وَقَوْلِ اللهِ عَزَّ وَجَلَّ: (وَان جَنَحُواْ لِلسَّلْمِ فَاجْنَحْ لَهَا وَتَوْكَلْ عَلَى اللهُ)
وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ: وَالْآيَةُ وَإِنْ كَانَتْ مُطْلَقَةٌ، لَكِنَّ إِجْمَاعَ الْفُقَهَاءِ عَلَىتَقْيِيْدِهَا بِرُؤْيَةِ مَصْلِحِةٍ لِلْمُسْلِمِيْنَ فِي ذَلِكَ، بِآيَةٍ أُخْرَى وَهِيَ قَوْلُهُ تَعَالَى: (فَلَا تَهِنُواْوَتَدْعُوًا إِلَى السَّلْمِ وَأَنتُمُ الْأَعْلَوْنَ)، فَأَمَّا إِذَا لَمْ يَكُنْ فِي الْمُوَادَعَةِ مَصْلحَةٌ، فَلَا يَجُوْزُبِالْإِجْمَاعِ.
Allah, the Exalted, says: “And if they incline to peace, then incline to it and rely upon Allah” [Qur’an 8:61].
Shaykh Ibn al-Humam said: Though the verse is absolute, the consensus of jurists qualifies it with the condition of benefit to Muslims, based on another verse: “Do not weaken and call for peace while you are superior” [Qur’an 47:35]. If the treaty brings no benefit, it is impermissible by consensus.
وَعَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ وَمَرْوَانَ بْنِ الحَكَمِ رضي الله عنه قَالا: خَرَجَ النَّبِيُّ صلي الله عليه واله وسلم عَامَ الْحُدَيْبِيَةِ فِي بِضْعَ عَشْرَةَ مِائَةً مِنْ أَصْحَابِهِ، فَلَمَّا أَتَى ذَا الْحُلَيْفَةَ قَلَدَ الْهَدْيَ وَأَشْعَرَ١وَأَحْرَمَ مِنْهَا بِعُمْرَةٍ، وَسَارَ حَتَّى إِذَا كَانَ بِالثَّنِيَةِ الَتِي يُهْبَطُ عَلَيْهِمْ مِنْهَا بَرَكَتْ بِهِ رَاحِلَتُهُ،فقَالَ النَّاسُحَلْ حَلْخَلاتِ القَصْوَاءُفَقَال النَّبي صلي الله عليه واله وسلم (مَا خَلاتِ القَصْوَاءُ، وَ مَا ذاك لَهَا يِخْلُقٍ، وَلَكِنْ حَبَسَهَا حَابِسُ الْفِيلِ)، ثُمَّ قَالَ:(وَالَّذِي نَفْسِي بِيَدِهِ، لَا يَسْأَلُونِي خُطَّةًيُعَظَّمُونَ فِيهَا حُرُمَاتِ اللهِ إِلَّا أَعْطَيْتُهُمْ إِيَّاهَا) ثُمَّ زَجَرَهَا فَوَثَبَتْ، فَعَدَلَ عَنْهُمْ حَتَّى نَزَلَبِأَقْصَى الْحُدَيْبِيَةِ عَلَى ثَمَدٍ قَلِيلِ الْمَاءِ، يَتَبَرّصُهُ النَّاسُ تَبَرُصًا، فَلَمْ يُلَبَّثْهُ النَّاسُ حَتَّى نَزَحُوهُ، وَشُكِيَ إِلَى رَسُوْلِ اللهِ صلي الله عليه واله وسلم الْعَطَشُ، فَانْتَزَعَ سَهْمًا مِنْ كِنَانَتِهِ، ثُمَّ أَمَرَهُمْ أَنْيَجْعَلُوهُ فِيهِ، فَوَاللهِ مَا زَالَ يَجِيشُ لَهُمْ بِالرِّيِّ حَتَّى صَدَرُوا عَنْهُ، فَبَيْنَمَا هُمْ كَذَلِكَ إِذْ جَاءَبُدَيْلُ بْنُ وَرْقَاءَ الْخُزَاعِيُّ فِي نَفَرٍ مِنْ خُزَاعَةَ، ثُمَّ أَتَاهُ عُرْوَةُ بْنُ مَسْعُوْدٍ.
