ف: واضح ہو کہ موات ایسی زمین کو کہتے ہیں جس کا کوئی ماکہ نہوجیا کر قاموس میں لکھا ہے اور نہا ی میں کہتا
ہے کہ موات وہ زمین ہے جس میں نہ بویا گیا ہواور نہ اس کوآباد کیا گیا ہواور نہ وہ کسی کے قبض میں آئی اور ایسی زمین کو
زندہ کرنا یعنی کہ اس کوآباد کرنےاور شرب کیتے ہیں پانی کے حصولاور شرب کی اصلاح میں کیتے ہیں پانی لینے
کی باری کو جو کہیتوں اور چوپاپیوں کے لئے مقرر ہوتی ہے-
وقول اللہ عزوجل: "وَنَبْعُهُمْ أَنَّ الْمَاءَ قِسْمَةٌ بَيْنَهُمْ، كُلُّ شِرْبٍ مُحْتَضَرٌ".
اور اللہ تعالیٰ کا ارشاد ہے: (سورۃ قمر، پ:27، ع:2، آیت نمبر:28، میں) اور ان کو جتادو کر ان میں (اور
اونٹ میں) پانی بانٹ دیا گیا ہے تو ہر ایک فریق اپنی اپنی باری پر (پانی پینے کے لئے) حاضر ہوا کرے-
ف: واضح ہو کہ آیت صدر میں جس اونٹ کا ذکر ہے وہ حضرت صاح علی السلام کی اونٹ ہےاور حضرت صاح علی کو قوم
ثموڈ کی بدائیت کے لئے نبی بنیا کر مجیجا گیا تھا اور اونٹ کے لئے اوردومراد ن جانور ول کے لئے مقرر کیا گیا-
وقولہ تعالیٰ : "لَها شِرْبٌ وَلُکُمْ شِرْبٌ يَوْمٍ مَعْلُومٍ".
اور اللہ تعالیٰ کا ارشاد ہے (سورۃ شعراء، پ:19، ع:8، آیت نمبر:155، میں) (حضرت صاح علی السلام
نے فرمایا اونٹ پانی پینے کا ایک مہجر ہے اس کے پانی پینے کے لئے) ایک دن کی اس کی اوردومراد ن مقرر کیا جاتا ہے
تمہارے (مویشیوں کے) پانی کے لئے-
افرادہ زمین کو حاکم کی اجازت کے بغیر اپنے لیے مختصر کرنا منوع ہے
In this chapter, the plan for settling uninhabited land and scheduling water for fields and livestock is discussed.
It is clear that ‘mawat’ refers to land that has not been cultivated or inhabited, as mentioned in the dictionary, and it is also stated that mawat is land that has neither been sown nor inhabited, nor has it come under anyone’s possession. Reviving such land means cultivating it and obtaining and distributing water for irrigation and drinking purposes. The schedule for drawing water, which is designated for fields and livestock, is as follows:
And Allah, the Exalted, says: “Their watering place is where the water is divided among them, every drink being brought forth.”
And Allah, the Most High, instructs: (in Surah Qamar, Part 27, Hizb 2, Verse 28) “And when they give their animals to drink, then each group comes to drink at its appointed time.”
It is clear that the camel mentioned in the initial verse is the camel of the Prophet Salih (AS), and he was sent to the people of Thamud as a prophet. A schedule was set for the camel and other animals.
And Allah, the Most High, says: (in Surah Ash-Shu'ara, Part 19, Hizb 8, Verse 155) “For it (the camel) there is a drink, and for you (your livestock) there is a drink on a known day.”
It is forbidden for individuals to take possession of land without the permission of the ruler.
امام مومین حضرت علی رضی اللہ عنہ اسے روایت ہے وہ حضرت صلی اللہ علیہ و
آلہ وسلم سے روایت فرماتے ہیں کہ آپ نے ارشاد فرمایا جو شخص کسی ایسی زمین کوآباد کرنے جس کا
کوئی ماکہ نہ ہو تو وہ اس زمین کا (امام یا خلیفہ وقت کی جازت سے ماکہ ہو نے) کا زیادہ حق دار
ہوگا حضرت عروہ نے کہا کر حضرت عمر رضی اللہ عنہ نے اپنی خلافت میں اس کے مطابق فیصلہ دیا۔
اس کی روایت بخاری نے کی ہے۔
Aishah (may Allah be pleased with her) narrated that the Prophet (ﷺ) said: “Whoever cultivates land that belongs to no one, he is most entitled to it.” Urwah said: Umar judged by this during his caliphate. [Narrated by Bukhari]
At-Tabarani narrated in his Mu’jam Al-Kabir and Al-Wasat from Mu’adh (may Allah be pleased with him) that the Prophet (ﷺ) said: “A man only has what his leader willingly gives him.”
In a narration by Bukhari from Ibn Abbas (may Allah be pleased with him), As-Sa’b ibn Jathamah said: I heard the Messenger of Allah (ﷺ) say: “There is no protected land except for Allah and His Messenger.”
(1) The statement: He is most entitled, meaning that land becomes his property. However, Abu Hanifah (may Allah be pleased with him) stipulated the leader’s permission, while his two companions, Shafi’i, and Ahmad disagreed, citing the generality of the narration. The narration: A man only has what his leader willingly gives him indicates the condition of permission, so the general is interpreted by it, as they relate to the same incident. Abu Hanifah also cited: There is no protected land except for Allah and His Messenger in the two Sahihs, where “protected land” refers to land reserved. This indicates that the authority over lands belongs to the leaders, not others. This is supported by what Ahmad narrated from Samurah ibn Jundub and At-Tahawi from Muhammad ibn Ubaydullah ibn Sa’id Abu Awn Ath-Thaqafi Al-A’war Al-Kufi, a Tabi’i, who said: A man from the people of Basra, called Abu Abdullah, went to Umar (may Allah be pleased with him) and said: “In the land of Basra, there is land that does not harm any Muslim and is not taxable land. If you wish, grant it to me, and I will make it into reeds and olives.” Umar wrote to Abu Musa: If it is protected land, grant it to him. Do you not see that Umar did not allow him to take it or own it except by the caliph’s grant? If it were otherwise, he would have said: “Why do you need my grant? Protect it, cultivate it, and own it.” This indicates that revival, according to Umar (may Allah be pleased with him), is what the leader permits for the one who undertakes it and grants ownership.
