Umar ibn al-Khattab (may Allah be pleased with him) narrated: "I heard Hisham ibn Hakim reciting Surah al-Furqan differently from how the Messenger of Allah (ﷺ) had taught me... The Messenger of Allah (ﷺ) said: 'Indeed this Qur'an has been revealed in seven different modes (ahruf), so recite whichever is easy for you.'" [Agreed upon]

English notes

1 His statement: "In seven different modes, etc." It is permissible with the seven narrations, and even with the ten, as stated in Asl al-Usul. However, it is preferable not to recite rare narrations among the common people to safeguard their religion, meaning rare narrations and inclinations, as some fools say what they do not know, falling into sin and misery. Imams should not burden the common people with what diminishes their religion. They should not recite among them like the recitations of Abu Jafar, Ibn Amir, Ali ibn Hamza, and Al-Kisai to protect their religion, lest they mock or laugh, even though all recitations and narrations are correct and eloquent. Our scholars chose the recitation of Abu Amr and Hafs from Asim. This is from Al-Tatarkhaniyyah, from Fatawa al-Hujjah, as mentioned in Al-Durr al-Mukhtar and Radd al-Muhtar. He ordered its writing, but it was scattered on parchments and the like. Abu Bakr ordered its copying from one place to a collected place, like papers found in the Prophet’s house with the Qur'an dispersed, which a compiler gathered and tied with a thread so nothing would be lost. This is in Al-Itqan. Al-Marqat and Umdat al-Qari, compiled from them.

Ubayy ibn Ka‘b (may Allah be pleased with him) narrated: I was in the mosque when a man entered and prayed, reciting in a manner I disapproved of. Then another man entered and recited differently from the first. When we finished the prayer, we all went to the Messenger of Allah (ﷺ). I said"This man recited in a way I disapproved of, and then another came and recited differently from his companion." The Messenger of Allah (ﷺ) instructed them to recite, and he approved of both their recitations. At that moment, doubt entered my heart, something I had not felt even during the days of ignorance. When the Messenger of Allah (ﷺ) saw the distress that had overcome me, he said"By Allah, it is good." Abu Bakr kept reassuring me until Allah opened my heart to what He had opened the hearts of Abu Bakr and Umar (may Allah be pleased with them). I then sought to gather the entire Qur’an from palm stalks, thin white stones, and the memories of men, until I found the last verses of Surah At-Tawbah with Abu Khuzaymah al-Ansari, which I did not find with anyone else: Indeed, there has come to you a Messenger from among yourselves... (9:128) to the end of Surah Bara’ah. The compiled sheets remained with Abu Bakr until his death, then with Umar during his lifetime, and then with Hafsah, the daughter of Umar [Narrated by Bukhari].

Notes /
English notes

1 The statement: "And the memories of men", because they had memorized its miraculous composition and recognized its structure. They had witnessed its recitation from the Prophet (ﷺ) for twenty years, so falsifying anything not part of it was impossible. The only concern was the loss of some authentic parts. As stated in Al-Mirqah. 2 The statement: "I did not find it with anyone else", this indicates that Zayd (may Allah be pleased with him) was not satisfied with merely finding it written down unless he also had oral testimony confirming it, even though he himself had memorized it. He did this as an extra precaution. Al-Sakhawi in Jamal al-Qurra’ said: The meaning is that both witnesses confirmed that what was written had been transcribed in the presence of the Messenger of Allah (ﷺ), or that it was one of the authentic recitations. Abu Shama said their intention was to only write what had been transcribed before the Prophet (ﷺ), not merely based on oral transmission. As cited in Al-Mirqah. 3 The statement: Indeed, there has come to you..., The last verses of Surah Bara’ah were only found with Abu Khuzaymah ibn Thabit. He said"Write them, for the Messenger of Allah (ﷺ) considered his testimony equal to that of two men." So they wrote it. Umar also brought the verse of stoning, but it was not written because it was only attested by him alone. The summary is that they only compiled what was confirmed by definitive evidence in wording and probable evidence in writing. As stated in Al-Mirqah. 4 The statement: "The compiled sheets remained with Abu Bakr...", It is disliked to recite the Qur’an in reverse order, such as reciting a higher-numbered surah in the second rak‘ah than in the first, because the order of surahs is part of the etiquette of recitation. However, it is permitted for children to facilitate learning, except when completing the Qur’an. As mentioned in Sharh al-Muniyyah: In Al-Walawaliyyah, it is stated that one who completes the Qur’an in prayer should, after finishing Al-Mu‘awwidhatayn in the first rak‘ah, bow and then recite Al-Fatihah and part of Surah Al-Baqarah in the second rak‘ah, because the Prophet (ﷺ) said"The best of people are those who are constantly engaged (with the Qur’an)." Al-Durr al-Mukhtar and Radd al-Muhtar, summarized.