وَسَاقَ الْحَدِيْثَ إِلَى أَنْ قَالَ: إِذْ جَاءَ سُهَيْلُ بْنُ عَمْرِو، فَقَالَ التَّبِيُّ صلي الله عليه واله وسلم (اكَتُبْ: هَذَا ٢ مَا قَاضَى عَلَيْهِ مُحَمَّدٌ رَسُولُ اللهِ)، فَقَالَ سُهَيْلٌ: وَاللهِ لَوْ كُنَّا نَعْلَمُ أَنَّكَ رَسُولُ اللهِمَا صَدَدْنَاكَ عَنِ الْبَيْتِ، وَلَا قَاتَلْنَاكَ، وَلَكِنْ اكْتُبْ: مُحَمَّدُ بْنُ عَبْدِ اللهِ، قَالَ: فَقَالَ النَبِيُّ صلي الله عليه واله وسلم : (وَاللهِ إِنِّي لَرَسُولُ اللهِ وَإِنْ كَذَّبْتُمُونِي، اكْتُبْ مُحَمَّدُ بْنُ عَبْدِ اللهِ)، فَقَالَسُهَيْلٌ: وَعَلَى ٣ أَنْ لَا يَأْتِيكَ مِنَّا٤ رَجُلٌ وَإِنْ كَانَ عَلَى دِينِكَ إِلَّا رَدَدْتَهُ إِلَيْنَا. فَلَمَّا فَرَغَ مِنْقَضِيَّةِ الْكِتَابِ قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم لِأَصْحَابِهِ (قُومُوا فَانْحَرُوا ٥ ثُمَّ احْلِقُوا)، ثُمَّ جَاءَهُ نِسْوَةٌ مُؤْمِنَاتٌ، فَأَنْزَلَ اللهُ تَعَالَى: (يَأَيُّهَاٱلَّذِينَ ءَامَنُواْ إِذَا جَاءَكُمُ ٱلْمُؤْمِنَٰتُ مُهَٰجِرَاتٍ) الْآيَةَ، فَنَهَاهُمْ اللهُ أَنْ يَرُدُّوهُنَّ، وَأَمَرَهُمْأَنْ يَرُدُّوا الصَّدَاقَ، ثُمَّ رَجَعَ إِلَى الْمَدِينَةِ، فَجَاءَهُ أَبُو بَصِيرٍ رَجُلٌ مِنْ قُرَيْشٍ وَهُوَ مُسْلِمٌ،فَأَرْسَلُوا فِي طَلَبِهِ رَجُلَيْنِ، فَدَفَعَهُ إِلَى الرَّجُلَيْنِ، فَخَرَجَا بِهِ حَتَّى إِذَا بَلَغَا ذَا الْحَلَيْفَةِ نَزَلُوا
يَأْكُلُونَ مِنْ تَمْرِ لَهُمْ، فَقَالَ أَبُو بَصِيرٍ لِأَحَدِ الرَّجُلَيْنِ: وَاللهِ إِنِّي لَأَرَى سَيْفَكَ هَذَا يَا فُلَانُجَيِّدًا، أَرِنِي أَنْظُرْ إِلَيْهِ، فَأَمْكَنَهُ مِنْهُ فَضَرَبَهُ حَتَّى بَرَدَ، وَفَرَّ الْآخَرُ حَتَّى أَتَى الْمَدِينَةَ، فَدَخَلَ الْمَسجِدَ يَعْدُو. فَقَالَ النَبِيُّ صلي الله عليه واله وسلم :(الَقَدْ رَأْى هَذَا ذُعْرًا)، فَقَالَ: قَدْ قُتِلَ وَاللهِ صَاحِبِيوَإِنِّي لَمَقْتُولُ. فَجَاءَ أَبُو بَصِيرٍ، فَقَالَ النَّبِيّ صلي الله عليه واله وسلم : ( وَيْلَ أَمِّهِ، مِسْعَرَ حَرْبٍ لَوْ كَانَ لَهُ أَحَدٌ) فَلَمَّا سَمِعَ ذَلِكَ عَرَفَ أَنَّهُ سَيَرُدُّهُ إِلَيْهِمْ، فَخَرَجَ حَتَّى أَتَّى سَيْفَ الْبَحْرِ، قَالَ: وَانْفَلَتَ أَبُوجَنْدَلٍ ابْنُ سُهَيْلٍ فَلَحِقَ بِأَبِي بَصِيرٍ، فَجَعَلَ لَا يَخْرُجُ مِنْ قُرَيْشٍ رَجُلُ قَدْ أَسْلَمَ إِلَا لَحِقَبِأَبِي بَصِيرٍ حَتَّى اجْتَمَعَتْ مِنْهُمْ عِصَابَةُ، فَوَاللهِ مَا يَسْمَعُونَ بِعِيرٍ خَرَجَتْ لِقُرَيْشٍ إِلَى الشَّأْمِإِلَّا اعْتَرَضُوا لَهَا، فَقَتَلُوهُمْ وَأَخَذُوا أَمْوَالَهُمْ، فَأَرْسَلَتْ قُرَيْشُ إِلَى النَّبِيِّ وَلِيِّهِ تُنَاشِدُهُ بِاللهِ وَالرَّحِمِ، لَمَّا أَرْسَلَ فَمَنْ أَتَاهُ فَهُوَ آمِنٌ، فَأَرْسَلَ النِّبيُ صلي الله عليه واله وسلم إليْهِمْ. رَوَاهُ الْبُخَارِيُّ.
