الل بزر و برتر كا رشاد يا اي ا اللذين امنوا انما الخمر والميسر والانصاب والازلام رجس من عمل الشيطان فاجتنبوه لعلكم تفلحون انما يريد الشيطان ان يوقع بينكم العداوه و البغضاء في الخمر والميسر ويصدكم عن ذكر الل وعن الصلاه فهل انتم منتهون
ترجمہ: اے ایمان والو! بلاشبہ شراب، جوا، بت اورپائے (یہ سب) ناپاک اورشيطانی کام
ہیں تو ان سے پچھڑہوتا کر تم کامیاب ہو بلاشبہ شیطان تو بھی چاہتا ہے کہ شراب اور جوے کے

حضرت سالم بن عبد اللہ اپنے والد سے روایت کرتے ہیں کہ رسول اللہ صلی اللہ
علیہ وسلم نے فرمایا: ان میں الْعِنبِ خَمْرَا (یعنی انگور سے شراب ہے) اور میں تم کوہرنشا ور
قولہ: اعْصِرُ خَمْرًا (میں شراب چوڑ رباہون) فقہاء نے کہا یاس بات کی دلیل ہے کہ شراب چوڑی
جانے والی چیز سے بھگونی جانے والی چیز (یعنی نمیز بنائی جانے والی چیز) نمیں ہے -(نیل الاوطار)
قولہ: ان میں الْعِنبِ خَمْرَا لح (شراب انگور سے ہے) تم اس بات کو جانو کروہ تمام چیزیں جس سے
شراب بن کشیدی جاتی ہیں چار ہیں -
انگور 2- کجور 3- شکمش 4- دیگر غلہ جیسے گیہون، جو اور کچی
پھراس پانی کی جوان اجناس سے کشید کیا جاتے گا دو حالیتیں ہیں (1) کچا (2) پکا یا ہوا
پھیر پکا ہو نے کی دو شمیں ہیں -
اتنا پکا یا ہو کر اس کا دو تھائی اثر جاتے اور ایک تھائی باقی رہے -
ایک تھائی اثر جاتے دو تھائی رہے یا نصف اثر جاتے نصف رہے -
اور ان اجناس سے کشید کی جانے والے پانی کے بھی تین قسم ہیں -
میٹھا 2- قارص (ترش و تیز) 3- کڑوا
انگور سے بنائی جانے والی چیزیں پانچ ہیں -
خمر (شراب) انگور کا کپا پانی جب اس میں جوش آ جاتے اور وہ تیز ہواور جهاگ آ جاتے پیامام ابوحنیفرحمۃ
اللہ علیہ کے پاس ہے اورصاحبین کے پاس جب تیز ہوا جاتے تو بغیر جهاگ کے نہیں وہ (خمر) شراب بن جاتا ہے اور
اتمر تلاش کی پی فرماتے ہیں -
امام اعظم ابوحنیفرحمۃ اللہ علیہ کی دلیل یہ کہ جوش کا آنا تیزی ہے اور اس میں کمال جهاگ آ نے اور جوش کے
کچھ جانے سے ہے کیونکہ اس سے شراب خالص کی مکدر سے تمیز ہوتی ہے اور شریعت کے احکام قطعی ہیں اور وہ انتہائی
حد پر متعلق ہوتے ہیں جیسے حدود، اور حرام کو حلال جانے والے کو فرق اردن اوراس کے متعلق احکام ہیں تو اس کی
(یعنی ایسی شراب کی) تجویزی اور زیادہ مقدار سب حرام ہے -
باذق: وہ ہے جس کو تجویز اس اپکا یا گیا ہو تو اس کا پی میٹھا پانی حلال ہے اور جب اس میں جوش آ جاتے اور وہ تیز
ہو جاتے تو حرام ہے - .......
منصف: وہ جس کو اس قدر پکائی جائے کہ وہ آدھارہ جائے۔ اس کا حکم بھی بازوق کے حکم کی طرح ہے۔
ملٹھ: وہ جس کو اس قدر پکائی گیا ہو کہ دو تہائی پلے جائے۔ اور ایک تہائی رہ جائے تو پی حلال ہے اگر چیکہ
اس میں جوش آ کے اور تیز ہو جائے۔ اور پی حضرت امام اعظم البوحنیفہ اور امام ابویوسف رحمہما اللہ کے پاس سے۔
اور امام محمد امام مالک اور امام شافعی رحمہ اللہ کے پاس اس کی تجویزی مقدار اور زیادہ سے حرام ہے۔ اور ایک خلاف
اس وقت سے جب کس سے قوت حاصل کرنا مقصود ہے۔ اور اگراس سے خواہش نفس (مشغل) مقصود ہو تو بالاتفاق یہ
حلال نہیں ہے۔ اور حضرت امام محمد رحمہ اللہ نے دو شخصیں کے مش ایک قول مروی ہے۔ اور ایک قول میں وہ اس کو کروہ قرار
دے ہیں۔ اور ایک قول میں ان سے توقف ثابت ہے کہ اصول سے کہہ ہے کہ میں اس کو نہ حرام قرار دیتا ہوں۔ اور ہے جائز
قرار دیتا ہوں۔
جمهوری: پا چویں قسم جمهوری وہ اگور کا شیرہ ہے۔ جب اس پر پانی دال دیا جائے۔ اور اس قدر پکائی جائے کہ اس کا
ایک تہائی اڑ جائے۔ اور دو تہائی باقی رہے۔ اس کا حکم بازوق کے حکم کی طرح ہے۔
کس کس شے بنائی جائے۔ والی شراب کی دو قسمیں ہیں۔ 1_ تقیق 2_ نبيذ
تقیق لیعن تقیق یہ کہ اس کو پانی میں دال کراس قدر جحوڑ دیا جائے کہ پانی میں اس کی مطہاس آجائے۔ اس کا
حکم بازوق کے حکم کی طرح ہے (حلال ہے)۔
اور دوسری لیعن نبيذ کس کس شے کا وہ پانی ہے۔ جس کو جحوڑ اس پکائی جائے۔ اس کا حکم مثلث کے حکم کی طرح ہے۔
کہ جحوڑ سے بنائی جائے۔ والی شراب۔ اس کی تین قسمیں ہیں۔
فضیح: گدرے کہ جحوڑ سے بنائی جائے۔ والی شراب۔ اس کا حکم بازوق شراب کے حکم کی طرح سے ہے۔
سکر: (کے، حکمت کے ساتھ) پی کہ جحوڑ سے بنائی جائے۔ والی شراب۔
تقیق: گدرے کہ جحوڑ سے بنائی جائے۔ والی شراب۔ اس کا حکم بازوق شراب کے حکم کی طرح سے ہے۔
نبيذ: یہ اور گدرے دم دار جحوڑ کے پانی سے بنایا جائے۔ والا شیرہ جب اس کو جحوڑ اپکائی جائے۔ اس کا حکم
مثلث کا حکم ہے۔
شہد، آلو بخارا، شہتوت، کمی اور گیہول سے بنائی جائے۔ والی شراب بھی مثلث کی طرح سے ہے۔
آپ کو یہ بات بھی معلوم ہونا چاہئے کہ خمر کے حقیقی معنی اتم لغت کے پاس بالاتفاق حقیقت میں اگور کے پانی کی
پی شراب کے پی جب اس میں سکر (لیعن نشر) آ جائے۔ یہاں تک کہ لفظ خمر کا استعمال اس معنی میں مشہور ہو گیا ہے۔
اس کے سوا مختلف ناموں کے ساتھ اس کو جا خمر موسوم کیا گیا ہے۔ اور پیہمارے (خفیہ) کے پاس سے امام شافعی اور
دیگر ائمہ نے فرمایا کہ "خمر" پر نشر آور چیز کا نام ہے۔ کیونکہ عبد اللہ بن عمر رضی اللہ عنہما سے روایت ہے کہ حضرت علی اللہ علیہ وسلم
نے فرمایا پر نشر آور چیز خمر ہے۔ اور پر نشر آور چیز حرام ہے۔
اور نعمان بن بشیر رضی اللہ عنہما سے روایت ہے۔ انہوں نے کہا۔ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا کہ گیہول
سے خمر ہے۔ اور جو سے خمر ہے۔ اور کس شے سے خمر ہے۔ اور جحوڑ سے خمر ہے۔ اور شهد سے خمر ہے۔
........سیرنا ابوہریرہ رضی اللہ عنہ روایت سے کر رسول اللہ صلی اللہ علیہ وآلہ وسلم نے فرمایا نمر کہ جور اور انگور کے ان دو درختوں سے ہے۔ اور "نخر" کا نام اس کے عقل کو ذہاک دینے کی وجہ سے نمر کہا گیا ہے۔ اور ہر نشآور چیز عقل کو ذہاک دینے سے۔
ہمارا کہنا یہ ہے کہ لفظ "نخر" حقیقت میں انگور کے پانی کی پھیثراب کا نام ہے جب کروہ نشآور نہوجائے۔ اور اس کے سوا دوسری شرابول میں سے ہر ایک کے لے الگ نام ہے۔ جیسے مثلث، باذق، طلاء اور منصف اور سکر وغیرہ ان دوسری شرابول پر نمر کا اطلاق مجازاً اور فرق مقابل (دیگر اتمہ) کی احادیث کو ای پر مقبول کیا جاتے ہیں۔ اس باب کی نذکورہ احادیث اس کی تفسیر کرتی ہیں۔ کیونکہ اس باب کی احادیث میں کچھ جوشآور ثراب سے وہ نمر کے علاوہ ہے۔ کیونکہ عطف مغايرت کا تقاضہ کرتا ہے۔ اس کی تفصیل یہ ہے کہ حضرت رسول اللہ صلی اللہ علیہ وسلم کا ارشاد کر ائی کہ "نمر کہ جور اور انگور کے ان دودرختوں سے ہے"۔ہمارے پاس اس کی بہت سی تاویلات ہیں۔
