بَابُ الْبَيَانِ وَالشَّعْرِ وَالتَّغَنِّيEloquence, Poetry, and Singing
وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿ يَاأَيُّهَا الَّذِينَ آمَنُوا لِمَ تَقُولُونَ مَا لَا تَفْعَلُونَ 2 كَبُرَ مَقْتًا عِنْدَ اللَّهِ أَنْ تَقُولُوا مَا لَا تَفْعَلُونَ 3﴾ (الصف: ۲-۳)
وَقَوْلِ اللَّهِ تَعَالَى: ﴿ وَالشُّعَرَاءُ يَتَّبِعُهُمُ الْغَاوُونَ 224 أَلَمْ تَرَ أَنَّهُمْ فِي كُلِّ وَادٍ يَهِيمُونَ 225 وَأَنَّهُمْ يَقُولُونَ مَا لَا يَفْعَلُونَ 226 إِلَّا الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ وَذَكَرُوا اللَّهَ كَثِيرًا وَانْتَصَرُوا مِنْ بَعْدِ مَا ظُلِمُوا وَسَيَعْلَمُ الَّذِينَ ظَلَمُوا أَيَّ مُنْقَلَبٍ يَنْقَلِبُونَ 227 ﴾ (الشعراء: ٢٢٤-٢٢٧)
وَقَوْلِهِ تَعَالَى: ﴿وَمِنَ۱ النَّاسِ مَنْ يَشْتَرِي لَهْوَ الْحَدِيثِ لِيُضِلَّ عَنْ سَبِيلِ اللَّهِ بِغَيْرِ عِلْمٍ وَيَتَّخِذَهَا هُزُوًا أُولَئِكَ لَهُمْ عَذَابٌ مُهِينٌ 6﴾ (لقمان: ٦
۱ قوله: ومن الناس من يشتري لهوا الحديث إلخ فيها مسألة حرمة التغني، اعلم أن مسائل الغناء أكبر المسائل المختلف فيها، وقد تعارضت الآيات والأحاديث الدالة على إباحته وحرمته، وكثرت فيه أقاويل العلماء وآراء الصلحاء، ونحن نسمعك أولا الحجج المتعارضة، ثم نذكر ما هو الحق الحقيق، فنقول: من الآيات الدالة على حرمته الآية المذكورة، وإنها نزلت في النضر بن الحارث اشترى كتب الأعاجم، وكان يحدث بها قريشا، ويقول: إن كان محمد يحدثكم بحديث عاد وثمود فأنا أحدثكم بحديث رستم وأسفنديار والأكاسرة. وقيل: كان يشتري الفتيات المغنيات ويحملُهُنَّ على مُعاشرة من أراد الإسلام، ويقول: هذا خير مما يدعوك إليه محمد، هكذا في «الكشاف» و «البيضاوي».
وفي رواية الإمام الزاهد أيضًا أنها نزلت في الوليد بن المغيرة ويشتري إما بمعنى الشراء كما علمت أو بمعنى الاختيار، و«الحديث» إن كان هو الحديث المنكر فإضافة اللهو إليه بيانية، وإن كان أعم منه فالإضافة بمعنى «من» التبعيضية، ويضل» قُرِئَ بالضم والفتح بمعنى المضل والضال جميعًا، وكذا يتخذ» قُرِئَ منصوبا عطفا على «يضل». ومرفوعا عطفا على يشتري».
وإنما قلنا: إنه يدل على حرمة الغناء؛ لأن الله تعالى قد ذم من يشتغل بلهو الحديث، وأوعده بالعذاب المهين ولهو الحديث وإن كان ظاهره عاما في كل ما يلهي عما يعني، كالأحاديث التي لا أصل لها، والأساطير التي لا اعتبار لها، والمضاحيك وفضول الكلام على ما هو رأي أكثر المفسرين، ويوافقه الرواية الأولى من النزول إلا أنه قد ذكر في الفتاوى الحمادية وكذا في «العوارف وغيره أن ابن عباس وابن مسعود الله كانا يحلفان بالله إنا قد سمعنا عن رسول الله ﷺ أن المراد به التغني، ويوافقه الرواية الثانية من النزول، فيكون دليلا على حرمته، ومنها : ما ذكر في آخر سورة النجم، وهي قوله تعالى: ﴿ وَأَنْتُمْ سٰمِدُونَ 61﴾ (النجم : ٦١) فإنه ذكر في «البيضاوي»: أن المراد به وأنتم مغنون.
وفي «العوارف»: أن عبد الله بن عباس حلف أن المراد به التغني، ومنها ما ذكر في سورة بني إسرائيل هو قوله تعالى: ﴿وَاسْتَفْزِزْ مَنِ اسْتَطَعْتَ مِنْهُم بِصَوْتِكَ ﴾ (الإسراء : ٦٤)؛ فإنه أيضًا ذكر في الفتاوى الحمادية» و«العوارف» أنه قال مجاهد: إنها تدل على حرمه التغني، وذلك لأن قوله: ﴿وَاسْتَفْزِزْ﴾ خطاب لإبليس عليه اللعنة، ومعناه: وحرك من استطعت من بني آدم بصوتك، وهو صوت التغني والمزامير والدف وغير ذلك، فهذه الآيات الثلاث دالة على حرمته مطلقا، والأحاديث الصحاح المعتبرة الدالة على حرمته أكثر من أن يعد ويحصى، وأكثرها مذكور في «العوارف».
وكتب الفتاوى مملوؤة من ذلك، منها ما ذكرته في آخر هذا الباب نقلا عن المشكاة». ومنها: ما نقل أنه لما مات ابن رسول الله له طاهر بكت عيناه، فقال عبد الرحمن بن عوف: أليس يا رسول الله قد نهيتنا عن البكاء؟ فقال: «إنما نهيتكم عن صوتتين فاجرين أحمقين: صوت النوحة وصوت الغناء . وقال رسول الله ﷺ : «كان إبليس أول من ناح وأول من تغنى . وقال رسول الله ﷺ : التغني حرام، والتلذذ بها كفر، والجلوس عليها فسق ومعصية». وقال النبي ﷺ: ما من رجل يرفع صوته بالغناء إلا بعث الله عليه شيطانين: أحدهما على هذا المنكب، والآخر على هذا المنكب، ولا يزالان يضربان بأرجلهما حتى يكون هو الذي يسكت». وهذه الحجج كلها دالة على حرمته مطلقا.
ومن الحجج الدالة على إباحته ما ذكر في «العوارف»: فمن الآيات قوله تعالى: ﴿وَإِذَا سَمِعُوا مَا أُنزِلَ إِلَى الرَّسُولِ تَرَى أَعْيُنَهُمْ تَفِيضُ مِنَ الدَّمْعِ مِمَّا عَرَفُوا مِنَ الْحَقِّ (المائدة: ۸۳ وقوله تعالى: ﴿فَبَشِّرْ عِبَادِ الَّذِينَ يَسْتَمِعُونَ الْقَوْلَ فَيَتَّبِعُونَ أَحْسَنَهُ ﴾ (الزمر: (۱۷-۱۸) وقوله تعالى: ﴿تَقْشَعِرُّ مِنْهُ جُلُودُ الَّذِينَ يَخْشَوْنَ رَبَّهُمْ ثُمَّ تَلِينُ جُلُودُهُمْ وَقُلُوبُهُمْ إِلَى ذِكْرِ اللَّهِ ﴾ (الزمر: ۲۳، فإن هذه الآيات دالة على استماع القول والبكاء فيه واقشعرار الجلد منه، ولا يخفى ضعفه.
قال صاحب «العوارف»: وهذا جملة لا ينكر، ولا اختلاف فيها، وإنما الاختلاف في سماع الأشعار بالإلحان، وقد كثرت الأقوال في ذلك وتباينت الأحوال، ومن الأحاديث ما قال: أخبرنا الشيخ الطاهر بن أبي الفضل عن أبيه الحافظ المقدسي قال : أخبرنا أبو بكر القاسم الحسن بن محمد الخولاني قال: حدثنا أبو محمد عبد الله بن يوسف قال: حدثنا أبو بكر بن وثاب قال: حدثنا عمر بن الخطاب قال: حدثنا الأوزاعي عن الزهري عن عروة عن عائشة : أن أبا بكر دخل عليها، وعندها جاريتان تغنيان وتضربان بدفين ورسول الله الله مسجى بثوبه، فانتهرهما أبو بكر فكشف رسول الله ﷺ عن وجهه. وقال: «دعهما يا أبا بكر، فإنها أيام عيد».
