عَنْ زَيْدِ بْنِ أَسْلَمَ عَنْ رَجُلٍ مِنْ بَنِي ضَمْرَةَ عَنْ أَبِيْهِ أَنَّهُ قَالَ: سُئِلَ رَسُولُاللهِ صلي الله عليه واله وسلم عَنِ الْعَقِيقَةِ فَقَالَ: (لَا أُحِبُّ الْعُقُوقَ)، وَكَأَنَّهُ إِنَّمَا كَرِهَ الاِسْمَ، وَقَالَ: (مَنْ ١ وُلِدَ لَهُ وَلَدٌ فَأَحَبَّ أَنْ يَنْسُكَ عَنْ وَلَدِهِ فَلْيَفْعَلْ). رَوَاهُ مَالِكَ، وَبَوَّبَ عَلَيْهِ (بَابٌ تُسْتَحَبُّالْعَقِيْقَةُ).

وَرَوَى أَبُوْ دَاوُدَ وَالنَّسَائِيُّ وَالطَّحَاوِيُّ فِي (مُشْكِلِ الْآثَارِ) وَالْبَيْهَقِيُّ فِي (السُّنَنِالْكُبْرَى) نَحْوَهُ، وَفِي رِوَايَةٍ لِمَالِكِ عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيْمَ بْنِ الْحَارِثِ التَيْمِيِّ أَنَّهُ قَالَ:سَمِعْتُ أَبِيْ يُسْتَحَبُّ الْعَقِيْقَةُ وَلَوْ بِعُصْفُوْرٍ. وَفِي رِوَايَةِ أَحْمَدَ وَالتَّرْمِذِيِّ وَأَبِيْ دَاوُدَوَالنَّسَائِيّ: يُذْبَحُ عَنْهُ يَوْمَ السَّابِع، وَيُسَمَّى وَيُحْلَقُ رَأْسُهُ. وَقَالَ الطَّحَاوِيِّ فِي (مُشْكِلِالْآَثَارِ): يُسْتَدَلُّ عِنْدَنا بِهَذِهِ الْأَحَادِيْثِ عَلَى اسْتِحْبَابِ الْعَقِيْقَةِ، وَمَا رُوِيَ مِنْ تَوْكِيْدِأَمْرِهَا مَحْمُوْلٌ عَلَى النَّسْخِ.

English

Zayd ibn Aslam narrated from a man from Banu Damrah, from his father, who said: The Messenger of Allah (ﷺ) was asked about aqiqah. He said: “I do not like disobedience (uquq),” as if he disliked the name. He said: “Whoever has a child born and wishes to offer a sacrifice for it, let him do so.” 1 [Narrated by Malik, who titled it “Chapter: Aqiqah is Recommended”]

Abu Dawud, al-Nasa’i, al-Tahawi in “Mushkil al-Athar,” and al-Bayhaqi in “Al-Sunan al-Kubra” narrated something similar. In Malik’s narration from Muhammad ibn Ibrahim ibn al-Harith al-Taymi, he said: “I heard my father say: Aqiqah is recommended, even with a small bird.” In narrations by Ahmad, al-Tirmidhi, Abu Dawud, and al-Nasa’i: “It is slaughtered on the seventh day, the child is named, and its head is shaved.” Al-Tahawi said in “Mushkil al-Athar”: These hadiths indicate the recommendation of aqiqah, and narrations emphasizing its obligation are considered abrogated.

1 The statement: “Whoever has a child born, etc.”: In “Radd al-Muhtar,” in the last section of the Book of Sacrifice: It is recommended for one who has a child born to name it on the seventh day, shave its head, and give charity equivalent to the weight of its hair in silver or gold, per the three Imams. Then, perform aqiqah at the time of shaving, as permissible per “Al-Jami’ al-Mahbubi” or as voluntary per “Sharh al-Tahawi.” It is a sheep fit for sacrifice, slaughtered for both male and female, whether its meat is distributed raw, cooked with or without seasoning, with or without breaking its bones, with or without hosting a gathering, per Malik. Al-Shafi’i and Ahmad considered it a strongly recommended Sunnah: two sheep for a boy and one for a girl, per “Ghurrar al-Afkar.” In “Urf al-Shadhi”: It is attributed to Abu Hanifah that he did not uphold aqiqah, implied by Muhammad’s statement in his Muwatta. The truth is our school recommends it on the seventh, fourteenth, or twenty-first day, and the child is named on that day. In “Umdat al-Qari,” Abu Hanifah said: Aqiqah is not a Sunnah. The author of “Al-Tawdih” cited Abu Hanifah and the Kufis saying it is an innovation. Some said in its commentary that Abu Hanifah called it an innovation. I say: This is a false attribution; Abu Hanifah would not say such a thing. He meant it is not a fixed or strongly emphasized Sunnah.