۔ اس حدیث شریف اور اس جسی دوسری احادیث شریفہ میں اس کے حکم کو جتنی حرمت کوپیان کرنا مقصود ہے۔ حقیقت کا بیان مقصود نہیں ہے کیونکہ کچھ بات منصب رسالت کے مناسب ہے۔ اس لے کہ نبی اکرم صلی اللہ علیہ وسلم احکام بیان کرنے کے لے معبوت ہوئے۔ جس حقائق بیان کرنے کے لے نہیں کر آپ اس طرح فرما کیں کہ پیچھے اور پیدرخت ہے کیونکہ فرار انسانی میں سے ہر ایک اس کو جانتا ہے۔
۔ حضرت صلی اللہ علیہ وسلم کے ارشاد کے دودرختوں سے "ان دونوں میں ایک مراد ہے جسے اللہ بزرگ وبرتر کا ارشاد ہے "یَمْعُشَرَ الْجِنِّ وَالْإِنسِ أَلَمْ يَأْتِكُمْ رُسُلٌ مِّنكُمْ "(اے جن وانس کی جماعت کیا تمہارے پاس تم میں سے رسول نہیں آئے) (سورۃ الانعام، 6، آیت نمبر:130) رسول انسانوں میں سے ہوئے جنات میں سے نہیں اور اللہ بزرگ وبرتر کا ارشاد "یَخْرُجُ مِنهُمَا اللُّؤْلُؤُ وَالْمَرْجَانُ " (ان دونوں سے موتی اور موم نگ تکتے ہیں) (سورۃ الرحمن، 55، آیت نمبر:22) حالاںکہ وہ توصرف ان دونوں سے ایک سے نکلتے ہیں۔ پس رسول اللہ صلی اللہ عليه وسلم کے ارشاد کا مقصود یہ کہ نمر انگور کی سے ہے کہ جور سے نہیں۔
۔ دونوں درخت مرادہوں اور ان میں کا جوشی (عقل کو) ذہاک دے وہ نمر ہے۔
۔ اس کا مطلب یہ کہ نمر ان دودرختوں سے ہے اگر چہ کوہ مختلف ہیں۔ لیکن عنب (انگور کی شراب) سے نمر کا حقیقت مراد مفہوم ہے اور اس کے لے اس کا نام نمر کہا گیا ہے نموہ وہ کہوڑاہو یازیادہ، نشر لائے یانہ لائے اور کہ جور کی شراب نشآور سے پیس کہ جور (کا جوپانی) نشرآوردہووہ اس میں داخل نہیں اور یہ بات انگور کے سواہر اس چیز میں ہے جس پر نمر کا اطلاق کیا گیا۔
اگر تم یہو کہہروہ چیز جوشآور نہواس پر نمر کا اطلاق کیا جاتا ہے۔ چنانچہ کیا تم عبد اللہ بن عمر رضی اللہ تعالی عنہما کی حدیث میں دیکھے جو نبی اکرم صلی اللہ عليه وسلم سے مرودی سے کرآ پعلیسے نے ارشادفر مایا "ہر نشآور نمر سے اور ہر نشآور چیز ہرام ہے۔".......
پاۓ جانے کی حالت میں خمر کھا جاتا ہے۔ نشر نہوں نے کی صورت میں نہیں۔
برخلاف انگور کے پانی کے جوہریز ہوگیا تو وہ بھر حالت میں خمر ہے نواہ وہ نشر لا گے۔ اس کی ویل رسول اللہ صلی
اللہ علیہ وسلم کا ارشاد ہے ’الخمر ماخامر العقل‘، خمر وہ ہے جو عقل کو ذہاکر دے۔ اس کے عقل کو ذہا کرنے کی
صورت میں اس کا نام خمر رکھا گیا ہے۔ برخلاف انگور کے پانی کے جوہریز ہو جائے۔
اگر تم بیہو کہ جب رسول اللہ صلی اللہ علیہ وسلم کے منادی ان کے پاس پینے کے خمر (شراب) حرام کروئی جائے گی تو
وہ رکے گے اور نہوں نے مگر کو توڑ دیا اور اس سے انکار نہیں کیا اور نہ بیکہا کی تم حی رہے ہیں بلکہ وہ اس سے رکے
گے۔ اگر وہ ان کے پاس خمر نہوں تو اس سے نہ رکے تو اس میں بیکہتاہوں کر جوہریز وہ اس وقت پی رہے ہیں وہ نشر آور
تھی اور نشر آور پر خمر کے نام کا اطلاق کیا جاتا ہے اس اعتبار سے کروہ عقل کو ذہا کر دیتی ہے۔ کیونکہ خمر حقیقتاً انگور کی وہ
پچی شراب ہے جوہریز ہو جائے۔ اور اس شراب کے تحویلے حضرت پر حی حمد متعلق ہوئی ہے۔ انگور کے سواد وسری اور شرابول
سے جب تک کروہ نشر آور نہ ہو لحد متعلق نہیں ہوتی۔
اور ہمارا کہنا کہ ’خمرصرف عنب سے ہے‘ صحابہ کے اس قول کے خلاف نہیں کہ ’خمر پانچ چیزوں سے ہے‘ اور ان کی
فصاحت (حسن تعبیر) ہمارے قول کے لئے مضر نہیں ہے۔ کیونکہ وہ اپنے کلام میں حقیقت وجا کو جمع کے ہیں جویں
فصاحت سے صحابہ کے کلام میں ان دونوں کے درمیان وی آدی فرق کر سکتا ہے جس کو کلام کی بار کیوں کے ادراک کا
ذوق ہے۔ نہیں صحابہ کی حرم الرضوان نے غیر انگور کے شیرہ پر خمر کا جوا اطلاق کیا ہے تو وہ لغت کے اعتبار سے نہیں ہے بلکہ
تشیہ کے طور پر لیتی (کسی چیز کا نام رکھنے کے طریقے پر ہے)۔ اور نام رکھنا یو ضع سے بہتر کر ہوتا ہے۔ جس میں کوئی
اختلاف نہیں اور ان کا پی نام رکھنا تشیہ اور جاز کے باب سے ہے حقیقت سے نہیں۔ اس کے سوائیں کر اخول نے کچوراور
رطب سے بنائے ہوئے شیرہ کو بھادیا کیوں کہ وہ اس وقت نشر آور نہا اس کے نشر لا نے کی وجہ سے اس کو خمر کہا گیا وہ کر ضع
لغوی اعتبار سے۔ جس وقت ان کو خمر کے حرام ہو نے کی اطلاع میں اس وقت وہ نشر آور نہیں اس کی ویل وہ حدثیں ہیں
جن کو ابو عاصم نے ان الفاظ کے ساتھ روایت کیا ہے کہ جس وقت ان کے مر ظہاکے گے تو ایک صحاب آ گے اور انہوں
نے کہا کہ خمر حرام کروئی گئی۔ اخول نے کہا کہ تم میں کوئی نکلے والانہیں نکلا اور کوئی داخل ہو نے والا داخل نہیں ہوا
پہال تک کہ تم نے گھڑے توڑ دے۔ اور شراب کو بھادیا (الحدیث)
اگر وہ غیر موسکر ہوئی وہ عمل نہ کرتے۔ امام طحاوی رحمۃ اللہ علیہ حضرت انس رضی اللہ عنہ کہتے ہیں کہ اخول نے کہا: ابوعبدہ بن جراح، سمیل بن بیضاء، الی کعب رضی اللہ عنہم، یحضرات البطل رضی اللہ عنہم
کے پاس تھے اور میں ان کو شراب پلا رہا تھا پیال تک کروہ ان میں اثر کرنے کو تھی۔ (الحدیث) اور اس حدیث کے اخیر
میں پیہ کر گردے۔ اور پی کچور تھے۔ اور وہ ان دونوں کے اماری خمریں شراب تھی۔ اور اس کو امام احمد نے روایت کیا ہے۔
اور اس میں پرالفاظ ہیں ’حتی کاد الشراب ان یاخذ فیہم‘۔ یہاں تک کہ شراب ان میں اثر کرنے کو تھی۔ اور……
چیز سے منع کرتا ہوں - (طحاوی)-
Salim ibn Abdullah ibn Ubayd narrated that the Messenger of Allah (ﷺ) said: Indeed, from grapes there is wine, and I forbid you from every intoxicant. [Narrated by Al-Tahawi.]
In another narration by him from Ibn Abbas (may Allah be pleased with them), he said: Wine is prohibited in itself, and the intoxicant from every drink. And in a narration by Al-Tabarani and Al-Daraqutni, something similar. Al-Nasa’i narrated in his Sunan through multiple chains from Ibn Abbas (may Allah be pleased with them), who said: Wine is prohibited, whether little or much, and the intoxicant from every drink.
In another narration: Wine is prohibited in itself, little or much, and the intoxicant from every drink. And in another narration: Wine is prohibited, little or much, and whatever intoxicates from every drink. And Al-Bazzar narrated something similar. Our companions said: The intoxicant from every drink in these narrations is other than wine because the conjunction implies distinction.
Abd al-Razzaq narrated from Ibn Amr with a good chain, who said: As for wine, it is forbidden with no way to it, but as for other drinks, every intoxicant is forbidden.
In a narration by Abu Dawud (may Allah be pleased with him), the Prophet (ﷺ) forbade wine, gambling, the drum, and ghubayra, and said: Every intoxicant is forbidden.
