عَنِ ابْنِ عَبَّاس رضي الله عنهما قَالَ: كَانَ أَهْلُ الْجَاهِلِيَّةِ يَأْكُلُونَ أَشْيَاءَ وَيَتْرُكُونَ أَشْيَاءَتَقَذُّرًا، فَبَعَثَ اللهُ نَبِيَّهُ وَأَنْزَلَ كِتَابَهُ وَأَحَلَّ حَلَالَهُ وَحَرَّمَ حَرَامَهُ، فَمَا أَحَلَّ فَهُوَ حَلَالٌ،وَمَا حَرَّمَ فَهُوَ حَرَامٌ، وَمَا سَكَتَ عَنْهُ فَهُوَ عَفْوٌ، وَتَلَا: (قُل لَآ٢ أَجِدُ فِي مَا أُوجِىَ إِلَىَّمُحَرَّمًا عَلَى طَاعِمِ يَطْعَمُهُو إِلَّا أَن يَكُونَ مَيْتَةً) الْآَيَةَ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Ibn Abbas (may Allah be pleased with them both) narrated: The people of the pre-Islamic era ate some things and avoided others out of disgust. Then Allah sent His Prophet (ﷺ), revealed His Book, made lawful what is lawful, and prohibited what is prohibited. Whatever He made lawful is lawful, whatever He prohibited is prohibited, and whatever He was silent about is pardoned. He recited: Say, I do not find within that which was revealed to me [anything] forbidden 2 to one who would eat it unless it be a dead animal (Qur’an 6:145). [Narrated by Abu Dawud]

3 The statement: “Forbade, etc.”: This means no animal that hunts with its fangs, excluding camels, or with its claws (talons), excluding doves, is permissible. “Predator” specifies fanged animals, meaning aggressive, attacking, or killing creatures. “Bird” specifies clawed ones, excluding insects (small terrestrial creatures). Domestic donkeys are prohibited, unlike wild ones, which are permissible, as is their milk. In “Al-Durr al-Mukhtar.” In “Radd al-Muhtar,” “Al-Kifayah” states: The basis for prohibition is harmfulness, sometimes via fangs, sometimes claws, or impurity, either inherent, as in insects and vermin, or acquired, as in jallalah (animals fed impurities). The reason is that their natures are reprehensible in Shariah, lest their traits transfer through consumption, prohibiting them to honor humanity, just as permissible foods are allowed to honor them. In “Al-Hidayah,” this hadith includes hyenas and foxes, refuting al-Shafi’i’s permissibility of them. Al-Zayla’i said: The narration permitting their consumption applies to the initial ruling. In “Sharh al-Sunnah,” if an animal’s meat is not permissible, its milk is not, except human milk for infants, and if a bird’s meat is not permissible, its eggs are not. Thus, in “Al-Mirqat.”

٣ قوله: نهى رسول اللّٰه صلي الله عليه واله وسلم إلخ: يعني لا يحل ذو ناب يصيد بنابه، فخرج نحو البعير أو مخلب يصيد بمخلبه أيظفره، فخرج نحو الحمامة،(من سَبُع) بيان لذي ناب، والسبع: كل مختطف منتهب جارح قاتل عادة،(أو طير)بيان لذي مخلب، ولا الحشرات: هي صغار دواب الأرض، واحدها حشرة،(والحمر الأهلية) بخلاف الوحشية،فإنها ولبنها حلال. قاله في (الدر المختار). وقال في (رد المحتار): وفي (الكفاية): والمؤثر في الحرمة الإيذاء، وهوطَوْرًا يكون بالناب وتارةً يكون بالمخلب، أو الخبث وهو قد يكون خلقة كما في الحشرات والهوام. وقد يكون بعارضكما في الجلالة. والسر فيه أن طبيعة هذه الأشياء مذمومة شرعًا فيخشى أن يتولد من لحمها شيء من طباعها فيحرمإكراما لبني آدم، كما أنه يحل ما أحل إكراما له، عن الحموي، انتهى. وقال في (الهداية): ويدخل في هذا الحديث الضبعوالثعلب، فيكون الحديث حجة على الشافعي في إباحتهما اه. وقال الزيلعي: وما روي أنه عليه السلام إباح أكلها محمول علىالابتداء، انتهى. وفي (شرح السنة): كل حيوان لا يحل أكله، فلا يحل شرب لبنه إلا الآدميات، يعني للأطفال، وكلطير لا يحل لحمه لا يحل بيضه. كذا في (المرقاة).

Abu Qatadah (may Allah be pleased with him) narrated: He saw a wild donkey, killed it, and the Prophet (ﷺ) said: “Do you have any of its meat?” He said: “We have its leg.” The Prophet took and ate it. [Narrated by Bukhari and Muslim]

Zahir al-Aslami (may Allah be pleased with him) narrated: I was cooking pots with donkey meat when the caller of the Messenger of Allah (ﷺ) announced that the Messenger of Allah (ﷺ) forbids you from the meat of donkeys. [Narrated by Bukhari]

Khalid ibn al-Walid (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) forbade eating the meat of horses, 2 mules, and donkeys. [Narrated by Abu Dawud and al-Nasa’i]

In a narration agreed upon by Bukhari and Muslim, Jabir (may Allah be pleased with him) narrated: On the day of Khaybar, the Messenger of Allah (ﷺ) forbade the meat of domestic donkeys but permitted the meat of horses.