It is also argued with the narration: The land belongs to Allah and His Messenger, then to you after me. Whoever revives something from the dead land, its title is his, narrated by Abu Yusuf in Kitab Al-Kharaj. Since it is attributed to Allah and His Messenger, it cannot be exclusively owned except with the leader’s permission. Summarized from Al-Marqah, Umdat Al-Qari, and Al-Binayah. It is stated in Radd Al-Muhtar: The opinion of the Imam is the chosen one, which is why it is prioritized in Al-Khaniyyah and Al-Multaqa as usual, and At-Tahawi adopted it, and it is in the texts. In Ad-Durr Al-Mukhtar: This applies to a Muslim. For a non-Muslim under protection, permission is unanimously required, and for a temporary resident, he cannot own it at all by consensus.
(2) The statement: There is no protected land except for Allah and His Messenger, meaning no one can reserve land for himself to graze his livestock to the exclusion of others, as preventing grazing is prohibited. It is only for Allah, His Messenger, and those caliphs who needed it for the Muslims’ benefit, as Abu Bakr, Umar, and Uthman did when necessary. Summarized from Umdat Al-Qari. In Nayl Al-Awtar: There is no protected land except for Allah and His Messenger. Shafi’i said: The narration has two possible meanings. First: No one can protect land for the Muslims except what the Prophet (ﷺ) protected. Second: It refers to what he protected, so it is exclusive to the caliph who takes the Prophet’s place. On the first, no governor after him can protect land. On the second, it is exclusive to the caliph. Al-Hafiz said: Shafi’i’s companions derived two opinions from this, with the second being more likely among them, though the first is closer to the apparent wording. Some Shafi’is included regional governors with the caliph. Al-Hafiz said: Permissibility is general if it does not harm all Muslims. The Imam, even if equated with the Prophet (ﷺ), cannot protect land for himself, as per Malik, Shafi’is, and Hanafis. They said: He protects it for the Muslims’ horses and livestock, especially for the weak among them, as Umar (may Allah be pleased with him) did.
اور طبرانی نے اپنے جمہیرا وراوسط میں معاذ رضی اللہ عنہ سے روایت کی ہے کہ بنی کریم صلی اللہ علیہ وسلم نے ارشاد فرمایا کر آدمی اس چیز کا ماکہ ہوگا (جس کے ماکہ ہونے پر) حاکم خوش ہو (یعنی حاکم نے اس کی اجازت دی ہو)
A person will be a guarantor for something (when) the ruler is pleased (meaning the ruler has given permission).
اور بخاری کی ایک روایت میں ابن عباس رضی اللہ عنہما سے اس طرح مروی ہے کہ صحب بن جثامہ رضی اللہ عنہ نے فرمایا ہے کہ میں نے رسول اللہ صلی اللہ علیہ وسلم کو ارشاد فرماتے سنہ کر (کسی شخص کو اپنے مویشیوں کے چارہ اور پانی کے لئے کسی زمین کو منصوب کر لینے کا حق نہیں ہے بال) اللہ اور اس کے رسول (جہاد کے غوڑوں یا بیت المال کے مویشی یا مسلمانوں کے مصالح عامہ کے لئے) زمین کو منصوب کر سکتے ہیں۔ (زمانہ جاهلیت میں قبیلوں کے سردار بعض مرسیز اور شاداب زمینوں کو اپنے اغراض کے لئے منحت رضی اللہ عنہ کر لیا کرتے تھے جس سے دوسروں کی منفعت حاصل نہیں کر سکتے تھے، حضور صلی اللہ علیہ وآلم نے اس کو منع فرمادیا۔)
کمزور کے حقوق کی حفاظت مقاصد نبوت میں ہے

طاوس (یمانی) رحمۃ اللہ علیہ سے روایت ہے وہ رسول اللہ صلی اللہ علیہ وسلم سے مرسلا روایت کرتے تھے کہ آپ نے ارشاد فرمایا کہ جو کسی نہ جگڑ زمین کو آباد کر لے وہ (حاکم کی اجازت سے) اس کی ملک ہوگی اور نہ جگڑ زمین اللہ اور اس کے رسول کی ہے پھر وہ میری طرف سے تمہاری ہے (اس سے کچھ معلوم ہوتا ہے افادہ زمین کو آباد کرنے اور اس کے ماکہ بنانے کے حاکم کی اجازت ضروری ہے)۔ اس کی روایت امام شافعی نے کی ہے۔
Tawus narrated in a mursal form that the Messenger of Allah (ﷺ) said: “Whoever revives dead land, it is his, and the barren land belongs to Allah and His Messenger, then it is for you from me.” [Narrated by Shafi’i]
In Sharh As-Sunnah: The Prophet (ﷺ) granted Abdullah ibn Mas’ud houses in Madinah, located among the Ansar’s buildings, between their dwellings and palm trees. Banu Abd ibn Zuhrah said: “Ibn Umm Abd has encroached upon us.” The Messenger of Allah (ﷺ) said to them: “Why then did Allah send me? Allah does not sanctify a nation where the weak among them are not given their rights.”
(1) The statement: Then it is for you from me, I say: This indicates the condition of the leader’s permission for reviving dead land.
