وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَأَعِدُّواْ لَهُم مَّا أَسْتَطَعْتُم مِّن قُوَّةٍ وَمِن رِّبَاطِ الْخَيْلِ تُرْهِبُونَ بِهِ، عَدُوَّ اللّهِ وَعَدُوَّكُمْ﴾

English

And the saying of Allah, the Mighty and Exalted: And prepare against them whatever you are able of power and of steeds of war by which you may terrify the enemy of Allah and your enemy [Al-Anfal: 60].

وَعَنْ عُقْبَةَ بْنِ عَامِرٍ رضي الله عنه، قَالَ: سَمِعْتُ رَسُوْلَ اللهِ صلي الله عليه واله وسلم وَهُوَ عَلَى الْمِنْبَرِيَقُوْلُ:﴿وَأَعِدُواْ لَهُم مَّا أَسْتَطَعْتُم مِّن قُوَّةٍ﴾ أَلَا ١ إِنَّ الْقُوَّةَ الرَّميُ أَلَا إِنَّ الْقُوَّةَ الرَّميُّ أَلَا إِنَّ الْقُوَّةَ الرَّميُ). رَوَاهُ مُسْلِمٌّ.

English

Uqbah ibn Amir (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) while he was on the pulpit saying: And prepare against them whatever you are able of power [Al-Anfal: 60]. "Indeed, 1 the power is archery, indeed, the power is archery, indeed, the power is archery." [Narrated by Muslim]

1 The statement: "Indeed, the power is archery, etc.": It is stated in (Al-Musawwa): It is not meant to limit it to that, but to highlight the most perfect of its components. It is stated in (Nayl al-Awtar): Al-Qurtubi said: The power was interpreted as archery, even though power includes preparing other instruments of war, because archery is the most effective in harming the enemy and the easiest in its burden; for one may shoot at the head of the battalion, causing it to be struck and those behind it to flee. It was repeated to encourage learning it and preparing its instruments. It also indicates the permissibility of engaging in learning the tools of jihad, training in them, and taking care in preparing them to practice jihad, train in it, and exercise one’s limbs for it.

١قوله: ألا أن القوة الرمي إلخ: قال في (المسوى): وليس المراد بذلك الحصر، بل بيان الفرد الكامل من أفراده، انتهى. وقال في (نيل الأوطار): قال القرطبي: إنما فسر القوة بالرمي، وإن كانت القوة تظهر بإعداد غيره من آلات الحرب؛ لكون الرمي أشد نكاية في العدو وأسهل مؤنة له؛ لأنه قد يرمي رأس الكتيبة فيصاب فينهزم من خلفه. وكرر ذلك للترغيب في تعلمه وإعداد آلاته، وفيه دليل على مشروعية الاشتغال بتعلم آلات الجهاد والتمرن فيها، والعناية في إعدادها ليتمرن بذلك على الجهاد ويتدرب فيه ويروض أعضاءه.

English

From the same (may Allah be pleased with him), he narrated: I heard the Messenger of Allah (ﷺ) say: "Lands will be opened for you, and Allah will suffice you, so let none of you be incapable of practicing with his arrows." [Narrated by Muslim]

وَعَنْهُ رضي الله عنه قَالَ: سَمِعْتُ رَسُوْلَ اللهِ صلي الله عليه وسلم يَقُوْلُ: (إِنَّ اللهَ يُدْخِلُ بِالسَّهْمِ الْوَاحِدِ ثَلَاثَةَ نَفَرِ الْجَنَّةَ: صَانِعَهُ يَحْتَسِبُ فِي صَنْعَتِهِ الْخَيْرَ، وَالرَّامِيَ بِهِ، وَمُنْبِلَهُ. وَارْمُوا وَارْكَبُوا، وَأَنْ تَرْمُوا أَحَبُّ إِلَيَّ مِنْ أَنْ تَرْكَبُوا، كُلُّ شَيْءٍ يَلْهُو بِهِ الرَّجُلُ الْمُسْلِمُ بَاطِلٌ إِلَّا رَمْيَهُ١ بِقَوْسِهِ وَتَأْدِيَبَهُ فَرَسَهُ وَمُلَا عَبَتَهُ أَهْلَهُ فَإِنَّهُنَّ مِنَ الْحَقِّ). رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَه.

وَزَادَ أَبُوْ دَاوُدَ وَالدَّارِميُّ: (وَمَنْ تَرَكَ الرَّنْيَ بَعْدَ مَا عَلِمَهُ رَغْبَةً عَنْهُ فَإِنَّهَا نِعْمَةُ تَرَّكَهَا .أَوْ قَالَ :- كَفَرَهَا).

