(اس باب میں نج سلم اور رهن کے احکام ہیں)
وَقَوْلُ اللّٰہِ عَزَّوَجَلَّ : " يَاۤيُهَا الَّذِيۡنَ اٰمَنُوا۟ اِذَا تَدَايَنتُمۡ بِدَيۡنٍ اِلَىٰ اَجَلٍ مُّسَمٰٓى فَاكْتُبُوْهُ "۔
اور اللہ تعالیٰ کا ارشاد ہے : (سورۃ بقرہ، پ:3، ع:39، آیت نمبر:282) -
ترجمہ : اے ایمان والو!جب معاملہ کرنے لگو ادھار کا (خواہ دام ادھار ہو یا چیز ادھار ہو)
ایک معین مدت کے لئے تو (اس کی یاد واشت و ستا ویز کو) لکھ لیا کرو -
ف : تفسیرات احمدی میں لکھا ہے کہ حضرت ابن عباس رضی اللہ عنہما نے فرمایا ہے کہ اس آیت میں نج سلم کا ذکر
ہے اہ -
نج سلم کی صورت یہ ہے کہ مشترک سے ادھار گیہون خریدے یا مکان خریدے اور وعدہ بقرار پایا کر 6 ماہ کے
بعد دام دیے گے یا سورپیا فی الحال کسی کودیتیے اور پیمعا پده ہو کر 6 ماہ کے بعد فلان غلام اتنی مقدار میں لیس گے - اس
نچ کو اصطلاح شرع میں نج سلم کہتے ہیں اور پیدونوں صورتیں شرع میں جائز ہیں -
اس کے تفصیلی شراط کتب فقہ میں ذکور ہیں لیکن آیت میں میعاد کی طرف جواشار ہے اس کو پورے طور پراس
طرح متعمین کرنا چاہیے کہ اس میں اختلاف اور زراع باقی نہ رہے مثلًا پینے کے کر فلان فصل کے پر غلام لوگوں کا بلہ مشترک
یول کے کرماہ رمضان کی پچدرہ تاریخ کو قدم دول کا یاغلوں کا یاغلوں گا -
وَقَوْلُہُ : " فَرِهْنٌ مَّقْبُوْضَة "۔ اور اللہ تعالیٰ کا ارشاد ہے (سورۃ بقرہ، پ:2 ع:39، آیت
نمبر:283 میں ) اور اگر تم ادھار کا معاملہ کرتے وقت کسی سفر میں ہو اور وستا ویز کچھ کے لئے کوئی کتاب موجود نہ ہو تو
اِس کی صورت میں اطمینان کا ذریعہ رہے ن رکھ کی چیزیں ہیں (جو قرض دار کی طرف سے قرض دینے والے کے ) قبضہ
میں دیئی جائیں -
ف : واضح ہوگا علماء کا اس بات پر اتفاق ہے کہ میں حس طرح سفر میں جائزہ حضریعنی وطن میں بھی جائزہ ہے
اور آیت میں سفر کی تخصیص اس وجہ سے ہے کہ سفر میں اطمینان کے ذرائع کم رہتے ہیں البتہ جو چیز رہن رکھی جائے اس پر
واثق رہا ہے ن کا قبضہ ونا ضروری ہے ورنہ نہیں ہو گا -
نیچ سلم کے صحت ہونے کے شرائط
(This chapter contains the rulings on Naj Salam and Rahn)
And Allah’s statement, exalted and glorified be He: “O you who have believed, when you contract a debt for a specified term, write it down.”
And Allah’s guidance is: (Surah Al-Baqarah, Vol. 3, Chap. 39, Verse Number: 282) -
Translation: O believers! When you engage in a loan (whether it is a loan of money or goods) for a specified period, then write it down.
It is written in Tafseer-e-Ahmedi that Hazrat Ibn Abbas (RA) said that this verse refers to Naj Salam:
The form of Naj Salam is that the buyer purchases grain or property from the seller and agrees to pay the price after six months, or the buyer gives something immediately and agrees to receive a slave or other goods after six months. This is called Naj Salam in the terminology of Sharia, and both forms are permissible in Sharia.
The detailed conditions of this are mentioned in the books of Fiqh, but the verse emphasizes the importance of specifying the time. It should be meticulously recorded to avoid any ambiguity or dispute, such as the harvest of a particular crop by the laborers on the thirteenth of Ramadan or the delivery of goods on a specific date.