(2) The statement: Granted Abdullah ibn Mas’ud houses in Madinah, etc., if a Muslim or non-Muslim under protection revives barren land that has no owner, far from the village such that if someone stood at the edge of the inhabited area and shouted, his voice would not be heard, he owns it according to Abu Yusuf, which is the chosen opinion, as stated in Al-Mukhtar and others. Muhammad considered the lack of benefit to the village’s residents, so it is not permissible to revive land they benefit from, even if far, but it is permissible to revive land they do not benefit from, even if near the inhabited area. This was the view of the three. The ruling depends on distance according to Abu Yusuf and the cessation of benefit according to Muhammad, and this is the fatwa, as in Zakat Al-Kubra and the apparent narration, as in Sharh At-Tahawi and Al-Burjandi from Al-Mansuriyyah from Qadi Khan, that the fatwa is on Muhammad’s opinion. اور ثرہ الحسنی روایت ہے کہ بنی کریم صلی اللہ علیہ وآلم وسلم نے عبد اللہ بن
مسعود رضی اللہ عنہ کو مدینہ منتقل ہوئے چند گھر دے دیے اور وہ انصاری آبادی میں ان کے مکانوں اور کچور کے باغات کے درمیان تختو بنوعبد بن زبرہ کے کھاکرا بن ام عبیہ بن مسعود کے سے دور رکھو تو رسول صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ اللہ تعالیٰ نے مجھ کس لے نہیں ناکر مجھیا ہے؟ (یاد رکھو) اللہ تعالیٰ اس قوم کو پاک نہیں کرتے جس کے کمزور کا حق نہیں لیا جاتا ہو۔ مجھر ز میں اگر غیر مملوک ہوتا وہ کس طرح ملکیت میں آ سکتا ہے

حسن بصری رحمۃ اللہ علیہ سے روایت ہے وہ سمہ رضی اللہ عنہ سے روایت فرما تے ہیں کہ نبی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ جو (کسی مجھر اور غیر مملوک) زمین کو محصور کر لے (تاکہ اس کو آباد کرے) تو وہ اس کی ملکیت ہو جائے گی۔ اس کی روایت ابوداود نے کی ہے۔ مستعارز میں پر تعمیر کرنے یاد رخت اگانے کے مسائل
Al-Hasan narrated from Samurah (may Allah be pleased with him) that the Prophet (ﷺ) said: “Whoever surrounds a piece of land with a wall, it is his.” [Narrated by Abu Dawud]
(1) The statement: It is his, meaning he owns it. The marginal note says: The apparent narration indicates that surrounding is sufficient for ownership, which is Ahmad’s more well-known opinion, provided the wall is strong as per custom. Most scholars hold that ownership is by revival, and enclosing is not revival. The narration is interpreted as revival for residence. Al-Qari said: An-Nawawi said: If he intends an enclosure for livestock or a yard to dry fruits or gather firewood and grass, enclosing is required, and setting up markers or stones without building is insufficient. I say: In Al-Bada’i: If he encloses dead land, he does not own it by consensus, as dead land is owned by revival. Enclosing is merely placing stones or drawing a line around it to prevent others from claiming it, which is not revival, so he does not own it. However, he is more entitled to it than others, so no one can displace him, as his prior claim is a basis for preference. The Prophet (ﷺ) said: The resting place belongs to the one who arrives first. As stated in Bazl Al-Majhood. In Rahmat Al-Ummah: How is land owned, and what constitutes its revival? Abu Hanifah and Ahmad said: By enclosing it and providing water for it. For a house, by surrounding it, even without roofing. Malik said: By what is customarily considered revival, such as building, planting, or digging a well. Shafi’i said: For agriculture, by cultivating and extracting water; for residence, by dividing it into houses and roofing them. I say: In Al-Hidayah: Enclosing is not revival to own it, as revival is cultivation, and enclosing is for marking, named so because they marked it with stones or to prevent others from reviving it. Thus, it remains unowned as it was, which is the correct view.
(اس پر) حضور صلی اللہ علیہ و آلہ و سلم نے فرمایا کہ ان درختوں کو ان انصاری کو صحب کر دیا اور تم کو (اس بخشش کے بدلہ میں بہت سے فوائد حاصل ہوں گے) اور حضور صلی اللہ علیہ و آلہ و سلم نے اس کے لئے بحد ترغیب دی (اس تجویز کو مجھی) انہول نے نماز تو حضور صلی اللہ علیہ و آلہ و سلم سے (سمہ سے فرمایا تو تم موزی ہو ( کہ عاریق زمین پر درخت لگا کر دوسروں کو تکليف دینا چاہتے ہواؤر کسی تجویز کو تم نہیں مانتے) پھر حضور صلی اللہ علیہ و آلہ و سلم نے ان انصاری سے فرمایا :جاو! ان کے کھجور کے درختوں کو کٹ دو اس کی روايت البوداوو نے کی ہے
سمہ بن جندب رضی اللہ عنہ سے روایت ہے کہ ان کے کچور کے چند درخت ایک انصاری کے باغ میں تھا اور ان انصاری کے ساتھ ان کے پیوی نے کچی (اسی باغ میں) ربا کرتے تھے۔ سمہ اس (باغ) میں آیا کرتے تو ان انصاری کو (سمہ کے آنے جانے تے) تکلیف ہوا کرتی تھی۔ انصاری نے نبی کریم صلی اللہ علیہ وآلہ وسلم کی خدمت میں حاضر ہو کر (اپنی تکلیف) بیان کی تو حضور صلی اللہ علیہ وآلہ وسلم نے سمہ کو اپنے پاس بلا کر توہ (کچور کے درختوں کو) انصاری کے باٹھتے دیں۔ سمہ نے (حضرت صلی اللہ علیہ وآلہ وسلم کی اس تجویز کو) قبول نہ کیا تو حضور صلی اللہ علیہ وآلہ وسلم نے ان سے چاہا کہ وہ ان درختوں کے بدلے میں دوسرا جگہ کے درختوں کو لے لیں۔ سمہ نے اس (دوسری تجویز) کو بھی قبول نہ کیا۔
ف: اس حدیث شریف میں حضور علیہ صلاۃ و السلام نے ان انصاری کو سمرہ رضی اللہ عنہ کے کھجور کے درخت کاٹنے کا حکم اس لئے دیا کہ سمرہ کے و بالآ نے جانے سے ان انصاری کو تکلیف پہوچ رہی تھی جبکہ ان انصاری نے حضرت سمرہ کو زمین عاریتہ دی تھی - پیرقت میں نذور کے اورحد اپی میں کچا ہے کہ اگر کوئی شخص کسی کی زمین عاریتہ لے تاکہ اس میں مکان بنانے یا درخت اگانے تو جانے کے اور ما کب زمین کو یقین حاصل ہے کہ کس وقت کسی اپنی ضرورت پراپنی عاریتہ کو اٹھا لے سکتا ہے اور عاریتہ لینے والے کی تجویز کو رسلتا ہے اور درخت ہونے تو کاٹ سکتا ہے۔
ف: اس حدیث شریف میں حضرت سمرہ رضی اللہ عنہ نے حضور صلی اللہ علیہ و آلہ وسلم کی تیون تجویز کو قبول نہ کیا اس بارے میں صاحب مرقات اور صاحب اشعة اللمعات نے کہا ہے کہ حضور صلی اللہ علیہ و آلہ وسلم کی تیون تجویز کی بطور سفارش تخصیص بطور لزوم اور حکماً نہیں ورنہ حضرت سمرہ رضی جعلی القدر صحابی حضور صلی اللہ علیہ و آلہ وسلم کے حکم کو طال نہیں سکتے تھے۔
حاکم کو نہیں زمین بطور جاگیر دے سکتا ہے
Samurah ibn Jundub (may Allah be pleased with him) narrated that he had a cluster of palm trees in an Ansari man’s garden, and the man had his family there. Samurah would enter, causing the man discomfort and hardship. He asked him to sell it, but he refused. He asked him to exchange it, but he refused. Samurah went to the Prophet (ﷺ) and informed him. The Prophet (ﷺ) asked the man to sell it, but he refused. He asked him to exchange it, but he refused. He said: “Gift it to him, and you will have such and such,” enticing him, but he refused. He said: “You are causing harm.” He said to the Ansari: “Go and uproot his palm trees.” [Narrated by Abu Dawud]
(1) The statement: Uproot his palm trees, he ordered the Ansari to uproot the palm trees because it was clear that Samurah was harming him, as it was known that they were planted on borrowed land. As stated in Al-Marqah. In Al-Hidayah: If someone borrows land to build or plant, it is permissible, and the lender can retract and require the removal of the building or plants.