وَرَوَى الطَّحَاوِيُّ عَنِ الْمِسْوَرِ أَنَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم كَانَ بِالْحُدَيْبِيَّةِ خَبْاؤُه ٦ فِي الْحِلِّوَمُصَلَّاهُ فِي الحَرَمِ. وَفِي (الْمَدَارِكِ) عِنْدَ قَوْلِهِ تَعَالَى: (وَسْئَلُواْ مَآ أنفَقْتُمْ) هُوَ مَنْسُوْخُ،فَلَمْ يَبْقَ سُؤَالُ الْمَهْرِ، لَا مِنَّا وَلَا مِنْهُمْ، وَقَالَ عُلَمَاؤُنَا: أَمَّا الصُّلْحُ الَّذِيْ وَقَعَ فِي الْقِصَّةِمَعَ الْمُشْرِكِيْنَ عَلَى أَنْ يَرُدَّ إِلَيْهِمْ مَنْ جَاءَ مُسْلِمًا مِنْ عِنْدِهِمْ إِلَى بِلَادِ الْمُسْلِمِيْنَ، فَهُوَمَنْسُوْخٌ عِنْدَنَا، وَإِنَّ نَاسِخَهُ حَدِيْثُ: (أَنَا بَرِيْءٌ مِنْ كُلِّ مُسْلِمٍ بَيْنَ مُشْرِكِيْنَ).
Al-Miswar ibn Makhrama and Marwan ibn al-Hakam (may Allah be pleased with them) narrated: The Prophet (ﷺ) set out in the year of Hudaybiyyah with some thirteen hundred of his Companions. At Dhu al-Hulayfah, he garlanded the sacrificial animals, marked them, 1 and assumed ihram for Umrah. He proceeded until, at the pass descending to them, his she-camel Qaswa knelt. The people said, “Hal, hal! Qaswa has become obstinate!” The Prophet (ﷺ) said: “Qaswa is not obstinate; that is not her nature. Rather, she is held back by the One who held back the elephant.” Then he said: “By the One in whose hand is my soul, they will not ask me for any matter that honors Allah’s sanctities except that I will grant it.” He urged her, and she stood. He diverted from them and encamped at the farthest point of Hudaybiyyah, by a waterhole with little water, which people sipped sparingly until it was depleted. Thirst was reported to the Messenger of Allah (ﷺ), so he drew an arrow from his quiver and ordered them to place it in the hole. By Allah, it gushed with water until they left. While they were there, Budayl ibn Warqa al-Khuza‘i came with a group from Khuza‘ah, followed by Urwah ibn Mas‘ud. The narration continues until Suhayl ibn Amr arrived. The Prophet (ﷺ) said: “Write: This is what Muhammad, the Messenger of Allah, has agreed upon.” 2 Suhayl said: “By Allah, if we knew you were the Messenger of Allah, we would not have barred you from the House nor fought you. Write: Muhammad ibn Abdullah.” The Prophet (ﷺ) said: “By Allah, I am the Messenger of Allah even if you belie me. Write: Muhammad ibn Abdullah.” Suhayl said: “And that 3 no man from us comes to you, 4 even if on your religion, except you return him to us.” When the agreement was finalized, the Messenger of Allah (ﷺ) told his Companions: “Rise, slaughter, then shave.” 5 Then believing women came, and Allah revealed: “O you who believe, when believing women come to you as emigrants…” [Qur’an 60:10], forbidding their return and ordering the dowry be returned. He returned to Madinah. Abu Basir, a Muslim from Quraysh, came, and they sent two men to retrieve him. He handed him over. They took him until, at Dhu al-Hulayfah, they stopped to eat dates. Abu Basir said to one: “By Allah, your sword looks fine. Let me see it.” He handed it over, and Abu Basir struck him until he died. The other fled to Madinah, entering the mosque running. The Prophet (ﷺ) said: “This man has seen terror.” He said: “By Allah, my companion is killed, and I am next.” Abu Basir arrived, and the Prophet (ﷺ) said: “Woe to his mother, a spark of war! If only he had others.” Hearing this, Abu Basir knew he would be returned, so he fled to Sayf al-Bahr. Abu Jandal ibn Suhayl escaped and joined him. Every Muslim who left Quraysh joined Abu Basir, forming a group. By Allah, whenever they heard of a Quraysh caravan to Sham, they ambushed it, killed them, and took their wealth. Quraysh sent to the Prophet (ﷺ), pleading by Allah and kinship to grant safety to anyone who came to him. The Prophet (ﷺ) sent to them. [Narrated by Bukhari]
At-Tahawi narrated from Al-Miswar: At Hudaybiyyah, the Prophet’s (ﷺ) tent was in the non-sacred area, 6 and his prayer place was in the sanctuary. In (Al-Madarik), regarding “Ask for what you spent” [Qur’an 60:10], this is abrogated, so dowry is not asked from either side. Our scholars said: The treaty with the polytheists to return Muslims coming from them is abrogated per the Hadith: “I am free of any Muslim among polytheists.”