And His statement: “Or collateral held in trust.” And Allah’s guidance is (in Surah Al-Baqarah, Vol. 2, Chap. 39, Verse Number: 283): If you are in a journey and there is no writing material available, then in such a situation, the means of security are the items pledged (which are held in trust by the lender from the borrower).
It is clear that the scholars agree that this is permissible during travel as well as while at home. The verse specifically mentions travel because the means of security are fewer during travel. However, whatever is pledged must be held in trust by the lender; otherwise, it will not be valid.
ابن عباس رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم (جب) مدینہ منورہ تشریف لاے تو اصل مدینہ محلون میں ایک سال، دوسال اور تین سال کی مدت کے نیچ سلم کیا کرتے تھے تو حضرت علیہ صلی اللہ علیہ نے ارشاد فرمایا جو خص نیچ سلم کر لے تو اس کو چاہے کہ نیچ سلم معین پیمانے، معین وزن اور معین مدت کے لئے ہو۔ اس کی روایت بخاری اور مسلم نے کی ہے۔
ف: ہدایت میں کہا ہے کہ امام عظیم ابو حنیفہ رحمۃ اللہ علیہ کے پاس نیچ سلم کے صحت ہونے کے سات شرائط ہیں۔(1) پہلی شرط یہ ہے کہ جنس معلوم ہو۔ مثلاً مطلقاً غلہ کا ذکر نہ ہو بلکہ یول کہا جائے کہ غلہ میں گیہون خرپیا جائے گا یا جوخر پیدی جائے گی۔(2) دوسرا شرط یہ ہے کہ غلہ کی نوعیت بھی معین ہو۔ مثلاً اس بات کی ضاحت کروی جائے مثلاً گیہون اتنے ہونے گے یا قص تیری شرط یہ ہے کہ غلہ کی صفت بھی معین ہو۔ مثلاً اس بات کی ضاحت کروی جائے مثلاً گیہون اتنے ہونے گے یا قص ہوں گے۔(4) چوتھی شرط یہ ہے کہ غلہ کا نزخ بھی ناپ تول بھی معین ہو۔ مثلاً یول کہ کا ایک روپیے کے 20 کیلو لون گا یا 20 ناپ لون گا۔(5) پانچویں شرط یہ ہے کہ مدت بھی مقرر ہو جائے مثلاً یول نہ کہ کر آٹے دہ فصل پر غلدے دول گا بلکہ یول کہ کر مثلاً رمضان کی 15 / تاریخ غلدے دیا جائے گا۔(6) چھٹی شرط یہ ہے کہ غلہ کی جملہ مقدار بھی معین ہو۔ مثلاً یول نہ کہ کچھ غلہ لون گا بلکہ یول کہ کر 20 من یا کنٹل لون گا اور (7) ساتویں شرط یہ ہے کہ فلال جگہ غلہ پیو نچا دول گا یا فلال جگہ غلدے پیدول گا۔ اگر کوئی ایسی چیز ہو جس کے حمل ونقل میں مزدور کی ضرورت نہ ہو جسے مشکل یا موٹی وغیرہ تو اس کے لئے جگہ کے تعین کی ضرورت نہیں۔ پیشہ را ط پداپی میں نذور ہیں ان کے علاوہ فقہ کی بعض کتابوں میں اور کچھ چند شرائط کا ذکر ہے جو حسب ذیل ہیں:
نیچ سلم کی مدت کم از کم ایک ماہ بعیدی ہواس سے کم کی مدت جائزہ نہیں۔ جتنی زائد مدت چاہے مقرر کی جاسکتی ہے۔
ایک اور شرط یہی ہے کہ نیچ کا معاملہ طریقے کے بعد تو اس چیز کی حصول کر لئے تک وہ چیز بازار میں دستیاب ہو۔
نایاب نہ ہو۔ ایک مزید شرط یہی ہے کہ جس چیز کے لئے نیچ سلم کی جائے اگر وہ دستیاب نہ ہو تو پیچھے والے کو پچھڑا مہلت دی جائے پچھڑی وہ چیز ندل سے تو اس کے بدل کوئی اور چیز لینا جائزہ نہیں۔ اپنارو پیرو اپس لے لیا جائے۔
یہ بات بھی واضح رہے کہ نیچ سلم جانور ول میں درست نہیں۔
قبضہ پہلے مال کی فروخت جائز نہیں
When the Messenger of Allah ﷺ arrived in Madinah, he would perform the lesser pilgrimage (Umrah) for one year, two years, and three years from the original site of Madinah. Then, Allah's Messenger ﷺ said: 'Whoever performs the lesser pilgrimage (Umrah) from a specific point, it may be for a specific distance, a specific weight, and a specific duration.' This has been narrated by Bukhari and Muslim.
