بَابُ فَضَائِلِ الْمَدِينَةِ زَادَهَا اللَّهُ تَعَالَى شَرَفًا وَتَعْظِيمًاThe Virtues of Madinah
عن أَنَسٍ (رضي الله عنه) قَالَ : كَانَ لِأَبِي طَلْحَةَ ابْنٌ مِنْ أُمَّ سُلَيْمٍ يُقَالُ لَهُ: أَبُو عُمَيْرٍ، وَكَانَ رَسُولُ اللَّهِ ﷺ يُضَاحِكُهُ إِذَا دَخَلَ ، وَكَانَ لَهُ طَيْرٌ، فَدَخَلَ رَسُولُ اللَّهِ ﷺ فَرَأَى أَبَا عُمَيْرٍ حَزِيْنًا، فَقَالَ: «مَا شَأْنُ أَبِي عُمَيْرٍ ؟» فَقِيلَ: يَا رَسُولَ اللَّهِ، مَاتَ نُغَيْرُهُ، فَقَالَ رَسُوْلُ اللهِ: «أَبَا عُمَيْرٍ۱ مَا فَعَلَ التَّغَيْرُ؟». رَوَاهُ أَحْمَدُ، وَقَالَ ابْنُ الْأَثِيْرِ: هَذَا حَدِيثُ صَحِيحٌ قَدْ أَخْرَجَهُ الْبُخَارِيُّ وَمُسْلِمٌ فِي كِتَابَيْهِمَا ، وَكَذَا التَّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَه.
Anas (may Allah be pleased with him) narrated:
"Abu Talha had a son from Umm Sulaym called Abu Umayr. The Prophet (ﷺ) would joke with him when visiting. The boy had a small bird that died, making him sad. The Prophet (ﷺ) asked: 'Why is Abu Umayr sad?' They said: 'His bird died.' So he said: 'O Abu Umayr, what happened to your little bird?'" [Narrated by Ahmad. 2 The statement: "O Abu Umayr..." - At-Tahawi said this occurred in Madinah; if its game had Makkah's sanctity, the Prophet (ﷺ) wouldn't have allowed keeping the bird. At-Turbushti added: If it were forbidden, he wouldn't have remained silent when needed. Our madhab follows Ibn Mas'ud, Ibn Umar and Aisha - their practice is better than analogy. (Al-Mirqah) As for Sa'd ibn Abi Waqqas' hadith about confiscation, that was when financial punishments were applied for sins (like taking half the wealth of those who refused zakat), but this was abrogated. Ibn Battal said Malik didn't authenticate Sa'd's hadith. (Umdat al-Qari) The confiscation contradicts Madinah having Makkah's sanctity, as there's no confiscation in Makkah's Haram by consensus. (Al-Mirqah) There is no Haram for Madinah in our view (unlike the three Imams), as hunting is permitted unless proven otherwise. (Al-Kafi) The hadith "Madinah is Haram between its two lava fields..." (Muslim) was answered in Al-Muhit as being a solitary narration about a widespread matter, thus unreliable - had it been authentic, it would be widely known.
۱ قوله: يا أبا عمير ما فعل النغير: قال الطحاوي: فهذا كان في المدينة، ولو كان حكم صيدها حكم صيد مكة لما أطلق رسول الله ﷺ حبس النغير ولا اللعب به، كما لا يطلق ذلك بمكة، وقال التوربشتي: لو كان حراما لم يسكت عنه في موضع الحاجة، ومذهبنا مروي عن ابن مسعود وابن عمر وعائشة ، وكفى بهم قدوة، وتقليدهم أولى من القياس باتفاق الناس كذا في المرقاة».
وأما الجواب عن حديث سعد بن أبي وقاص في أمر السلب فهو أنه كان في وقت كانت العقوبات التي تجب بالمعاصي في الأموال، فمن ذلك ما روي عن النبي ﷺ في الزكاة أنه قال: من أداها طائعا فله أجرها، ومن لا أخذناها منه وشطر ماله، ثم نسخ ذلك في وقت نسخ الربا، وقال ابن بطال : حديث سعد بن أبي وقاص في السيب لم يصحعند مالك، ولا أرى العمل عليه بالمدينة. قاله في «عمدة القاري».
وقال في «المرقاة»: وإن أخذ السلب ينافي كون تحريمها كتحريم مكة، فإنه ليس في حرم مكة سلب الثياب في جزاء العقاب إجماعا، مع أنه في ذلك مخالف لجمهور الصحابة، ولذلك قال في رد المحتار: ولا حرم للمدينة عندنا، أي خلافا للأئمة الثلاثة. قال في «الكافي»: لأنا عرفنا حل الاصطياد بالنص القاطع، فلا يحرم إلا بدليل قطعي، ولم يوجد، انتهى.
وقال في شرح الأشباه والنظائر : أقول: وما ورد من قوله : حرمت المدينة ما بين لابتيها، لا تقطع أغصانها ولا يصاد صيدها كما في صحيح مسلم، فأجاب عنه في «المحيط»: أنه من الأخبار الآحاد فيما تعم به البلوى، فلا تقبل؛ إذ لو كان صحيحا لاشتهر نقله.
وَعَنْهُ (رضي الله عنه) قَالَ: قَدِمَ النَّبِيُّ للهِ الْمَدِينَةَ أَمَرَ بِبِنَاءِ الْمَسْجِدِ، فَقَالَ: «يَا بَنِي النَّجَّارِ ثَامِنُونِي، قَالُوا: لَا نَطْلُبُ ثَمَنَهُ إِلَّا إِلَى اللهِ، فَأَمَرَ بِقُبُورِ الْمُشْرِكِينَ فَنُبِشَتْ، ثُمَّ بِالْخِرَبِ فَسُوِّيَتْ، وَبِالنَّخْلِ۱ فَقُطِعَ، فَصَفُوا النَّخْلَ قِبْلَةَ الْمَسْجِدِ. مُتَّفَقٌ عَلَيْهِ.
Jabir (may Allah be pleased with him) narrated: When the Prophet (ﷺ) arrived in Madinah, he ordered the construction of the mosque and said, “O Banu Najjar! Name your price for this land.” They replied, “We do not seek any price except from Allah.” He then commanded that the graves of the polytheists be dug up, the ruins be leveled, and the date palms be cut. They aligned the cut palms towards the qibla of the mosque. [Agreed upon]