ابيض بن جمال ماری رضی اللہ عنہ سے روایت ہے وہ وفد بن کر رسول اللہ صلی اللہ علیہ و آلہ وسلم کی خدمت اقدس میں حاضر ہوئے اور انہول نے شہر ما رب (جویس کا ایک شہر ہے) کی ایک نمک کی کان بطور جاگیر کے دینے کی درخواست کی تو حضور صلی اللہ علیہ و آلہ وسلم نے ان کو بطور جاگیر (نمک کی کان) کا حکم دی جب واقس ہوئے گئے ایک شخص نے عرض کیا یارسول
اللہ تعالیٰ نے ان کو ایک تیار پانی کی کان وے دی ہے تو (پین کر) حضور صلی اللہ علیہ وآلہ وسلم نے
(دیہوئی وہ جاگیر) ان سے واپس لے لی۔ راوی کاپیانہ کہا بیش بن جمال نے حضور صلی اللہ
علیہ وآلہ وسلم سے دریافت کیا کہ پیلو کی کوئی زمین گھیر لی جاسکتی ہے؟ تو حضور صلی اللہ علیہ وآلہ وسلم
نے ارشاد فرمایا کہ ایسی زمین گھیر لی جاسکتی ہے جس تک اونٹ نہ پہوچے ہوئی (یعنی آبادی سے
بہت دور ہواور سستی کے جانوروں بالچڑنے کے لئے نہ جائے ہوئی)۔ اس کی روایت ترمذی، ابن
مجاورداری نے کی ہے۔
حاکم کو جاگیر دینے کا اختیار ہے
ف(1): اس حدیث شریف میں ذکور ہے کہ حضور صلی اللہ علیہ وآلہ وسلم کی کان بطور
جاگیر دے دی۔ اس حدیث اور اس باب کی اور حدیثول سے پی ثابت ہوتا ہے کہ حضور صلی اللہ علیہ وآلہ وسلم اور آپ
کے بعد آنے والے خلفاء کو اس بات کا حق ہے کہ وہ کانوں کو بطور جاگیر کسی کو دے سکتے ہیں۔ جس کا معنی یہ ہے کہ بعض
بحر زمینوں کو جو کسی کی ملک نہ ہوں بعض اشخاص سے مختص کروایا جائے گے خواہ وہ کسی چیز کی کان ہو یا زمین ہو گر شرط یہ ہے
کہ وہ ایسی زمین یا کان نہ ہو جو پیلے سکی سے مختص ہواور اس پر سب کا حق ہے۔ پیلے الاوطار سے ماخوذ ہے۔
اگر مصلح عام کی چیز ہوتی ہو تو دی ہوئی جاگیر واپس لی جاسکتی ہے
ف(2): اس حدیث شریف میں یہ بھی ذکور ہے کہ حضور صلی اللہ علیہ وآلہ وسلم نے حضرت ابیض کودی ہوئی
جاگیر واپس لے لی اس کی وجہ یہ کہ حاکم ایسی چیزوں بطور جاگیر کسی کو دینے سکتا جس سے مسلمانوں کی ضرورت ہیں
متعلق ہوئی جسے نمک کی کان یا کوئی پیعام ضرورت کی چیز یا کہ جن میں سب کا بر اب کا حق ہے۔ پیتملة بحر راق میں
ذکور ہے اس کے اگر حاکم لا می سے ایسی چیز کو بطور جاگیر دے دے تو وہ واپس بھی لے سکتا ہے۔ چنانچہ حضور صلی اللہ
علیہ وآلہ وسلم نے حضرت ابیض کی جاگیر واپس لے لی اور مرقات میں کہا ہے کہ حاکم ایسی کانوں کو بطور جاگیر کسی کو
دو سکتا ہے جن سے معدنی اشياء کے حاصل کرنے میں برتری محت اور مشقت درکار ہو جیسے پترول، فیروزہ اور ابرک
و غیرہ۔ اس کے برخلاف ایسی کا نیں جس میں محت ضروری نہیں جیسے گھاس کے رمن اور وادیوں کا پانی وغیرہ تو ایسی
چیزیں بطور جاگیر دینے کا حکم کو اختیار نہیں اس لئے کہ عامہ الناس اس کے استفادہ میں شریک ہیں اور یہ حکم نہیں
کسی کو ایسی چیز بطور جاگیر دیئی اوراس کو علم ہوا کہ وہ مصالح عامہ کی چیز ہے تو وہ اس پر حکم کو منسوخ کر دے اور دی ہوئی
جاگیر کو واپس لے لے۔
نخلستان کو بطور جاگیر دینے کا ایک واقعہ
Abyad ibn Hammal Al-Maribi (may Allah be pleased with him) narrated that he came to the Messenger of Allah (ﷺ) and requested the salt mine in Ma’rib, which he granted. When he turned away, a man said: “O Messenger of Allah, you have granted him flowing water.” So he revoked it from him. He asked about what could be protected from the arak trees, and he said: “What the camels’ hooves cannot reach.” [Narrated by Tirmidhi, Ibn Majah, and Ad-Darimi]
(1) The statement: He granted it, the narrations of this chapter indicate that it is permissible for the Prophet (ﷺ) and the leaders after him to grant minerals. Granting means designating some dead lands for specific individuals, whether minerals or land, making them more entitled to it than others, provided it is from dead lands not exclusively owned. This is agreed upon. As stated in Nayl Al-Awtar.
(2) The statement: He revoked it from him, hence they said: The leader cannot grant what the Muslims cannot do without, such as salt or wells from which people draw water. As stated in Takmilah Al-Bahr Ar-Ra’iq. In Al-Marqah: It is understood that granting minerals is permissible only if they are subsurface, requiring effort and expense, such as salt, oil, turquoise, sulfur, and the like. What is surface-level and obtained without labor or effort cannot be granted, as people share in it, like grass and valley waters. If the judge rules and it becomes clear that the truth is otherwise, his ruling is overturned, and he retracts it.
