عَنْ عَائِشَةَ (رضي الله عنها)قَالَتْ: مَا تَرَكَ رَسُولُ اللهِ ﷺ دِينَارًا وَلَا دِرْهَمًا وَلَا شَاةً وَلَا بَعِيرًا وَلَا أَوْصَى۱ بِشَيْءٍ. رَوَاهُ مُسْلِمٌ.

English

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) left neither dinar nor dirham, nor sheep nor camel, nor did he bequeath 1 anything. [Narrated by Muslim]

1 His statement “nor did he bequeath anything”: An-Nawawi said: In another narration, it was mentioned in Aishah’s presence that Ali (may Allah be pleased with him) was the executor, and she said: “When did he bequeath to him? I was supporting him until he passed away, so when did he bequeath?” The meaning of “nor did he bequeath anything” is that he did not bequeath a third of his wealth or anything else, as he had no wealth. Nor did he bequeath to Ali or anyone else, contrary to what the Shi‘ah claim. As for the authentic Hadiths about his bequest regarding the Book of Allah, his household, expelling the Jews from the Arabian Peninsula, and allowing delegations, these are not meant by her statement “nor did he bequeath.” As for the land he had in Khaybar and Fadak, he designated it as charity for the Muslims during his lifetime. Regarding what some biographers mentioned, that the Messenger of Allah (ﷺ) had many camels, twenty she-camels kept around Madinah whose milk was brought nightly, seven sheep whose milk was consumed, and seven goats whose milk was consumed, this does not contradict this authentic Hadith. If true, it can be understood that these were from the charity camels, and his poor companions, like those of the Suffah and others, drank their milk. (As stated in Al-Mirqat)

۱ قوله : ولا أوصى بشيء: قال النووي: وفي رواية أخرى ذكروا عند عائشة لها أن عليا لله كان وصيا، فقالت: متى أوصى إليه. وقد كنت مسندته حتى مات، فمتى أوصى، ومعنى ولا أوصى بشيء أي لا أوصى بثلث ماله ولا غيره؛ إذ لم يكن له مال، ولا أوصى إلى علي، ولا إلى غيره خلاف ما يزعمه الشيعة. وأما الأحاديث الصحيحة في وصيته بكتاب الله ووصيته لأهل البيت وإخراج اليهود من جزيرة العرب، وإجازة الوفد، فليست مرادة بقولها: «ولا أوصى»، وأما الأرض التي كانت له الله بخيبر وفدك، فقد سبلها الله في حياته وجعلها صدقة للمسلمين. وأما ما حكى بعض أهل السير من أن رسول الله الله كان له إبل كثير، وكان له عشرون ناقة يحفظونها في نواحي المدينة، ويأتون بألبانها في كل ليلة، وكان له سبع شياه يشربون ألبانها، وكان له سبع معز يشربون من ألبانها، فلا يصلحالمعارضة هذا الحديث الصحيح، ولو صح الحمل على أنها كانت من إبل الصدقة، وكان أصحابه الفقراء من أهل الصفة وغيرهم يشربون من ألبانها. التقطته من «المرقاة».

وَعَنْ عَمْرِو بْنِ الْحَارِثِ أَخِي جُوَيْرِيَةَ (رضي الله عنهما) قَالَ: مَا تَرَكَ رَسُولُ اللَّهِ ﷺ عِنْدَ مَوْتِهِ دِينَارًا وَلَا دِرْهَمًا وَلَا عَبْدًا۱ وَلَا أَمَةً وَلَا شَيْئًا إِلَّا بَغْلَتَهُ۲ الْبَيْضَاءَ وَسِلَاحَهُ وَأَرْضًا ۳ جَعَلَهَا صَدَقَةً. رَوَاهُ الْبُخَارِيُّ.