Abu Dawud and Ibn Majah narrated from Ibn Umar (may Allah be pleased with them), who said: The Messenger of Allah (ﷺ) said: Allah has cursed wine, its drinker, its server, its seller, its buyer, its presser, the one for whom it is pressed, its carrier, and the one to whom it is carried.
In a narration by Muslim: Whoever drinks wine in this world and dies addicted to it without repenting will not drink it in the Hereafter.
The jurists have said that this is proof that wine is derived from a substance that ferments and becomes intoxicating. - (Nail al-Awtar)
The statement: 'Among them, al-'inab khamra' (wine is made from grapes). You should know that there are four substances from which wine can be extracted:
1. Grapes
2. Dates
3. Figs
4. Other grains such as barley, wheat, and young fruits and vegetables.
There are two conditions for these substances: (1) Raw (2) Ripe or fermented. The ripening has two stages:
1. So ripe that two-thirds of its effect is lost and one-third remains.
2. One-third of its effect is lost and two-thirds remain, or half of its effect is lost and half remains.
And there are three types of water that can be extracted from these substances:
1. Sweet
2. Tart (sharp and acidic)
3. Bitter
There are five things that can be made from grapes:
1. Khamr (wine): The juice of grapes when it begins to ferment and becomes sharp and foamy. According to Imam Abu Hanifa (RA), it is considered wine when it becomes sharp and foamy. Imam Abu Hanifa (RA) would search for foam, and when it became sharp without foam, it was considered wine.
2. Bazraq: If it is extracted to the point where it is sweet, it is permissible to drink. When it begins to ferment and becomes sharp, it is forbidden.
3. Mustaq: If it is cooked until it becomes thick, its ruling is like that of bazraq.
4. Muthlath: If it is cooked until two-thirds of it evaporates and one-third remains, it is permissible to drink even if it ferments and becomes sharp. This is according to Imam Abu Hanifa (RA) and Imam Abu Yusuf (RA). Imam Muhammad, Imam Malik, and Imam Shafi (RA) consider any amount that causes intoxication to be forbidden. If the intention is to gain strength or pleasure, it is unanimously forbidden.
5. Jumhuri: The fourth type, jumhuri, is grape syrup. When water is added and it is cooked until one-third evaporates and two-thirds remain, its ruling is like that of bazraq.
There are two types of wine made from different substances: 1. Tiquq 2. Nabidh
1. Tiquq: This means that it is soaked in water until its flavor is absorbed. Its ruling is like that of bazraq (permissible).
2. Nabidh: This is the water of a substance that is cooked. Its ruling is like that of muthlath (forbidden if it causes intoxication).
There are three types of nabidh:
1. Sakr: (with wisdom) It is drunk after being cooked and becoming sharp.
2. Tiquq: It is cooked and becomes sharp. Its ruling is like that of bazraq.
3. Nabidh: It is drunk and cooked until it becomes sharp. Its ruling is like that of muthlath.
Wine made from honey, apples, grapes, raisins, and barley is also like muthlath.
You should also know that the true meaning of khamr, according to the lexicons, is the juice of grapes that becomes wine when it ferments and becomes sharp. The term khamr has become famous in this sense. Apart from this, it is known by various names. Imam Shafi (RA) and other Imams have stated that 'khamr' refers to anything that causes intoxication, based on the narration from Abdullah bin Umar (RA) that Ali (RA) said, 'Anything that causes intoxication is khamr, and anything that causes intoxication is forbidden.'
Another narration from Nu'man bin Bashir (RA) states that the Prophet (SAW) said, 'Wine is made from barley and grapes, and anything that causes intoxication is forbidden.'
Abu Hurairah (RA) narrated that the Prophet (SAW) said, 'Intoxicants come from these two trees: the date palm and the grapevine.' The term 'nakh' is used because it causes intoxication. Every intoxicant is named nakh because it causes intoxication.
Our view is that the term 'nakh' specifically refers to the foam of grape juice before it becomes intoxicating. Each type of wine has a different name, such as muthlath, bazraq, tala, and mustaq, among others. The term nakh is applied figuratively to other wines, and this is accepted based on the differences in the hadiths. These hadiths explain the matter, as some hadiths mention fermentation and intoxication beyond just nakh, which requires distinction.
The Prophet (SAW) said, 'Intoxicants come from these two trees: the date palm and the grapevine.' There are several interpretations of this hadith:
1. The purpose of this and similar hadiths is to emphasize the prohibition, not to describe the reality, as some matters are appropriate for the station of prophethood. The Prophet (SAW) was sent to convey commands, not to describe realities. For example, he did not say, 'Behind and in front of the tree,' because every human knows this.
2. The intended meaning is that both trees produce something that causes intoxication, as Allah says, 'From both of them come pearls and coral' (Quran 55:22), although they come from only one of them. Thus, the Prophet (SAW) meant that nakh comes from grapes, not from dates.
3. Both trees are intended, and what causes intoxication from both is nakh.
4. The meaning is that nakh comes from both trees, although they are different. However, the true meaning of nakh is from grapes, and it is called nakh because it causes intoxication, whether it is a small or large amount. The juice of dates, when it becomes intoxicating, is not called nakh, and the same applies to other substances.
If you argue that nakh is applied to anything that ferments and causes intoxication, as seen in the hadith of Abdullah bin Umar (RA) where the Prophet (SAW) said, 'Every intoxicant is nakh, and every intoxicant is forbidden,'...
Khamr is consumed when it causes intoxication, not when it does not. If grape juice ferments, it is khamr in all cases, even if it does not cause intoxication. The Prophet (SAW) said, 'Khamr is what confounds the mind.' It is called khamr because it confounds the mind. If grape juice ferments,
If you argue that when the Prophet (SAW) announced the prohibition of drinking khamr, the people stopped and broke their containers without objection, it shows that they were drinking something that caused intoxication. If it did not cause intoxication, they would not have stopped. At the time of prohibition, what they were drinking was intoxicating, and anything that causes intoxication is called khamr because it confounds the mind. Khamr is truly the fermented juice of grapes that causes intoxication, and this is related to the hadiths concerning the Prophet (SAW).
Our statement that 'khamr is only from grapes' does not contradict the statement of the Companions that 'khamr is from five things.' Their eloquence does not harm our statement, as they combine truth and falsehood in their speech. The Companions could distinguish between the two, as those with a taste for language can perceive. If the Companions applied the term khamr to non-grape syrups, it was not in the literal sense but figuratively. Naming something is better than leaving it unnamed, and there is no disagreement. Drinking such syrups is figurative and permissible, not literal. For example, Akhul called the syrup made from unripe and ripe dates 'khamr' because it was not yet intoxicating. When they learned of the prohibition of khamr, they stopped, as reported by Abu Asim. When they realized it, one of the Companions said, 'Khamr has been prohibited,' and Akhul said, 'No one left or entered until you broke the jars.' (Hadith)
If it were not intoxicating, they would not have acted. Imam Tahawi (RA) narrates from Anas (RA) that Akhul said, 'Abdullah ibn Jarrah, Sami ibn Baida, Kaab (RA), and the leaders (RA) were present, and I was serving them wine until it affected them.' (Hadith) In the end, it was said, 'Until the wine affected them.' This is narrated by Imam Ahmad. The words are, 'Until the wine affected them.'... I forbid this substance - (Tahawi).

اپی اور روایت میں ہے: شراب تھوڑی ہو یا زیادہ اور ہرنشآ ور مشروب حرام ہے- اور امام بزارکی روایت اس کے معنی ہے- اور ہمارے اصحاب (احناف) نے کہا ہے: ان احادیث میں ہر تم کے نشآ ور مشروب کے مراد نہمر کے ماسوا کے کیونکہ عطف مغايرت کو چاہتا ہے-
امام کی ایک روایت میں ہے حتی اسرعت فيهم "(یہاں تک کہ شراب تیزی سے ان میں اثر کرگی)- لیس ہی حدیث باگوہل پر اعلان کر، ہی ہے کہ ان کی شراب ان دونوں میں نشآ ور ہی- اور جب ان کو شراب کے حرام کر دے جانے کی نہمر چیز تو انہوں نے پیا چھوڑ دیا- اور جو پکھی پی چھی اس کو پھادیا- اگر تم پیچھے ہو کہ نہمر کو عقل و حاکم دین کے مفهوم کی وجہ سے اس کا نام نہمر کہا گیا ہے تو مجھی یہ بات اس چیز پر دلالت نہیں کرتی کہ عقل کو ذہاکنے والی ہر چیز نہمر کہا جائے- گا- کیا تم نہیں جانتے اس بات کو کہ اس گھوڑے کو جس کے دو جانب میں سے ایک سفید اور دوسرا کالا ہوتا اس کا نام ابلق رکھا جاتا ہے، چھروہ کپڑا جس میں کالا اور سفید رنگ مجمع ہو جاتے تو اس کو پیر نام میں دیا جاتا- اسی طرح نجم کو نجم اس کے نظاہر ہونے کی وجہ سے کہا جاتا ہے مجھے کہتے ہیں "نجم" لیکن نظاہر ہواور پر ایک ستارہ کا نام ہے جوثریا سے مشہور ہے اور پیہر نظاہر ہو نے والی چیز کے لے عام نہیں ہے اور اس کے بہت نظاہر ہیں جسے قارور ہے- پقرارے مشتق ہے اور ہراس چیز کا نام نہیں ہے جس میں کوئی چیز قرار پانی ہے- بلکہ ابل لغت سے پی متنقول ہے کہ نہمر عنب سے ہوتی ہے اور عنب کے سوا کسی دوسری چیز سے بنائی جانے والی چیز کا نام نہمر ہے حقیقتاً نہیں ہے بلکہ مجاز اہے- (ماخوذ از عقیدہ الجواہر، بدایی، ثروح کنز، عمدۃ القاری، مہسوط)
Wine, whether little or much, and every intoxicating drink is forbidden. According to the narration of Imam Bazaar, this means: And our scholars (the Hanafis) have said: The 'every' in these hadiths refers to all intoxicating drinks except for nabidh, because the conjunction indicates a difference. In one narration from the Imam, it is said: 'Even if it quickly affects them' (meaning that the wine will quickly affect them). This hadith does not declare something forbidden based on its intoxication alone; rather, it is because the drink is intoxicating that it is declared forbidden. When they realized that anything that causes intoxication is forbidden, they stopped drinking it. And whoever drank it was punished. If you argue that the term 'nabidh' is used because it is understood to be rational and lawful, then the term 'nabidh' does not imply that every intoxicating substance is called 'nabidh'. Do you not know that a horse with one white and one black side is called 'ablaq', and a cloth with black and white colors mixed is called 'pier'? Similarly, a star is called 'najm' because it appears, but 'najm' is the name of a specific star known as 'Suhayl', and not everything that appears is called 'najm'. There are many things that appear, and 'najm' is a specific term. The term 'nabidh' is derived from the fact that it is made from dates, and any drink made from something other than dates is not truly called 'nabidh', but is used metaphorically. محدث عبد الرزاق نے عمدہ سنده ابن عمر رضی اللہ عنہما سے روایت کی ہے انہوں نے کہا "اب رباخمر تو" حرام ہے اس کے لئے کوئی راستہ نہیں۔ اس کے علاوہ دگر مشروبات میں سے ہر نشا ور چیز حرام ہے۔
"Al-riba al-khamr is forbidden; there is no way for it. Furthermore, any intoxicating substance among other beverages is forbidden."