وفيه أيضًا: وروت عائشة قالت: كان عندي جارية تغني، فدخل رسول الله له وهي على حالها، ثم دخل عمر فَفَرَتْ، فضحك رسول الله ، فقال عمر : ما يُضحكك يا رسول الله ؟ فحدثه حديث الجارية، فقال: لا أبرححتى أسمع ما سمع رسول الله ، فأمرها رسول الله له فأسمعته، وفيه أيضًا قالت عائشة : رأيت رسول الله وسترني بردائه وأنا أنظر إلى الحبشة يلعبون في المسجد حتى أكون أنا أسأم، وفيه أيضًا قال: أخبرنا أبو زرعة طاهر عن والده أبي فضل الحافظ المقدسي قال: أخبرنا أبو منصور محمد بن عبد الملك الظفري السركسي، قال: أخبرنا أبو علي فضل بن منصور بن نصر الكاغذي السمرقندي إجازة قال: حدثنا الهيثم عن كليب، قال: حدثنا أبو بكر عمار بن إسحاق قال: قد حدثنا سعد بن عامر عن شعبة عن عبد العزيز بن صهيب عن أنس له قال: كنا عند رسول الله إذ نزل جبيريل ، فقال : يا رسول الله إن فقراء أمتك يدخلون الجنة قبل الأغنياء بنصف يوم وهو خمس مائة ففرح رسول الله ﷺ ، فقال : أفيكم من ينشدنا ؟ قال : بدوي، نعم، أنا يا رسول الله، قال: هات، فأنشد البدوي شعرا:
قد لَسَعَتْ حَيَّةُ الْهَوَى كَبِدِي ....... إلا الحبيب الذي شُغِفْتُ به
فلا طبيب لها ولا راق .................. فعنده رقيتي وترياقي
فتواجد رسول الله ﷺ وتواجد الأصحاب معه حتى سقط رداءه عن منكبيه، فلما فرغوا آوى كل واحد منهم مكانه. قال معاوية بن أبي سفيان ما أحسن لعبكم يا رسول الله، فقال: يا معاية ليس بكريم من لم يهتز عند سماع ذكر الحبيب، ثم قسم ردائه رسول الله الله على من حاضرهم بأربع مائة قطعة. وهذا الحديث أوردناه مسندا كما سمعناه ووجدناه، وقد تكلم في صحته أصحاب الحديث، وما وجدنا شيئًا نقل عن رسول الله و يشاكل وجد أهل الزمان وسماعهم واجتماعهم إلا هذا، وما أحسن حجة الصوفية وأهل الزمان في سماعهم وتمزيقهم الخرق وقسمتها إن لو صح والله أعلم بذلك وتخالج سرى أنه غير صحيح، ولم أجد فيه ذوق اجتماع النبي ﷺ مع أصحابه يعتمدونه على ما بلغنا في هذا الحديث ويأبى القلب قبوله، والله أعلم وأحكم بذلك.
هذه عبارة «العوارف بعينها، فهذه الححج كلها دالة على إباحته؛ إذ أدنى منازل فعل الرسول ﷺ وقوله أن يكون مباحا، فتعارضت الأخبار الدالة على إباحته وحرمته ظاهرا، والتاريخ مجهول، وإذا نظرت إلى ضابطتي الأصول يوجب حرمته، أحدهما: أنه إذا تعارض المبيح والمحرم كان العمل بالمحرم أولى ثانيهما: أنه إذا وقع التعارض بين السنتين وجب المصير إلى قول الصحابة .. وههنا قول الصحابة دال على حرمته مطلقا حيث قال عثمان : ما تغنيت ولا تمنيت ولا مسست ذكري بيميني منذ بايعت رسول الله ﷺ. وقال عبد الله بن مسعود الله: الغناء ينبت النفاق في القلب، وروي أن ابن عمر مر عليه قوم محرومون وفيهم رجل يتغنى، فقال: ألا لا سمع الله لكم، ثم ألا لا سمع الله لكم.
والتابعون وتبعهم كانوا أيضًا قائلين حرمته، كما قال بعضهم: إياكم والغناء؛ فإنه يزيد الشهوة ويهدم المروءة، وإنه ينوب عن الخمر ويفعل السكر. وقال فضيل بن العياض : الغناء رقية الزناء، وعن الضحاك : الغناء مفسدة للقلب ومسخطة للرب. والأئمة الأربعة الكرام كانوا أيضًا ممن ينكرونه، وهكذا ذكر في «العوارف حيث قال: وقد نقل عن الشافعي أنه قال في كتاب القضاء الغناء لهو مكروه يشبه الباطل. وقال: من استكثر منه فهو سفيه ترد شهادته، وعند مالك إذا اشترى جارية فوجدها مغنة فله أن يردها بالعيب، وهكذا مذهب الإمام الأعظم أبي حنيفة أن سماع الغناء من الذنوب. وما أباحه إلا نفر قليل من الفقهاء، ومن أباحه من الفقهاء أيضًا لم ير إعلانه في المساجد والبقاع الشريفة هذ كلامه.
وأيضًا قد اشتهر أن أبا حنيفة الله دعي يوما إلى الوليمة فوجد ثمة لعبا وغناء، وكان غير مقتدى حينئذ فصبر عليه، ولما سئل عنها بعد ذلك قال : ابتليت بهذا مرة فصبرت فقوله: «ابتليت دال على حرمته مطلقا؛ لأن الابتلاء إنما يكون بالمحرم، وهكذا اتفق على حرمته مطلقًا كثير من المجتهدين حتى بلغ أعدادهم إلى خمس أو اثنين وسبعين مجتهدا، جمعت أقوالهم كلها في رسالة، فمن أراد الإطلاع عليها فليرجع إليها. علماء الشريعة الغراء أكثرهم كانوا متفقين على مطلق الحرمة، ثم فرق فريق بوجه تطبيق، فذكر شيخ الشيوخ في «العوارف»: فأما الدف والشانة وإن كان في مذهب الشافعي فيها فسحة، فالأولى تركها، وأما غير ذلك فإن كان من القصائد في ذكر الجنة والنار والتشويق إلى دار القرار ووصف نِعَمِ الملك الجبار، وذكر العبادات والترغيب في الخيرات، فلا سبيل إلى الإنكار.
ومن ذلك القبيل قصائد الغزاة والحجاج في وصف الغزو والحج مما يثير كَامِنُ العزم من الغازي وساكن الشوق من الحجاج، وأما ما كان فيه ذكر القدود والخدود ووصف النساء فلا يليق بأهل الديانات الاجتماع المثل ذلك، وأما ما كان من ذكر الهجر والوصال والقطيعة والقرب مما يقرب حمله على أمر الحق سبحانه وتعالى من تلون أحوال المريدين ودخول الآفات على الطالبين، فمن سمع ذلك وحدث عليه ندم على ما فات أو تجدد عنده عزم لما هو آت، فكيف ينكر سماعه.
