are judged by intentions, * and each person will be rewarded only according to what they intended. So whoever's migration was for Allah and His Messenger, their migration was for Allah and His Messenger. And whoever's migration was for worldly gain or to marry a woman, their migration was to what they migrated for." (Muttafaq Alayh – agreed upon]

This hadith was also narrated by the Imam of the Madhhab, Abu Hanifa (may Allah be pleased with him), in his Musnad, with slight variations. In it, the wording is: "Actions are judged by intentions" (rest of the hadith).

Mullah Ali Al-Qari (may Allah have mercy upon him) commented:

"It is not possible here to negate the existence of actions themselves, as they are established by sensory evidence and in form, even without accompanying intention. Therefore, something must be implied to which the negation is directed and upon which the preposition depends. The interpretation is: 'considered' or 'are considered' according to the methodology of Imam Abu Hanifa and his companions."

1. His statement: "Actions are judged by intentions," etc.: This hadith is considered by some to be mutawatir (widely transmitted), while the general consensus is that it is mashhur (well-known). It has become customary for compilers of sunan (collections of prophetic traditions) and jawami (comprehensive works) to begin their Sihah and Sunan collections with this hadith. This is due to its emphasis on refining and purifying intentions at the outset of righteous deeds, as well as its indication that the goodness of virtuous actions hinges on the purity of intention and sincerity of purpose.

Know that this hadith is agreed upon and has been narrated by the Jama'ah (the collective of hadith narrators). Scholars agree that the word "inna-ma" (إنما) is used for restriction (hasr). Thus, the meaning is: "Actions are only considered valid if they are accompanied by intention, and they are not considered valid if they are devoid of intention." Therefore, "inna-ma" here means "only" or "nothing but." Some have said that the restriction is derived from the collective noun prefixed with the definite article "al-" (ال), as it implies universality, which necessitates restriction. Hence, the meaning is: "Actions are only achieved through intention." It is not possible here to negate the actions themselves, as their existence is perceptible and observable even without intention. Therefore, something must be implied to which the negation applies and to which the preposition is connected. Some have suggested that the implied wording is “sahiha” or “tasihhu” (which means ‘to be valid’), as per the view of Imam al-Shafi'i and his followers. Others have said “kamila” or “takmilu” (which means ‘to be complete’), according to the view of Abu Hanifah and his followers.

The most apparent interpretation is that the implied meaning is "considered" (mu'tabarah) or "are considered" (tu'tabaru), so as to encompass all actions, whether they are independent acts of worship like prayer and zakat, for which intention is unanimously considered necessary for their validity, or conditions for acts of obedience like purification and covering one's awrah, for which intention is considered necessary for earning reward, as conditions do not depend on intention for validity. This differs from al-Shafi'i's view regarding purification, and thus, the distinction must be clarified.

Or, in the case of permissible actions, they may be transformed into good deeds through intention, just as they may be transformed into sins without disagreement. The crux of the matter is that the conditions for validity and completeness are determined externally, and there is no harm in this. To elaborate, al-Shafi'i and other imams have held that intention is a condition for wudu (ablution), ghusl (ritual bath), and other means of worship.

I say to the Hanafis, there are several responses to this:

First: By clinging to the context of the hadith, as it was revealed regarding the migration of Umm Qais, as indicated by the Prophet's (ﷺ) statement: "Or a woman he marries," etc. He migrated with the intention of marrying Umm Qais, the migrant woman. Although his migration did not earn him the reward of migration, his migration was not deemed invalid.

Second: The implied meaning is: "The ruling of actions is based on intentions." Many actions are performed without specific intent or will, and the ruling applies to both worldly rulings (validity) and otherworldly rulings (reward). It is not valid to intend both simultaneously, as the generality of the shared meaning would be invalid. Thus, one must be intended, and it cannot be validity, as reward is unanimously tied to intention. Therefore, reward is the intended meaning. The absence of reward in wudu does not imply the absence of its validity or its role as a key to prayer, though this requires further reflection.

