عَنْ أَبِي أَيُّوبَ الْأَنْصَارِيّ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ : «يَحِلُّ۱ لَا لِرَجُلٍ أَنْ يَهْجُرَ أَخَاهُ فَوْقَ ثَلَاثِ لَيَالٍ يَلْتَقِيَانِ، فَيُعْرِضُ هَذَا وَيُعْرِضُ هَذَا، وَخَيْرُهُمَا الَّذِي۲ يَبْدَأُ بِالسَّلَامِ». مُتَّفَقٌ عَلَيْهِ.

English

Abu Ayyub Al-Ansari (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “It is not lawful 1 for a man to abandon his brother for more than three nights: they meet, and this turns away and that turns away; the better of them is who 2 initiates the greeting.” [Agreed Upon]

1 His statement: “It is not lawful for a man to abandon his brother for more than three nights”: Akmal ad-Din from our imams said: The Hadith proves prohibiting abandoning a Muslim brother over three days. Permitting abandonment for three days is implied, not explicit. Who holds implied evidence like Shafi’is may say it is permissible; who does not, no. [As stated in Al-Mirqat] In Radd al-Muhtar, Qadi Khan said: Abandoning is prohibited if causing shortcoming in companionship, brotherhood, or interaction etiquette like backbiting or neglecting advice. For religion or doctrine, abandoning innovators and desirous is obligatory until repentance appears. [As stated in Al-Alamgiriyyah] 2 His statement: “the better of them is who initiates the greeting”: In Al-Mirqat, it implies one not initiating has no good, so abandoning him is permissible, obligatory as failing to return greeting makes him sinful.

۱ قوله : لا يحل لرجل أن يهجر أخاه فوق ثلاث ليال : وقال في المرقاة»: قال أكمل الدين من أئمتنا في الحديث دلالة على حرمة هجران الأخ المسلم فوق ثلاثة أيام، وأما جواز هجرانه في ثلاثة أيام فمفهوم منه، لا منطوق، فمن قال بحجية المفهوم كالشافعية جاز له أن يقول بإباحته، ومن لا فلا اهـ. وفيه أن الأصل في الأشياء الإباحة، والشارع إنما حرم المهاجرة المقيدة لا المطلقة، مع أن في إطلاقها حرجا عظيما، حيث يلزم منه أن مطلق الغضب المؤدي إلى مطلق الهجران يكون حراما اهـ. قال السيوطي والمراد حرمة الهجران إذا كان الباعث عليه وقوع تقصير في الصحبة والأخوة وآداب العشرة، كاغتياب وترك نصيحة. وأما ما كان من جهة الدين والمذهب فهجران أهل البدع والأهوماء واجب إلى وقت ظهور التوبة.

۲ قوله وخيرهما الذي يبدأ بالسلام قال في المرقاة: فيه إيماء على ان من لم يرده ليس فيه خيرا أصلا، فيجوز هجرانه، بل يجب لأنه بترك رد السلام صار فاسقا، وإنما يكون البادئ خيرهما لدلالة فعله على أنه أقرب إلى التواضع وأنسب إلى الصفاء وحسن الخلق. قال الأكمل: وفيه حث على إزانة الهجران، وأنه يزول بمجرد السلام.

وَعَنْ عَائِشَةَ (رضي الله عنها) أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «لَا يَكُونُ لِمُسْلِمٍ أَنْ يَهْجُرَ مُسْلِمًا فَوْقَ ثَلَاثَةٍ، فَإِذَا لَقِيَهُ سَلَّمَ عَلَيْهِ ثَلَاثَ مَرَّاتٍ كُلُّ ذَلِكَ لَا يَرُدُّ عَلَيْهِ فَقَدْ بَاءَ بِإِثْمِهِ». رَوَاهُ أَبُو دَاوُدَ.