(3) The statement: What the camels’ hooves cannot reach, I say: This indicates that granting and revival are restricted to what is not tied to public interests. The narration indicates that revival is not permissible except with the leader’s permission, otherwise it would not have been revoked from him. Understand. As stated in Ath-Thawb Al-Hali.
This noble hadith mentions that the ear was granted as a fief. From this hadith and other narrations in this chapter, it is established that the Prophet ﷺ and the caliphs who came after him have the right to grant ears or lands as fiefs to individuals. This means that certain uncultivated lands, which do not belong to anyone, can be assigned to specific individuals, whether they are ears or lands, provided that these lands or ears were not previously assigned and everyone had a right to them. This is derived from earlier traditions. If it serves the public interest, the granted fief can be taken back.
(2): This noble hadith also mentions that the Prophet ﷺ took back the fief granted to Abu Darda. The reason for this was that the ruler can grant fiefs of things that are necessary for Muslims, such as salt mines or any essential item or something where everyone has a common right. It is mentioned in the Bahr al-Ra'iq that if the ruler grants something as a fief that is not essential, he can still take it back. Thus, the Prophet ﷺ took back the fief from Abu Darda. It is stated in the Maraqi that the ruler can grant fiefs of such lands where the extraction of mineral resources requires skill and effort, such as petroleum, emeralds, and marble, among others. Conversely, lands that do not require such effort, such as grasslands and valley waters, cannot be granted as fiefs because the general public shares the benefit of these resources. Therefore, if someone is granted such a fief and it is later discovered that it serves the public interest, the ruler can revoke the grant and take back the fief.
An incident regarding the granting of palm groves as fiefs.
_ اسماء بنت ابوبکر صدیق رضی اللہ عنہما سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے
کهجور کے چندرخت حضرت زبیر رضی اللہ عنہ کو بطور جاگیر دے دیے اس کی روایت ابوداود نے کی
ہے۔
This narration is reported by Abu Dawud.
_ اور بخاری نے " کتاب الخمس " کے آخر میں حضرت اسماء رضی اللہ
عنہا کی حدیث اس طرح روایت کی ہے کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے حضرت زبیر رضی اللہ
عنہ کو بنو انصار کی ایک زمین بطور جاگیر دے دی (اور پیڑ مین انصار نے رسول اللہ صلی اللہ علیہ وآلہ
وسلم کے خوالہ کی تھی )۔
زمین کے اقسام اوراس کے مسائل
ف : بدائع میں کہا ہے کہ زمین کی روسمیں ہیں -(1) مملوک زمین (2) غیر مملوک زمین جومباح ہے یعنی اس کا
استفادہ سب کر سکتا ہے _ مملوک زمین کی کچھ روسمیں ہیں -(1) آباد زمین (2) نجبر زمین _ اس طرح غیر مملوک مباح
زمین کی کچھ روسمیں ہیں (1) ایسی مباح زمین جو اطراف شہر میں ہوسے البتہ شہر کے حقوق متعلق ہول جیسے گھاس
کے رمنا اور جنگل وغیرہ (2) ایسی مباح زمین جو شہر سے دور ہواور نجبر ہو _
ایسی زمین جو آباد اور مملوک ہواس پر بخیر ما لک کی اجازت تصرف جائز نہیں، اورموات یعنی آباد زمین ایسی
زمین ہے جو نجبر ہواور خارج شہر ہو، کی کی ملک کچھ نہ ہواور کی کاس زمین پر کوئی خاص حق کچھ متعلق نہ ہویعنی حکم نہیں
کسی کو استفادہ کے لئے نہ دیا ہواو ا ضح ہو کہ اندرون شہر کی زمین کو نجبر زمین کہیں کہا جا سکا اور اس طرح خارج شہر کی
اس زمین کو نجبر زمین کہا جا سکتا ہے گا جس سے مصالح عامہ متعلق ہیں _
حاکم ایس زمین کو جو بھجر ہواور خارج شہر ہواور اس سے مصاف عامہ متعلقہ جس نہول وہ کو بطور جاگیر دے سکتا ہے اور جس کواس فتم کی زمین بطور جاگیر دی گئی اور اگروہ شخص تین (3) سال تک اس کو لیے،ی بھجر رکے اورآباد نہ کرے تو حاکم کو حق ہے کہ وہ کسی دوسرے شخص کو بطور جاگیر دیے۔ زمین کو بطور جاگیر دینے کا ایک واقعہ
Asma bint Abi Bakr (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) granted Zubair palm groves. [Narrated by Abu Dawud]
Bukhari narrated at the end of the Book of Khums from Asma (may Allah be pleased with her) that the Prophet (ﷺ) granted Zubair land from the wealth of Banu Nadir.
(1) The statement: Granted Zubair, etc., they differed on granting. The Shafi’i and Maliki view, as An-Nawawi said: The leader may grant land owned by the public treasury that no one owns except by the leader’s grant. Sometimes he grants its title, and the person owns it for a beneficial purpose, so it is permissible to own it like owning coins or other items given. Sometimes he grants its benefit, so the person is entitled to benefit from it for the duration of the grant. As for dead land, anyone may revive it without needing the leader’s permission. The Hanafi view on granting, as stated in Al-Bada’i: Lands are of two types: owned and unowned permissible land. Owned land is of two types: inhabited and ruined. Permissible land is of two types: part of the town’s utilities, such as firewood or grazing for livestock, and what is not part of its utilities, called dead land. Owned inhabited land cannot be disposed of without the owner’s permission, as the sanctity of ownership prevents it. Dead land outside the town, not owned or exclusively entitled to anyone, is not dead land if within the town. Likewise, what is outside the town but part of its utilities, such as firewood or grazing, is not dead land, so the leader cannot grant it. The leader can grant dead land for the Muslims’ benefit, as it pertains to developing the land. Disposal of what relates to the Muslims’ interests, such as digging major rivers or repairing their bridges, belongs to the leader. If the leader grants dead land to someone who leaves it uncultivated, it is not interfered with for three years. After three years, it reverts to dead land, and he can grant it to another, as per the statement: There is no right for the encloser after three years. The granting to Zubair is evidence for Abu Hanifah (may Allah be pleased with him), as this granting is either from the fifth that is his share or from dead land that no one owns, owned by revival. As stated in Al-Marqah. This is supported by what is in Bukhari’s narration afterward.