In Hidayah, it is stated that Imam-e-Azam Abu Hanifah (RA) has outlined seven conditions for the validity of salam (forward sale). (1) The first condition is that the genus must be specified. For example, instead of simply mentioning grain, it should be specified whether barley or wheat will be sown or produced. (2) The second condition is that the species of the grain must also be defined. For instance, it should be clarified whether the wheat will be of a certain type or quality. (3) The third condition is that the characteristics of the grain must also be specified. For example, it should be clarified whether the wheat will be of a certain quantity or quality. (4) The fourth condition is that the price and measurement of the grain must be clearly defined. For example, it should be stated that one rupee will buy 20 kilograms or 20 measured units of grain. (5) The fifth condition is that the time period must be specified. For example, instead of saying that grain will be delivered after the harvest, it should be specified that the grain will be delivered on the 15th of Ramadan. (6) The sixth condition is that the total quantity of the grain must be specified. For example, instead of saying that some grain will be bought, it should be specified that 20 mounds or quintals of grain will be bought. (7) The seventh condition is that the place where the grain will be delivered or produced must be specified. If the item is such that it does not require labor for transportation, such as something light or small, then specifying the place is not necessary. There are additional conditions mentioned in professional texts and some other books of jurisprudence, which are as follows: The duration of the salam contract must be at least one month; any duration shorter than this is not permissible. The duration can be extended as much as desired. Another condition is that the item for which the salam is made must be available in the market until it is obtained. It should not become scarce. An additional condition is that if the item for which the salam is made becomes unavailable, the seller must be granted an extension to procure it. The buyer cannot take any other item in its place; they must wait for the original item. It should also be noted that salam is not valid for animals. Selling the proceeds of a sale before taking possession of the item is not permissible.
ابوسعید خدری رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم ارشاد فرما تے ہیں کہ جو شخص کسی سے بیج سلم کا معاملہ کرے تو وہ چیز اس کے قبضہ میں آنے سے پہلے اپنی بیج کو دوسرا کی طرف منتقل نہ کرے (یعنی مال پر قبضہ ہونے سے پہلے کسی دوسرے شخص سے زبانی اس کا معاملہ نہ کرے )۔
اس حدیث کی روایت ابوداوداورابن ماجہ نے کی ہے۔
جانورولی خریدوفروخت ادھارجا نزہیں
Abu Sa‘id Al-Khudri (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever advances payment for something, let him not divert it to something else.” [Narrated by Abu Dawud and Ibn Majah]
(1) The statement: “Let him not divert it to something else”: For this reason, it is stated in Al-Hidayah: It is not permissible to dispose of the capital of a forward sale or the item advanced before possession. In Badhl Al-Majhud, Al-Khattabi said: If someone advances a dinar for a qafiz of wheat for a month and the term arrives but wheat is unavailable, Abu Hanifah held that it is not permissible to sell it in exchange for the dinar, but he returns the capital, based on the general and apparent meaning of the narration. According to Ash-Shafi‘i, it is permissible to buy a sa‘ with the dinar if they settle and take possession before parting, to avoid debt for debt. Before cancellation, it is not permissible, which is the meaning of the prohibition against diverting the advance to something else.
ابن عباس رضی اللہ عنہما سے روایت ہے کہ نبی کریم صلی اللہ علیہ وآلہ وسلم نے جانورولی بیج سلم سے منع فرما یا ہے۔
اس کی روایت حاکم اوردارقت نی نے کی ہے اور حاکم نے کہا ہے کہ اس حدیث کی سنن ہے اور بخاری اورمسلم نے اس کی تخریج نہیں کی ہے۔
کہ معظمر کا تول اور مد پینے منورہ کا ناپ تجاری اغراض کیلئے معتمبر ہے
Ibn ‘Abbas (may Allah be pleased with him) narrated that the Prophet (ﷺ) prohibited advancing payments for animals. [Narrated by Al-Hakim and Ad-Daraqutni. Al-Hakim said: This hadith has an authentic chain, but they did not include it]
(1) The statement: “He prohibited”: For this reason, it is stated in Al-Hidayah: Forward sales for animals are not permissible. Ash-Shafi‘i said they are permissible.