English

Aishah (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) said: “It is not for a Muslim to abandon a Muslim over three, but if he meets him and greets three times without return, he bears the sin.” [Narrated by Abu Dawud]

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “It is not lawful for a believer to abandon a believer over three; if three pass, let him meet and greet him. If he returns the greeting, they share the reward; if not, he bears the sin, and the greeter exits abandonment.” [Narrated by Abu Dawud]

Abu Khirash As-Sulami (may Allah be pleased with him) narrated that he heard the Messenger of Allah (ﷺ) say: “Whoever abandons his brother for a year is like shedding his blood.” [Narrated by Abu Dawud]

وَعَنْ أَبِي ۱ هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: يُفْتَحُ أَبْوَابُ الْجَنَّةِ يَوْمَ الاثْنَيْنِ وَيَوْمَ الْخَمِيسِ، فَيُغْفَرُ لِكُلِّ عَبْدٍ لَا يُشْرِكُ بِاللَّهِ شَيْئًا إِلَّا رَجُلًا كَانَتْ بَيْنَهُ وَبَيْنَ أَخِيهِ شَحْنَاءُ ، فَيُقَالُ: أَنْظِرُوا هَذَيْنِ حَتَّى يَصْطَلِحَا». رَوَاهُ مُسْلِمٌ.

Abu Hurairah 1 (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Paradise’s gates open on Mondays and Thursdays; every servant not associating with Allah is forgiven except one with enmity between him and his brother. It is said: ‘Delay these two until they reconcile.’” [Narrated by Muslim]

وَعَنْ عَنْهُ قَالَ: قَالَ رَسُولُ اللهِ ﷺ : يُعْرَضُ أَعْمَالُ النَّاسِ فِي كُلِّ جُمُعَةٍ مَرَّتَيْنِ، يَوْمَ الِاثْنَيْنِ وَيَوْمَ الْخَمِيسِ، فَيُغْفَرُ لِكُلِّ عَبْدٍ مُؤْمِنٍ إِلَّا عَبْدًا بَيْنَهُ وَبَيْنَ أَخِيهِ شَحْنَاءُ، فَيُقَالُ: اتْرُكُوا هَذَيْنِ حَتَّى يَفِيئَا». رَوَاهُ مُسْلِمٌ.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “People’s deeds are presented every Monday and Thursday; every believing servant is forgiven except one with enmity between him and his brother. وَعَنْ عَائِشَةَ (رضي الله عنها) قَالَتْ: اعْتَلَّ بَعِيرٌ لِصَفِيَّةَ وَعِنْدَ زَيْنَبَ فَضْلُ ظَهْرٍ، فَقَالَ رَسُولُ اللهِ ﷺ لِزَيْنَبَ : أَعْطِيهَا بَعِيرًا ، فَقَالَتْ: أَنَا أُعْطِي تِلْكَ الْيَهُودِيَّةَ، فَغَضِبَ رَسُولُ الله ﷺ فَهَجَرَهَا ۱ ذَا الْحِجَّةِ وَالْمُحَرَّمَ وَبَعْضَ صَفَرٍ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Aishah (may Allah be pleased with her) narrated: Safiyyah’s camel became ill, and Zaynab had extra mounts. The Messenger of Allah (ﷺ) said to Zaynab: “Give her a camel.” She said: “I give that Jewess?” The Messenger of Allah (ﷺ) became angry and abandoned her 1 for Dhul-Hijjah, Muharram, and part of Safar. [Narrated by Abu Dawud]

