حدود میں سفارش کرنے کا بیان

اللہ بزرگ و برتر کا ارشاد ہے:

جزاء بما كسبا

(بیان دونوں کے عمل کی سزا ہے) (5، سورۃ المائدة، آیت نمبر:38)

حضرت عائشہ رضی اللہ تعالیٰ عنہا سے روایت ہے کہ قریش کو ایک مخزومی خاتون کا معاملہ جو پوری کی طرح فکر مند کر دیا تو وہ کہنے لگی کہ اس کے بارے میں رسول اللہ صلی اللہ علیہ وسلم سے کوئی غفتگو کرے گا۔ پھر وہ کہنے لگی کہ اسامہ بن زید کے سوا جو حضرت رسول اللہ صلی اللہ علیہ وسلم کے محبوب بیٹے کوئی اس کی جرات کرسکتا ہے۔ چنانچہ اسامہ نے آپ علیہ صلاۃ و سلام سے غفتگو کی۔ حضرت رسول اللہ صلی اللہ علیہ وسلم نے فرمایا کیا تم اللہ کی حد میں سفارش کرتے ہو۔ 2 پھر آپ علیہ صلاۃ و سلام نے

قولہ: جزاء بما کسبا (بیان دونوں کے عمل کی سزا ہے) اس میں صراحت ہے کہ باقاعدہ کا ظنا اس کی ساری حرکتوں کی سزا ہے۔ تعمیر واقع کر کے جین کر لفظ جزاء میں کمال سزا کا ارشاد ہے۔ اگر تعمیر اس کے ساتھ ضمان واجب کریں گے تو باقاعدہ کا ظنا اس کی ساری حرکتوں کی سزا نہیں رہے گی۔ اور نقص سے ثابت شدہ حکم منسوخ ہوجائے گا۔ اور عبد الرحمٰن بن عوف رضی اللہ تعالیٰ عنہ سے روایت ہے کہ حضرت نبی اکرم صلی اللہ علیہ وسلم نے ارشاد فرمایا چور پراس کا باقاعدہ کا ظہر جانے کے بعد تاوان نہیں ہے۔ اس کا مطلب یہ ہے کہ قطع یدا کی ایک سزا ہے جوشہہات سے دفع ہوجائے گی۔ اور ضمان ایک جرم ہے جوشہہات سے ثابت ہوتا ہے۔ کسی ایک کام کی وجہ سے دونوں کو جمع نہیں کیا جاسکتا۔ جسے قصاص اور دیت ہے کہ دونوں جمع نہیں کے جاسکتے۔ (میسوط)۔

۔ اتشفّع فی حدّمن حدود اللہ..... الخ (کیا تم اللہ کی حد میں سفارش کرتے ہو) اس لے حاکم کے پاس جب مقدار پیش ہو جائے تو کسی حد کے بارے میں سفارش جائز نہیں۔ اور کیسی مقدار حاکم کے پاس پیش ہو نے اور اس کے پاس ثابت ہو جائے نے پہلے اس کو چھڑا نے کے لے مقدار پیش کر نے والے کے پاس سفارش کر سکتے ہیں اس لے کر ایسی کسی حد کا جواب ثابت نہیں ہوائے۔ اور حد کا جواب محض کسی فعل کی وجہ سے ثابت نہیں ہوتا بلکہ حد امام ثابت ہو نے سے واجب ہوتی ہے (فتح القدیر) اس سے پیشات ظاہر ہے کہ مقدار امام کے پاس پیش ہو کر ثابت ہو نے سے پہلے کسی سفارش جائز نہے۔ اور جموی سے اس کی صراحت آئی ہے۔ (درمتار، ردالمختار) صاحب مرقات نے فرمایا اس حد میث کی بناء پر علماء کا اجماع ہے کہ حدود میں جب کے مقدار حاکم کے پاس پیش جائے سفارش کرنا حرام ہے۔ اس طرح سفارش قبول کرنا بھی حرام ہے اب را مقدار حاکم کے پاس پیش نے پہلے اکثر علماء نے اس کی اجازت دی ہے۔ بشرط کہ س کے بارے میں سفارش کی جائے۔ یہ وہ لوگوں کے لے باعث ثراور۔

کہرے ہو کر خطۂ دیاور ارشاد فرمایا سے کے سوا نہیں کہ تم سے پہلے کے لوگوں کو جس چیز نے بلا ک کیا

وہ پیش کران میں جب کوئی شریف (معزز آدمی) چوری کرتا تو اس کو چھوڑ دیتے تھے۔ اور جب کوئی