English

Amr ibn al-Harith, the brother of Juwayriyah (may Allah be pleased with them both), narrated: The Messenger of Allah (ﷺ) left at his passing neither dinar nor dirham, nor male slave 1 nor female slave, nor anything except his white mule 2, his weapons, and land 3 which he designated as charity. Al-Kirmani, in his commentary on Bukhari, said: Half of Fadak’s land, a third of Wadi al-Qura’s land, his share of Khaybar’s fifth, and a portion of Banu Nadir’s land. The pronoun in “he designated it” refers to all three, not just the land, as he said: “We, the company of prophets, do not leave inheritance; what we leave is charity.” (As stated in Al-Mirqat)

۱ قوله: ولا عبدا ولا أمة: أي في الرق، ففيه دلالة على أن ما ذكر من ذكر من رقيق النبي له في جميع الأخبار كان إمامات وإما أعتقه. كذا في «المرقاة».

۲ قوله: إلا بغلته البيضاء: أي التي كان يختص بركوبها وسلاحه، أي الذي كان يختص بلبسه من نحو سيف ورمحودرع ومغفر وحربة. ولعل هذا الحصر إضافي مبني على عدم اعتبار أشياء أخر، مثل الأثواب وأمتعة البيت، وإلا فقد ثبت أنه ترك أثوابا وغيرها قد بينت في موضعها. ولعل حكمة سكوت الراوي عن ذكرها كونها محقرة بالنسبة للمذكورات. كذا في «المرقاة».

۳ قوله: وأرضا جعلها صدقة قال العسقلاني: أي تصدق بمنفعة الأرض فصار حكمها حكم الوقف والمعنى أنه جعلها في حياته صدقة جارية باقية إلى قيامها فيدوم ثواب الصدقة بدوامها فلا ينافي أن ما عداها من أملاكه بنفس الموت تصير صدقة كما لا يخفى. قال العلامة الكرماني في شرح البخاري: نصف أرض فدك وثلث أرض وادي القرى وسهمه من خمس خيبر وحصة من أرض بني النضير، وضمير جعلها راجع إلى كل الثلاثة لا إلى الأرض فقط؛ فإنه قال: نحن معاشر الأنبياء لا نورث ما تركناه صدقة. كذا في «المرقاة».

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «لَا يَقْتَسِمُ۱ وَرَثَتِي۲ دِينَارًا مَا تَرَكْتُ بَعْدَ نَفَقَةِ۳ نِسَائِي وَمَثُونَةِ عَامِلِي فَهُوَ صَدَقَةٌ». مُتَّفَقٌ عَلَيْهِ.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “My heirs will not divide 1 a dinar. Whatever I leave after the maintenance 3 of my wives and the expenses of my agent is charity.” [Agreed Upon]

3 His statement “after the maintenance of my wives and the expenses of my agent, it is charity”: In Sharh as-Sunnah, Sufyan ibn Uyaynah said: The Prophet’s wives were in the status of those in waiting, as they could never remarry, so maintenance was due to them. “My agent” refers to the caliph after him. The Prophet (ﷺ) took his family’s maintenance from the spoils allocated to him from Banu Nadir and Fadak, spending the rest on the Muslims’ welfare. Abu Bakr, then Umar, managed it similarly. A commentator from our scholars said: “After the maintenance of my wives,” because their maintenance after him depended on each wife’s lifetime, as they were restricted from remarriage for Allah and His Messenger, and the Prophet’s marriage bond remained effective during their lives, so maintenance was obligatory from the spoils’ wealth, like a wife’s maintenance from her husband. The point is that “maintenance of my wives” does not mean their inheritance, but because they were restricted from marriage due to him, they were like those in waiting as long as they lived. It is said: They had no waiting period, as he is alive in his grave, as are all prophets. (As stated in Al-Mirqat)

۱ قوله : لا تقتسم ورثتي دينارا بتأنيث الفعل ورفعه، فهو إخبار حقيقة، ومعناه ليس تقتسم ورثتي بعد موتي دينارا؛ إذ لست أخلف بعد موتي دينارا أملكه فيتقسمون ذلك. ويحتمل أن يكون إخبارا في الصورة ونهيا في المعنى، فهو أبلغ من النهي الصريح. كذا في «المرقاة».