وَعَنْ أَبِي هُرَيْرَةَ لله قَالَ: قَالَ رَسُولُ اللهِ : «إِيَّاكُمْ۱ وَالظَّنَّ؛ فَإِنَّ الظَّنَّ أَكْذَبُ الْحَدِيثِ، وَلَا تَحَسَّسُوا۲ وَلَا تَجَسَّسُوا ، وَلَا تَنَاجَشُوا ۳ وَلَا تَحَاسَدُوا ٤ وَلَا تَبَاغَضُوا ٥ وَلَا تَدَابَرُوا٦ وَكُونُوا ٧ عِبَادَ اللهِ إِخْوَانًا». وَفِي رِوَايَةٍ: «وَلَا تَنَافَسُوا۸ . مُتَّفَقٌ عَلَيْهِ.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Beware 1 of suspicion, for suspicion is the falsest speech. Do not spy 2 or search, do not outbid 3, envy 4, hate 5, or turn away 6 from each other. Be 7 servants of Allah as brothers.” In a narration: “Do not compete 8.” [Agreed Upon]

6 His statement: “Do not turn away”: Meaning, do not sever or turn backs from brothers or avert from them. From “back,” as severers turn backs. Some said: Meaning, do not backbite. [As stated in Al-Mirqat]

7 His statement: “Be servants of Allah as brothers”: Meaning, you are equal as Allah’s servants, one nation: envy, hatred, severing contradict your state. Obliged to treat as brothers in affection, mutual aid in righteousness, piety, advice in all good, sympathy. [As stated in Al-Mirqat]

8 His statement: “Do not compete”: Commentators said competition and envy are same in meaning, though different in origin. I say: Competition implies exaggeration leading to dispute: do not envy or dispute in base worldly matters; your competition should be in precious pleasing otherworldly things. ۱ قوله: إياكم والظن أي احذروا اتباع الظن في أمر الدين الذي مبناه على اليقين، أو اجتنبوا الظن في التحديث والإخبار، أو اتقوا سوء الظن بالمسلمين. التقطته من «المرقاة».

۲ قوله: ولا تحسسوا ولا تجسسوا : قال ابن الملك: أي لا تطلبوا التطلع على خير أحد ولا على شره، وكلاهما منهي عنه؛ لأنه لو اطلعت على خير أحد ربما يحصل لك حسد، بأن لا يكون ذلك الخير فيه، ولو اطلعت على شره تعيبه وتفضحه، وقد ورد طوبى لمن شغله عيبه عن عيوب الناس. كذا في «المرقاة».

۳ قوله: ولا تناجشوا قيل: المراد به طلب الترفع والعلو على الناس وهو المناسب لسابقه ولاحقه. وقيل: من النجش بمعنى التنفير، أي لا ينفر بعضكم بعضا بأن يسمعه كلاما ، أو يعمل شيئا يكون سبب نفرته. التقطته من «المرقاة».

٤ قوله: ولا تحاسدوا : أي لا يتمنى بعضكم زوال نعمة بعض، سواء أرادها لنفسه أو لا. كذا في «المرقاة»

٥ قوله: ولا تباغضوا والأظهر أن النهي عن التباغض تأكيد للأمر بالتحابب مطلقا، إلا ما يختل به الدين؛ فإنه لا يجوز حينئذ التحابب، ويجوز التباغض؛ لأن غرض الشارع اجتماع كلمة الأمة لقوله تعالى: ﴿وَاعْتَصِمُوا بِحَبْلِ اللهِ جَمِيعًا وَلَا تَفَرَّقُوا ) (آل عمران: ۱۰۳ ولا أن التحابب سبب الاجتماع، والتباغض موجب الافتراق، فالمعنى: لا يبغض بعضكم بعضا . وقال بعض المحققين: أي لا تشتغلوا بأسباب العداوة. كذا في «المرقاة».

٦ قوله: ولا تدابروا أي لا تقاطعوا، ولا تولوا ظهوركم عن إخوانكم، ولا تعرضوا عنهم. مأخوذ من الدبر؛ لأن كلا من المتقطعين يولي دبره صاحبه. وقيل : معناه لا تغتابوا. كذا في «المرقاة».

٧ قوله: كونوا عباد الله إخوانا والمعنى: أنتم مستوون في كونكم عبيد الله، وملتكم واحدة، والتحاسد والتباغض والتقاطع منافية لحالكم ، فالواجب أن تعاملوا معاملة الأخوة، والمعاشرة في المودة، والمعاونة على البر، والنصيحة بكل حسنة. كذا في «المرقاة».