Third: Intention refers to the aim of drawing closer to Allah and the will to perform an act of worship, as suggested by the context. It is specific to acts of worship, thereby restricting the scope of actions to worship. Do you not see that the validity of actions in transactions is not tied to intention? Thus, it is clear that wudu, being an act of worship, is tied to intention, and we adhere to this. Reward is only earned through intention, and our jurists have explicitly stated that what is commanded is wudu performed with intention, as recorded in "Al-Nahr al-Fa'iq" and "Al-Durr al-Mukhtar", among others. There is no disagreement on this.

Fourth: If the validity of all actions were conditional on intention, as your generalization implies, it would follow that washing clothes, bathing, facing the qiblah, and other similar actions would not be valid without intention. This conclusion is invalid, and thus, the premise is also invalid.

It cannot be argued that these are sensory matters and do not require intention, as this is a debate about examples. Replace them with marriage and other matters, which are legal matters. The transfer of marital rights through offer and acceptance is a legal matter like a sale, and intention is not required. It cannot be argued that water naturally removes impurities, so if it removes impurity perceptibly, it is judged to have done so based on sensory judgment, unlike wudu, where impurity is a legal matter, and its removal by water is not rationally understood. We respond that water is recognized in the Shariah as a purifier and remover of impurities by nature. The legal aspect is the impurity itself. If the limbs are deemed impure, the removal of their impurity by water is rationally understood.

Fifth: What has occurred to this weak and limited servant, woven by the spider of a lukewarm thought, is that the implied meaning is legal consideration, as per your view, which is the apparent meaning. There are two aspects to consideration: consideration in itself and consideration for something else. There is no shared meaning between them, as the first is independent, and the second is not. It is inconceivable to share meaning between the independent and the dependent, as established in the case of existence in itself and relational existence. Thus, they cannot both be intended simultaneously, so one must be chosen, and it is consideration in itself, as it is the apparent and immediate meaning. Moreover, this is agreed upon between us and you, so negating this type of consideration does not negate the second type. Therefore, negating the consideration of wudu in itself does not negate its consideration for prayer as a means of permitting it, and Allah knows best.

Know that the commentator al-Qari also interpreted "consideration" (i'tibar) in this context, making it vary according to circumstances. Sometimes it is realized within validity, as in intended acts of worship, and other times within completeness, as in non-intended acts, where he said: "Its consideration encompasses both validity and completeness, varying with circumstances." Al-Halabi said in "Al-Ghunya Sharh al-Munya" after explaining the Hanafi response: "The truth is that the dispute over the method of deducing from the hadith is verbal. It indicates the invalidity of acts of worship without intention by consensus, but it does not indicate the invalidity of other actions without intention by consensus. This is because it cannot be intended to apply to all actions, whether legal or non-legal, as most non-legal actions occur without intention. Nor can it be intended to apply to all legal actions, whether acts of worship or transactions, as transactions do not depend on intention by consensus. Thus, it must refer to acts of worship or matters related to reward and punishment."

At this point, the real dispute is whether legal purification (taharah hukmiyyah) is solely an act of worship or part of natural, habitual actions that are perceptible. If the intention of worship is present, it becomes an act of worship for which one is rewarded; otherwise, it is not, even though it is realized, like other movements, stillness, actions, and abstentions that have a perceptible existence. This concludes the discussion, which is taken from "Al-Maraqiyat" and "Tansiq al-Nizam fi Musnad al-Imam."

1 قوله: إنما الأعمال بالنيات إلخ : هذا الحديث عند البعض متواتر، والعامة على أنه مشهور. وقد جرت عادة عامة أرباب السُّنن والجوامع بتصدير صحاحهم وسُنَنهم بهذا الحديث؛ نظرًا إلى تحسين النيَّة وإخلاصها في مبادئ أعمال الخير، وإشارةً إلى أن مَناط خَيرية الأفعال الحَسَنة هو حُسْن النيَّة وخلوص الطوية.