هذا كلامه، وذكر آخرون وجها آخر لتطبيقه، فجوزه بعضهم ومنهم الإمام الغزالي للأهل، وفسر الأهل بمن كان قلبه حيا ونفسه ميتا، ولا يكون صاحب الهواء، ولا يصرفه إلى خلاف الحق، واشترطوا أن يكون المغني أيضًا أهلا، ولا يكون نيته أخذ الأجرة، ولا الرياء والسمعة، ولا يحضر في المجلس غير الأهل وأمثاله، وعليه أكثر المتأخرين، وبه نأخذ ؛ لأنا شاهدنا أنه نشأ من قوم كانوا عارفين بالله ومحبين لرسول الله متبعين لشرائعه وأحكامه، وهم أهل كرامات ظاهرة وخوارق عادات باهرة، وكانوا معذورين لغلبة الحال ويستكثرون السماع للغناء، ويشوقون بها إلى تجليات الحق سبحانه وتعالى، وكانوا يحسبون ذلك عبادة أعظم وجها وأكبر، ولم يحضرهم حين السماع ذمي، ولا فاسق، ولا أمرد، ولا نسوة، ويقيمون آدابه كآداب سائر العبادات، فيحل لهم خاصة. وأما ما رسمه أهل زماننا من أنهم يهيئون المجالس، ويرتكبون فيها بالشرب والفواحش، ويجمعون الفساق والأمارد، ويطلبون الغنين والطوائف ويسمعون منهم الغناء، ويتلذذون بها كثير من الهواء النفسانية والخرافات الشيطانية، ويحمدون على المغنين بإعطاء النعم العظيم ويشكرون عليهم بالإحسان العميم، فلا شك أن ذلك ذنب كبير، واستحلاله كفر قطعا ويقينا؛ لأنه عين لهو الحديث في شأنهم بخلاف أولياء الحق؛ فإنه لم يبق حديث لهو في شأنهم، بل يكون ذلك وسيلة لرفع درجاتهم، ونيل كمالاتهم.
ولعل في ذكره تعالى لهو الحديث دون التغني، وكذا في ذكر من التبعيضية ولام» الغاية إشارة إلى هذه التفرقة، ولهذا لا ينبغي أن يفتى بجوازه للأهل في زماننا؛ لأنه قد بلغ من فساد الزمان إلى حيث يدعي كل واحد أني أهله، بل إنما نقول بجوازه للأهل بعد أن صدر من الأجلاء العظام والأولياء الكرام؛ لئلا يلزم منهم ارتكاب الذنوب والآثام، وحاش الله من ذلك على أن أكثر الأولياء أيضًا لم يبتلوا بذلك ولم يحسنوه، وقد صح أن جنيدا لله تاب عن السماع في زمانه مع تلك المعرفة والحال، فما بال غيره، فالأولى هو الترك؛ دفعا للتهمة والعناد، غاية ما في الباب أنه إذا كانت نيته صالحة وسمع حينئذ أو يغني بنغمة؛ دفعا للوحشة لم يعاتب فيما بينه وبين الله تعالى. وهذا الذي جرى منا إنما جرى بقطع النظر عن شائبة التعصب والطغيان، ومن غير إفراط وتفريط، والله أعلم، هذا كله في التفسيرات الأحمدية».
And the saying of Allah, the Mighty and Majestic: "O you who believe, why do you say what you do not do? Most hateful is it in the sight of Allah that you say what you do not do" (As-Saff: 2-3).
And the saying of Allah, the Exalted: "And the poets, the deviators follow them. Do you not see that they wander in every valley, and that they say what they do not do? Except those who believe and do righteous deeds and remember Allah much, and vindicate themselves after they have been wronged. And those who do wrong will come to know what overturning they will be overturned" (Ash-Shu'ara: 224-227).
And His saying, the Exalted: "And among 1 the people is he who buys the diversion of discourse to lead astray from the way of Allah without knowledge, and takes it in mockery; those will have a humiliating punishment" (Luqman: 6).
1 His saying "and among the people is he who buys the diversion of discourse", to the end: in it lies the question of the prohibition of singing. Know that the questions of singing are among the greatest of the disputed questions; the verses and hadiths indicating its permissibility and its prohibition stand in apparent opposition, and the sayings of the scholars and the views of the righteous concerning it are many. We shall first let you hear the opposing proofs, then state what is the established truth.
We say: among the verses indicating its prohibition is the verse cited, which was sent down concerning al-Nadr ibn al-Harith, who bought the books of the Persians and would recite them to Quraysh, saying: if Muhammad recounts to you the stories of Aad and Thamud, I recount to you the stories of Rustam, Isfandiyar and the Chosroes. And it is said: he used to buy singing slave-girls and set them to entertain whoever inclined to Islam, saying: this is better than that to which Muhammad calls you. Thus in al-Kashshaf and al-Baydawi. In the transmission of al-Imam al-Zahid it was also sent down concerning al-Walid ibn al-Mughira. "Buys" is either in the sense of purchase, as you have learnt, or in the sense of choosing; "discourse", if it means blameworthy discourse, then the annexation of "diversion" to it is explicative, and if it is more general, the annexation has the sense of the partitive "of". "To lead astray" has been read with damma and with fatha, in the senses of one who misleads and one who strays alike; likewise "takes it" has been read in the accusative, joined to "lead astray", and in the nominative, joined to "buys".
We say it indicates the prohibition of singing because Allah Most High has censured whoever occupies himself with the diversion of discourse and threatened him with the humiliating punishment. Although its outward sense is general, covering everything that diverts from what concerns one, such as baseless tales, legends of no account, buffooneries and excess of talk, according to the view of most commentators, agreeing with the first account of its revelation, yet it is recorded in al-Fatawa al-Hammadiyya, and likewise in al-Awarif and elsewhere, that Ibn Abbas and Ibn Mas'ud used to swear by Allah that they had heard from the Messenger of Allah ﷺ that what is meant by it is singing, agreeing with the second account of the revelation, so it is a proof of its prohibition. Among them also is what is mentioned at the end of Surat an-Najm, His saying, the Exalted, "while you amuse yourselves" (An-Najm: 61), for it is mentioned in al-Baydawi that its meaning is "while you sing"; and in al-Awarif that Abdullah ibn Abbas swore that what is meant by it is singing. Among them is what is mentioned in Surat Bani Isra'il, His saying, the Exalted, "and incite whom you can of them with your voice" (Al-Isra: 64), for it is likewise recorded in al-Fatawa al-Hammadiyya and al-Awarif that Mujahid said it indicates the prohibition of singing; for "incite" is an address to Iblis, upon whom be the curse, and its meaning is: stir whom you can of the children of Adam with your voice, which is the voice of singing, of pipes, of the drum and the rest. So these three verses indicate its prohibition absolutely; and the sound, weighty hadiths indicating its prohibition are more than can be counted or reckoned, most of them recorded in al-Awarif, and the books of fatawa are full of them, among them what I have cited at the end of this chapter from the Mishkat. Among them is what is related that when the son of the Messenger of Allah ﷺ, Tahir, died, his eyes wept, and Abd al-Rahman ibn Awf said: O Messenger of Allah, did you not forbid us to weep? He said: "I only forbade you two corrupt, foolish voices: the voice of wailing and the voice of singing." And the Messenger of Allah ﷺ said: "Iblis was the first to wail and the first to sing." And the Messenger of Allah ﷺ said: "Singing is prohibited, taking pleasure in it is ingratitude, and sitting for it is corruption and disobedience." And the Prophet ﷺ said: "No man raises his voice in song but Allah sends upon him two devils, one on this shoulder and one on that, and they keep striking with their heels until he is the one who falls silent." All these proofs indicate its prohibition absolutely.