ضعیف (کمزور آدمی) چوری کرتا تو اس پر حد کجاري کردیتے تھے۔ اللہ کی فتنہ اگر بفرض محل فاطمه

بنت محمد (علیہ السلام) کہی چوری کرتی تو میں ضرور باٹھ کاٹ دیتا۔ (متفق علیہ)

Aisha (may Allah be pleased with her) narrated: The Quraysh were concerned about the Makhzumite woman who stole. They said: Who will speak to the Messenger of Allah (ﷺ) about her? They said: Who dares but Usama ibn Zayd, the beloved of the Messenger (ﷺ)? Usama spoke to him, and the Messenger (ﷺ) said: Do you intercede in one of Allah’s limits? He stood, addressed the people, and said: What destroyed those before you was that if a noble stole, they let him go, but if a weak person stole, they enforced the limit. By Allah, if Fatima, daughter of Muhammad, stole, I would cut her hand. [Agreed upon]

In Muslim’s narration: She said: The Makhzumite woman borrowed goods and denied them. The Prophet (ﷺ) ordered her hand cut. Her family went to Usama ibn Zayd, spoke to him, and he spoke to the Messenger (ﷺ) about her. Then the hadith continues as above.

(1) The statement: Do you intercede in one of Allah’s limits?: Intercession in a prescribed punishment is not permitted after reaching the judge. Before reaching or being proven before the judge, intercession is allowed for the one raising the case to release him, as the punishment’s obligation is not yet established. Obligation arises not from the act alone but upon proof before the Imam. (As in Fath al-Qadir)

It appears intercession is allowed after reaching the judge but before proof, as Tahtawi cited from Hamawi. (As in Al-Durr al-Mukhtar and Radd al-Muhtar)

In Al-Mirqat: They agreed intercession in a prescribed punishment is forbidden after reaching the Imam, per this hadith, and seeking intercession is forbidden. Before reaching, most scholars allow it if the person is not a habitual wrongdoer. For offenses requiring discretionary punishment, intercession is permitted whether it reaches the Imam or not, as they are weaker, and it is recommended if the person is not harmful, per al-Nawawi.

(2) The statement: The Makhzumite woman borrowed goods and denied them, so the Prophet (ﷺ) ordered her hand cut: The intent is that she was cut for theft. Borrowing was mentioned to identify and describe her, as it was the cause. The amputation was for her theft, and denial was noted for identification. Muslim’s narrations explicitly state she stole and was cut for theft, so this narration aligns to reconcile them, as it is one incident. Some imams said this narration is irregular, contradicting most narrators, and irregular narrations are not acted upon. Scholars said: Theft was omitted here because the narrator’s focus was prohibiting intercession in limits, not reporting theft. Most scholars and jurists of the regions hold there is no amputation for denying borrowed goods and interpret this hadith accordingly. Ahmad and Ishaq said amputation is required, per al-Tayyibi and al-Nawawi.

This makes it clear that the prescribed punishment for theft is retribution for all his actions. The word 'jaza' (punishment) implies complete retribution. If the restoration of the stolen property is made obligatory along with the punishment, then the prescribed punishment for theft will not serve as retribution for all his actions. And the command established by deficiency will be abrogated. It is narrated from Abdur Rahman bin Auf (RA) that the Noble Prophet (SAW) said: 'There is no strength after the prescribed punishment for theft has been carried out.' This means that cutting off the hand is one form of punishment which will deter [the thief]. And guaranteeing [restoration] is a crime that is established through testimony. Both cannot be combined due to a single act, just as retaliation and compensation cannot be combined. (Mausut).

2. 'Do you intercede in the prescribed punishments of Allah... etc.' When the matter is presented to the judge, intercession regarding any prescribed punishment is not permissible. Before the matter is presented to the judge and established before him, one can seek intercession from those who will present the matter. Therefore, such intercession regarding any prescribed punishment is not valid. And the prescribed punishment is not established merely due to an act; rather, it becomes obligatory when the judge establishes it (Fath al-Qadir). From this, it is evident that intercession is not permissible before the matter is presented to and established before the judge. This is clearly stated in Jamu'i (Drumtar, Rad al-Mukhtar). The author of Mirqat said: 'The scholars have reached a consensus based on this tradition that intercession in prescribed punishments is forbidden when the matter is presented to the judge. Thus, accepting such intercession is also forbidden. Before the matter is presented to the judge, most scholars have permitted intercession, provided it is about the matter itself. This is to ensure fairness.