واعلم أن هذا الحديث متفق عليه، ورواه الجماعة. واتفقوا على أن «إنما» للحصر، فالتقدير: «إن الأعمال تُعتبر إذا كانت بنيَّة، ولا تعتبر إذا كانت بلا نيَّةٍ». فتصير «إنما» بمعنى «مَا وَإِلَّا». وقيل: الحصر مستفاد من الجمع المُحَلَّى باللام ؛ فإنه مفيد للاستغراق، وهو مستلزم للحصر. فالمعنى: ليست الأعمال حاصلة إلا بالنيَّة. ولا يمكن هنا نفي نفس الأعمال؛ لثبوتها حِسًّا وصورةً من غير اقتران النيَّة بها، فلا بُدَّ من إضمار شيء يتوجَّه إليه النفي ويتعلق به الجار، فقيل: التقدير: «صحيحة» أو «تَصِحُّ»، كما هو رأي الشافعي وأتباعه. وقيل: «كاملة أو تكمل» على رأي أبي حنيفة وأصحابه.

والأظهر أن المقدر: «معتبَرة» أو «تُعتبر»؛ ليشمل الأعمال كُلَّها، سواء كانت عبادات مستقلَّات كالصلاة والزكاة؛ فإن النيَّة تعتبر لصحّتها إجماعًا، أو شروطاً في الطاعات كالطهارة وستر العورة؛ فإنها تُعتبر لحصول ثوابها اتّفاقا؛ لعدم توقف الشروط على النيَّة في الصحة. خلافًا للشافعي في الطهارة، فعليه بيان الفرق.

أو أمورًا مباحةً ؛ فإنها قد تنقلب بالنيَّات حسنات كما أنها قد تنقلب سيئات بلا خلاف.

غاية ما في الباب أن متعلِّق الصحة والكمال يعرف من الخارج، ولا محذور فيه. وتفصيله أن الشافعي وغيره من الأئمة قد تمسكوا به في أن النيَّة شرط في الوضوء والغسل وغيرهما من وسائل العبادات المقصودة.

أقول للحنفية وجوه في الجواب عنه :

الأول: بالتشبث بمورد الحديث؛ فإنه ورد في مهاجر أُمِّ قيس على ما يشير إليه قوله ﷺ : «أو امرأة ينكحها إلخ»؛ فإنه هاجر لقصد نكاح أُمِّ قيس المهاجرة؛ لأنه وإن لم يترتَّب على هجرته ثواب الهجرة، فلم يحكم ببطلان هجرته.

والثاني: أن التقدير: «حكم الأعمال بالنيات»؛ فإن كثيرا من الأفعال تصدر بلا قصد وإرادة ، والحكم مشترك بين الحكم الدنيويّ وهو الصحة، والأخرويّ وهو الثواب. ولا يصح إرادتهما معًا؛ لبطلان عموم المشترك، فتعين إرادة أحدهما، ولا يجوز أن يكون هو الصحة؛ لأن الثواب مَنوط بالنيَّة بالاتفاق، فهو المتعين للإرادة. وخلوّ الوضوء عن الثواب لا يستصحب خلوّه عن الصحة وعن كونه مفتاحًا للصلاة، وفيه تأمل.

والثالث: أن النيَّة عبارة عن قصد التقرُّب وإرادة فعل القربة على ما يلوح إليه التلويح، وإنما هي في العبادات فبهذا تخصص الأعمال بالعبادات. ألا ترى أن صحة الأفعال في المعاملات غير منوطة بالنيَّة، فَلَاحَ أن كون الوضوء عبادة منوط بالنية، ونحن نلتزمه؛ فإنه لا يترتَّب عليه الثواب إلا بالنيَّة، وقد صرح فقهاؤنا بأن المأمور به هو الوضوء المنويّ، نقله في «النهر الفائق» و «الدر المختار» وغيرهما، ولا خلاف في هذا.