۸ قوله: ولا تنافسوا : قال الشراح التنافس والتحاسد في المعنى واحد، وإن اختلفا في الأصل. قلت: لكن التنافس يفيد المبالغة التي قد تفضي إلى المنازعة، فالمعنى: لا تحاسدوا ولا تنازعوا في الأمور الخسيسة الدنيوية، بل ينبغي أن يكون تنافسكم في الأشياء النفيسة المرضية الأخروية. كذا في «المرقاة»..

وَعَنْهُ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : حُسْنُ ۱ الظَّنَّ مِنْ حُسْنِ الْعِبَادَةِ». رَوَاهُ أَحْمَدُ وَأَبُو دَاوُدَ.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Good suspicion is from good worship 1.” [Narrated by Ahmad and Abu Dawud]

1 His statement: “Good suspicion is from good worship”: Meaning, part of good worship is good suspicion. Advanced the predicate for emphasis; a seeker with good suspicion of Allah through hope worships well in solitude and public, hoping acceptance. Allah said: Those who believe, emigrate, and strive in Allah’s way hope for Allah’s mercy [Al-Baqarah: 218]. Or suspicion from good worship. [As stated in Al-Mirqat]

الحواشي

۱ قوله: حسن الظن من حسن العبادة المعنى بعض حسن العبادة حسن الظن، وقدم الخبر اهتماما؛ فإن السالك إذا أحسن الظن بالله على سبيل الرجاء حسن العبادة في الخلا والملأ، فيستحسن مأموله ويرجى قبوله. قال الله تعالى: ﴿إِنَّ الَّذِينَ ءَامَنُوا وَالَّذِينَ هَاجَرُوا وَجَاهَدُوا فِي سَبِيلِ اللهِ أُوْلَبِكَ يَرْجُونَ رَحْمَتَ اللَّهِ﴾ (البقرة: ۲۱۸). وأما من يترك العبادة ويدعي حسن الظن بالمعبود فهو مغرور ومخدوع ومردود ومثلهما الغزالي بمن زرع ومن لم يزرع راجين للحصاد، ولا شك أن الثاني ظاهر الفساد والله رؤف بالعباد. وقال المظهر: يعني اعتقاد الخير والصلاح في حق المسلمين عبادة. كذا في «المرقاة».

وَعَنْهُ (رضي الله عنه) ، قَالَ: قَالَ رَسُولُ اللهِ : رَأَى عِيسَى ابْنُ مَرْيَمَ رَجُلًا يَسْرِقُ، فَقَالَ لَهُ عِيسَى بْنُ مَرْيَمَ: سَرَقْتَ؟ قَالَ: كَلَّا، وَالَّذِي لَا إِلَهَ إِلَّا هُوَ، فَقَالَ عِيسَى: آمَنْتُ بِاللهِ وَكَذَّبْتُ نَفْسِي». رَوَاهُ مُسْلِمٌ.

English

Abu Hurairah (may Allah be pleased with him) narrated from the Prophet (ﷺ): Jesus son of Mary saw a man stealing. Jesus son of Mary said to him: “Did you steal?” He said: “No, by the One besides Whom there is no god.” Jesus said: “I believe in Allah and disbelieve my self.” [Narrated by Muslim]