۲ قوله : ورثتي : أي بالقوة وإلا فحيث لا قسمة فلا ورثة. قال ابن حجر : أي من يصلح ورثتي لو أمكنت. وقال ميرك هم وقته باعتبار أنهم كذلك بالقوة لكن منعوا من الميراث بالدليل الشرعي وهو وقوله: «لا نورث». ثم بين سببه وعلته مستأنفا: ما تركت ما موصولة مبتدأ وتركت صلته والعائد محذوف أي الذي تركته. بعد نفقة نسائي ومؤنة عاملي فهو صدقة والفاء لتضمين المبتدأ معنى الشر. كذا في «المرقاة».

۳ قوله: بعد نفقة نسائي ومؤنة عاملي فهو صدقة وفي شرح السنة: قال سفيان بن عيينة: كان أزواج النبي و في معنى المعتدات؛ إذ كن لا يجوز لهن أن ينكحن أبدا، فجرت لهن النفقة. وقوله: ومؤنة عاملي» أراد بالعامل الخليفة بعده، وكان النبي له يأخذ نفقة أهله من الصفايا التي كانت له من أموال بني النضير وفدك، ويصرف الباقي في مصالح المسلمين، ثم وليها أبو بكر ثم عمر كذلك. وقال شارح من علمائنا قوله: «بعد نفقة نسائي؛ لأن نفقة نسائه بعده كانت تتعلق بحياة كل واحدة منهن؛ لكونهن محبوسات عن النكاح في الله وفي رسوله وبقي حكم نكاح النبي باقيا مدة بقائهن، فوجب لهن النفقة من مال الفيء وجوب نفقة النساء على أزوجهن.

والحاصل أنه ليس معنى نفقة نسائه إرثهن منه، بل لكونهن محبوسات وممنوعات عن الأزواج بسببه، فهن في حكم المعتدات ما دامت حياتهن، وقيل: لا عدة عليهن؛ لأنه لة حي في قبره، وكذلك سائر الأنبياء. كذا في «المرقاة».

وَعَنْ أَبِي بَكْرٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَا نُوْرِثُ۱ مَا تَرَكْنَاهُ ۲ صَدَقَةٌ». مُتَّفَقٌ عَلَيْهِ.

وَعَنْ أَبِي مُوسَى (رضي الله عنه) أَنَّ النَّبِيَّ ﷺ أَنَّهُ قَالَ: إِنَّ اللَّهَ إِذَا أَرَادَ رَحْمَةً أُمَّةٍ مِنْ عِبَادِهِ قَبَضَ نَبِيَّهَا قَبْلَهَا ، فَجَعَلَهُ لَهَا فَرَطًا ۱ بَيْنَ يَدَيْهَا ، وَإِذَا أَرَادَ هَلَكَةً أُمَّةٍ عَذَّبَهَا وَنَبِيُّهَا حَيُّ، فَأَهْلَكَهَا وَهُوَ يَنْظُرُ، فَأَقَرَّ عَيْنَيْهِ بِهَلَكَتِهَا حِينَ كَذَّبُوهُ وَعَصَوْا أَمْرَهُ». رَوَاهُ مُسْلِمٌ.

English

Abu Musa (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “When Allah intends mercy for a nation among His servants, He takes their prophet before them, making him a forerunner 1 ahead of them. When He intends the destruction of a nation, He punishes it while their prophet is alive, destroying it as he watches, soothing his eyes with their destruction when they deny him and disobey his command.” [Narrated by Muslim]

وَعَنْ أَبِي هُرَيْرَةَ اللهِ قَالَ: قَالَ رَسُولُ اللهِ : وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ! لَيَأْتِيَنَّ عَلَى۱ أَحَدِكُمْ يَوْمٌ وَلَا يَرَانِي، ثُمَّ لَأَنْ يَرَانِي أَحَبُّ إِلَيْهِ مَنْ أَهْلِهِ وَمَالِهِ مَعَهُمْ». رَوَاهُ مُسْلِمٌ.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “By the One in Whose hand is Muhammad’s soul! A day will come upon 1 one of you when he will not see me, and seeing me will be dearer to him than his family and wealth combined.” [Narrated by Muslim]