١ قوله: من ولد له ولد فأحب أن ينسك وعن ولده فليفعل: قال في (رد المحتار) في آخر كتاب الأضحية: يستحبلمن ولد له ولد أن يسميه يوم أسبوعه، ويحلق رأسه، ويتصدق عند الأئمة الثلاثة بزنة شعره فضةً أو ذهبًا، ثم يعقعند الحلق عقيقة إباحة على ما في (الجامع المحبوبي ) أو تطوعا على ما في (شرح الطحاوي)، وهي شاة تصلحللأضحية تذبح للذَّكر والأنثى، سواء فرق لحمها نيا أو طبخه بحموضة أو بدونها مع كسر عظهما أو لا، واتخاذ دعوةأو لا، وبه قال مالك. وسنها الشافعي وأحمد سنة مؤكدة، شاتان عن الغلام وشاة عن الجارية، (غرر الأفكار) ملخصًا. وقال في (العرف الشذي): نسب إلى أبي حنيفة أنه لا يقول بالعقيقة، والموهم إليه عبارة محمد في موطئه،والحق أن مذهبنا استحبابها لسابع بعد يوم الولادة، أو للرابع عشر أو الحادي والعشرين، ويسميه في ذلك اليوم اه.وفي (عمدة القاري): قال أبو حنيفة: العقيقة ليست بسنة، ونقل صاحب (التوضيح) عن أبي حنيفة والكوفيين أنهابدعة، وكذلك قال بعضهم في شرحه، والذي نقل عنه أنها بدعة أبو حنيفة. قلت: هذا افتراء، فلا يجوز نسبته إلى أبيحنيفة، وحاشاه أن يقول مثل هذا، وإنما قال: ليست بسنة، فمراده إما ليست بسنة ثابتة، وأما ليست بسنة مؤكدة.

وَعَنِ ابْنِ عَبَّاس رضي الله عنهما أَنَّ رَسُوْلَ١ الله صلي الله عليه واله وسلم عَقَّ عَنِ الْحَسَنِ وَالْحُسَيْنِ كَبَشًاكَبَشَا. رَوَاهُ أَبُوْ دَاوُدَ.

وَفِي رِوَايَةِ التَّرْمِذِيِّ وَالنَّسَائِيِّ وَأَبِيْ دَاوُدَ: (وَلَا يَضُرُّكُمْ ذُكْرَانًا كُنَّ أَمْ إِنَاثًا).

وَرَوَى مَالِكٌ عَنْ نَافِعٍ أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ لَمْ يَكُنْ يَسْأَلُهُ أَحَدٌ مِنْ أَهْلِهِ عَقِيقَةًإِلَّا أَعْطَاهُ إِيَّاهَا، وَكَانَ يَعُقُ عَنْ وَلَدِهِ بِشَاةٍ شَاةٍ عَنْ الذُكُورِ وَالْإِنَاثِ.

وَفِيْ رِوَايَةٍ لَهُ عَنْ هِشَامٍ بْنِ عُرْوَةَ أَنَّ أَبَاهُ عُرْوَةَ بْنَ الزُّبَيْرِ كَانَ يَعُقُّ عَنْ بَنِيهِ الذُّكُورِوَالْإِنَاثِ بِشَاةٍ شَاةٍ. وَقُلْنَا: إِنَّ صَدَقَةَ الْفِضَّةِ قَدْرَ أَشْعَارِ رَأْسِ الْحَسَنِ رضى الله عنه وَاقِعَةُ حَالٍ لَاعُمُوْمَ ٢ لَهَا عِنْدَنَا.

English

Ibn Abbas (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) performed aqiqah for al-Hasan and al-Husayn with one ram each. 1 [Narrated by Abu Dawud]

In narrations by al-Tirmidhi, al-Nasa’i, and Abu Dawud: “It does not harm you whether they are male or female.” Malik narrated from Nafi’ that Abdullah ibn Umar would give aqiqah to anyone in his family who asked, performing it with one sheep for both males and females. In another narration from Hisham ibn Urwah, his father Urwah ibn al-Zubayr performed aqiqah for his sons and daughters with one sheep each. We say: The charity of silver equivalent to the weight of al-Hasan’s hair (may Allah be pleased with him) is a specific case, not a general rule for us. 2

وَعَنْ بُرَيْدَةَ رضي الله عنه قَالَ: كُنَّا فِي الجَاهِلِيَّةِ إِذَا وُلِدَ لِأحَدِنَا غُلَامُ ذَبَحَ شَاةً، وَلَطَخَرَأْسَهُ بِدَمِهَا، فَلَمَّا جَاءَ اللهُ بِالْإِسْلَامِ كُنَّا نَذْبَحُ الشَّاةَ يَوْمَ السَّابِع، وَنَحْلِقُ رَأْسَهُ وَنُلَطَخُهُبِزَعْفَرَانٍ. رَوَاهُ أُبُوْ دَاوُدَ وَزَادَ رَزِيْنٌ: وَنُسَمَّيْهِ.

English

Buraydah (may Allah be pleased with him) narrated: In the pre-Islamic era, if a boy was born to one of us, we would slaughter a sheep and smear its blood on his head. When Allah brought Islam, we would slaughter a sheep on the seventh day, shave the head, and smear it with saffron. [Narrated by Abu Dawud; Razin added: “And name him.”]