Maslamah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) asked me, “Where were you?” I said, “Hunting.” He asked, “Where?” I informed him of the area, and he seemed displeased with it, saying, “If you had gone to Al-Aqiq, I would have escorted you when you left and welcomed you when you returned, for I love Al-Aqiq.” [Narrated by Ibn Abi Shaybah and Al-Sahawi; Al-Tabarani also narrated it with a chain authenticated by Al-Mundhiri]

2 The statement: “If you were to go to Al-Aqiq...” In Al-Nukhbah, it is said: “This is a clear indication from the Prophet (ﷺ) of the permissibility of hunting in Madinah, for the scholars unanimously agree that Al-Aqiq is part of Madinah, with no disagreement. The Prophet’s (ﷺ) encouragement to hunt there over other places is due to the superiority of its game, as the animals feed on the vegetation of Madinah, making their meat superior to game from elsewhere, just as its fruits are superior to others.” This is also in (Al-Mirqat).

وَعَنْ أَنَسٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: أُحُدٌ جَبَلُ يُحِبُّنَا وَنُحِبُّهُ، فَإِذَا جِئْتُمُوهُ فَكُلُوا۱ مِنْ شَجَرِهِ وَلَوْ مِنْ عِضَاهِهِ». رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ».
وَفِيْهِ كَثِيرُ بْنُ زَيْدٍ، وَثَقَهُ أَحْمَدُ وَغَيْرُهُ، وَرَوَى ابْنُ أَبِي شَيْبَةَ مِثْلَهُ.
Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said, “Uhud is a mountain that loves us and is loved by us. When you go there, eat from its trees, even from its thorny bushes.” [Narrated by Al-Tabarani in Al-Awsat; its chain includes Kathir ibn Zayd, whom Ahmad and others deemed reliable. Ibn Abi Shaybah narrated a similar version.]