Among the proofs indicating its permissibility is what is mentioned in al-Awarif: from the verses, His saying, the Exalted: "And when they hear what has been sent down to the Messenger, you see their eyes overflow with tears because of what they have recognized of the truth" (Al-Ma'idah: 83); and His saying, the Exalted: "So give good tidings to My servants who listen to the word and follow the best of it" (Az-Zumar: 17-18); and His saying, the Exalted: "The skins of those who fear their Lord shiver at it; then their skins and their hearts soften to the remembrance of Allah" (Az-Zumar: 23). These verses indicate listening to speech, weeping at it and the shivering of the skin at it; and its weakness is not hidden. The author of al-Awarif said: this, as a whole, is not denied, and there is no disagreement about it; the disagreement is only about listening to poems with melodies, and the sayings on that have multiplied and the states have diverged. From the hadiths is what he related with his chain from Aisha: that Abu Bakr came in to her while two slave-girls were with her singing and beating two tambourines, and the Messenger of Allah ﷺ was covered with his garment; Abu Bakr rebuked them, and the Messenger of Allah ﷺ uncovered his face and said: "Leave them, O Abu Bakr, for these are days of festival." In it also: Aisha related: I had a slave-girl who sang; the Messenger of Allah ﷺ came in while she was so engaged, then Umar came in and she fled; the Messenger of Allah ﷺ laughed, and Umar said: what makes you laugh, O Messenger of Allah? So he told him the story of the girl, and Umar said: I shall not stir until I hear what the Messenger of Allah ﷺ heard; so the Messenger of Allah ﷺ ordered her and she let him hear. In it also Aisha said: I saw the Messenger of Allah ﷺ screening me with his cloak while I watched the Abyssinians playing in the mosque, until it was I who wearied. In it also, with his chain from Anas: we were with the Messenger of Allah ﷺ when Jibril came down and said: O Messenger of Allah, the poor of your community will enter Paradise before the rich by half a day, which is five hundred years; and the Messenger of Allah ﷺ rejoiced and said: is there any among you who will recite for us? A bedouin said: yes, I, O Messenger of Allah. He said: come forth; and the bedouin recited verses: "The serpent of passion has stung my liver; there is no physician for it and no charmer, save the beloved with whom I am enraptured; with him is my charm and my antidote." The Messenger of Allah ﷺ was moved to ecstasy, and the Companions with him, until his cloak fell from his shoulders; when they finished, each retired to his place. Mu'awiya ibn Abi Sufyan said: how fine is your play, O Messenger of Allah! He said: "O Mu'awiya, he is no noble man who is not stirred at hearing mention of the Beloved." Then the Messenger of Allah ﷺ divided his cloak among those present in four hundred pieces. This hadith we have cited with its chain as we heard and found it; the masters of hadith have questioned its soundness, and we have found nothing transmitted from the Messenger of Allah ﷺ that resembles the ecstasy of the people of this age, their listening and their gatherings, except this; and how fine an argument it would be for the Sufis and the people of the age in their listening and their tearing of garments and dividing them, if only it were sound. And Allah knows best; my inmost self stirs with the sense that it is not sound; the heart refuses to accept it. This is the very wording of al-Awarif.
So all these proofs indicate its permissibility, since the least station of the Messenger's deed and word ﷺ is permissibility. Thus the reports indicating permissibility and prohibition stand in apparent opposition, and their dating is unknown. And when you look to the two rules of usul, it requires its prohibition: the first, that when the permitting and the prohibiting conflict, acting on the prohibiting has priority; the second, that when opposition occurs between two sunnahs, recourse must be had to the saying of the Companions. And here the saying of the Companions indicates its prohibition absolutely, for Uthman said: I have not sung, nor wished, nor touched my member with my right hand since I pledged allegiance to the Messenger of Allah ﷺ. And Abdullah ibn Mas'ud said: singing makes hypocrisy sprout in the heart. And it is related that a company passed by Ibn Umar among whom was a man singing, and he said: ha! may Allah not hear you; ha! may Allah not hear you. The Successors and those after them likewise held its prohibition, as one of them said: beware of singing, for it increases appetite and demolishes manliness, and it stands in for wine and works what intoxication works. Fudayl ibn Iyad said: singing is the charm of fornication. And from al-Dahhak: singing corrupts the heart and angers the Lord. The four noble Imams were likewise among those who censured it; so it is recorded in al-Awarif, where he said: it is transmitted from al-Shafi'i that he said in the book of judgeship: singing is a disliked diversion resembling the false; and he said: whoever takes much of it is a fool whose testimony is rejected. With Malik, if a man buys a slave-girl and finds her a singer, he may return her for the defect. And such is the school of the Greatest Imam Abu Hanifa, that listening to singing is among the sins. None permitted it save a small band of the jurists; and those of the jurists who did permit it did not sanction its public performance in the mosques and the noble places; this is his wording. It is also well known that Abu Hanifa was once invited to a wedding feast and found there play and singing, and being not yet one who was followed, he bore it patiently; asked about it afterwards he said: I was tried by this once, and I bore patiently. His saying "I was tried" indicates its prohibition absolutely, for trial is only by the prohibited. Likewise many mujtahids have agreed on its absolute prohibition, until their number has reached seventy-two; I have gathered all their sayings in a treatise, and whoever wishes to see them may refer to it.
The scholars of the radiant Shariah were mostly agreed on absolute prohibition; then one party drew a reconciling distinction. The Shaykh of Shaykhs said in al-Awarif: as for the tambourine and the reed, though in the school of al-Shafi'i there is latitude in them, leaving them is preferable. As for other than that: whatever consists of odes on the mention of Paradise and the Fire, the awakening of longing for the abode of permanence, the description of the favours of the Compelling King, the mention of acts of worship and the encouragement of good works, there is no way to censure it. Of that kind are the odes of warriors and pilgrims describing battle and pilgrimage, which rouse the dormant resolve of the warrior and the still longing of the pilgrims. As for what contains mention of figures and cheeks and the description of women, it does not befit the people of religion to gather over its like. As for what mentions separation and union, estrangement and nearness, of what may be carried upon the affair of the Real, glory be to Him, of the changing states of the aspirants and the entry of trials upon the seekers: whoever hears that and there arises in him regret over what has passed, or a fresh resolve for what is to come, how should his listening be censured? This is his wording. Others mentioned another mode of reconciliation: some of them, among them Imam al-Ghazali, permitted it for the fit, and interpreted the fit as one whose heart is alive and whose lower soul is dead, who is not a man of caprice and does not turn it to what opposes the truth; and they stipulated that the singer too be fit, that his intention be not the taking of a fee nor show and repute, and that none but the fit and their like attend the session; and upon this are most of the later scholars, and by it we hold, for we have witnessed that it arose from a people who knew Allah, loved His Messenger, and followed his laws and rulings, people of manifest miracles and dazzling ruptures of the norm, excused by the overpowering of the state; they made much of listening, and by it awakened longing for the manifestations of the Real, glory be to Him, counting that a worship of the greatest aspect; nor did there attend their listening any non-Muslim, corrupt person, beardless youth or women, and they kept its etiquettes like the etiquettes of all acts of worship, so it is lawful for them in particular. As for what the people of our time have made their custom, preparing gatherings in which they commit drinking and indecencies, assembling the corrupt and the beardless, summoning singers and troupes and listening to their song, taking pleasure in it with many a carnal caprice and satanic vanity, lavishing great favours on the singers and thanking them with sweeping largesse, there is no doubt that this is a great sin, and counting it lawful is unbelief, decisively and certainly, for it is the very diversion of discourse in their case; unlike the friends of the Real, in whose case no diversion of discourse remains, but rather it becomes a means to the raising of their degrees and the attainment of their perfections. Perhaps in His mention, the Exalted, of the diversion of discourse rather than singing, and likewise in the partitive "of" and the lam of purpose, there is a pointer to this distinction. For this reason it is not fitting in our time to give fatwa of its permissibility for the fit, because the corruption of the age has reached the point that every one claims "I am fit for it"; we affirm its permissibility for the fit only after it has issued from the illustrious great ones and the noble friends, lest the commission of sins and offences be imputed to them, Allah forbid; besides, most of the friends were also not tried by it and did not deem it good. It is established that Junayd repented of listening in his own time, with all that knowledge and state; what then of others? So the preferable course is abandonment, to repel accusation and obstinacy. The utmost of the matter is that if one's intention is sound and he then listens, or hums a melody to drive away desolation, he is not blamed in what is between him and Allah Most High. What we have set down here has been set down apart from any taint of partisanship and excess, without overreach or neglect; and Allah knows best. All of this is in al-Tafsirat al-Ahmadiyya.
وَعَنْ أَنَسٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : مَرَرْتُ لَيْلَةَ أُسْرِيَ بِي بِقَوْمٍ تُقْرَضُ شِفَاهُهُمْ بِمَقَارِيضَ مِنَ النَّارِ، فَقُلْتُ: يَا جِبْرِيلُ مَنْ هَؤُلَاءِ؟ قَالَ: هَؤُلَاءِ خُطَبَاءُ أُمَّتِكَ يَقُولُونَ مَا لَا يَفْعَلُوْنَ». رَوَاهُ التَّرْمِذِيُّ.