اہلی سے ایک روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرماتے، جویے، نردے اور غمیر اءثرب سے منع فرمایا۔ آپ علیہ السلام نے فرماپر نشا ور حرام ہے۔ (ابوداود)
He prohibited dice, chess, and other similar games. He said: 'Intoxicants are forbidden.'
ابن عمر رضی اللہ عنہما سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرما یا اللہ تعالیٰ نے لعنہ کی بے ثراب پراوراس کے پینے پلانے والے پراس کے پینے والے اوراس کے خریدار پراوراس کو کشید کرنے اور کشید کرانے والے پراوراس کو لے جانے والے پراوراس پر جس کی خاطر لے جانے جائے۔ (ابوداود، ابن ماجہ)
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "An orphan girl is consulted about herself; if she remains silent, that is her permission, but if she refuses, there is no compulsion upon her" [Narrated by At-Tirmidhi, Abu Dawud, and An-Nasa’i, and by Ad-Darimi from Abu Musa]
(1) The statement: "An orphan girl, etc." She is a minor without a father, and here it means a mature virgin, called so based on her past state, as in the Exalted’s saying: And give the orphans their wealth [An-Nisa: 2]. The benefit of the designation is to observe her right and show compassion in seeking suitability and righteousness, as an orphan is a subject of mercy and compassion. Before maturity, her permission or her father’s is meaningless, so it is as if her maturity is stipulated. Thus, it means: She is not married until she matures and is consulted, i.e., her permission is sought, as stated in "Al-Marqah"
ایک روایت میں ہے جوآدمی دنیا میں شراب پے اوراس حال میں مرے کہ وہ اس کا عادی رباہواور توہین کیا ہوتا آخرت میں وہ اس کو نہیں پیگا۔ (مسلم شریف)
A man drinks wine in this world and dies while he is habitually indulging in it and mocking it; in the Hereafter, he will not drink it.
ام سلمہ رضی اللہ تعالیٰ عنہا سے روایت ہے انہوں نے کہا کہ رسول اللہ صلی اللہ علیہ وسلم نے هر نشا ور اور فتوڑ لا نے والی چیز سے منع فرما یا۔ ابوداود
Umm Salama (may Allah be pleased with her) said: The Messenger of Allah (ﷺ) forbade every intoxicant and every relaxant. [Narrated by Abu Dawud]
حضرت جابر رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرما یا وہ چیز جس کا کثر 5 نشرآ ورہوتا اس کا قليل بھی حرام ہے۔ (ترمذی، ابوداود، ابن ماجہ)
اس کے سوا تین اور شرابیں ہیں کہ جب ان میں جوش آ جائے اور وہ تمیز ہو جائیں تو ان قليل وکثر حرام ہے ورنے
بالائق وہ حرام نہیں ہیں۔
اور ایک روایت میں وہ نجاست خفیفہ ہے امام صلیٰ نے اس کو اختیار کیا ہے۔ اور ایک روایت میں نجاست غلیظ
ہے جس کو صاحب ةدايین اختیار کیا ہے۔
ان میں (تمیز شرابول) میں ایک طلاع ہے اور وہ اگر کاپ کا ہوا شیرہ ہے جس کا دو تھالی حصہ باقی رہے اور تمیز
ہو جائے۔ اور تمیز غیر کاپ کا ہوا ہوتا ہے طلاع کی اس کے سوا ایک دوسری تفسیر بھی ہے۔
دوسری فسمل سکر ہے اور تمیزی فسمل نچج ہے۔ پینول کو اور تمیز کو ملا کر اشربہ اربعہ (چار سم کی شرابیں) کہا جاتا ہے
اور ان کا قليل وکثر سب حرام ہے اور تمیز کا لفظ ان چارول میں صرف پہلی فسمل پر بولا جاتا ہے۔
اب ربان کے سوا نمیز تو غل، چجل اور شیرہ ہر چیز سے بنایا جاتا ہے اور ان قسمون کو نیز کہتے ہیں۔ اور جب ان
میں جوش آ جائے اور تمیز ہو جائے میں تو ان کا حکم بھی نذکورہ شرابول کا حکم ہے اور ان کی قليل مقداری میں اتنی مقدار جوش آ ور
نہ ہو و حلال ہے۔ بشرط عبادت پر قوت حاصل کرنے کی غرض سے ہو۔ اور لو و لذت کے لیے ہمو تو حرام ہے۔ اور ان کی
کثیر مقداری میں اتنی مقدار جوش آ ور سے و حرام ہے اور پیامام عظم البوحنیفہ اور امام ابو يوسف رحمهما اللہ کا ذہب ہے اور
اس میں آ پ کے ساتھ کچج بن جراح اور سفیان ثوری بھی ہیں۔ لیکن سفیان شاہ اس سے رجوع کر لیے ہیں۔
پہاپی میں تمام امور میں امام عظم البوحنیفہ رحمۃ اللہ علیہ کے موافق اوز ای سے ایک روایت موجود ہے۔ اور بعض صحابہ سے
کچی روایت ہے اور اگر پچی فریق مختلف ان کے اقوال تاویل کرے۔ اور دیگر اتنہ بھی جملہ امور میں بینیں کے موافق ہیں
نیز ابن مسعود کے بھی ایسا ہی فرمایے جسیا کہ امام البوحنیفہ نے کہا ہے۔
مقصود یہ ہے کہ وہ چار شرابیں ہیں جوش خین کے پاس حرام ہیں جب اس میں جوش آ جائے۔
اور وہ تمیز ہو جائیں ورنے دوسرا شرابول کی طرح بالائق حرام نہیں۔ اور امام البوحنیفہ رحمۃ اللہ علیہ کے استدلال کی بہت
سی حدیثیں ہیں۔
۔ ان میں سے یک ایک شخص نے حضرت فاروق عظم رضی اللہ تعالیٰ عنہ کے مشکیز ہے نبیز پی لی اور اس کونش
آ گیا تو اس پر حد لگائی گئی۔ اس نے کہا۔ اے امیر المومنین میں تو آپ میں کے مشکیز ہے پیا ٹا۔ حضرت عمر رضی اللہ
تعالیٰ عنہ فرمایا میں نے تمہیں پرنش کی وجہ سے حد لگائی ہے۔
امام عظم البوحنیفہ رحمۃ اللہ علیہ کی طرف سے تقویت کی سب سے بڑی چیز وہ حدیث ہے جس کو امام طحاوی نے
مرفوعاً بیان کیا ہے آ پعلیہ نے ارشاد فرمايا اشربا ولا تسکرا۔ تم دونوں اس کو پیا ور تم کونش رندآ ہے انج۔
اور بعض خفیہ نے کہا ہے کہ حرام چیز کا پکڑ حصر حلال ہوتا ہے لہذا احرام شراب کی نبیز حلال ہوگی اس کے نظارت
میں سے ایک رشتم کروہ حرام ہے اور مر دول کے لیے چارا گشت کے بقدر جائزہ اور ای طرح سونا اور چاندی ہے۔
اور مجھے سلف کے بعض اقوال سے اس کی دلیل میں ہے۔ جبعض ابلیت سے روایت کے پیں اور احوال نے ایا۔
حلال تھا۔ پس اس سے بیات معلوم ہوتی ہے کہ بعض حرفی کے اس قول کی اصل ہے۔
پھر میں ان کی عبارت کو ان کے مقصد میں فرق آ کے بخیرتبدیل کر کے لکھتا ہوں اور بیات کے مفید ہوگی۔ احول
نے کہا کہ جارثرابول کے سوا جوثراب سے اس کا تحوّز احص عبادت پرتقویت کی غرض سے حلال ہے لہو ولعب کی غرض
سے حرام ہے۔
تو میں ان کی عبارت میں تغیر کر کے یوں لکھتا ہوں کہ جارثرابول کے سوا جوثراب سے وہ رام سے سوا تحوّزی مقدار کے
جو عبادت پرتقویت کی غرض سے ہواور فرق پیہ کر ان کی عبارت سے معلوم ہوتا ہے کہ اصل ابا حت سے او رحمت اہو ولعب کی
جہت سے اور میں جو کہا ہوں اس سے معلوم ہوتا ہے کہ اصل حرمت سے او رتحوّزی مقدار جو عبادت پرتقویت کی غرض سے ہو
حلال ہے پس ایسی صورت میں عبادت پرتقویت مشل دوا کے پس اس معاملہ کو باب تد اول کی طرف مول کیا جائے گا۔
اس سلسلہ میں آئی ہوئی احادیث امام اعظم ابوحنیفہ کے نہیب کے خلاف نہیں ہیں۔ اور میں ہمارے اس قول کی
طرح سے کہ مردار حرام سے سوا مجبو ری کے قت میں تو عبادت تقویت اس میں مخصوص اور مستثنی رہے گی۔ پس
"المسکر حرام "( نشرآ و ر حرام سے ) کی تمام حدیثیں، ان المیتہ حرام، (یقیناً مردار حرام سے ) کی طرح اپنے
ظاہر پر ہیں۔
اور جو کوئی امام صاحب کے احادیث وغیرہ سے تقسیمی دوالس چاہتا ہے وہ الحرف الشذی، بزل المجہود، غایہ
البيان، معرج الدرایی کی طرف مراجعت کریں۔
اب رہا امام شافعی، امام احمد امام ما لک، امام محمد بن حسن اور مجہور صحابرضی اللہ تعالیٰ عنہم تو ان کا نہیب یہ کہ
پھر کسی بھی چیز کی نشرآ ور بنه و ای چیز اس کا قیل و کثر حرام سے خواہ وہ نشر لائے یا نہ لائے اور مسکر جامد ( نہ بنہ و ای نشرآ ور
چیز ) نہ میں سے ہمارے ارباب فقوی، امام محمد بن حسن کے قول پر فوی دیتے ہیں رسول اللہ صلی اللہ علیہ وسلم کے اس
ارشاد کی بناء پر ما اسکر کثیر فقلیله حرام "ہروہ چیز حس کا کثیر نشر لائے اس کا قیل و کثرام سے۔
اس کا ذکر زیادہ سے اور ان کے علاوہ صاحب ملتی، صاحب مواهب، صاحب کفا ی، صاحب نہایی، صاحب معرج،
شارح مجمع، شارح درر البحار، تہستانی اور عینی نے بھی کیا ہے اس طور پر کہ ان حضرات کا قول یہ کہ "فساد کے غلبہ کی وجہ
سے ہمارے زمانے میں فقوی امام محمد کے قول پر "ان میں سے بعض علماء نے اس کی وجہ یہ بیان فرمائی کہ فاسقین ان