1 The statement: “Eat from its trees”: This is only permissible by cutting or uprooting, yet we unanimously agree this is impermissible in the Haram of Makkah. Thus, the prohibition elsewhere (outside Uhud) is either recommendatory (not obligatory) or meant to prevent commercial exploitation (not personal consumption), to avoid scarcity and preserve game, similar to the interpretation of the prohibition regarding Wajj Valley’s trees. This is mentioned in Sharh Al-Sunnah: “The Prophet (ﷺ) protected Wajj for public welfare (e.g., charity camels), so hunting there is allowed, as the restriction aimed to prevent public misuse.” Al-Khattabi in Ma’alim Al-Sunan said, “I find no basis for its prohibition unless it was a temporary protection for communal benefit.” If the prohibition was absolute, Al-Tahawi suggested it may have been due to the obligation of migration (Hijrah) to Madinah, ensuring its appeal for settlers. ثم إن صح مراد التحريم، فقال الطحاوى يحتمل أن يكون سبب النهي عن صيد المدينة وقطع شجرها كون الهجرة إليها واجبة، فكان يفعله بقاء لزينتها ليستطيبوها ويألفوها؛ لأن بقاء ذلك مما يزيد في زينتها ويدعوا إليها، كما روى ابن عمر لما أن النبي الله نهى عن هضم آطام المدينة، فإنها من زينتها. فلما انقطعت الهجرة زال ذلك، فكذا هذا. فإن قيل: فصار الأمر محتملا أجيب فعاد على ما كان هو عدم التحريم؛ لأنه الأصل، وإنما أطنبنا الكلام مع أنه خلاف المراد ردا للجاهل بعلم الإمام الأعظم والمجتهد الأعلم الذي صار عياله في الفقه جميع الفقهاء، وقد انفرد بكونه تابعيا من بين المجتهدين عن العلماء حيث قال في حقه لم يبلغه حديث المنع، أو بلغه فخالفه بالرأي والدفع والله سبحانه وتعالى أعلم، هذا كله من المرقاة».
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «لَا يَصْبِرُ عَلَى لَأْوَاءِ الْمَدِينَةِ وَشِدَّتِهَا أَحَدٌ مِنْ أُمَّتِي إِلَّا كُنْتُ لَهُ شَفِيعًا يَوْمَ الْقِيَامَةِ أَوْ شَهِيدًا». رَوَاهُ مُسْلِمٌ.
وَفِي رِوَايَةٍ لَهُ: «لَا يَدَعُهَا أَحَدٌ رَغْبَةً عَنْهَا إِلَّا أَبْدَلَ اللَّهُ فِيهَا مَنْ هُوَ خَيْرٌ مِنْهُ، وَلَا يَثْبُتُ أَحَدٌ عَلَى لَأْوَائِهَا وَجَهْدِهَا إِلَّا كُنْتُ لَهُ شَفِيعًا أَوْ شَهِيدًا يَوْمَ الْقِيَامَةِ».
Abu Hurairah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said, “No one among my Ummah endures the hardships of Madinah except that I will be their intercessor or witness on the Day of Resurrection.” [Narrated by Muslim]
In another narration: “No one leaves Madinah out of dislike for it except that Allah replaces them with someone better. And no one steadfastly endures its hardships except that I will intercede or testify for them on the Day of Resurrection.”