English

From the same (may Allah be pleased with him), he narrated: I heard the Messenger of Allah (ﷺ) say: "Indeed, Allah admits three people into Paradise for a single arrow: the one who makes it seeking good in his craft, the one who shoots it, and the one who hands it. Shoot and ride, but your shooting is dearer to me than your riding. Everything a Muslim man engages in for amusement is futile except 1 his shooting with his bow, training his horse, and playing with his family, for these are from the truth." [Narrated by Tirmidhi and Ibn Majah]

And Abu Dawud and Ad-Darimi added: "And whoever abandons archery after learning it out of aversion to it, it is a blessing he has forsaken, or he said: he has been ungrateful for it."

1 The statement: "his shooting with his bow": It is stated in (Badhl al-Majhud): In the time of the Messenger of Allah (ﷺ), there was no weapon in war except shooting arrows, so this includes, or rather is replaced by, what is shot in its place, such as bullets from rifles, cannons, and other modern war instruments used in this era, as they have sufficed for and replaced shooting arrows with a bow. Al-Nawawi said: These Hadiths indicate the virtue of archery, target practice, and care in it with the intention of jihad in the path of Allah, the Exalted, as well as swordsmanship and all types of weapon use, and likewise racing with horses and others, as mentioned in its chapter. The intent is training for combat, practicing, mastering it, and exercising the limbs for it.

١قوله: رميه بقوسه: وقال في (بذل المجهود): ولم يكن في زمان رسول الله صلي الله عليه واله وسلم في الحرب إلا رمي السهام فيدخل، بل يعوض عنه فيه ما يرمي به من الرصاص بالبندقة والمدافع وغير ذلك من آلات الحرب الجديدة المستعملة في هذا الزمان، فإنها أغنت عن رمي السهام بالقوس وعطلته. وقال النووي: وفي هذه الأحاديث فضيلة الرمي والمناضلة والاعتناء بذلك بنية الجهاد في سبيل الله تعالى، وكذلك المثاقفة وسائر أنواع استعمال السلاح، وكذا المسابقة بالخيل وغيرها كما سبق في بابه. والمراد بهذا كله التمرن على القتال والتدرب والتحذق فيه ورياضة الأعضاء بذلك.

وعن انس رضي الله عنه قال: كان ابو طلحة يتترس١ مع النبي صلي الله عليه وسلم بترس واحد ،وكان ابو طلحة حسن الرمي ،فكان اذا رمي تشرف النبي صلي الله عليه وسلم ،فينظر الي موضع نبله .رواه البخاري.

English

Anas (may Allah be pleased with him) narrated: Abu Talhah would shield 1 with the Prophet (ﷺ) using a single shield, and Abu Talhah was an excellent archer. When he shot, the Prophet (ﷺ) would lean forward to see where his arrow landed. [Narrated by Bukhari]

وَعَنْ أَبِيْ نَجِيجِ السُّلَمِيِّ ُرضي الله عنه قَالَ: سَمِعْتُ رَسُوْلَ اللّهِ صلي الله عليه وسلم يَقُوْلُ: (مَنْ بَلَغَ بِسَهْمٍ فِي سَبِيلِ اللهِ فَهُوَ لَهُ دَرَجَةٌ فِي الْجَنّةِ، مَنْ رَمى بِسَهْمٍ فِي سَبِيلِ اللهِ فَهُوَ عِدْلُ مُحَرَّرِ، وَمَنْ شَابَّ شَيْبَةٌ فِي الْإِسْلَامِ كَانَتْ لَهُ نُوْرًا يَوْمَ الْقِيَامَةِ). رَوَاهُ الْبَيْهَقِيُّ فِي (شُعَبِ الْإِيْمَانِ).

وَرَوَى أَبُوْ دَاوُدَ الْفَصْلَ الْأَوَّلَ وَالنَّسَائِيُّ الْأَوَّلَ وَالثَّانِيُّ وَالتِّرْمِذِيُّ الثّانِيَّ وَالثَّالِثَ، وَفِي رِوَايَتَهِمَا:(مَنْ شَابَّ شَيْبَةً فِي سَبِيْلِ اللهِ) بَدَلَ (فِيَّ الْإِسْلاَمِ).

English

Abu Najih as-Sulami (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) say: "Whoever delivers an arrow in the path of Allah has a degree in Paradise, whoever shoots an arrow in the path of Allah, it is equivalent to freeing a slave, and whoever grows gray hair in Islam, it will be a light for him on the Day of Resurrection." [Narrated by Al-Bayhaqi in (Shu‘ab al-Iman)]

Abu Dawud narrated the first part, Nasa’i narrated the first and second, and Tirmidhi narrated the second and third, and in their narration: "Whoever grows gray hair in the path of Allah" instead of "in Islam."