Anas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “On the night I was taken on the Isra’, I passed by a people whose lips were being cut with scissors of fire. I said, ‘O Jibril, who are these?’ He said, ‘These are the preachers of your nation who say what they do not do.’” [Narrated by At-Tirmidhi]
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : مَنْ تَعَلَّمَ صَرْفَ الْكَلَامِ لِيَسْبِيَ ۱بِهِ قُلُوبَ الرِّجَالِ أَوْ النَّاسِ لَمْ يَقْبَلْ اللَّهُ مِنْهُ يَوْمَ الْقِيَامَةِ صَرْفًا وَلَا عَدْلًا». رَوَاهُ أَبُو دَاوُدَ.
Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever learns eloquent speech to captivate 1 the hearts of men or people, Allah will not accept from him on the Day of Resurrection any excuse or justice.” [Narrated by Abu Dawud]

۱ قوله: ليسبي قلوب الرجال إلخ: قال في بذل المجهود: كتب مولانا محمد يحيى المرحوم في التقرير»: قوله: ليسبي به القلوب». فأما لو نوى فيه أن يؤثر كلامه ووعظه في سبيل الله خالصا فلا ضير.
۱ قوله: ومن الناس من يشتري لهوا الحديث إلخ فيها مسألة حرمة التغني، اعلم أن مسائل الغناء أكبر المسائل المختلف فيها، وقد تعارضت الآيات والأحاديث الدالة على إباحته وحرمته، وكثرت فيه أقاويل العلماء وآراء الصلحاء، ونحن نسمعك أولا الحجج المتعارضة، ثم نذكر ما هو الحق الحقيق، فنقول: من الآيات الدالة على حرمته الآية المذكورة، وإنها نزلت في النضر بن الحارث اشترى كتب الأعاجم، وكان يحدث بها قريشا، ويقول: إن كان محمد يحدثكم بحديث عاد وثمود فأنا أحدثكم بحديث رستم وأسفنديار والأكاسرة. وقيل: كان يشتري الفتيات المغنيات ويحملُهُنَّ على مُعاشرة من أراد الإسلام، ويقول: هذا خير مما يدعوك إليه محمد، هكذا في «الكشاف» و «البيضاوي».
وفي رواية الإمام الزاهد أيضًا أنها نزلت في الوليد بن المغيرة ويشتري إما بمعنى الشراء كما علمت أو بمعنى الاختيار، و«الحديث» إن كان هو الحديث المنكر فإضافة اللهو إليه بيانية، وإن كان أعم منه فالإضافة بمعنى «من» التبعيضية، ويضل» قُرِئَ بالضم والفتح بمعنى المضل والضال جميعًا، وكذا يتخذ» قُرِئَ منصوبا عطفا على «يضل». ومرفوعا عطفا على يشتري».
وإنما قلنا: إنه يدل على حرمة الغناء؛ لأن الله تعالى قد ذم من يشتغل بلهو الحديث، وأوعده بالعذاب المهين ولهو الحديث وإن كان ظاهره عاما في كل ما يلهي عما يعني، كالأحاديث التي لا أصل لها، والأساطير التي لا اعتبار لها، والمضاحيك وفضول الكلام على ما هو رأي أكثر المفسرين، ويوافقه الرواية الأولى من النزول إلا أنه قد ذكر في الفتاوى الحمادية وكذا في «العوارف وغيره أن ابن عباس وابن مسعود الله كانا يحلفان بالله إنا قد سمعنا عن رسول الله ﷺ أن المراد به التغني، ويوافقه الرواية الثانية من النزول، فيكون دليلا على حرمته، ومنها : ما ذكر في آخر سورة النجم، وهي قوله تعالى: ﴿ وَأَنْتُمْ سٰمِدُونَ 61﴾ (النجم : ٦١) فإنه ذكر في «البيضاوي»: أن المراد به وأنتم مغنون.
وفي «العوارف»: أن عبد الله بن عباس حلف أن المراد به التغني، ومنها ما ذكر في سورة بني إسرائيل هو قوله تعالى: ﴿وَاسْتَفْزِزْ مَنِ اسْتَطَعْتَ مِنْهُم بِصَوْتِكَ ﴾ (الإسراء : ٦٤)؛ فإنه أيضًا ذكر في الفتاوى الحمادية» و«العوارف» أنه قال مجاهد: إنها تدل على حرمه التغني، وذلك لأن قوله: ﴿وَاسْتَفْزِزْ﴾ خطاب لإبليس عليه اللعنة، ومعناه: وحرك من استطعت من بني آدم بصوتك، وهو صوت التغني والمزامير والدف وغير ذلك، فهذه الآيات الثلاث دالة على حرمته مطلقا، والأحاديث الصحاح المعتبرة الدالة على حرمته أكثر من أن يعد ويحصى، وأكثرها مذكور في «العوارف».
وكتب الفتاوى مملوؤة من ذلك، منها ما ذكرته في آخر هذا الباب نقلا عن المشكاة». ومنها: ما نقل أنه لما مات ابن رسول الله له طاهر بكت عيناه، فقال عبد الرحمن بن عوف: أليس يا رسول الله قد نهيتنا عن البكاء؟ فقال: «إنما نهيتكم عن صوتتين فاجرين أحمقين: صوت النوحة وصوت الغناء . وقال رسول الله ﷺ : «كان إبليس أول من ناح وأول من تغنى . وقال رسول الله ﷺ : التغني حرام، والتلذذ بها كفر، والجلوس عليها فسق ومعصية». وقال النبي ﷺ: ما من رجل يرفع صوته بالغناء إلا بعث الله عليه شيطانين: أحدهما على هذا المنكب، والآخر على هذا المنكب، ولا يزالان يضربان بأرجلهما حتى يكون هو الذي يسكت». وهذه الحجج كلها دالة على حرمته مطلقا.
ومن الحجج الدالة على إباحته ما ذكر في «العوارف»: فمن الآيات قوله تعالى: ﴿وَإِذَا سَمِعُوا مَا أُنزِلَ إِلَى الرَّسُولِ تَرَى أَعْيُنَهُمْ تَفِيضُ مِنَ الدَّمْعِ مِمَّا عَرَفُوا مِنَ الْحَقِّ (المائدة: ۸۳ وقوله تعالى: ﴿فَبَشِّرْ عِبَادِ الَّذِينَ يَسْتَمِعُونَ الْقَوْلَ فَيَتَّبِعُونَ أَحْسَنَهُ ﴾ (الزمر: (۱۷-۱۸) وقوله تعالى: ﴿تَقْشَعِرُّ مِنْهُ جُلُودُ الَّذِينَ يَخْشَوْنَ رَبَّهُمْ ثُمَّ تَلِينُ جُلُودُهُمْ وَقُلُوبُهُمْ إِلَى ذِكْرِ اللَّهِ ﴾ (الزمر: ۲۳، فإن هذه الآيات دالة على استماع القول والبكاء فيه واقشعرار الجلد منه، ولا يخفى ضعفه.
قال صاحب «العوارف»: وهذا جملة لا ينكر، ولا اختلاف فيها، وإنما الاختلاف في سماع الأشعار بالإلحان، وقد كثرت الأقوال في ذلك وتباينت الأحوال، ومن الأحاديث ما قال: أخبرنا الشيخ الطاهر بن أبي الفضل عن أبيه الحافظ المقدسي قال : أخبرنا أبو بكر القاسم الحسن بن محمد الخولاني قال: حدثنا أبو محمد عبد الله بن يوسف قال: حدثنا أبو بكر بن وثاب قال: حدثنا عمر بن الخطاب قال: حدثنا الأوزاعي عن الزهري عن عروة عن عائشة : أن أبا بكر دخل عليها، وعندها جاريتان تغنيان وتضربان بدفين ورسول الله الله مسجى بثوبه، فانتهرهما أبو بكر فكشف رسول الله ﷺ عن وجهه. وقال: «دعهما يا أبا بكر، فإنها أيام عيد».