۱ قوله : لا يصبر على لاواء المدينة إلخ : قال النووي: وفي هذه الأحاديث المذكورة في الباب مع ما سبق وما بعدها دلالات ظاهرة على فضل سكنى للمدينة، والصبر على شدائدها، وضيق العيش فيها، وإن هذا الفضل باق مستمر إلى يوم القيامة، وقد اختلف العلماء في المجاورة بمكة والمدينة، فقال أبو حنيفة وطائفة تكره المجاورة بمكة، وقال أحمد بن حنبل وطائفة : لا تكره المجاورة بمكة، بل تستحب، وإنما كرهها من كرهها لأمور، منها: خوف الملل وقلة الحرمة للأنس وخوف ملابسة الذنوب، فإن الذنب فيها أقبح منه في غيرها، كما أن الحسنة فيها أعظم منها في غيرها، واحتج من استحبها بما يحصل فيها من الطاعات التي لا تحصل بغيرها وتضعيف الصلوات والحسنات وغير ذلك، والمختار أن المجاورة بهما جميعا مستحبة إلا أن يغلب على ظنه الوقوع في المحذورات المذكورة وغيرها، وقد جاورتهما خلائق لا يحصون من سلف الأمة وخلفها ممن يقتدى به، وينبغي للمجاور الاحتراز من المحذورات وأسبابها، وقد مر الكلام فيه في آخر باب حرم مكة. وقال في رد المحتار: ولا يظن أن كراهة القيام تناقض فضل البقعة؛ لأن هذه الكراهة علتها ضعف الخلق وقصورهم عن القيام بحق الموضع، قال في «الفتح»: وعلى هذا، فيجب كون الجوار في المدينة المشرفة كذلك، يعني مكروها عنده، فإن تضاعف السيئات أو تعاظمها إن فقد فيها مخافة السامة وقلة الأدب المفضي إلى الإخلال بوجوب التوقير والإجلال قائم.
وَعَنْ سُفْيَانَ بْنِ أَبِي زُهَيْرِ (رضي الله عنه) قَالَ: سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ: تُفْتَحُ الْيَمَنُ فَيَأْتِي قَوْمٌ يُبِسُّوْنَ، فَيَتَحَمَّلُوْنَ بِأَهْلِهِمْ وَمَنْ أَطَاعَهُمْ، وَالْمَدِينَةُ۱ خَيْرٌ لَهُمْ لَوْ كَانُوا يَعْلَمُوْنَ، وَتُفْتَحُ الشَّأْمُ فَيَأْتِي قَوْمٌ يُبِسُّوْنَ فَيَتَحَمَّلُوْنَ بِأَهْلِيهِمْ وَمَنْ أَطَاعَهُمْ، وَالْمَدِينَةُ خَيْرٌ لَهُمْ لَوْ كَانُوا يَعْلَمُوْنَ، وَتُفْتَحُ الْعِرَاقُ فَيَأْتِي قَوْمُ يُبِسُّوْنَ، فَيَتَحَمَّلُوْنَ بِأَهْلِيهِمْ وَمَنْ أَطَاعَهُمْ، وَالْمَدِينَةُ خَيْرٌ لَهُمْ لَوْ كَانُوا يَعْلَمُوْنَ». مُتَّفَقٌ عَلَيْهِ.
Sufyan ibn Abi Zuhayr (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) say, “Yemen will be conquered, and people will come forth with their families and followers. Yet Madinah is better for them if they knew. Then Syria will be conquered, and people will come forth with their families and followers. Yet Madinah is better for them if they knew. Then Iraq will be conquered, and people will come forth with their families and followers. Yet Madinah is better for them if they knew.” [Agreed upon]

Aisha (may Allah be pleased with her) narrated: When the Messenger of Allah (ﷺ) arrived in Madinah, Abu Bakr and Bilal fell ill. I informed the Prophet (ﷺ), and he prayed, “O Allah, make Madinah as beloved to us as Makkah or more, and bless its sa‘ and mudd (measures). Remove its fever and relocate it to Al-Juhfah.” [Agreed upon]