When the matter is presented and the judge gives guidance, it is nothing but to prevent favoritism and corruption. The noble people (respected individuals) used to be let off when they committed theft, while the weak (poor individuals) were punished with the prescribed penalty. Allah's trial: If Fatima bint Muhammad (AS) were to steal, I would certainly cut off her hand.' (Muttafiq Alayh)

مسلم کی ایک روایت میں ہے وہ فرماتے ہیں کہ ایک مخزومیہ 3 خاتون لوگوں

سے عاریتا ساز وسامان لیتے چھراس کا انکار کر دیتے تو نہیں اکرم صلی اللہ علیہ وسلم اس کے باٹھ کاٹنا

حکم صادر فرما لے تو اس کے گھر والے حضرت اسامہ کے پاس آئے اور ان سے گفتگو کے تو انہول نے

رسول اللہ صلی اللہ علیہ وسلم سے اس بارے میں گفتگو کی۔ اس کے بعد سا بقہ حدیث کا مضمون ہے۔

In a narration from Muslim, they say that a man from Makhzum would take tools from people and deny having done so, so the Prophet ﷺ issued a ruling to cut off his hand. Then his family went to Umar (RA) and spoke to him about it, and he spoke to the Messenger of Allah ﷺ about it. After that, the rest of the hadith is as follows.

سیدنا عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے انہول نے کہا کہ میں

ایذاء رسول نہ ہو اب رہاوہ جرام جس میں تعزیر واجب ہوتی ہے تو اس میں سفارش کرنا اور سفارش قبول کرنا مقدرمہ

خواہ حاکم کے پاس پیش ہوا ہو یا نہ ہو پر حالات میں جائز نہیں۔ کیونکہ پیرامتم بلکہ ہیں بلکہ جس کے بارے میں سفارش

کی جائے یہ اگروہ ایذاء رسول نہیں ہے تو سفارش کرنا مستحب ہے۔ (نووی)

قولہ: کانت امرأة مخزومية تستعير المتعاع وتجحدہ، فامر النبی صلی اللہ علیہ وسلم

بقطع يدها...... الخ (ایک مخزومیہ خاتون لوگوں سے عاریتا ساز وسامان لیتے چھراس کا انکار کر دیتے تو نہیں اکرم صلی

اللہ علیہ وسلم نے اس کے باٹھ کاٹنا کا حکم صادر فرما)۔

مراد یہ کہ اس کا باٹھ کہ چوری میں کاذاگیا اور عاریتا کا ذکراس عورت کی شناخت و پہچان کے لیے ہے وہ

اس کے باٹھ کے کاٹنے کا سبب نہیں ہے۔

اس کا باٹھ کاٹنا تو چوری کی وجہ سے ہے، اور عاریت کے ساز وسامان کا انکار کہی اس کی پہچان کے لیے ہے۔

اور امام مسلم نے اس حدیث کی جو تمام سننی بیان کی ہیں اس میں صراحت ہے کہ اس نے چوری کی کہی اور چوری کے

سبب اس کا باٹھ کاذاگیا تو اس روایت کو جیسی اس معنی پر مول کیا جاتے گا تاکہ تمام روايتول میں طبق ہو اور اس لے کہی

کہ پیرا کیسی واقعہ ہے و نیز اتمہ کی ایک جماعت نے اس روایت کو شاہ بتایا ہے۔ کیونکہ پیروايت جمہور راویوں کے

مخالف ہے۔ اور شاہ روایت پر عمل نہیں کیا جاتا علماء نے کہا ہے کہ اس روایت میں چوری کا ذکر نہیں کیا گیا ہے۔ کیونکہ

راوی کے پاس اس سے مقصد حدود میں سفارش کے رو کے کاذاکر نہیں ہے۔ چوری کے متعلق خبر دینے کے ہے۔

جمہور علماء اور فقہاء امصار نے کہا ہے کہ عاریت کے انکار کرنے والے کا باٹھ نہیں کاذا جاتے گا اور انہول نے

اس حدیث کی ایسی بیتاویل کی ہے جسیا کہ میں ذکر کیا ہوں۔ امام احمد اور امام اسحاق فرماتے ہیں کہ اس میں باٹھ کا نہیں

ضروری ہے۔ (امام طیبی اور امام نووی نے اس کا ذکر کیا ہے)۔

رسول اللہ صلی اللہ علیہ وسلم کو یہ فرما تے ہوئے سنہوں کہ اللہ تعالیٰ کے حدود میں سے کسی حد کے مقابلے کی سفارش حاصل ہو جائے تو یقیناً اس نے اللہ تعالیٰ کی خلافت کی اور کسی باطل معاملہ میں جائے تو وہ بھی جھگڑا کرے گا تو وہ بھی اللہ تعالیٰ کی ناراضگی میں رہتا ہے۔ تا آ کہ وہ اس کے کنارہ کش ہو جائے۔ اور جو آدمی کسی مسلمان کے بارے میں ایسی بات کہ جوس میں نہیں ہے تو اللہ تعالیٰ اس کو پیپ و نون کے دلدل میں رکے گا۔ تا آ کہ وہ اپنی کسی بات کو ترک کر دے۔