2 The statement: “Forbade eating the meat of horses, etc.”: In “Bazl al-Majhud,” narrations differ regarding Imam Abu Hanifah on horse meat. Per al-Hasan’s narration, he prohibited it. Per the apparent narration, he disliked it without declaring it prohibited due to conflicting hadiths and early scholars’ differences, disliking it as a precaution. Abu Hanifah’s evidence, per al-Hasan, from the Qur’an is: And [He created] the horses, mules, and donkeys for you to ride and [as] adornment (Qur’an 16:8). Ibn Abbas cited this for disliking horse meat, as it does not say “to eat.” From the Sunnah, Jabir narrated: On Khaybar, people faced famine, slaughtered donkeys, and the Prophet (ﷺ) prohibited donkey and horse meat. Khalid ibn al-Walid narrated: “The Prophet (ﷺ) forbade horse, mule, and donkey meat.” Miqdam ibn Ma’dikarib narrated: “The Prophet (ﷺ) prohibited domestic donkeys and their horses.” This explicitly prohibits. By consensus, mule meat is prohibited, and as a horse’s offspring, if the mother were permissible, the mule would be, as the offspring follows the mother’s ruling. Since the mule is prohibited, so is the horse. Permissive hadiths may apply to when donkeys were eaten at Khaybar, and horses were eaten then but later prohibited. Al-Zuhri said: “We know of no horse meat eaten except during a siege.” Al-Hasan said: “The Prophet’s companions ate horse meat during campaigns,” indicating necessity, as al-Zuhri stated, or the prohibitive narration is preferred for caution. Mawlana Muhammad Yahya noted: “And permitted horse meat” explicitly applies to Khaybar. The later narration clarifies the permission was tacit approval. ٢ قوله: نهى عن أكل لحوم الخيل إلخ: وقال في (بذل المجهود): اختلفت الروايات عن الإمام أبي حنيفة في لحومالخيل، فعلى رواية الحسن عنه أنه يحرم أكل لحم الخيل، وأما على ظاهر الرواية عن أبي حنيفة أنه يكره أكله،ولم يطلق التحريم لاختلاف الأحاديث المروية في الباب واختلاف السلف، وكرهها احتياطا لباب الحرمة، وأماالاستدلال لأبي حنيفة رحمة اللّٰه عليه على رواية الحسن بالكتاب، فبقوله جل شأنه: (وَالخَيْلَ وَٱلْبِغَالَ وَٱلْخَمِيرَالِتَرْكَبُوهَا وَزِينَةَ) (النحل: ٨) واستدل به ابن عباس على كراهة أكلها، وهو أنه سئل عن لحم الخيل، فقرأ بهذه الآية،ولم يقل تبارك وتعالى: (لتأكلوها).

وأما السنة فما روي عن جابر: لما كان يوم خيبر أصاب الناس مجاعة، فأخذوا الحمر الأهلية فذبحوها، فحرمرسول الله صلي الله عليه واله وسلم لحوم الحمر الإنسية، ولحوم الخيل،الحديث. وعن خالد بن الوليد أنه قال:( نهى رسول لله صلي الله عليه واله وسلم عن أكل لحوم الخيل والبغال والحمر)، وعن المقدام بن معديكرب: أن النبي صلي الله عليه واله وسلم قال: (حرم عليكم الحمار الأهليوخيلها). وهذا نص على التحريم، وبالإجماع وهو أن البغل حرام بالإجماع، وهو ولد الفرس، فلو كانت أمه حلالالكان هو حلالا أيضًا؛ لأن حكم الولد حكم أمه؛ لأنه منها، وهو كبعضها، فلما كان لحم الفرس حراما كان لحم البغلكذلك.

وأما ما ورد من الأحاديث في باب الإذن والإباحة فيحتمل أنه كان ذلك في الحال التي كان يؤكل فيها الحمر يومخيبر، وكانت الخيل تؤكل في ذلك الوقت، ثم حرمت، يدل عليه ما روي عن الزهري أنه قال: ما علمنا الخيل أكلتإلا في حصار، وعن الحسن أنه قال: كان أصحاب رسول اللّٰه صلي الله عليه واله وسلم يأكلون لحوم الخيل في مغازيهم، فهذا يدل على أنهمكانوا يأكلونها حال الضرورة، كما قال الزهري، أو يحمل على هذا عملا بالدليل صيانة لها عن التناقض أو يترجحالحاظر على المبيح احتياطا، وكتب مولانا محمد يحيى المرحوم قوله: (وأذن لنا في لحوم الخيل) فيه تصريح بأنه كانذلك يوم خيبر، والرواية الآتية تفسير المراد بالإذن أنه كان تقريرا منه صلي الله عليه واله وسلم ثم إن خالد روى التحريم، ولا شك فيأنه أسلم بعد خيبر، فلم تكن رواية التحريم إلا متأخرة، والأصل في رواية الصحابي أنه سمع من غير واسطة،واحتمال الواسطة عدول عن الظاهر، فلا يسلم من غير ضرورة، انتهى.