ابن عمر رضی اللہ عنہما سے روایت ہے کہ نبی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یا ہے کہ پیانولی اعلی مدنہ کا پیانہ اور وزن میں اعلی کہا وزن معتمبر ہے۔ اس کی روایت ابوداوداورنسائی نے کی ہے۔
Ibn ‘Umar (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “The measure is the measure of the people of Madinah, and the scale is the scale of the people of Makkah.” [Narrated by Abu Dawud and An-Nasa’i]
(1) The statement: “The measure is the measure of the people of Madinah”: At-Tahawi said in Mushkil Al-Athar: We examined this hadith and found that Makkah had no produce or cultivation at that time, nor before it. Do you not see the saying of Ibrahim (peace be upon him): Our Lord, I have settled some of my descendants in an uncultivated valley (Ibrahim: 37)? It was a trading city where pilgrims brought goods, selling them for the prices of traded goods. Madinah was different, as it was a land of palm trees, and their livelihood came from its fruits. Charities entered it, and the obligatory charity was taken by measure. The Prophet (ﷺ) made all cities follow these two cities. People needed scales for the prices of what they bought and other transactions, for paying zakat, and other purposes, including what they advanced for measured items. The Sunnah prohibited advancing measured items for measured items or weighed items for weighed items but permitted advancing measured items for weighed items and weighed items for measured items. It prohibited selling weighed items for weighed items except in equal amounts and selling measured items for measured items except in equal amounts. The scale was based on what was used in Makkah, and the measure was that of the people of Madinah, unchanged. If people altered it to something contrary, they would return to the knowledge of measured items according to the measure of the people of Madinah and weighed items according to the scale of the people of Makkah at that time. Their rulings do not change or turn to their opposites. From this, Imam Abu Hanifah and his companions took that anything called a sealed measure, qafiz, mukuk, mud, or sa‘ is measured, and the rulings of measured items apply to it in all we described. Anything called a ratl or uqiyyah is weighed. This was narrated from them by Muhammad ibn Al-‘Abbas ibn Ar-Rabi‘ Al-Lu’lu’i from ‘Ali ibn Ma‘bad from Muhammad ibn Al-Hasan from Abu Yusuf from Abu Hanifah, with no disagreement among them reported.
ف : اس حدیث شریف میں وزن کے لئے کہ معظمر ہو نے کا ذکر ہے اس کی وجہ یہ کہ کہ معظمر تجاری مرکز ہے اور اعتبار اعلی کہ کے تول کا ہوگا اور چونکہ مد پینے منورہ باعات کا شہر ہے جہاں چجل اور کچور کیثرت ہوتی ہیں اور ان کی خریدوفروخت ناپ کے ذریعہ ہوا کرتی ہی اس لئے حضرت صلی اللہ علیہ وآلہ وسلم نے پینے منورہ کے ناپ کو معتمبر قرار دیا ہے۔
ابن عباس رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ناب پ او رتول والون سے لعنی تاجروں سے ارشاد فرمایا: تمہارے باٹھ میں دو ایسے کام ہیں (جس کی ناب پ او رتول میں کی کرنا) جس کی وجہ سے تم پہلے تو میں بلاک ہوگئیں۔ (جب حضرت شعیب علیہ السلام کی قوم کہ لین میں تو پورا تول اوردی میں کم تول تولے)۔ اس کی روایت تزندی نہیں ہے۔ اس حدیث میں رسول اللہ صلی اللہ علیہ وسلم نے اپنی امت کو معاشرہ کی اس برائی سے پاکر بلا کرتے ہے محفوظ فرما دیا)۔
رہمن سے کسی چیز کے ادخار لین کا جواز
Ibn ‘Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said to those responsible for measures and scales: “You have been entrusted with two matters due to which the nations before you were destroyed.” [Narrated by At-Tirmidhi]
ام المؤمنین حضرت عائشہ صدیقہ رضی اللہ عنہا سے روایت ہے آپ فرماتی ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے (ایک مرتبہ) ایک یہودی سے پھلوں ایک مقررہ مدت کے وعدہ پر (ادخار) لیا اوراس کے پاس اپنی ایک زرعی جولوہے کی رہمن رکھ دی۔ اس کی روایت بخاری اورمسلم نے متفق طور پر لی ہے۔
ادخار اور رہمن کے بعض مسائل