وعن سلمة بن الاكوع رضي الله عنه قال: خرج رسول الله صلي الله عليه وسلم علي قوم من اسلم يَتَنَاضَلُونَ بِالسُّوقِ، فَقَالَ: (ارْمُوا بَنِي إِسْمَاعِيلَ؛ فَإِنَّ أَبَاكُمْ كَانَ رَامِيًّا، وَأَنَا مَعَ بَنِي فُلَانٍ) لِأَحَدِ الْفَرِيقَيْنِ، فَأَمْسَكُوا بِأَيْدِيهِمْ، فَقَالَ:(مَا لَهُمْ؟) قَالُوا: وَكَيْفَ نَرْبِي وَأَنْتَ مَّعَ بَنِي فُلَانٍ؟ قَالَ: (ارْمُوا وَأَنَا مَعَكُمْ كُلِّكُمْ). رَوَاءُ الْبُخَارِيُّ.

English

Salamah ibn al-Akwa‘ (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) came upon a group from Aslam practicing archery in the market and said: "Shoot, O sons of Isma‘il, for your father was an archer, and I am with the clan of so-and-so," referring to one of the two teams. They held back their hands, and he said: "What is wrong with them?" They said: "How can we shoot when you are with the clan of so-and-so?" He said: "Shoot, and I am with all of you." [Narrated by Bukhari]

وَعَنْ عَائِشَةَ رضي الله عنها قَالَتْ: سَابَقَنِي رَسُوْلُ اللهِ صلي الله عليه وسلم فَسَبَقْتُهُ، فَلَبِثْنَا حَقَّى إِذَا رَهِقَنِي اللَّحْمُ سَابَقَنِي فَسَبَقَنِي، فَقَالَ: (هَذِهِ بِتِييكِ). رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ.

English

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) raced me, and I outran him. We stayed for a while until I gained weight, then he raced me again and outran me, and he said: "This is for that." [Narrated by Ahmad and Abu Dawud]

وَعَنْ أَنَسِ رضي الله عنه قَالَ: كَانَتْ نَاقَةٌ لِرَسُوْلِ اللهِ صلي الله عليه وسلم تُسَمَّى الْعَضْبَاءَ وَكَانَتْ لَا تُسْبَقُ، فَجَاءَ أَعْرَابِيُّ عَلَى قَعُودٍ لَهُ فَسَبَقَهَا، فَاشْتَدَّ ذَلِكَ عَلَى الْمُسْلِمِينَ، فَقَالَ رَسُولُ الله صلي الله عليه وسلم : (ان حقا علي الله ان لا يرفع شيئا من الدنيا الا وضعه).رواه البخاري.

English

Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) had a she-camel named Al-Adba’ that was never outrun. A Bedouin came on his young camel and outran her. This was hard on the Muslims, so the Messenger of Allah (ﷺ) said: "It is a right upon Allah that nothing is raised in this world except that He lowers it." [Narrated by Bukhari]

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ هُ أَنَّ رَسُوْلَ اللهِ صلي الله عليه وسلم سَابَقَ١ بَيْنَ الْخَيْلِ الَّتِي أُضْمِرَتْ مِنَ الْحَفْيَاءِ، وَأَمَدُهَا ثَنِيَّةُ الْوَدَاعِ وَبَيْنَهُمَا سِتَّةُ أَمْيَالٍ، وَسَابَقَ بَيْنَ الْخَيْلِ الَّتِيْ لَمْ تُضَمَّرْ مِنَ القَّنِيَّةِ إِلَى مَسْجِدِ بَنِي زُرَبْقٍ وَبَيْنَهِمَا مِيْلٌ. مُتَّفَقَّ عَلَيْهِ.

وَرَوَى الْبَغَوِيُّ فِي (شَرْح السُّنَّةِ) عَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه وسلم : (مَنْ أَدْخَلَ فَرَسا بَيْنَ فَرَسَيْنٍ فَإِنْ كَانَ يُؤْمِنُ أَنْ يَسْبِقَ فَلَا خَيْرَ فِيْهِ، وَإِنْ كَانَ لَا يُؤْمِنُ أَنْ يَسْبِقَ فَلَا بَأْسَ بِه).

وَفِي رِوَايَةِ أَبِي دَاوُدَ قَالَ: (مَنْ أَدْخَلَ فَرَسًا بَيْنَ فَرَسَيْنِ يَعْنِي وَهُوَ لَا يُؤْمَنُ أَنْ يَسْبِقَ فَلَيْسَ بِقِمَارٍ، وَمَنْ أَدْخَلَ فَرَسًا بَيْنَ فَرَسَيْنٍ وَقَدْ أُمِنَ أَنْ يَسْبِقَ فَهُوَ قِمَارً).