Anas ibn Malik (may Allah be pleased with him) narrated that Hudhayfah ibn al-Yaman came to Uthman after fighting alongside the people of Syria in the conquest of Armenia and Azerbaijan with the people of Iraq. Hudhayfah was alarmed by their differences in recitation and said to Uthman, "O Leader of the Believers, save this ummah before they differ over the Book as the Jews and Christians did." So Uthman sent word to Hafsah (may Allah be pleased with her), "Send us the compiled sheets so we may copy them into codices and then return them to you." Hafsah sent them to Uthman, who then ordered Zayd ibn Thabit, Abdullah ibn al-Zubayr, Sa‘id ibn al-‘As, and Abd al-Rahman ibn al-Harith ibn Hisham to transcribe them into codices. Uthman told the three Qurayshi men, "If you and Zayd ibn Thabit disagree over any part of the Qur’an, write it in the dialect of Quraysh, for it was revealed in their tongue." They did so until they had copied the sheets into codices. Uthman then returned the sheets to Hafsah and sent a copy to every region. He also ordered that any other Qur’anic writings on scrolls or in codices be burned [Narrated by Bukhari]

Notes /
English notes

1 The statement: "He sent a copy to every region...", The difference between Abu Bakr’s compilation and Uthman’s is that Abu Bakr’s was motivated by the fear that parts of the Qur’an might be lost with the death of its memorizers, as it had not yet been compiled in one place. He gathered it into sheets, arranging its verses and surahs as the Prophet (ﷺ) had taught them. The purpose of Abu Bakr’s compilation was to preserve the Qur’an in all its recitations and dialects, including those of Quraysh and others. Uthman’s compilation, however, was prompted by widespread differences in recitation as people read in their own dialects. This led some to accuse others of error, so Uthman feared escalation. He thus transcribed the sheets into a single codex, arranging its surahs and limiting it to the dialect of Quraysh, arguing that the Qur’an was revealed in their tongue. Although other dialects had initially been permitted to ease difficulty, Uthman saw that the need for this had passed and restricted it to one dialect. Thus, Abu Bakr’s compilation differed from Uthman’s. Summarized from Al-Mirqah. 2 The statement: "Be burned", Our Hanafi scholars state that if a Qur’anic codex becomes worn and unusable, it should be buried in a clean place away from foot traffic. As mentioned in ‘Umdat al-Qari, this is supported by Ibn Abi Dawud’s narration that a member of Abu Talhah’s family said Uthman buried the codices between the grave and the pulpit. As for burning, Abd al-Razzaq reported that Ibrahim disliked it. Al-Qari said analogizing Uthman’s action is impermissible because he only burned what was confirmed not to be part of the Qur’an or what was irretrievably mixed with it. He chose burning to eliminate doubt, had it been Qur’an, no Muslim would have permitted its burning. This is further evidenced by the lack of instruction to preserve its ashes from impurity, contrary to the Shafi‘i view of transformation. The discussion here concerns what is definitively established. Given the distinction and apparent disrespect, burial is obligatory. In Nafi‘ al-Mufti wa al-Sa’il, it is stated that discarded papers containing Allah’s name should be erased and then thrown into abundant water or buried in clean earth. As in Nasab al-Ihtisab, people neglect this, tearing and scattering such papers in pathways and filth without concern. In Al-Dhakhirah: A worn codex that can no longer be read should not be burned, this is Muhammad’s view, and we follow it. Burial is not disliked; it should be wrapped in a clean cloth and placed in a niche to avoid trampling. Alternatively, it may be washed with water or stored in a clean place safe from contamination. This honors the speech of Allah. As in Radd al-Muhtar.