ف: واضح ہوکر اس حدیث ثبوت سے اوراس کے بعد والی حدیث سے کئی فوائد اور مسائل معلوم ہوتے ہیں:
(1) ادخار کسی چیز کے خرید فروخت کا جواز
(2) رہمن کے کر ادخار چیز لین کا جواز
(3) رہمن کا معاملہ نصرف سفر بلکہ حضر (وطن) میں بھی جائز ہے۔
(4) نچ اورثراء کے معاملات ذمی اور غیرمسلم کے ساتھ کر سکتے ہیں اگرچہ ان کے معاملات سودی اور غیرشریعی وسائل کے ذریعہ ہوا کرتے ہیں اس لے پیشرے اگر مکلف ہوتے ہیں۔
(5) مشترکین اگر مسلماں ہیں تو ایسی صورت میں ان کے باٹھ اسلامی فروخت نہیں کی جاسکتا کروہ مسلماں کے خلاف استعمال نہ ہونے مرقات عبادۃ القاری
دوسرا حدیث
‘Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) bought food from a Jew on credit and pledged an iron armor to him. [Agreed upon]
(1) The statement: “The Messenger of Allah (ﷺ) bought”: In Sharh As-Sunnah, it is stated: This indicates the permissibility of buying on credit, pledging for a debt, pledging in residence, though the Book restricts it to travel, and transacting with the People of the Covenant, even if their wealth may involve usury or the price of wine. This is stated in Al-Marqah.
(2) The statement: “From a Jew”: This indicates the permissibility of transacting with disbelievers in matters where the prohibition of the transacted item is not confirmed, disregarding their corrupt beliefs and transactions among themselves. It also permits selling, pledging, leasing weapons, and other things to disbelievers who are not at war. This is stated in Umdat Al-Qari.
امام مثنی حضرت عاشر رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ایسی حالت میں وصال فرما کر آپ کی زرع ایک یہودی کے پاس تھیں جو کے بدلہ نہیں اس کی روایت بخاری نے کی ہے۔
The Messenger of Allah ﷺ visited him in a state where his land was with a Jew who did not give any compensation for it. This is narrated by Bukhari.
شمعی رحمۃ اللہ علیہ سے روایت ہے وہ فرماتے ہیں کہ نہیں کی چیز کسی قسم کا فائدہ نہ اٹھایا جائے۔ اس کی روایت امام طحاوی نے کی ہے۔
رہمن سے استفادہ درست نہیں ف: واضح ہو کہ جب کوئی چیز رہمن کا کرقرض لیا جائے تو قرض ادا کی بخیرا یہ چیز ماگلن اور لین کا حق نہیں ہے۔ جو چیز کسی کے پاس رہمن رکھی جائے تو رہمن رکھنے والے پر پلازم ہے کہ مال کے کسی طرح کا خود فع نہ اٹھائے۔ اگر باعث کا چیل پاز مین کا غلم نکلوہ اصل ما ککا ہوگا۔ اس طرح رہمن کے گھر میں رہ کر مین لین وا لے کو ایسے گھر میں رک کراس سے فائدہ اٹھانا بھی درست نہیں۔ اور اگر کوئی جانور مثلًا بگڑی ایا گا۔ وغیرہ رہمن رکھی گئی ہوتوہ بھی اصل ما کے ی کے ہول گے ان کا دودھ، پیہ وغیرہ جو پکھی ہووہ اصل ما کے کے ہول گے اور ان کو لینا درست نہیں البتہ دودھ ثچ کر دودھ کے دام رہمن میں شال کرے اور جب وہ تمہارا قرض ادا کر دے تو رہمن کی پیچیزیں اور دودھ وغیرہ کے دام سب اصل ما کے اوپن کر دے البند کھلا نی کے پی وضے کر لے۔
رہمن کی چیز تلف ہو جائے تو اس کا حکم
Ash-Sha‘bi narrated: Nothing may be benefited from a pledge. [Narrated by At-Tahawi]
(1) The statement: “From Ash-Sha‘bi”: Ash-Sha‘bi says this, yet it is narrated from Abu Hurairah (may Allah be pleased with him) that the Prophet (ﷺ) said: “The mount may be ridden for its maintenance if pledged, and the milk of the livestock may be drunk for its maintenance if pledged.” It is possible that Abu Hurairah narrated this from the Prophet (ﷺ), yet Ash-Sha‘bi says the opposite without abrogation being established for him. If so, his opinion becomes questionable. If his opinion is questionable, so is his narration. If his reliability in narration is established, so is his reliability in not contradicting it. If one must be invalidated, so must the other. Those who argue against us with this hadith of Abu Hurairah say: The one who narrates a hadith from the Prophet (ﷺ) knows its interpretation best, so it aligns with their principle. They must say: Since Ash-Sha‘bi said what we mentioned, contradicting what is narrated from Abu Hurairah from the Prophet (ﷺ), it indicates its abrogation. This is stated in Sharh Ma‘ani Al-Athar.