It is narrated from Abdullah ibn Umar (RA) that he said:

I heard the Messenger of Allah ﷺ say: 'Do not intercede in cases where corporal punishment is due, whether the case has been presented to the judge or not, as it is not permissible under any circumstances. For such cases are obligatory by divine decree. However, if intercession is sought in a matter that does not involve harm to the Messenger of Allah, then intercession is recommended.' (Nawawi)

He said: 'A woman from the tribe of Makhzum came to borrow tools and denied having borrowed them, so the Prophet ﷺ ordered that her hand be cut off... etc. (A woman from the tribe of Makhzum used to borrow tools and deny having borrowed them, so the Prophet ﷺ ordered that her hand be cut off.)

The meaning is that her hand was cut off for theft, and the mention of her borrowing and denying is to identify and recognize her; it is not the reason for cutting off her hand.'

The cutting of his hand is due to theft, and the denial of the instruments of obscenity is for identification. Imam Muslim has narrated this hadith in all its versions, making it clear that he mentioned theft and that the cutting of his hand was due to theft. Therefore, this tradition will be interpreted in such a way that it aligns with all the traditions, and it is said that this incident is a solitary one, and a group of scholars has declared this tradition as weak. Because a solitary tradition contradicts the majority of narrators, and scholars have stated that action is not based on a weak tradition. They have said that there is no mention of theft in this tradition because the narrator's purpose was not to recommend punishment but to report the theft. The majority of scholars and jurists have said that the hand of one who denies obscenity will not be cut, and they have interpreted this hadith as I have mentioned. Imam Ahmad and Imam Ishaaq state that there is no necessity for cutting the hand in this case (Imam Taby and Imam Nawawi have mentioned this). The Messenger of Allah �aid: 'If someone pleads for leniency in any of Allah’s prescribed punishments, he has indeed rebelled against Allah. If he intervenes in any false matter, he will remain in Allah’s displeasure until he desists. And whoever speaks about a Muslim in a way that is not true, Allah will place him in the dust of the Fire until he abandons his falsehood.'

امام ترمذی کی شعب الایمان میں روایت ہے کہ جو کوئی کسی ایسے مقدرمیں مدد کرے جس کے حق یا طلب ہوئے کوئی جانتا تو وہ اللہ تعالیٰ کی ناراضگی میں ہے۔ تا آ کہ وہ اس باز آ جائے۔

It is narrated in Imam al-Tirmidhi's Shu'ab al-Iman that whoever assists someone in a matter where there is a right or claim, when no one knows about it, is in Allah's displeasure until he desists from it.

صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ (مِنْ تَوْبَةِ يَكُونُ) تَوَابَ نَفْرِ مَايَاسَ كَوْلَ جَاوَ اور بَاتَحَ كَاتَ كَر دَاغَ دَو

پُحْرَاسَ کَوْمِیرَ پَاسَ لاوَ اسَ کَوْلَ جَاکَر بَاتَحَ کَا طَآگِيا اور دَاغَ دَوْ کَر لا آگِيا تَوَآبَ پَ نَفْرِ مَايَا

اللَّهُ بَزَرگَ وَ بَرتَکِی جَنَابَ مِنْ تَوْبَکَر تَوَاسَ نَ عَرضَ کِيا مِنْ اللَّهُ تعَالی کِی جَنَابَ مِنْ تَوْبَ کِيا، تَوَآبَ پَ

عَلَیْهِ صَلَّى اللَّهُ نَ فَرْ مَايَا اللَّهُ تعَالی نَ تَیرِی تَوْبَ قَبولَ کِيا (طَحاوِی)

خدمت میں ایک چور لائے گیا صحابہ نے عرض کیا: یا رسول اللہ صلی اللہ علیہ وسلم! اس نے چوری کی ہے۔ تو آپ نے فرما کہ میں نہیں مجھتا کر اس نے چوری کی ہے۔ چور نے عرض کیا کیون نہیں 4 یا رسول

Abu Hurayra (may Allah be pleased with him) narrated: A thief was brought to the Prophet (ﷺ). They said: O Messenger of Allah, he stole. He said: I don’t think he stole. The thief said: Yes, O Messenger of Allah. He said: Take him, cut him, cauterize him, and bring him back. He was taken, cut, cauterized, and returned. He said: Repent to Allah. He said: I repent to Allah. He said: Allah has accepted your repentance. [Narrated by al-Tahawi]