English

Abdullah ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) held races 1 between horses that were trained, from Al-Hafya’ to Thaniyyat al-Wada‘, a distance of six miles, and between horses that were not trained, from Al-Qaniyyah to the mosque of Banu Zurayq, a distance of one mile. [Narrated by Bukhari and Muslim]

And Al-Baghawi narrated in (Sharh as-Sunnah) from Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: "Whoever enters a horse between two horses, if he is certain it will win, there is no good in it, but if he is not certain it will win, there is no harm in it."

And in Abu Dawud’s narration, he said: "Whoever enters a horse between two horses, meaning he is not certain it will win, it is not gambling, but whoever enters a horse between two horses and is certain it will win, it is gambling."

(Branch) In miscellaneous issues of (At-Tatarkhaniyah) from (As-Sirajiyyah): It is disliked to shoot at a target toward the Qiblah, and the same ruling applies to swordsmanship. If stipulated for one specific person with the correct outcome, it is valid, but if stipulated for each against the other, it is invalid, such as saying: "If the correct outcome is with you, you get such-and-such, or if it is with me, I get nothing," or vice versa. But if they say: "Whoever has the correct outcome gets such-and-such from the other," it is invalid because it is a condition from both sides, which is gambling unless they include a neutral third party. Wrestling is not an innovation unless for amusement, in which case it is disliked, as in (Burhandi). He wrestled several people, including Ibn al-Aswad al-Jumahi, such as Rukana, whom he wrestled three consecutive times on the condition that if he was defeated, he would accept Islam, as in (Sharh ash-Shama’il by Al-Qari). Al-Jurahi said: His wrestling with Abu Jahl has no basis. It was permissible because it encourages jihad and learning knowledge, as the religion is upheld by jihad and knowledge, so it is permissible in what pertains to them, nothing else, as in (Fusul al-‘Allami). Racing without a wager is permissible in everything that teaches horsemanship and aids jihad without the intention of amusement, as evident from our jurists’ statements, inferred from the saying of the Prophet (ﷺ): "The angels do not attend any amusement except archery, target practice, and racing." It appears that calling it amusement is due to formal resemblance.

1 The statement: "held races between horses, etc.": It is stated in (Ad-Durr al-Mukhtar) and (Radd al-Muhtar): There is no harm in racing with archery, horses, mules, and donkeys, as stated in (Al-Multaqa) and (Al-Majma‘), and similarly in (Al-Mukhtar), (Al-Mawahib), and (Durar al-Bihar). The author approved it here, contrary to what he mentioned in miscellaneous issues before the Book of Inheritance, where he limited it to horses, camels, foot races, and archery, as in (Al-Kanz) and (Az-Zayla‘i). The commentator approved it there, stating: Racing is not permissible with a wager except in these four, but without a wager, it is permissible in everything, as detailed in (Az-Zayla‘i), and similarly in (Adh-Dhakhirah), (Al-Khaniyah), and (At-Tatarkhaniyah). The essence is that the hoofed animals mentioned in the Hadith are general. Those who consider its generality include mules and donkeys, while those who consider the reason exclude them because they are not instruments of jihad, unlike camels, which are, making them recommended. According to the three [other schools], it is not permissible with foot races with a wager, but without one, it is permissible in all sports. The wager is permissible, but it does not become obligatory, so if the loser refuses to pay, the judge does not compel him or rule for it, as in (Az-Zayla‘i) in miscellaneous issues. Al-Bazzazi explained it as not being obligatory due to the absence of a contract and receipt. It implies it becomes binding with a contract, as the Shafi‘is say, so reflect. It may be said: The meaning of "absence of a contract" is the impossibility of it, and the permissibility of a wager in what was mentioned is by juristic preference. Az-Zayla‘i said: The analogy is that it is not permissible due to the condition of ownership being tied to chance, which is why it is not permissible in anything other than the four, even if the wager is stipulated from one side. If the wager in a race is stipulated from one side or a third party, such as one saying to another: "If you outrun me, I will give you such-and-such, and if I outrun you, I take nothing from you," or the leader says to two riders or archers: "Whoever wins gets such-and-such, and if he loses, he gets nothing," as in (Ikhtiyar) and (Ghurrar al-Afkar). It is forbidden if stipulated from both sides, such as saying: "If your horse wins, you get such-and-such from me, and if my horse wins, I get such-and-such from you," as in (Az-Zayla‘i), and similarly if he says: "If your camel or arrow wins, etc.," as in (At-Tatarkhaniyah). It becomes gambling unless they include a third neutral party with a horse equivalent to theirs, expecting it might outrun them; otherwise, it is not permissible, based on the general saying: "Whoever enters a horse between two horses and is not certain it will win, there is no harm in it," but whoever enters a horse between two horses and is certain it will win, it is gambling. If he outruns them, he takes from them, and if they outrun him, he gives them nothing, and between them, whoever wins takes from the other. It is stipulated in (Al-Ghayah) that it must be bearable for the horse, and each horse must have the potential to win, as in (Az-Zayla‘i). It should be said for arrows and foot races as well. It is narrated in (Ghurrar al-Afkar) from (Al-Muḥarrar): If the race is with camels, the criterion for winning is the shoulder, and if with horses, it is the neck, though some say it is the feet.