وَعَنِ ابْنِ عُمَرَ (رضي الله عنها) قَالَ: صَعِدَ رَسُولُ اللهِ ﷺ الْمِنْبَرَ، فَنَادَى بِصَوْتٍ رَفِيعِ، فَقَالَ: يَا مَعْشَرَ مَنْ أَسْلَمَ بِلِسَانِهِ وَلَمْ يُفْضِ۱ الْإِيْمَانُ إِلَى قَلْبِهِ! لَا تُؤْذُوا الْمُسْلِمِينَ وَلَا تُعَيِّرُوهُمْ وَلَا تَتَّبِعُوا ۲ عَوْرَاتِهِمْ؛ فَإِنَّهُ مَنْ يَتَّبِعْ عَوْرَةَ أَخِيهِ الْمُسْلِمِ يَتَّبِعِ اللَّهُ عَوْرَتَهُ، وَمَنْ يَتَّبِعِ اللَّهُ عَوْرَتَهُ يَفْضَحْهُ وَلَوْ فِي جَوْفِ رَحْلِهِ». رَوَاهُ التَّرْمِذِيُّ.

English

Abdullah ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) ascended the pulpit and called loudly: “O group who submitted with tongues but faith has not reached hearts 1! Do not harm Muslims, reproach them, or follow 2 their faults; whoever follows his Muslim brother’s fault, Allah follows his fault. Whoever Allah follows his fault exposes him even in his home’s depths.” [Narrated by At-Tirmidhi]

1 His statement: “faith has not reached hearts”: Indicating without faith reaching heart, no knowledge of Allah, no fulfilling rights. If treating all heart diseases is knowledge of Allah, established in the book’s beginning: does not harm or hurt, reproach or spy conditions. [As stated in Al-Mirqat]

2 His statement: “do not follow their faults”: Al-Ghazali said: Spying and following stem from bad suspicion of a Muslim; heart not satisfied with suspicion seeks verification, leading to veil tearing and concealment breach: closing house door, concealing with walls; not permissible eavesdropping to hear lute sounds, entering to see sin, unless apparent outside like pipe sounds, drunkards’ familiar talk. ۲ قوله: ولا تتبعوا عوراتهم: قال الغزالي: التجسس والتتبع ثمرة سوء الظن بالمسلم، والقلب لا يقنع الظن ويطلب التحقيق، فيؤدي على هتك الستر وحد الاستتار : أن يغلق باب داره ويستتر بحيطانه، فلا يجوز استراق السمع على داره ليسمع صوت الأوتار، ولا الدخول عليه لرؤية المعصية، إلا أن يظهر بحيث يعرفه من هو خارج الدار، كأصواب المزامير، والسكارى بالمكلمات المألوفة بينهم، وكذلك إذا ستروا أواني الخمر وظروفها وآلات الملاهي في الكم وتحت الذيل، فإذا رأى ذلك لم يجز أن يكشف عنه، وكذلك لا يجوز أن يستنشق ليدرك رائحة الخمر، ولا أن يستخبر من جيرانه ليخبروه بما يجري في داره. كذا في «المرقاة».

۱ قوله : فإن الحسد تأكل الحسنات إلخ : قال القاضي تمسك به من يرى إحباط الطاعات بالمعاصي كالمعتزلة. وأجيب عنه بأن المعنى أن الحسد يذهب حسنات الحاسد ويتلفه عليه، بأن يحمله على أن يفعل بالمحسود من إتلاف مال وهتك عرض وقصد نفس ما يقتضي صرف تلك الحسنات بأسرها في عرضه، كما روي في صحاح «باب الظلم عن أبي هريرة أنه قال: إن المفلس من أمتي من يأتي يوم القيامة بصلاة وزكاة وصيام وقيام ويأتي قد شتم هذا وقذف هذا وأكل مال هذا وسفك دم هذا وضرب هذا فعطى هذا من حسناته وهذا من حسناته فإن فنيت حسناته قبل أن يقضى ما عليه أخذ من خطاياهم فطرحت عليه ثم طرح في النار. لإحباط الطاعات بالمعاصي، وإلا لم يكن يبقى لهذا الآتي المتعاطي لتلك الكبائر حسنة، يقضي بها حق خصمه، انتهى كلامه. وهذا أحد الوجهين مما ذكره التوربشتي. والوجه الآخر له أن يقال: إن التضعيف في الحسنات يوجد على حسب استعداد العبد وصلاحه في دينه، فمهما كان مرتكبا للخطايا نقص من ثواب عمله فيما يتعلق بالتضعيف ما يوازي انحطاطه في المرتبة بما اجترحه من الخطايا، مثل أن يقدر أن ذا رهق عمل حسن، فأثيب عليها عشر، أو لو لم يكن رهقه لا يثب أضعاف ذلك. فهذا الذي نقص من التضعيف بسبب ما ارتكبه من الذنب، هو المراد من الإحباط. كذا في «المرقاة».