4 قو لہ: فقال السارق بلی یا رسول اللہ صلی اللہ علیہ وسلم الخ (جن ساحب نے چوری کی تھی انہوں نے عرض کیا کیون نہیں یا رسول اللہ صلی اللہ علیہ وسلم (میں چوری کیا ہوں) آپ صلی اللہ علیہ وسلم ارشاد فرما نے ان کو لے جا کر با تحکا ت دو لیتی چور کا با تحکا ت ضروری ہے۔ جب کہ وہ ایک مرتبہ اس کا اقرار کیا ہواوراس میں وہ تمام قیود پا کے جا میں جو کتب فقر میں نذور میں۔ پرامم الوجدیفدا مام محمد امام ما کے، امام شافعی اورا کثر علماء امت رحمۃ اللہ علیہم کا مسلک ہے۔ اور امام ابویوسف رحمۃ اللہ علیہ کے پاس ایک مرتبہ اقرار کے با تحبیس کا تاجا نے گا۔ یقول امام احمد اور ابن ابی لیلی، امام زفر اور ابن شہبر معاہے۔ اوریا بوامی مخزوی کی حدیث کی بناء پر ہے۔ جس میں ایک سے زائد مرتبہ اقرار کے بعد کا تاگیا۔ اور امام الوجدیفرا ور دیگر ائمه کی دلیل وہ حدیث ہے۔ جس کو امام طحاوی نے سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ سے سند متصل کے ساتھ بیان کیا ہے۔ میں پیہ کر اس کے ایک مرتبہ اقرار کے اس کا با تحکا تا کیا۔ الان دولو ن حدیثوں میں جو تعارض واقع ہوا اس کے لیے تج اور تریح کی ضرورت ہے۔ مہتر بات یہ ہے کہ پہلی حدیث کو اس بات پر محول کیا جائے کہ پہلے اس نے صحابہ کے سامنے اعتراف کیا صحابہ کے اعتراف کی وجہ سے عرض کے یا رسول اللہ صلی اللہ علیہ وسلم اس نے چوری کی ہے۔ یخبر کے طور پر ہے۔ یگو اس کے طور پر نہیں۔ اس سے دولو ن حدیثوں کے درمیان مطابقت پیدا ہو جائے گی۔ پس دولو ن کا محل ایک ہی ہے۔ کہ با تحکا ت نے کے لیے ایک سے زائد اقرار کی ضرورت نہیں ہے۔ (فتح القدیر، مرقات، ثروح کنز)

سید نا عبْد الرحمٰن بن عوف رضی اللہ تعالی عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم ارشاد فرمائے جب چور پر حد جاری کی جائے تو وہ تاواؤن 5 نہیں دے گا (نسائی)

قولہ: لا یُغرم صاحب السرقة اذا اقيم علیہ الحد (جب چور پر حد جاری کی جائے وہ تاواؤن نہیں

دے گا) لیعن جب چور کا باتح کا ثا جاے اور چوری کی ہوتی چیز اس کے پاس موجود ہے تو وہ چیز ما لک کو واپس کر دی جائے

گی اگر چیز اس کو نچ دیا کسی کو بہتر کر دیا ہو کیونکہ اس کے ما لک کی ملکیت باقی ہے اور وہ شیء بلاکہ وجہ جائے یا اس کو اس

کے بلاک کر دیا ہو و نہ صورتوں میں کوئی فرق نہیں، اس کا ضمان نہیں لیا جائے گا جسیما کہ روایت سے ظاہر ہے اور یہ

امام ابو یوسف رحمۃ اللہ علیہ کی امام اعظم ابو حنیفہ رحمۃ اللہ علیہ سے روایت ہے اور پی مشہور ہے اور حسن بن زیاد کی

روایت میں ہے کہ امام صاحب نے بلاک کرنے کی صورت میں اس پر ضمان عائد کیا ہے البتر وہ شیخود بلاک ہو جائے تو

اس پر ضمان عائد نہیں کیا ہے۔

امام شافعی رحمۃ اللہ علیہ فرماتے ہیں: دونوں صورتوں میں ضمان دے گا۔

اس کی تفصیل یہ ہے کہ چوری کی چیز میں باتح کا ثنا ضروری ہے اب رہا مسر و قد سامان اگر وہ موجود ہے تو ما لک

کو واپس کر دیا جائے گا اور اگر موجود نہیں ہے خواہ وہ بلاک ہو جائے یا بلاک کر دیا گیا ہو ہمارے پاس اس کا ضمان نہیں