وقال في (الدر المختار) لا تحل الخيل عنده، وعندهما والشافعي تحل. وقيل: إن أبا حنيفة رجع عن حرمته قبلموته بثلاثة أيام، وعليه الفتوى اه. وقال في (رد المحتار): فهو مكروه كراهة تنزيه، وهو ظاهر الروية، كما في (كفايةالبيهقي) وهو الصحيح على ما ذكره فخر الإسلام وغيره، (قهستاني). ثم نقل تصحيح كراهة التحريم عن (الخلاصة) و(الهداية) و(المحيط ) و(المغني) و(قاضي خان) و(العمادي) وغيرهم، وعليه المتون، وأفاد أبو السعود أنه علىالأول لا خلاف بين الإمام وصاحبيه؛ لأنهما وإن قالا بالحل لكن مع كراهة التنزيه، كما صرَّح به في (الشرنبلالية) عن (البرهان)، قال ط: والخلاف في خيل البر، أما البحر فلا تؤكل اتفاقا.

وَعَنْ أَنَسِ رضي الله عنه قَالَ: أَنْفَجْنَا أَرْنَبًا بِمَرِّ الظَّهْرَانِ فَأَخَذْتُهَا، فَأَتَيْتُ بِهَا أَبَاطَلْحَةَ، فَذَبَحَهَا وَبَعَثَ إِلَى رَسُوْلِ اللهِصلي الله عليه واله وسلم بِوَرِكِهَا وَفَخِذَيْهَا، فَقَبِلَهُ.١ مُتَّفَقُ عَلَيْهِ.

English

Anas (may Allah be pleased with him) narrated: We startled a rabbit at Marr al-Zahran, I caught it and brought it to Abu Talhah, who slaughtered it and sent its haunch and thighs to the Messenger of Allah (ﷺ), who accepted it. 1 [Narrated by Bukhari and Muslim]

وَعَنْ عَبْدِ الرَّحْمَنِ بْنِ شِبْلٍ أَنَّ النَّبِيَّ صلي الله عليه واله وسلم نَهَى ٢ عَنْ أَكْلٍ لَحْمِ الضَّبِّ. رَوَاهُأَبُوْ دَاوُدَ وَسَكَتَ ٣ عَلَيْهِ فَهُوَ حَسَنٌ أَوْ صَحِيْحٌ عِنْدَهُ.وَقَالَ فِي (الدُّرِّ الْمُخْتَارِ): وَمَارُوِيَ مِنْ أَكْلِهِ مَحْمُوْلُ عَلَى الإِبْتِدَاءِ.

2 The statement: “Forbade eating lizard meat”: Lizard is called “susmar” in Persian and “goh” in Hindi. It is disliked by us. Our jurists say it is prohibitively disliked; our hadith scholars say it is mildly disliked. Al-Shafi’i and others say it is permissible. We say the Prophet (ﷺ) was uncertain initially, then settled on avoiding it. Shafi’is say the prohibition was initial, then permitted. Authentic hadiths exist for both permission and prohibition, differing in sequence. Muslim’s narration of the prohibition as final suffices. In “Urf al-Shadhi.” In “Bazl al-Majhud,” the Prophet (ﷺ) initially permitted it but avoided it out of disgust, saying it was not in his people’s land, so he found it repulsive. He hesitated, suspecting it might be metamorphosed, neither commanding nor prohibiting it, leaving it permissible initially. Later, he prohibited it, making it prohibited. This view prioritizes prohibition over permission.

3 The statement: “Remained silent on it, etc.”: Al-Mundhiri said: Its chain includes Ismail ibn Ayyash and Damdam ibn Zur’ah, who are debated. We say: Ismail’s narrations from Syrians are authentic, and Damdam is Syrian (from Homs). Al-Bayhaqi admitted his narrations from Syrians are authentic, as in the hadith on not performing wudu from blood, so Abu Dawud’s silence indicates it is hasan or sahih. Bukhari, Ibn Ma’in, and others affirmed Ismail’s authenticity from Syrians. Damdam is truthful but prone to errors, a trait in many Sahih narrators, so the hadith is authentic. Al-Ayni said: Al-Tirmidhi authenticated Ismail’s narration from Sharhabil ibn Muslim from Abu Umamah, so the chain is authentic. Thus, in “Tansiq al-Nizam.”

In “Al-Durr al-Mukhtar,” narrations of eating it apply to the initial ruling.

٢ قوله: نهى عن أكل لحم الضب: يقال للضب في الفارسية: (سوسمار). وفي الهندية (گوه). وهذه مكروهة عندنا. وقالفقهاؤنا بكراهة تحريمة، ومحدثونا بكراهة تنزيهة. وقال الشافعي وغيره: إنها حلال، ونقول: إنه عليه السلام كان متوقفا في أولالزمان، ثم استقر رأيه على تركه. وقال الشافعية: إن النهي كان أولا ثم أجاز النبي صلي الله عليه واله وسلم ، وأقوال الأحاديث الصحاحفي الإجازة والنهي موجودة، والخلاف في الترتيب، ويكفينا ما ذكره مسلم في كتابه؛ فإنه ذكر النهي آخرًا. قاله في (العرف الشذي). وقال في (بذل المجهود): إن رسول اللّٰه :صلي الله عليه واله وسلم أباحه أولا، ولكن ترك أكله تقذُّرًا، واعتذر بأنه لميكن في أرض قومي فأجدني أعافه، ثم تردد فيه باحتمال كونها من الممسوخات، فلم يأمر فيه بشيء ولم ينه عنه، فكانفي حكم الإباحة الأصلية، ثم بعد ذلك نهى عنه، فصار حراما، وهذا الوجه أولى؛ لأن فيه تغليب الحظر على الإباحة.