1 The statement: "From him...", Mentioned in Majma‘ al-Zawa’id.

Uthman replied: 'Sometimes long surahs would be revealed to the Messenger of Allah (ﷺ). When something was revealed, he would call his scribes and say: "Put these verses in the surah that mentions such-and-such." Al-Anfal was among the first revealed in Medina, while Bara'ah was among the last of the Qur'an. Their themes were similar, and the Messenger (ﷺ) passed away without clarifying if they were one surah. Therefore, I joined them without writing 'Bismillah' between them and placed them among the seven long surahs.'" [Ahmad, Tirmidhi, Abu Dawud]

Ibn Abbas (may Allah be pleased with them) reported: "The Prophet (ﷺ) would not know the end of a surah until 'Bismillah ar-Rahman ar-Raheem' was revealed. When it was revealed, he would know that the surah had ended and a new one had begun." [Al-Bazzar with two chains, one of which has authentic narrators]

In Al-Binayah: The discussion on Basmalah has three aspects:

Whether it's part of the Qur'an

Whether it's part of al-Fatihah

Whether it's part of every surah

For the first: The correct Hanafi view is that it's part of the Qur'an because the ummah agrees anything written between the covers by revelation is Qur'an - and Basmalah is written thus. Al-Mu'alla narrated from Muhammad: "I asked Muhammad: 'Is Basmalah a Qur'anic verse?' He replied: 'Everything between the two covers is Qur'an.'" Similarly Al-Jassas reported Muhammad said: "Basmalah is part of the Qur'an revealed to separate surahs, recited initially for blessing but not part of any surah." Based on this, the recitation obligation is fulfilled by Basmalah according to Abu Hanifah when recited with intent of recitation not praise, since it's a Qur'anic verse.

Some of our scholars disagreed because there's doubt whether it's a complete verse, as Al-Awza'i said: "Allah only revealed 'Bismillah...' in Surah an-Nahl (16:98), and it's not a complete verse - the complete verse is "Indeed, it is from Solomon, and indeed, it is: 'In the name of Allah...'" (27:30)." Thus since there's doubt about it being a complete verse, it can't be relied upon, and it's prohibited for those in major impurity to recite it as Qur'an. According to Al-Karkhi's view, even less than a verse is prohibited for them, and similarly in At-Tahawi's narration due to possibility of it being a complete verse, so it's prohibited as precaution.

In 'Umdat al-Qari': At-Tahawi said: "The Prophet's (ﷺ) not reciting Basmalah aloud proves it's not part of the Qur'an, because Qur'an must be recited aloud. The Basmalah in an-Naml (27:30) must be recited aloud like other Qur'an, but it's established to recite it quietly like seeking refuge and opening supplications. Since we see it written at surah beginnings in the mus'haf but it's not part of non-Fatihah surahs, this proves it's not part of al-Fatihah either."

For the second and third aspects: Our view and the majority's is that it's not part of any surah - neither al-Fatihah nor others. Ash-Shafi'i held it's definitely part of al-Fatihah and famously held it's part of every surah [Al-Sa'ayah]. If one argues: "Had it not been part of every surah, why did the Prophet (ﷺ) recite it with al-Kawthar?" We reply: This doesn't prove it's part of every surah, only that it's an independent verse. Evidence includes the revelation's beginning when the angel said: "Read in the name of your Lord..." (96:1) - had Basmalah been part of every surah's beginning, he would have said: "Read 'Bismillah... Read in the name of your Lord...'" Also, the Prophet (ﷺ) said: "A surah of thirty verses interceded..." (referring to al-Mulk without Basmalah) [Narrated by at-Tirmidhi as hasan, and others] - had Basmalah been part of it, he would have mentioned it Umdat al-Qari.