مشروبات کے پاس اکثر ہوتے ہیں اور ان کو پی کر دولت کی اور نشر و مست کا قصد کرتے ہیں۔ میں کہتا ہوں کہ ( اس علی
تے ) یہ بات ظاہر ہے کہ ان فقہاء کا مقصد مطلقاً حرام قرار دینا اور بالکلی طور پر سد باب کرنا ہے۔ ورنہ لو لعب کے
ارادے سے اس کی حرمت محل اختلاف نہیں بلکہ متفق علیہ ہے۔ اور اس زمانے میں جب طاعت پر طاقت و قوت حاصل
کرنے کی بجائے عموماً لو لعب زمت مقصود بن گئی تو فقہاء نے اس وجہ سے کمل طور پر تحکر دیا۔ اس کو لحو ظر کہوں
و نہیں شارح و صبانی نے اس کو اختیار کرتے ہوئے بیان کیا ہے کہ یہ بات سے مراد یہ ہے۔

Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: Whatever intoxicates in large amounts, its small amount is forbidden. [Narrated by Al-Tirmidhi, Abu Dawud, and Ibn Majah]
Ahmad, Al-Tirmidhi, and Abu Dawud narrated from Aisha (may Allah be pleased with her) that the Messenger of Allah (ﷺ) said: If a faraq of it intoxicates, a handful of it is forbidden. Muhammad said: Whatever intoxicates in large amounts, its small amount is forbidden, and this is followed in our time due to the prevalence of corruption.
Abu Dawud narrated from Daylam al-Himyari, who said: I said to the Messenger of Allah (ﷺ): O Messenger of Allah, we live in a cold land and engage in hard work, and we make a drink from this wheat to gain strength for our work and to combat the cold of our land. He said: Does it intoxicate? I said: Yes. He said: Then avoid it. I said: The people won’t abandon it. He said: If they don’t abandon it, fight them.
Besides these, there are three other intoxicants: when they ferment and become clear, their small and large quantities are forbidden; otherwise, they are not forbidden. In one tradition, they are considered mildly impure, which Imam (SAW) has adopted. In another tradition, they are considered severely impure, which the two companions have adopted. Among them, (when they become clear) there is a clarification: if it is grape juice that has turned into wine, leaving two-thirds of its original volume, and becomes clear. Clarity occurs in non-grape juice as well, but there is another interpretation. Another type is sugar cane, and the clarified type is honey. When combined, they are called 'ashribat arba'ah' (the four types of drinks), and all their small and large quantities are forbidden. The term 'tamiz' is used specifically for the first type of sugar cane. Now, except for raban, the others, ghal, chal, and shir, are made from any substance and are known as nimez. When they ferment and become clear, their ruling is like the aforementioned drinks, and their small quantities are permissible if they do not cause intoxication, provided they are consumed for the purpose of gaining strength for worship. However, consuming them for pleasure is forbidden. Their large quantities, which cause intoxication, are forbidden, according to the opinion of Imam Abu Hanifah (RA) and Imam Abu Yusuf (RA), and this view is shared by Qatada bin Derar and Sufyan Thawri, although Sufyan later retracted his opinion. In all matters, there is a tradition in accordance with Imam Abu Hanifah (RA), and some traditions from the Companions exist. If different groups interpret their statements differently, they still align with Imam Abu Hanifah's (RA) views. Similarly, Ibn Masud (RA) stated what Imam Abu Hanifah (RA) said. The point is that these four drinks are forbidden when they ferment and become clear; otherwise, they are not forbidden like other drinks. Imam Abu Hanifah (RA) has many supporting hadiths. One such hadith involves a person who drank a beverage in the presence of Hazrat Umar (RA), and when he became intoxicated, he was punished. He said, 'O Commander of the Faithful, I drank it because I was thirsty.' Hazrat Umar (RA) replied, 'I have punished you for drinking it.' The strongest support for Imam Abu Hanifah (RA) is the hadith narrated by Imam Tirmidhi, where the Prophet (SAW) said, 'Do not drink anything that intoxicates, for both of you will be considered drunkards.' Some scholars have said that the consumption of something forbidden is permissible to avoid greater harm, so the fermentation of wine is permissible to prevent greater evil. This is one of the reasons why a small amount is permissible for worship, while a large amount is forbidden. Some early scholars have mentioned this. It is evident from some traditions and conditions that the original statement is based on certain principles. I will modify their statements to better convey their intended meaning. They said that, except for the four drinks, any other drink that ferments is permissible for the purpose of gaining strength for worship but forbidden for pleasure. I will write it as follows: except for the four drinks, any other drink that ferments is permissible in a quantity that does not cause intoxication for the purpose of gaining strength for worship, but forbidden for pleasure. This shows that the original prohibition is based on the purpose of pleasure, and the permissible quantity is for the purpose of gaining strength for worship. Therefore, in such a case, the matter should be referred to the principles of jurisprudence. The hadiths in this series do not contradict the views of Imam Abu Hanifah (RA). In cases where something is forbidden, the purpose of worship remains specific and exempted. Thus, all hadiths stating 'al-muskir haram' (intoxicants are forbidden) and 'in al-mayta haram' (dead animals are forbidden) are taken at face value. Anyone seeking a detailed division of opinions should refer to Al-Harf Ash-Shadhi, Bazz Al-Mujhud, Ghaya Al-Bayan, Ma'raj Ad-Duray, and other works. As for Imam Shafi'i, Imam Ahmad, Imam Malik, Imam Muhammad bin Hasan, and the prominent Companions (RA), their view is that any substance that ferments, whether it causes intoxication or not, is forbidden in both small and large quantities. Our jurists, including Imam Muhammad bin Hasan, follow this view based on the Prophet's (SAW) statement, 'Whatever has a large quantity that causes intoxication, its small and large quantities are forbidden.' This is mentioned in various works, and some scholars have explained that the reason for this is the prevalence of corruption in our time, leading to the complete prohibition of these substances. The purpose is to completely forbid them and close the door to evil. Otherwise, there is no disagreement about the prohibition for pleasure, which is a universally accepted view. In this time, when the general purpose of consuming these drinks is for pleasure rather than for gaining strength for worship, the jurists have completely prohibited them. This is clearly stated by the commentators and scholars, who explain that the intention is to prevent evil.