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ (رضي الله عنهما) فِي رُؤْيَا النَّبِيِّ ﷺ فِي الْمَدِينَةِ: رَأَيْتُ امْرَأَةً سَوْدَاءَ ثَائِرَةَ الرَّأْسِ خَرَجَتْ مِنَ الْمَدِينَةِ حَتَّى نَزَلَتْ بِمَهْيَعَةَ، فَتَأَوَّلْتُهَا أَنَّ وَبَاءَ الْمَدِينَةِ نُقِلَ إِلَى مَهْيَعَةَ وَهِيَ الْحُجْفَةُ. رَوَاهُ الْبُخَارِيُّ.
Abdullah ibn Umar (may Allah be pleased with him) narrated regarding the Prophet's (ﷺ) dream about Madinah: "I saw a disheveled black woman leaving Madinah and settling at Mahya'ah. I interpreted this to mean that Madinah's plague would be transferred to Mahya'ah, which is Al-Juhfah." [Narrated by Bukhari]
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ : كَانَ النَّاسُ إِذَا رَأَوْا أَوَّلَ الثَّمَرِ جَاءُوا بِهِ إِلَى النَّبِيِّ ﷺ فَإِذَا أَخَذَهُ قَالَ: «اللَّهُمَّ۱ بَارِكْ لَنَا فِي ثَمَرِنَا، وَبَارِكْ لَنَا فِي مَدِينَتِنَا، وَبَارِكْ لَنَا فِي صَاعِنَا، وَبَارِكْ لَنَا فِي مُدَّنَا اللَّهُمَّ إِنَّ إِبْرَاهِيمَ عَبْدُكَ وَخَلِيلُكَ وَنَبِيُّكَ وَإِنِّي عَبْدُكَ وَنَبِيُّكَ، وَإِنَّهُ دَعَاكَ لِمَكَّةَ وَإِنِّي أَدْعُوكَ لِلْمَدِينَةِ بِمِثْلِ مَا دَعَاكَ لِمَكَّةَ وَمِثْلِهِ مَعَهُ». قَالَ: ثُمَّ يَدْعُو أَصْغَرَ وَلِيدٍ لَهُ، فَيُعْطِيهِ ذَلِكَ الثَّمَرَ . رَوَاهُ مُسْلِمٌ.
Abu Hurairah (may Allah be pleased with him) narrated: "When people would see the first fruits of the season, they would bring them to the Prophet (ﷺ). When he took them, he would say: 'O Allah, bless our fruits, bless our city, bless our sa' and mudd measures. O Allah, Ibrahim was Your servant, friend and prophet, and I am Your servant and prophet. He prayed to You for Makkah, and I pray to You for Madinah with what he prayed for Makkah and more.' Then he would call the youngest child present and give them the fruits." [Narrated by Muslim]

2 The statement: "O Allah, bless our fruits..." Our scholars and Al-Shafi'i considered Makkah superior to Madinah, while Malik held the opposite view based on this hadith. However, we have Abdullah ibn Adi ibn Hamra's hadith where the Prophet (ﷺ) said to Makkah: "By Allah, you are the best land of Allah and most beloved to Allah." Also Ibn Abbas narrated that the Prophet (ﷺ) said to Makkah: "How pure you are as a city and how dear you are to me! Had my people not driven me out, I would not have lived anywhere else." The Prophet's prayer for Madinah was specifically regarding abundance of fruits, not absolute superiority. As mentioned in Sharh An-Nuqayah and Umdat Al-Qari.

وقال في عمدة القاري: فإن قلت: الاستدلال به على تفصيل المدينة على مكة ظاهر. قلت: نعم، ظاهر من هذه الجهة، ولكن لا يلزم من حصول أفضلية المفضول في شيء من الأشياء ثبوت الأفضلية على الإطلاق. فإن قلت: فعلى هذا يلزم أن يكون الشام واليمن أفضل من مكة لقوله في الحديث الآخر : اللهم بارك لنا في شامنا، وأعادها ثلاثا. قلت: التأكيد لا يستلزم التكثير المصرح به في حديث الباب، وقال ابن حزم: لا حجة في حديث الباب لهم؛ لأن تكثير البركة بها لا يستلزم الفضل في أمور الآخرة.

Before acceptance, the gift is not complete without a preventing factor, though revoking is disliked, either prohibitively or preferably. Shafi’i said there is no revocation, and this narration supports us. As stated in Al-Hidayah and Ad-Durr Al-Mukhtar.