ومفاده لزومه بالعقد كما يقول الشافعية، فتبصر. قد يقال: معنى قوله:(لعدم العقد) أي لعدم إمكانه على أن جواز الجعل فيما ذكر استحسان. قال الزيلعي: والقياس أن لا يجوز لما فيه من تعليق التمليك على الحظر، ولهذا لا يجوز فيما عدا الأربعة كالبغل، وإن كان الجعل مشروطا من أحد الجانبين. إن شرط المال في المسابقة من جانب واحد أو من ثالث بأن يقول أحدهما لصاحبه: إن سبقتني أعطيتك كذا، وإن سبقتك لا آخذ منك شيئًا أو يقول الأمير لفارسين أو راميين: من سبق منكما فله كذا، وإن سبق فلا شيء له، اختيار وغرر الأفكار، وحرم لو شرط فيها من الجانبين بأن يقول: إن سبق فرسك فلك عليّ كذا، وإن سبق فرسي فلي عليك كذا، (زيلعي). وكذا إن قال: إن سبق إبلك أو سهمك إلخ (تاتارخانية).

لأنه يصير قمارا، إلا إذا أدخلا ثالثا محللا بينهما بفرس كفء لفرسيهما يتوههم أن يسبقهما، وإلا لم يجز، أي إن كان يسبق أو يسبق لا محالة لا يجوز لقوله كلية: (من أدخل فرسا بين فرسين وهو لا يأمن أن يسبق فلا بأس به) ومن أدخل فرسا بين فرسين، وهو أمن أن يسبق فهو قمار، ثم إذا سبقهما أخذ منهما، وإن سبقاه لم يعطهما وفيما بينهما أيهما سبق أخذ من صاحبه، ويشترط في (الغاية) أن تكون مما تحتملهما الفرس، وأن يكون في كل من الفرسين احتمال السبق، (زيلعي) وينبغي أن يقال في السهم والأقدام كذلك، ونقل في (غرر الأفكار) عن (المحرر): إن كانت المسابقة على الإبل فالاعتبار في السبق بالكتف، وإن كان على الخيل فبالعنق. وقيل: الاعتماد على الأقدام.

(فرع) في متفرقات (التاترخانية) عن (السراجية): يكره الرمي إلى هدف نحو القبلة، وكذا الحكم في المتفقهة، فإذا شرط لواحد معين معه الصواب صحَّ، وإن شرطاه لكل على صاحبه لا دور ومجتبى، أي بأن يقول: إن ظهر الصواب معك فلك كذا، أو ظهر معي فلا شيء لي، أو بالعكس، أما لو قالا: من ظهر معه الصواب منا فله على صاحبه كذا، فلا يصحُّ؛ لأنه شرط من الجانبين، وهو قمار إلا إذا أدخلا محللا بينهما.

والمصارعة ليست ببدعة إلا للتلهي فتكره، (برجندي). فقد صرع ثة جمعًا منهم ابن الأسود الجمحي، منهم: ركانة؛ فإنه صرعه ثلاث مرات متواليات لشرطه إنه إن صرع أسلم، كما في (شرح الشمائل للقاري). قال الجراحي: ومصارعته محنة لأبي جهل لا أصل لها، وإنما جاز؛ لأن فيه حثا على الجهاد وتعلم العلم، فإن قيام الدين بالجهاد والعلم، فجاز فيما يرجع إليهما لا غير. كذا في (فصول العلامي). وأما السباق بلا جعل فيحل في كل شيء، أي مما يعلم لفروسية ويعين على الجهاد بلا قصد التلهي، كما يظهر من كلام فقهائنا، مستدلين بقوله صلي الله عليه وسلم : (لا تحضر لملائكة شيئًا من الملاهي سوى النضال الرمي والمسابقة)، والظاهر أن تسميته لهوًا للمشابهة الصورية.