وفيه أيضًا: وروت عائشة قالت: كان عندي جارية تغني، فدخل رسول الله له وهي على حالها، ثم دخل عمر فَفَرَتْ، فضحك رسول الله ، فقال عمر : ما يُضحكك يا رسول الله ؟ فحدثه حديث الجارية، فقال: لا أبرححتى أسمع ما سمع رسول الله ، فأمرها رسول الله له فأسمعته، وفيه أيضًا قالت عائشة : رأيت رسول الله وسترني بردائه وأنا أنظر إلى الحبشة يلعبون في المسجد حتى أكون أنا أسأم، وفيه أيضًا قال: أخبرنا أبو زرعة طاهر عن والده أبي فضل الحافظ المقدسي قال: أخبرنا أبو منصور محمد بن عبد الملك الظفري السركسي، قال: أخبرنا أبو علي فضل بن منصور بن نصر الكاغذي السمرقندي إجازة قال: حدثنا الهيثم عن كليب، قال: حدثنا أبو بكر عمار بن إسحاق قال: قد حدثنا سعد بن عامر عن شعبة عن عبد العزيز بن صهيب عن أنس له قال: كنا عند رسول الله إذ نزل جبيريل ، فقال : يا رسول الله إن فقراء أمتك يدخلون الجنة قبل الأغنياء بنصف يوم وهو خمس مائة ففرح رسول الله ﷺ ، فقال : أفيكم من ينشدنا ؟ قال : بدوي، نعم، أنا يا رسول الله، قال: هات، فأنشد البدوي شعرا:
قد لَسَعَتْ حَيَّةُ الْهَوَى كَبِدِي ....... إلا الحبيب الذي شُغِفْتُ به
فلا طبيب لها ولا راق .................. فعنده رقيتي وترياقي
فتواجد رسول الله ﷺ وتواجد الأصحاب معه حتى سقط رداءه عن منكبيه، فلما فرغوا آوى كل واحد منهم مكانه. قال معاوية بن أبي سفيان ما أحسن لعبكم يا رسول الله، فقال: يا معاية ليس بكريم من لم يهتز عند سماع ذكر الحبيب، ثم قسم ردائه رسول الله الله على من حاضرهم بأربع مائة قطعة. وهذا الحديث أوردناه مسندا كما سمعناه ووجدناه، وقد تكلم في صحته أصحاب الحديث، وما وجدنا شيئًا نقل عن رسول الله و يشاكل وجد أهل الزمان وسماعهم واجتماعهم إلا هذا، وما أحسن حجة الصوفية وأهل الزمان في سماعهم وتمزيقهم الخرق وقسمتها إن لو صح والله أعلم بذلك وتخالج سرى أنه غير صحيح، ولم أجد فيه ذوق اجتماع النبي ﷺ مع أصحابه يعتمدونه على ما بلغنا في هذا الحديث ويأبى القلب قبوله، والله أعلم وأحكم بذلك.
هذه عبارة «العوارف بعينها، فهذه الححج كلها دالة على إباحته؛ إذ أدنى منازل فعل الرسول ﷺ وقوله أن يكون مباحا، فتعارضت الأخبار الدالة على إباحته وحرمته ظاهرا، والتاريخ مجهول، وإذا نظرت إلى ضابطتي الأصول يوجب حرمته، أحدهما: أنه إذا تعارض المبيح والمحرم كان العمل بالمحرم أولى ثانيهما: أنه إذا وقع التعارض بين السنتين وجب المصير إلى قول الصحابة .. وههنا قول الصحابة دال على حرمته مطلقا حيث قال عثمان : ما تغنيت ولا تمنيت ولا مسست ذكري بيميني منذ بايعت رسول الله ﷺ. وقال عبد الله بن مسعود الله: الغناء ينبت النفاق في القلب، وروي أن ابن عمر مر عليه قوم محرومون وفيهم رجل يتغنى، فقال: ألا لا سمع الله لكم، ثم ألا لا سمع الله لكم.
والتابعون وتبعهم كانوا أيضًا قائلين حرمته، كما قال بعضهم: إياكم والغناء؛ فإنه يزيد الشهوة ويهدم المروءة، وإنه ينوب عن الخمر ويفعل السكر. وقال فضيل بن العياض : الغناء رقية الزناء، وعن الضحاك : الغناء مفسدة للقلب ومسخطة للرب. والأئمة الأربعة الكرام كانوا أيضًا ممن ينكرونه، وهكذا ذكر في «العوارف حيث قال: وقد نقل عن الشافعي أنه قال في كتاب القضاء الغناء لهو مكروه يشبه الباطل. وقال: من استكثر منه فهو سفيه ترد شهادته، وعند مالك إذا اشترى جارية فوجدها مغنة فله أن يردها بالعيب، وهكذا مذهب الإمام الأعظم أبي حنيفة أن سماع الغناء من الذنوب. وما أباحه إلا نفر قليل من الفقهاء، ومن أباحه من الفقهاء أيضًا لم ير إعلانه في المساجد والبقاع الشريفة هذ كلامه.
وأيضًا قد اشتهر أن أبا حنيفة الله دعي يوما إلى الوليمة فوجد ثمة لعبا وغناء، وكان غير مقتدى حينئذ فصبر عليه، ولما سئل عنها بعد ذلك قال : ابتليت بهذا مرة فصبرت فقوله: «ابتليت دال على حرمته مطلقا؛ لأن الابتلاء إنما يكون بالمحرم، وهكذا اتفق على حرمته مطلقًا كثير من المجتهدين حتى بلغ أعدادهم إلى خمس أو اثنين وسبعين مجتهدا، جمعت أقوالهم كلها في رسالة، فمن أراد الإطلاع عليها فليرجع إليها. علماء الشريعة الغراء أكثرهم كانوا متفقين على مطلق الحرمة، ثم فرق فريق بوجه تطبيق، فذكر شيخ الشيوخ في «العوارف»: فأما الدف والشانة وإن كان في مذهب الشافعي فيها فسحة، فالأولى تركها، وأما غير ذلك فإن كان من القصائد في ذكر الجنة والنار والتشويق إلى دار القرار ووصف نِعَمِ الملك الجبار، وذكر العبادات والترغيب في الخيرات، فلا سبيل إلى الإنكار.
ومن ذلك القبيل قصائد الغزاة والحجاج في وصف الغزو والحج مما يثير كَامِنُ العزم من الغازي وساكن الشوق من الحجاج، وأما ما كان فيه ذكر القدود والخدود ووصف النساء فلا يليق بأهل الديانات الاجتماع المثل ذلك، وأما ما كان من ذكر الهجر والوصال والقطيعة والقرب مما يقرب حمله على أمر الحق سبحانه وتعالى من تلون أحوال المريدين ودخول الآفات على الطالبين، فمن سمع ذلك وحدث عليه ندم على ما فات أو تجدد عنده عزم لما هو آت، فكيف ينكر سماعه.
هذا كلامه، وذكر آخرون وجها آخر لتطبيقه، فجوزه بعضهم ومنهم الإمام الغزالي للأهل، وفسر الأهل بمن كان قلبه حيا ونفسه ميتا، ولا يكون صاحب الهواء، ولا يصرفه إلى خلاف الحق، واشترطوا أن يكون المغني أيضًا أهلا، ولا يكون نيته أخذ الأجرة، ولا الرياء والسمعة، ولا يحضر في المجلس غير الأهل وأمثاله، وعليه أكثر المتأخرين، وبه نأخذ ؛ لأنا شاهدنا أنه نشأ من قوم كانوا عارفين بالله ومحبين لرسول الله متبعين لشرائعه وأحكامه، وهم أهل كرامات ظاهرة وخوارق عادات باهرة، وكانوا معذورين لغلبة الحال ويستكثرون السماع للغناء، ويشوقون بها إلى تجليات الحق سبحانه وتعالى، وكانوا يحسبون ذلك عبادة أعظم وجها وأكبر، ولم يحضرهم حين السماع ذمي، ولا فاسق، ولا أمرد، ولا نسوة، ويقيمون آدابه كآداب سائر العبادات، فيحل لهم خاصة. وأما ما رسمه أهل زماننا من أنهم يهيئون المجالس، ويرتكبون فيها بالشرب والفواحش، ويجمعون الفساق والأمارد، ويطلبون الغنين والطوائف ويسمعون منهم الغناء، ويتلذذون بها كثير من الهواء النفسانية والخرافات الشيطانية، ويحمدون على المغنين بإعطاء النعم العظيم ويشكرون عليهم بالإحسان العميم، فلا شك أن ذلك ذنب كبير، واستحلاله كفر قطعا ويقينا؛ لأنه عين لهو الحديث في شأنهم بخلاف أولياء الحق؛ فإنه لم يبق حديث لهو في شأنهم، بل يكون ذلك وسيلة لرفع درجاتهم، ونيل كمالاتهم.