1 The statement: “Marked them”: Shafi‘i permits marking, while Abu Hanifah considers it disliked, though permissible per Abu Yusuf and Muhammad, whose view is preferred. At-Tahawi said: Abu Hanifah disliked excessive marking by commoners and Bedouins that risks death, not marking itself, as chosen in (Ghayat al-Bayan) and confirmed in (Fath al-Qadir). As in (Al-Hidayah) and (Bahr ar-Ra’iq).
2 The statement: “This is what Muhammad, the Messenger of Allah, has agreed upon”: Meaning a treaty, as (Al-Hidayah) states: If the leader sees benefit for Muslims in making a treaty with the enemy or a group, it is permissible.
3 The statement: “That no man from us comes to you”: Ibn al-Humam said: If they stipulate returning Muslims, the condition is void, and we do not return them, per Abu Hanifah and Malik. Shafi‘i says men must be returned, not women, as done at Hudaybiyyah. Women are not returned by consensus, per: “If you know them to be believers, do not return them to the disbelievers” [Qur’an 60:10]. This abrogates returning men too, as there is no difference, and returning Muslims is more harmful. As in (Al-Mirqat).

5 The statement: “Rise, slaughter, then shave”: This shows unblocking requires sacrifice in the sanctuary per Hanafis, as the Prophet (ﷺ) slaughtered at Hudaybiyyah within the sanctuary, per: “If you are prevented, offer what is easy of sacrificial animals, and do not shave your heads until the offering reaches its place” [Qur’an 2:196], and “An offering reaching the Ka‘bah” [Qur’an 5:95], meaning its sanctuary. At-Tahawi’s Hadith confirms his tent was in the non-sacred area, his prayer place in the sanctuary. In (An-Nihayah), Hudaybiyyah is partly in the sanctuary, per Al-Waqidi, aligning with Abu Hanifah. Al-Muhib at-Tabari said Hudaybiyyah is mostly in the sanctuary, nine miles from Makkah, not contradicting Bukhari’s statement that it is outside. As in (Al-Mirqat) and (Sharh Ma‘ani al-Athar). 6 The statement: “His tent was in the non-sacred area, and his prayer place was in the sanctuary”: At-Tahawi said this proves the Prophet (ﷺ) was not barred from the sanctuary and could access part of it. No scholar permits slaughtering outside the sanctuary if one can enter it. Thus, the Prophet (ﷺ) did not slaughter outside, as slaughtering outside is only allowed when barred, not when access is possible. This is the view of Abu Hanifah, Abu Yusuf, and Muhammad.
١ قوله: وأشعروا: عليه الشافعي، وهو مكروه عن أبي حنيفة حسن عندهما، والفتوى على قولهما. وقال الطحاوي:إنما كره أبو حنيفة الإشعار المحدَث الذي يفعل عوام زمانه والأعراب على وجه المبالغة، ويخاف منه السراية إلىالموت، لا مطلق الإشعار، واختاره في(غاية البيان) وصححه. وفي (فتح القدير): أنه الأولى، هذا حاصل ما في(الهداية) و(البحر الرائق).
٢ قوله: هذا ما قاضى عليه محمد رسول اللّٰه إلخ: أي صالح، لذلك قال في (الهداية): وإذا رأى الإمام أن يصالح أهلالحرب أو فريقا منهم، وكان في ذلك مصلحة للمسلمين فلا بأس به.
٣ قوله: وعلى أن لا يأتيك منا رجل : وإن كان على دينك إلا رددته علينا. قال الشيخ ابن الهمام: ولو شرطوا فيالصلح أن يرد إليهم من جاء مسلما منهم بطل الشرط، فلا يجب الوفاء به، فلا يرد عندنا من جاءنا مسلما منه، وهو قول مالك. وقال الشافعي: يجب الوفاء بالرجال دون النساء؛ لأنه صلي الله عليه واله وسلم فعل ذلك في الحديبية، وأما لو شرط مثله فيالنساء لا يجوز ردهن إجماعا. قلنا: قال تعالى:(فَإِنْ عَلْمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ (الممتحنه١٠). وهذا هو دليل النسخ في حق الرجال أيضًا؛ إذ لا فرق بين الرجال والنساء في ذلك، بل مفسدة ردّ المسلم إليهمأكثر. كذا في (المرقاة).