والرابع: أن صحة جميع الأعمال لو كانت مشروطة بالنيَّة - على ما يقتضيه تعميمكم - لزم أن لا يصحَّ غسل الثوب والبدن واستقبال القبلة وغيرهما إلا بالنيَّة ، واللازم باطل، فالملزوم كذلك.

لا يقال: هذه أمور حِسِّيَّة، وهي لا تحتاج إلى النيَّة ؛ لأن هذه مناقشة في المثال، فنبدله بالنكاح وغيره فإنها أمور شرعية، فإن ترتّب مِلْك البُضع على الإيجاب والقبول أمرٌ شرعيٌّ كالبيع، ولا تمسُّ فيها الحاجة إلى النيَّة. لا يقال: الماء مُزِيلٌ بالطبع، فإذا أزال النجاسة حِسًّا حُكِم بزواله؛ بناءً على الحكم الحِسِّي، بخلاف الوضوء؛ فإن الحدث نجاسة حكمية، فزوالها بالماء غير معقول؛ لأنا نقول: الماء عُرِف مُطَهِّرًا ومُزيلًا للنجاسات بالطبع في الشرع، فالحكمية إنما هي النجاسة، فإذا سُلِّم كون الأعضاء نجسةً، فإزالة الماء نجاستَها أمرٌ معقولٌ.

والخامس: ما سنح لهذا العبد الضعيف القاصر ونسجته عنكبوت الخاطر الفاتر أن المقدر هو الاعتبار الشرعي على ما هو قولكم، كما هو الظاهر، فللاعتبار نحوان : اعتباره في نفسه، واعتباره لغيره. ولا اشتراك بينهما معنًى؛ لأن الأول مستقل، والثاني غير مستقل، ولا يتصور الاشتراك المعنويّ بين المستقل وغيره، كما حقّق في الكَون في نفسه والكَون الرابطي، فلا يُرادانِ معًا، فتعين أحدهما، وهو الاعتبار في نفسه؛ لأنه هو المتبادر الظاهر. على أنه متفق عليه بيننا وبينكم، فلا يلزم من نفي هذا النحو من الاعتبار انتفاء النحو الثاني، فلم يلزم من نفي اعتبار الوضوء في نفسه اعتباره للصلاة بأن يكون مستبيحا لها، والله أعلم.

واعلم أن الشارح القاري قدَّر «الاعتبار» أيضا في هذا المقام، وجعله مختلفًا باختلاف الحالات، فتارةً يتحقَّق في ضمن الصحة كما في العبادات المقصودة، وأخرى في ضمن الكمال كما في غير المقصودة، حيث قال: أي اعتبارها الشامل لصحتها وكمالها باختلاف الحالات. وقال العلامة الحلبي في «الغُنية شرح المُنية» بعد بيان جواب الحنفية: فالحق أن النزاع في طريق الاستدلال بالحديث لفظيٌّ ؛ فإنه يدلُّ على عدم صِحَّة العبادات بِدُون النيَّة بالاتفاق، ولا يدل على عدم صحة غيرها بدونها بالاتفاق. وذلك أنه لا يجوز أن يراد من الأعمال جميعًا شرعية أو غير شرعية؛ لوجود أكثر الأعمال الغير الشرعية بدون النيَّة. ولا أن يراد الأعمال الشرعية جميعا عبادات أو معاملات؛ لعدم توقُّف المعاملات على النيَّة بالاتفاق، فتعين أن يراد العبادات أو متعلق الثواب والعقاب.

وحينئذٍ فإنما النزاع الحقيقي في أن الطهارة الحكمية، هل هي عبادة ليس غير، أو هي من جملة الأفعال العادية الطبعية التي تتحقّق حِسًّا؟ فإن وجد فيها نيَّة القربة كانت عبادة يثاب عليها، وإلا فلا، مع تحققها كما في سائر الحركات والسكنات والأفعال والتروك التي لها تحقّق في الوجود حِسًّا. انتهى. وهكذا سرد الكلام، وفيه تأمل، أخذته من «المرقات» و «تنسيق النظام في مسند الإمام».