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "There is no prize 1 except in arrows, hooves, or feet." [Narrated by Tirmidhi, Abu Dawud, and Nasa’i] That is, taking money in a race is not permissible except in one of these, and our jurists included racing on foot with them because it is a means of jihad.

3 The statement: "and do not adorn them with strings": Ibn al-Jawzi said: There are three opinions regarding what is meant by strings. First, they used to hang bowstrings on camels to ward off the evil eye, so they were ordered to cut them to show that strings do not avert anything of Allah’s decree, as per Malik’s view. Second, the prohibition is to prevent the animal from choking during intense running, as narrated from Muhammad ibn al-Hasan, the companion of Abu Hanifah, and Abu Ubayd’s statement supports it, as he said: It was prohibited because it harms the animals, restricts their breathing and grazing, and they might get caught in a tree and choke or be hindered in movement. Third, they used to hang bells on them, as narrated by Al-Khattabi. Al-Nawawi and others said: The majority hold that the prohibition is for disapproval, specifically mild disapproval. Some said it is forbidden. Others said it is prohibited before need but permissible when needed. Malik specified that the disapproval applies to adornments with strings, but it is permissible with others if not intended to ward off the evil eye. This applies to amulets and similar things without Qur’an or the like. As for what contains Allah’s remembrance, there is no prohibition, as it is used for blessing and seeking refuge with His names and remembrance. Similarly, there is no prohibition for adornments used for decoration unless they reach the level of arrogance or extravagance. As stated in (Badhl al-Majhud).

وَعَنْهُ رضی الله عنه قَالَ: كَانَ رَسُوْلُ اللهِ صلي الله عليه وسلم عَبْدًا مَأْمُورًا مَا اخْتَصَّنَا دُونَ النَّاسِ بِشَيْءٍ إِلَّا ٢ بِثَلاَثٍ: أَمَرَنَا أَنْ نسبغ الْوُضُوءَ، وَأَنْ لَا تَأْكُلَ الصَّدَقَةَ، وَأَنْ لَا نُنْزِيَ حِمَارًا عَلَى فَرَسٍ. رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيُّ.

وفي رواية لابي داود والنسائی عن علي رضي الله عنه قال: اهديت للنبي صلي الله عليه وسلم بغلة فركبها فَقَالَ عَلِيٍّ: لَوْ حَمَلْنَا الْحَمِيْرَ عَلَى الْخَيْلِ فَكَانَتْ لَهَا مِثْلُ هَذِهِ. فَقَالَ رَسُوْلُ اللهِ صلي الله عليه وسلم : (إِنَّمَا يَفْعَلُ ذَلِكَ الَّذِينَ لَا يَعْلَمُونَ).

وَقَالَ الطَحَاوِيُّ: ٣ إِنَّ النَّهيَ نَهيُ إِرْشَادٍ شَفَقَة؛ كَيْلَا يَكُوْنَ تَقْلِيْلُ آلَّةِ الْجِهَادِ، فَإِنَّ الْفَرَسَ يَعْمَلُ مَا لَا يَعْمَلُ الْبَغْلُ. فَالْخَاصِلُ: أَنَّ تَحْصِيْلَ الْبِغَالِ لَيْسَ غَيْرُ جَائِزٍ.

English

From the same (may Allah be pleased with them both), he narrated: The Messenger of Allah (ﷺ) was a servant commanded; he did not distinguish us from others except 2 in three things: He commanded us to perfect ablution, not to eat charity, and not to breed a donkey with a horse. [Narrated by Tirmidhi and Nasa’i]

In a narration by Abu Dawud and Nasa’i from Ali (may Allah be pleased with him), he said: A mule was gifted to the Prophet (ﷺ), and he rode it. Ali said: "If we bred donkeys with horses, we would have ones like this." The Messenger of Allah (ﷺ) said: "Only those who do not know do that."

At-Tahawi said: 3 The prohibition is one of guidance out of concern, so as not to reduce the equipment of jihad, for a horse can do what a mule cannot. The essence is that acquiring mules is not impermissible.