٤ قوله: منا رجل: فيه أن الصلح لم يقع على ردّ النساء؛ لقوله: في هذا الحديث لا يأتيك منا رجل. كذا في (المرقاة).
٥ قوله: قوموا فانخروا ثم احلقوا: فيه أن الإحلال نسك على المحصر وإن له نحر هديه بالحرم عندنا؛ لأن الموضعالذي نحر وافيه بالحديبية من الحرم بدليل قوله تعالى: (فَإِنْ أُحْصِرْتُمْ فَمَا ٱسْتَيْسَرَ مِنَ ٱلْهَدْيِّ وَلَا تَجْلِقُواْ رُءُوسَكُمْ حَتَّىٰيَبْلُغَ ٱلْهَدْىُ مَحِلَّةُ) (البقرة: ١٩٦). وقد قال تعالى: (هَدْيًا بَلِغَ الْكَعْبَةِ) (المائدة: ٩٥) أي حرمها، ويؤيدهحديث الطحاوي: أن رسول اللّٰه صلي الله عليه واله وسلم كان بالحديبية خباؤه في الحل ومصلاه في الحرم. وفي (النهاية): الحديبية قريةإليها ينتهي حد الحرم، ومن ذلك الصوب، وهي من الحل، وبعضها من الحرم على ما ذكره الواقدي، وهو الموافقلمذهب أبي حنيفة. وقد قال المحب الطبري: الحديبية قرية قريبة من مكة أكثرها في الحرم، وهي على تسعة أميال من مكة، وهو لا ينافي ما في (صحيح البخاري) أن الحديبية خارج الحرم. أخذته من (المرقاة) و (شرح معاني الآثار)
وأمرهم أن يروا الصداق، ولا شك في انفساخ نكاحها، اختلف القول في أن ردّ المهر كان واجبًا أو مندوبًا.واختلفوا في أنه هل يجب العمل به اليوم في رد المال إذا شرط في معاقدة الكفار، فقال قوم: لا يجب، وزعموا أن الآيةمنسوخة، وهو قول عطاء ومجاهد وقتادة. وقال قوم: هي غير منسوخة للشافعي فيه قولان في قول لا يعطان، وهوقولنا وقول مالك وأحمد، وفي قول يعطاه. التقطته من (المرقاة) و(فتح القدير).
٦ قوله: خباؤه في الحل ومصلاه في الحرم: وقال الطحاوي: فثبنت بما ذكرنا أن النبي صلي الله عليه واله وسلم لم يكن صد عن الحرم، وأنهكان يصل إلى بعضه، ولا يجوز في قول أحد من العلماء لمن قدر على دخول شيء من الحرم أن ينحر هديه دون الحرم، فلماثبت بالحديث الذي ذكرنا: أن النبي صلي الله عليه واله وسلم كان يصل إلى بعض الحرم استحال أن يكون نحر الهدي في غير الحرم؛ لأنالذي يبح نحر الهدى في غير الحرم إنما يبيحه في حال الصد عن الحرم، لا في حال القدرة على دخوله فانتفى بما ذكرنا أنيكون النبي صلي الله عليه واله وسلم نحر الهدي في غير الحرم. وهذا قول أبي حنيفة وأبي يوسف ومحمد.
وَعَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ: صَالِحَ ١ النَّبِيُّ صلي الله عليه واله وسلم المُشْرِكِيْنَ يَوْمَ الحُدَيْبِيَةِعَلَى ثَلَاثَةِ أَشْيَاءَ: عَلَى أَنَّ مَنْ أَتَاهُ مِنَ الْمُشْرِكِينَ رَدَّهُ إِلَيْهِمْ، وَمَنْ أَتَاهُمْ مِنَ الْمُسْلِمِينَ لَمْ يَرُدُّوهُ، وَعَلَى أَنْ يَدْخُلَهَا مِنْ قَابِلٍ، وَيُقِيمَ بِهَا ثَلَاثَةَ أَيَّامٍ، وَلَا يَدْخُلَهَا إِلَّا بِجُلبَّانِ السِّلَاحِوَالسَّيْفِ وَالْقَوْسِ وَنَحْوِهِ. فَجَاءَ أَبُو جَنْدَلٍ يَحْجُلُ فِي قُيُودِهِ فَرَدَّهُ إِلَيْهِمْ. مُتَفَقُ عَلَيْهِ.
Al-Bara ibn Azib (may Allah be pleased with him) narrated: The Prophet (ﷺ) made a treaty with the polytheists 1 on the Day of Hudaybiyyah on three terms: to return to them any polytheist who came to him, not to return Muslims who went to them, and to enter Makkah the next year for three days, carrying only sheathed weapons like swords and bows. Abu Jandal came in chains, and he returned him to them. [Agreed upon]

1 The statement: “The Prophet (ﷺ) made a treaty with the polytheists…”: Ibn al-Humam said: If the enemy besieges Muslims and seeks a treaty with Muslims paying them wealth, the leader must not agree, as it involves humiliation, and a believer must not be humbled, per: “To Allah belongs honor, and to His Messenger and the believers” [Qur’an 63:8]. An exception is if the leader fears destruction for himself and Muslims, then it is permissible.