Al-Tahawi narrated in his hunting book: Abu Hanifah was asked if locusts are like fish, eaten whether named or not, found anywhere, even dead on the ground or killed by rain. وَرَوَى مَالِكٌ عَنْ نَافِعٍ أَنَّ عَبْدَ الرَّحْمَنِ بْنَ أَبِيْ هُرَيْرَةَ سَأَلَ عَبْدَ اللهِ بْنَ عُمَرَ عَمَّالَفَظَ الْبَحْرُ، فَنَهَاهُ عَنْ أَكْلِهِ، قَالَ نَافِعُ: ثُمَّ انْقَلَبَ عَبْدُ اللهِ، فَدَعَا بِالْمُصْحَفِ، فَقَرَأَ:(أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُو مَتَعًا لَكُمْ وَلِلسَّيَّارَةِ) (المائدة٩٦). قَالَ نَافِعُ: فَأَرْسَلَنِيعَبْدُ اللهِ بْنُ عُمَرَ إِلَى عَبْدِ الرَّحْمَنِ بْنِ أَبِي هُرَيْرَةَ: إِنَّهُ لَا بَأْسَ بِأَكْلِهِ.

قَالَ مُحَمَّدٌ: وَبِقَوْلِ ابْنِ عُمَرَ الْآخِرِ نَأْخُذُ، لَا بَأْسَ بِمَا لَفَظَهُ الْبَحْرُ، وَبِمَا حَسَرَ عَنْهُ الْمَاءُ،إِنَّمَا يُكْرَهُ مِنْ ذَلِكَ الطَّافِي. وَهُوَ ١قَوْلُ أَبِيْ حَنِيْفَةَ وَالْعَامَةِ مِنْ فُقَهَائِنَا رَحِمَهُمُ اللهُ تَعَالَى.

English

Jabir (may Allah be pleased with him) narrated: We campaigned at Jaysh al-Khabat under Abu Ubaydah, facing severe hunger. The sea cast out a dead creature we had never seen, called amber, and we ate it for half a month. Abu Ubaydah took one of its bones, and a rider passed under it. When we returned, we mentioned it to the Prophet (ﷺ), who said: “Eat the provision Allah has brought forth for you, and feed us if you have any.” We sent some to the Messenger of Allah (ﷺ), and he ate it. [Narrated by Bukhari and Muslim]

Malik narrated from Nafi’ that Abd al-Rahman ibn Abi Hurayrah asked Abdullah ibn Umar about what the sea casts out, and he forbade eating it. Nafi’ said: Then Abdullah returned, called for the Qur’an, and read: Lawful to you is the game of the sea and its food as provision for you and the travelers (Qur’an 5:96). Nafi’ said: Abdullah sent to Abd al-Rahman ibn Abi Hurayrah, saying: “There is no harm in eating it.”

Muhammad said: We adopt Ibn Umar’s later view; there is no harm in what the sea casts out or what water recedes from. Only floating fish is disliked. This is Abu Hanifah’s view 1 and that of most of our jurists, may Allah have mercy on them.

Al-Daraqutni and al-Bayhaqi narrated permissibility of floating fish from Abu Bakr and Abu Ayyub. Abu al-Zubayr, from Jabir (may Allah be pleased with him), narrated: The Messenger of Allah (ﷺ) said: “Eat what the sea casts out or leaves behind; do not eat what dies in it and floats.”2 [Narrated by Abu Dawud and Ibn Majah]

Muhyi al-Sunnah said: Most consider it a stopped narration (mawqoof) on Jabir. Ali al-Qari said: This does not harm, as such a mawqoof narration has the ruling of a marfoo’ (prophetic) one.

It also indicates that creatures without flowing blood, like flies, bees, scorpions, beetles, or wasps, do not render small amounts of water or drink impure if they die in it. Submerging a fly might kill it, so if it rendered food impure, the Prophet (ﷺ) would not have ordered it to avoid contamination. This is the view of most jurists. In “Ikhtilaf al-A’immah,” Abu Hanifah and Malik say it does not render liquids impure and is pure itself. The preferred Shafi’i view is it does not render liquids impure but becomes impure upon death, as per Ahmad. وَعَنْ مَيْمُونَةَ رضي الله عنها أَنَّ فَأْرَةً وَقَعَتْ فِي سَمْنٍ فَمَاتَتْ، فَسُئِلَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم عَنْهَا، فَقَالَ:(أَلْقُوهَا١ وَمَا حَوْلَهَا وَكُلُوهُ). رَوَاهُ الْبُخَارِيُّ.

وَذَكَرَ هَذَا الْحَدِيْثَ صَاحِبُ (التَّمْهِيْدِ) أَيْضًا، وَقَالَ الْعَلَّامَةُ الْعَيْنِيُّ: وَالْبَيْعُ مِنْ بَابِ الإِنْتِفَاعِ. وَرُوِيَ عَنْ أَبِيْ مُوْسَى رضي الله عنه أَنَّهُ قَالَ: بِيْعُوْهُ وَبَيَّنُوْ لِمَنْ تَبِيْعُوْنَهُ مِنْهُ، وَلَا تَبِيْعُوْهُمِنْ مُسْلِمٍ.وَرُوِيَ عَنِ ابْنِ وَهْبٍ عَنِ الْقَاسِمِ وَسَالِمٍ أَنَّهُمَا أَجَازا بَيْعَهُ وَأَكْلَ ثَمَنِهِ بَعْدَالْبَيَانِ. وَقَالَ عَلِيُّ الْقَارِي: وَالْمُرَادُ مِنْ قَوْلِهِ صلي الله عليه واله وسلم ( فَلَا تَقْرَبُوْهُ) أَكْلًا وَطَعْمًا لَا انْتِفَاعًا.