ہے حضرت امام شافعی رحمۃ اللہ علیہ کا اس میں اختلاف ہے ہمارے پاس اس کے ضمان کا نہونا اس لے ہے کہ قطع یہ

اور ضمان (تاوان) دونوں نمج نہیں ہوسکتا البتر یہ اور مال کا واپس کرنا دونوں نمج ہوسکتا ہیں جب کہ مال موجود ہو

کیونکہ وہ مال بندر کے حق کی حثیت سے حفظ ہے جب اس کو چوری کیا جائے تو شارع نے اس پر حد کو اجب کیا ہے

اور پیشریعت کا حق ہے اور جنايت حق شرع میں ہوتی ہے پس اس کو چوری کرنے کی صورت میں سیمال شریعت کے حق کی

حثیت سے حفظ ہوگیا اس بندر کا حق باقی نہیں رہا اس لے ضمان واجب نہیں ہوگا اور اس کی تمام سزا باتح کا ثنا مقرر

کیا گیا تو باتح کا ثنا کے ساتھ ضمان نمج نہیں ہوسکتا اگراس تقریر کو درست مان لیا جائے تو اس پر اعتراض کر اگر مال

مسروق بعینہ موجود ہو تو بھی واپس نہیں کیا جانا چاہیے حالاکہ ایسا نہیں ہے تو اس کا جواب پیدا جائے گا کہ سیمال صورت

مشابہت کی وجہ سے واپس دلا جائے گا نیز اس لے کر اس میں مال کی ملکیت باقی ہے اگر چوکر اس کی عصمت اللہ کی

طرف منتقل ہو جائے ہے مزید تفصیلات کے لے اصول فقہ کتابوں کی طرف رجوع کیا جائے۔

اس پرامام شافعی رحمۃ اللہ علیہ نے پر اعتراض فرمایا ہے کہ اللہ تعالی کے ارشاد فاقط عوا مصرف

Abd al-Rahman ibn Awf (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: A thief is not liable for compensation if the limit is enforced. [Narrated by al-Nasa’i]

Ibn Jarir al-Tabari narrated in Tahdhib al-Athar with a connected, reliable chain from him that the Messenger (ﷺ) said: If the limit is enforced on the thief, there is no liability on him.

(2) The statement: A thief is not liable for compensation if the limit is enforced: If the thief is cut and the stolen item is intact, it is returned to its owner. If sold or gifted, it remains the owner’s property. There is no liability whether the item is destroyed or consumed, per Abu Yusuf’s narration from Abu Hanifa, the well-known view. Hasan narrated liability for consumption but not destruction. Al-Shafi‘i said: Liable in both. In detail: Amputation is obligatory for theft. If the stolen item exists, it must be returned. If destroyed or consumed, no liability per us, unlike al-Shafi‘i, as amputation and liability do not combine, though return is allowed. The property was protected for the person’s right, but theft made the limit a Sharia right, making the property protected for Sharia, not the person, so no liability. Hanafis responded in usul books: Protection’s shift to Allah is from “As a recompense for what they earned” [Al-Ma’ida: 38], not “Cut off their hands”. ابن جریر طبری نے تہذیب الآثار میں قابل استدلال سنہ متصل کے ساتھ اس کی روایت اہلی سے (عبد الرحمن بن عوف رضی اللہ تعالیٰ عنہ) کی ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ جب چوڑ پر حد جاری کی جائے اس پرتاوان نہیں ہے۔