١ قوله: صالح النبي وَا ليه المشركين يوم الحديبية على ثلاثة أشياء إلخ: قال الشيخ ابن الهمام: ولو حاصر العدوالمسلمين وطلبوا الموادعة على مال يدفعه المسلمون إليهم لا يفعله الإمام؛ لما فيه من إعطاء الدنية أي النقيصة،وليس للمؤمن أن يذل نفسه فالعزة خاصية الإيمان قال تعالى: (وَلِلَّهِ الْعِزَّةُ وَلِرَسُولِهِ وَلِلْمُؤْمِنِينَ) (المنافقون: ٨) إلاإذا خاف الإمام الهلاك على نفسه والمسلمين، فلا بأس.
وَعَنْ أَنَسِرضي الله عنه أَنَّ قُرَيْشًا صَالَحَوا النَّبِيَّ صلي الله عليه واله وسلم فَاشْتَرَطُوا عَلَى النَّبِيَّ صلي الله عليه واله وسلم أَنَّمَنْ جَاءَنَا مِنْكُمْ لَمْ نَرُدَّهُ عَلَيْكُمْ، وَمَنْ جَاءَكُمْ مِنَّا رَدَدْتُمُوهُ عَلَيْنَا، فَقَالُوا: يَا رَسُولَاللهِ، أَنَكْتُبُ هَذَا؟ قَالَ:(نَعَمْ، إِنَّهُ مَنْ ذَهَبَ مِنَّا إِلَيْهِمْ فَأَبْعَدَهُ الله، وَمَنْ جَاءَنَا مِنْهُمْسَيَجْعَلُ اللهُ لَهُ فَرَجًا وَمَخْرَجًا). رَوَاهُ مُسْلِمُ.
Anas (may Allah be pleased with him) narrated: Quraysh made a treaty with the Prophet (ﷺ), stipulating: “Whoever comes to us from you, we will not return to you, but whoever comes to you from us, you return to us.” They said: “O Messenger of Allah, shall we write this?” He said: “Yes. Whoever goes from us to them, may Allah keep him far, and whoever comes to us from them, Allah will grant him relief and a way out.” [Narrated by Muslim]
وَعَنِ الْبَرَاءِ بْنِ عَازِبِ رضى الله عنه قَالَ: اعْتَمَرَ النَّبِيُّ صلي الله عليه واله وسلم فِي ذِي الْقَعْدَةِ، فَأَبَى أَهْلُمَكَّةَ أَنْ يَدَعُوهُ يَدْخُلُ مَكَّةَ، حَتَّى قَاضَاهُمْ عَلَى أَنْ يُقِيمَ بِهَا ثَلَاثَةَ أَيَّامٍ، فَلَمَّا كَتَبُواالْكِتَابَ، كَتَبُوا: هَذَا مَا قَاضَى عَلَيْهِ مُحَمَّدٌ رَسُولُ اللهِ، فَقَالُوا: لَا نُقِرُ بِهَا، فَلَوْ نَعْلَمُ أَنَّكَرَسُولُ اللهِ مَا مَنَعْنَاكَ، لَكِنْ أَنْتَ مُحَمَّدُ بْنُ عَبْدِ اللهِ، قَالَ: (أَنَا رَسُولُ اللهِ، وَأَنَا مُحَمَّدُ بْنُعَبْدِ اللهِ) ثُمَّ قَالَ لِعَليِّ بْن أَبِيْ طَالِبٍ: (امْحُ رَسُولَ اللهِ) قَالَ: لَا وَاللهِ لَا أَمْحُوكَ أَبَدًا، فَأَخَذَرَسُولُ اللهِ صلي الله عليه واله وسلم الْكِتَابَ، وَلَيْسَ يُحْسِنُ يَكْتُبُ، فَكَتَبَ: هَذَا مَا قَاضَى عَلَيْهِ مُحَمَّدُ بْنُعَبْدِ اللهِ، لَا يُدْخِلُ مَكَّةَ السَّلَاحَ إِلَّا السَّيْفَ فِي الْقِرَابِ، وَأَنْ لَا يَخْرُجَ مِنْ أَهْلِهَا بِأَحَدٍإِنْ أَرَادَ أَنْ يَتْبَعَهُ، وَأَنْ لَا يَمْنَعَ مِنْ أَصْحَابِهِ أَحَدًا إِنْ أَرَادَ أَنْ يُقِيمَ بِهَا، فَلَمَّا دَخَلَهَا وَمَضَى الْأَجَلُ أَتَوْا عَلِيًّا، فَقَالُوا: قُلْ لِصَاحِبِكَ اخْرُجْ عَنَّا، فَقَدْ مَضَى الْأَجَلُ. فَخَرَجَ النَّبِيُّ صلي الله عليه واله وسلم . مُتَّفَقٌ عَلَيْهِ.