ولعل في ذكره تعالى لهو الحديث دون التغني، وكذا في ذكر من التبعيضية ولام» الغاية إشارة إلى هذه التفرقة، ولهذا لا ينبغي أن يفتى بجوازه للأهل في زماننا؛ لأنه قد بلغ من فساد الزمان إلى حيث يدعي كل واحد أني أهله، بل إنما نقول بجوازه للأهل بعد أن صدر من الأجلاء العظام والأولياء الكرام؛ لئلا يلزم منهم ارتكاب الذنوب والآثام، وحاش الله من ذلك على أن أكثر الأولياء أيضًا لم يبتلوا بذلك ولم يحسنوه، وقد صح أن جنيدا لله تاب عن السماع في زمانه مع تلك المعرفة والحال، فما بال غيره، فالأولى هو الترك؛ دفعا للتهمة والعناد، غاية ما في الباب أنه إذا كانت نيته صالحة وسمع حينئذ أو يغني بنغمة؛ دفعا للوحشة لم يعاتب فيما بينه وبين الله تعالى. وهذا الذي جرى منا إنما جرى بقطع النظر عن شائبة التعصب والطغيان، ومن غير إفراط وتفريط، والله أعلم، هذا كله في التفسيرات الأحمدية».
وَعَنِ ابْنِ مَسْعُوْدٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «هَلَكَ ۱الْمُتَنَطِّعُونَ قَالَهَا ثَلَاثًا. رَوَاهُ مُسْلِمٌ.
Ibn Mas‘ud (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “The pedants 1 are ruined,” saying it three times. [Narrated by Muslim]

Abu Tha‘labah Al-Khushani (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “The most beloved of you to me and the closest to me on the Day of Resurrection are those with the best character. The most hated to me and the farthest from me are those with the worst character: the talkative 1, the verbose 2, and the arrogant 3.” [Narrated by Al-Bayhaqi in Shu‘ab Al-Iman] Narrated similarly by At-Tirmidhi from Jabir, who added: They said, “O Messenger of Allah, we know the talkative and the verbose, but who are the arrogant?” He said, “The haughty.”

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ (رضي الله عنهما) أَنَّ رَسُولَ اللهِ ﷺ قَالَ: «إِنَّ اللَّهَ يُبْغِضُ الْبَلِيغَ مِنَ الرِّجَالِ الَّذِي يَتَخَلَّلُ بِلِسَانِهِ كَمَا يَتَخَلَّلُ الْبَاقِرَةُ بِلِسَانِهَا». رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ.
Abdullah ibn Umar (may Allah be pleased with them both) narrated that the Messenger of Allah (ﷺ) said: “Allah hates the eloquent man who picks at his tongue as a cow picks at its tongue.” [Narrated by At-Tirmidhi and Abu Dawud]

Amr ibn Al-‘As (may Allah be pleased with him) narrated that one day a man stood and spoke at length 1, so Amr said, “If he had been concise in his speech, it would have been better for him. Some of Imam Malik’s followers said it is a condemnation of eloquence, which is why Malik included it in the chapter on disliked speech. They said it likens eloquence to magic, which is blameworthy and forbidden in all its forms, due to its pomposity and portrayal of falsehood as truth. It is said, “The most hated to me are the talkative and the pompous,” and a man may be on the truth but enchant people with his eloquence, leading them astray. Others said it is in praise of eloquence, citing that the people marveled at their speech, and marveling only occurs with what is good and pleasant to hear. They said likening it to magic is praise, as magic means captivation, and whoever captivates you has enchanted you. The best interpretation is that it neither condemns nor praises all eloquence, as the word “some” indicates partiality. Ka‘b ibn Malik (may Allah be pleased with him) narrated that he said to the Prophet (ﷺ), “Allah, the Exalted, has revealed about poetry what He has revealed.” The Prophet (ﷺ) said, “The believer strives with his sword and his tongue. By the One in Whose Hand is my soul, it is as if you strike them with it like a shower of arrows.” [Narrated in Sharh As-Sunnah] In Al-Isti‘ab by Ibn Abdul-Barr, he said, “O Messenger of Allah, what is your view on poetry?” He replied, “The believer strives with his sword and his tongue.”

Al-Bara’ (may Allah be pleased with him) narrated that on the day of Qurayzah, the Messenger of Allah (ﷺ) said to Hassan ibn Thabit, “Satirize the polytheists, for Jibril is with you.” The Messenger of Allah (ﷺ) also said to Hassan, “Defend me. O Allah, support him with the Holy Spirit.” [Agreed Upon]

In Radd Al-Muhtar, before the chapter on Witr and supererogatory prayers, it is stated that Imam At-Tahawi narrated in Sharh Majmu‘ Al-Athar that the Prophet (ﷺ) forbade reciting poetry in the mosque, selling goods there, or gathering in circles before prayer. He reconciled this with the narration of setting up a pulpit for Hassan to recite poetry by interpreting the former as referring to poetry like that used by the Quraysh to satirize, or anything harmful, or that which dominates the mosque, making it like a marketplace. For just as he did not forbid Ali from mending sandals in the mosque, though it would be disliked if people gathered to mend sandals there, so too with selling, reciting poetry, and gathering before prayer: what dominates is disliked, but what does not is not.
۱ قوله: يضع الحسان منبرا في المسجد وقال في رد المحتار» قبيل باب الوتر والنوافل: وقد أخرج الإمام الطحاوي في شرح مجمع الآثار»: أنه نهى أن تنشد الأشعار في المسجد، وأن تباع فيه السلع، وأن يتحلق فيه قبل الصلاة، ثم وفق بينه وبين ما ورد أنه وضع الحسان منبرا ينشد عليه الشعر بحمل الأول على ما كانت قريش تهجوه به ونحوه مما فيه ضررا، وعلى ما يغلب على المسجد حتى يكون كالسوق؛ لأنه لا لم ينه عليا عن خصف النعل فيه مع أنه لو اجتمع الناس لخصف النعال فيه كره، فكذلك البيع وإنشاد الشعر والتحلق قبل الصلاة، فما غلب عليه كره، وما لا فلا.
وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ (رضي الله عنه) قَالَ: بَيْنَمَا نَحْنُ نَسِيرُ مَعَ رَسُولِ اللَّهِ ﷺ بِالْعَرْجِ، إِذْ عَرَضَ شَاعِرُ يُنْشِدُ فَقَالَ رَسُولُ اللهِ ﷺ: «خُذُوا الشَّيْطَانَ أَوْ أَمْسِكُوا الشَّيْطَانَ، لَأَنْ يَمْتَلِئَ۱ جَوْفُ رَجُلٍ قَيْحًا خَيْرٌ لَهُ مِنْ أَنْ يَمْتَلِئَ شِعْرًا». رَوَاهُ مُسْلِمٌ.