4۔ قولة: نہی رسول اللہ صلی اللہ علیہ وسلم عن كل مسكر و مفتر (رسول اللہ صلی اللہ علیہ وسلم نے منع فرماپر نشا ور اور فتوڑ لا نے والی چیز سے) طبی رحمہ اللہ نے فرماپیہ اس حدیث سے بھگگ اور شعشاء (شراب کا نام) اوران جسی دوسری چیز دول سے جوفتور پیا کر دیتی اور عقل کو زاکل کرتی پین ان کے حرام ہونے پر استدلال کیا جانا بغیر نهييں کیونکہ (حرمت کی) علم ازال عقل سے اوروہ اس میں پالی جاتی ہے (مرقات)
۔ قولة: ما اسكر كثيره فقلیه حرام (وہ چیز جس کا کثر نشا ورہوتا اس کا قليل بھی حرام ہے) تم اس بات کو جانو کہ خطر حضرت امام اعظم ابوحنیفہ رحمۃ اللہ علیہ کے پاس انگور کا شیرہ ہے جب اس میں جوش اور تمیزی اور جھاگ آ جاتے پیل اس کے احکام دس ہیں۔ جو بدایی میں نذور ہیں۔ اس کو حلال تحقیق والا کفر ہے۔ اوروہ نجاست غلیظ ہے اوراس کا قليل و کثر حرام ہے اوراس کے پینے والے پر۔۔۔۔
سیدنا علیؓ رضی اللہ عنہما سے مروی ہے کہ رسول اللہ ﷺ فرمایا جس چیز کا ایک فرق (۱۶، رطل یعنی ۵۰٪) نشآ ورہوتواس کی چلو بھر (مقدار) بھی حرام ہے۔ (مسند احمد، ابو داود، ترمذی)
اور امام محمد نے فرمایا جس کا کچھ نشآ ورہوتواس کا قليل بھی حرام ہے اور غلبہ فساوکی وجہ سے موجودہ زمانہ میں اس پرفتوی ہے۔
Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: Whatever intoxicates in large amounts, its small amount is forbidden. [Narrated by Al-Tirmidhi, Abu Dawud, and Ibn Majah]
Ahmad, Al-Tirmidhi, and Abu Dawud narrated from Aisha (may Allah be pleased with her) that the Messenger of Allah (ﷺ) said: If a faraq of it intoxicates, a handful of it is forbidden. Muhammad said: Whatever intoxicates in large amounts, its small amount is forbidden, and this is followed in our time due to the prevalence of corruption.
Abu Dawud narrated from Daylam al-Himyari, who said: I said to the Messenger of Allah (ﷺ): O Messenger of Allah, we live in a cold land and engage in hard work, and we make a drink from this wheat to gain strength for our work and to combat the cold of our land. He said: Does it intoxicate? I said: Yes. He said: Then avoid it. I said: The people won’t abandon it. He said: If they don’t abandon it, fight them.
سیدنا ویلم حمیری رضی اللہ عنہ سے روایت ہے انہوں نے کہا میں نے رسول اللہ ﷺ کے عرض کیا کہ یا رسول اللہ صلی اللہ علیہ وسلم سردوز میں میں رہتا ہیں اور وہاں سخت وشوار کام کی مشقت اٹھاتے ہیں (جس کی بناء پر) ہم اس گیہول کی شراب بناتے ہیں جس سے ہم اپنے کام میں پر طاقت اور اپنے ملک کی سردی کو (برداشت کرنے کی) قوت حاصل ہوتی ہے۔ آپ ﷺ نے فرمایا کیا وہ نشآ ورہوتي ہے؟ تو میں نے عرض کیا بالکل آپ ﷺ نے فرمایا پھر تو تم اس کو میں نے عرض کیا کہ لوگ اس کو چھوڑنے والے نہیں ہیں۔ آپ ﷺ نے فرمایا اگر وہ اس کونے چھوڑ دیں تو تم ان سے جنگ کرو۔ (ابوداود)
I presented myself to the Messenger of Allah ﷺ and said, 'O Messenger of Allah ﷺ, I live in Sarduz and endure hard and strenuous labor there (with which) we make this beverage from barley, which gives us strength for our work and power to endure the cold of our region.' He ﷺ asked, 'Is it intoxicating?' I replied, 'Yes.' He ﷺ then said, 'Then do not drink it.' I said, 'People will not give it up.' He ﷺ said, 'If they abandon it, fight them.' (Abu Dawud)
حضرت جابر رضی اللہ تعالیٰ عنہ سے روایت ہے کہ ایک صاحب میں سے آکے اور انہوں نے بی کریم صلی اللہ علیہ وسلم سے ایک شراب کے بارے میں سوال کیا جس کو لوگ ان کی سرز میں میں پیتے تھے وہ کچھ سے بنائی جاتی ہے اور اس کو مزر کہا جاتا تھا۔ بی اکرم صلی اللہ علیہ وسلم نے ان سے دریافت فرمایا کیا وہ نشآ ورہے تو انہوں نے کہا بالکل (وہ نشآ ورہے)۔ تو آپ ﷺ نے فرمایا ہر نشآ ور حرام ہے اللہ تعالیٰ کا عہد ہے ہراس آدمی کے لئے جوز نشآ ور چیز پیتا ہے۔ وہ اس کو طينة الخبال (دوز خیون کا خون پیپ) پلا کے وہ (صحابی) عرض کہ یا رسول اللہ صلی اللہ علیہ وسلم کیا ہے تو آپ صلی اللہ علیہ وسلم نے فرمایا دوز خیون کی رپشیاں کا خون، پیپ۔ (مسلم)
حضرت عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے کہ فرمایا رسول اللہ صلی اللہ علیہ وسلم نے جوآدمی شراب پیے تو اللہ تعالیٰ اس کی چاپیس نج (دن) کی نمازیں قبول نہیں کرے گا اور اگر وہ توبہ کرے تو اللہ تعالیٰ اس کی توبہ قبول کرے گا۔ اگر وہ پھر دوبارہ اس (شراب نوشی) کی طرف لوگا تو اللہ تعالیٰ پھر چاپیس نج کی نمازیں قبول نہیں کرے گا۔ پھر اگر وہ توبہ کرے تو اللہ تعالیٰ اس کی توبہ قبول کرتا ہے۔ پھر وہ پھر اس کی
طرف لوٹ تو پھر چاپس صحح (چاپس دون) کی نمازی قبول نہیں کرے گا۔ اور اگر وہ پھر تو پھر کرے تو پھراس کی توپہقبل کرتا ہے۔ اگر وہ چوٹی مرتبہ پھراس (ثراپ نوشی) کی طرف لوٹ کا تو پھر چاپس صحح (چاپس دون) کی نمازی قبول نہیں کرے گا پھر وہ توپہ کرے گا تو اللہ تعالیٰ اس کی توپہ قبل نہیں کرے گا اور اس کونہر خبال (خون پیپ کی نہبر) سے پلا لے گا۔ (ترمزی)
Abdullah ibn Umar (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: Whoever drinks wine, Allah will not accept his prayer for forty mornings. If he repents, Allah will accept his repentance. If he returns, Allah will not accept his prayer for forty mornings. If he repents, Allah will accept his repentance. If he returns, Allah will not accept his prayer for forty mornings. If he repents, Allah will accept his repentance. If he returns a fourth time, Allah will not accept his prayer for forty mornings. If he repents, Allah will not accept his repentance, and He will make him drink from the river of khabal. [Narrated by Al-Tirmidhi, Al-Nasa’i, Ibn Majah, and Al-Darimi from Abdullah ibn Amr]
تعالیٰ انہما سے روایت کیا ہے۔

سیدنا ابو امامہ رضی اللہ تعالیٰ عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے ارشاد فرمایا اللہ تعالیٰ نے مجھے سارے عالمون کے لئے رحمت اور سارے عالمون کے لئے بدایت بنایا کر بھیجا ہے۔ اور اللہ بزرگ و برتر نے مجھے حکم فرمایا ہے مطاہ کا موسيقی کے آلات اور گائے ججان کے آلات کو اور بھٹول اور صليب کو اور جاپیت کے کامول کو اور میرے پروردگار کے جوبزرگ و برتر کے بطور قسم فرمایا ہے کہ میری عزت کی قسم میرے بندول میں سے کوئی مجھی بندہ ایک گہونٹ کچھ شراب پیے تو میں اس کے مش خون پیپ میں سے اس کو پلا لے گا۔ اور میرے خوف کے جوبندہ اس کو چھوڑے ہے کا تو اس کو پا کیزہ حوضون میں سے پلا لے گا۔ (امام احمد)
Abu Umama (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: Indeed, Allah, the Exalted, sent me as a mercy to the worlds and a guidance to the worlds. My Lord, Mighty and Exalted, commanded me to destroy musical instruments, flutes, idols, crosses, and the affairs of Jahiliyya. My Lord, Mighty and Exalted, swore by His might that no servant of His will drink a gulp of wine except that I will make him drink its equivalent from pus, and no one will abandon it out of fear of Me except that I will make him drink from the pools of holiness. [Narrated by Ahmad]

داری کی ایک روایت میں قمار "(جواری) کے بجاے" ولا ولد زنیہ" (اور نکوئی ولد زنا) ہے۔
In one narration of adultery, instead of 'fornication' it says 'adultery with a married woman' (and unlawful intercourse with a married woman).
سیدنا ابن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا تین لوگوں پر اللہ تعالیٰ نے جنت کو حرام کر دیا ہے۔ شراب کا عادی، والدین کا نفرمان، اور دیوث وہ بہ حیا جوگر میں بہ حیائی کے کام کرتا ہے۔ یا یہ کام کر میں ہوتے ہوئے دیکھ کر چشم پوٹی کرتا ہے۔ (احمد، نسائی)

اور جادو کی تصدیق کر نے والا۔ (مسداحمر)
Abu Musa al-Ash’ari (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: Three will not enter Paradise: an addict to wine, one who severs family ties, and one who believes in magic. [Narrated by Ahmad.]