Al-Bara ibn Azib (may Allah be pleased with him) narrated: The Prophet (ﷺ) performed Umrah in Dhu al-Qa‘dah, but the people of Makkah refused him entry until he made a treaty to stay three days. When they wrote the agreement, they wrote: “This is what Muhammad, the Messenger of Allah, has agreed upon.” They said: “We do not acknowledge this. If we knew you were the Messenger of Allah, we would not have prevented you. You are Muhammad ibn Abdullah.” He said: “I am the Messenger of Allah and Muhammad ibn Abdullah.” He told Ali ibn Abi Talib: “Erase ‘Messenger of Allah.’” Ali said: “By Allah, I will never erase it.” The Messenger of Allah (ﷺ), who could not write well, took the document and wrote: “This is what Muhammad ibn Abdullah has agreed upon: not to bring arms into Makkah except sheathed swords, not to take anyone from its people if they wish to follow him, and not to prevent any of his Companions who wish to stay.” When he entered and the term ended, they told Ali: “Tell your companion to leave; the term is over.” The Prophet (ﷺ) left. وَعَنْ عَائِشَة رضى الله عنها قَالتْ فِي بِيْعَةِ النَّسَاءِ: إِنَّ رَسُوْلَ اللّهِ صلي الله عليه واله وسلم كان يمتحنهن بِهَذِهِ الآيَةِ: (يَأَيُّهَا النَّبيُّ إِذَا جَاءَكَ ٱلْمُؤْمِنَٰتُ يُبَابِعْنَكَ) فَمَنْ أَقَرَّتْ بِهَذَا الشَّرْطِمِنْهُنَّ قَالَ لَهَا: (قَدْ بَايَعْتُكِ) كَلامًا يُكَلَّمُهَا بِهِ، وَاللهِ مَا مَسَّتْ يَدُهُ يَدَ امْرَأَةٍ قَطَّ فِيالْمُبَايَعَةِ. مُتَّفَقُّ عَلَيْهِ.
Aisha (may Allah be pleased with her) narrated regarding the women’s pledge: The Messenger of Allah (ﷺ) tested them with the verse: “O Prophet, when believing women come to you pledging…” [Qur’an 60:12]. Whoever accepted the condition, he said: “I have accepted your pledge,” speaking to her. By Allah, his hand never touched a woman’s in the pledge. [Agreed upon]
وَعَنْ أُمَيْمَةَ بِنْتَ رُقَيْقَةَ رضي الله عنها قَالَتْ: بَايَعْتُ رَسُولَ اللهِ صلي الله عليه واله وسلم فِي نِسْوَةٍ فَقَالَلَنَا: فِيمَا اسْتَطَعْتُنَّ وَأَطَقْتُنَّ، قُلْتُ: اللهُ وَرَسُولُهُ أَرْحَمُ بِنَا مِنَّا بِأَنْفُسِنَا، قُلْتُ: يَا رَسُولَ اللهِ،بَايِعْنَا تَعْنِي صَافِحْنَا، فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم : (إِنَّمَا قَوْلِي لِمِائَةِ امْرَأْةٍ كَقَوْلِي لا مْرَأْةٍوَاحِدَةٍ). رَوَاهُ التَّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَه، وَمَالِكَ فِي (الْمُوَطَّا)، وَقَالَ التَّرْمِذِيُّ:حَدِيْثُ حَسَنٌ صَحِيْحُ.
Umaymah bint Ruqayqah (may Allah be pleased with her) narrated: I pledged allegiance to the Messenger of Allah (ﷺ) among women. He said: “In what you can and are able.” I said: “Allah and His Messenger are more merciful to us than we are to ourselves.” I said: “O Messenger of Allah, pledge us,” meaning shake our hands. He said: “My word to a hundred women is like my word to one.” [Narrated by Tirmidhi, Nasa’i, Ibn Majah, and Malik in (Al-Muwatta); Tirmidhi said: Hasan Sahih]
وَعَنِ الْمِسْوَرِ وَمَرْوَانَ أَنَّهُمْ١ اصْطَلَحُوا عَلَى وَضْعِ الْحُرْبِ عَشْرَ سِنِينَ يَأْمَنُ فِيهِنَّ النَّاسُ، وَعَلَى أَنَّ بَيْنَنَا عَيْبَةً مَكْفُوفَةً، وَأَنَّهُ لَا إِسْلَالَ وَلَا إِغْلَالَ. رَوَاهُ أَبُوْ دَاوُدَ.