1 The statement: “And lawful to you is what is beyond that, that you seek with your wealth”: This verse indicates that marriage requires a dowry, which is obligatory even if not specified, that non-wealth cannot be a dowry, and that a small amount is not suitable as a dowry, as a single grain is not considered wealth, as stated in Al-Madarak.
2 The statement: “We know what We have ordained for them concerning their wives”: This refutes Ash-Shafi‘i’s view that the dowry is not specified by Allah, and its determination is left to the husband’s discretion. Since Allah used the term “ordained,” meaning specification, and attributed it to the speaker’s pronoun, it means what We have specified for them regarding their wives. The verse pertains to dowry, so it is known that the dowry is legally specified by Allah, which is ten dirhams. Jabir ibn Abdullah (may Allah be pleased with him) narrated that a Bedouin pledged allegiance to the Messenger of Allah (ﷺ) then fell ill in Madinah. He came to the Prophet (ﷺ) saying: "O Muhammad, release me from my pledge." The Prophet refused. He came again and was refused. When he came a third time, the Prophet (ﷺ) said: "Madinah is like a furnace - it expels its impurities and purifies what is good." [Agreed upon]

٥قوله: فاستمتع بها هذا الحديث بظاهره يخالف ما ذهب إليه الأحناف من أنه إذا كان الملتقط غنيا لا يجوز له الانتفاع بها. وهذا الحديث يدلُّ على أن الملتقط إذا كان غنيا يجوز له الانتفاع بها؛ لأن أبي بن كعب كان من مياسير أصحاب النبي له وأغنيائهم، ومع هذا فأباح رسول الله ﷺ الانتفاع بها. فالجواب عنه ما في الصحيحين عن أبي طلحة. قلت: يا رسول الله، إن الله تعالى يقول: ﴿لَن تَنَالُوا الْبِرَّ حَتَّى تُنفِقُوا مِمَّا تُحِبُّونَ (آل عمران: ٩٢) وإن أحب أموالي إلي بيرحاء، فما ترى يا رسول الله ؟ فقال رسول الله : اجعلها في فقراء قرابتك، فجعلها أبو طلحة في أبي وحسان، انتهى. فهذا صريح في أن أبيا كان فقيرًا، لكن يحتمل أنه أيسر بعد ذلك، وقضايا الأحوال متى تطرق إليها الاحتمال سقط منها الاستدلال، بذل المجهود» و «نصب الراية» ملخصا.