باجہ کا تین کا حکم ہے کیونکہ لفظ قطع ایک خاص معنی کے لے وضے کیا گیا ہے۔ اس میں مال کا حق اوراس کی حفاظت کی ذمہداری اللہ تعالیٰ کی طرف منتقل ہو نے میں کوئی دلالت نہیں ہے۔ پس تم لوگوں نے خاص پر عمل کرنا چاہئے ویا اور رسول اللہ صلی اللہ علیہ وسلم کے ارشاد لاگرم علی السارق بعد ما قطعت يمينه، پر اضافہ کیا ہے۔ حفیہ کی طرف سے کتب اصول میں اس کا جواب دیا گیا ہے کہ مال مسود کی عصمت بندے سے ختم ہو کر اللہ تعالیٰ کی طرف اس کا منتقل ہوجانا "فاقطعوا" سے نہیں ہے بلکہ "جزاء بما کسبا" سے اس کو ثابت کے ہیں، اس لے کہ لفظ جزا کا جب عقوبات میں استعمال ہوتا ہے تو اس سے بندے کے فعل کے مقابل میں اللہ تعالیٰ کا حق مراد ہوتا ہے۔ کیونکہ لفظ جزا جزئی یجزی کا مصدر ہے کفی و قضی کے معنی میں ہے۔ اس سے معلوم ہوتا ہے کہ قطع یہ چوڑی کی کامل سزا ہے۔ اور کامل سزا کامل جنايت کی ہوتی ہے۔ اور جنايت کامل اس وقت ہوتی ہے جب کروہ حقوق اللہ میں کی گئی ہو اور حقوق اللہ میں کی جانے والی جنايت ہر اعتبار سے کمل ہوتی ہے۔ اور حقوق العباد میں جنايت، ایک جہت سے جنايت ہوتی ہے اور ایک جہت سے نہیں، ایک لے اس کی عصمت کا اللہ تعالیٰ کی طرف منتقل ہونا ضروری ہوگیا تا کروہ نفس حرام ہو جائے۔ اور اگر مال کی عصمت بندے کی جہت سے باقی رہے تو وہ حرام بذا نہیں ہوگا اور یہ بہم نے اللہ تعالیٰ کے ارشاد میں لفظ جزا سے ثابت کیا ہے، تم جسیا کہتے ہو لفظ فاقطعوا سے نہیں ہے۔ نیز ضمان واجب نہ ہو نے پر کی وجہ سے استدلال کیا ہے۔ حدیث شریف میں ہے کہ چوڑی کرنے والے پر حد جاری کی جائے تو اس پر ضمان ادا کرنا نہیں ہے۔ اور ضمان نہ ہو نے کی روایت ابن سیرین، نخعی، شعیب عطا، حسن اور قاہرہ میں اللہ مروی ہے۔ صاحب نہایہ کہا ہے کہ کہی بات درست ہے اس لے کہ اللہ تعالیٰ کا ارشاد ہے: "فاقطعوا ایدیہما جزاءً بِمَا کَسَبا" تم ان دونوں کے باٹھ کا ط دویان کے کے کا بدلہ اس آیت میں تاوان کا حکم نہیں دیا گیا ہے۔ اگر تاوان دینا لازم ہوتا تو اس کا ذکر آتا تھا۔ اگر تم اعتراض کرو کہ یہ حدیث ضعیف ہے۔ امام دار قطنی نے فرمایا ہے کہ اس کی سنہ میں سعید بن ابراہیم راونی مجہول ہیں۔ اور اس کی دیگر سنہ بیان کی صحت سے ثابت نہیں ہیں۔ اگراس کو حثیت میں کر لیا جائے تو اس میں احتمالات ہیں۔

تاوان کی نفی سے عذاب آخرت کی نفی مراد ہو

حدگا نے والے کی اجرت مراد ہو

ضمان کی نفی جسیا کے ابتدا ء اسلام میں تھا ان تمام احکامات کے ساتھ تاوان کی نفی کے لے اس سے استدلال

کرنادرست نہیں ہے۔

اس کے جواب میں، میں کہتا ہوں کرامام دار قطعی اپنے قول میں منفرد ہو نے کی وجہ سے قبول نہیں کیا جا سکتا۔

اس حدیث شریف میں جو پچھلا کلام کیا گیا ہے وہ سنہ پڑھ کر مسور نے عبد الرحمن بن عوف کے حجروایت کی بہ اس میں مصور کی

عبد الرحمن بن عوف کے ملاقات ثابت نہیں۔ اگر بیات ثابت ہو جائے تو یہ حدیث مرسل ہو جائے گی اور حدیث مرسل

جحت ہے۔

علاؤہ ازیں علماء کی بنایی میں ذکر کیا ہے کہ ابن جریر طبری نے تہذیب الآثار میں قابل استدلال سنہ متصل

کے ساتھ اس کی تخریج کی ہے اور حضرت مسور اوران کے والد دونوں امام بخاری کی شرط کے مطابق ہیں ثقات میں سے

ابن حبان نے ان کے والد کو ثقات تا لمعین میں ذکر کیا ہے۔

عبد الباقی نے نقل کیا ہے کرامام زہری نے اس حدیث شریف کو سعید بن ابراہیم سے رویت کیا ہے اور فرمایا کہ

یہ حدیث چہ اور کہا کہ بیہد بینہ منورہ کے قاضی اور ثقة و ثبت ہیں۔

باتحاکی نے والے کی اجرت طاوان کا اطلاق کرنا خلاف ظاہر ہے نیز یہ کہ حضرت رسول اللہ صلی اللہ علیہ وسلم نے