(2) The statement: Bukhari narrated, etc., it specifies the mentioned land as being from what Allah bestowed on His Messenger from the wealth of Banu Nadir, so he granted Zubair from it. This resolves Al-Khattabi’s confusion, where he said: I do not know how the Prophet (ﷺ) granted land in Madinah when its people embraced Islam willingly, unless it refers to what the Ansar gave to the Prophet (ﷺ) from their land that water did not reach, so he granted it to whomever he wished. As stated in Umdat Al-Qari.
ابن عمر رضی اللہ عنہما سے روایت ہے کہ بنی کریم صلی اللہ علیہ وآلہ وسلم نے حضرت زبیر رضی اللہ عنہ کو (ایک بھجر زمین) بطور جاگیر دینے کا حکم دیا جس قدر زمین پرانا گھوڑا دو طلائے تو حضرت زبیر نے اپنے گھوڑے کو دورا پیہال تک کروہ ظہر گیا پھر انہوں نے اپنا کوڑا پھینکا تو حضرت صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ ان کواس مقام تک زمین دیو جہاں تک ان کا کوڑا پھو پیا ہے۔ اس کی روایت ابوداود نے کی ہے۔ ایضاً دوسرا حدیث
Ibn Umar (may Allah be pleased with them) narrated that the Prophet (ﷺ) granted Zubair the extent of his horse’s stride. He ran his horse until it stopped, then threw his whip and said: “Give it to him from where the whip reached.” [Narrated by Abu Dawud]
(1) The statement: Give it to him from where the whip reached, Al-Mudhhar said: The granting to Zubair is interpreted as dead land or the fifth that is his share, so it is evidence for Abu Hanifah (may Allah be pleased with him). The general narrations are interpreted by it. Summarized from Al-Marqah.
علقہ بن واکل رضی اللہ عنہ اپنے والد حضرت واکل رضی اللہ عنہ سے روایت کرتے ہیں کہ بنی کریم صلی اللہ علیہ ان کو حضرموت (یعنی کا ایک شہر) میں ایک زمین بطور جاگیر دے دی حضرت واکل نے کہا کہ رسول صلی اللہ علیہ وآلہ وسلم نے میرے ساتھ حضرت معاویہ کو مجھجااوران سے فرما کہ ان کوزمین (ناپ کر) دے دو اس کی روایت ترمذی نے کی ہے۔ ضرورت سے زانگ پانی کو بھیسرو کنا چاہیے
Alqamah ibn Wa’il narrated from his father (may Allah be pleased with him) that the Prophet (ﷺ) granted him land in Hadramawt. He sent Mu’awiyah with me, saying: “Give it to him.” [Narrated by Tirmidhi and Ad-Darimi]
ابو بریرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا ہے کہ نچی ہوئے پانی کو (جو تمہاری ضرورت سے زانگ ہو) مت رکواس سے تم زانگ حاس (اگنے) رونے کا سبب بنو گے۔ اس کی روایت بخاری اورمسلم نے کی ہے۔
ف : حدیث شریف میں ارشاد ہے کہ پچھوے پانی کومت رکو! اس کا مطلب یہ ہے کہ اگر کسی کے پاس زاں پانی ہے تو ایسا شخص اس پانی کودوسروں کے پینے کے لئے کسی کے جانور کو پلانے کے لئے نہ دو کے وہ تین آدمی جن سے اللہ تعالیٰ قیامت کے دن نہ بات کریں گے نہ ان کو رکیسیں گے
The Messenger of Allah ﷺ said: 'Do not use water that has been used (for washing your private parts), for it will cause you to burn in Hell.' This hadith has been narrated by Bukhari and Muslim. In the noble hadith, it is stated: 'Do not give away used water!' This means that if someone has used water for washing their private parts, they should not give that water to others for drinking or for watering animals, lest they become people whom Allah the Exalted will neither speak to nor look at on the Day of Resurrection.
ابو ہریرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہے کہ رسول اللہ صلی اللہ علیہ وسلم ارشاد فرما یہ کہ تین آدمی ایسے ہیں جن سے اللہ تعالیٰ قیامت کے دن بات نہیں کریں گے اور ان کی طرف رکیسیں گے۔ (1) ایک وہ شخص جو کسی سامان پرتم کہا گے کہ جو قیمت اس کودی گئی ہے اس سے زیادہ دی جائے (تو اس کے لئے بہتر تھا) حالانکہ وہ ججوٹا ہے۔ (2) دوسرا وہ شخص جو نماز عصر کے بعد ججوٹی وقتم کہا گے تاکہ وہ (وقتم کا کر) کسی مسلمان شخص کا مال وقتم کے ذریعہ لے لے ( حالانکہ عصر کے بعد دن اور رات کے فرشتے پہرہ بدل کے لئے ملتے ہیں اور اس شخص کے اس فضیلت وا لے وقت کا کچھ لاحاظ نہیں کیا) اور (3) تیسرے وہ شخص جو (اپنی) ضرورت سے زاں پانی کو (لوگوں سے روکتا ہے) تو اللہ تعالیٰ (روز قیامت) اس سے فرما ئیں گے آج کے دن میں تجھ کو اپنے فضل سے روکتا ہوں جسیا کہ تو نے (اپنی ضرورت سے) زاں پانی کوروکا تھا (حالانکہ اس پانی کو) تیسرے باجوں نے نہیں نکالا تھا۔ اس کی روایت بخاری اور مسلم میں متفرق طور پر کی ہے۔ پانی، گھاس اور آگ میں شرکت کاپائی نہیں
Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “There are three whom Allah will not speak to or look at on the Day of Resurrection: a man who swore about a commodity, claiming he was given more than he was, and he lied; a man who swore a false oath after Asr to seize a Muslim’s wealth; and a man who withheld excess water. Allah will say: ‘Today, I withhold My favor from you as you withheld the excess of what your hands did not make.’” [Agreed upon]
ابن عباس رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یہ کہ مسلمان تین چیزوں میں شریک ہیں (کہ ہر ایک کوالے مفت
فاکده حاصل کرنا درست ہے) پانی، گھاس اورآگے۔ اس کی روايت ابو داوداور ابن ماجے نے کی
ہے۔
ف: واشح ہو کہ حدیث شریف میں پانی، گھاس اورآگے میں شرکت کی جوازت ہے اس کی تفصیل یہ ہے-