Abu Sa‘id Al-Khudri (may Allah be pleased with him) narrated: While we were traveling with the Messenger of Allah (ﷺ) at Al-‘Arj, a poet came reciting. The Messenger of Allah (ﷺ) said, “Seize the devil, or catch the devil. That a man’s stomach be filled with pus 1 is better for him than it being filled with poetry.” [Narrated by Muslim]

In Radd Al-Muhtar, at the beginning of the book before the section on the mufti, it is stated: Know that the disliked poetry is that which one persists in, making it a profession that dominates and distracts from the remembrance of Allah, the Exalted, and religious knowledge. This is how the agreed-upon Hadith is interpreted: “That a man’s stomach be filled with pus is better than it being filled with poetry.” A little of it is permissible if intended to display subtleties, finesse, excellent metaphors, and fitting meanings, even if describing cheeks and figures. Scholars of rhetoric have cited such poetry from later poets and others for this purpose. The erudite Ibn Al-Humam stated in the chapter on testimonies in Fath Al-Qadir that the forbidden poetry is that containing unlawful content, such as describing specific living men or women, wine that incites toward it, taverns, or satire of a Muslim or protected non-Muslim if intended as satire, but not if intended to demonstrate eloquence or rhetoric. As for innocent love poetry describing flowers, gardens, and waters, there is no basis for prohibiting it. However, if recited with musical instruments, it is forbidden, even if it contains admonitions or wisdom. In Adh-Dhakhirah from An-Nawazil, reciting literary poetry containing mention of immorality, wine, or youths is disliked, with the same ruling for youths as for specific living women. If the person is deceased, it is not disliked.

In Radd Al-Muhtar, before the chapter on Witr and supererogatory prayers, it is stated in Ad-Diya’ Al-Ma‘nawi, the twentieth affliction of the tongue is poetry. When asked about it, he said, “It is speech; its good is good, and its bad is bad,” meaning poetry is like prose: praised when praiseworthy and condemned when blameworthy. There is no harm in listening to the chanting of Bedouin poetry without melody. Satirizing a Muslim is forbidden, even if true, as he said, “That a man’s stomach be filled with pus is better than it being filled with poetry.” Poetry containing admonitions, wisdom, mention of Allah’s blessings, or descriptions of the righteous is good. Poetry about ruins, times, or nations is permissible. Poetry involving satire or vulgarity is forbidden, and poetry describing cheeks, figures, or hair is disliked. Amr ibn Ash-Sharid, from his father (may Allah be pleased with him), narrated: I rode behind the Messenger of Allah (ﷺ) one day, and he said, “Do you have any poetry of Umayyah ibn Abi As-Salt?” I said, “Yes.” He said, “Go ahead.” So I recited 1 a verse, and he said, “Go on.” I recited another, and he said, “Go on,” until I recited a hundred verses. Al-Bara’ (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) was carrying earth on the day of the Trench until his stomach was covered, saying:
By Allah, without Allah, we would not be guided … Nor give charity, nor pray.
So send down tranquility upon us … And make firm our feet if we meet.
Indeed, the enemies have oppressed us … When they intended tribulation, we refused.
He raised his voice, saying, “We refused, we refused.” [Agreed Upon]

Anas (may Allah be pleased with him) narrated that the Muhajirun and Ansar were digging the Trench and carrying earth, saying:
We are those who pledged allegiance to Muhammad … For jihad as long as we remain forever.
The Prophet (ﷺ) responded, saying:
O Allah, there is no good but the good of the Hereafter … So forgive the Ansar and the Muhajirah.

وَعَنْهُ (رضي الله عنه) قَالَ: كَانَ لِلنَّبِيِّ ﷺ حَادٍ يُقَالُ لَهُ أَنْجَشَةُ، وَكَانَ حَسَنَ الصَّوْتِ، فَقَالَ لَهُ النَّبِيُّ ﷺ: رُوَيْدَ يَا أَنْجَشَةُ، لَا تَكْسِرْ الْقَوَارِيرَ» ۱ قَالَ قَتَادَةُ: يَعْنِي ضَعَفَةً النِّسَاءِ. مُتَّفَقٌ عَلَيْهِ.
Anas (may Allah be pleased with him) narrated that the Prophet (ﷺ) had a camel driver named Anjashah, who had a beautiful voice. The Prophet (ﷺ) said to him, “Gently, O Anjashah, do not break the glass vessels 1.” Qatadah said: He meant the delicate women. [Agreed Upon]

Ibn Mas‘ud said, “The sound of amusement and singing breeds hypocrisy in the heart as water nurtures plants.” I say: In Al-Bazaziyyah, listening to the sound of musical instruments, like striking reeds, is forbidden, as it is said: “Listening to musical instruments is a sin, sitting for it is transgression, and taking pleasure in it is disbelief.” This refers to disbelief in the blessing, not gratitude, as the limbs are used contrary to their purpose. It is obligatory to avoid it so as not to hear, as he put his fingers in his ears upon hearing it. Arabic poetry containing immorality is disliked. This is either to emphasize the sin, as in Al-Ikhtiyar, or due to deeming it lawful, as in An-Nihayah. In Radd Al-Muhtar, it is said: The attribution to emphasizing the sin refers to calling it disbelief for exaggeration. The narration of him listening to poetry does not indicate the permissibility of singing and can be understood as referring to permissible poetry containing wisdom or admonition. The Hadith about his ecstasy is not authentic, and the discussion on singing was covered at the beginning of this chapter from At-Tafsir Al-Ahmadiyya, which is valuable in its field.
۱ قوله : الغناء ينبت النفاق في القلب إلخ : قال في الدر المختار» في كتاب الحظر والإباحة: وفي «السراج» أن الملاهي كلها حرام ويدخل عليهم بلا إذنهم لإنكار المنكر، قال ابن مسعود: صوت اللهو والغناء ينبت النفاق في القلب كما ينبت الماء النبات. قلت: وفي البزازية»: استماع صوت الملاهي كضرب قصب ونحوه حرام؛ لقوله : «استماع الملاهي معصية، والجلوس عليها فسق والتلذذ بها كفر. أي بالنغمة، فصرف الجوارح إلى غير ما خلق لأجله كفر بالنعمة لا شكر، فالواجب كل الواجب أن يجتنب كيلا يسمع ؛ لما روي أنه أدخل إصبعه في أذنه عند سماعه، وأشعار العرب لو فيها ذكر الفسق تكره انتهى، أو لتغليظ الذنب، كما في الاختيار أو للاستحلال، كما في «النهاية». وقال في رد المحتار: قوله أو لتغليظ الذنب عطف على قوله : أي بالنعمة، يعني إنما أطلق عليه لفظ الكفر تغليظا، وما نقل أنه سمع الشعر لم يدل على إباحة الغناء، ويجوز حمله على الشعر المباح المشتمل على الحكمة والوعظ، وحديث تواجده لم : لم يصح، وقد مر الكلام في التغني في صدر هذا الباب مستوفى، نقلا عن التفسيرات الأحمدية فليتطالع؛ فإنه نفيس في بابه.
وَعَنْ نَافِعٍ قَالَ: كُنْتُ مَعَ ابْنِ عُمَرَ فِي طَرِيقٍ فَسَمِعَ مِزْمَارًا، فَوَضَعَ إِصْبَعَيْهِ فِي أُذُنَيْهِ وَنَأَى عَنِ الطَّرِيقِ إِلَى الْجَانِبِ الْآخَرِ، ثُمَّ قَالَ لِيْ بَعْدَ أَنْ بَعُدَ: يَا نَافِعُ هَلْ تَسْمَعُ شَيْئًا ۚ قُلْتُ: لَا ، فَرَفَعَ إِصْبَعَيْهِ مِنْ أُذُنَيْهِ وَقَالَ: كُنْتُ مَعَ رَسُولِ اللَّهِ ﷺ فَسَمِعَ صَوْتَ يَرَاعِ، فَصَنَعَ مِثْلَ مَا صَنَعْتُ، قَالَ نَافِعُ : وَكُنْتُ إِذْ ذَاكَ صَغِيرًا. رَوَاهُ أَحْمَدُ.
Nafi‘ narrated that he was with Ibn Umar (may Allah be pleased with them both) on a road when he heard a flute. He placed his fingers in his ears and moved to the other side of the road. After moving away, he said to me, “O Nafi‘, do you hear anything?” I said, “No.” He removed his fingers from his ears and said, “I was with the Messenger of Allah (ﷺ), and he heard the sound of a flute and did as I did.” Nafi‘ said, “I was young at the time.” [Narrated by Ahmad]