ایک روایت میں لفظ غرم کو کہہ ذکر فرمایا ہے۔ جومضع نفی میں بہ اور کہہ موضع نفی میں عام ہوتا ہے اس لے پر اپنے تمام

اقسام کوشامل ہونا چاہیے۔

علامہ فقیہ ابواللیث نے امام محمد بن حسن رحمۃ اللہ علیہ سے روایت نقل کی ہے۔ اس میں ضمان قضاء نہیں ہے۔

لیکن دیانت واجب ہے اور بیات زیادہ مناسب ہے۔ اور اسی پر فتوی ہے کیونکہ القد ریاور مہسوط میں بہ مشام ہے

محمد سے روایت کیا ہے کہ سارق کے ضمان قضاء ساقط ہو جائے گا کیونکہ دونوں میں مما ثلت مشکل ہے لیکن دیانت ضمان کا

دیاجائے گا۔ اس لے کہ چور کی طرف سے ما کو نقصان پہنچائے۔

Ibn Jarir al-Tabari narrated in Tahdhib al-Athar with a sound chain from his family (Abd al-Rahman ibn 'Awf (RA)) that

the Messenger of Allah ﷺ said: 'When the limit is set on a road, there is no sin [for passing over it].'

The ruling for theft is threefold because the word 'cut off' has been used in a specific sense. There is no indication that the responsibility for the property and its protection has been transferred to Allah Almighty. Therefore, you should act specifically according to the guidance of the Prophet (peace be upon him) as stated in the hadith: 'After that, cut off the hand of the thief,' with the addition. The answer to this, provided by the learned, is found in the books of principles, which state that the sanctity of the property being transferred from the individual to Allah Almighty does not occur through 'cut off' but rather through 'a punishment for what he has earned.' This is because when the word 'punishment' (jaza) is used in the context of penalties, it implies the right of Allah Almighty over the actions of the individual. The word 'jaza' is derived from 'juz' or 'jazi,' meaning 'to fulfill or decide.' This indicates that cutting off the hand is a complete punishment, and a complete punishment is for a complete crime. A crime is considered complete when it involves a violation of the rights of Allah, and such a crime is complete in every respect. A crime against individuals is a crime in one aspect and not in another; the sanctity of the property must be transferred to Allah Almighty to make the act itself haram. If the sanctity of the property remains with the individual, it would not be haram, and this is established in the guidance of Allah Almighty through the word 'jaza,' not through 'cut off.' Furthermore, the argument is based on the fact that there is no liability. In the hadith, it is stated that when the hand of a thief is cut off, there is no liability. The tradition of no liability is reported by Ibn Sirin, Nakhai, Shaib Ata, Hassan, and Qahira. The author of Nihaya states that this is correct because the guidance of Allah Almighty is: 'Cut off their hands as a punishment for what they have earned.' The command for compensation is not mentioned in this verse. If compensation were necessary, it would have been mentioned. If you object that this hadith is weak, Imam Dar Qutni has said that the chain of narrators includes Sa'id bin Ibrahim Rawani, who is unknown, and the other chains are not established. Even if it is considered, there are possibilities: 1) The denial of compensation implies the denial of punishment in the Hereafter. 2) The reward of those who enforce the limit is implied. 3) The denial of liability, as was the case at the beginning of Islam, along with all these rulings, is not a valid argument for the denial of compensation. In response, I say that Imam Dar Qutni's statement cannot be accepted due to his uniqueness in this claim. The previous statement in this hadith, which mentions Musur reading it in the presence of Abdur Rahman bin Auf, is not established. If the meeting were established, the hadith would be classified as mursal, which is weak. Additionally, scholars have noted that Ibn Jarir Tabari has included a reliable chain in Tahdhib al-Athar and traced it back. Both Musur and his father meet the conditions set by Imam Bukhari and are considered trustworthy. Ibn Hibban has mentioned his father in Thiqat al-Ma'rif. Abdul Baqi has reported that Imam Zuhri narrated this hadith from Sa'id bin Ibrahim and stated that he is a judge of Madina and a trustworthy and reliable person. It is contrary to the apparent meaning to apply the term 'reward' to the enforcers of the limit. Moreover, the Prophet (peace be upon him) has mentioned the word 'ghurm' in one tradition, which is generally used for denial and should include all its types. Al-Faqih Abu al-Layth has narrated from Imam Muhammad bin Hasan (may Allah have mercy on him) that there is no liability, but restitution is required, and this is the prevailing opinion because it is consistent with the practice of al-Qadri and Mahsud. It is narrated from Muhammad that the liability of the thief is waived because both involve significant difficulty, but restitution must be made because the thief has caused damage.