English

Maymunah (may Allah be pleased with her) narrated: A mouse fell into ghee and died. The Messenger of Allah (ﷺ) was asked about it and said: “Remove it and what is around it, then eat it.” [Narrated by Bukhari]

Al-Tahawi narrated in “Al-Mushkil” and “Ikhtilaf al-Ulama” with a reliable chain from Abu Hurayrah that the Prophet (ﷺ) was asked about a mouse falling into ghee. He said: “If it is solid, take it and what is around it and discard them. If it is melted or liquid, use it for lighting or benefit from it.” The author of “Al-Tamhid” mentioned this hadith. Al-Ayni said: Selling is a form of benefit. Abu Musa narrated: “Sell it, disclose its condition to the buyer, and do not sell it to a Muslim.” Ibn Wahb narrated from al-Qasim and Salim that they permitted its sale and eating its price after disclosure. Ali al-Qari said: The Prophet’s (ﷺ) saying “do not approach it” means for eating or tasting, not for benefit.

1 The statement: “Remove it and what is around it, then eat it”: In “Umdat al-Qari,” there is consensus that this applies to solid ghee. For liquid ghee or other liquids, there is no dispute that if a mouse or similar falls in, none is eaten. They differed on selling or benefiting from it. Al-Hasan ibn Salih and Ahmad said it cannot be sold or benefited from, as it cannot be eaten. Al-Thawri, Malik, and al-Shafi’i said it can be used for lighting or soap but not sold or eaten. Abu Hanifah, his companions, and al-Layth said it can be benefited from in all ways except eating and sold with disclosure. Our evidence includes al-Tahawi’s hadith and narrations from Abu Musa and Ibn Wahb.

وَعَنِ ابْنِ عُمَرَرضي الله عنهما أَنَّهُ سَمِعَ النَّبِيَّ صلي الله عليه واله وسلم يقُوْلُ: (اقْتُلُوْا٢ الْحَيَّاتِ، وَاقْتُلُواذَا الطُّفْيَتَيْنِ وَالْأَبْتَرَ، فَإِنَّهُمَا يَطْمِسَانِ الْبَصَرَ، وَيَسْتَسْقِطَانِ الْحَبَلَ)، قَالَ عَبْدُ اللهِ: فَبَيْنَاأَنَا أُطَارِدُ حَيَّةً أَقْتُلُهَا نَادَانِي أَبُو لُبَابَةَ: لَا تَقْتُلْهَا، فَقُلْتُ: إِنَّ رَسُولَ اللهِ صلي الله عليه واله وسلم أَمَرَ بِقَتْلِالْحَيَّاتِ، فَقَالَ: إِنَّهُ نَهَى بَعْدَ ذَلِكَ عَنْ ذَوَاتِ الْبُيُوتِ، وَهُنَّ الْعَوَامِرُ. مُتَفَقُ عَلَيْهِ.

وَقَالَ فِي (الدُّرِّ الْمُخْتَارِ): فِيْهِ الْأَمْرُ بِالْقَتْلِ لِلْإِبَاحَةِ؛ لِأَنَّهُ مَنْفَعَةٌ لَنَا، فَالْأَوْلَى تَرْكُالْحَيَّةِ الْبَيْضَاءِ لِخَوْفِ الْأَذَى.

Ibn Umar (may Allah be pleased with them both) narrated: He heard the Prophet (ﷺ) say: “Kill snakes, and kill the two-striped and short-tailed ones, for they blind the sight and cause miscarriage.” 2 Abdullah said: While chasing a snake to kill it, Abu Lubabah called: “Do not kill it.” I said: “The Messenger of Allah (ﷺ) ordered killing snakes.” He said: “After that, he forbade killing house snakes, called al-awamir.” [Narrated by Bukhari and Muslim]

2 The statement: “Kill snakes, etc.”: In “Radd al-Muhtar,” al-Tahawi said: There is no harm in killing all snakes, as the Prophet (ﷺ) made a pact with jinn not to enter his community’s homes. If they enter, they break the pact, losing protection. The better approach is to warn them, saying: “Return by Allah’s permission,” and kill if they refuse, except during prayer. In “Al-Hilyah,” al-Tahawi and others, including Ibn al-Humam, agreed. Ibn al-Humam said: The truth is permissibility remains, but it is better to avoid those with jinn signs, not for prohibition but to avoid potential harm.

In “Al-Durr al-Mukhtar,” the command to kill is for permissibility, as it benefits us, but it is better to avoid killing white snakes due to fear of harm.