Al-Mustawrid (may Allah be pleased with him) narrated from the Prophet (ﷺ): “Whoever 1 consumes from a Muslim a meal, Allah feeds him like it from Hell. Whoever 2 is clothed from a Muslim, Allah clothes him like it from Hell. Whoever 3 attains a position from a man for reputation and show, Allah attains him a position for reputation and show on the Day of Resurrection.” [Narrated by Abu Dawud]

۳ قوله : ومن قام برجل مقام سمعة إلخ : ذكروا لهذه العبارة معنيين، أحدهما : أن الباء للتعدية أي من أقام رجلا مقام سمعة ورياء ووصفه بالصلاة والتقوى والكرامات و شهره بها، وجعله وسيلة إلى تحصيل أغراض نفسه وحطام الدنيا فإن الله يقوم له أي بعذابه وتشهيره أنه كان كذابا. وثانيهما: أن الباء للملابسة. وقيل: وهو أقوى وأنسب، أي من قام بسبب رجل من العظماء من أهل المال والجاه مقاما يتظاهر فيه بالصلاح والتقوى؛ ليعتقد فيه، ويصير غليه المال والجاه، أقامه الله مقام المراثين ويفضحه ويعذب عذاب المرائين. كذا في «المرقاة».

وَعَنْ أُمَّ كُلْثُومٍ بِنْتِ عُقْبَةَ بْنِ أَبِي مُعَيْطٍ (رضي الله عنها) قَالَتْ: سَمِعْتُ رَسُوْلَ اللهِ ﷺ يَقُوْلُ: «لَيْسَ الْكَذَّابُ الَّذِي يُصْلِحُ بَيْنَ النَّاسِ وَ يَقُوْلُ خَيْرًا وَيَنْمِي خَيْرًا». مُتَّفَقٌ عَلَيْهِ،

وَزَادَ مُسْلِمُ: قَالَتْ: وَلَمْ أَسْمَعْهُ تَعْنِي۱ النَّبِيَّ لا يُرَخّصُ فِي شَيْءٍ مِمَّا يَقُوْلُ النَّاسُ إِلَّا فِي ثَلَاثٍ: الْحَرْبُ وَالْإِصْلَاحُ بَيْنَ النَّاسِ وَحَدِيثُ الرَّجُلِ امْرَأَتَهُ وَحَدِيْثُ الْمَرْأَةِ زَوْجَهَا.

Umm Kulthum bint Uqbah ibn Abi Mu’ayt (may Allah be pleased with her) narrated: I heard the Messenger of Allah (ﷺ) say: “The liar is not who reconciles between people, speaking good or promoting good.” [Agreed Upon] Muslim added: She said: “I did not hear him 1, meaning the Prophet (ﷺ), permit anything people say except three: war, reconciling between people, and a man’s speech to his wife, a woman’s to her husband.”

Lying permitted for reconciliation or repelling oppressor,

Pleasing wife or war to triumph.

Supports some moderate Hadiths excepting four. Qadi Khan said: Lying to save Muslim blood or strengthen weak Muslim is permitted. [As stated in Ad-Durr al-Mukhtar and Radd al-Muhtar]

Asma bint Yazid (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) said: “Lying is not lawful except in three: a man lying to his wife to please her, lying in war, and lying to reconcile between people.” [Narrated by Ahmad and At-Tirmidhi]