(1) پانی سے مراد وہ پانی ہے جو دریا چشمون میں کا ہواور جو بہتا ہوتا ایہ پانی کو کسی مسلمان کے پینے یا
جانورون کو پلانے سے رکنا حرام ہے۔ البتہ اگر کوئی شخص ایہ پانی کو پینے برتن میں محفوظ کر لے تو ایہ پانی کا
پینا جائز ہے-
(2) گھاس سے مراد ایکی گھاس ہے جو غیر مملوک زمین میں خودرو آگی ہواور اگر ایکی گھاس کو کسی کے
کاٹ کر محفوظ کر لیا تو وہ اس کی ملک ہوگی اور وہ اس کو رج سکتا ہے-
(3) آگ میں شرکت کی تفصیل یہ ہے کہ اگر کسی نے آگ روش کی تو اس کو اس باٹ کا حق ہے کر اس
سے سکیہ اور کچر ون کو سکھا لے البتہ انگار لینا چاہے تو آگ سلگانے والے سے اجازت لینا ضروری ہے۔
مضمون فتح القدیر، قدوری اور مرقات سے ماخوذ ہے-
پانی، آگ اور مک دین کی فضیلت
Ibn Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Muslims are partners in three: water, grass, and fire.” [Narrated by Abu Dawud and Ibn Majah]
(1) The statement: In water, grass, and fire, water refers to that in rivers and wells. If taken and placed in a vessel, it is contained, so selling it is permissible. Grass refers to what grows in unowned land or in owned land without the owner’s cultivation. If the owner cultivates it by watering and preparing the land, the narrations differ. In Adh-Dhakhirah and Al-Muhit: If he sells grass in his land that he cultivated by watering for the sake of the grass, and it grew with his effort, it is permissible, as he owns it. No one can take it without his permission. If it grew naturally, it is not permissible, as it is not owned by him but is permissible by default, as anyone can take it. In Al-Quduri: Selling grass in its land is not permissible, even if he brought water to his land and incurred expenses, as the partnership in grass is established naturally, and partnership ends only by containment. Bringing water to his land is not containment for the grass, so it remains shared, and selling it is not permissible. Al-Halwani narrated from Muhammad (may Allah be pleased with him) that grass is what has no stem, and what stands on a stem is not grass. Al-Fadli said: It is also grass. The partnership in fire means benefiting from its light, warming by it, and drying clothes with it. Taking embers is not allowed without the owner’s permission. As stated in Al-Kifayah.
ام المومنین حضرت عائشہ رضی اللہ عنہا سے روایت ہے کہ انہوں نے عرض
کیا یارسول اللہ (صلی اللہ علیہ وآلہ وسلم) وہ کوئی چیزیں ہیں جن کا منع کرنا جائز نہیں ہے۔ تو حضور
صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا (وہ چیزیں یہیں) پانی، نمک اورآگے۔ ام المومنین کہتی ہیں
میں نے عرض کیا یارسول اللہ صلی اللہ علیہ وسلم! پانی (کی ضرورت اور اہمیت) کیا ہے؟ (پیس کر)
رسول صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا: اے حمیراء! (یا ام المومنین لی لی عائشہ کا لقب ہے)
(آگ دین کی فضیلت میں تخمین بناون کر) جو کی کوآگے دیوے تو (اس کا ثواب اتنا بڑا ہے کہ
) گویا سے ان ساری چیزوں کو خیرات کر دیا جن کو اس آگے نے پکایا ہے۔ اور جس شخص نے
نمک دیا تو گویا سے ان تمام چیزول کو خیرات کر دیا جس نمک کی وجہ سے ان چیزوں میں خوبی لیئے لدّت پیراہوئی _اور(اب پانی پلانے کی فضیلت بھی سلو ) حسنے کسی مسلمان کو ایک مرتبہ ایسی جگہ پانی پلاپچہال پانی (آسانی سے) مل جاتا ہے تو (اس کا اتنا براثواب سے کر) گویا س نے ایک غلام آزاد کر دیا اور جس نے کسی مسلمان کو ایک مرتبہ ایسی جگہ پانی پلاپچہال پانی نہیں ملتا سے تو گویا سے اس کو زندگی بخشی _ (اس کی روایت ابن ماجہ نے کی ہے ) _ جوشخص کسی مبارح چیزر پر پیلے قبضہ کر لے تو وہ اس کاما لک ہوجاۓ گا
Aishah (may Allah be pleased with her) narrated that she said: “O Messenger of Allah, what is the thing that is not lawful to withhold?” He said: “Water, salt, and fire.” She said: “O Messenger of Allah, we understand water, but what about salt and fire?” He said: “O little red one, whoever gives fire is as if he gave charity with all that the fire cooked. Whoever gives salt is as if he gave charity with all that the salt seasoned. Whoever gives a Muslim a drink of water where water is available, it is as if he freed a slave. Whoever gives a Muslim a drink of water where water is not available, it is as if he brought him to life.” [Narrated by Ibn Majah]
اسر بن مضرس رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میں نے نبی کریم صلی اللہ علیہ وسلم کی خدمت میں حاضر ہو کر بیعت کی تو آپ نے ارشاد فرمایا کہ جوشخص کسی چشمه پر سب سے پہلے پہوچ کر قبضہ کر لے اس طرح کے اس سے پہلے کوئی اور مسلم نہیں پہوچ سکا تو وہ اس کاما لک ہوجاۓ گا _ (اس کی روایت البوداودی نے کی ہے ) ف : اس حدیث ثبوت سے ثابت ہوتا ہے کہ پانی پانا کونی اور مبارح چیزیے محاس بکثری وغیرہ پر جو کوئی پہلے قبضہ کر لے تو وہ اس کی ملکیت ہوجاتی ہے _ (مرقات)
مدینہ منورہ کی ایک نہر سے زمین کو سیراب کرنے کا ایک واقعہ
Asmar ibn Mudarris (may Allah be pleased with him) narrated: I came to the Prophet (ﷺ) and pledged allegiance to him. He said: “Whoever reaches water that no Muslim reached before him, it is his.” [Narrated by Abu Dawud]
(1) The statement: It is his, indicates that water becomes owned by containment.