سیدنا ابن عباس رضی اللہ تعالیٰ علیہما سے مروی ہے کہ رسول اللہ صلی اللہ تعالیٰ علیہ وسلم کا ارشاد ہے کہ راب کا عادی شخص اگر مر جائے تو اللہ تعالیٰ سے وہ ایک بت پرست کی طرح لے گا۔ (مسداحمر)
If a person from the people of Rabah dies, Allah will take him as if he were an idol worshiper.
(اس حدیث ثبوتیف کو) ابن ماجہ نے سیدنا ابوہریرہ رضی اللہ تعالیٰ علیہ سے
اور نہیں ہے نے شعب الامیان میں محمد بن عبید اللہ سے روایت کی ہے اور انہوں نے اپنے والد سے نقل کیا ہے اور نہیں ہے نے کہا ہے کہ امام بخاری نے اپنی تاریخ میں (اس حدیث) کو محمد بن عبد اللہ سے ذکر فرمایا جوابین والد سے روایت کردہ ہیں۔
سیدنا ابوموسی اشعری رضی اللہ تعالیٰ علیہ روایت سے کہ میں ان دونوں کی (حزمت کی کیسانیت میں) فرق محسوس نہیں کرتا کہ شراب پیون یا اللہ کو چھوڑ کر اس ستون کی پرستش کروں؟ (اس کو امام نسا ئی نے موقوفاروایت کیا ہے)۔
Abu Musa (may Allah be pleased with him) said: I don’t care if I drank wine or worshipped this pillar instead of Allah. [Narrated by Al-Nasa’i, stopped at Abu Musa]
سیدنا صفیہ بنت عطیہ رضی اللہ تعالیٰ علیہما سے روایت سے کہ میں قبیلہ عبد القیس کی چند عورتوں کے ساتھ عاشر (رضی اللہ علیہما) کی خدمت میں حاضر ہوئی۔ چنانچہ میں ان سے کچوراور کشمش (کوملا کرنیز بنانے) کے بارے میں دریافت کیا تو انہوں نے فرمایا: میں ایک مشت کچوراور ایک مشت کشمش ایک برتن میں دال کر پانی میں بھگودیا کرتی تھی 6 پھر اسے
(پینے کے لئے) نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں (نوش فرما نے کے لئے) پیش کرتی تھی -

Safiyya bint Atiyya said: I entered with some women from Abd al-Qays to Aisha and asked her about dates and raisins. She said: I used to take a handful of dates and a handful of raisins, put them in a vessel, crush them, and give it to the Prophet (ﷺ) to drink. [Narrated by Abu Dawud]
In another narration by him from Aisha: The Messenger of Allah (ﷺ) had nabidh made for him with raisins, and dates were added to it, or with dates, and raisins were added to it. Al-Bayhaqi narrated both in his Sunan.
Ibn Majah narrated from her: We used to make nabidh for the Messenger of Allah (ﷺ) in a waterskin. We would take a handful of dates or raisins, put them in it, then pour water over it. We would make it in the morning, and he would drink it in the evening, or make it in the evening, and he would drink it in the morning.
What was narrated that he forbade combining dates and raisins, or raisins and fresh dates, or fresh dates and unripe dates, is interpreted as applying to when it becomes strong. This was in the beginning when Muslims faced hardship and scarcity.
In Al-Binaya and elsewhere: This prohibition was advisory during times of drought and scarcity. In times of abundance, there is no issue, as Ibn Adi narrated in Al-Kamil from Umm Sulaym and Abu Talha that they drank nabidh from unripe dates and raisins mixed together. Abu Talha was told: The Messenger of Allah (ﷺ) forbade that. He said: That was only for that time, like the prohibition of combining two types of dates. Abu Dawud narrated from Aisha that the Messenger of Allah (ﷺ) had nabidh made with dates and raisins added. There are other narrations and reports in this regard from Sharh al-Kanz and Al-Ta’liq al-Mumajjad. [By quotation.]
6۔ قولاہا: کہت آخذ قبضۃ من تمر و قبضۃ من زبيب فالقيه في اناء الخ (میں ایک مشت کچوراور ایک مشت کشمش ایک برتن میں دال کر پانی میں بھگودی تھی)۔ پر وخلوط چیزیں ہیں۔ وہ اس طرح کہ کچوراور کشمش کاپانی ایک جڑ جمع کر دیا جاتے چھراس کو چورز اسپاکراس حد تک چھورز دیا جاتے کہ جوش آ جائے اور وہ تمیز ہو جائے۔ عبد اللہ بن ابی قتادہ اپنے والد سے روایت کرتے ہیں کہ انہوں نے کہا کہ اکرم صلی اللہ علیہ وسلم نے کہ کچوراورسرخی مائل کچور کو ملانے سے منع فرمایا نہیز کچوراور کشمش کو ملانے سے جسی منع فرمایا اور ان میں سے ہر ایک کی علیحدہ علیحدہ نہیز بنائی جانی چاہیے۔ اور ابوسعید رضی اللہ تعالیٰ علیہ مرفوعاً روایت کرتے ہیں کہ جونبیز پینا چاہے تو وہ کسی دوسری چیز کو ملانے بغیر خالص کشمش کی نیبز پیئے یا خالص کچور کی یا گردے کچور کی۔ ان احادیث کے ظاہری مفہوم کہ بناء پر امام ماکو امام احمد اور ایک قول میں امام شافعی کی نیبز کی حزمت کو اختیار کے پیچس میں دو چیزوں کی آمیزش ہواگرچہ کہ ان دونوں سے بنائی ہوئی نیبز نشرآور شہو۔ اور امام اعظم البوحنیفہ نے اور امام شافعی نے اپنے ایک دوسرے قول میں فرمایا جب تک نشر نہ آئے حرام نہیں ہے لیکن وہ اس باب کی احادیث کی بناء پر حلال ہے۔ اور مہا نعت کی جواہادیث آئی ہیں تو ان کو ابتدائی زمانے پر مول کیا گیا ہے۔ یا لی نیبز پر حس کو پکائی نگیا۔
سیدتنا عائشہ صدیقہ رضی اللہ عنہا نے مروی ہے کر رسول اللہ صلی اللہ علیہ وسلم
کے لئے کرشمش کی نبیز بنانی جاتی تھی جس میں کھجور ذا لے جاتے - یا کھجور کی نبیز بنانی جاتی تھی جس
میں کرشمش ذا لے جاتے تھے - (ابوداود، سنن نہیسی)

امیں سے مروی ہے وہ کہتی ہیں کہ تم رسول اللہ صلی اللہ علیہ وسلم کے لئے

میں دوال دیتے چھراس میں پانی انڈیل دیتے - پس،تم نے میں اس کی نبیز بناتے تو آپ علیہ صلاۃ و شام
کے وقت اس کونوش فرما تے،اور تم شام میں اس کی نبیز بناتے تو آپ علیہ صلاۃ و صبح کے وقت اس کونوش
فرما تے - (ابن ماجہ)
اور جس روایت میں پرآیہے کہ "حضور پاک صلی اللہ علیہ وسلم نے (نبیز بنانے کے لئے)
خشک کھجور اور کرشمش کو، کرشمش اور پختہ وتازہ کھجور کو، پختہ وتازہ کھجور اور گلرے کھجور کو ملانے سے منع
فرما یہ،تو وہ نہیں اورتی کی صورت پر ممکن ہوگی - اور یہ ممکن ہے ابتدا ئے اس وقت تک جب مسلمان
تعداد تی اورتی میں تھے -
Safiyya bint Atiyya said: I entered with some women from Abd al-Qays to Aisha and asked her about dates and raisins. She said: I used to take a handful of dates and a handful of raisins, put them in a vessel, crush them, and give it to the Prophet (ﷺ) to drink. [Narrated by Abu Dawud]
In another narration by him from Aisha: The Messenger of Allah (ﷺ) had nabidh made for him with raisins, and dates were added to it, or with dates, and raisins were added to it. Al-Bayhaqi narrated both in his Sunan.
Ibn Majah narrated from her: We used to make nabidh for the Messenger of Allah (ﷺ) in a waterskin. We would take a handful of dates or raisins, put them in it, then pour water over it. We would make it in the morning, and he would drink it in the evening, or make it in the evening, and he would drink it in the morning.
What was narrated that he forbade combining dates and raisins, or raisins and fresh dates, or fresh dates and unripe dates, is interpreted as applying to when it becomes strong. This was in the beginning when Muslims faced hardship and scarcity.
In Al-Binaya and elsewhere: This prohibition was advisory during times of drought and scarcity. In times of abundance, there is no issue, as Ibn Adi narrated in Al-Kamil from Umm Sulaym and Abu Talha that they drank nabidh from unripe dates and raisins mixed together. Abu Talha was told: The Messenger of Allah (ﷺ) forbade that. He said: That was only for that time, like the prohibition of combining two types of dates. Abu Dawud narrated from Aisha that the Messenger of Allah (ﷺ) had nabidh made with dates and raisins added. There are other narrations and reports in this regard from Sharh al-Kanz and Al-Ta’liq al-Mumajjad. [By quotation.]