وَعَنْ عَائِشَةَ رضي الله عنها أَنَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم كَانَ يُؤْتَى بِالصِّبْيَانِ فَيُبَرِّكُ عَلَيْهِمْوَيُحَنَّكُهُمْ ١. رَوَاهُ مُسْلِمُ.

English

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) would be brought infants, and he would pray for their blessing and perform tahnik for them. 1 [Narrated by Muslim]

1 The statement: “Perform tahnik for them”: Al-Nawawi said: This hadith contains benefits, including the recommendation of tahnik for a newborn at birth, which is a Sunnah by consensus. He also said elsewhere: Scholars agree on the recommendation of tahnik with dates at birth. If dates are unavailable, something similar or sweet is used. The person performing tahnik chews the date until it becomes liquid enough to swallow, then opens the infant’s mouth and places it inside so some enters its stomach. It is recommended that the person performing tahnik be righteous and blessed, whether male or female. If not present, the infant is brought to them.

١قوله: ويحنكهم: قال النووي: في هذا الحديث فوائد، منها: تحنيك المولود عند ولادته، وهو سنة بالإجماع اه.وأيضًا قال النووي في موضع آخر: اتفق العلماء على استحباب تحنيك المولود عند ولادته بتمر، فإن تعذر فما في معناهوقريب منه من الحلو، فيمضغ المحنك التمرة حتى تصير مائعة بحيث تبتلع، ثم يفتح فم المولود ويضعها فيهليدخل شيء منها جوفه، ويستحب أن يكون المحنك من الصالحين وممن يتبرك به، رجلًا كان أو امرأة، فإن لم يكنحاضرا عند المولود حمل إليه.

وَعَنْ أَسْمَاءَ بِنْتِ أَبِي بَكْرٍ أَنَّهَا حَمَلَتْ بِعَبْدِ اللهِ بْنِ الزُّبَيْرِ بِمَكَّةَقَالَتْ: فَوَلَدْتُ بِقُبَاءٍ، ثُمَّ أَتَيْتُ بِهِ رَسُولَ اللهِ صلي الله عليه واله وسلم فَوَضَعْتُهُ فِي حَجْرِهِ، ثُمَّ دَعَا بِتَمْرَةٍفَمَضَعَهَا، ثُمَّ تَفَلَ فِي فِيهِ، ثُمَّ حَنَّكَهُ، ثُمَّ دَعَا لَهُ وَبَرَّكَ عَلَيْهِ، وَكَانَ أَوَّلَ مَوْلُودٍ وُلِدَ فِيالْإِسْلَامِ. مُتَّفَقُ عَلَيْهِ.

English

Asma’ bint Abi Bakr narrated: I was pregnant with Abdullah ibn al-Zubayr in Makkah. I gave birth in Quba’, then brought him to the Messenger of Allah (ﷺ) and placed him in his lap. He called for a date, chewed it, then spat it into his mouth, performed tahnik, prayed for him, and blessed him. He was the first child born in Islam. [Narrated by Bukhari and Muslim]

وَعَنْ أَبِيْ رَافِعِ قَالَ: رَأَيْتُ رَسُوْلَ اللهِ صلي الله عليه واله وسلم أَذَّنَ ٢ فِي أُذُنِ الْحَسَنِ بْنِ عَلِيّ حِينَوَلَدَتْهُ فَاطِمَةُ بِالصَّلَاةِ. رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيْثُ

حَسَنٌ صَحِيْحُ.

English

Abu Rafi’ narrated: I saw the Messenger of Allah (ﷺ) perform adhan in the ear 2 of al-Hasan ibn Ali when Fatimah gave birth to him, with the prayer. [Narrated by al-Tirmidhi and Abu Dawud; al-Tirmidhi said: This is a hasan sahih hadith.]

2 The statement: “Perform adhan in the ear, etc.”: In “Al-Mirqat,” this indicates the Sunnah of performing adhan in the newborn’s ear. In “Sharh al-Sunnah,” it is narrated that Umar ibn Abdul Aziz would perform adhan in the right ear and iqamah in the left when a child was born. I say: In “Musnad Abi Ya’la al-Mawsili,” from al-Husayn, raised to the Prophet: “Whoever has a child born and performs adhan in its right ear and iqamah in its left will not be harmed by the mother of children (a jinn).” In “Radd al-Muhtar,” in the chapter on adhan: Adhan is not recommended except for prayers, but it is encouraged for a newborn.

٢ قوله: أذن في أذن الحسن إلخ: قال في (المرقاة): وهذا يدل على سنية الأذان في أذن المولود. وفي (شرح السنة):روي أن عمر بن عبد العزيز، كان يؤذن في اليمنى ويقيم في اليسرى إذا ولد الصبي. قلت: قد جاء في (مسند أبييعلى الموصلي) عن الحسين مرفوعًا: (من ولد له ولد فأذن في أذنه اليمنى وأقام في أذنه اليسرى لم تضره أمالصبيان) اه. وقال في (رد المحتار) في باب الأذان: لا يسن الأذان لغير الصلوات، وإلا فيندب للمولود.