عمر وہ بن زبیر رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ حضرت زبیر اور ایک انصاری کے درمیان (جومنافق تھا) حرز نامی پہاڑی زمین سے نکلن والی ایک نہر کے بارے میں جھگڑا ہوا _ (یعنہ حضرت زبیر کی زمین سے گزرتی ہوتی اس منافق کی زمین میں داخل ہوتی تھی ) (جب حضور صلی اللہ علیہ وسلم کی خدمت میں پیغمبر پہنچ ہوا تو ) رسول اللہ صلی اللہ علیہ وسلم نے (حضرت زبیر سے ) فرمایا کے زبیر ! تم (پہلے پنی زمین کو ) سیراب کر لو، پھر اپنے
پڑاوی کے لئے پانی چھوڑ دو _ (پین کر) اس انصاری نے کہا کر آپ نے یہ بات اس لئے فرمائی
ہے کہ وہ آپ کے پجوشگی زاد بجاگی ہیں۔ اس پرسول اللہ صلی اللہ علیہ وسلم کا چہرا اور متغیر ہوا اور فرمایا _
زبرتم (اپنی زمین کو) سیراب کر لو اور پانی روک رکھو پہلا تک کر اس کی سطح منتہی تک پیو پی جائے
(اس لئے کہ پیتمہ راحت ہے اس سے تم پورا فائدہ حاصل کرو) پھر پانی کو اپنے پڑاوی کے لئے چھوڑ
دو اس طرح نی کریم صلی اللہ علیہ و آلہ وسلم نے حضرت زبیر کو حکم صريحی کے ساتھ ان کا پورا حق
دلوایا جب راس (منافق) انصاری نے آپ کو غضبناک کرواوراس سے پبلآ پ نے الان دونوں کو
ایسی بات کا حکم دیتا جس میں دونوں کے لئے سہولت تھی (لیکن جب منافق نے ناشکری اور
غستاخی کی تو آپ نے شفقت کا لحاظ نظر ما کر انصاف کا فیصلہ دیا) اس کی روایت بخاری اور مسلم
نے متفقہ طور پر کی ہے _
ف : واضح ہوگا کہ عملہ بحران ق میں کس حاہے کا اگر نہر دو اشخاص کی زمینوں میں سے گزر رہی ہواور نہر کا رقبان میں
مشترک ہوتا دونوں باری باری سے نہر کے پانی سے اپنی اپنی زمینوں کو سیراب کریں اور اگر نہر اس طرح گزر رہی ہوگی
جب تک ایک زمین کی سیرابی کو بندر کیا جائے تو دوسری زمین کی سیرابی ممکن نہیں تو ایسی صورت میں بالائی زمین کی
سیرابی پہلے کی جائے اور بعد میں زمیں زمین کی سیرابی کی جائے اور بالائی زمین والوں کو پیچ نہیں پیو پیتا کر وہ
زمیں زمین والوں سے پانی کو دو کیں _
شهرول، چشمون اورناول کے پانی کے استعمال میں لوگ برابر کے شریک ہیں
عمرو بن شعیب رضی اللہ عنہما اپنے والد کے واسطے اپنے دادا (عمرو بن
العاص رضی اللہ عنہ ) سے روایت کرتے ہیں کہ رسول اللہ صلی اللہ علیہ و آلہ وسلم نے (بنی قریظہ کی)
محرز وانا کی وادی کی نہر کے بارے میں یفیصل دیا کہ (اس نہر کے پانی کو بالائی علاقے والا اپنی زمین
کواس طرح سیراب کرے کر وہ) پانی کو روک رکے پہلا تک کر (پانی کی سطح) طخون برابر
ہوجائے پھر بالائی علاقے والا پانی کوز ریین علاقے والے کیلے چھوڑ دے (اور اگر شیب میں اور جی
زیمنات ہون تو ہر ایک گھون برابر پانی روک کر اپن بعد وا لے کلمے چھوڑ دے ) اس حدیث کی روایت ابوداوداورابن ماجے نے کی ہے۔
امام محمد رحمۃ اللہ علیہ نے فرمایا ہے کہ تم ایک واختیار کرتے ہیں اس لے مختلف زمین والوں میں صلح کا بہترین طریقہ ہے کہ برابر علاقہ والا چشمہ ہو، نہروں اور نالوں کے پانی کو باہمی بجھوتے استعمال کر کیونکہ اس قسم کے پانی سے استفادہ میں لوگ برادر کے ثریک ہیں جسیا کہ تعقلیق ممجد میں ذکور ہے )۔
Urwah narrated that Zubair disputed with an Ansari man over a stream in Al-Harrah. The Prophet (ﷺ) said: “Water, O Zubair, then send the water to your neighbor.” The Ansari said: “Because he is your cousin?” His face changed color, then he said: “Water, O Zubair, then hold the water until it reaches the wall, then send the water to your neighbor.” The Prophet (ﷺ) upheld Zubair’s right explicitly in the ruling when the Ansari provoked him. He had initially advised them with something that gave them both leeway. [Agreed upon]
(1) The statement: Water, O Zubair, then hold the water until it reaches the wall, then send the water to your neighbor, means that no one can block the river from the lower land, but he takes his share, as blocking introduces something new in the middle of the river, and the river’s title is shared among them. No one can do that without the partners’ permission. If they agree that the upper land blocks the river to take his share and they settle that each blocks it in turn, it is permissible, as the impediment is their right, and it is removed by their agreement. If they can block it with a board or gate, he cannot block it with mud or dirt, as that harms the partners. If the water in the river is such that it does not flow to each one’s land except by blocking, the upper land starts until it is irrigated, then the next, and the upper land cannot prevent it from the lower land. As stated in Takmilah Al-Bahr Ar-Ra’iq.
It is clear that in the case of a canal passing through the lands of two individuals, if the canal is shared by both, they should irrigate their respective lands alternately. If the canal passes in such a way that until one land is fully irrigated, it is impossible to irrigate the other, then in such a situation, the upper land should be irrigated first, followed by the lower land. The people of the upper land should not cause inconvenience to those of the lower land, and they should share the water with them. People are equal partners in the use of water from springs, wells, and canals. Amr bin Shu'ayb (RA) narrates from his father, who heard from his grandfather (Amr bin Al-As (RA)), that the Messenger of Allah (peace be upon him and his family) gave a ruling regarding the canal in the valley of Banu Qurayzah that the person from the upper area should irrigate his land and retain the water until the surface is level, then he should release the water for the person from the lower area. If there are multiple terraces or plots, each should retain the water until it is level before releasing it to the next. This hadith has been narrated by Abu Dawud and Ibn Majah. Imam Muhammad (may Allah have mercy on him) said that you should adopt this method as the best way to achieve peace among owners of different lands is to ensure that the water from springs, canals, and ditches is used mutually, since people are equally entitled to benefit from such water, as mentioned in the respected tradition.