کرتی تھی نہی کریم صلی اللہ علیہ وسلم نے اس کونہ پایا تو آپ علیہ صلاۃ و صاحبہ

ابوداود نے سیدتنا عائشہ صدیقہ رضی اللہ تعالیٰ عنہا نے روایت نقل کی ہے کر رسول اللہ صلی اللہ علیہ وسلم کے لئے نبیز بنانی
جانی جس میں کھجور ذا لے جاتے اوراس میں کرشمش ذالی جاتی تھی -
اس باب میں اورتی آثار واخبار مووجود ہیں - (ثروح کنز،تعلیق محبر)
ہوتا کر تمام احادیث میں مطابقت ہوجائے اوراس آخری بات سے سب میں تطیق حاصل ہوجاتی ہے - اور تعارض
بھی دور ہوجاتا ہے جواب نعمتی اللہ تعالیٰ عظمہما سے معقول ان کے قول و فعل کے درمیان پایا جاتا ہے - کتاب بنایا اوراس
کے سوا دیگر کتابول میں پیش کریم مانعت ارشادی ہے جو قط اور خشک سالی کے زمانے میں تکی - اب ربا سعت کے
زمانے میں اس میں کوئی حرج نہیں کیونکہ ابن عدی نے کتاب کامل میں امیم اور ابوظہرہ سے روایت لا نی ہے کہ وہ دونوں
گردے کھجور اور کرشمش کی مخلوط نبیز پیتے تھے - تو ابوظہرہ رضی اللہ تعالیٰ عنہ کہا گیا کر رسول اللہ صلی اللہ علیہ وسلم نے اس
سے منع فرما تو انہوں نے کہا کہ یہ ممکن ہے ای زمانے میں تکی جسیا کر دو کھجور ول کو مجمع کرنے (دو کو ایک ساتھ ملا کر
کہا نے تے )آپ علیہ صلاۃ و صحبہ فرما تے -
ن عرض کیا کر وہ تو مردار ہے۔ پس نبی کریم صلی اللہ علیہ وسلم نے فرمایا کر اس کی و باخت اس کو حلال کر دیتے ہے۔ جس طرح کے عرض کیا وہ مرگی۔ آپ صلی اللہ علیہ وسلم نے فرمایا تم نے اس کی کحال سے فاندہ کیون نہیں انجا؟، تم
I had a she-goat which I used to milk. When the Messenger of Allah ﷺ found out about it, he said: 'Milk it for the Prophet ﷺ.'
سیدنا جابر رضی اللہ تعالیٰ عنہ سے مروی ہے کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا تمہارا بہترین سرکرہ مباری شراب کا سرکرہ ہے۔ (تہقیق فی المعرفۃ)
Your best vinegar is the vinegar of wine.
حضرت ابوذر لیس خوالانی رحمۃ اللہ علیہ سے روایت ہے کہ سیدنا ابوذر داء رضی اللہ تعالیٰ عنہ میری (ایسے میں چھٹی جس میں شراب ہوتی ہے۔ جس میں نمک ڈال کر دھوب میں رکھے اور سرکہ بنائے ہیں) تناول فرماتے اور فرماتے دھوب پاورنک نے اس کو ختم کر دیا۔ (مشکل الآثار للطحاوی)
Abu Dharr (RA) used to consume a drink made from dates (in which wine is mixed, and salt is added, then it is placed in a container and turned into vinegar), and he would say, 'The washerman has finished it off.'
اور امام محمد رحمۃ اللہ علیہ نے کتاب الحجج میں فرمایا اور تم کو علی بن الی طالب رضی اللہ عنہ سے پردايت چھٹی سے کرانہول نے شراب کو سرکہ بنالیا۔ اور تم کو بیبات ابن عباس سے بھی چھٹی سے اور تم کو ابوذر داء سے پردايت چھٹی سے کرانہول نے فرمایا شراب کے سرکہ میں کوئی حرج نہیں ہے۔ (کتاب الحجج)
اور ابوطرہ رضی اللہ تعالیٰ عنہ کی حدیث میں بعض راویوں نے ذکر کیا ہے۔ افلا اخللها۔ کیا میں اس کو سرکہ بنالوں تو آپ علیہ السلام نے ارشاد فرمایا پال اور اگر نذورہ حدیث شریف گیہ تو سرکہ بنانے کی یمامعت ابتداے میں چھٹی اور بیان کوان کی مانوس عادت سے رو کے کلیے چھٹی پس پیچیا شرب نمرکی عادت سے رکنا ان پرشاق قتاو حضرت نبی اکرم صلی اللہ علیہ وسلم نے شراب کو بہادینے کا حکم فرما اور سرکہ بنانے سے اس لے منع فرما یا جسیا کر بلطو رمبالغ کتو ل کو تل کر دینے کا حکم فرما اتحا اور یہ کون کو پا لک کے بارے میں ان کی مانوس عادت سے ان کو رو کنے کے لے تھا پچران پراند پشرا تھا کے جب ان کے باٹھ میں کوئی شراب نہیں رہے گی تو تیمور کی شراب کو پیا کر رہیس گے تو آپ صلی اللہ علیہ وسلم نے تیمور کی شراب کو جی زبری طور پر بہادینے کا حکم فرما حالا کہ وصی پشتیم کے مال کو خراب کرنے سے رو کنا واجب ہے۔ اس میں جو خراب ہوگیا ہے اس کو طیک کرنا واجب نہیں ہے۔ کیا تم نہیں جانتے کہ تیمور کی بری جب مر جاتے تو وصی پراس کے پچرتے کو باغت دینا واجب نہیں اگر وہ یکام کرتا ہے تو جانے زاورد رستہ پہلی اسی طرح وصی پشتیم کو سرکہ بنانا واجب نہیں ہے۔ اگر وہ پی کرتا ہے تو جانے زاورد رستہ سے جب سرکہ بنانے کا جواز ثابت ہوگیا تو اسی طرح شراب سے مر جی (بنانا) اس میں نہک اور پچلتی ظا لکر جانے زا ہوگا کیونکہ اس میں شراب کی صفت ختم کر دی جائے گے جسیا کر شراب سے سرکہ بنانے میں ہے۔ اور اس کی خلافت کے بارے میں سیدنا عمر فاروق رضی اللہ تعالیٰ عنہ سے مروی روایت اس روایت کے معارض سے جس میں سیدنا ابن عباس رضی اللہ تعالیٰ عنہ ماتے اس کے متعلق دریافت کیا گیا تو آپ نے فرما یا لا بأس ہے۔ لیعنی اس میں کوئی حرج نہیں۔ پچر عمر فاروق رضی اللہ تعالیٰ عنہ کی حدیث کی تاول ایسے تم نے مرفو ع حدیث کی تاول بیان کی سے کر اس سے (نہر کو سرکہ بنانے سے) ممانعت شراب سے رو کنے کے لے سیاسی مصلحت کے طور پر ہے۔ 8قولہ: اصطبغ علی خمر لیعنی شراب سے سرکہ بنایا (ماخوذ از حاشیہ کتاب الحجج)
امام محمد نے ایس شخص کے بارے میں جوثراب کو میراث میں پائے عطاء بن ابی رباح کا قول روایت کیا ہے کہ انہوں نے فرمايواه اس کو بھاذا لے وہ (امام محمد) کہتے ہیں کہ میں نے کہا اگر اس میں پانی ڈال دیا جائے اور پھر وہ سرکہ بن جائے تو آپ کی کیا رائے ہے؟ انہوں نے فرمایا اگر وہ سرکہ بن جائے تو اس میں کوئی حرج اور گناہ نہیں ہے اگر وہ چاہے تو اس کو فروخت کر سکتا ہے۔ (كتاب الحجج)
اور امام طحاوي علیہ الرحمة نے فرمایا ہے کہ سرکہ بنانے کی ممانعت سے متعلق احاديث تغليظ اور تشدد (تکفیر اور شدت) برحمول ہیں، جو کر اسلام کے ابتدائی زمانے میں ہوا کرتی تھی۔ جسیا کہ کے کے ججوں کے بارے میں تی آتی ہے۔ چنانچہ اس کی دلیل یہ کہ بعض روایت میں (ثرب کے) مطلوب کوتوڑ دینے، اور مشکیزول کو طکرے کے طور کے کر دینے کا حکم دیا گیا ہے۔
Imam Muhammad narrated on the authority of Ja'far, who reported the statement of 'Ata bin Abi Rabah regarding a person found with tharib in his inheritance, that he said: If water is poured into it and it turns into vinegar, what is your opinion? He said: If it turns into vinegar, there is no harm or sin in it; if he wishes, he can sell it. (Kitab al-Hujjat)
And Imam Tahawi (may Allah have mercy on him) said: The hadiths prohibiting the production of vinegar are based on severity and strictness, which were prevalent in the early days of Islam, as is mentioned in the case of certain companions. Thus, in some narrations, there is a command to break the desired tharib and to treat the one who produces it with harshness.
سیدنا واکل حضرتی رضی اللہ تعالیٰ عنہ سے روایت ہے کہ طارق بن سوید نے نبی اکرم صلی اللہ علیہ وسلم سے شراب کے متعلق دریافت کیا، تو آپ صلی اللہ علیہ وسلم نے انہیں منع فرمایے پھر انہوں نے عرض کیا "میں اس کو صرف دواء کے لیے بناتا ہوں"، تو آپ صلی اللہ علیہ نے فرمایا کہ وہ دواء نہیں ہے بلکہ پیاری ہے۔ (مسلم)
Wa’il al-Hadrami narrated that Tariq ibn Suwayd asked the Prophet (ﷺ) about wine, and he forbade it. He said: I only make it for medicine. He said: It is not a medicine but a disease. [Narrated by Muslim.]
9 قو لہ : انہ لیس بدواء و لكنه داء (وہ دواء نہیں بلکہ پیاری ہے)
فتاوی عالمگیری میں ہے شراب سے کسی زخم کا علاج کرنا ایکسی جانور کے دبر کا علاج کرنا جائز نہیں ہے۔ اور اس طرح زمی کو شراب پلانا یا کسی یہ کو علاج کے لیے شراب پلانا جائز نہیں۔ اور اس کا ابال پلانے والے پر ہوگا۔