(2) The statement: “Nothing may be benefited from a pledge”: Ibrahim An-Nakha‘i, Ash-Shafi‘i, and a group of Zahiris said: The pledger may ride the pledged item for its maintenance and drink its milk accordingly, citing the hadith of Abu Hurairah that the Prophet (ﷺ) said: “The mount may be ridden for its maintenance if pledged, and the milk of the livestock may be drunk for its maintenance if pledged.” Ath-Thawri, Abu Hanifah, Abu Yusuf, Muhammad, Malik, and Ahmad in one narration said: The pledger has no such right, as it contradicts the ruling of a pledge, which is permanent retention, so he does not own it. Thus, he may not benefit from the pledged item by use, riding, milk, dwelling, or otherwise, nor sell it to anyone other than the pledgee without his permission. If he sells it and it depends on the pledgee’s approval, it is valid if approved, and the price becomes the pledge, whether the pledgee stipulates it as pledged with him or not. Abu Yusuf said it is not a pledge unless stipulated. Likewise, the pledgee may not benefit from the pledged item, so if it is a slave, he does not employ him; if a mount, he does not ride it; if clothing, he does not wear it; if a house, he does not live in it; if a Qur’an, he does not read from it. He may not sell it except with the pledger’s permission. For this reason, Ash-Sha‘bi said: Nothing may be benefited from a pledge, meaning neither the pledgee nor the pledger. The ruling for the pledgee is mentioned in most texts. The ruling for the pledger is derived from consensus and attributed in Ghayat Al-Bayan to Al-Aqta‘, where it is stated: Our companions said: The pledger may not benefit from the pledge’s benefits except with the pledgee’s permission, nor dispose of it, contrary to Ash-Shafi‘i, except for intimacy with a slave girl or wearing clothing. At-Tahawi said in arguing for our companions: Scholars agreed that the maintenance of the pledge is on the pledger, not the pledgee, and the pledgee has no right to use the pledge. The hadith of Abu Hurairah, which Ash-Shafi‘i and others cited, is ambiguous, as it does not specify who rides or drinks. How can the opponent assume it is the pledger, not the pledgee, without evidence? It is not permissible to attribute it to either without proof. Hushaim narrated from Zakariya from Ash-Sha‘bi from Abu Hurairah that the Prophet (ﷺ) said: If the animal is pledged, its fodder is on the pledgee, and the milk of the livestock is drunk, and the one who drinks or rides bears its maintenance. This hadith indicates that the riding and drinking in the first hadith refer to the pledgee, not the pledger, so it is assigned to him, and the maintenance is in exchange for what is benefited. According to us, and Allah knows best, this was when usury was permissible, and loans yielding benefits or taking something unequal were not prohibited. Then usury was prohibited, and every loan yielding a benefit was forbidden. This is derived from Umdat Al-Qari and Fath Allah Al-Mu‘in. Abu Hanifah said: The benefits and increments of the pledged item are pledged. The cost of its preservation and housing, if it contributes to maintaining the pledged item, is on the pledger; otherwise, it is on the pledgee. This is stated in Al-‘Urf Ash-Shadhi. In Ad-Durr Al-Mukhtar, it is stated: Benefiting from it is not permissible at all, whether by use or dwelling, for either the pledgee or pledger, except with mutual permission. Some said it is not permissible for the pledgee as it is usury. Others said if it is stipulated, it is usury; otherwise, it is not. Ibn ‘Abidin narrated from ‘Abdullah ibn Muhammad, a prominent scholar of Samarkand, that it is not permissible for the pledgee to benefit even with the pledger’s permission, as it is permission for usury. Ibn ‘Abidin said: This contradicts the generally accepted view that it is permissible with permission, unless it is interpreted as a matter of piety, while the accepted view pertains to the ruling. Then I saw in Al-Kawkab Ad-Durri: This applies if the benefit is not stipulated in the pledge, and the custom of the pledgee benefiting is not prevalent, as what is customary is like what is stipulated. It involves two transactions in one, which is prohibited, and every loan yielding a benefit is forbidden.