English notes

1 The statement: "He would not recognize the end of a surah until 'Bismillah...' was revealed..." - Scholars have differed over this matter with nine opinions. Al-Shafi'i held it is an ayah of Surah al-Fatihah and every surah. Early Shafi'i scholars said it's not part of the Qur'an but was revealed to separate surahs. Later Hanafi scholars said it's part of the Qur'an revealed for separation but not part of any surah. They ruled that omitting Basmalah once during complete Qur'an recitation in Taraweeh doesn't invalidate the Sunnah - this being the most correct view as verified by Al-Taftazani in his marginalia on Al-Kashshaf and Al-Zayla'i in Nasb al-Rayah [Al-Sa'ayah].

English notes

1 The statement: "Until Bismillah... was revealed", Our scholars cite this as evidence that the Basmalah is an ayah revealed to separate surahs. The apparent meaning of the hadith indicates its revelation was repeated, which carries no objection. Rather, it demonstrates its virtue, like the repeated revelation of Al-Fatihah according to one opinion (Al-Mirqah)

2 The statement: "It is Blessed is He...", The evidence from this is that this surah consists of thirty verses excluding the Basmalah, without dispute among those who count the verses. Additionally, its opening with Blessed is He... proves the Basmalah is not part of it (Al-Binayah)

Abu Hurairah (may Allah be pleased with him) narrated in a lengthy hadith: I heard the Messenger of Allah (ﷺ) say: "Allah the Exalted said: 'I have divided the prayer between Myself and My servant into two halves...'" [until the end of Surah Al-Fatihah] [Narrated by Muslim]

Notes /
English notes

3 The statement: "The servant says: Alhamdulillahi Rabbil-‘alamin", Ibn ‘Abd al-Barr said: This hadith resolves the confusion about the omission of the Basmalah from Al-Fatihah. It is an explicit text that cannot be interpreted otherwise. The evidence is that Allah began the division with Alhamdulillah... without the Basmalah. Had it been part of the surah, He would have started with it. Moreover, making Iyyaka na‘budu the midpoint results in three verses for Allah’s praise, three for the servant, and one between them. Including the Basmalah would invalidate this division. Also, the Prophet (ﷺ) said the servant recites Ihdina as-sirat al-mustaqim to the end, then said: "These are for My servant", narrated by Abu Dawud and An-Nasa’i with sound chains. This implies three verses, whereas according to Ash-Shafi‘i’s view (counting the Basmalah), it would be two, making four and a half for Allah, contradicting the hadith’s explicit "half." Here"prayer" means recitation (Al-Binayah)

1 The statement: "Supplications", An-Nawawi said: Scholars across all regions and eras unanimously agree on the recommendation of supplication, based on the apparent texts of the Qur’an, Sunnah, and traditions of the prophets (Al-Mirqah) 2 The statement: "I respond...", The response to supplication means Allah says"Here I am, My servant," at the time of calling, this is granted to every believer. It does not necessarily mean granting the request, as the verse does not mention this. Lovers who call upon Allah without worldly or religious desires are never deprived, even if they seek nothing but Him. Sometimes, Allah delays the response because He loves to hear His servant’s voice, as Yahya ibn Sa‘id reported seeing in a dream: "O Yahya, I love to hear your voice." Other reasons include lacking conditions for acceptance (halal sustenance, sincerity), or because Allah’s favor is tied to His will. The response may also come as: 1) acceptance of the exact request, 2) averting a calamity, or 3) elevating one’s rank in the Hereafter, as in authentic reports. Alternatively, the word "when" may imply partiality (At-Tafsirat al-Ahmadiyyah)