Al-Abbas narrated: “O Messenger of Allah, we want to clean Zamzam, and it contains these small snakes (jinnan).” The Messenger of Allah (ﷺ) ordered their killing. [Narrated by Abu Dawud]

وَعَنْ أَبِيْ السَّائِبِ قَالَ: دَخَلْنَا عَلَى أَبِيْ سَعِيْدٍ الْخُدْرِيِّ، فَبَيْنَمَا نَحْنُ جُلُوسٌ إِذْسَمِعْنَا تَحْتَ سَرِيرِهِ حَرَكَةً، فَنَظَرْنَا فَإِذَا فِيْهِ حَيَّةٌ، فَوَتَبْتُ لِأَقْتُلَهَا وَأَبُوْ سَعِيْدٍ يُصَلِّيْ،فَأَشَارَ إِلَيَّ أَنْ اجْلِسْ فَجَلَسْتُ، فَلَمَّا انْصَرَفَ أَشَارَ إِلَى بَيْتٍ فِي الدَّارِ، فَقَالَ: أَتَرَى هَذَاالْبَيْتَ؟ فَقُلْتُ: نَعَمْ، فَقَالَ: كَانَ فِيْهِ فَتَّى مِنَّا حَدِيثُ عَهْدٍ بِعُرْسِ. قَالَ: فَخَرَجْنَا مَعَرَسُولِ اللهِ صلي الله عليه واله وسلم الَى الْخَنْدَقِ، فَكَانَ ذَلِكَ الْفَتَى يَسْتَأْذِنُ رَسُولَ اللهِ صلي الله عليه واله وسلم بِأَنْصَافِ النَّهَارِ،فَيَرْجِعُ إِلَى أَهْلِهِ، فَاسْتَأْذَنَهُ يَوْمًا، فَقَالَ لَهُ رَسُول اللهِ صلي الله عليه واله وسلم :(خُذْ عَلَيْكَ سِلَاحَكَ، فَإِنِّيأَخْشَى عَلَيْكَ قُرَيْظَةَ، فَأَخَذَ الرَّجُلُ سِلَاحَهُ، ثُمَّ رَجَعَ، فَإِذَا امْرَأَتُهُ بَيْنَ الْبَابَيْنِ قَائِمَةً،فَأَهْوَى إِلَيْهَا الرُّمْحَ لِيَطْعُنَهَا بِهِ، وَأَصَابَتْهُ غَيْرَةٌ، فَقَالَتْ لَهُ: اكُفُفْ عَلَيْكَ رُمْحَكَ، وَادْخُلْالْبَيْتَ حَتَّى تَنْظُرَ مَا الَّذِي أَخْرَجَنِي، فَدَخَلَ فَإِذَا بِحَيَّةٍ عَظِيمَةٍ مُنْطَوِيَةٍ عَلَى الْفِرَاشِ،فَأَهْوَى إِلَيْهَا بِالرُّمْحِ، فَانْتَظَمَهَا بِهِ، ثُمَّ خَرَجَ فَرَكَزَهُ فِي الدَّارِ، فَاضْطَرَبَتْ عَلَيْهِ، فَمَا يُدْرَىأَيُّهُمَا كَانَ أَسْرَعَ مَوْتًا، الْحَيَّةُ أَمْ الْفَتَى.

قَالَ: فَجِئْنَا رَسُولَ اللهِ صلي الله عليه واله وسلم وَذَكَرْنَا ذَلِكَ لَهُ، وَقُلْنَا: ادْعُ اللهَ يُحْبِيهِ لَنَا، فَقَالَ:(اسْتَغْفِرُوا لِصَاحِبِكُمْ)، ثُمَّ قَالَ:(إِنَّ لِهَذِهِ الْبُيُوْتِ عَوَامَرَ، فَإِذَا رَأَيْتُمْ مِنْهَا شَيْئًا فَحَرَّجُواعَلَيْهَا ثَلَاثًا، فَإِنْ ذَهَبَ، وَإِلَّا فَاقْتُلُوهُ؛ فَإِنَّهُ كَافِرً). وَقَالَ لَهُمْ: (اذْهَبُوا فَادْفِنُوا صَاحِبَكُمْ). وَفِي رِوَايَةٍ: (قَالَ إِنَّ بِالْمَدِينَةِ جِنَّا قَدْ أَسْلَمُوا فَإِذَا رَأَيْتُمْ مِنْهُمْ شَيْئًا فَآذِنُوهُ ثَلَاثَةَ أَيَّامٍ، فَإِنْبَدَا لَكُمْ بَعْدَ ذَلِكَ فَاقْتُلُوهُ؛ فَإِنَّمَا هُوَ شَيْطَانُ). رَوَاهُ مُسْلِمٌ.

Abu al-Sa’ib narrated: We visited Abu Sa’id al-Khudri, and while we were sitting, we heard movement under his bed. We looked and found a snake. I jumped to kill it, but Abu Sa’id was praying and signaled me to sit, so I sat. When he finished, he pointed to a house in the courtyard and said: “Do you see that house?” I said: “Yes.” He said: “There was a young man among us recently married. We went with the Messenger of Allah (ﷺ) to the Trench, and this young man would seek the Prophet’s permission at midday to return to his family. One day, he sought permission, and the Messenger of Allah (ﷺ) said: ‘Take your weapon, for I fear Qurayzah may harm you.’ The man took his weapon and returned, finding his wife standing between the doors. Overcome with jealousy, he aimed his spear to strike her. She said: ‘Hold your spear and enter the house to see what drove me out.’ He entered and found a large snake coiled on the bed. He struck it with his spear, piercing it, then went out and planted the spear in the courtyard. The snake writhed on it, and it is unclear which died first, the snake or the young man. We came to the Messenger of Allah (ﷺ), informed him, and said: ‘Pray to Allah to revive him for us.’ He said: ‘Seek forgiveness for your companion.’ Then he said: ‘These houses have dwellers (snakes). If you see any, warn them for three days. If they leave, fine; otherwise, kill them, for they are disbelievers.’ He also said: ‘Go and bury your companion.’ In another narration: ‘There are jinn in Madinah who have embraced Islam. If you see any of them, warn them for three days. If they appear after that, kill them, for they are devils.’ [Narrated by Muslim]