2 The statement: "except in three things, etc.": The distinction in perfecting ablution and breeding is problematic, as the first is recommended and commanded for everyone, and the second is disliked and prohibited for everyone. Indeed, the prohibition of eating charity is specific to the Prophet’s household. It is answered that the intent is obligation, which is specific to them, or the intent is to emphasize or stress it. It is also said: This is like Ali’s saying, "except in this document," meaning the negation of distinction or consultation in any rulings, as these things are not specific to them. As stated in (Al-Luma‘at). 3 The statement: "At-Tahawi said, etc.": The original wording is as follows: If someone asks, "What is the meaning of the Prophet (ﷺ) distinguishing Banu Hashim with the prohibition of breeding donkeys with horses?" It is said to him: When Ibn Abi Dawud narrated to us, he said: Abu Umar al-Hawdi narrated to us, saying: Al-Marji, who is Ibn Raja, narrated to us, saying: Abu Jahdam narrated to me, saying: Ubaydullah ibn Abdullah narrated from Ibn Abbas, who said: The Messenger of Allah (ﷺ) did not distinguish us except in three things: not to eat charity, to perfect ablution, and not to breed a donkey with a horse. I met Abdullah ibn al-Hasan while he was circumambulating the Ka‘bah and told him this, and he said: "True, horses were few among Banu Hashim, so he wanted them to increase among them." Abdullah ibn al-Hasan explained that the reason the Prophet (ﷺ) distinguished Banu Hashim with not breeding donkeys with horses was not for prohibition but due to the scarcity of horses among them. When that reason is removed and horses become abundant among them, they are like others. The Prophet’s (ﷺ) distinction of them with this prohibition indicates its permissibility for others. Since he (ﷺ) made keeping horses carry the reward and merit we mentioned, and when asked about keeping donkeys, he did not assign any reward to it, and mules, which are unlike horses, are similar. Thus, those who prefer to produce what has no reward in keeping or acquiring over what has reward are among those who do not know. It is established that producing mules is permissible for Banu Hashim and others, though producing horses is better, and this is the opinion of Abu Hanifah, Abu Yusuf, and Muhammad, may Allah have mercy on them all. As stated in (Ad-Durr al-Mukhtar): Breeding donkeys with horses is permissible, as is the reverse, as in (Qahastani). In (Takmilat Bahr ar-Ra’iq): It is permissible to breed donkeys with horses because he (ﷺ) rode and kept a mule, and if it were forbidden, he would not have done so, as it would open its door. As stated in (Al-Hidayah).

٢ قوله: إلا بثلاث إلخ: ويشكل الاختصاص في الإسباغ والإنزاء، فإن الأول مستحب، أمر به كل واحد، والثاني مكروه، نهى عنه كل أحد. نعم، حرمة أكل الصدقه مخصوص بأهل البيت، ويجاب بأن المراد الإيجاب، وهو مختص بهم، أو المراد الحث على المبالغة أو التاكيد. وقيل: هذا كقول علي إلا في هذه الصحيفة، فالمقصود نفي الاختصاص والاستيشار بشيء من الأحكام، فإن هذه الأشياء ليست بمخصوصة لهم. كذا في (اللمعات).

٣ قوله: وقال الطحاوي إلخ: وأصل عبارته هكذا، فإن قال قائل: فما معنى اختصاص النبي صلي الله عليه وسلم بني هاشم بالنهي عن إنزاء الحمير على الخيل؟ قيل له: لما حدثنا ابن أبي داود، قال: حدثنا أبو عمر الحوضي قال: حدثنا المرجي هو ابن رجاء قال: حدثنا أبو جهضم قال: حدثني عبيد الله بن عبد الله عن ابن عباس قال: ما اختصنا رسول الله صلي الله عليه وسلم إلا بثلاث: أن لا نأكل الصدقة، وأن نسبغ الوضوء، وأن لا ننزي حمارا على فرس. قال: فلقيت عبد الله بن الحسن، وهو يطوف بالبيت فحدثته، فقال: صدق كانت الخيل قليلة في بني هاشم، فأحب أن تكثر فيهم، فبين عبد الله بن الحسن بتفسيره هذا المعنى الذي له اختص رسول الله صلي الله عليه وسلم بني هاشم أن لا ننزي الحمار على فرس، وأنه لم يكن للتحريم، وإنما كانت العلة قلة الخيل فيهم، فإذا ارتفعت تلك العلة، وكثرت الخيل في أيديهم صاروا في ذلك كغيرهم.

وفي اختصاص النبي صلي الله عليه وسلم إياهم بالنهي عن ذلك دليل على إباحته إياه لغيرهم، ولما كان صلي الله عليه وسلم قد جعل في ارتباط الخيل ما ذكرنا من الثواب والأجر، وسئل عن ارتباط الحمير، فلم يجعل في ارتباطها شيئًا، والبغال التي هي خلاف الخيل مثلها كان من ترك أن تنتج ما في ارتباطه وكسبه ثواب وانتج ما لا ثواب في ارتباطه وكسبه من الذين لا يعلمون. فقد ثبت بما ذكرنا إباحة نتج البغال لبني هاشم وغيرهم، وإن كان انتاج الخيل أفضل من ذلك، وهو قول أبي حنيفة وأبي يوسف ومحمد رحمة الله عليهم أجمعين، انتهى.