The majority’s evidence includes the upcoming narration, Let it remain a trust with you, and Muslim’s narration, Note its container and tie, then consume it, and if its owner comes, deliver it to them, and more explicitly, Abu Dawud’s narration: If its seeker comes, deliver it to them; otherwise, note its container and tie, then consume it, and if its seeker comes, deliver it to them. The command to deliver it before and after permitting consumption is the majority’s strongest evidence. As stated in Bazl Al-Majhood. 9 The statement: Deliver it to them, Meaning if the claimant proves its mark, it is lawful to deliver, but not obligatory without proof, according to us. Shafi’i said delivery is obligatory if the mark is proven. According to us, delivery is not judicially required without evidence, but conscientiously, it should be returned. As stated in Sharh Al-Wiqayah and Al-Arf Ash-Shadhi. In Al-Inayah: We say the command in this narration must be interpreted as permission to reconcile with the well-known narration, The burden of proof is on the claimant. If not interpreted as permission but obligation, it would lead to contradiction necessitating abandonment. 10 The statement: Spend it, etc., This indicates clearly that found property is a trust with the finder. The command to spend on oneself is not for ownership but because its purpose is charity. If the finder is poor and needy, it is permitted to give charity to oneself, as the Messenger of Allah (ﷺ) ordered delivery to the owner after spending, meaning the item if it exists or its value if consumed. ٦قوله: فليتصدق به إلخ : قال القاضي : إن من التقط لقطة وعرفها سَنَةً ولم يظهر صاحبها، كان له تملكها، سواء كان غنيا أو فقيرًا، وإليه ذهب الشافعي وأحمد. وروي عن ابن عباس لما أنه قال: يتصدق بها الغني، ولا ينتفع بها، ولا يتملكها، وبه قال أصحاب أبي حنيفة ، ويؤيدنا هذا الحديث، أخذته من «المرقاة».
۸ قوله : ثم كلها فإن جاء باغيها فأدها إليه : قال الحافظ واختلف العلماء فيما إذا تصرف في اللقطة بعد تعريفها سنة، ثم جاء صاحبها هل يضمنها له أم لا ؟ فالجمهور على وجوب الرد إن كانت العين موجودة أو البدل إن كانت استهلكت. وخالف في ذلك الكرابيسي صاحب الشافعي، ووافقه صاحباه البخاري وداود بن علي إمام الظاهرية لكن وافق داود الجمهور إذا كانت العين قائمة. ومن حجة الجمهور قوله في الرواية الآتية: ولتكن وديعة عندك»، وقوله أيضًا عند مسلم: فأعرف عفاصها ووكائها، ثم كلها، فإن جاء صاحبها فأدها إليه وأصرح من ذلك رواية أبي داود بلفظ: فإن جاء باغيها فأدها إليه وإلا فاعرف عفاصها ووكائها، ثم كلها، فإن جاء باغيها فأدها إليه فأمر بأدائها إليه قبل الإذن في أكلها وبعده، وهي أقوى حجة الجمهور. كذا في بذل المجهود».
٩قوله: فأدها إليه: يعني فإن بين مدعيها علامتها حل الدفع، ولا يجب بلا حجة، هذا عندنا. وعند الشافعي يجب الدفع إن بين العلامة، أي لا يجب عندنا الدفع قضاء بلا بينة، وأما ديانة فيردها شرح الوقاية» و«العرف الشذي» ملتقط منهما، وقال في العناية»: ونحن نقول: الأمر في هذا الحديث وجب حمله للإباحة لأجل العمل بالحديث المشهور، وهو قوله : البينة على المدعي الحديث. فإنه لو لم يحمل على الإباحة وحمل الوجوب لزم التعارض المستلزم للترك.
۱۰ قوله: فاستنفقها إلخ: وفي هذه الجملة دلالة ظاهرة على أن اللقطة وديعة عند الملتقط، فالأمر بالاستنفاق على نفسه ما كانت على سبيل التمليك، بل لأنها كانت سبيلها التصدق، فإذا كان الملتقط محلا للصدقة فقيرا ذا حاجة أباحله التصدق على نفسه؛ لأن رسول الله له أمر بعد الإنفاق على نفسه إن جاء صاحبها بعد الإنفاق فأدها إليه أي إن كان موجودًا، وبالبدل إن كان مستهلكا. كذا في بذل المجهود».
وَعَنْ جَرِيرِ بْنِ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ قَالَ: «إِنَّ اللَّهَ أَوْحَى إِلَيَّ أَيَّ هَؤُلَاءِ۱ الثَّلَاثَةِ نَزَلْتَ فَهِيَ دَارُ هِجْرَتِكَ الْمَدِينَةَ أَوْ الْبَحْرَيْنِ أَوْ قِنَّسْرِينَ». رَوَاهُ التَّرْمِذِيُّ.
Jarir ibn Abdullah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: "Allah revealed to me to choose between these three places as my city of migration: Madinah, Bahrain or Qinnasrin." [Narrated by Tirmidhi]