Abd al-Rahman ibn Abi Layla narrated: Abu Layla (may Allah be pleased with him) said: The Messenger of Allah (ﷺ) said: “If a snake appears in your dwelling, say to it: ‘We ask you by the covenant of Noah and the covenant of Solomon ibn Dawud not to harm us.’ If it returns, kill it.” [Narrated by al-Tirmidhi and Abu Dawud]

Abu Tha’labah al-Khushani narrated, raising it to the Prophet (ﷺ): “The jinn are of three types: one type has wings and flies in the air, another type is snakes and dogs, and a third type settles and travels.” [Narrated in “Sharh al-Sunnah”]

وَعَنْ أُمَّ شَرِيْكِ أَنَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم أَمَرَ ١ بِقَتْلِ الْوَزَعِ، وَقَالَ: (كَانَ يَنْفُخُعَلَى إِبْرَاهِيمَ عليه السلام). مُتَّفَقُ عَلَيْهِ.

وَنَقَلَ ابْنُ عَبْدِ الْبَرِّ الإِتَّفَاقَ عَلَى جَوَازٍ قَتْلِهِ، كَذَا فِي (الْفَتْحِ) وَ(الْعَيْنِيِّ). قَالَ مُحَمَّدٌفي (الْمُوَطَّأ): وَبِهَذَا نَأْخُذُ، وَهُوَ قَوْلُ أَبِيْ حَنِيْفةَ وَالْعَامَةِ مِنْ فُقَهَائِنَا.

English

Umm Sharik narrated: The Messenger of Allah (ﷺ) ordered the killing of geckos 1 and said: “It used to blow on Ibrahim (peace be upon him).” [Narrated by Bukhari and Muslim]

Ibn Abd al-Barr reported consensus on the permissibility of killing geckos, as stated in “Al-Fath” and “Al-Ayni.” Muhammad said in “Al-Muwatta”: We adopt this, and it is the view of Abu Hanifah and most of our jurists.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “An ant bit a prophet among the prophets, so he ordered the ant colony burned. Allah revealed to him: ‘Because one ant bit you, you burned a nation among nations that glorifies [Me]?’” [Narrated by Bukhari and Muslim]

2 The statement: “The bee”: In “Hayat al-Hayawan,” Mujahid disliked killing bees, and eating them is prohibited, though honey is permissible, as human milk is permissible but human flesh is not. Some early scholars permitted eating bees like locusts. The prohibition is evidenced by the Prophet’s (ﷺ) prohibition on killing them. In “Al-Ibanah,” selling bees is disliked, especially in hives unless fully visible; otherwise, it is selling the unseen. Abu Hanifah said: Selling bees, wasps, or insects is invalid. Thus, in “Al-Mirqat.”

3 The statement: “The shrike”: In “Al-Mirqat,” the shrike (surad) is a bird with a large head and beak, its feathers half white, half black, per “Al-Nihayah.” In “Al-Ghayath”: A large-headed bird that hunts sparrows, called “warkak” in Persian and “lanura” in Hindi, per “Tarjumat al-Shafiyah.” Arabs took omens from its sound or appearance, so the Prophet (ﷺ) forbade killing it to remove their superstitious beliefs. This alludes to the narration: “O Allah, there is no omen but Your omen, no good but Your good, no god but You. O Allah, none brings good deeds but You, and none averts evil but You.” In “Hayat al-Hayawan,” the sounder view is that eating the shrike is prohibited due to this hadith. Some said it is permissible, as al-Shafi’i required compensation for killing it in ihram, as did Malik.

Ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) forbade eating jallalah5 (animals fed impurities) and their milk. [Narrated by al-Tirmidhi] In Abu Dawud’s narration: “He forbade riding jallalah.”

5 The statement: “Forbade eating jallalah, etc.”: In “Sharh al-Sunnah,” for an animal that eats filth, if it does so occasionally, like chickens, it is not jallalah, and eating it is not prohibited. If most of its feed is filth, affecting its meat and milk, scholars differed. Some, including al-Shafi’i, Ahmad, and Abu Hanifah, said it is not permissible unless confined and fed clean feed until its meat is purified. Al-Hasan saw no issue with eating jallalah, as did Malik. Ishaq said it is permissible after thorough washing. In “Rahmat al-Ummah,” jallalah, whether camel, sheep, or chicken, is disliked by Abu Hanifah, Abu Yusuf, and Muhammad. Ahmad said its meat, milk, and eggs are prohibited until confined and fed clean feed until the impure odor is gone, removing the dislike unanimously. Some said: Camels and cows are confined for forty days, sheep for seven, chickens for three. In “Radd al-Muhtar,” in the section on leftover water, they stated jallalah cannot be sacrificed, as noted in sacrifices. In “Sharh al-Wahbaniyyah” and “Al-Muntaqa,” jallalah with a foul odor is not eaten, its milk not drunk, nor used for work, and its sale or gifting is disliked in that state. Al-Baqqali said its sweat is impure. The author in “Al-Hazr wal-Ibahah” stated that female donkey and jallalah meat is disliked. The commentator said: Jallalah is confined until its meat’s odor is gone, three days for chickens, four for sheep, ten for camels and cows, per the sounder view. If it eats filth and clean feed without affecting its meat, it is permissible. Thus, jallalah whose leftover water is disliked is one that eats only filth until its meat is foul, as it is then inedible. In “Al-Jawharah,” if it mixes feed or most of its feed is clean, its leftover water is not disliked.