وقال في (الدر المختار): وجاز إنزاء الحمير على الخيل كعكسه، (قهستاني). وقال في (تكملة البحر الرائق): يعني جاز إنزاء الحمير على الخيل؛ لأنه صلي الله عليه وسلم ركب البغل واقتناه، ولو حرم لما فعل. لما فيه من فتح بابه. قاله في الهداية.

وَقَالَ التَّوْرَبُشْتِيّ: حَدِيْث مزيدةٍ لَا يَقُوْمُ بِهِ حُجَّةٌ؛ إِذْ لَيْسَ لَهُ سَنَدَّ يُعْتَمَدُ بِهِ. ذَكَرَصَاحِبُ (الإِسْتِيْعَابِ) حَدِيْئَهُ، وَقَالَ: إِسْنَادُهُ لَيْسَ بِالْقَوِيِّ.

English

Anas (may Allah be pleased with him) narrated: The hilt 1 of the sword of the Messenger of Allah (ﷺ) was made of silver. [Narrated by Tirmidhi, Abu Dawud, Nasa’i, and Ad-Darimi]

At-Tawrabushti said: The Hadith of Mazidah is not a proof, as it has no reliable chain. The author of (Al-Isti‘ab) mentioned this Hadith and said: Its chain is not strong.

In (Al-‘Alamgiriyyah) said: As stated in As-Siyar that it is not appropriate to adorn a sword with gold in warfare, as adornment is of no use in war and is for decoration, as he (may Allah forgive him) said. If this applies to the sword, it is even more so for its scabbard. As stated in (At-Tamartashi). Qahastani, in (Sharh an-Naqayah), citing (Fatawa Qadi Khan): There is no harm in adorning the belt, weapon, and sword scabbard with silver according to them, but some dislike it with gold. This applies if it is pure silver or gold; otherwise, there is no issue according to all.

In (Al-‘Alamgiriyyah): There is no harm in gilding weapons with gold and silver, as in (As-Sirajiyyah). In (Majma‘ al-Barakat): Gilding from which gold or silver is not extracted is permissible. Cited from the summary of the glosses.

1 The statement: "The hilt of the sword of the Messenger of Allah (ﷺ) was made of silver": The condition for the adornment of a sword is that the hand does not touch the silver part. As stated in (Radd al-Muhtar). In Nasa’i’s wording: The guard of the sword of the Messenger of Allah (ﷺ) was silver, its hilt was silver, and what was between them were silver rings. The hilt (qabi‘ah) is, with a qaf, then a ba, then a ya under it, then a ha, on the pattern of safinah, referring to what is on the end of the sword’s handle, made of silver or iron. As stated in (Sharh an-Naqayah). In (Al-‘Alamgiriyyah): If there is silver in the blade or handle of the sword, Abu Hanifah (may Allah be pleased with him) said: If the hand touches the silver part, it is disliked; otherwise, it is permissible. Abu Yusuf (may Allah be pleased with him) said: It is disliked absolutely. As stated in (Radd al-Muhtar): The hand should avoid the blade, handle, and reins where it touches. Sword adornment is with silver, not gold. As stated in (Radd al-Muhtar).

Musa ibn Ubaydah, the freedman of Muhammad ibn al-Qasim, narrated: Muhammad ibn al-Qasim sent me to Al-Bara’ ibn Azib to ask him about the banner of the Messenger of Allah (ﷺ). He said: It was black, square, made of striped cloth. [Narrated by Ahmad, Tirmidhi, and Abu Dawud]

وَعَنْ عَلِيَّ ُرضي الله عنه قَالَ كَانَتْ بِيَدِ رَسُولِ اللهِ َصلي الله عليه وسلم قَوْسُّ عَرَبِيَّةُ، فَرَأَى رَجُلًا بِيَدِهِ قَوْسٌ فَارِسِيَّةٌ، فَقَالَ: مَا هَذِهِ؟ أَلْقِهَا، وَعَلَيْكُمْ بِهَذِهِ وَأَشْبَاهِهَا، وَرِمَاجِ الْقَنَا، فَإِنَّهَا يُؤَيِّدُ اللهُ لَكُمْ بِهِمَا فِي الدِّينِ، وَيُمَكِّنُ لَكُمْ فِي الْبِلَادِ). رَوَاهُ ابْنُ مَاجَه.

English

Ali (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) was holding an Arabian bow. He saw a man holding a Persian bow and said: "What is this? Throw it away, and keep to these and their like, and cane spears, for through them Allah will support you in religion and establish you in the lands." [Narrated by Ibn Majah]