the thing of the Merciful is kept with the one who is merciful as a trust. This narration is recorded by Abu Dawud in his Musnad. And Ibn al-Qattan said that this hadith is mursal.
اوراس کی روایت دار قطی نے حضرت انس رضی اللہ عنہ سے اساداً لیں تے

صلی اللہ علیہ وآلہ وسلم نے راہن رکن وا لے سے ارشاد فرما کہ اب تمہارا حق جاتا رہا لیکن رہن
رکن وا لے کو اس کامل میں گا اور نہ قرض دینے وا لے کو اس کی رقم میں لگی۔
‘Ata’ narrated from the Prophet (ﷺ): “The pledge includes what is in it.” [Narrated by Abu Dawud in his Marasil. Ibn Al-Qattan said: It is a sound mursal. Ad-Daraqutni narrated it from Anas (may Allah be pleased with him) as a connected narration]
Abu Dawud narrated in his Marasil from ‘Ata’ that a man pledged a horse, and it died in his possession. The Messenger of Allah (ﷺ) said to the pledgee: “Your right is gone.”
(1) The statement: “The pledge includes what is in it”: The “ba” indicates exchange and compensation, as stated in Sa‘di Shalbi’s commentary on Al-‘Inayah. It means the pledge is guaranteed. If the pledgee takes possession and the pledged item perishes in his hand after possession, he guarantees the lesser of the pledge’s value or the debt. This is our view. Ash-Shafi‘i (may Allah have mercy on him) said the pledge is a trust in the pledgee’s hand, and nothing of the debt is waived if it perishes, citing: “The pledge is not withheld from its owner who pledged it; he benefits, and he bears its loss.” This hadith is disconnected, narrated by Ash-Shafi‘i and others as mursal, as the authentic version is from Sa‘id ibn Al-Musayyib’s mursal. Abu Dawud narrated it in his book, and only Ibn Abi Anisa connected it. Malik said: If it perishes due to an apparent cause, it is on the pledger’s guarantee; if due to a hidden cause, it is on the pledgee’s. Our evidence is the narration that a man pledged a horse, and it died, and they disputed before the Prophet (ﷺ), who said: “Your right is gone,” and in another narration: “The pledge includes what is in it,” and the consensus of the Companions that the pledge is guaranteed. This is derived from Al-Hidayah and Al-Marqah. In At-Ta‘liq Al-Mumajjad, regarding “The pledge is not withheld,” the author of An-Nihayah said: This was a saying of the people of ignorance that if the pledger did not repay by the specified time, the pledgee owned it. Islam invalidated this. Ash-Shafi‘i and a group of scholars used this hadith to argue that if the pledge perishes in the pledgee’s hand, the debt is not lost, and the pledger must pay the debt. At-Tahawi narrated in Sharh Ma‘ani Al-Athar that scholars interpreted it differently, citing Mughirah from Ibrahim about a man who gave a pledge for a term and took dirhams, saying: If I bring your right by such time, otherwise the pledge is yours for your right. Tawus, Sa‘id ibn Al-Musayyib, and Malik narrated similarly, indicating that the withholding in the hadith refers to withholding by sale, not loss. Muhammad said in his Muwatta, interpreting “The pledge is not withheld”: A man would pledge to another, saying: If I bring your money by such time, otherwise the pledge is yours for your money. The Messenger of Allah (ﷺ) said: “The pledge is not withheld,” nor is it the pledgee’s for his money. We say the same, as does Abu Hanifah, and Malik ibn Anas interpreted it similarly. In Al-Hidayah, it is stated: The meaning of “The pledge is not withheld” is complete retention by becoming owned, as Al-Karkhi reported from the predecessors.