وقال في (رحمة الأمة): الجلالة من بعير أو شاة أو دجاجة، يكره أكلها باتفاق الثلاثة. وقال أحمد: يحرم لحمهاولبنها وبيضها، فإن حبست وعلفت طاهرا حتى زالت رائحة النجاسة حلت وزالت الكراهة بالاتفاق. ثم قيل:يحبس البعير والبقرة أربعين يوما، والشاة سبعة أيام، والدجاجة ثلاثة أيام، انتهى. وقال في (رد المحتار) في فصلالسؤر: إنهم صرحوا بأن الجلالة لا يضحى بهما، كما يأتي في الأضحية، قال في (شرح الوهبانية): وفي (المنتقى): الجلالةالمكروهة التي إذا قربت وجدت منها رائحة فلا تؤكل، ولا يشرب لبنها، ولا يعمل عليها، ويكره بيعها وهبتها وتلكحالها، وذكر البقالي أن عرقها نجس اه.

وصرح المصنف في الحظر والإباحة أنه يكره لحم الأتان والجلالة، قال الشارح هناك: وتحبس الجلالة حتىيذهب نتن لحمها، وقدر بثلاثة أيام لدجاجة، وأربعة لشاة، وعشرة لإبل وبقر على الأظهر. ولو أكلت النجاسةوغيرها بحيث لم ينتن لحمها حلت. وبه علم أن الجلالة التي يكره سؤرها هي التي لا تأكل إلا لنجاسة حتى أنتنلحمها؛ لأنها حينئذٍ غير مأكولة، ولذا قال في (الجوهرة): فإن كانت تخلط أو أكثر علفها علف الدواب لا يكرهسؤرها.

وَرَوَى الْبَيْهَقِيُّ فِي (السُّنَنِ الْكُبْرَى) عَنْ عَطَاءٍ قَالَ: لَا بَأْسَ بِثَمَنِ ٢ السَّنَّوْرِ.

وَقَالَ الْخَطَابِيُّ: وَمِمَّنْ أَجَازَ بَيْعَ السِّنَّوْرِ ابْنُ عَبَّاس، وَإِلَيْهِ ذَهَبَ الْحَسَنُ البَصْرِيُّوَابْنُ سِيْرِيْنَ وَالْحَكَمُ وَحَمَادٌ، وَبِهِ قَالَ مَالِكُ بْنُ أَنَسِ وَسُفْيَانُ الثَّوْرِيُّ وَأَبُوْ حَنِيْفةَ، وَهُوَقَوْلُ الشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ.

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “The cat is among the predatory animals.” 1 [Narrated by al-Tahawi in “Mushkil al-Athar”]

Al-Bayhaqi narrated in “Al-Sunan al-Kubra” from Ata’ who said: “There is no harm in the price of a cat.” 2

Al-Khattabi said: Among those who permitted the sale of cats are Ibn Abbas, al-Hasan al-Basri, Ibn Sirin, al-Hakam, Hammad, Malik ibn Anas, Sufyan al-Thawri, Abu Hanifah, al-Shafi’i, and Ahmad.

The sale of vermin of the land, like beetles, or sea vermin, like crabs, and all sea creatures except fish, is not permissible, even if not harmful. ٢ قوله: لا بأس بثمن السنور: يعني صحّ بيع السباع من البهائم بسائر أنوعها حتى الهرة، فبيع الهرة جائز؛ لأنها ينتفعبها في دفع مؤذيات البيت وبجلدها، ويجوز بيع كل ذي ناب من السباع كالأسد والفهد والضبع والذئب وذي مخلبمن الطيور لجواز الانتفاع بها شرعا إلا الخنزير؛ فإنه نجس العين، ولا يجوز الانتفاع به فكذا لا يجوز بيعه، ولا يجوز بيعهوام الأرض كالخنافس ولا هوام البحر كالسرطان وكل ما عدا السمك، وإن لم تكن مؤذية، ويجوز بيع ماله ثمنكالسَّقَنْقور، ويجوز بيع الحيات إن انتفع بها في الأدوية وإلا لا، هذا حاصل ما في (الكنز) وشروحها.

وَعَنْ خَالِدٍ بْنِ الْوَلِيدِ قَالَ: غَزَوْتُ مَعَ النَبِيِّ صلي الله عليه واله وسلم يَومَ خَيْبَرَ، فَأَتَتِ الْيَهُودُفَشَكَوْا أَنَّ النَّاسَ قَدْ أَسْرَعُوا إِلَى حَضَائِرِهِمْ، فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم : (أَلَا لَا يَحِلُّ أَمْوَالُالْمُعَاهَدِينَ إِلَّا بِحَقِّهَا). رَوَاهُ أَبُوْ دَاوُدَ.

English

Khalid ibn al-Walid narrated: I campaigned with the Prophet (ﷺ) on the day of Khaybar. The Jews came complaining that people had rushed to their enclosures. The Messenger of Allah (ﷺ) said: “The wealth of those under a covenant is not lawful except by its right.” [Narrated by Abu Dawud]