A man from the family of Al-Khattab narrated that the Prophet (ﷺ) said: "Whoever visits me intentionally, I will intercede for him on the Day of Judgment. Yahya ibn Sa'id narrated that while the Messenger of Allah (ﷺ) was sitting near a grave being dug in Madinah, a man looked into it and said: "What a terrible resting place for a believer!" The Prophet (ﷺ) said: "How terrible is what you said!" The man replied: "O Messenger of Allah, I didn't mean that. I meant dying in Allah's cause." The Prophet (ﷺ) said: "Nothing compares to dying in Allah's cause. There is no place on earth where I would prefer to be buried more than this" - meaning Madinah - which he repeated three times. Ibn Abbas (may Allah be pleased with him) narrated that Umar ibn Al-Khattab (may Allah be pleased with him) said: I heard the Messenger of Allah (ﷺ) say in Wadi Al-Aqiq: "A messenger from my Lord came to me tonight and said: 'Pray in this blessed valley and say: Umrah in Hajj.'" 1 The statement: In water, grass, and fire, water refers to that in rivers and wells. If taken and placed in a vessel, it is contained, so selling it is permissible. Grass refers to what grows in unowned land or in owned land without the owner’s cultivation. If the owner cultivates it by watering and preparing the land, the narrations differ. In Adh-Dhakhirah and Al-Muhit: If he sells grass in his land that he cultivated by watering for the sake of the grass, and it grew with his effort, it is permissible, as he owns it. No one can take it without his permission. If it grew naturally, it is not permissible, as it is not owned by him but is permissible by default, as anyone can take it. In Al-Quduri: Selling grass in its land is not permissible, even if he brought water to his land and incurred expenses, as the partnership in grass is established naturally, and partnership ends only by containment. Bringing water to his land is not containment for the grass, so it remains shared, and selling it is not permissible. Al-Halwani narrated from Muhammad (may Allah be pleased with him) that grass is what has no stem, and what stands on a stem is not grass. Al-Fadli said: It is also grass. The partnership in fire means benefiting from its light, warming by it, and drying clothes with it. Taking embers is not allowed without the owner’s permission. As stated in Al-Kifayah.

This hadith is their evidence. This is stated in Al-Marqah. 2 The statement: “With a known measure”: According to Abu Hanifah (may Allah have mercy on him), forward sales have seven conditions: a known type, such as saying wheat or barley; a known kind, such as saying irrigated or rain-fed; a known quality, such as saying good or inferior; a known quantity, such as saying twenty measures or two cubits; a known term, which Ash-Shafi‘i (may Allah have mercy on him) disputed; knowledge of the capital amount; and specifying the place of delivery, which Abu Yusuf and Muhammad disputed. These seven conditions are detailed in Al-Hidayah and other sources. In Fath Al-Qadir, it is stated: This hadith explicitly mentions the conditions of a known quantity and term, and the remaining five are established by implication due to the clear intent of precision to avoid disputes. 3 The statement: “A known term”: The Imams differed regarding immediate forward sales. Imam Ash-Shafi‘i permitted it, while Malik, Abu Hanifah, and others prohibited it. Our evidence is this hadith, as Allah mandated observing the term in forward sales, just as He mandated observing the quantity, indicating it is a condition like quantity. 2 The statement: Ruled that debts are settled before bequests, For this reason, their scholars said: Four rights are attached to the deceased’s estate in order. First, burial and preparation without extravagance or stinginess. Then, debts are settled from all that remains of the wealth. Then, bequests are fulfilled from one-third of what remains after debts. Then, the remainder is divided among the heirs according to the Qur’an, Sunnah, and consensus of the Ummah. As stated in As-Sirajiyyah. If you say: If debts take precedence over bequests, why were they mentioned after in the revelation? I say: Due to the importance of bequests, as they resemble inheritance in being taken without compensation, their fulfillment is burdensome for heirs and significant, and their souls are not at ease with it, making it prone to neglect, unlike debts, which their souls are inclined to settle. Thus, bequests were mentioned before debts to emphasize their obligation and urge haste in fulfilling them alongside debts. As stated in Al-Marqah.
3 The statement: Full siblings inherit to the exclusion of paternal siblings, Some of our meticulous scholars said: The notables of a people are their elites, and full siblings are called the notables. The mention of the mother here is to clarify what gives full siblings precedence over paternal siblings. The meaning is that when full siblings are present with paternal siblings, the inheritance goes to full siblings due to the strength of kinship and dual connection. As stated in Al-Marqah. In Dhaw’ As-Siraj: If it is said: The hadith uses the term sons, which includes males but not females. We say: Not so, rather it includes females just as it includes males. Allah says in the Qur’an: O children of Adam [Al-A’raf: 26], and the address includes women as it includes men.