وَرَوَى الْبَيْهَقِيُّ فِي (دَلَائِلِ النُّبُوَّةِ) فِي أَبْوَاب قِصَّةِ الْحَدَيْبِيَةِ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِوَمُوْسَى بْنِ عُقْبَةَ مُرْسَلًا، فَذَكَرَ الْقِصَّةَ، وَفِي آخِرِهَا: فَكَانَ الصُّلْحُ بَيْنَ رَسُوْلِ اللهِ صلي الله عليه واله وسلم وَبَيْنَ قُرَيْشٍ سَنَتَيْنِ، وَقَالَ فِي (الْعِنَايَةِ): فَكَانَتِ الْمُدَّةُ الْمَرْوِيَّةُ وَهِيَ عَشَرَ سِنِيْنَ مِنَالْمُقدرَاتِ الَّتِيْ لَا تَمْنَعُ الزِّيادَةَ وَالنُقْصَانَ ؛ لِأَنَّ الْمُدَّةَ الْمُوَادَعَةَ تَدُوْرُ مَعَ الْمَصْلِحَةِوَهِيَ قَدْ تَزِيْدُ وَقَدْ تَنْقُصُ.
Al-Miswar and Marwan narrated: They agreed to cease war for ten years, 1 ensuring people’s safety, with a sealed covenant between them, and no theft or treachery. [Narrated by Abu Dawud]
Al-Bayhaqi narrated in (Dala’il an-Nubuwwah) in the chapters on Hudaybiyyah from Urwah ibn az-Zubayr and Musa ibn Uqbah, mursal, mentioning the story, concluding: The treaty between the Messenger of Allah (ﷺ) and Quraysh lasted two years. In (‘Inayah), the reported ten-year duration is among estimates allowing increase or decrease, as the treaty’s duration depends on benefit, which may vary.

1 The statement: “They agreed to cease war for ten years…”: Ibn al-Humam said: The treaty’s duration is not limited to ten years, as its permissibility is based on Muslims’ need or benefit. If the treaty or duration is not in Muslims’ interest, it is impermissible, as it abandons jihad in form and meaning. Jihad is only permitted if it benefits Muslims; otherwise, it neglects the command. This refutes some scholars’ prohibition of exceeding ten years if the leader is not dominant, as Shafi‘i said. We say: There is no limit; the duration is at the leader’s discretion and the situation’s need. As in (Al-Mirqat).
١قوله: إنهم اصطلحوا على وضع الحرب عشر سنين إلخ: قال الشيخ ابن الهمام: لا يقتصر جواز مدة الموادعة علىالمدة المذكورة، وهي عشر سنين؛ لأن ما علل جوازها به هو حاجة المسلمين أو ثبوت مصلحتهم؛ فإنه قد يكونبأكثر بخلاف ما إذا لم تكن الموادعة أو المدة المسماة خيرا للمسلمين؛ فإنه لا يجوز؛ لأنه ترك للجهاد صورةومعنى، وما أبيح إلا باعتبار أنه جهاد، وذلك إنما يتحقق إذا كان خيرا للمسلمين وإلا فهو ترك للمأمور به، وبهذايندفع ما نقل عن بعض العلماء من منعه أكثر من عشر سنين، وإن كان الإمام غير مستظهر، وهو قول الشافعي،ولذلك قلنا: لا حد لها، وإن تقدير مدتها موكول إلى رأي الإمام واقتضاء الحال. كذا في (المرقاة).
وَعَنْ صَفْوَانَ بْن سُلَيْمٍ عَنْ عِدَّةٍ مِنْ أَبْنَاءِ أَصْحَابٍ رَسُولِ اللهِ صلي الله عليه واله وسلم عَنْآبَائِهِمْ رِضْوَانُ اللهِ عَلَيْهِمْ أَجْمَعِيْنَ عَنْ رَسُوْلِ اللهِ صلي الله عليه واله وسلم قَالَ:(أَلَا مَنْ ظَلَمَ مُعَاهِدًا أَوْانْتَقَصَهُ أَوْ كَلَّفَهُ فَوْقَ طَاقَتِهِ أَوْ أَخَذَ مِنْهُ شَيْئًا بِغَيْرِ طِيبِ نَفْسٍ فَأَنَا حَجِيجُهُ يَوْمَالْقِيَامَةِ). رَوَاهُ أبُوْ دَاوُدَ.
Safwan ibn Sulaym narrated from several sons of the Companions of the Messenger of Allah (ﷺ), from their fathers (may Allah be pleased with them all), from the Messenger of Allah (ﷺ) who said: “Whoever wrongs a person under a covenant, diminishes his rights, burdens him beyond his capacity, or takes something from him without his consent, I will be his adversary on the Day of Resurrection.” [Narrated by Abu Dawud]
